Christmas comes early for coastal beautification project By DAVE SCHWAB The hard part of beautifying Children’s Pool Walkway — finding the money for improvements — is done, as a good Samaritan has donated the lion’s share of funding to complete the project. Walkway project promoter Phyllis Minick had much to be thankful for the day before Thanksgiving when she called a Nov. 27 news conference to announce that La Jollan Tom Morgan has pledged $200,000 to make the project a reality. “I live in La Jolla, I walk the property a lot and I saw it wasn’t getting done and I wanted it to be completed so we can all enjoy it,” said Morgan, a retired commercial Realtor and banker. “He saw that something needed to be done, and he was appalled at the condition of the sidewalks in this Village, so he stepped forward and said he would like to help us do this,” said Melinda Merryweather, one of Morgan’s friends and neighbors and a walkway improvement supporter. “Two hundred thousand dollars is literally the rest of the money we need to complete the project.” Minick said a plaque inscribed with the names of Morgan and SEE WALKWAY >> PG. 3

Beach access proponents get decision in their favor, but battle likely far from over A 30-plus-year battle over historic beach access at Princess Street in La Jolla Shores may finally be over. Or is it? “We’re studying all of our legal options and an appeal is one of those options,” said Ure Kretowicz, owner of a blufftop property at 7957 Princess St., following a Nov. 18 Superior Court judgment by Judge Judith F. Hayes in Kretowicz vs. California Coastal Commission. Hayes ruled against Kretowicz, who contended in his lawsuit against the state regulatory agency that historic beach access never existed — and therefore there was no requirement to restore it — on his Princess Street property. Excerpts from Judge Hayes’ decision: “… There was a historical use by the public of access to the ocean
through the subject property … the California Coastal Commission acted appropriately and the 1979 revised permit and its public-access condition are enforceable. … The public access condition runs with the land and the failure to record the dedication does not extinguish the public’s right to access. … In 1979, a revised permit was issued including the public easement requirements. Even though Jane Baker (the previous owner) did not sign the revised permit she was required to comply with its requirements.” Kretowicz said he is weighing his options following the judge’s decision. “The good news is we aren’t forced to make a decision immediately. We have a little bit of time to make that decision on which [legal] direction is the best for us to

take,” he said. “An appeal would be one of those viable alternatives.” Kretowicz is steadfast in contending there “never was an easement recorded” on the Princess Street property as it changed hands over the years, adding “it (access) hadn’t been used in more than 30 years. If this was a high-use easement, wouldn’t there have been a public outcry 10, 15, 20 years ago?” Kretowicz said the issue of a

Ciani, an architect whose main residence is no longer in La Jolla, but who still owns property there, said the Superior Court decision speaks for itself. “To all your causes of action, the answer is no. That’s what the judge said,” said Ciani. Kretowicz’s strategy throughout the long and arduous legal battle, Ciani contended, has been to “postpone hearings, drag this out even longer. They (Kretowicz) tried every statute of limitations, every

Local WWII veteran pens recollections about life, love and liberty in the 20th century By SHARONANN HAMILTON Born in 1927, Jessie Lee Russell is part of a generation of American men and women who came of age during the Great Depression, were personally impacted by World War II and experienced tremendous growth and change in our country and in their lives. In his book,
“Doing What Comes Natcherly,” he shares his story with candor, honesty and humor, admitting he was often amazed he lived and prospered through such challenging times. “When I am gone, all my lessons will be gone,” said Russell. “I am
war and politics, love and loss. “Everyone in America was involved in the [war] effort,” he said. “For example, people saved their cooking grease in cans and once a week a big truck came into town to collect the grease for the munitions factory. All goods were rationed: gas, tires and shoes. There was no TV, only radio and newsreels at the movie house. Today there is no ceremony when soldiers are shipped home in coffins. To help England, the United States made a deal called the Lend Lease Program. We loaned England many ships to escort their lifeline convoys, which were being sunk by the German U-boats. Meanwhile, Japan was warned by President Roosevelt to end its conquest of China. The situation finally exploded on Dec. 7, 1941 when Japan bombed the Hawaiian Island of Oahu, including all the military bases and our giant naval base at Pearl Harbor. Most Americans knew about Hawaii but had never heard of Pearl Harbor. The next day, the president delivered his message to Congress: “Yesterday, Sunday, Dec. 7, 1941, a day that will live in
heroic sacrifices daily and are not properly recognized or thanked.” Today, Russell is a lifetime member of Lions Club and attends every Wednesday meeting. He is an active member of St. Marks Methodist Church. He walks 30 minutes a day and takes himself out to breakfast several times a week, somewhere on the water. He visits his wife’s gravesite at Ft. Rosecrans National Cemetery and remembers good times, bad times and everything in between. infamy …” And suddenly, we were at war. I was 14 years old at the time. When the news came over the radio, we were visiting with Verne and Uncle Millard, who said, “Well this will be short and sweet.” It was neither. From that day in 1941 until the final surrender of Japan in 1945, the life of every American changed. On the civil front, our industrial might rapidly came to bear, turning out tanks instead of cars and modifying practically every other daily activity we knew. Rationing was immediately put into force. Gasoline, tires, shoes and all types of foods, including meats, sugar and canned goods were rationed. An office of price administration was established, controlling prices and issuing ration books. Gasoline rations were based on activity or business.”

Walkway landscape architect Jim Neri said Morgan’s donation to finish the project didn’t come as a complete surprise. “We knew there was someone out in the community — several donors, including one major donor — who would see the value of the improvements that we’ve designed and would step forward for the betterment of their community,” Neri said. Walkway improvements are to include vastly improved pedestrian flow along Coast Walk, double-seat walls similar to existing ones at Shell Beach and Seal Rock, the planting of shade trees, repairs to the existing gazebo, the addition of interpretive/historical/educational signage near the new lifeguard station, use of native plants on the bluffs to control erosion and restricting vendor “free speech” tables to a single location. Demolition of the old Children’s Pool Lifeguard Tower is complete and grading work, including installation of utilities — water, sewer, electric — is nearly finished. Jihad Sleiman, city engineer and project manager for the lifeguard tower, said the city hopes to pour the concrete slab for public restrooms on the bottom level of the pool before work stops for the harbor seals’ pupping season beginning Dec. 16.
Man gets trial in La Jolla gallery holdup A judge has ordered a 22-year-old man to stand trial for three robbery counts in a Sept. 18 incident at the Carlton Gallery in La Jolla where the bandit was

pepper sprayed by the owner. A Feb. 19 trial date was set for Camron Dale Cash, who is charged with robbing three workers at the gallery at 1144 Prospect St. He has pleaded not guilty. A police detective and three others testified at the preliminary hearing conducted by San Diego Superior Court Judge Michael Washington, according to court records. “Work is only stopping during pupping season and will resume June 1,” Sleiman said, adding the city’s getting a waiver for work on completing the tower to proceed unimpeded through summer 2014. “We hope to have the core of the building (lifeguard tower) up, all three stories, and all the heavy equipment should be out of there by Dec. 31, 2014,” Sleiman said. Neri said preparation of construction drawings to improve the walkway, which have been on hold while funding was secured, will now move forward with the project likely being put out to bid. He said the current Children’s Pool lifeguard tower contractor will be included in the mix. Whoever ultimately is awarded

the job, Neri said the idea will be to reconfigure the Coast Walk space, both in and around the sidewalks. “The idea will be to create some extra sidewalk width going to a minimum of 11 feet,” Neri said, noting existing sidewalk space is a little as 4 ½ feet in some sections. “There will be no loss of parking, though parking will be reconfigured,” Neri added. Neri said the goal of walkway improvements will be to increase traffic flow on land, mimicking what happens offshore. “The idea is to make traffic flow smoothly through that space on land in much the same way currents drift in the ocean,” Neri said.

La Jolla doctor sees the potential in every infertility case When a couple is told their chances of conceiving are low, the resulting psychological effects can be devastating. And yet, if you have cancer, insurance companies, the government, everybody steps up to help you. That’s not true with infertility. It’s considered a cosmetic procedure by most insurance companies, but having a child is a major life goal for a vast majority of men and women, and when you take that away, it’s a tremendous loss.” Part of the difficulty of an infertility diagnosis, Wood said, has to do with the isolation felt by many couples. Every child they see, he said, can be a sign of something they don’t have, something missing from their life, and the result-
ing depression can be very difficult to relate to family and friends. But Wood is in the business of hope. Each patient that walks through his doors presents a new challenge to be overcome. He looks at each one as a success story waiting to happen. “The truth is with modern fertility treatments, there is no reason that anyone cannot have a baby,” he said confidently. “I have never met anyone who couldn’t. Some might give up before they do, but if you walk in here and tell me you want to have a baby, I tell you you’re going to have one.” Wood is able to make such a sweeping statement mostly because of enormous strides made in fertility research in recent years. In the past, he explained, invitro fertilization was used almost exclusively for women who fallopian tubes were blocked (it can now be used to combat a number of issues resulting in infertility). Men, meanwhile, were out of luck, Wood said, if they had a low sperm count. Now, with the advent of intra-cytoplasmic sperm injection (ICSI), nearly any man can be a biological father. Additionally, egg donation meant any woman with a normal uterus could bear a child, while the rise of surrogacy

gave those without a uterus hope. “This field is changing constantly,” Wood said. “With many fields of medicine, change is slow. But with this field, there are so many remarkable things that have happened over the last 30 or 40 years, and it’s just a question of what’s coming next.” Even more recently, innovations like egg freezing have “dramatically changed the field,” Wood said. A new technique known as vitrification has made it increasingly easy to freeze a woman’s eggs. “It used to be that, unless a woman wanted to have a child on her own, she had to wait until she found the right partner,” he said. “Many would end up with no chance of having a biological child or with increased risks. Now women who might not have the right partner or who feel it’s not the right time in her life can come in and freeze her eggs. Her biological clock is frozen the day she freezes those eggs, which really frees her up. If you freeze your eggs when you’re 33, they stay 33 no matter how old you are when you decide to implant them. The chronological age of the woman doesn’t matter — the age of the egg is what matters.” Other advances have been made
IN LOVING MEMORY: HARRIET FLORENCE DAUM Life-long beach resident Harriet Florence Daum passed away in the morning of November 21, 2013 at the age of 91. Born at home on Narragansett Street in Ocean Beach in 1922 to Harry and Lillie Dunn, she moved to La Jolla as a teenager. Harriet was the oldest of three children; sister Dorothy and brother George. As a child of the depression, she remembered “having to eat” a continuous plethora of abalone, lobster, and fish harvested by her father off of the Point Loma and La Jolla reefs, supplemented by wild mushrooms picked in the La Jolla hills and vegetables from their large garden. Harriet graduated from La Jolla High School in 1940 and was always proud to be a Viking. After high school she worked at Scripps Institute of Oceanography as a secretary for Harald Sverdrup’s office and typed many manuscripts for some of the forefathers of Scripps including Carl Hubbs, Walter Munk, Claude ZoBell, Roger Revelle, and others. Harriet married William Marshall Daum of National City in 1948 at La Jolla Congregational Church and then settled in Crown Point for the remainder of her life. She was a member of Christ Lutheran Church (Cass St) for over 60 years, Pacific Beach Women’s Club since 1955, and a long-time volunteer for Meal-onWheels. Harriet was quite the adventurer, from the 1924 train ride to visit family in rural Illinois to the many family vacations in their small travel trailer after marrying “Bill”. They camped and fished throughout the most beautiful areas in the West. After their only child David was born in 1952, Harriet settled into being a homemaker in their Crown Point home, chauffeuring David and his friends to the many local activities of the time, and involvement in the local Pacific Beach community. In the late 60’s, Harriet re-joined the workforce and became the secretary/office manager for Lucky Line Products in Clairemont, where she had a rewarding career. Harriet was an accomplished artist and sold many of her paintings. In her later years, she enjoyed getting her hair done by Viet in the Cass St. salon, helping with the church’s newsletter, attending woman’s club meetings, and visits from David and family. Harriet is survived by husband William and sister Dorothy of Pacific Beach, son David and daughter-inlaw Lisa of Fairbanks, Alaska and grandchildren Laura (Boise, Idaho) and Logan (Washington DC). A visitation and service to celebrate Harriet’s life was held at El Camino Mortuary-Pacific Beach (4710 Cass St) on Friday, November 29. In lieu of flowers, Harriet has requested donations be made to Christ Lutheran Church Memorial Fund (4761 Cass St, San Diego, 92109).

Comprehensive testing of embryos has drastically reduced the rate of failed embryo implantations, as the tests weed out embryos with minor problems that might prevent them from “sticking” in the woman’s uterus. Wood’s clinic, meanwhile, is perhaps the first in San Diego to use the practice of time-lapse photography to monitor embryos through their various stages, thus giving a further glimpse into the health of embryos and making the process that much more efficient. “It used to be that you would put the sperm and egg together. You come back a while later and see they’ve fertilized,” Wood said. “But
you don’t want to take them out too often, so you come back after a few days and look at it again, and one [embryo] might look good and another bad. Then you come back after another day and it’s reversed — the one that looked bad now looks good. With time-lapse photography, we see the whole picture. All kinds of bad decisions were being made about which embryos to put in, because there are signs you never see. Now, we see them go through these strange stages that you would have to just be lucky to see before, and it could mean the success or failure of the embryo.” His clinic, Wood said, is exceptional in the industry for more than just time-lapse photography.
Many invitro clinics operate as “mills,” he said, churning out as many patients as possible. And he should know — his own clinic, when he started out 20 years ago, was just such a mill. When he opened his practice, he had no patients. But within 18 months, his was one of the largest clinics in the area. He was performing upward of 350 IVF cycles a year, and feeling like he didn’t know any of his patients personally. I wanted to take care of every patient really well, just as I wished someone had done with my mother.” Wood downsized his patient load and adopted a policy of treating patients like family. Now his facility is, by design, a “boutique size” clinic. The concept seems to
be working. One wall of Wood’s reception room boasts a huge world map, with pins stuck in locations all over the globe. They represent, Wood said, the people who have had babies with the help of The Reproductive Sciences Center. The pins are present on every continent except Antarctica. “The five millionth baby from IVF and fertility treatments was recently born,” Wood said. “That’s pretty amazing. That’s a lot of dreams fulfilled. There has been a striking change in the practice of infertility from when I started. It’s true that no matter what you do, there’s no 100 percent chance, but my goal is that no one leaves here without a baby. That’s what matters to me.”

The La Jolla High girls’ varsity tennis team had another great season this year. The team’s record of 17-6 for the season placed it No. 1 in the Western League. It was seated second place in CIF Div. III and made it to the third round, where it narrowly lost 8-10 to The Bishop’s School. The varsity team has not lost a Western League match in four seasons, a 40-league match winning streak. Coach Lisa Shih did an out-
standing job building and coaching the team again this year. “I was fortunate, yet again, to have a great group,” she said. “Although we came up short this season, there is no other team out there I would rather coach than those 13 girls.” A big congratulations goes out to Colleen Mellinger and Taylor Mohrdardt for making it to the CIF individual doubles finals. — Staff and contribution

Thornton was the honorary chairwoman of this red-carpet gala. Celebrity TV personality Amanda Baker was mistress of ceremonies, while Lena Lewis gave the proclamation presentation. Auctioneer Shawn Parr headed up the live auction, which began with

Arts & Entertainment Another box complete La Jolla High School’s Splatter! Art Club recently painted another electrical box in Pacific Beach near Belmont Park. For this box, club members tackled the theme of roller skates. With the help and instruction of club president Stephanie Foster, vice president Kaitlin Wheeler and club advisor Jane Wheeler, a beautifully painted box was collaboratively painted and complete within five hours. Each club member took a different approach to his or her own individually themed roller skate. Maddie Bolinger decided to add a lot of color and had a vibrant rainbow coming out from the back of the roller skate. Similarly, Emma Willis added lots of bright colors to her 1970s-

themed roller skates. Charlie Mann used his artistic abilities to create an abstract pair of roller skates very different from the rest. Foster took a more graphic approach by adding wings and flames, while Wheeler added a touch of aboriginal art to create her roller skate. In the end, all the different types of artwork flowed perfectly to create a masterpiece. However, this team of talented artists isn’t finished yet. The Splatter! MARTIN LAWRENCE GALLERIES LA JOLLA’S Nov. 15 event benefiting the Challenged Athletes Foundation was a great success, said event organizers. More than $3 million worth of art was on display, including some of the finest work by Marc Chagall, Andy Warhol and Picasso. More than 100 guests attended the event that featured special guest speaker Bill Walton and Padres sportscaster Dick Enberg. Themed “The Art of Giving Back,” the event raised funds for CAF through a raffle prize with a Chagall lithograph going to the lucky winner. Combined with Martin Lawrence La Jolla’s efforts at the Peers Network Gala in September, as well as the gallery’s booth at the CAF 20th anniversary event at La Jolla Cove in October, the Nov. 15 event added to a total of $14,500 that Martin Lawrence Gallery was able to donate to the foundation. The La Jolla Playhouse recently opened a really big new show with a deceptively small name. Although it’s called “Side Show,” it’s actually a main attraction. The title refers to the play’s leading ladies, Violet and Daisy Hilton (convincingly portrayed by Broadway favorites Erin Davie and Emily Padgett, respectively). As conjoined twins, they share more than a birthday — they’re very well-connected (joined at the hip, in fact) and as the play begins, they are one (or two?) of the attractions in a carnival freak show. (Political correctness, for whatever it’s worth, hadn’t been invented yet.) “Side Show” is based on the true-life story of the Hilton twins, born in 1908 England. The Playhouse production is a re-imagined version of the 1997 musical of the same

The best time to establish a support network for your parents is BEFORE they need it. Here’s a story that is all too familiar. I lived far from my parents but we usually talked every day. When I talked to my mother I noticed she really wasn’t giving me a lot of information on their lives but I didn’t think much about it. A neighbor called me one day saying she hadn’t seen my parents out for a walk in a long time but my mother said the weather had just been too cold to go out. She assured me they were fine. Then a few months later I got a call from adult protective services (APS) saying that they had received a call and had found my parents malnourished and dehydrated with the house in total disarray and with rotted food everywhere. I had twenty-four hours to get there and take care of things or they would be placed in a nursing home by the state. I was overwhelmed not knowing how I could immediately be there to assist. The best thing I did was call a geriatric care manager. She assessed the needs of my parents, placed a caregiver into the home that day, talked to my parent’s doctors and A.P.S. and was able to present me with some options when I arrived. That’s what clients are doing at Cardio Barre La Jolla, which promises a “no impact” comprehensive workout in one hour. “Everyone wants a dancer’s body, so we created this workout that incorporates those tech-
niques for everybody,” said Cristiana Jebran, owner of the fitness studio at 7580 Fay Ave. “It has no impact. That’s the greatest part. You do weight training, isolated muscle groups, cardio.” The program, said instructor Amber Gallacher, “gets your heart rate up there running high without hurting your joints.” “It’s safe,” she said. “You’ll be breathing heavily. It’s a great cardiovascular workout. It’s about endurance, toning and stretching.” Class sizes are central to Cardio Barre’s appeal. “It’s a small-group class so
light. It smells nice. There’s a great sound system and you get to sweat.” Cardio Barre, which began in Los Angeles and is branching out via franchising, was created by dancer Richard Giorla after a hip injury ended his career. Having witnessed an alarming number of injuries caused by high-impact workouts, as well as seeing a growing number of injured athletes and others struggling to find a less taxing workout for their conditions, Giorla ended up creating his own new exercise modality reflecting his passion for both fitness and dance.

“It’s a combination of ballet techniques, Pilates, and stretching and strengthening exercises using light weights,” said Jebran, a walking testimonial who said she lost six dress sizes utilizing the workout technique. At the fitness studio, everything begins — and ends — at the barre, a stationary traditional ballet handrail. “We start at the ballet barre with a warmup, where we work in true traditional dance positions,” said Gallacher while stretching at the barre. The studio’s program, she said, is “continual fat-burning motion — always moving, always stretching.” Gallacher said there are other muscle-toning exercises performed on the plush, carpeted floor. The Cardio Barre technique is applicable to both genders and any age. “Our age range is 14 to 80,” Gallacher said. “That’s great. All different ages come in here and we work together and we all have fun and it’s good energy motivating each other.” Gallacher has also had couples as clients. “It’s something they can do together,” she said, adding no experience is necessary for anyone to participate. “We have a lot of clients who are coming here to recover from their injuries,” Jebran said. “Some of them have had things like hip replacements. It’s great for them because they don’t have to put pressure on their joints or jump up and down.” Cardio Barre has no long-term membership and classes cost $17 for a single one-hour class, considerably less than the per-hour cost for most other workout classes in the area. “We have a Nieman Marcus product with a Wal-Mart price,” said Jebran.

Real estate must: drive as much traffic as possible to your listing Inside REAL ESTATE Charles Schevker & Natasha Alexander Hello Charles and Natasha. We always read your articles in La Jolla Today. This is our situation. My husband, Clifford, and I are in our 70s. We have lived in the same house in La Jolla for 26 years and now have decided to relocate to Florida so we can be closer to our children and grandchildren. We are excited about our plans, yet apprehensive about selling our house. Generally, what advice do you have for us? — Mary H. Mary, anyone wanting to sell their home must get the answers to these four questions: (1) What is the value of your home in today’s marketplace? (2) What is the action plan to get your house sold? (3) How long will it take to get your house sold? (4) How much money will you put in your pocket? A huge part to answer your question lies in this caution — in our opinion, 95 percent of the reason houses do not sell is because (1)

the wrong agent was hired and/or that agent did not have an aggressive marketing/selling plan, and (2) the list price was set too high. If you heed this caution and take the appropriate action then questions 1 and 2 from the preceding paragraph are answered directly, and 3 and 4 will be answered by default. The marketing plan is crucial. It must be aggressive and have measures to expose the features and benefits of your house to as many potential buyers as possible. It must also drive as much of that traffic to physically view your home. In other words, rather than passively dropping a fishing line into the water and waiting for something to come along, your agent has to dive into the water to get those fish. Does this make sense? The real-estate agent who you hire must have the knowledge and insight into homes that have recently sold in your area, as well as hard data on how the market is performing and whether any pending shifts will impact your expected results. These attributes are critical so that you will have sufficient information and confidence to set your listing price at a point that will attract those buyers who will be driven to your house via the efforts of the marketing plan. Your house is a product for sale, no different than any other consumer product, and you

It is also important to give attention to the physical condition and appearance of your house. Since you have lived in your current home for 26 years, you likely have many fond memories. Last call! Nicks at the Beach closes its doors “Last Call! Thank you Pacific Beach for 18 Great Years” says NicksAtTheBeach.com. Nicks at the Beach is closed for business and a new group is moving in. In a recent lease transaction involving a 5,640-square-foot fully fixturized restaurant building with a Type 47 alcohol license located at 809 Thomas Ave. in Pacific Beach, The Local Group LLC (owned by Mini Desiderio and Paul Huffman) has taken over as lessee. Desiderio also owns a bar in downtown called The Local located at 1065 Fourth Ave. According to the Department of Alcoholic Beverage Control of California, a Type 47 license is described as “on sale general” and “authorizes the sale of beer, wine and distilled spirits for consumption on the premises. [It] authorizes the sale of beer and wine for consumption off the premises. [The facility] must operate and maintain the licensed premises as a bona fide eating place. [It] must maintain suitable kitchen facilities, and must make actual and substantial sales of meals for consumption on the premises. Minors are allowed on the premises.” On a personal note, I wanted to say thank you to Nicks at the Beach (especially to Missy the bartender) for providing my friends and I so many great times over the years, even though I vaguely remember those nights.
Third quarter beach apartment and retail report This year’s third-quarter commercial property report is in and the market has showed no signs of slowing down. Over the course of 2013’s first nine months, apartment transactions are more popular than ever, and large
offices/retail properties have been shifting ownership. There have been 16 apartment transactions totaling more than $35 million. During the same nine-month stretch in 2012, there were 12 apartment transactions totaling nearly $23.256 million. When I asked Dave Andrews of Hendricks Berkadia (a local 10-plus year veteran apartment specialist in Pacific Beach) why the 92109 apartment market so strong, he said, “Investors are looking to diversify into high quality assets in coastal locations in order to minimize risk. Additionally, interest rates have remained low, thus allowing buyers to create positive leverage and maximize their return on investment.” In the nine-month period, there have been 16 retail and office transactions totaling $29,000,000. During the same period in 2012,

prescriptive right under the sun and the judge said, ‘No, you don’t get it.’ That’s huge.” Ciani said he felt previous case law in California “paved the way for this case.” The lesson with the probeach access side prevailing, Ciani said, is that, “If you’re patient, diligent or persistent, at some point you probably are going to succeed.” Ciani also credited the California Coastal Commission for “having a consistent passion to protect public access.” Merryweather, a longtime member of parks and beaches subcommittees who has mapped all of La Jolla’s 50-plus beach-access points, said the land-use issue has been drawn out because Kretowicz failed to
accept the obvious and inescapable conclusion. “It’s astonishing to me that somebody who’s lived with an 8-foot sign in front of their house that said ‘coastal access’ has the audacity to claim he never knew he lived in a house that had a coastal access on it,” Merryweather said. “It’s always been known that [beach access] goes with the land.” Now that the Kretowicz court judgment has been rendered, Merryweather said the next step is to “get somebody to accept the (easement) dedication.” Who could that be? “Maybe an Indian tribe,” answered Merryweather, adding the ultimate objective will be restoration of the easement. “We’ll make it walkable again,” she said.

name. The play portrays the sisters during the Great Depression era being gawked at by curious carnival patrons, where they’re “discovered” by a producer who makes them big stars in vaudeville. The Playhouse’s 500-seat Mandell Weiss Theatre was sold out for opening night. Festivities began with a reception in and around the Play Development Center, decorated carny-style with red-and-black upholstered settees and chairs (some with 6-foot-high backs; some with no backs at all). Handpainted posters hawked fire-eaters, strongmen and other carnival acts. Pamplemousse Grille catered (at no expense to the Playhouse), serving up Jeffrey Strauss’ signature hors d’oeuvres, plus three varieties of Kobe and portobello sliders, pasta, paella and much more. Reception entertainment included aerialists performing on long fabric sashes hung from the ceiling, and an acrobat deftly rolling about in a large metal hoop called a Cyr wheel. Among the guests were director Bill Condon (well known for writing screenplays and directing such films as “Dreamgirls”; “Side Show” is his first stageplay); composer Henry Krieger (he also did “Dreamgirls”); and Michael Kaiser (president of Washington, D.C.’s Kennedy Center for the Performing Arts, where the play will run next June). “Side Show” seemed to captivate the packed house with its plot twists and unexpected surprises. The opening night audience rose for a standing ovation, and since that first performance, ticket demand has been tremendous. After the show, guests met the cast and crew at a lavish dessert reception. The process was repeated three nights later, for the Playhouse’s sixth annual Innovation Night. It’s the Playhouse’s second-largest annual fundraiser (only their formal gala, coming March 29, is bigger). Founded by the recently deceased Duane Roth (to whom the evening was dedicated), the event invites innovation in the biotech, high-tech and clean-tech industries to meet innovation at the theater. Tech industry heavy hitters network big-time here, so the organizers started the sold-out event 30 minutes earlier this year to allow more time for productive meeting and mingling. Ivor Royston, Tim Scott and Don Rosenberg co-chaired Innovation Night. Festivities were much like opening night, but Giuseppe Fine Catering did the food, with a delicious Middle Eastern theme featuring lamb, chicken, scallops and more. The event brought in more than $200,000 to benefit new play development and the Playhouse’s education and outreach programs.
