CHAIRMAN’S MESSAGE
As everyone is well aware of on July 3rd President Trump visited South Dakota for a 4th of July celebration at Mount Rushmore. The SDTA was issued two VIP tickets from the White House and Myron was unable to attend so my wife and I had the pleasure and honor of attending. In these trying times and it being an election year there were certainly plenty of issues to be talked about. I enjoyed the activities of the day immensely. We listened to Governor Noem and President Trump both speak and it was comforting to know that our President and Governor were in agreement of our Nation and States path. I will never be able to put in words the emotions we experienced as we watched Air Force One and Marine One fly over Mount Rushmore upon the Presidents arrival. When we thought we had seen everything, we had fly-bys from every branch of the military service. I tried to take pictures and got some, but they certainly don’t do the day justice. It is impossible to take a picture of these jets when you don’t know where they are coming from and when. Then they are gone in the blink of an eye. The media has put out some very good pictures and there are some great you-tube videos if you get a chance please watch them. Because of the Pine Beetle epidemic and the forest fire danger it had created, there has not been a fireworks display at Mount Rushmore for eleven years. Over the years through a united effort from the US Forest Service and the Logging Industry in the Black Hills, the Black Hills of South Dakota and Wyoming have virtually been alleviated of the Pine Beetle epidemic. Governor Noem worked very hard with the Secretary of Interior David Bernhardt to bring the fireworks back this year for this special occasion and was it ever breathtaking. Secretary Bernhardt was also present to enjoy the fireworks display. I share some of the pictures I took, but again there are some out there through the media that are fabulous. You can listen to both the President’s and the Governor’s speech on You-Tube. I encourage you to do so. The SDTA Convention is just around the corner September 9th through the 11th and it’s in Deadwood for the first time this year. Hope to see you all there. I think we are all ready for some social activity. I know I am.

I am going to start this column with what I feel is good news. The east river annual SDTA Golf Fundraiser scheduled for July 23rd is a “GO!” Since our spring and summer events were cancelled, this event will give us a chance to reconnect and have some fun during some rather challenging times. Attendees will notice some changes to the event; for instance, there will not be a social gathering following golf and we will be mailing the winnings to each person and publishing the list of winners. The second good news announcement is the fact that we have also decided to move forward with the annual convention scheduled in Deadwood on September 9th through the 11th. Again, attendees will notice some changes with regard to social distancing and food service changes. You will find a tentative agenda in this edition of the Trucking News; please review it and make plans to attend. We all feel cooped up and attending an industry gathering with friends is certainly something we all need. After that “positive news,” I will now pivot to a completely different subject; that is nuclear verdicts by juries. “Nuclear Verdicts” is a term adopted by the insurance industry for verdicts that significantly exceed their evaluations of a case. The American Transportation Research Institute (ATRI) recently released comprehensive research that confirms that large verdicts against trucking fleets are increasing dramatically, both in number and in size of awards. ATRI’s research is partially based on a newly created trucking litigation database that provides detailed information on 600 cases between 2006 and 2019. In the first five years of the data, there were 26 cases over $1 million, and in the last five years of the data, there were nearly 300 cases. Fortunately, I am not aware of a nuclear verdict levied by a South Dakota Jury. However, SDTA Members travel through most of the 48 contiguous states, many of which have seen extremely large verdicts. Many larger fleets are self-insured up to a point, meaning they are on the hook for a certain amount of liability before their insurance company takes over. In the case of some of the largest trucking companies, they may be self insured for $10 million. If such a fleet is hit with a verdict higher than $10 million, the trucking company would then have to pay out $10 million before the insurance company comes in to pay the rest. Smaller fleets that may just have $1 million in liability insurance coverage, which is common normal coverage (federal law requires a minimum of $750,000) the money owed in a verdict needs to come from somewhere. You will be hearing more on this subject since insurance companies have partnered with the American Trucking Associations making it a priority one item for the trucking industry. Brake Safety Week is Set for August 23-29, 2020 Greenbelt, Maryland (July 8, 2020) – The Commercial Vehicle Safety Alliance’s (CVSA) Brake Safety Week will proceed as scheduled, Aug. 23-29. Enforcement officials will inspect commercial motor vehicles throughout the week and vehicles found to have critical outof-service brake violations, or other critical vehicle out-of-service inspection item violations, will be restricted from traveling until those violations are corrected. Vehicles that pass eligible inspections may receive a passed-inspection CVSA decal. Checking brake system components is always part of the roadside inspection process; however, inspectors will be paying special attention to brake hoses/tubing during this year’s Brake Safety Week to highlight the importance of those components to vehicle mechanical fitness and safety. The brake systems on commercial motor vehicles are comprised of components that work together to slow and stop the vehicle, and brake hoses/tubing are essential for the proper operation of those systems. Brake hoses/tubing must be properly attached, undamaged, without leaks and appropriately flexible. Brake hoses/tubing are an important part of the braking system so when they do fail, they can cause problems for the entire braking system. During last year’s International Roadcheck inspection and enforcement initiative, brake system and brake adjustment violations accounted for 45.1% of all vehicle out-of-service conditions. That’s more than any other vehicle violation category. And during last year’s Brake Safety Week, 13.5% of the commercial motor vehicles inspected had brake-related vehicle inspection item violations and were placed out of service. Brake Safety Week is part of law enforcement’s effort to reduce brake-related crashes by conducting roadside inspections and identifying and removing unsafe commercial motor vehicles from roadways. “Despite the pandemic, commercial motor vehicle safety inspectors continue to prioritize vehicle and driver safety by conducting inspections every day,” said CVSA President Sgt. John Samis with the Delaware State Police. “Safety is always our top priority and it’s our mission to ensure the vehicles on our roadways have met all safety standards and regulations. This is especially important as we rally behind truck drivers as they transport essential goods during this public health crisis. We need to do everything we can to ensure that the vehicles truck drivers are driving are as safe as possible.” In addition to CVSA’s Brake Safety Week, August is also Brake Safety Awareness Month. Along with inspections and enforcement, law enforcement agencies also engage in outreach and awareness efforts to educate drivers, motor carriers, mechanics, owner-operators and others on the importance of proper brake maintenance, operation and performance. “Brakes are one of the most important systems in a vehicle,” added Sgt. Samis. “Failure of any component of a brake system could be catastrophic. Routine brake system inspections and component replacement are vital to the safety of commercial motor vehicles.” Brake Safety Week is part of CVSA’s Operation Airbrake program, in partnership with the Federal Motor Carrier Safety Administration and the Canadian Council of Motor Transport Administrators. My name is Ty and I am 18 years old. I grew up outside a small town on a farm. I began work on the farm at a young age. I was taught to haul corn for the farm at a pretty young age and have enjoyed driving truck since then. I worked for a haying business and did everything from cut &bail hay to haul the bales. I also did concrete work for a summer. I worked in a welding shop all last winter and built things like free standing panels, wind breaks and calf shelters. I was a mill operator at Prairie States Trucking early this summer. Currently, I am working at the welding shop but now I haul panels, pull side dump, and haul bales with semis. I really enjoy driving truck and being able to see other places along the way. Ty will be attending Southeast Technical Institute this Fall.

Morgan LeBeau is a recipient of the South Dakota Trucking Association Scholarship. She graduated from West Central High School in Hartford, SD where she has spent her academic career thus far. In the fall, Morgan will start at the University of Sioux Falls. She will pursue a degree in Elementary and Special Education. Morgan has worked at Imagination Station Daycare for the last four years. Morgan enjoys volunteering in her community by feeding the homeless, assisting in teaching dance, and helping with Sunday School.Â

The link between quality sleep & productivity It’s no secret — the average adult is sleep deprived.
It’s no big secret that American adults are sleep deprived. In fact, it’s such an important piece of overall health and productivity that the Centers for Disease Control and Prevention (CDC) recommends seven or more hours of sleep per night for optimal well-being. But 1 in 3 Americans are lacking the sleep they need.
The true cost of employees who are sleep deprived Poor sleep habits are associated with an increased risk of developing chronic conditions like obesity, diabetes, high blood pressure, heart disease, stroke and more. On top of that, a Harvard research study found insomnia leads to the loss of 11.3 days’ worth of productivity each calendar year for an average worker. When the study calculated cost impact, that’s equal to $2,280 per worker! Not only do we need to get enough sleep, we need quality sleep, too. A poor night’s sleep can be caused by waking up frequently due to snoring or gasping for air. Snoring could be more than just a habit; it may be a sign of sleep apnea. This sleep disorder, affecting nearly 22 million Americans, can reduce or
stop normal breathing and momentarily interrupts sleep. If you experience loud snoring, gasping for air during sleep, excessive daytime sleepiness, or any of these other symptoms, make sure to tell your personal doctor.
BE WELL WITH WELLMARK Six tips to a better night of sleep
When should employees consider sleep evaluations?
1. Be consistent: Go to bed at the same time each night and get up at the same time each morning, including on the weekends.
If the doctor has ruled out other potential causes of disrupted sleep, like a nasal obstruction, they may recommend completing a sleep study. Overnight sleep studies measure several things (breathing rate, blood oxygen level and heart rate) and can be completed in a hospital, sleep center or at home. All settings will provide a complete evaluation of your sleep, but homebased studies are more comfortable.
2. Make sure your bedroom is quiet, dark, relaxing and at a comfortable temperature.
The importance of healthy sleep habits Sleep shouldn’t be a luxury; it’s a pivotal component of overall good health. “As a nation, we are not getting enough sleep,” said Wayne Giles, M.D., director of CDC’s Division of Population Health. “Lifestyle changes such as going to bed at the same time each night; rising at the same time each morning; and turning off or removing televisions, computers, mobile devices from the bedroom, can help people get the healthy sleep they need.”
3. Remove electronic devices, such as TVs, computers, and smartphones, from the bedroom. 4. Avoid large meals, caffeine, and alcohol before bedtime. 5. Avoid tobacco/nicotine. 6. Get some exercise: Being physically active during the day can help you fall asleep more easily at night.

SDTA DRIVER OF THE MONTH RULES Each month the SDTA Safety Management Council reviews the nominations and votes to select the next months winner. At the Annual Convention the past 12 monthly winners interview to be named the S.D. Driver of the Year.
Driver may be nominated for Driver of the Month for any outstanding act of heroism, a contribution to highway safety, an extraordinary act of courtesy, an exceptional deed or act of service to mankind within the community reflecting positively on the motor carrier industry, or for a long period of safe and courteous driving. An outstanding act shall be deemed to mean unusual or other than the normal every day courtesies afforded by truck drivers.
ELIGIBILITY: 1. The nominated driver must be an employee of a member in good standing of the South Dakota Trucking Association. 2. The nominated driver must have been employed by the present employer for at least two years and have a minimum of five years overall experience. 3. South Dakota domiciled* drivers are eligible for nomination for an outstanding act performed in any state. * The intent of the word “domiciled” shall be interpreted to mean: Any driver reporting to or regularly dispatched from a terminal within the State of South Dakota (in keeping with Federal Motor Carrier Safety Regulations definition of his home terminal) regardless of where the driver may dwell. 4. A driver may receive the Driver of the Month award only one time in any contest year. He/she may be renominated in any subsequent year. 5. Nominations for outstanding acts on the highway shall be accompanied by supporting evidence (letters, statements, news clipping, etc.). A clear, factual account is absolutely necessary. Vague generalizations will not be accepted. 6. A copy of recent driver motor vehicle record check must accompany the nomination. 7. Drivers nominated and not selected as Driver of the Month will be held over and used in the following month’s selection. Nominees not selected in either of these two months may be re- nominated for any future month’s selection. 8. Entries must be in the office of the South Dakota Trucking Association no later than the 10th of each month for that current month’s contest. 9. Nominations may be made by any party, but must be approved by the employer or a representa tive of the employer. 10. The annual contest will run from September of the previous year through August of the current year. 11. Company agrees to submit a professional, head and shoulders, black and white photo of entry upon notification of winning. (3” X 5” preferred)
