Is being part of the transportation industry worth investing your life’s blood? Driving back from Indiana this week, I was reflecting on the best and worst of my 57 years and eight million plus miles spent owning/driving big rigs. If you are an owner/ operator, you are very familiar with the expenses: Time away from your loved ones’ special occasions, equipment purchases, repairs, tires, taxes, insurance, etc. If you are an employee, add in the expenses to your employer: Work comp premiums, unemployment compensation premiums, possibly 401K contributions. Now that I’ve noted the difficult parts of this industry, I will concentrate on the good parts: excellent pay, the feeling of accomplishment, pride in providing for your loved ones’ and country’s needs, increasing equity, maybe a real estate/mortgage payment or two. Yes, being part of this industry is both difficult and rewarding to many. It takes a village to be successful at this life’s work, not the least are our loved ones left behind while we provide. The next thought I had was to encourage us all to be appreciative of those left behind to keep the home fires burning. It is difficult for them as well, to be without their partners as we ply the roads earning a living. The next opportunity you have when you return to the home base, please give a small gesture to your loved ones, anything at all, so they understand that YOU understand their value to you and your chosen career. On another note, SDTA sponsored a pheasant hunt in November the day before the Fall Board Meeting. The hunt was valuable in good exercise, building relationships within the industry, and all-around good times. Not sure how many pheasants were harvested, but that was really beside the point. Plan to join the hunt in 2021. I assure you that it is worth the time commitment. At the Board meeting, Myron noted that over 90% of our PAC recipients, who hold our industry in high regard, were elected/re-elected; an excellent return for our PAC contributions. It is my and Jean’s wish that you and your loved ones enjoy the blessings of the Christmas season, and that you remain well and safe.

I was quite concerned when we got a lot of heavy snow in October but the November and December South Dakota weather has been fantastic. It appears that we could be headed for Christmas with very little snow. That may not please those that are into winter sports but that news is likely to please most people. I am quite confident that we will see our share of snow and winter, however, when the snow comes in late December it seems to shorten the winter. With a heavy heart, I would like to let everyone know that we recently lost a couple of great friends and long time members of the trucking industry. As you will see in this edition of the Trucking News, we lost both Nathan R. Behne and Gary A. Goodman, Sr. Both passed away on Saturday, November 28th. Please keep their families in your thoughts and prayers. The November elections brought some new people into state and federal service. There are challenges ahead for these leaders. It is our job to keep them educated regarding the significant parts the trucking industry plays in keeping our economy moving forward. As we approach the holiday season, I personally want to thank everyone for their membership in the South Dakota Trucking Association. Your dedication and commitment keeps the organization strong. The trucking industry is a vital part of our state's economy as well as the economy of this nation. As I struggle for more thoughts to share this month, I will end with a short column this month. Please check your email and watch for bill status reports from the State Capitol as I spend a couple of months lobbying the legislature. I will be moving to Pierre on or about the 12th of January and will return to my office on or about the 11th of March. As always, if you need to contact me during my time in the state Capitol, please call your SDTA Office and the staff will get me a message to call you. OUR CONDOLENCES... Gary A. Goodman, Sr. October 10, 1950 - November 28, 2020
Gary A. Goodman, Sr. 70,of Oacoma, SD passed away on November 28, 2020. Visitation will be from 4:00 to 7:00 pm on Monday, December 7, 2020 at the Hickey Funeral Chapel in Chamberlain. Private family services will be at a later date with burial in Graceland Cemetery at Oacoma, SD. A celebration of Gary’s life is planned June 12, 2021. In lieu of flowers a memorial will be established. Gary Alan Goodman Sr., son of Troy and Beaulah (Johnson) Goodman was born October 10, 1950 in Chamberlain. In 1970, he was operating heavy equipment for a construction company building the interstate bridge causeway. It was during that time that he met the love of his life Amy Ferrier and together they shared 50 years of marriage. After working construction, he began working with his best friend Jim Olesen at Jay Lundt’s feedlot in Pukwana. In the late 70’s he bought a truck and started Goodman Trucking which still exists today. His trucking business gave him the opportunity to make many great friends all across the United States and Canada.
Nathan Behne May 4, 1943 - November 28, 2020
Nathan Behne passed away on November 28, 2020 at the age of 77. Nathan was born on May 4, 1943, at home in Triumph, MN, to Lawrence and Elsie (Weber) Behne. When he was 5, the family moved to a farm north of Alpha and attended school in both Alpha and Jackson. Ten years later the family moved to Sherburn. Nathan graduated from Sherburn High School in 1961 and then attended Universal Trade School in Omaha, NE, for vehicle mechanics. Nathan was united in marriage on January 27, 1963, to Dorothy Louise Clabaugh. Nathan and Dorothy enjoyed 57 years together. Nathan held jobs in Estherville, IA and Hopkins, MN, as a mechanic and began local hauling. In 1967 Nathan went into long distance trucking, working for Lloyd Hartke, hauling grain from local elevators and from SD to elevators in the Minneapolis area. Nathan then began working for D&J Transfer of Sherburn, becoming the second owner operator D&J ever had. In 1970 Nathan started his own business, Behne Truck Line, moving into flatbed hauling. Nathan retired from the business in January 2015 when the business was sold to his son Rick, who had worked with Nathan in the business for more than 25 years. Nathan was a lifelong member of St John’s Lutheran Church and a longtime member of the Sherburn Lion’s Club, including being a past president and recipient of the Melvin Jones Award. Nathan served on the Sherburn City Council for 12 years including Region 9 development. Nathan participated in the Martin County Mentoring program for youth and enjoyed hobby stock racing, hunting and fishing. He and Dorothy enjoyed wintering in TX and the many friends they made there. There was always dancing, concerts, crafts and golf cart rides to the many park festivals. Memorial contributions can be made to the SDTA Trucking Foundation through the SDTA office in honor of those lost.

EXPANSION AND EXTENSION OF THE MODIFIED EMERGENCY DECLARATION No. 2020-002 UNDER 49 CFR § 390.25 THE FIFTY UNITED STATES OF AMERICA AND THE DISTRICT OF COLUMBIA The Federal Motor Carrier Safety Administration (FMCSA) hereby declares that the continuing national emergency warrants the expansion and extension of the modified Emergency Declaration No. 2020-002. The expansion and extension of the modified Emergency Declaration continues the exemption granted from Parts 390 through 399 of the Federal Motor Carrier Safety Regulations (FMCSRs) for the fifty States and the District of Columbia as set forth below. Emergency Declaration No. 2020-002 was issued following the declaration of a national emergency by the President pursuant to 42 U.S.C. § 5191(b) in response to the Coronavirus Disease 2019 (COVID-19), the public health emergency declared by the Health and Human Services Secretary, and the immediate risk COVID-19 presents to public health and welfare. FMCSA has previously modified Emergency Declaration 2020-002 to expand and remove categories of supplies, equipment and persons covered by the Emergency Declaration to respond to changing needs for emergency relief. On September 11, 2020, FMCSA extended the modified Emergency Declaration No. 2020-002 and associated regulatory relief through December 31, 2020 in accordance with 49 CFR § 390.25. FMCSA is continuing the exemption because the presidentially declared emergency remains in place and because a continued exemption is needed to support direct emergency assistance for some supply chains. FMCSA is expanding and extending the modified Emergency Declaration No. 2020-002 and associated regulatory relief in accordance with 49 CFR § 390.25. This notice continues and extends the relief granted in Emergency Declaration 2020-002 as modified on June 15, 2020 and August 15, 2020 through February 28, 2021 and expands the relief to include the transportation of vaccines and medical supplies and equipment related to the prevention of COVID-19, subject to the restrictions and limitations set forth herein. This expansion and extension of the modified Emergency Declaration addresses national emergency conditions that create a need for immediate transportation of essential supplies, and provides necessary relief from the FMCSRs for motor carriers and drivers. By execution of this expansion and extension of modified Emergency Declaration No. 2020-002, motor carriers and drivers providing direct assistance in support of relief efforts related to the COVID-19 public health emergency are granted emergency relief from Parts 390 through 399 of the FMCSRs, except as restricted herein. Direct assistance means transportation and other relief services provided by a motor carrier or its driver(s) incident to the immediate restoration of essential services (such as medical care) or essential supplies related to COVID-19 during the emergency. The expansion and extension of the modified Emergency Declaration No. 2020-002 provides regulatory relief for commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to COVID-19 and is limited to transportation of (1) livestock and livestock feed; (2) medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19; (3) vaccines, constituent products, and medical supplies and equipment including ancillary supplies/ kits for the administration of vaccines, related to the prevention of COVID-19; (4) supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectants; and (5) food, paper products and other groceries for emergency restocking of distribution centers or stores. Direct assistance does not include routine commercial deliveries, including mixed loads with a nominal quantity of qualifying emergency relief added to obtain the benefits of this emergency declaration. Emergency Declaration Restrictions & Limitations By execution of this expansion and extension of the modified Emergency Declaration No. 2020-002, motor carriers and drivers providing direct assistance to the national emergency are not granted emergency relief from, and must continue to comply with, the following Federal Motor Carrier Safety Regulations and conditions: 1. 49 CFR § 392.2 related to the operation of a commercial motor vehicle in accordance with State laws and regulations, including compliance with applicable speed limits and other traffic restrictions. 2. 49 CFR § 392.3 related to the operation of a commercial motor vehicle while a driver’s ability or alertness is so impaired, (Continued on page 13)

or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the motor vehicle. 3. Motor carriers shall not require or allow fatigued drivers to operate a commercial motor vehicle. A driver who informs a carrier that he/she needs immediate rest shall be given at least ten consecutive hours before the driver is required to return to service. 4. 49 CFR §§ 392.80 and 392.82 related to the prohibitions on texting while driving and using a hand-held mobile telephone while driving. 5. A motor carrier whose driver is involved in a crash while operating under this emergency declaration must report any recordable crash within 24 hours, by phone or in writing, to the FMCSA Division Office where the motor carrier is domiciled. The carrier must report the date, time, location, driver, vehicle identification, and brief description of the crash. 6. Nothing in the Emergency Declaration or this expansion and extension of the modified Emergency Declaration shall be construed as an exemption from the controlled substance and alcohol uses and testing requirements (49 CFR Part 382), the commercial driver’s license requirements (49 CFR Part 383), the financial responsibility (insurance) requirements (49 CFR Part 387), the hazardous material regulations (49 CFR Parts 100-180), applicable size and weight requirements, or any other portion of the regulations not specifically exempted under 49 CFR § 390.23. 7. Motor carriers or drivers currently subject to an out-of-service order are not eligible for the relief granted by this declaration until they have met the applicable conditions for its rescission and the order has been rescinded by FMCSA in writing. 8. Direct assistance terminates when a driver or commercial motor vehicle is used in interstate commerce to transport cargo or provide services that are not in support of emergency relief efforts related to COVID-19 or when the motor carrier dispatches a driver or commercial motor vehicle to another location to begin operations in commerce. (49 CFR § 390.23(b)). Upon termination of direct assistance to emergency relief efforts related to COVID-19, the motor carrier and driver are subject to the requirements of 49 CFR Parts 390 through 399, except that a driver may return empty to the motor carrier’s terminal or the driver’s normal work reporting location without complying with Parts 390 through 399. When a driver is moving from emergency relief efforts to normal operations a 10-hour break is required when the total time a driver operates conducting emergency relief efforts, or a combination of emergency relief and normal operations, equals 14 hours.
In accordance with 49 CFR § 390.25, this expansion and extension of the modified Emergency Declaration No. 2020-002 is effective at 12:00 A.M. (ET), December 1, 2020 and shall remain in effect until 11:59 P.M. (ET), February 28, 2021, or until the revocation of the Presidentially declared COVID-19 national emergency, whichever is sooner.

Eighteen Companies with Outstanding Safety Records Now Eligible for Two Grand Prizes Alexandria, Virginia: The Truckload Carriers Association (TCA) and sponsor Great West Casualty Company have named 18 division winners in the 45th Annual TCA Fleet Safety Awards competition. These awards identify trucking companies which have demonstrated an unparalleled commitment to safety. The top three winning companies in each of six mileage-based divisions had the lowest accident frequency ratios per million miles, annually. “TCA is immensely proud of the work our members do each and every day to improve safety,” said TCA President John Lyboldt. “In this year of so many unique challenges, these Fleet Safety Award winners have found a way to not only keep their employees protected from COVID-19, but also go above and beyond to improve safety on our highways.” The 18 division winners are now invited to compete for one of two grand prizes – one for carriers with a total annual mileage less than 25 million miles, and the other for carriers with mileage greater than 25 million miles. Grand prize winners will be announced at TCA’s 2021 Annual Convention, April 17-20 at the Wynn Las Vegas Resort. How to stop the flu from spreading in your workplace Gear up for cold and flu season with ready-to-use resources.
If the coronavirus has taught us anything, it’s that, no matter how healthy you are, airborne illnesses are highly contagious and spread very quickly. Whether your employees are heading back to the office, or continue to work remotely, there’s no escaping the spread of germs. You may have employees who are parents of young ones that contract or spread illness through a simple cough or sneeze. And, let’s not forget about the individuals who still lack proper hand sanitation (yes, people still don’t wash their hands), and when this all comes together, the cold and flu season will continue to take a toll on businesses in the United States. Employees spend one-third of their life working, which is why it’s essential for employers like you to find solutions, and provide education to employees on combating the cold and flu in (and out) of the office. It might just save your company’s bottom line, and your employees’ overall health and productivity.

Without Truckers, There Wouldn’t Be a Holiday Season

While most people look forward to taking time off this holiday season, truckers will be preparing for their busiest time of the year. Billions of packages and millions of miles will be added to the clock as truckers kick things into high gear to make the holidays happen. But, despite the countless hours truckers will spend to bring the holidays together for the rest of us, many of us don’t consider or fully understand what it takes to get things together for our family celebrations. Oftentimes, truckers work 7 days a week throughout this season in order to get everything done. How Truckers Spend The Holidays: Each year, during the holiday season we look forward to spending time with our families enjoying Thanksgiving dinner and spending Christmas together. We busily and excitedly order new decorations to light up the tree and deck the halls with our own personal touch. Many of us order a multitude of gifts online from the warmth and comfort of our homes. We prepare the shopping list for our dinner and dessert menus and head to the store where the freezers and shelves are stocked with everything we need to make our traditional holiday feasts; but how often have you stopped to consider that all of that was made possible by truck drivers? While we enjoy our vacations, truckers will spend their holiday season on the road driving for tens of hours per day, oftentimes great distances away from any family or friends. Holiday season can be a very lonely time for the profession. Truckers Deliver Our Food and Gifts: During the Thanksgiving and Christmas seasons truck drivers clock thousands of miles and hundreds of hours every holiday season so we can spend time with our families opening gifts, eating delicious food and making memories. Throughout this hustle bustle time of year, with each of us focusing on our own agendas and deadlines, most likely it doesn’t even enter our minds as to what was involved to get that package delivered to our doorstep on time. We don’t very often think about the miles that truck drivers drove in order to deliver the 46,000,000 turkeys that are eaten at Thanksgiving dinner every year, plus the hams and various other foods that we buy. This doesn’t even begin to consider the other seasonal products we wouldn’t get without truckers either. The fresh Christmas trees that get shipped across the country, the faux ones that get shipped internationally, and the billions and billions of dollars worth of gifts that we send to one another to remind our family members and friends that we care all have to be handled by multiple truckers in order to reach their destination. From manufacturer to seller to recipient, countless truck drivers will be involved in any single gift exchange—from long-haul transporters to your local delivery driver who brings it directly to your doorstep just in time for the Christmas season. Truckers Spend Holidays Alone So You Don’t Have To: Many truck drivers do not get the luxury of spending the holidays with their families. Quite often they are working to get deliveries made on those days and there are other instances where the truck drivers have plans to be home, only for bad weather to cause delays and stranding them for hours and oftentimes miles away from home. Truck drivers from all around share stories of how they celebrate Christmas with families on alternative days or by a phone call, face time or Skype in order to participate in some way. One gentleman shared that over the course of twelve years, he had been at home only once for Christmas. While many people can relate to being unable to travel or visit family during the holidays, having a job that puts you on a road leading even further away from them—all on your own—can make things extra difficult. Most drivers admit that it is difficult being away from families and when small acts of kindness are shared, it makes the job a lot easier. Over 30,000,000 packages Delivered on Black Friday: While it is a part of the job they do, that doesn’t mean Black Friday is an easy part of the year for them. In 2017, in an effort to keep up with delivery demands, UPS mandated package drivers work seventy-hour weeks to accommodate for the daily delivery of 30,000,000 packages, which equates to 750,000,000 within the twenty shipping days prior to Christmas. Long-haul truckers also take on extra pressure during the holiday season and in the weeks leading up to it as manufacturers prepare for increased sales and stores work to increase their stock. From bringing in new arrivals for the new year to bumping up inventory for hot items to shipping items off to customers, the entire trucking industry sees an uptick in activity. Obviously, this makes it one of the busiest times of the year and many companies have to supplement their year-round labor by hiring seasonal and part-time staff who can make up for any extra work. With that said, there is still a huge shortage of truck drivers and the industry often faces a challenge with the ever-increasing demand of our consumer-driven economy. Show Some Appreciation - A Little Goes A Long Way: It only takes a little from us to mean a lot to them. Other stories that are shared include the times when strangers stop at the truck stops to give Christmas cards and care packages to the drivers, or parents and their kids, sharing a life lesson in the important act of giving by knocking on the doors of the parked trucks doors and gifting them a cupcake, a pair of gloves, Christmas candy or a pen and paper. It doesn’t take much at all. Some truck stops make a special meal to help comfort the drivers and provide them with a taste of home. You can also help spread some holiday cheer to these important industry workers who make it all happen. While they may not be wearing elf ears or a santa hat, these drivers truly are the ones driving Christmas and all the holiday traditions your family enjoys. A simple act of giving, whether it’s for the delivery driver who comes knocking at your door or the next trucker you see stopped at the corner station, can go a very long way in helping everyone feel welcomed and joyful this season. Truckers new and old alike often take to the internet to share such simple acts of kindness that brighten their day.
