As I write this, I have just returned from Chamberlain and the Spring/Summer Board of Directors’ Conference. The full board and executive board meetings were very important and very well-attended, either in person or via Zoom. I stress, this particular meeting was very important, as it addressed the ongoing progress of searching for our President’s (Myron’s) successor as our leader and lobbyist, as well as working in tandem with the South Dakota Auto Dealers towards the same end. Your Executive Board and Search Committee have spent much time and effort to conduct the search in a manner that is respectful of Myron’s 20+ years of outstanding service to both organizations. My thanks to the members of the Executive Board, especially the Search Committee. Myron is retiring, effective April 1, 2022, and any member of the Board can update you any time on the efforts of this progress between now and then. I, and they, invite you to contact us with any questions/concerns. Two important segments of our Spring/Summer Board meeting are the Cliff Tjaden Fishing Tournament, preceded by the Fishing Calcutta. With twenty five fishing teams participating on which to bid during the Calcutta, over $4,000 was raised for our Association’s Foundation. The first five teams bringing in the best fish catches shared in the proceeds. Kudos to all the bidders for bidding so generously, and a special thanks to Shelley and Brad Schipper for all their preparation to make the entire activity organized and enjoyable for all. And of course, Michelle Wells is behind-the-scenes, always taking the photos to add to the story, as she also assures that the records of the Fishing Tournament are accurate. If you attended, you know how much networking is enjoyed by all, and if you couldn’t make it this year, definitely make plans to attend next year. All of the above give our association valuable exposure. The friendships developed during a gathering such as this are priceless to our businesses and bottom lines. There is another important issue to address, Truckers Against Trafficking, but to do it justice, I will write about that subject next month…stay tuned. Until next month, I wish you and yours, a meaningful Memorial Day as we remember and honor our deceased loved ones and military members.

President’s I am certainly not advocating that we are in a post-COVID time, however, now that the CDC has declared that vaccinated individuals are no longer required to wear masks, I am feeling much better about where we are headed. I am also convinced that no one will ever again be allowed to enter a clinic or hospital without a mask. So, in other words don’t throw your masks away! It does seem a bit liberating and exciting to think that maybe we can get back to traveling, going out to dinner and visiting others in their homes. Maybe it’s just me but I’m sure tired of virtual meetings! The trucking industry has many challenges including driver shortages, infrastructure issues, hours of service and many more. For these reasons and many others, is why it is crucial to keep this association healthy and thriving in the future. Once again, it is the time of year when we turn to greener outside events such as golf, cutting grass, riding bikes and motorcycles. This is especially precious since we have closed the gate on 2020 which was truly a hectic year due to the pandemic. We recently had a very successful Summer Board Meeting and the annual Cliff Tjaden Fishing Event in Chamberlain. Upcoming in June is the west river poker run coupled with the west river golf outing. After that, the next SDTA Event is the annual east river summer golf tournament scheduled for the Brandon Golf Course for Thursday, July 22nd. This is always a fun and action packed event; please plan to join us for one or more of these events. I am writing this column while attending the ATA Midyear Management Meeting in San Antonio, TX. They were concerned about attendance at this first post pandemic face-toface meeting. What I am hearing and seeing is record attendance. It seems that everyone is tired of being cooped up and not able to travel. This is all a good sign that we will have active conversations about industry issues. Stay safe!

Congratulations to Scott Jamison, FedEx Freight Inc., Rapid City, SD. He was selected as the May 2021 Driver of the Month by the South Dakota Safety Management Council. Scott has been a professional truck driver for 15 years, nearly 10 of which were logged for FedEx Freight, Inc. He has nearly a half a million accident-free miles in his career! Recently Scott was in a Coffee Cup Fuel Stop and noticed a man in distress. As the Lyman County Ambulance crew put it, “Mr Jamison recognized the signs of a person having a medical emergency. He didn’t think twice as he approached the situation, not knowing anything about the distressed individual. Scott provided care, comfort and compassion for a complete stranger without being asked or told. His calmness during the indicent helped the patient know help was on its way and that he was not alone. Scott Jamison reacted to a situation that most people would have stayed away from. He jumped in to help a person he had never met, a rare reaction in most of the public these days.” Scott provides safety for the public, not just in this occasion, but on an every day basis. Scott and his wife Carrie reside in Box Elder, SD. The South Dakota Trucking Association joins the Safety Management Council in congratulating Scott Jamison for being selected as the May 2021 Driver of the Month.

FMCSA: Beware of Companies Posing as Government Agencies April 13, 2021 11:45 AM, EDT reprinted from: Transport Topics

Federal Motor Carrier Safety Administration officials posted a warning to truckers on April 8 to be aware of “predatory” companies that pose as government agencies. The message came one day after the Iowa attorney general issued a news release announcing it reached an agreement with a Texas company that agreed to refund money to any Iowa truck drivers that paid it $149 to submit federal documents that can be filed for free. The company, Compliance Processing Group of Frisco, Texas, sent past-due notices to Iowa truck drivers under the name FMCSA Compliance Processing Group. The letters warned that the truckers must “contact us immediately” or risk fines of $1,000 a day — for a total of up to $10,000 — and risk being taken out of service, “per the Federal Motor Carrier Safety Administration.” Iowa Attorney General Tom Miller dubbed the company’s letter a “scam” that takes advantage of a requirement that every company that holds a U.S. DOT number update their company information every two years by updating the MCS-150 form. “The company’s mailer deceptively implies it is sent by a government agency and that failure to respond could be punished with civil penalties,” Miller alleged. “In smaller print at the bottom of the mailers, the letter stated that FMCSA Compliance Processing Group was not a government agency.” In its warning, FMCSA said it is aware that motor carrier officials and new entrant applicants often receive “confusing or misleading solicitations” from service providers or thirdparty administrators by telephone, email, text and U.S. mail. “These businesses obtain your company’s information when you submit an application or update your information with FMCSA, because your basic carrier information is publicly available,” FMCSA said. The warning said that FMCSA does not contact carriers via telemarketers or “robocall” automated telephone solicitations, nor does it request credit card numbers by telephone or charge a fee for downloadable forms that can be found at fmcsa.dot.gov/mission/forms. FMCSA said that predatory companies often contact new carriers after they complete online transactions with FMCSA. Aggressive or fraudulent marketing complaints have included carriers being pressured to immediately enroll in drug and alcohol supervisor training, offer general agency regulatory and compliance support, Unified Carrier Registration compliance or biennial updates, FMCSA said. “Motor carrier service providers and third-party administrators or their employees can and do provide valuable services to motor carriers and new entrants in the motor carrier community, and the use of a private entity or company to assist a motor carrier with compliance is an option for motor carrier officials and new entrant applicants,” the agency said. “However, the U.S. government does not endorse private businesses or vendors, and the use of a service provider is not required by FMCSA,” FMCSA said. Under federal law, impersonating “an officer or employee acting under the authority of the United States” to demand or obtain “any money, document or thing of value” can result in a fine as well as imprisonment for up to three years, the agency said. The agency said that truckers who want to report a fraudulent request for information to DOT should contact the Office of Inspector General Hotline via oig.dot.gov/hotline or by calling (800) 424-9071. Iowa did not seek to penalize or fine Compliance Processing Group, but issued an assurance of voluntary compliance that requires the company to no longer operate in Iowa. The company’s manager, Robert Corrigan, did not return a phone message seeing comment. However, the compliance document noted that the company denied it engaged in “acts or practices which had the tendency to mislead a substantial number of consumers as to a material fact or facts.” “We were using the Iowa consumer fraud act,” said attorney general spokesman Lynn Hicks. “Our main interest was basically to get these guys out of town. We were able to do that without going to court and getting an injunction or small penalty.” TRUCKING NEWS ~ PAGE 9

Understanding Clearinghouse rules is essential for small trucking businesses By Cliff Abbott -April 9, 2021 Starting up your own trucking business with your own authority is a big step that adds complexity to your business. Growing your business from a single truck to multiple units adds even more complexity. The management side of the business changes — you now need to provide payroll, insurance and other services for the people who drive for you. One important change you may need to make is your relationship with the Federal Motor Carrier Safety Administration (FMCSA) Drug and Alcohol Clearinghouse. You may have already registered yourself as a driver; this allows any carriers you drive for to run preemployment and annual queries of your record at the Clearinghouse. Depending on your business model, you may now also need to register as an employer. Whether or not you need to register as an employer hinges on whether you operate under your own authority, using your own Department of Transportation (DOT) number, or under the authority of another carrier. If you’re going it alone, you’ll need to register as an employer, even if you’re the sole driver. If you’re leasing your equipment to another carrier, the employer functions of the Clearinghouse may be handled for you by the carrier, but you’ll need to make sure. Some consortium services are registered with the Clearinghouse and can help handle your registration for you. It’s important to be clear on exactly what services are offered. Carriers have, in the past, failed DOT audits because they incorrectly assumed the consortium they used was performing Clearinghouse duties. While a consortium can conduct a query for you, it can’t purchase a query plan. Before you (or the consortium) can run a query, you’ll need to pay in advance for the number of queries you expect to use in a year. Currently, the cost is $1.25 per query. If you need to register as an employer, go online to clearinghouse.fmcsa.dot.gov and click the “Register” button. You’ll need to have an account set up on login.gov to register. If you have previously registered as a driver, you may already have a login. You’ll need to designate a “Clearinghouse administrator” for your company. If your spouse or someone else handles the paperwork, it can be that person, or it can be yourself. The administrator is the person who makes queries of records and receives the results. You’ll also need to specify the drug and alcohol consortium or third-party administration (C/TPA). If you are leased to a carrier, you and any drivers you hire may be included in the list of names they draw from for random drug and alcohol testing. If you run as your own company and are the only driver, however, you can’t “randomly” draw names from a list of one. A consortium allows your name to be placed in a pool with the names of other drivers and owner-operators to create a large enough group to draw from. Once registered, you’ll need to run queries on any new drivers you hire before they can drive. You’ll also need to run annual queries on every person who drives for you. These queries must be maintained in a file that can be easily accessed by you if your business is audited by the DOT. There are two types of queries — limited and full. Limited queries only tell you if information exists in a driver’s Clearinghouse record. Full queries provide detailed information about violations contained in the record. The cost for either query is the same, $1.25. The biggest difference, however, is the type of driver consent you’ll need to obtain results.

Operation Safe Driver Week Set for July 11-17 With Focus on Speeding Greenbelt, Maryland (April 6, 2021) – This year's Operation Safe Driver Week will take place July 1117 with an emphasis on speeding. During Operation Safe Driver Week, law enforcement personnel will be on the lookout for commercial motor vehicle drivers and passenger vehicle drivers engaging in risky driving behaviors in or around a commercial motor vehicle. Identified unsafe drivers will be pulled over and issued a citation or warning. "Data shows that traffic stops and interactions with law enforcement help reduce problematic driving behaviors," said Commercial Vehicle Safety Alliance (CVSA) President Sgt. John Samis with the Delaware State Police. "By making contact with drivers during Operation Safe Driver Week, law enforcement personnel aim to make our roadways safer by targeting high-risk driving behaviors." CVSA selected speeding as its focus this year because despite a drop in roadway travel last year due to the pandemic, nationally, traffic fatalities increased. According to the National Safety Council's (NSC) preliminary estimates, the estimated rate of death on roads last year increased 24% over the previous 12-month period, despite miles driven dropping 13%. The increase in the rate of death is the highest estimated year-over-year jump NSC has calculated in 96 years. In addition to speeding, law enforcement personnel will be tracking other dangerous driver behaviors throughout Operation Safe Driver Week, such as reckless or aggressive driving, distracted driving, following too closely, improper lane change, failure to obey traffic control devices, failure to use a seat belt, evidence of drunk or drugged driving, etc. CVSA's Operation Safe Driver Program was created to help to reduce the number of crashes involving commercial motor vehicles and passenger vehicles due to unsafe driving behaviors. Operation Safe Driver Week is sponsored by CVSA, in partnership with the Federal Motor Carrier Safety Administration and with support from the motor carrier industry and transportation safety organizations. This initiative aims to improve the behavior of all drivers operating in an unsafe manner – either in or around commercial motor vehicles – through educational and traffic enforcement strategies. SDTA Summer Board Meeting

Following the Board Meeting we gathered at the back patio of the hotel for the SDTA Cliff Tjaden Fishing Event Calcutta. During the Calcutta over $9,000 was raised, half of which goes to the SDTA Foundation to be used for future SDTA Scholarships. Cliff Tjaden started several years ago to help get the South Dakota Trucking Association out of debt. It has continued for more than a decade after the debt was paid in full. What a wonderful way to honor an amazing man!

Class A CDL Driver Position Summary: The Class A CDL driver will provide excellent customer service to our customers with the timely arrival/delivery of agricultural products while meeting company deadlines. Have a full understanding of Bill of Lading and E-log use as well as governing federal restrictions of transportation use. Drivers will be responsible for the condition of their truck/ trailer combination. Vehicle cleanliness and serviceability are an important aspect of DMGs customer service stance. The SDTA Safety Management Council talked about CBD and marijuana laws and how it impacts trucking companies. They discussed what the laws are and how to protect your business. They also discussed what to do if a driver tests positive for THC (marijuana or CBD related). This is the first gathering for SDTA’s NextGen since COVID-19. It was great to get together again. Gerry Anderson

July 12, 1960 - April 16, 2021

We are sad to announce the passing of Gerry Anderson, brother of SDTA’s Pam Kolseth. He passed at the age of 60, following a courageous battle with cancer. In 1980 he started Anderson Landscaping with his dad, a business that continues to flourish. Gerry was a “big picture” man prioritizing the important things in life. He was the embodiment of an optimist and his glass was always overflowing. His sense of humor was contagious and he was the most compassionate, loving (he never had an enemy), giving, and humble man. Everyone who knew Gerry could see God and his love for the Lord in his every action. Please keep their family in your thoughts and in your prayers as they mourn the loss of a brother, husband, father and friend.

December 21, 1961 ~ May 16, 2021 (age 59)

Harold R. Christiansen, Jr., age 59 of Nebraska City, NE passed away on May 16, 2021. Harold was born on December 21, 1961 in Nebraska City, NE; the son of Harold R., Sr. and Alice Mae (Schalk) Christiansen. He grew up and attended school in Nebraska City. After high school he served in the United States Navy. On July 7, 2007, Harold was united in marriage to Lori Renee Lee in Mesquite, NV. He was an over the road truck driver all his working life. He owned and operated his own semi and drove for Johnson Feed Inc., Canton, SD.

Stephen Willers

January 06, 1947 - April 12, 2021

Stephen Lee Willers, Reeds Spring, MO, son of Clifford and Bettylou (Simmons) Willers, was born January 6, 1947 in Sioux Falls, South Dakota and departed this life peacefully on April 12, 2021 at the age of 74 surrounded by his family. Stephen was always a hard worker. In 1959, at the age of 12 years old, his dad told him that he needed to go to work for the family trucking business so he started cleaning livestock trailers. When Stephen was 15 years old, he started delivering trailers around town. Even though Stephen was only 18 years old (driving age on the interstate was 21 years old), he began hauling cattle and hogs to Albert Lea, MN and Austin, MN. During college, Stephen would work in the office at Willers Truck Service in the summer, then go to the yards and load trucks with cattle and hogs, and then take the last load out to Albert Lea or Austin and arrive back in Sioux Falls at 4:00 a.m. Stephen graduated from Washington High School in 1965. It was in high school that Stephen met his wife, Jeanan Sather, in Economics class. Stephen went on to attend the University of Nebraska-Lincoln until he transferred back to Sioux Falls and graduated from Augustana College with a double major while working for the family business. Stephen and Jeanan were united in marriage on August 16, 1969. Stephen continued in his grandmother and father’s footsteps and worked for Willers Truck Service and Jet Leasing along with his brother until his retirement at the young age of 48 years old. Stephen was the president of the South Dakota Trucking Association from 1992-1994. Stephen relocated to Reeds Spring, MO with his family to enjoy his retirement and spent many happy years fishing at Table Rock Lake.

Nellie Louise Petterson, mother of SDTA’s Michelle Wells, passed away May 8th, 2021, at the age of 80. Nellie struggled with Alzheimer’s Disease for the last 8 years of her life.
