Short-term rentals ordinance sent back for a rewrite BY DAVE SCHWAB | THE BEACON On Dec. 3 the city Planning Commission “tore up” a proposed new city ordinance on Short Term Vacation Rentals (STVRs) cobbled together following months of public testimony and directed city staff to return Jan. 28 with a new set of proposed regulations. The city ordinance commissioners nixed what would have created a new use category for STVRs

while amending an existing one. Does the increasingly popular practice of renting property in residential areas to short-term vacationers add unwanted noise and trash, reduce parking and create havoc in otherwise placid neighborhoods? Or does it inject excitement and new perspectives, exposing neighborhoods to far-flung voyagers and cultures, benefiting businesses with more customers and providing a badly needed second income to property owners? Regardless of where you stand, the effort to regulate the practice is about to kick into high gear. A draft ordinance that seeks to both define the enterprise and rein in its perceived abuses has had its first hearing by the San Diego Planning Commission. On Dec. 3, the city Planning Commission directed city staff to return to them Jan. 28 with an entirely new set of proposed regulations for Short Term Vacation Rentals. The Ocean Beach Planning Board, which recently sent a letter to District 2

OB PLANNING BOARD CHAIRMAN San Diego City Councilmember Lorie Zapf calling for strict limits on the practice, also discussed the issue at its monthly meeting on Dec. 2. In recent years, online rental services such as Airbnb or VRBO have allowed property owners to rent out their homes and condos to short-term occupants. Predictably, the practice has become especially popular in neighborhoods adjacent to the coast, such as Ocean Beach. Zapf, who has overseen development of the ordinance in her role as chair of the City Council’s Smart Growth and Land Use Committee, favors imposing a minimum stay of 21 days for whole-

home rentals in single-family zones. Her office has stressed, however, the ordinance is still considered a work in progress. Instead of a duration limit, the board has called for placing a 3 percent limit on the number of all city residential units – both in single- and multi-family zones – that could be allowed for use as vacation rentals. “It’s time for Ocean Beach to take a stance,” said board chairman John Ambert before the board voted unanimously to approve the letter at its November meeting. If the ordinance only applies to single-family zones, most of Ocean Beach – where multifamily zones dominate – would go unregulated, Ambert said. Not addressing multifamily zones is “particularly troubling, given the number of renters we have in Ocean Beach,” Ambert said. “The more short-term vacation rentals, the less opportunity for long-term renters. It will exacerbate the affordability of housing.” Without saturation limits, it could become too easy for property owners to turn homes into short-term rentals – displacing families, driving up rents and property values, encouraging real estate speculation and degrading community character, board members said. Some even wondered out loud if the practice may have fueled the need to terminate two teachers at Ocean Beach Elementary School, where enrollment is down more than 15 percent since last year. “What we’re worried about is losing our neighborhoods,” vice chairman Blake Herrschaft said. As for “homesharing,” the practice of renting a room to a vacationer while the owner lives on premises, both Zapf and the board agree the practice should be permitted to continue with minor restrictions. The draft ordinance calls for a limit of two boarders per home at any given time and for the homeowner to provide one parking spot for boarders. In addition to the 3 percent saturation limit – which was inspired by a law recently approved in Austin, Texas – the letter also calls for an annual licensing fee, with the proceeds earmarked for code enforcement resources.

The woman felt threatened when she received strange text messages from someone whom Rosales described as his boss. Rosales was not a legitimate modeling agent, but had advertised as such on Craigslist, according to a San Diego Police detective. Rosales used the same scheme with a second woman, and is alleged to have used Facebook to lure other victims. He met two victims at Starbucks stores in La Jolla and Chula Vista. Rosales was arrested July 31. If he’s convicted, he could face up to 13 years in prison, according to the District Attorney’s Office. He remains in the George Bailey Detention Facility on $300,000 bail.

It's something that gives the woman the best of both worlds. They get the surprise proposal. Cabrillo Isle Marina in Harbor Island is home for hearty souls BY TERRY RATNER | THE BEACON It wasn’t until Bernie Nelson’s 21year-old sister died of an overdose on April 19, 2008, that he began his search for the perfect boat. He was living at home with his mother when the topic turned to sailing, perhaps as a distraction to offset his shock or maybe to feel something other than the enormous wave of grief that surrounded him. Bernie wanted to think about new adventures. He wanted to live life to the fullest and start while he was young enough to enjoy it. When I mention his sister and the circumstances of her death, Bernie says, “It’s complicated and still under investigation, so I’d rather not talk about the specifics.” Then he extends his left arm to reveal a tat. It’s an outline, a stylized representation of her face; wisps of dark hair, big eyes with long lashes, and her name, Brianne Nicole Nelson, tattooed in bold, black letters. He smiles as he flexes and extends his left forearm. Bernie’s mother helped finance his sailboat with a small insurance settlement Brianne had banked before her unexpected death. Within a year after her death, Bernie became the proud owner of the ‘87 Catalina 34-foot sailing vessel (SV) Independence. When I ask about prior sailing experience, he says, “I’d been on smaller Hobie cats but never a large monohull. Our dad used to take us lake boarding in the Sierras and to Catalina on an 18-foot Sea Ray.” Bernie pauses, looks down for a moment. “I don’t think Brianne ever set foot in a boat larger than the Sea Ray. I think she’d love sailing.” After a few sailing excursions around the harbor, Bernie signed up with the American Sailing Association. “It's fairly easy to sail, but I wanted to understand the mechanics and concepts involved with sailing. I was planning to fly to Greece with my mom, charter a bareboat in the Greek islands and captain a sailboat to Mykonos, Naxos and Paros. I needed the knowledge, experience and certification for the trip.”

‘We live in a tiny space and work in cubicles at our office. That gets difficult. We look forward to weekends when we can party and sail.’ – MELISSA VAUGHN Sailing helped ease the pain, but the unexpected death of his sister took Bernie by surprise. It isn’t easy to experience a loved one's death at any age, but at 26, loss takes a toll. After Brianne’s death, Bernie worked as an intern at an architectural firm before starting a five-year program at the New School of Architectural Design in downtown San Diego, where he met fellow student, Melissa Vaughn, who shared his passion for adventure and the sea. They dated for a year before renting a house in Ocean Beach, using the Independence for staycations. In 2012, they decided to downsize, sell most of their belongings and live full-time on the Independence, docked at Cabrillo Isle Marina in Harbor Island – a decision they haven’t regretted. When they talk about downscaling from a house to a boat, approximately 260 square feet, Melissa says, “He’s very simple. It was harder for me. We had a huge garage sale and sold the majority of our belongings.” I ask about challenges as liveaboards, and they giggle as if there’s a joke only they are privy to. “Fighting. You don’t get your own space,” Melissa says. “One of us usually retreats to the hammock, which hangs from the mast to the forestay. It’s a good solution.” On Friday nights, music blasts from the Independence. By Saturday and Sunday morning, empty beer cans are scattered on deck and the surrounding dock. “We work hard on weekdays and play hard on weekends,” Bernie says with a boyish grin. His face has a ruddy look. He has big brown eyes and dark, wavy hair that glistens in the sun. He’s softspoken, with a hardy laugh. There’s a sadness noted that isn’t outwardly displayed, a kind of inner grief that exposes itself from time to time, as if a bandage has loosened

revealing an unhealed wound. Melissa, a brunette with brown eyes and a mellow disposition, can be spotted every few months cutting Bernie’s hair on the dock. He sits straight on his chair drinking a beer, staring out at the water, bare-chested, wearing sunglasses and a pair of shorts. After a few snips, Melissa bends over to kiss him. Their dog, Kaya, a Chiweenie they bought at a dive bar in Point Loma, stands watch on the deck alerting them to seagulls, small children and other dogs that pass by. Bernie describes the inside of their boat. “We have a u-shape settee to starboard,” he says, “and a straight settee on portside. There’s only one comfortable spot, and it belongs to whoever gets there first.” “Or he just gets it,” Melissa adds, smiling. I ask them what happens when one or the other wants to read and one wants to watch TV. “I’ll just take my book into the aft cabin, “Melissa says. “We don’t read a lot, and our basic Internet service is spotty, so it’s hard. We’re cutting back on everything, trying to get away from the monthly payments.” Bernie laughs. “We don’t have to worry about phone service,” he says. “I was drunk on the dinghy when I lost mine, and Melissa ruined her phone when she dropped it in a washing machine. All our social communication is done via Facebook.” “We live in a tiny space and work in cubicles at our office. That gets difficult,” says Melissa. “We look forward to weekends when we can party and sail.” Recent trips include motoring to a concert at Humphrey’s on their dinghy and cruising to Coronado Island and Mariner’s Cove in Mission Bay. “Last weekend, we went to La Playa, dropped anchor and tied up with a friend and paddled around in our dinghy.” says

Bernie. “There’s something about sailing that sets you free – cruising out the marina with nothing around you but ocean.” We began talking about social situations for liveaboards. “When we moved into our sailboat, I had no idea what to expect,” says Melissa. “The best thing about living at Cabrillo Isle Marina is the being part of this tight community.” Bernie compared it to a “glorified trailer park. “You get to hang out with millionaires, engineers, architects, writers – people from all walks of life.” A subject Bernie is adamant about involves marinas setting a limit on the number of liveaboards. Cabrillo allows 10 percent liveaboards, and currently they are at 8 percent. “Marinas think of liveaboards as second-class citizens, afraid of attracting derelict boats,” Bernie says. “But at the same time, it’s like a neighborhood watch – eyes on the marina, the boats, and a safer environment for everyone who docks here.” The topic turns to marina management. “I wish they would provide more security, like they used to,” Bernie says. “I had a surfboard and bicycle stolen, one from storage and another from my car. But we feel safe on the boat.” Bernie and Melissa sit on the settee, holding hands, talking about a certain liveaboard mindset. “When someone walks by, you say hello. It doesn’t matter who it is,” Melissa says. “You end up

bringing that type of warmth to other areas of your life.” They grin when they talk about the perks of living aboard – marina parties, discounted food, Jacuzzi and swimming privileges at the Sheraton and a 20 percent discount off all food and soft drinks at Tom Ham’s down the road. The subject returns to Bernie’s sister, Brianne. “How do you handle the anniversary of her death?” I ask. Bernie ponders the question for a few seconds and says, “I drink a Jack and Coke because it was her favorite drink. Otherwise, I drink my usual – rum, vodka or beer.” From outside the hatch, we hear “BerNie” shouted from across the way. “BerNie, come on over!” “That’s Chris on D dock,” Bernie says, laughing and blushing. Again, we hear, “Ber-Nie, you there?” I stick my head out the hatch and yell, “Bernie’s busy; he can’t come out and play.” As the sun sets and prevailing winds whistle through the halyards, I ask about plans for their future. “We think spending our money on traveling and seeing the world is more important than marriage,” Bernie says. “Our goal is to save up money, quit our jobs and sail to Mexico and who knows where else. We’re only young once.” “I know one thing for sure,” Melissa adds. “I definitely don’t ever want to live back on land.”

San Diego fire stations are drop-off points for annual Toys for Tots The San Diego Fire-Rescue Department is once again working with Toys for Tots to help bring smiles to Christmas morning. Every San Diego fire station has a collection box to help make contributing to Toys for Tots convenient. “With a fire station in every neighborhood, San Diego Fire is a great partner in our program,” said Marine Capt. Evita Mosqueda-Chapman, the San Diego Toys for Tots coordinator. “The stations are not only drop-off points, but the Fire Department moves the toys to central collection points so our Marines can more easily get them to the Reserve Center to be sorted and distributed.”

Residents can drop off a new, unwrapped toy at a San Diego fire station anytime until Dec. 18 and be assured it will get to Toys for Tots. “We’re glad to do our part,” San Diego Fire Chief Brian Fennessy said. “The Fire-Rescue Department has worked with Toys for Tots for several years, but the credit for this program all goes to the Marine Reservists.” Mosqueda-Chapman says their warehouse is currently completely out of toys for boys and girls ages 10 to 12 and girls 6 to 9 years old. “We want and need toys for all ages, but the warehouse is bare for those age groups now,” she said.

This is your opportunity to become a docent volunteer at the topranked maritime museum in North America. Learn about worldwide maritime history with a special focus on the 16th through 21st centuries represented by the vessels and artifacts in the Maritime Museum’s collection. As a docent, you will be able to engage with museum visitors, fielding their questions and sharing your knowledge, thereby enriching their experience. Training is carried out in a series of lectures, suggested readings and walking tours. occupancy and eligible housing types in both Home Sharing and STVRs. Architect and Planning Commission chair Tim Golba acknowledged that STVRs are a daunting issue that staff will be challenged to remedy. “There’s not a whole lot here to find common ground on,” Golba said. During their deliberations, commissioners pointed out they didn't want to repeat the mistake of a recently passed city ordinance restricting to four the number of medical marijuana cooperatives allowed to exist in each council district. They noted that ordinance has culminated in a race between competing applicants to be the first to open, which they added “has not resulted in the best-quality operators being in business.” The failed city STVR ordinance was crafted by the Council’s Smart Growth and Land Use Committee (SG&LUC), chaired by Second District Council woman Lorie Zapf, whose district includes the beachfront between Point Loma and La Jolla. That ordinance which came out of SG&LUC recommended minimum stays of at least 21 days for the short-term rental of a home not occupied by the owner. It, however, didn't place the same restriction on the sharing of homes with live-in owners. STVRs have been a divisive neighborhood issue with two clearly drawn and mutually exclusive sides. On the one hand are homeowners convinced STVRs should be excluded entirely from residential neighborhoods. On the other side are STVR and Airbnb industry representatives arguing such rentals are a private property right and are good for the economy. Ordinance detractors insist that all that really needs to be done is to beef up enforcement of existing regulations to police — and eliminate — a few problematic operators. We need sensible regulations and we need them now.” Point Loma Realtor Robert Tripp Jackson noted it's been “common for shortterm rentals to exist in beach areas (most notably Mission Beach). He pointed out that when the real estate market “cooled” in 2006, that was when investors, who were sitting on inventory they couldn't sell, realized short-term rentals could bring in more income than longterm rentals. “It really started becoming a 'big business' here in Point Loma,” Jackson said. “Instead of just renting a home, it would be offered on a weekly rate.” Jackson added problems started when those short-term rentals started “popping up everywhere.” “Often there would be a ton of vacationing people partying late into the night,” he said, adding, “It has brought a real-world nuisance to our community.” Jackson gave a proposed compromise solution. “I would support regulation limiting the number of vacation rentals, their location, and capping them (occupancy) at two (persons) per bedroom,” he said. “Law enforcement would have to be the police power (supporting) code compliance. The property owner would be fined, if two warnings didn't work. Regulations would apply for owner-occupied rentals too.”

New public art project installed at SD airport As a prelude to the opening of its $316 million Rental Car Center in January, San Diego International Airport Dec. 8 unveiled MetroGnome, a public art project featuring two 54-foot-high kinetic sculptural forms adjacent to the new building. Created by German-born, Los Angeles-based artist Christian Moeller, the artwork is located within one of the facilities’ exterior bioswale areas. At a press conference, Lauren Lockhart, airport art program manager, said the sculptures were created specifically for that site. “We hired the artist based on their past qualifications and experience,” Lochhart said. “We formed an ad hoc panel of art and design professionals who looked through a competitive pool of submissions from across the country.” Moeller was chosen as the most qualified and worked with the larger architecture and design team to identify this location and to create a site-specific piece, Lockhart said. Concerning his muse, Moeller said he was thinking about this unique site where the Rental Car Center is, noting it's a hub of transportation modes near the I-5 and Pacific Highway, San Diego Bay and the airfield. “He (Moeller) wanted something that reflected that constant coming and going and movement of travelers at this site, and that's why the art pieces are kinetic – like a metronome keeping time,” Lockhart said. “But then it's also a little bit playful because there's a G

MetroGnome's sort of an elegant abstract hybrid of a garden gnome and metronome.” The beauty of the sculpture, said Lockhart, is that “you can read a lot of different associations into it. I've heard a lot of different interpretations of it.” The MetroGnome is controlled with electro-magnets in its interior. The sculpute is going to continue to be tested, but it will be ready in January for the grand opening of the building, noted Lockhart. There is also another major art piece

in the works, “Dazzle,” by artist group Uberall International, LLC, which is to adorn the outside of the new rental car facility. Ueberall International, a leading experiential design firm, and E Ink Holdings, an innovator of electronic ink technology, have joined to produce eFlow, a groundbreaking project at the airport that will combine art, media and stateof-the-art technology. Ueberall and E Ink have been selected to do the exterior art work on the northeast side of the new, four-story airport rental car center. “Their cutting-edge technology will animate the entire façade of the building in a camouflage dazzle pattern,” said Lockhart.

Point Loma's Heather Leavitt named PacWest Player of Year Heather Leavitt was named the 2015 PacWest Volleyball Player of the Year by the league's coaches. The senior outside hitter is the first Sea Lion student-athlete to earn the honor, bestowed her after pacing the PacWest and ranking third in the NCAA with 4.77 kills per set. The Mesa, Ariz. native had a .264 hitting percentage and averaged 3.63 digs per set to rank 13th and 14th in the PacWest, respectively. She posted double-doubles in 23 of 29 matches and finished the regular season with double-figure kills in all but one match. She was the first Sport Imports/AVCA National Player of the Week on the season after averaging 5.27 kills and 4.07 digs per set in four PLNU wins at the Seaside Invitational.

But a yellow flag lay on the turf. Game officials called a holding penalty that was, to many seasoned viewers, including some who later viewed the play on video, "a phantom penalty." Ten yards were marched off, leaving the Pointers at the 21-yard line, where Torrence attempted a pass that landed in the arms of a Pirate defender at the oneyard line, effectively ending not only the game, but also the Pointers' championship dreams as the final seconds ticked off the game clock. Earlier, the Pointers found themselves on the short end of a 21-7 halftime score, their only touchdown coming on the block of an Oceanside punt midway through the first quarter by a pair of sophomore standouts. Mathew Fa'alele (6-0, 240) got the block, with teammate Davey Folsom (6-4, 300) scooping up the loose ball and rambling for the score. But the Dogs trimmed the Pirate lead to 28-24 with a 17-point third quarter. Torrence began the rally, forging a 16yard path to the end zone to end the Pointers first second-half possession. After a Pirate score, Torrence scored again, this time from one yard out before senior kicker Jaime Medina launched a 33-yard field goal in the third quarter's final minute. Much of the final quarter featured possession changes and punts until the Pointers mounted their fateful final drive. Years from now, players and fans will talk about this game and the touchdown that should have beat mighty Oceanside. And that yellow flag.

Sitting just three miles from the entrance to massive Camp Pendleton, a proliferation of American flags can be seen at Oceanside High and in the surrounding Marine-dominated community. For Point Loma High players and fans who made the 36-mile foray up the I-5 to Simcox Field for a CIF Div. I semifinal football game, their patriotic spirits were stirred. But it was flags of another type that left the Pointer faithful frustrated and disappointed as the Pirates edged the Pointers 28-24. The disfavored flags were of a solid bright yellow color and flew not from flagpoles but from the waistbands of prep football game officials. And one of those flags flew during a furious lastminute Pointer drive when a likely game-winning touchdown was negated by one of those flags. The Pointers rallied for 17 third-quarter points to cut the Pirates lead to 2824, and both teams exchanged possessions and punts until the Dogs mounted their final drive in the last minutes before game's end. Crossing midfield, the Pointers moved to the Pirate 11-yard line as the stadium clock showed one final minute remaining. From there, senior wide receiver Caleb Johnson took a handoff from fellow senior quarterback Brenden Torrence, running laterally before he spotted a seam in the Pirate defense. The Las Posadas pro-

cession is a walking reenactment of the biblical story of Mary and Joseph’s search for a birthplace for Jesus. Everyone is invited to join the candlelit procession, starting at 4:45 p.m., and sing traditional holiday songs in both Spanish and English as the players go from inn to inn, symbolically asking for lodging. The procession will include local actors playing the parts of Joseph and the innkeepers. The procession culminates with

a live nativity tableau in front of Casa de Estudillo along with a choir performance. The events are sponsored by Wells Fargo Foundation and The Old Town State Park Merchants Association.
