CHAIRMAN’S MESSAGE As I ply my trade on this nation’s roads, I have plenty of time to think. This is Spring, not Thanksgiving time, but I am grateful for so many things. One being this nation’s infrastructure. There have been many improvements namely the Minnesota exit ramp on westbound 494 onto 169, the Iowa exit ramp on eastbound 80 onto 29 and the Arizona beltways of 101, 202 and 303. So I am grateful to civil engineers and construction crews. However, don’t get me started on interstates that are now toll roads! As a follow up to my quandary of replacing my ‘14 Pete or overhauling it, I chose to overhaul it. I am grateful for the technical expertise and hard work of my local diesel “mechanic.” I am grateful to our SDTA President Myron Rau. He has propelled and guided our Association into the well-respected reputation it enjoys today. I urge you to attend a retirement gathering in Myron’s honor on Friday, March 18th, 2-4 PM in the Association office. If you can’t attend to congratulate him personally, make every effort to do so with a call, text, or an email. Senator Rounds is working on a bill to exempt certain agricultural employees from the federally mandated ELD training and has reached out to SDTA for our input. The bill would exempt ag, county and state government and tribal drivers from the ELDT. The bill is quite appropriate in South Dakota, as well as other rural states. For more info, contact Senator Rounds’ office, myself or our Executive Director Christine Erickson. Fuel prices are skyrocketing with no end in sight. As you absorb the additional cost to your bottom line, my hope is that the increased freight rates that you must charge will help. After all, the shippers can’t herd the cattle down the road, “sluice” the liquids to their destination, or carry the heavy freight on their backs. Happy Spring to you and yours.

As the weather has turned a corner towards a little more sunshine, I am hopeful that it stays. Nothing beats the sun shining and the windows open. As you all know, the 2022 Legislative session recently wrapped up with little fanfare for the trucking industry. We have been extremely fortunate to have a supportive Legislature. If we can point to something good with Covid, it has been the increased support for the trucking industry. I spent the session reconnecting with many of the people that I served with 10 years ago when I was in the house, from Legislators, Lobbyists and many within the administration. At times it felt like a family reunion, getting to see so many of these old friends. Often times, I had to remind myself to put my lobbyist hat on and remove that elected official hat. While it was fairly easy to do, it also created many instant relationships in my new role with SDTA. Now, that doesn’t go without saying that it was recently reported by Bob Mercer, “This is perhaps the deepest and widest Republican split, both within a chamber and between the Legislature and the governor, since Republican Frank Farrar was governor in 1970.” I share this as in past years our association has not participated in using PAC dollars during Legislative primaries. This may be the year we consider doing so. I have appreciated getting to know so many of you over the last couple of months. I will be hitting the road over the next few months, sprinkling my time between both associations to see your operations, learn about the industry, and meet your staff. Please reach out anytime. New ATRI Study Evaluated Carrier Strategies For Responding To Rising Insurance Costs The American Transportation Research Institute (ATRI) has released a new report analyzing the impact that rising costs of insurance has on the trucking industry. The report assesses immediate and longer-term impacts that rising insurance costs have on carrier financial conditions, safety technology investments, and crash outcomes as well as strategies used by carriers to manage escalating insurance costs. The study found that carrier strategies included decreasing insurance coverage levels, raising deductibles and/or Self-Insurance Retention (SIR) levels, and decreasing investments in other cost centers. Despite this increased liability exposure, outof-pocket incident costs and carrier crash involvement remained stable or decreased among a majority of respondents. Despite reductions in insurance coverage, rising deductibles and improved safety, almost all motor carriers experienced substantial increases in insurance costs from 2018 to 2020, according to ATRI. Premiums increased across all fleet sizes and sectors, with small fleets paying more than three times as much as very large fleets on a per-mile basis. A third of the respondents reported cutting wages or bonuses due to rising insurance costs, and 22% cut investments in equipment and technology—potentially creating future safety and driver shortage concerns. However, in the short-term, crash data confirms that carriers that raised deductibles or reduced insurance coverage were generally incentivized to reduce crashes in the subsequent year. Finally, the research describes a process for calculating the “Total Cost of Risk” in order to evaluate the full scale and impact of rising insurance costs on a carrier’s long-term safety and financial viability, including safety investments in drivers, programs and technologies. “ATRI’s study corroborates the Triple-I’s research on rising insurance costs and social inflation – that increased litigation and other factors dramatically raise insurers’ claim payouts,” noted Dale Porfilio, Chief Insurance Officer of the Insurance Information Institute. “External factors that go well beyond carrier safety force commercial trucking insurance costs to increase, which then requires carriers to redesign their business strategies. The higher premiums ultimately tend to be passed along to consumers in the form of higher prices for goods and services.” A detailed copy of the report can be found below on ATRI's website. FMCSA ANNOUNCED EXTENSIONS OF SOME COVID-19 EMERGENCY WAIVERS AND DECLARATIONS Emergency Declaration

FMCSA’s Emergency Declaration that was set to expire on February 28th has been extended until May 31, 2022. The declaration extended yesterday is limited to the transportation of: 1. Livestock and livestock feed; 2. Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19; 3. Vaccines, constituent products, and medical supplies and equipment, including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19; 4. Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap, and disinfectants; 5. Food, paper products, and other groceries for emergency restocking of distribution centers or stores; 6. Gasoline, diesel, jet fuel, and ethyl alcohol; and, 7. Supplies to assist individuals impacted by the consequences of the COVID-19 pandemic (e.g., building materials for individuals displaced or otherwise impacted as a result of the emergency). As with the previous extension, this declaration applies only to 395.3 “Maximum Driving Time for Property-Carrying Vehicles”. This declaration becomes effective at 12:00 a.m. on March 1, 2022, and expires May 31, 2022, unless modified or terminated sooner. Reporting requirements previously established remain in effect. To be eligible, the transportation must be both (1) of qualifying commodities and (2) incident to the immediate restoration of those essential supplies. We strongly encourage everyone to review the applicability, restrictions, and limitations listed within the waiver. CDL/CLP/MEDICAL EXAMINATION ENFORCEMENT DISCRETION FMCSA has issued a notice of enforcement policy/discretion regarding CDL/CLPs and Medical Examinations. FMCSA will exercise its enforcement discretion to not take enforcement action for a CLP or CDL holder operating a CMV with an expired license, but only if the CLP or CDL was valid on February 29, 2020 and expired on or after March 1, 2020. FMCSA will also exercise enforcement discretion for CMV drivers whose medial certification or medical variance expired on or after December 1, 2021. Drivers whose medical certification or medical variance expired before December 1, 2021 are not covered by this notice of enforcement policy. This notice is effective March 1, 2022 and expires on April 15, 2022.

Driver may be nominated for Driver of the Month for any outstanding act of heroism, a contribution to highway safety, an extraordinary act of courtesy, an exceptional deed or act of service to mankind within the community reflecting positively on the motor carrier industry, or for a long period of safe and courteous driving. An outstanding act shall be deemed to mean unusual or other than the normal every day courtesies afforded by truck drivers. Eligibility: 1. The nominated driver must be an employee of a member in good standing of the South Dakota Trucking Association. 2. The nominated driver must have been an employee by the present employer for at least two years and have a minimum of five years overall experience. 3. South Dakota domiciled* drivers are eligible for nomination for an outstanding act performed in any state. * The intent of the word “domiciled” shall be interpreted to mean: Any driver reporting to or regularly dispatched from a terminal within the state of SD (in keeping with the Federal Motor Carrier Safety Regulations definition of his/her home terminal) regardless of where the driver may dwell. 4. A driver may receive the Driver of the Month award only one time in any contest year. He/she may be renominated in any subsequent year. 5. Nominations for outstanding acts on the highway shall be accompanied by supporting evidence (letters, statements, news clippings, etc.). A clear, factual account is absolutely necessary. Vague generalizations will not be accepted. 6. A copy of recent driver motor vehicle record check must accompany the nomination. 7. Drivers nominated and not selected as Driver of the Month will be held over and used in the following month’s selection. 8. Entries must be in the SDTA office no later than the 10th of each month for that current month’s contest. 9. Nominations may be made by any party, but must be approved by the employer or a representative of the employer. 10.
