Buyers changing how we do business Recently, I thought about a new car. I began searching the major car sites online. Instead of finding information, I discovered home pages that were commercials. I wanted information, yet, these sites and the emails that followed wanted to sell me a car in a nanosecond. The sales agents chose to sell rather than inform and build trust. I went to their sites for information, not to be sold. Fortunately, one of my Twitter friends was the social-media voice for Ford. I was able to communicate with someone I trusted, rather than to a faceless corporate site. With suggestions from Facebook friends, I discovered Edmunds.com. I researched prices, buying advice, dealer inventory, and incentives and connected to other buyers by engaging in car forums. Finally, I had information! Along the way, I became a DIY (do it yourself) car buyer. My own experience pushed me to think differently about the experience real-estate buyers were having online when they
begin to search for homes. Do real-estate sites look like the auto company sites? Did their look and feel online mimic advertising offline? If buyers begin their journey for a new home with a Google search, they are more than likely looking for information and not ads. They want more specific details about a home, a subdivision or a community. The mobile apps and the web are turning more customers into DIY buyers. They are seeking authentic content and a way to interact in a conversation with a human. If they are not planning to buy a home in the next 72 hours or even 72 days, they do want more than pretty pictures or endless email alerts. They are searching for information first and frustration last. Yet the many traditional brokerage and agent websites are built to market homes for sale without any interactive communication built into the site other than a “contact” or “registration” form. Buyers can stay on the site and search until they
are asked to register. If they prefer to search without providing an email or phone, they will move on to one of the top three real-estate sites, such as realtor.com, Trulia or Zillow. There they can search for homes, find buying and selling advice, ask questions, read reviews, and learn more about the homebuying process. If they are more fluent in social media, they will turn to their friends and followers on Facebook, Twitter, Linkedin and Google+ to find out what their friends think about the community, a particular home or an agent. Your proactive customers will search by using hashtags (#word). By googling #SantaFe they can learn what people are saying about Santa Fe in real time. Think about your buying habits. Do you begin with a search on Google? Do you contact your friends on social media and ask them for referrals or opinions? If you are in business and your buying habits have changed, then you may need to

connect differently with your customers. The social media are not about marketing; they’re about engaging with your customers to help them make more informed buying choices. What to do, what to do? We all know that the Federal Reserve Board has pushed billions of dollars into the bond markets over the last few years to keep rates down and stimulate the economy. The Fed has always said that this measure, known as “quantitative easing” (QE), was temporary and that as soon as the economy recovered sufficiently the infusion of funds would end. The year 2015 has been proposed as the target for the end of QE. Stronger hints came July 30 when the Fed announced, “In light of the cumulative progress toward maximum employment and the improvement in the outlook for labor market conditions” there would be a further $5 billion a month reduction in purchases of mortgage-backed securities (MBS). This brings the monthly MBS purchase rate to $10 billion. At the same time, the Fed reduced Treasury purchases by $5 billion a month. I fully expect to see a tug-of-war at the Fed over the economy in the months ahead: Is it stronger? Weaker? Status quo? One key player, influential Fed vice chair Stanley Fischer, spoke out in mid-Au24

gust, stating that both the U.S. and global economic recoveries have been “disappointing” and may point to a permanent downshift in economic potential. As reported by Howard Schneider of Reuters, Fischer commented on the years since the 2007-2009 financial crisis and recession. In his remarks he stated that a slowing of U.S. productivity, declining labor force participation and other factors may have scarred the United States’ ability to generate economic growth. However, he also stated that some of that may represent temporary factors that will change if, for example, the U.S. housing market improves. The most recent recent update came from Federal Reserve Bank of St. Louis president James Bullard, interviewed Aug. 22 by CNBC at the Fed’s annual research conference in Jackson Hole, Wyo. Commenting on the Fed’s plans to increase short-term interest rates, Bullard said, “I’m sticking right now with the end of the first quarter [of 2015] on liftoff.” Because the Fed has clearly indicated that QE will end in 2015, I believe that
this could be the last year to really — I mean really — take advantage of the super low rates still available. It’s interesting that despite the historic low rates of the past three years, only 19 percent of current homeowners either purchased or refinanced between 2011 and 2013. That means there’s still time to reap your potential reward and lock in these rates. Rates may be good, but what about real estate values? Altos Research is “bullish” on the market and put it this way in a recent blog: “The real-time data paints a much more robust environment than the headlines would indicate. Demand remains high, transactions happen very quickly. Home prices are up another 9% year over year as of July, 2014. We’ve had a strong run and the American consumer is anxious to again buy real estate.” And how are people doing their house-hunting? Online and with a Realtor! The National Association of Realtors’ 2013 Profile of Homebuyers and Sellers indicated that 42 percent of buyers look for properties online and 88 percent purchased using a real-estate agent or broker.

One final thought. Real estate is still outperforming the Dow, S&P, and NASDAQ. From January 2000 through July 2014, the Dow was up 51.3 percent, the S&P up 38 percent and the NASDAQ up 10.5 percent. If you would like to meet some of them, sign up for the Animals and Architecture fundraiser happening in Santa Fe from 6 to 9 p.m. on Saturday, Sept. 13. A visit to the chimp sanctuary is one of the items in the silent auction scheduled during this event benefiting Animal Protection of New Mexico. The auction also might afford you the opportunity to tour, dine, and stay at Ted Turner’s Armendaris Ranch in Sierra County. “There are millions of bats that live in a volcano tube and at dusk they all fly out. It’s amazing,” said Anne Coller, Animal Protection of New Mexico (APNM). “It’s like a National Geographic show, because there are also peregrine falcons and Swainson’s hawks who hunt them.” Animals and Architecture is the first of what Lisa Barker of Barker Realty/Christie’s plans to be an annual event. “We’ll have a different venue each year so people get to see a house they wouldn’t otherwise be able to see, and support Animal Protection of New Mexico. We want to get the APNM name out there, because so many people don’t know what it is.” Coller said the organization has been working on advocacy for animals over 30 years, but added, “Part of the problem is that we’re not a shelter, so there’s no brickand-mortar building, except for our headquarters office in Albuquerque. “We have our own animal cruelty hotline. If you live next door to someone who’s abusing an animal or who leaves a dog out in the winter with no shelter, you can call 877-5-HUMANE. “We have a humane education program, The Animal Connection, where we have teachers who go into 5th-grade classrooms. We have a curriculum that fits state standards. It’s a six-week program that includes English and mathematics and presentation skills. Each kid has to pick an animal and do the research, calling a vet and finding out how much it costs to vaccinate a dog, for example, how much food the dog eats, and then figure out how to care for the animal properly. The students have to write an essay and do an oral report.” APNM has a staff member who helps shelters find funding and set standards for shelters, and the group works with local organizations such as The Horse Shelter. “There is a problem with horse overpopulation, but we believe we can do better for our horses by having a gelding program, having an end-of-trail humane euthanasia program, and helping people keep their horses,” Coller said. “If you lose your job, horse feed and veterinary care are expensive and you can apply to APNM for three months’ help.” Among the organization’s other initiatives right now are Chimpanzees to Sanctuary, which supports the retirement

A captivating hacienda in Placitas

nown as the Hacienda de Placitas, this is a sprawling collection of buildings boasting a combination of old-fashioned comfort and contemporary facilities. Complimenting the main house (4,054 square feet) and five casitas (5,655 s.f.) is a splendid outdoor environment that includes a kidney-shaped swimming pool and a vast patio, all set against an arc of piñon/ juniper-studded foothills. This is a storied property. Near the entrance to the main house is the oldest building on the property, a 19th-century adobe that is now one of the casitas; it’s framed by rampant broom and ocotillo plants, a crabapple tree, and a huge wisteria. Another casita was remodeled from an old well house. A third was once a shearing barn. A windmill that looms over the pool area once provided water to a nearby coal mine and railroad. This all might look familiar to fans of the Emmy-winning drama Breaking Bad. That’s because the episode in which Don Eladio and other cartel members are killed by means of poisoned tequila was filmed around this very pool. Stephen and Laura Bass, owners of the hacienda for the last seven years, have engaged themselves in some substantial improvements here and there. One example is the master suite expansion. “We took down a couple of walls here,” Laura said, standing in one section of the suite. “This was a casita and it was incorporated into the master.” The curved space includes a den with a carved-wood fireplace dating to the mid-1800s, and unique doors and shutters. The bed faces a long row of windows out to the hills. “It’s like a living

painting, watching the skies change and the light on the hills change,” she said. The master bathroom previously had a low ceiling; now it’s higher and the room is bright and happily elegant with travertine floor and surrounds. Another one of those rather magnificent neo-Gothic fireplaces anchors the living room, also boasting Saltillo-tile floors and a ceiling of huge beams supporting vigas and coved plaster. The ceiling in the gourmet-remodeled kitchen is tamarisk shoots on beams. The floor is wood-plank. “We designed a lot of this ourselves,” Laura Bass said. “This kitchen was small and dark.” It’s now modern, equipped with new cabinets, a Sub Zero refrigerator, and a Dacor electric range in the large island. Adjacent is an old commercial kitchen having a double Wolf gas oven/range with eight burners and a griddle. Beyond this is a room ideal for staging catering. The patio around the pool is paved with flagstone close in and wood decking beyond. There’s lots of great seating, including at a corner grilling post with a wraparound, tiletopped bar under a latilla portál. Nearby — as if the place doesn’t have enough character — there’s an old cabin that was transported from the Pecos wilderness. This “Cowboy’s Place” has chinked-log walls, three Dutch doors, wood floors, and a big rock fireplace. From Hacienda de Placitas, 491 N.M. 165, it’s 35 minutes to Santa Fe and 25 minutes to Albuquerque. A helical pier is comprised of a solid steel shaft with one or more helices attached. A helix is one pitch of screw; imagine a wood screw that instead of having a continuous thread, has only one full turn. The advantage of having individual helices is that, unlike an auger, the soil is not displaced. We screw the piers into the earth beneath a house using hydraulic equipment that can fit in very small spaces. Once in place, a bracket slides over the pier shaft and bolts to the footing. We can then use hydraulic jacks to transfer the load from the bad soils to the shaft of the pier. A pier every 8 feet or so along a concrete footing will support even the heaviest wall. Because piers are installed below grade, the appearance of your home is not altered.

Get active. Think passive. One of the founders of the permaculture movement, Bill Mollison, sets a high bar for property owners. “Every drop of water that leaves our system is a failure in our system,” he once told me. It is difficult to live up to this standard with active water-harvesting alone. Tanks will inevitably fill up, and most precipitation in many sites will not make it into a given cistern. Passive water harvesting is the act of storing precipitation, roof runoff, or stormwater directly in the soil. In addition to roofs, precipitation from roads, parking lots, sidewalks, pathways, patios, and earthen slopes — be they steep or gentle, vegetated or denuded — are all fair game for wise landowners in the desert. In this age of inexpensive apps, strong plastics, and easily overnighted technology, passive water harvesting would seem almost anachronistic if it were not for its relatively low cost and high yield. Here is a mini-glossary of passive water-harvesting strategies to apply before our next monsoon season arrives:
Check dam – an installation used in gullies, ditches, and arroyos that slows the flow of stormwater, holds back sediment, and retains moisture. Often made of rocks ranging in size from 6” to 18” in diameter, check dams are typically placed in the narrowest sections of ephemeral waterways. Curb cut – an opening or diversion point from a roadway that diverts runoff to an on-contour swale. Mulch – any material placed on bare earth for one or more of the following purposes in addition to retaining moisture: creating shade, insulating the soil from extreme temperatures, and preventing erosion from wind, forceful forms of precipitation, and stormwater. Thick mulches can prevent some weeds. All mulches create habitat for beneficial microbes. On-contour swale (a.k.a. “rain garden,” “ponding”) – a ditch with the dirt from the ditch placed on the downhill side in the form of a berm. The primary purpose
of this type of swale is to allow stormwater to soak into the swale. The ditch and berm are typically level except where overflow spillways are located. Swales function best when they are long, skinny, and shallow rather than wide and deep. One-rock dam – a check dam or gabion-like structure that is only one rock high. Built by hand with 4” to 8” rocks placed in a tessellating pattern, these dams can be of any width. In some cases, they resemble a rock-mulched area rather than a typical dam. Seeds sown under these dams germinate and mature due to the moisture retained under the rocks. Wattle (a.k.a. “fascine”) – a large sausage-like product that can be purchased or locally fabricated. Often filled with straw, jute, coconut or other fibers, wattles can serve the same function as check dams, gabions, and weirs, or they can be tacked along contours in order to function like on-contour swales. Wick – an installation that stores runoff at the root zones of plant material. Typ-

Artist riffs (respectfully) on church forms By Paul Weideman The parishioners of Santa Clara Pueblo Church never saw it like this. Roberto Cardinale adorned his wooden model of the building using a rather wild palette. “I use latex house paint and they mix in funny ways,” the artist said. “First I stain, then I rub paraffin, then I open four gallons, four colors, and I don’t wash my brush going from one to the other. You get these layers. “When I finish painting and scraping, I rub it with graphite using my fingers, so I end up carressing every part of it.” Since the mid-1980s, Cardinale, who is also a longtime Realtor with Sotheby’s International Real Estate, has created replicas of about 500 American and European buildings, most of them churches. Look at his portfolio and it’s easy to see he loves the old churches of New Mexico. Some of the newest in his one-of-a-kind sculpture series are fragments, such as the one of the ancient church at Pecos. “We don’t know exactly what Pecos Pueblo looked like, so I thought I would do bits and pieces,” he said. He uses pine from Spotted Owl Timber to build his churches. Some have tiny doors on pintle hinges fashioned from hardwood toothpicks. “I tend to interpret. The scale is not accurate,” he said, pointing to a model of San Esteban del Rey at Acoma. “One of the problems I have is compressing features and still keeping a sense of what the structure is like.” Cardinale’s fascination with church architecture began when he was a young Benedictine monk at Holy Cross Abbey in Cañon City, Colorado. At that time, he earned bachelor’s degrees in mathematics and philosophy at St. Benedict’s College in Atchison, Kansas. He went on to get his master’s in art at the University of Northern Colora-

do and a Ph.D. in art education from Arizona State University. He was an art professor at Ohio State University and the University of Arizona. He served as director of the program in artisanry at Boston University and then was president of the San Antonio Art Institute. Whenever he traveled here and abroad, he would seek out churches. But the churches on the pueblos, in which he sees both faith and the strength of community, have always pulled him strongest. Worth Gallery in Taos first showed his artistic models, and the commissions increased. He exhibited at Patina Gallery for 10 years, then joined Jane Sauer Gallery, which is now Tansey Contemporary. The last exhibition there was in July. The Persistence of Religion also featured works by Teri Greeves and Patrick McGrath Muñiz. These days, Cardinale generally works every day selling real estate, and often every night on the churches. One of his variations that has become characteristic is the addition of a drawer, loosely filled with interesting objects, in the base of the church. He talked about the inspiration for these. “In old Catholic homes, they’d have these cabinets on the wall, sacramental cabinets that held holy oils and other items, so when the priest came, everything was there. When I was a kid growing up in Pueblo, Colorado, I’d go to my grandma’s house and look at those little drawers and see the vials and scapulars and holy medals. Now my wife, P.J., who is a collage artist, collects all kinds of things and she does these drawers.” What’s next? Cardinale is working on commissions for two Italian towers, for a replica of the 1879 Yosemite Valley Chapel, and for a large version of the Cathedral Basilica of St. Francis of Asissi. HOME

Yardman takes top award in Parade of Homes “We knocked it out of the park,” Kim Shanahan said of the 2014 Haciendas - A Parade of Homes. “We’re just thrilled. We’re probably 30 percent over what our budget was in ticket sales, and some of the builders report leads and are scheduling meetings to go look at lots.” Shanahan is executive director of the Santa Fe Area Home Builders Association, which sponsors the annual home tour. Tourgoers on two weekends in August were wowed by the glass-enclosed wine/tasting room in the middle of the new house at 47 Sundance Ridge Circle. Built by Frank Yardman Construction, that entry won the Grand Hacienda Award. “Typically a house like this takes two years,” said Frank Yardman. “It’s a big house, very detailed, and we’re on top of a ridge, so we had to cut and compact all the soil. All of that wetting and compacting and bulldozing and soil-testing took at least a month, and it was in November and December.” But the house — 4,530 heated square feet — was finished in one year. Architect Craig Hoopes said getting it ready

for this year’s Parade of Homes was the prime motivator for that ambitious schedule. The owners previously bought a Yardman spec house from the 2004 Parade. “They were in it for just six weeks and got transferred and had to sell it,” the builder recalled. “They’re now back here in retirement. They looked at everything on the market. I saved this lot until last intentionally; being a Realtor for 22 years, I know how to build the anticipation. They trusted me and let me create my own team. His dream team was Hoopes + Associates Architects, Serquis+Associates Landscape Architecture, and Annie O’Carroll Interior Design. “The testament to our success,” Yardman said, “is that we’re all still friends.” A few other standout features of this grandly elegant home are the stone-veneer wall holding the television and slot fireplace, the beautiful kitchen cabinets and glass-tile backsplash, and the butterfly roof that creates a living-room ceiling sloping up dramatically toward the skies and mountain vistas. Hoopes said the owners previously were going to retire to Walla Walla, Washington, and they had
designed a house with a shed roof. “Here in this community [Sundance Ridge Estates], shed roofs can’t be visible, so the idea was to use a sloping roof but to surround it with something more traditional.” “Not only that,” Yardman added, “but we have 10-foot glass walls, Sierra Pacific windows with pocket doors, so there are huge expanses of glass and clerestories on top of that, so you’re just taking in the views from this amazing piece of property.” Framing views was also important in the Haciendas entry by Green Star Builders at 102 Starview. From the master bedroom, you look through 12-foot doors, through a central courtyard with beautiful steel planters and steel infinity-edge fountain, and through the living room and more glass to the distant hills and sky. The house took five prizes, including Best Design and the Grand Green Award. Like Green Star’s 2012 Grand Hacienda winner on Cordova Road, it boasts lots of steel; here it shows up in sleek, heavy doors that swing or roll to transform spaces. “This is 1,852 square feet and we wanted it to function as a larger house, so we have a lot of spaces that
are adaptable,” said the company’s principal, Jesse Gries. “Here’s an office but if you need it to be private office or a third bedroom, two steel doors, 680 pounds each, roll along and change the space. It’s adaptable and it’s very playful.” The kitchen backsplash, door surrounds, garden planters, and threshholds are all made of 1/4-inch steel plate. Gries said he’s trying to build as green as possible, and part of that is using a pretty indestructible material. The stairs at the entry and between the house and garage also look like metal, but they’re Corten metallic-finish tile. Overall, this house, designed by Stephen Beili, Studio Dionisi Inc., is bright and modern, and very green. “There’s no gas in here,” Gries said during a walkthrough of the kitchen on the last day of the tour. “It’s all electric and induction, fueled by 4.1 kilowatts of solar on the roof.” The walls are made of Faswall blocks, which are 85 percent recycled wood pallets and 15 percent cement. The highly efficient Pyramid Triangle Tube boiler also contributes to the house’s GreenBuild New Mexico “Emerald” certification. That allowed us to get over two feet of fiberglass insulation up there, plus you’re able to get a positive slope for drainage.” “What’s important today is thinking small, thinking sustainable,” said Wollens’ architect, Michael Bauer. “I’m proudest of the directness and simplicity of that floor plan. I’m interested in doing a regionally informed architecture that’s not imitative of the traditions but it’s respectful and it’s contemporary. “I wanted some solar gain and views and that was the challenge because the houses are all cheek by jowl,” Bauer said. “But you sit in the living room with the large corner glazing or in the large exterior spaces and you don’t even sense the other houses. And I was shocked at how much larger than 1,800 square feet the house feels.” Transformation was key in Woods Design Builders’ entry at 544 Canyon Road, which took awards for Best Craftsmanship and Best Kitchen and was named for a special award for Outstanding Historic Remodel. The property has a 4,313-squarefoot main house built in 1938 and a guest house dating to the 1980s. Because the house is in Santa Fe’s central

historic district, Woods was guided by the need and desire to preserve the historic integrity of the exterior. Work there was limited to refurbishing windows and portáles. The interior could be brought right up to date, and it was. The kitchen is a good example. “This is a primary facade on a [historically] contributing building so we couldn’t do larger windows or raise the roof. How to get the kitchen bright? We did it by adding five
skylights and we have whitewashed whiteoak floors,” Woods said. The kitchen also boasts Cambria black-satin granite tops around the outside and marble-look Taj Mahal granite on the island. There’s also a thoughtful built-in pet feeding station. It’s all very modern and bright, and the brightness factor bops up a further few notches when you go upstairs. “All the exterior walls are pentile, which

Darlings, Indian Market and the Indigenous Fine Art Market are over (both groups survived), the Fine Arts and Crafts show and the Fiesta Crafts show are wrapping up today, and Zozobra has burned. You may be asking yourself, Is there nothing left to look forward to now that summer is drawing to a close and Old Man Gloom has been warded off once again? Never fear, you’re in Santa Fe, my dear. Later this month we have the 24th annual Wine and Chile Fiesta. Just when you think there might never be another market and/or fiesta, another one pops up. Which keeps people coming back. Not only coming back, Buttercups, but returning after leaving permanently (or so they think). Example: after growing up here, John Kelly (First American Title) and his wife, Ann, thirsted for a change of scenery, so they moved to the Seattle-Tacoma area in Washington. Almost 20 years and two young children, ages 7 and 10, later, they found themselves thirsting for dry weather and Christmas. (I’m talking about chile, Gumdrops.) So they figured it was time to head for the barn. Today John is assistant to Jana Lujan (branch manager and senior escrow officer at First American). When I see him sitting at his desk, I can still see that fresh-out-of-high-school young boy who started out as a runner for First American when it was then Territorial Abstract, and Jana worked as assistant to Mark McFerrin (the manager then). What’s it all about, Alfie? I think, dearest readers, it means that I’ve been around too long. But the upside is that I get to see young people like John mature into sane and productive adults, which gives me hope that this ole’ world will keep on turning. Welcome home, John. Another example of coming back to the Land of Enchantment is Spencer Ralston (associate broker, Barker Realty). His for-
mer career as a hospital administrator led him in 1990 to Albuquerque where he was COO at the VA Hospital. It was then that he first experienced the turquoise blue sky, the piñon-scented air, and the taste of Christmas — the chile again. When he decided to retire from VA hospitals (last stop was Tucson), he and his wife knew they were coming back, this time to Santa Fe, and Spence chose his next career, real estate. That was seven years ago. When I ran into him at the Santacafé recently, I thought he and his lunch partner Francis Phillips (First Choice Loan Services, Inc.) were practicing the French pronunciation of wines (preparing for the Wine and Chile Fiesta). Mais non, mes amis, they were enjoying an hour of conversational French. (Francis even loses his genteel Southern accent when speaking the language of love.) Bébés, I quickly said au revoir and left before I ran out of French words and had to start repeating myself. For Fred Raznick (Santa Fe Properties) there is no coming back because he’s never left since he and his family moved here and built their home in Eldorado 36 years ago. He’s such a believer in putting down roots and getting involved in a community that he and his wife Barbara still live in the same Bill Lumpkins-designed house, which now includes at least two additions. Because he has contributed so much of his time and expertise over the last 36 years to the community of Eldorado, he was named this year’s Eldorado Resident of the Year. An attorney by profession when he first moved here (Poochie-poohs, as Realtors we don’t hold that against him), he was soon captivated by the early solar development going on in Eldorado, so he segued into a real-estate career and initially worked with Rational Alternatives, the cutting-edge design/build company that put passive-solar design and Eldorado on the map. Fred is an asset to
Eldorado’s community and to the Santa Fe real-estate community, the community of Temple Beth Shalom, and, let’s face it, Pumpkins, he’s an asset wherever he goes, because Fred simply believes in the Power of Community. (It’s not a cult, Lollipops, it’s merely a philosophy.) Mortgage companies come and go, and Home Mortgage came and went when owner Doug Rand decided to retire. (Doug’s legacy will live on, however, as will his full-length fur coat. Was it beaver... or mink... I can’t remember now). Since Jim Gay and Tammy Branch (both formerly with Home Mortgage) didn’t want to retire and also didn’t want to move, they formed a new corporation, now called The Mortgage Place. Never fear, loyal clients, the name has changed, but the location (1640 Old Pecos Trail, suite E) and the service remain the same. What happened to the detail guy, Ron Blessey (formerly with Home Mortgage and Jim’s sidekick in the biz) you’re wondering. He missed the Plaza, so he moved downtown and is now a private mortgage banker with Wells Fargo on Washington Ave. Butter Beans, you might think that breaking up is hard to do, but Ron likes a change of scenery now and then, in his business life as well as his personal life. As a matter of fact, on the personal side, I think it’s about time that Ron should be “back on the market.” If I’m wrong, please call me. (Darlings, you know how I hate giving out false information.) Inside out and outside in Harvested rainwater is used predominantly for irrigation and occasionally, with treatment, for drinking water. There are other uses, too, but most of the time, this pure and precious resource is allowed to just run down the street. We need to rethink how we use this limited resource by exploring ways to use and reuse outside water inside the house and inside water outside the house. The typical home spends about 50 percent of its pure, costly drinking water on toilet flushing and clothes washing, yet these purposes do not require pure water. Additionally, we all create nutrient-rich greywater that would be heavenly to most of our plants and yet we send this water to our local treatment plant to be treated and released to run out of our watershed. Based on City of Santa Fe data, this “waste” water accounts for approximately 35 percent of the water used in a normal household. Rainwater is not so constant and in our
arid climate must be stored to ensure a ready supply. Rainwater is relatively pure, with the exception of bacteria, and is also good for plants. With treatment, greywater and rainwater could be used inside for our toilets or clothes washing or with less treatment for our landscape. Our current water-use paradigm needs to change as we look toward a future with increasing water costs and less frequent but more intense storms. Updating our plumbing codes — as other cities have already done — to allow inexpensive and easy permitting of greywater use for subsurface irrigation would be a great place to begin. A longer-term step would be to require new homes to build in stubouts for greywater similar to Tucson’s ordinance. This makes it easier and less expensive for homeowners to use this precious resource while saving taxpayer dollars by reducing water-treatment costs. To really push this effort along, we could offer rebates and incentives to homeown-
ers who want to do a retrofit to an existing home. The harvesting of rainwater reduces stormwater runoff, helps recharge local aquifers, and saves a local resource for a local beneficial use. There is currently a permitting process in the city and county for these systems, with rebates available in the city. However, these processes are targeted for irrigational use of rainwater and need to be updated to make it easy to use rainwater inside the building for non-potable use (i.e., toilet flushing and clothes washing). This process, referred to in the plumbing world as bringing purple pipe inside the building, is permitted by national plumbing code but not our local or state codes. A simple update to our plumbing and building codes would go a long way toward helping us use greywater and rainwater in a very different and beneficial matter. Get involved. Push our local and

state officials to modernize and incentivize conservation of our limited, local water supply. What in the world are overlays? For years, mortgage brokers and Realtors have thought that satisfying the Fannie Mae and Freddie Mac underwriting guidelines would secure the loan approval. But actually this step is merely one part of the approval process. Lenders have a trick up their sleeves which is little known by the public and even those in the mortgage business. It is called the “overlay.” What is this and why do we need to understand it? When speaking to an underwriter about a particular file or loan scenario I always ask the question, “Do your overlays modify or abridge the Fannie Mae guidelines on this file?” An overlay is a modification of the Fannie Mae underwriting guidelines. As an example, for a 2014 home purchase, Fannie Mae says
that a self-employed person need not file his federal tax return for 2013 until the Oct. 15 extension date has been reached. Fannie will normally accept the income calculation from the 2012 and 2011 tax returns. But be aware: some underwriters may demand that your 2013 tax return be filed before they will grant the approval. They may state that caution requires them to abridge the standard Fannie Mae requirements. I have also seen underwriters representing ultra-conservative lenders not willing to use a current salary for a borrower who owns 100 percent of the company. Instead of calculating the approval with current salary, they will use the prior year’s W-2 income. Again this is not the strict Fannie Mae method of calculating income. Go
figure. So what does the overlay tell us about the mortgage world? Well, it says that your mortgage company and loan officer better speak directly to the underwriter and have the experience to ask the most defining questions. It appears that commercial banks, in their mortgage departments, can be the most demanding with overlays. Thank goodness that there are mortgage companies that have multiple investors enabling them to steer away from these changes. Also, be aware that overlays are constantly changing. Lenders can change their underwriting standards (usually adding stricter requirements) at any moment. Look around and shop for an experienced mortgage source that will

Endorsements to your title insurance Did you know there are additional coverages that are available on the owner’s title insurance policy? Did you know you can ask for specific coverages? A better question is, do you know about the different title insurance products that are available when you purchase residential real estate? It is cafeteria-style if you know what you need. Some endorsements are automatically attached and there may be premiums for some of the endorsements, and some may not have a premium. According to state code, “Each insurer [underwriter] shall establish written instructions and underwriting standards concerning the use of the other promulgated endorsement forms to insure the specific estate or lien or provide mechanics’ [supplied labor or materials] and materialmen’s [supplies materials to the building site] lien coverages or to reflect the current status of improvements, advances, assignments or coverages as specifically provided by these regulations and the promulgated forms.” The insurer must approve many of the additional coverages. 58

Although there is an “insuring around endorsement,” it is not permissible to insure around any lien or adverse matter by intentionally omitting it from a commitment or policy. In new construction you may want to consider an endorsement that may be issued with no exception to possible unfiled mechanics’ or materialmen’s liens. There are additional premiums involved. You can request survey coverage in your owner’s title-insurance policy with a survey and the payment of an additional premium. Some of the additional coverages that are available: • A manufactured-housing endorsement may be issued for an additional premium. • A condominium endorsement may be issued at the same time as an owner’s title insurance policy for an additional premium. Paragraph 3 of the endorsement may be deleted at the option of the insurer. • A planned-unit development (PUD) endorsement may be issued at the same time as the title insurance policy for an additional premium.
• A leasehold owner’s endorsement is attached to an owner’s title insurance policy at no additional premium. The endorsement insures the leasehold interest. • A named insured endorsement may be attached to an owner’s or leasehold owner’s title insurance policy. There is a premium charged if the policy was issued prior to Aug. 15, 2001. • A correction/multipurpose endorsement may be attached to your owner’s title insurance policy. If the correction is caused by you, there is a premium charged. Always ask why. Ask enough questions to get what is needed. In the closing arena there are so many unknowns. One is product awareness. Many times decisions are made based on cost. The additional cost may be dollars well spent. The biggest investment one will make is the purchase of a home. An owner’s title insurance policy protects the owner if a past title or ownership issue comes up after the purchase. Seek the advice of a real-estate attorney. Only New Mexico-licensed title insurance companies, affiliates, agents, and

direct operations can sell title insurance. Ask to see a license. The Office of Superintendent, Title Bureau, can help: www. osi.state.nm.us.
