Chairman’s Report The importance of the Self Storage Association membership.

ven as I write this, membership of the Self Storage Association of Australasia is growing and I would like to inform our members of the importance of you, our existing members, in encouraging non-members to join the SSAA and become part of our growing organisation.
In a nut shell, it is better that as many self storage businesses as possible are all part of the same association, abiding by the same rules and the Association’s Code of Ethics. We have strength in numbers. With the increasing presence of aggregators trying to disrupt our business, it becomes more important for the smaller operators to be part of a larger group. This will also help to minimise the cowboy operators that currently sit outside the Association, and the impact and damage they can do to our industry and members. It is important that the industry is held in high regard by the community and especially by the other stakeholders in our industry. By being inclusive, as opposed to exclusive, it is important that the members along with the Executive and the combined strength, strive for excellence. Further to this there are the networking opportunities and cross information offered by other members that could well result in making a better investment in say, your facility presentation or customer service, which would then result in an increased occupancy and yield and an improved bottom line.

The Association is stronger and better able to represent members and members interests, the larger it is. It needs to be the body to go to for information and the body to lobby for or against legislation that effects members and members interests. With the limited resources available to the Executive and office to locate, and talk to and meet those owners that are not members, we need to establish other ways and means of growing the membership. Currently our numbers sit at 850 owners and 1500 facilities, I know that there are 1500 pair of eyes, ears and mouths, out there to assist in this drive. All it takes is for each facility to set the goal and get one new member this year. Just one. This would double our membership. How hard is that? Are you committed to doing this for your industry? The bigger it is, the better the services the Association is able to provide. Think about what it could do for you with double the membership. What additional services would you like to be provided? Education? Financial? Web site development? A Bigger say in legislation?

illegal activity, you can refund the full amount less expenses incurred by you in enforcing the agreement (were there any costs associated with the execution of the warrant?) Clause 23 covers termination, including the right to retain or charge apportioned fees where less than requisite notice was provided by the Storer. As for HOW it will be paid, this is up to you. You are entitled to pay into a bank account and you DO NOT have to pay cash.

ealing with raids, rifles, rats and rare art!!! Nearly 12 months ago I joined the SSAA and although I had years of experience working in law, including overseas in Canada, I wasn’t exactly sure what to expect. So now when people ask me, as the inhouse paralegal at the SSAA, what type of issues I deal with, in one sentence I answer from Australia to New Zealand anything from – Raids to rifles and rats to rare art!!! The above topics are from questions that have come through the Legal Help Desk in the last year!!! So, what were some of those questions?
RAIDS:
QUESTION: We had a warrant executed at our facility during the week. 6 units were opened, 5 of which contained illegal tobacco products. One of the units listed on the warrant was not padlocked and contained nothing more than some tobacco residue on the floor. This customer (name and unit number listed on search warrant) has called our office the day after the raid and has requested a cash refund for un-used storage fees, as the unit is empty.
ANSWER: Yes, you are entitled to pay the refund anyway that works for you. There is a term in the agreement aimed at this NOTE: Storer still needs to give notice to terminate hence you can refund money less notice period. It doesn’t matter if there is anything in the space or not. If you terminated without notice due to

Information has been made available to me that customers who have recently taken a storage unit with us are meth dealers. For the last week, we have also had a chemical smell on site that we cannot locate (which may be a complete coincidence). I have been issued with a section 11 information request by the Ministry of Social Development regarding the 2 customers (main contact and ACP) as they are currently being investigated for benefit fraud. I have served them with the standard 30-day notice (as the initial period had elapsed) not giving any other reason than we reserve the right to terminate the agreement, but ideally, I would like them to vacate immediately. I’ve spoken to the police; the customers are known to the police, and the police will apply for a search warrant if needed but also for expediency, they would be happy to inspect the unit today/tomorrow on my authority. Do I have sufficient grounds under clause 19 and clause 5c to access their unit/ authorise the police to view the contents of their unit? The police have specified that they would only be able to inspect what’s on view and not ‘search’ the Unit, for that they would require a court warrant.

Self Storage Year in review cont. ANSWER: The SSAA recommends you insist on a search warrant. This creates some distance between you and the action taken by the police. If you allow police to access without a warrant (even though you can allow this under the contract) the Storer may become vindictive toward you or the facility (it has happened in the past). A search warrant is best. If you describe the chemical smell it may assist in this process. We also don’t recommend you force access to the unit yourself. Meth labs, or indeed all drug labs, are often boobytrapped. Several members have had this experience. Leave access to the professionals under these circumstances.
RIFLES:
QUESTION: A storer wants to keep their gun collection at our facility?
ANSWER: The SSAA’s position is that if a storer wants to store guns, they will need to install a gun cabinet in their space, the storer will be the one who needs to ensure they comply with firearms legislation in their State and Territory and use an appropriate cabinet or safe. It is a condition of gun licences in each State and Territory that firearm owners have secure and appropriate storage for their guns. Indeed, an application for a licence cannot be made unless an applicant has such storage, and the storage address and type of cabinet used is included in the licence applications. In this instance the only issue for you is whether the storer is permitted to affix the safe or not. If the cabinet is a certain weight, they need not affix it, and hence they may simply ask if you mind them putting the safe or cabinet in their space. For your information you may wish to refer to the Victoria Police link: http://www.police. vic.gov.au/content.asp?Document_ ID=36210 that details the Storage and Safekeeping Requirements for Firearms or the equivalent police document for your state. NOTE: Important to continue to keep in
mind, that you don’t know what people are storing. When asked if a storer may store a gun cabinet, you should respond that you do not have control or have knowledge of what people store, but that you do not approve modification of the unit. If they can store within those parameters, that is up to the storer.
RATS:
QUESTION: A storer has put their antique couch in storage and a rat has been feasting on the couch and is demanding compensation?
ANSWER: First of all, your storage agreement states: Clause 10(k): must ensure their Goods are free of food scraps and are not damp when placed into storage. Rats and mice - if you can prove you engage in regular pest control and have the records to prove it then you should NOT be liable. Experience dictates that rodents usually came in with the storer or were attracted to furniture because it was not cleaned properly before being brought in, hence had food traces in the lounge that attracted the rodents. This is NOT your problem.
RARE ART: QUESTION:
Customer has passed away, he is of Aboriginal descent, the contents of his

unit is of significant historical value to Aboriginal Australia. The niece of the deceased has arrived with a power of attorney wanting to access the unit.
ANSWER: As you don’t have control of the space, you are not able to consent or deny access to the unit. You do however advise the niece that as her uncle is deceased the Power of Attorney is no longer valid and that it is of no consequence. The usual deceased estate procedure in the MAP will need to be followed. These along with many other questions have come across the Legal Help Desk from Australian and New Zealand members during the past 12 months. One of the keys to dealing with what you face in your facility is knowing what is worded in your Agreement. Have you read the terms of your storage agreements? Most issues can be dealt with by understanding the terms of your storage agreements and by referring to the Manual of Advice and Procedures (MAP) and of course when you can’t quite work it out, please feel free to contact your friendly paralegal at legalsupport@selfstorage.com.au The SSAA also has available to assist, Australian Legal Advisor, Simone Hill and New Zealand Legal Advisor, Mr Darryl King from Jackson Russell.

SSAA Members Storage King Truganina & Sentinel Australasia
S
entinel Australiasia outfitted the brand new purpose build store in Truganina which encompasses over 500 units with over 5,000 square meters of net lettable area. Storage King Truganina is located at 477 Doherty Road (cnr Jessica Way). Their grand opening was on the 26th of May 2018. The self-storage units will serve locals in the growing suburb, which grew 10
percent between 2010 and 2016. Many new residents are moving out of homes in more densely populated areas of Melbourne for more affordable housing options in Truganina. Home and business construction is booming in and around the area, but there were not a lot of self-storage options in town. So the development team and Storage King jumped at the
chance to bring the largest self-storage company to the bustling suburb to help new movers. Truganina is a suburb of Melbourne, Victoria, Australia, 22 km west of Melbourne’s Central Business District, located within the Cities of Melton and Wyndham local government areas. Truganina recorded a population of 20,687 at the 2016 census.

He said he had so many meetings in such a short time, it felt like speed dating!

Board Member Shaun Bain attended the ISS World Expo
I
n April, Board Member Shaun Bain headed over to Las Vegas for the Inside Self Storage World Expo. Held annually, this is one of the largest Self Storage conferences and expos in the world with over 3,600 people attending. Most are from the US, but there are attendees from all over the world. Shaun first attended this event four years ago when he was new to the selfstorage industry and decided to go again as he gained a significant amount of information and knowledge and was interested to see how it had evolved. This year he felt it was of benefit to new entrants and the small to medium operators, which in America is under 100 sites but in Australia that would be more like 10 sites or less. America is the largest market for selfstorage with approx. 8% of the population using the facilities whereas Australia it is 1.7%, so they have much knowledge to share. Although the two markets are different, the basics are the same, and the key points of value Shaun took away and

toreLocal has just opened Australia’s first Muslim Prayer Room within a storage centre at StoreLocal Campbellfield. They are working with the Australian Muslim Council to be a part of the local Muslim community. This is consistent with their focus on innovating and being a genuine part of the local community. as the unofficial world championship of endurance ocean paddling and a ‘bucket list’ event for any ocean paddler. Ivor’s participation was made possible by his industry sponsors, Storman, PTI and Regis Built. Ivor’s athletic prowess is well known. He won the Victoria Ocean Ski Championships in early April, has represented Australia in marathon kayaking and won many national championships. This year he was also one of the Baton Bearers at the Queens Baton Relay, preceding the Commonwealth Games in recognition of his sporting achievements, community involvement and volunteering work.

any SSAA and industry members know Ivor from Jim’s Self Storage in Victoria. Ivor has been an active Member of the Association since 1996 and on the Board for the last 12 months. Ivor has accepted the role of Deputy Chair as he is a firm believer and supporter of the SSAA and the benefits it provides to members. Starting in the industry in 1996 with his Father Jim Morgan, Jim’s Storage has grown from one site to taking over another four adjoining properties and another expansion underway. In his new role as Deputy Chair, Ivor will continue the excellent work of the Association by increasing membership, overseeing growth in the industry and creating a better vision of the industry than just a bunch of sheds!
Ivor believes that one bad experience within the storage industry can reflect upon everyone and by having the SSAA and its Members working together this provides a level of expectation and delivery of services which is second to none. Under Ivor’s management Jim’s Self Storage has won the SSAA’s Best Upgrade and Expansion award and Ivor has been a finalist for Manager of the year. He has been actively involved in the SSAA conferences as part of a panel of experts representing some of the smaller operators along with Sam Kennard and has also presented on Disaster management. Aside from his new role as Deputy Chair and running a storage business, Ivor recently returned from Hawaii where he competed in the Molokai Ocean Ski race. What is an
Aggregator? I
f you work in the Storage Industry you have may have heard about aggregators, you have probably dealt with them with sites like - Wotif? Uber Eats? Airbnb? Aggregators work in every aspect of our lives even if we aren’t always aware of it. They are web-based sites that combine the offering of a specific industry, with the primary objective to “aggregate” offerings from that industry in one place so customers can choose the best price. If applied to the storage industry, in theory, an aggregator’s web-based application aggregates updated information from numerous storage sites for viewing in one central location. An aggregator site provides customers with an ever-evolving picture of unit availability, prices of self-storage companies over a geographic territory. There’s a push worldwide against aggregators entering the self-storage arena as they are price driven. To a customer using this online to find a storage facility, what is the difference? They will go for the lowest price, but may not receive the service they need because they aren’t aware of the variances.

The challenge the Storage Industry has, is to educate customers in understanding what self-storage is, what the differences are between different facilities and what they offer and how do they distinguish costs versus the value for them and their goods? It is not like comparing a hotel room with a BnB, if customers don’t understand what the storage facility’s offer is, they won’t know how to differentiate between each other and listings on an aggregator site. For self-storage facilities associated with an aggregator site, this higher profile can be perceived as translating into more interest, leads, and rental agreements. Although that comes at a price, with fees, increased occupancy rates for lesser rates and sales numbers that show high yield for a quick return. Most people don’t travel more than 30 minutes to get to their storage facility, so aggregator’s need to provide localised results, not based on an entire suburb or district. If a customer uses an aggregator to search for a storage facility and finds none close enough to them, then they may conclude that there is no local selfstorage provider and look elsewhere which can lead to disappointment in the whole industry. To counteract this, the aggregator may forward a Facility enquiries from outside their catchment area, which are unlikely to be converted. This is a waste of internal resources, plus a waste of money as there is usually a lead fee to be paid back to the aggregator.

Small self-storage operators need to understand the role aggregator sites play. If you own a Storage
Facility and the Aggregator on sells the space for you, they take a percentage of the rental cost and a cost per lead. You might think that is fair given they are doing the work – but are they? What does this do to your bottom line? By marking-up pricing to cover the aggregator fee, you won’t be competitive. They can raise your profile beyond standard advertising and promotion, but they’ll take a slice out of your facility’s growth potential. Their business is to make money, so for short-term gain, yes you will make money, but longer term your fortunes may not last. If you sell your business, prospective buyers look at the bottom line at the revenue you bring in, which is minus the aggregator fees and therefore your facility may be instantly devalued. Think of an aggregator as a frenemy to your business, they’re not exactly your friend, but then they’re not an enemy either. There is value in having them on your side, yet it’s easy for them to control your online presence.
What can you do? Instead of letting self-storage aggregators devour a piece of your pie, take the money and put it towards your own online presence. Australia is a small market compared the USA and you and the Aggregators are competing for the same slice of the pie online, they are using the same search engine (SEO) terms as you, and they’re fighting to get to your customers first. That pie seems enticing, but once you find out what it will cost you, it won’t be so appealing. Overseas experience shows that if an aggregator gets established in an industry, then more aggregators join. Then operators end up on multiple aggregator’s sites, receiving referrals from the same customer from numerous sources. This is not an efficient or effective service for the customer – and diminishes the offering as you compete against yourself and the same market share.

anagement Software provider Storman have come a long way since Stephen Davies set up the company in New Zealand in 1992, but what hasn’t changed is the commitment to meeting the unique needs of the local self storage market. Stephen’s father owned two self storage facilities in New Zealand, but after GST changes were introduced, the duo struggled to make American-based software work for them – and so Storman was born. Expanding into Australia in 1997 and the UK in 2007, Storman has gone from strength to strength. As longterm members of the SSAA, thousands of facilities have chosen to partner with this home grown business over the past
25 years. The software was originally designed to make the management of storage spaces and the associated invoicing and reconciling easy. Since then, Storman now gives managers and owners the ability to manage every aspect of their business. n the future, Storman Cloud will look to integrate with other Big Data sets that provide further insights to help you make critical business decisions. A good example of this would be targeted marketing campaigns in your facility’s catchment area, where your facility data is combined with Payment Big Data to allow you to determine which areas will be best to target for increased sales.
Protecting your data by keeping it local
F
rom the beginning, Storman has prided itself on focussing on its own “backyard” in Australia and New Zealand. A key value is to ensure that the data it holds on behalf of their customers is kept local and secure, ensuring data sovereignty is paramount. In Storman, all data is held in Australia and New Zealand, while the data for Storman’s UK clients is held in the UK. So why is this so important? In the past, privacy concerns have focussed around the security of credit card and banking information, however there is now a
large shift aimed at making personal information more secure, as evidenced by recent updates to the Australian Privacy Act and the European Union’s General Data Protection Regulation (GDPR) both of which demand fundamental changes to how organisations handle personal information. Unfortunately, the legislation is much more fragmented and incoherent in the US, which is where some software providers keep their data. “As demonstrated recently by the Facebook data breach, companies sharing data is rife and legislation in Australia, New Zealand and the EU is coming into
force this year to protect consumers’ data rights, which is a great step forward. In America, the legislation has little on the horizon to change this,” explains Clarke.

We don’t need policies! We all get on like a house on fire… Well, have you seen how much damage a house fire can cause…..?
T
here are some businesses that are lucky enough to get away without a rule book. The staff have been together forever and have worked in quite a harmonious way. BUT, what if the business employs someone new, a great candidate, but someone with a new culture, a new manner….a different way of operating… then what? The truth is that a business needs some form of clear communication that ensures both the employer and employees are all on the same page when it comes to how you want the workplace to run. Like a rule book, so everyone knows how to play the game. Policies outline expected behaviour and performance and provide clear guidelines around what is and isn’t acceptable in your workplace. They ensure that all employees are on equal ground with how they conduct themselves whilst working, and how they relate to each other. Policies create boundaries, which, weirdly, can create security. Otherwise everyone is rudderless, and if several people work and act in their own way, no one is accountable, no one is in sync, and it could be, well, disastrous – yep, like a house on fire! The other aspect of policies is that they make it easy for everyone. Your employees
don’t have to guess what the expectations are if they are clearly laid out for them from day one. If you have fair and ethical policies that address behaviours including harassment, discrimination and bullying they can help to create a harmonious environment for people to enjoy working in. Policies reduce the risk of problems and conflict because there are clear guide lines that can be referred back to if a situation does arise. Some essential policies that any business needs are: • an Occupational Health and Safety policy, • Privacy/Confidentiality policy • Code of Conduct • Dress Code • Computer Use/IT/Social Media policy • Drug and alcohol policy • Performance Management • Bullying, Harassment and Discrimination But your policies don’t have to stop there, you can have policies on really any area that you feel is important to the running of your business. Some other ideas for policies are: • Volunteering | Community Service • Leave related
• Jury Duty • Grievances Here are some guiding principles for developing and maintaining effective workplace policies:
1. Be clear, but write basically, you are writing policies, not the next Harry Potter… Make sure that the policy aims and definitions are clear and contain the right details without being too intense and verbose. Providing examples helps understanding. For example, a definition of bullying might include types of behaviour such as physical aggression, intimidation or verbal abuse. It also needs to be clear who the policies apply to, for example do you want to include just employees, or volunteers and contractors too? Grievance procedures should follow a step by step process that is easy to understand and it should be clear who is responsible for the process. However, it doesn’t have to be a military operation. You don’t need to write them severely or in a threatening manner with implications if an employee doesn’t adhere to them. Instead write in clear, basic English to make sure everyone understands what they mean.

2. Make sure they are accessible in various forms (yes not just in a folder shoved in the stationary cupboard) Going online is a great way to get people to read and agree to your policies, for example an Human Resource Information system, an email with a link, a workshop where you go over them together, training if you have more complex policies, or one on one discussions.
3. Your policies should reflect your business values as well as operational methods. Try to get them aligned to your workplace philosophy so that your employees think, and act in the way that best reflects your business. Implementing generic rules and compliance requirements can be confusing to employees if your workplace culture says something different.
4. Live by your policies and set the example. Managers and Business Owners need to live by the book regarding policies. For
example, if you have a no denim rule, rocking up in your new Levis on a Monday morning doesn’t encourage your staff to want to stick to the “rules” either. Nor too if you let one or two employees get away with non-policy behaviour whilst others are trying hard to adhere to them and follow protocol. It can cause staff to be resentful and lose respect, with a why do I have to if she/he doesn’t? attitude and therefore your policy/policies have no merit.
5. Policies should be revisited by all staff from time to time (even the most switched on of us can forget) Existing employees should have regular opportunities to refresh their knowledge of policies. Think about some ways you can make your policies relevant and real for example using posters or regular discussions in Tool box meetings or weekly meetings.
6. Policies need to be updated! If you have a policy that is 10 years old, chances are things have moved on (we hope!). Your equipment might have been
upgraded, you may need a discrimination policy, or social media policy that wasn’t required when you first created your policy suite all those years ago. Also review them after an incident should one occur, such as a formal complaint or investigation. Make sure it is clear who is responsible for reviewing and drafting amendments and that task doesn’t fall through the gaps if the person takes leave or resigns. Communicate any changes to all employees. But remember, the most important aspect of having policies is ensuring that they are agreed and signed off on by each employee when they start working with you. No point having them if they are not read or not agreed to. They are a necessary part of the induction process and a way to ensure that you keep your workplace running as efficiently, as effectively and as harmoniously as possible! Cure Kids Auction from 2017 A
t the 2017 SSAA Convention an Auction was held for Cure Kids and $25,000 was raised. One of the auction items was at Reflections of Port Douglas for seven nights in a two bedroom, two bathroom apartment. Andrew Nairn from Wheeleasy in Perth took his wife Barbara and their two children Jasmine and Kevin on this fantastic holiday. On arrival they found the Apartment was beautifully designed and spacious, perfect for a family with teenagers. With its own fully equipped kitchen and laundry it was a home away from home. Andrew and his family said that “Reflections of Port Douglas was the ideal location to set up base and Carmel was an amazing hostess. From initial booking details to booking tours for us prior to arrival to the warm welcome at the front of hotel after a lengthy travel from Perth via Melbourne, she was marvellous.” “Helpful when we needed recommendations of where to eat, shop, family outing, hire a car for a couple of days etc... really the most perfect of host.. Located stones throw away from the beautiful Four Mile Beach where a morning walk refreshes the soul. Turn right at the front of Reflections and you immediately find the heart of Port Douglas shopping and
Cafe strip... lovely.” Andrew and his family didn’t waste any time on this trip and packed in many adventures which included, snorkelling on the Great Barrier Reef in semisubmersibles viewing the underwater world and exploring the reef in snorkelling gear. They went on the Kuranda Scenic Railway and Sky rail rides and said that “viewing the world from the top of the trees was breathtaking” They had a day trip to Cape Tribulation through the Daintree Rainforest and visited a sugar cane farm and Daintree Ice cream Plantation where local fruits are grown and turned into yummy treats. We tasted ice-cream made from soursop, coconut, mango, wattle seed and hibiscus.

Launching the new Standard Self Storage Agreement
T
he Self Storage Association of Australasia (SSAA) has just released the first updates to the Standard Self Storage Agreement (SSSA) in over three years. In this edition of the MLF, we look at what these changes mean and why they’ve been introduced.
Why change the agreement? Where possible, the SSAA avoids having to update or change its legal documents. We recognise that any changes necessarily mean there will be expenses incurred on the part of members – a new print run of documents, updating software, sometimes new operational procedures and training staff on what those changes mean. Some changes ae made because of legal or practical challenges, and some are required because of new or altered legislation. The most recent changes to the agreement were required because of both. We are starting to see how newish Consumer Laws will be interpreted by courts and tribunals, and needed to update our agreements to ensure our members avoid being in breach. We also needed to update and strengthen aspects of our agreements in response to previously unexperienced challenges.
Key new terms include: Solidifying right to disclose information and better screening rights The SSSA has been updated along with StorerCheck’s terms and conditions. The change has clarified that any person enquiring for storage – and this would include an online enquiry or telephone enquiry - consents to both the checking of their details and the release of any information obtained. This ensures that a facility can check the StorerCheck database on the first contact to better inform themselves about their potential storer.
Formalising fee increase procedure Due to changes in Australian Consumer Laws, it has become necessary to formalise the approach to storage fee increase. Any increase must be reasonable, and 28 days’ notice must be provided to the Storer. Should the Storer object to the increase they may move out before the expiration of the 28 days’ notice, giving 24 hours’ notice. The Storer is due a refund of any fees paid in advance and the usual notice period is waived (cl. 4 (a)). This is to ensure the right to increase fees is viewed as reasonable. NOTE! Only the storage fee can be increased during the life of the storage agreement. Other costs, including late fees, cleaning fees etc. cannot be changed without consent from the Storer (i.e. signing of a new agreement).
Better management of individual storers and their right to access the Facility. Previous agreements have given Storers the right to access the Facility as per times ‘posted’ by the Facility Owner (FO). This has been changed to ‘as advised’. This ensures members may better manage individual storers. The need for this change has occurred because we are seeing a marked increase in the use of technology in our industry around facility access, with the ability to use this technology to customise increased or decreased access times for specific customers. For example, a FO may allow for 24-hour access, but may only grant this to some storers. Altering this wording enables the FO to enforce individual access hours for specific customers.
Removed Admin Fee, added broader reference Members have reported that they do not charge an Admin Fee. We have removed reference to this and replaced it with a more general ‘other Fee(s)’ and

included the ability to attach a Fee Schedule (FS). A FS can be tailored to an individual facility’s needs and can assist to spell out when and why a fee might be charged eg. your Facility may have a fee for when a storer triggers their unit alarm, and a security call out occurs. You can include this fee in your FS and specify when it will apply. A FS provides individual members with better flexibility and control over their businesses.
Right to apply lock when Storer won’t Where the Storer fails to apply a padlock to their space, or refuses to do so, the FO can apply a lock and post keys to the Storer at the Storer’s expense. This clause has been added at the request of members. Many facilities are embracing the ability to offer individually alarmed units, and having an unlocked unit often results in alarm triggers. Although the facility has no liability for goods stolen or damaged because a Storer has failed to lock their space, having unlocked spaces is never ideal, regardless of whether or not the unit is alarmed.
No loitering We have introduced a term specifying that a Storer can’t live, loiter, or dwell in the Space. We’ve always had the ability to terminate for Storer’s residing in their Spaces, but in more recent years we have also seen an increase in problems with Storers using their Space as a ‘day home’, spending all day hanging around at the facility, often using the washrooms for bathing, sometimes cooking in their

Space. Having this clause will enable members to terminate Storers engaged in this behaviour.
Increased ability to deal with Alternate Contact Person (ACP) In the previous update to the SSSA, we included the ability for the FO to deal with the ACP if the Storer was in default or had made it clear they could not or would not meet their obligations under the Agreement. In this update, we have included the right to force access to the Space and release any goods stored to the ACP upon reasonable proof that the Storer is deceased.
Right to dispose of goods regardless of nature Cl. 18 has been adjusted to better protect facilities in the event goods seized upon default contain information which may fall within privacy legislation. It is the opinion of the SSAA that where a storer has defaulted on their agreement and goods stored in the Space contain documents requiring secure destruction, facilities shouldn’t carry the burden of privacy law breaches or cost of secure destruction. Although members are urged to continue to dispose of highly sensitive documents with caution, we believe alterations to this clause will better protect facilities in a broad range of scenarios.
Right to terminate immediately for antisocial, threatening, or offensive behaviour This clause has been introduced to assist members better manage the occasional need to terminate problem storers. Although facilities can terminate any storer with notice (usually 14 – 21 days) this clause provides for immediate termination. The SSAA cautions members
to ensure the clause is enforced reasonably, and members should continue to be mindful of the need to comply with discrimination laws. Remember!
A few key points worth revisiting: 1. The storer is either an individual OR a registered company. Where the storer is a company, you should confirm both that the company is registered (on the ASIC website) and that the individual signing is authorised by the company to do so. A business or trading name cannot be ‘a storer’ as it is not a legal entity capable of forming a contract. Where an individual wants their business name and ABN recorded on the contract, the contract should be executed in the individual’s name “Trading As” the business name. 2. You must record an end date. This is necessary for many reasons, including the right to terminate, increase fees, and avoid leasing laws applying to the agreement. The contract is still valid once the ‘end date’ passes, and still runs until either party gives notices. 3. Where a Storer has defaulted and the FO reasonably believes the goods are of such low value that they do not warrant the expense of attempting to sell, they may be disposed of. If members elect to take this action, they should protect themselves by ensuring they take plenty of video and photographic records of the items before disposing.
How should I roll out new agreements?
Members should speak with their Software Management providers and ensure they have access to the latest version of the agreements. Where printed agreements are used, you should contact your printer and provide them with the newest version of the agreement. Members should switch to using the most recent agreement as soon as possible. All new storers should be signed up on the latest agreements, and where any changes are required by existing storers, this should instigate the signing of a new updated agreement.
I have some really old agreements still in use, what should I do? Members are urged to ensure they take

any opportunity to get Storers signed up to new agreements. As discussed above, new contact details, replacement of ACP with another, taking another space or vacating a space for a smaller (or larger) one, all of these provide an opportunity to have the storer sign a new agreement. When a storer has been storing with you for a long time, and the agreement is very old (more than six years) it is worth incentivising them to sign a new agreement. The method you use will vary depending on your business style and the nature and size of your facility. Physical rewards – like a free bottle of wine, chocolates, plants etc. – or a fee rebate is reported as successful, as are other incentives such as no fee increase for a period when signing a new agreement.
Questions? The MAP will be updated to reflect these new contractual additions. It’s always a great place to start if you need better clarification. Attending a legal training day can also be an excellent way to bring your skills and knowledge up to date, and the content has been updated to include both these contractual changes and all other recent operational and legal changes. If it’s been a while since you attended, it might be time for a refresher.
Updates to New Zealand Agreements The SSAA is also in the process of updating the New Zealand agreements to reflect recent changes in NZ law, in particular, the truck and trailer agreements. The SSAA will provide a summary of changes when the updated documents are released. As always, legal support is available from the SSAA. (MSA) Managed Storage Agreement (Aus) Managed Storage Licence Agreement (NZ)
(AUSTRALIA - Agreement under review – to be released later in 2018) (NEW ZEALAND – Agreement updated in 2017 & reviewed in 2018) Used when the customer engages the storage facility to accept delivery of their goods and store them into the customers’ storage unit. The storage facility has possession of a key to the storage unit. If your storage facility stores vehicles/ boats/caravans that you hold keys for then you should use the managed agreement.
Mobile Storage Agreement – (Aus) **
(Agreement released in March 2017 – available for sale $550, incl GST) This agreement is used when your storage facility offers a mobile service to customers. e.g. a mobile storage unit is delivered to a customers’ premises and the customer stores their own goods, locks the unit and keeps the key. The unit can remain at the customers premises or arrangements can be made for the mobile storage unit to be stored at your
storage facility. The customer can elect to have the storage unit moved between your storage facility and their premises as they choose throughout the life of the Agreement by way of appointment. Under the agreement whilst the customer has control of the location of the Storage Unit, the Storage Facility retains proprietary title to the Storage Unit. The customer is unable to affix the Storage Unit to their own premises. In the event of default this Agreement enables the Facility Owner to enter upon or onto the Storer’s Premises by trespass where the Storage Unit is being stored and may break open any gate, door or fastening and detach or dismantle the Storage Unit from any part of the Premises to which the Storage Unit has been affixed and retake the Storage Unit, then enter the Storage Unit by force or otherwise and take possession of any Goods inside the Storage Unit. **This Agreement is available in Australia on a fee for use basis due to the costs associated with its production.
Mobile Storage Licence Agreement – (NZ)
This agreement is to be used when your facility delivers a mobile unit to a storer to be packed on their property and then returned to your storage facility for storage within 24 hours.

This agreement is used when your storage facility provides a move-in vehicle or a trailer to a storer or non storer free of charge or for a fee. Additionally, under the agreement your storage facility can elect to hire the vehicle or trailer to a nonstorer.
Delivery Room Agreement
(AUSTRALIA - Agreement under review – due for release later in 2018) This agreement is used in conjunction with the Standard Storage Agreement and enables the Storage Facility to accept deliveries and retain goods for collection on behalf of Storage Customers. The Delivery Room cannot be accessed by Storers or delivery and collection agents. This agreement offers an alternative for Storage Facilities who keep keys to Storage Customer’s Units to facilitate deliveries. It is a lower risk option than keeping keys, as the Storage Facility controls the Delivery Room, knows exactly what is in the room and can regulate the deliveries and pickups. Your Storage Facility is liable for the goods in the Storage Room and has a duty to exercise due care, skill and diligence for the safety of the goods. A fee for this service generates income where previously the keeping of keys for accepting deliveries generated no extra income.
