As you may remember in last months column, I referred to a summer road trip of 3,300+ miles in my personal vehicle. Driving through and returning through nine states to the Southeast coast, I encountered many crazy, risktaking drivers. It is “exciting” to maneuver a semi among such drivers, but at least in a semi, I am more visible to others. Driving a full-size pickup truck…less visible, apparently. I was on I-40, six lanes, 70 mph, topping a small hill, when below was a van completely STOPPED in the middle lane. The van was displaying no hazard lights or blinkers. As I approached it with much caution, the van turned left across two lanes of moderately heavy traffic toward the exit ramp! WOW! I understand missing an exit, but why not proceed to the next exit and double back? I’m grateful there was no dangerous/deadly pile up from that van driver’s incompetence. Are we allowing ourselves to be distracted too often while steering an 80,000# vehicle at high speeds? Especially in a semi, I implore you to concentrate, concentrate, concentrate on your responsibility to keep you safe, your equipment, your load, and others. Your cell phone can be answered a few minutes later; your dispatcher’s call can be returned from the next exit; your canine companion can be calmed at the next rest area. On a much different subject, the Search Committee of SDTA and SDADA has been successful in finding an excellent successor to our Associations’ President, Myron Rau. His successor is highly qualified and experienced; eager to learn even more about our industries; very well suited for the job. Attend the SDTA Convention on September 8, 9, 10, to meet and introduce yourself to our newest leader. It’s been over 20 years since our Associations underwent this process, and I’m grateful for the stellar job done by the Search Committees, headed by Tom Murphy of Parker Transfer. Thanks to you all! President’s For several years, the trucking industry has been encouraging Congress to repeal the

Federal Excise Tax (FET) on heavy duty trucks. I am dedicating my column this month with a status report regarding this effort.

The American Trucking Associations praised the introduction of the Modern, Clean, and Safe Trucks Act of 2021 by Senators Todd Young (R-Indiana) and Ben Cardin (D-Maryland). The bipartisan legislation would repeal the 12% federal excise tax on heavy-duty trucks, which currently adds approximately $22,000 to the cost of a new tractor-trailer.

“The federal excise tax on heavy trucks is a relic from the First World War that’s now serving to keep cleaner, safer trucks off of our nation’s roads today,” said Chris Spear, president and CEO of American Trucking Associations. “By repealing this antiquated tax, Congress can deliver a win for the environment, highway safety, manufacturing jobs and supply-chain efficiency. We thank Senators Young and Cardin for their bipartisan leadership in advancing a common-sense solution to the benefit of American truckers and the motoring public.”

Although technological advances have made the latest tractor-trailers cleaner and safer than ever before, the FET creates a disincentive for motor carriers to modernize their fleets by placing a punitive surcharge on investments in new equipment. As a result, the average age of a truck on the road today is nearly ten years old. Over the past two decades, cleaner fuel and engines used in new trucks have combined to reduce nitrogen oxide emissions by 97% and particulate matter emissions by 98%. Since 2010, more fuelefficient diesel trucks have saved 101 million barrels of crude oil and reduced CO2 emissions by 43 million tons. Life-saving, driver-assist safety technologies that weren’t widely available or effective a decade ago, such as automatic emergency braking, forward collision mitigation and electronic stability technology, are now offered in new models. The FET was enacted by Congress in 1917 at three percent to raise revenue for World War 1. Today it stands at 12%–making it the highest excise tax the federal government levies on any good across the entire economy. The bill calls on Congress to find more reliable and consistent revenue streams to sustain the Highway Trust Fund. “Funding our national infrastructure need not come at the expense of highway safety or environmental health. Our industry will continue to advocate for equitable and sustainable user fees that align the goals of safer roads, cleaner air and a growing economy,” said Spear. A 2020 survey by American Trucking Associations found 60% of fleets would be either somewhat likely or very likely to buy additional trucks and trailers beyond currently scheduled purchase if the FET were repealed.

Attention Log Haulers USDA Announces Pandemic Assistance for Timber Harvesters and Haulers USDA Office of Communications - Washington, July 20, 2021 The U.S. Department of Agriculture (USDA) is providing up to $200 million to provide relief to timber harvesting and timber hauling businesses that have experienced losses due to COVID-19 as part of USDA’s Pandemic Assistance for Producers initiative. Loggers and truckers can apply for assistance through USDA’s Farm Service Agency (FSA) July 22 through Oct. 15, 2021. The Pandemic Assistance for Timber Harvesters and Haulers program (PATHH) is administered by FSA in partnership with the U.S. Forest Service. The Consolidated Appropriations Act, 2021, authorized this critical assistance for the timber industry. Timber harvesting and hauling businesses that have experienced a gross revenue loss of at least 10% during the period of Jan. 1 and Dec. 1, 2020, compared to the period of Jan. 1 and Dec. 1, 2019, are encouraged to apply. “USDA’s Pandemic Assistance for Producers initiative promised to get financial assistance to a broader set of producers and today’s announcement delivers on that promise,” said Secretary Vilsack. “On top of the existing challenges associated with natural disasters and trade, the pandemic caused a major disruption for loggers and timber haulers including lack of access to wood processing mills. This industry plays a critical role in our nation’s economy and we are proud to support these hard-working loggers and truckers as they get back on track.” “Like many facets of the agriculture industry, the logging industry has experienced its share of financial hardships throughout the pandemic,” said FSA Administrator Zach Ducheneaux. “We’re happy to work with the U.S. Forest Service to develop this new program to provide critically needed support.” “We’ve heard from loggers and truckers whose livelihoods were significantly impacted this past year by the COVID-19 pandemic, and we are pleased that USDA can help alleviate some of the financial burden,” said Forest Service Chief Vicki Christiansen. “I encourage those logging and log-hauling businesses hardest hit by the pandemic to learn more about the assistance offered through this new program.” Program Details: To be eligible for payments, individuals or legal entities must be a timber harvesting or timber hauling business where 50% or more of its gross revenue is derived from one or more of the following: • Cutting timber. • Transporting timber. • Processing of wood on-site on the forest land (chipping, grinding, converting to biochar, cutting to smaller lengths, etc.). Payments will be based on the applicant’s gross revenue received from Jan. 1, 2019, through Dec. 1, 2019, minus gross revenue received from Jan. 1, 2020, through Dec. 1, 2020, multiplied by 80%. FSA will issue an initial payment equal to the lesser of the calculated payment amount or $2,000 as applications are approved. A second payment will be made after the signup period has ended based upon remaining PATHH funds. The maximum amount that a person or legal entity may receive directly is $125,000. Applying for Assistance Loggers and truckers can apply for PATHH beginning on July 22 by completing form FSA-1118, Pandemic Assistance for Timber Harvesters and Haulers Program application, and certifying to their gross revenue for 2019 and 2020 on the application. Applications can be submitted to the FSA office at any USDA Service Center nationwide by mail, fax, hand delivery, or via electronic means. As USDA looks to long-term solutions to build back a better food system, the Department is committed to delivering financial assistance to farmers, ranchers, and agricultural producers and businesses who have been impacted by COVID-19 market disruptions. For three years she enjoyed being a lifeguard at the Scotland pool during the summer and a teacher’s assistant at the Scotland Youth Center after school program during the school year. IRS reminds heavy vehicle owners of Aug. 31 highway use tax return deadline For video on How to File Form 2290 go to: https://www.youtube.com/watch?v=P1uFwQRi02M WASHINGTON — The Internal Revenue Service reminds those who have registered, or are required to register, large trucks and buses that it’s time to file Tax Year 2021 Form 2290, Heavy Highway Vehicle Use Tax Return. The deadline to file and pay is Aug. 31, 2021, for vehicles used on the road during July 2021. The highway use tax applies to highway motor vehicles with a taxable gross weight of 55,000 pounds or more. Taxpayers unsure if they must file can use the IRS online tool, “Do I Need to Pay the Heavy Highway Vehicle Use Tax?” The question-and-answer format helps owners determine if they are required to pay the highway use tax. The “Understanding Form 2290 – Heavy Highway Vehicle Use Tax” recorded webinar is also available. Ready to file? Gather information • Employer Identification Number (EIN) – not a Social Security number. For those who do not have one, it can take about four weeks to establish a new EIN. See How to Apply for an EIN. • Vehicle Identification Number and taxable gross weight of each vehicle. How to file • E-file is required when reporting 25 or more vehicles on Form 2290 and is the preferred filing method. The IRS provides a watermarked Schedule 1 within minutes after accepting the electronically filed return. • Visit IRS.gov for a list of IRS-approved e-file providers. • On paper. Complete and mail Form 2290. Expect to receive the stamped Schedule 1 within 6 weeks after the IRS receives the form. See Tax Year 2021 Instructions for Form 2290 for the correct mailing address. How to Pay • Pay by credit card or debit card. • Electronic funds withdrawal can be authorized as part of the e-file process. • Electronic Federal Tax Payment System; requires advanced enrollment. • Check or money order using Form 2290-V, Payment Voucher, mailed to: Internal Revenue Service, P.O. Box 932500, Louisville, KY 40293-2500. Vehicle registration date The filing deadline is not tied to the vehicle registration date. Regardless of the vehicle’s registration renewal date, taxpayers must file Form 2290 by the last day of the month following the month in which the taxpayer first used the vehicle on a public highway during the taxable period. Gene Tooley

May 29, 1938 - July 24, 2021

Gene Tooley, age 83 of Sioux Falls, SD passed away peacefully at home on Saturday, July 24, 2021 in Sioux Falls. From the age of 8 years old his dream was to drive truck for Wilson Truck Company. Gene would go each morning to highway 77 in Beresford and wait for the Wilson truck drivers to go past and honk before hustling to school. There were many tardies received because of that! Upon returning from his service in the Army he applied and was told he was too small to work for Wilson. Never one to give up he got a job as a package van delivery driver and his ability to do what needed to be done however it needed to be done to get it done caught the attention of the Wilson front office as he delivered packages to the docks one day. They offered him a job on the spot and his dream was fulfilled. Gene continued to work for Wilson Trucking/AllAmerican Trucking/American Freight until the company filed bankruptcy in 1988. In 1983 Gene competed in the South Dakota Truck Roadeo where he took First Place in the Straight Truck Division and was awarded the Rookie of the Year Award. On the national level he competed in Fort Worth, TX where he took 2nd place in the Straight Truck Division. He finished his driving career with ABF, eventually retiring from trucking in 1998. He continued to volunteer with the South Dakota Truck Roadeo and was a trucking instructor with Southeast Area Technical College for a short time as well. After retiring Gene worked in maintenance for the Splitrock Township until health issues forced a full retirement in 2010.
