During each month, I wonder what subject should be addressed in my column for this publication. Some months, the subject ideas come to me easier than other months. Allow me to continue concerning a very important topic. In August of 2014, SDTA, the US Attorney, FBI, TAT and SDHP, and SEVENTEEN of our members, among other “heavy hitters”, sponsored and conducted a well-attended symposium on the vile practice of human trafficking, either for labor or sex; harvesting a human being’s attributes and strengths to enrich their purveyors. The symposium was extremely educating and enlightening to the trucking companies, hospitality industry workers, truck stop personnel, and the general attendees. Educating, because we need to recognize the signs of a trafficking situation. Enlightening, because a majority of us needed to be more aware concerning the insidious nature of human trafficking, especially as it pertains to the younger victims. One of the speakers was drugged and transported from Minneapolis to Chicago at age 15. For two years, she was forced out onto the streets to “entertain” a minimum of “clients” per day, or she was not allowed to eat, shower, or sleep that day. Of course, her income all went to her purveyor. Personally, I was horrified and then filled with gratitude last September when our three-year-old granddaughter wandered away from home before dawn. A righteous person noticed her walking down a busy street in a large city, and alerted the authorities who returned her home safely. I shudder to think of the outcome if someone else had noticed her alone. I could go on with other scenarios, but I strongly urge you to access the Truckers Against Trafficking website to become even more aware and educated about how we, in the transportation industry, can “put the brakes” on, and disrupt sex and slave trafficking…www.truckersagainsttrafficking.org. The directors of Truckers Against Trafficking, Kylla Leeberg, and Kandice Paris, have addressed our members at various times, primarily during our annual convention. So, since 2014, Myron Rau and your Association have been on the cutting edge of spreading the word on this topic. I realize the above is heavy information to absorb. On a lighter note, I attended the Wheel Jam in Huron earlier in June. It was a walk down memory lane to watch the parade of semis rolling down the city’s streets. There were all makes, models, colors, years, and shapes of semis and trailers. It was a joyous, entertaining way to spend the day. I encourage you to take advantage of the future opportunities to connect with your fellow members at Associationsponsored events: East River Golf Outing in Brandon on July 22, and Annual Convention in Sioux Falls September 8-10. I trust the West River Golf Outing earlier in June was a well-attended, successful event. President’s Recently I received a call of concern from a long time member of the SDTA. The concern centers on headlights and auxiliary driving lights not only on passenger cars but also on trucks. My response was that we have pertaining state laws that govern proper use of these lights. The member then asked me to dedicate my next monthly column to this subject and include all pertaining laws. Here goes: 32-17-5, Construction and adjustment of headlamps--Visibility distance--Four headlight system--High beam indicator--Violation as misdemeanor. The headlamps of motor vehicles shall be so constructed, arranged, and adjusted that, except as provided in § 32-17-7, they shall at all times mentioned in § 32-17-4, and under normal atmospheric conditions and on a level road produce a driving light sufficient to render clearly discernible a person two hundred feet ahead. However, headlamps may not project a glaring or dazzling light to persons in front of such headlamps. Any vehicle equipped with a four lamp headlight system shall have all lamps lighted on high beam, if such system was designed by the manufacturer to require all four headlamps be lighted, and shall have the two low beam lamps lighted on low beam when headlamps are lighted as required in § 32-17-4, Every motor vehicle, except those excluded in § 32-17-1, shall be equipped with a high beam indicator lamp which shall be lighted whenever the vehicle headlamps are on high beam position. A violation of this section is a Class 2 misdemeanor. 32-17-7, Circumstances under which headlamps must be dimmed--Violation as misdemeanor. Whenever a motor vehicle, except a moped equipped with a single beam headlamp as provided in § 3217-24.1, is being operated upon a highway, or a portion thereof, which is sufficiently lighted to reveal a person on the highway at a distance of two hundred feet ahead of the vehicle, the driver shall tilt the beam downward. Whenever a motor vehicle meets another vehicle or overtakes another vehicle proceeding in the same direction on any highway, the driver shall tilt the beams of the headlamps downward, provided that at all times, as required in § 32-17-4, at least two lights shall be displayed on the front of and on opposite sides of every motor vehicle other than a motorcycle. A violation of this section is a Class 2 misdemeanor. 32-17-17. Auxiliary driving lamps--Mounting--Lighting restricted. Any motor vehicle may be equipped with up to three auxiliary driving lamps mounted on the front at a height not less than twelve inches nor more than twenty-four inches above the level surface upon which the vehicle stands, and every such auxiliary driving lamp or lamps shall meet the requirements and limitations of §§ 32-17-1 to 32-17-16, inclusive. A violation of this paragraph is a petty offense. No auxiliary driving lamp mounted on a motor vehicle, other than a fog lamp, may be lighted at any time the lighted headlamps on the vehicle are on a low beam position. A violation of this paragraph is a Class 2 misdemeanor. It never hurts to review our equipment and the equipment of our owner operators to make sure we are actually in compliance with state law Stay safe!

Reminder: What CDL Drivers Should Know About Using CBD Products Positive drug tests account for 81% of the total violations reported in the Clearinghouse since January 6, 2020. As of May 1, 2021, marijuana has been detected in over half of all drug tests that have been filed in the Clearinghouse. It is important for all employees who perform safety-sensitive functions, including CDL drivers, to know: The USDOT requires testing for marijuana and not CBD. The labeling of many CBD products may be misleading because the products could contain higher levels of tetrahydrocannabinol (THC) than what’s stated on the product label. The USDOT’s Drug and Alcohol Testing Regulation, 49 CFR Part 40, (www.transportation.gov/odapc/part40) does not authorize the use of Schedule I drugs, including marijuana, for any reason. CBD use is not a legitimate medical explanation for a laboratory-confirmed marijuana positive result. Therefore, Medical Review Officers will verify a drug test confirmed at the appropriate cutoffs as positive, even if an employee claims they only used a CBD product. Since the use of CBD products could lead to a positive drug test result, USDOT-regulated CDL drivers should exercise caution when considering whether to use CBD products. Drug and alcohol program violations incurred by CDL drivers are recorded in the Clearinghouse, and associated with the CDL number of the driver who incurred the violation. SDTA Road Team Back on The Road Again
SD Road Team Captains Jeff Eschen, K&J Trucking, Inc., Mike Whitehead, FedEx Freight, Inc. and Gary Schmidt, Cliff Viessman Inc., spent the morning May 24, 2021, with nearly 200 driver’s education students from O’Gorman High School, Sioux Falls. First they presented a slideshow to the students, allowing them to understand the blind spots around the trucks and emphasizing safety measures to use when sharing the road with trucks. After the slideshow the students all had the opportunity to sit inside one of the three tractor-trailer setups in the school parking lot. Until they had the opportunity to sit inside the semi and shut the doors they cannot truly grasp the driver’s view, or lack there of. This is the fourth year the South Dakota Road Team has had the opportunity to speak to the students. In 2020, due to the COVID-19 pandemic the Road Team Captains put together a video presentation the driver’s ed students were able to access from their own home computers.

Exclusive: US businesses warn crumbling infrastructure is hurting the economy By Matt Egan, CNN Business Updated 2:04 PM ET, Wed June 9, 2021
New York (CNN Business) As infrastructure negotiations between the White House and a GOP Sen-
ate group broke down this week, business executives are warning that aging infrastructure is holding America back. Nearly two-thirds (63%) of middle market executives say the nation's ailing infrastructure is restricting growth of the national economy, according to a new RSM survey shared exclusively with CNN Business. The survey, conducted in partnership with the US Chamber of Commerce, also found that 60% of these executives say the state of infrastructure is hurting local economies as well. The findings come as President Joe Biden struggles to convince Republicans in Washington to support his $2 trillion American Jobs Plan that would aim to modernize roads, bridges and broadband and invest in clean energy. "The antiquated nature of America's infrastructure is holding back the national economy, the local economy and the firms that comprise the beating heart and soul of the real economy," Joe Brusuelas, chief economist at RSM, said in an interview. Broad support for 5G, network security and highways The survey, conducted in April, focused on the middle market sector of the economy, which, as the name suggests, encompasses firms that are larger than small businesses yet not as big as the most powerful corporations with household names. These roughly 2,000 firms have revenue ranging between $10 million and $2 billion and employ around one-third of the US labor force. When asked about 21 specific initiatives — improving interstate highways, bridges, ports and railways and the like — at least 63% of executives said those improvements would have minor, moderate or significant benefits to their company's day-to-day operations, the RSM survey found. "The middle market is signaling to the political authority that we need to improve overall efficiency and productivity because the roads, bridges, waterways and conditions of broadband technology are holding us back," Brusuelas said. "We need to invest in the future." There was even stronger support for modernizing certain elements of infrastructure: telecom network security (95%), local roads or highways (94%), telecom networks such 5G (94%) and the energy grid (90%). It is important to note, however, that the questions from RSM did not offer any trade-offs for getting these upgrades done. In other words, there was no mention of how revamping the electric grid may require companies to pay more to Uncle Sam in taxes. "As a business community, we hope something gets done on infrastructure," Tim Ryan, CEO of accounting and consulting giant PricewaterhouseCoopers, told CNN Business. Ryan, whose firm advises Fortune 1000 companies and many middle market businesses, said there remains a debate over how to pay for infrastructure improvements and what should be included in the plan. "There is a clear view that we as a country need to progress on infrastructure," Ryan said. Exclusive: US businesses warn crumbling infrastructure is hurting the economy continued... "There is a reason that infrastructure, while extremely popular, has not gotten done: because it's hard," one White House official told CNN Business. "The president is committed to getting it done." Republicans have argued that Biden's $4.5 trillion Build Back Better agenda, which includes the American Families Plan, will backfire by overheating the economy with more spending. Senate Minority Leader Mitch McConnell recently warned that Biden's current budget proposal "would drown American families in debt, deficits and inflation." However, unlike the $1.9 trillion stimulus package enacted in March, Biden's infrastructure proposal and American Families Plan are long-term investments that do not include enhanced jobless benefits, small business loans or stimulus checks. "This is not stimulus. It's not going to be rolled out the minute the ink is dry on the legislation," a second White House official told CNN Business. Inflation is here. How long will it last? Even so, pricing pressures are real. Everything from gasoline and used cars to diapers and lumber has gotten more expensive. The latest: Chipotle (CMG) announced this week it raised menu prices by up to 4%, while SherwinWilliams (SHW) is jacking up paint prices by 7% beginning in August. The White House, like the Federal Reserve and many economists, is betting the return of inflation won't last. "We're going to see some short-term challenges with inflation, but that is likely to abate once we get through and come out of this crisis," the second White House official said. Paying for infrastructure Beyond the substantial price tag on the infrastructure package, one major sticking point is how to pay for it. The Build Back Better agenda calls for raising $3.5 trillion by increasing taxes on corporations and the wealthy. Republicans and many business groups, including the US Chamber of Commerce, oppose rolling back the Trump tax cuts that lowered the corporate rate to 21%. They argue that raising the tax rate to 28%, as Biden has proposed, would make US companies less competitive on the global stage. (Biden has also signaled a willingness to consider other options, such as imposing a 15% minimum tax on all corporations). First Solar (FSLR) CEO Mark Widmar cited the Trump tax cuts as one reason the solar panel manufacturer decided to build a third factory in Ohio. He told CNN Business that rolling back those tax cuts would have an "adverse impact" as companies consider investing in more manufacturing in the United States. Biden officials suggested there is an irony among Republicans' concerns about inflation and their desire to avoid raising taxes. "When you pay for something, you're taking money out of the economy. That helps reduce the expansionary effects of anything we do," the second White House official said. "If your main concern is inflation, then you should be very concerned about the other side of the equation." Brusuelas expressed concern that Washington will fail to take advantage of the current low borrowing costs to make overdue investments in the nation's infrastructure.
