Planners renew permit for police trailer near OB pier — for now BY TONY DE GARATE | THE BEACON

Many seem to agree that an office trailer smack-dab in the middle of the pier parking lot is not the ideal place for a police presence in Ocean Beach. But the fact remains that the trailer rented out by local business owners for use as a mini-police station has been sitting right there at the foot of Newport Avenue for 14 years — all the while without a permit. The Ocean Beach Planning Board (OBPB), for the second time this year, has voted to allow police to keep the trailer in place, but only until a “more suitable” location becomes available. Planners further stipulated in a 10-1 vote Aug. 7 that the permit expire five years after its issuance. The matter came before the OBPB because the state California Coastal Commission last year rejected the city’s claim that the trailer was temporary and determined it needed to have a coastal development permit or be moved. The OBPB, like the other 40-plus neighborhood planning groups in the city, makes recommendations on permits and other matters having to do with land use and quality-of-life issues. BY NEAL PUTNAM | THE BEACON A judge ordered an Ocean Beach man on Aug. 16 to stand trial for kidnapping and sexually assaulting two women in Ocean Beach, cases in which DNA evidence linked him to both attacks, according to testimony. At the end of the preliminary hearing, Richard Christopher Butts, 26, pleaded not guilty to eight felony counts and a trial date was set for Dec. 13 by San Diego Superior Court Judge David Gill. Butts is charged with kidnapping both women with intent to commit rape and oral copulation, charges that carry life terms in prison if he is convicted. He is also charged with rape, forcible oral copulation and two counts of assault with intent to commit rape and oral copulation. Butts was arrested by police on March 24 after a young woman was sexually assaulted in the early morning hours while she was walking along Long Branch Avenue in Ocean Beach.

over her mouth and she had trouble breathing. She stopped screaming, but screamed again after most of her clothing was removed. Witness Hali Moore testified she was pet sitting at a client’s house on Long Branch Street and heard the woman’s screams. She said she and her partner ran outside and saw Butts as he was running away. Moore said they called 9-1-1 and she identified Butts as the man who was running away. She said a police dispatcher told her to stop chasing the man for her own safety. Moore said she chased Butts to Cable Street until “I lost him on Abbott Street.” Moore said she went back to find the terrified victim. “She was shaking. She was hurt,” said Moore. The victim, whose identity is being withheld, testified in court. “I saw a man with a hoodie running toward me,” said the victim. “By the time I started to run for it, he grabbed me.” The victim said her attacker had his

Adam Dutra, a criminalist with the police department, testified that DNA found on the victim in the March 24 assault matched the DNA evidence found in a previous unsolved rape in Ocean Beach that took place on Aug. 25, 2012. Det. Cory Gilmore testified the distance between the sidewalk and the location where the March 24 victim was dragged was about 80 feet. Gilmore said the victim was wearing flip-flops and impressions of flip-flops and tennis shoes were found in the dirt near the garage, as well as drag marks. Gilmore testified the homeowner was not in the nearby house the night of the assault. A chart was displayed that showed Butts lived a few blocks from both attacks. The victim in the March 24 assault testified it was dark and she could not see her attacker’s face. She said she screamed, but her attacker put his hand

hand around her neck, somewhat suffocating her. “I began to fear for my life. I was afraid if I kept struggling … I would die,” she said. She said she told the suspect, “If you let me go, I’ll be quiet.” Det. James Hunter testified Butts was detained near Robb Field and had dirt on his jeans. He said Butts admitted to assaulting the victim and claimed he wanted to “sexually arouse her.” “He (said) he was looking for a fight. He was looking for violence,” said Hunter. Hunter said he asked Butts if he wanted to write a letter of apology to the victim, and Butts reportedly did so after being interviewed.

The first rape occurred on Muir Avenue near Bacon Street. That victim was bruised and bloodied, and the judge was presented color photos taken of the victim during her hospitalization. Madeline Marini, a hospital nurse, testified the victim described herself as “freaking out” as a result of the ordeal. Shawn Montpetit, a DNA technical manager for police, testified the DNA evidence from both cases matched Butts. He said the odds of a random match is “one in 87 quintillion,” which he noted contains 18 zeros. Butts’ attorney and Deputy District Attorney Wendy Patrick submitted the case to the judge without any argument. Butts remains in custody on $300,000 bail.

BY DAVE SCHWAB | THE BEACON The Peninsula Community Planning Board (PCPB) voted Aug. 15 to grant a time extension for a controversial redevelopment of the Point Loma Marketplace, as well as opting to send a letter opposing a draft environmental impact report (EIR) to San Diego International Airport’s Land Use Compatibility Plan. The vote on the time extension request for the marketplace redevelopment — calling for the demolition of two existing commercial buildings and the construction of three commercial buildings in their place at 955 Catalina Blvd. — was approved 7-3 following an unsuccessful 6-4 vote on a motion to deny the time extension. Neighbors next door to the development project, Jeff and Peggy Fischbeck, turned out to oppose the time extension. The couple urged the planning group not to vote immediately on the time extension, but rather to delay the vote for at least another month. “You’re considering giving them another three years to allow a project you don’t know anything about,” said Peggy Fischbeck. “This project doesn’t fully serve the needs of the community and the community needs time to be able to look at this plan again. I say no time extension. Go back to the drawing board and make the changes that need to be made.” Jeff Fishbeck agreed. “The fact is this project is taking away 20 current parking spaces and compensating by shrinking existing parking spaces,” he argued. “The pro-

ject will impact businesses negatively, traffic will overflow into the surrounding neighborhood, and 18-foot delivery trucks longer than what’s allowed are already backing into the site from the street causing problems.” The Fischbecks also pointed out only two members are still on the PCPB board that initially approved the project as proposed three years ago. Mark J. Linman, representing project developers, said the time extension was being asked for to meet administrative deadlines and to allow more time for the economy to improve. He said developers would willingly address questions about the project but have few answers at this time. “The anchor tenant, Fresh & Easy, is in limbo right now,” Linman said. “We don’t know who the tenants would be, how construction would be phased, don’t have the buildings leased at this point. We’re asking for the extension of time to modify the existing approval.” PCPB member Paul Webb said he

was conflicted about the project, but felt an obligation to treat the developer fairly. “I don’t like this project very much,” he said. “On the other hand, these guys have played by the rules, designed a project that’s been approved by this board and they’re allowed one time extension. I find it hard to deny that.” Planner Jay Shumaker said the group needed to consider economic realities relating to the project. “To let the project die now isn’t going to improve the economy,” he said. “You could punish the owners by not granting a time extension and you could end up with a project that’s a lot worse and cheaper.” PCPB member Brittany Taylor said that when the project comes up later

for environmental and governmental review, “only the extension of time will be looked at. They will not look at the entire project over again.” Webb gave a brief presentation to the group on the San Diego International Airport’s draft EIR for the Airport Land Use Compatibility Plan. He urged the group not to accept it as proposed. “The EIR is flawed and does not accurately represent the displacement of new residential or commercial uses that will result if the airport land use plan is approved in the from it’s in now,” he said. Webb said the method used in the draft EIR to analyze impacts was “very obscure” and “doesn’t look at each of the individual community plans.”

Webb concluded the airport plan needs to revisit the community plans of all areas adjacent to the airport and re-analyze, from each community’s perspective, how they’re going to be impacted to get a more accurate picture. PCPB chairwoman Julia Quinn said the planning group has been asked to submit a list of potential community projects related to infrastructure, like street, sidewalks, bike paths and so on to be considered for future public funding of the city’s 2015 capital improvement program. She urged residents and planners to email suggestions to her at pcpbem@gmail.com by Sept. 9 to be considered at PCPB’s next meeting on Sept. 19.

A recent worldwide animal-rights group’s protest of SeaWorld, including the site in San Diego, has rekindled debate over the appropriateness of keeping marine mammals in captivity. “We must let SeaWorld and all captive facilities know that we will not stop being a voice for these precious creatures who have lost their right to freedom, their right to live a natural life and [who] are now imprisoned, artificially inseminated and forced to perform tricks for food — all for human entertainment,” said Ellen Ericksen, San Diego spokeswoman for Empty the Tanks, during the July 27 global anti-captivity protest joined by about 150 picketers outside SeaWorld San Diego on Mission Bay. SeaWorld officials are of a different mind. “The protesters’ claims and accusations are without merit,” said SeaWorld San Diego’s communications director Dave Koontz. “There is no organization more passionately committed to the physical, mental and social care and well-being of animals than SeaWorld. The real advocates for animals are the trainers, aviculturists, animal-care staff and veterinarians at SeaWorld.” Rachel Greenhalgh, a Sea Shepherd volunteer and founder of Empty the Tanks, said the protest is “an awareness campaign and change movement.” She argues that marine mammal entertainment parks “do not have any place in the 21st century.” “We know the level of awareness these animals have,” Greenhalgh said. “We know their social connections, their eating habits and natural wild behaviors. You cannot breed natural instincts out of an animal in a handful of generations. These are incredibly social, intelligent beings that are being used to make money. It is animal slavery and it needs to be brought to the general public’s attention.” Greenhalgh said Empty the Tanks is not a radical movement requesting the release of captive whales and dolphins. “Some of these animals might be great candidates for release, but those that are not should be retired into sea pens, where they can enjoy the rest of

We will get bigger and louder until the world wakes up to the issue.” Reacting to the July 27 Empty the Tanks Day, the Alliance of Marine Mammal Parks & Aquariums, an international organization dedicated to conservation through public display, education and research, attacked the protest as a “publicity stunt by anti-marine park and aquarium protestors designed to discredit marine mammal facilities.” “The campaign paints a distorted picture of what our parks offer and ignores the value of the high-quality educational programs and conservation efforts of our parks and aquariums throughout the world and the quality of care they provide for marine mammals,” said Alliance officials in a prepared statement. “Accredited members of the Alliance of Marine Mammal Parks & Aquariums and our animal-care professionals know firsthand the educational and inspirational experiences children and adults have when they see live whales, dolphins and other marine mammals at our facilities. We also know from national opinion polls that the public strongly believes that seeing and experiencing live marine mammals is the best way for children to not only learn about the animals, but to inspire conservation action that can help marine mammals and their ocean environments.” Noting Birch Aquarium at Scripps in La Jolla has no marine mammals, Nigella Hilgarth, the marine education and science center’s executive director, said it’s easy to underestimate the value of having living organisms on exhibit. “The key is education,” Hilgarth said. “Historically, zoos and organizations

It’s true to say zoos have played a huge part in awareness, building education and conservation of creatures.” Steve Feldman, spokesman for the Association of Zoo and Aquariums, a nonprofit organization founded in 1924 that accredits more than 180 facilities worldwide, said there are a number of things going for wildlife exhibitors. “More than 90 percent of people like aquariums, zoos and marine parks, and only 1 to 4 percent of people don’t like these places,” he said. Feldman said the importance of zoos, aquariums and marine parks is growing with time — and the changing circumstances. “In a world where climate change, human encroachment and habitat loss are negatively impacting wildlife in the oceans and on land everywhere in the world, accredited zoos, aquariums and marine parks are even more important to educating people and to research and conservation,” he said. “If we didn’t have zoos and aquariums, we’d be asking ourselves how we could invent something an awful lot like them.” Answering the argument that captive animals like orcas, commonly called killer whales, range freely in the wild and are denied that opportunity in marine parks, Feldman responded, “There’s a lot of evidence that animals that travel long distances in the world in search of food don’t travel those distances when food is present.” Feldman said how well — and ethically — animals in zoos, aquariums and marine parks are treated is frequently overlooked. “Our enrichment program ensures we meet the physical, social and psychological needs of the animals,” he said. Enrichment is about “stimulating the natural behaviors in animals.” Feldman said the interaction of humans with marine mammals “stimulates play behavior and is really enriching for the animals.” Feldman said people who haven’t been to the zoo or a marine park in 20 or 30 years have “missed out on an awful lot.”

Airport Authority spokeswoman Katie Jones produced a laundry list of customer-friendly, progressive airport amenities now center stage at Lindbergh Field. She said there are 21 shops in the new expanded terminal and twice as many airport security lanes. “Our new Sunset Cove concession area is beautiful, bright and open, with an enormous three-story glass wall and art,” Jones said. Noting more than 800 outlets have been added throughout the terminal so people can plug in and charge electrical devices like laptops and phones, Jones said a fully automated baggage system with 550 motors will increase both the speed and accuracy of handling while “screening 100 percent of bags going through.” “We tried really hard to bring in all the high-tech amenities and new features that people are looking for,” Jones said. The board thought it was finished with the issue in January when the police department first applied for the permit and the board similarly approved the use. But police officials failed to notify everyone in a 300-foot radius as required by law, conceded police Lt. Natalie Stone, forcing the need to start the process over again. Stone said the mistake occurred because the department’s crime analysis unit, which had been tasked with determining the size of the area to be included in the mailing list, failed to measure from every corner of the parking lot. The Ocean Beach MainStreet Association (OBMA) has been renting the trailer to police since August 1999, the year after the police department lost its lease at a storefront in the 5000 block of Newport Avenue. Though the trailer is not regularly staffed, police go there to work on reports, use the restroom, microwave snacks and store equipment, Stone said. Having police spend more time around the parking lot reduces crime and response times, she said. Without the trailer, police would have to leave Ocean Beach and complete routine tasks at the Gaines Street headquarters or storefront on Sports Arena Boulevard. Craig Klein, a local property owner and former OBPB board member, was among the speakers who agreed with the trailer’s benefits. “Unless we have a police presence … there, the whole area is going to be overrun with travelers, dope dealers, gang members and other people engaged in harmful activity,” Klein said. But Vince Adame, a resident who lives east of the parking lot, said he’s been trying to get the trailer moved to a better

location for five years and charged that police have not pursued alternative locations. He said the trailer is rarely used, takes up too many parking spaces, and is “sitting there as an eyesore.” A speaker who identified himself as a 10-year resident named “Raymond” agreed. He said the view behind the trailer, known as Surf Check alley, had been ruined by the trailer. “On my balcony on the second floor, the only thing I’ve ever seen is trailer roof alley. Why can’t they move that against the east wall and let us have our view back? Simple as that,” he said. Stone said other locations would require the extension of utilities hookups or lack protection from being jumped on. “If a merchant came along and said, ‘We’d like to give you a space’ somewhere along Newport, we would abandon the trailer,” Stone said. Several speakers pointed to a $4.56 million city plan to replace the existing 33-year-old lifeguard tower on Abbott Street as the long-term solution. The new building would be more than double in size and allow joint use for police and lifeguards. But no funding has been identified for the project, according to city documents. Until that project is built, it makes no sense to remove the trailer, said OBMA executive director Denny Knox. “If we say it’s ugly and it’s got to go, what have we gained?” she said. Board member Scott Therkalsen cast the lone dissenting vote. “Seems like we’re just kicking this down the road. If there’s not going to be a new lifeguard tower in five years, (the trailer) isn’t going to move in five years,” he said. But board member Peter Ruscitti said the board’s action expressed both desires: to maintain police presence, but make it clear the trailer is not to be permanent. “We want that police trailer out of

there, but right now, with no other option available, it’s better than turning police away from Ocean Beach,” he said. The permit must be approved by the San Diego Hearing Officer but may be appealed to the California Coastal Commission. In other OBPB news • John Ambert has been appointed to represent District 1, the northernmost section of Ocean Beach. Ambert described himself as a 30-year resident and son of a local chiropractor. He listed three areas of concern: the fate of the former Apple Tree Market, the long-vacant lot at Voltaire Street and Sunset Cliffs Boulevard, and an “atrocious” project at the corner of Ebers Street and Santa Monica Avenue that resulted from lotsplitting. He also expressed interest in ecodistricts and improved access for pedestrians and bikes. • The board still has a vacancy available by board appointment in District 3. To qualify, a citizen must be at least 18 years old and have lived, owned property or run a business in the Ocean Beach planning area for at least 30 days. In addition, candidates must collect 35 signatures from eligible voters in District 3. More information is available at oceanbeachplanning.org. • Obeceans seem to like the idea that lifeguards who get injured in the line of duty get compensation benefits equal to those of police officers and firefighters. A recently passed bill (SB 527) to do just that, sponsored by state Sen. Marty Block, takes effect next year, said Block aide Roberto Alcanzar. The news was greeted with applause by audience members. • Block also wants ideas for next year’s legislative agenda, said Alcanzar. A town hall meeting will be scheduled next month to allow citizens to make suggestions. “Our goal is to have our legislative package for next year be completely community driven,” Alcanzar said.

Pointers football squad gets primed for Aug. 31 season opener BY SCOTT HOPKINS | THE BEACON Entering his 16th season as head coach, Bill Hastings has compiled a record of 108 wins, 64 losses and 2 ties. And while coaches at many schools don’t look beyond the physical skills of their players, Hastings continually finetunes an overall approach that he believes builds the whole person. His players are expected to be good students and role models on campus and helping members in their homes. Hastings often shares the successes, community contributions and leadership roles of former players. A look at the 2013 Pointer schedule confirms that Hastings wants his team

First up, in the home opener, is South Bay’s surprising Olympian, which administered a 38-10 whipping of the Pointers in Week 2 last season. The Eagles went on to an undefeated season before losing to Lincoln 20-7 in the CIF Div. III semifinals. Answers to Your Home Care Questions I’ve heard that there is a possibility that the live-in caregiver service that allows my mother to stay in her home may no longer be allowed. Why? The President and the former Secretary of Labor wanted to eliminate the Federal Companionship Exemption that exists under federal law. Last year the Exemption was saved but this year home care specialists are worried. Right now a live-in is exempt from overtime laws. If the Companion Exemption is eliminated, the cost of 24-hour daily care would double. A caregiver would only be

allowed to work in the home for eight hours a day before overtime laws would kick in, meaning you would have to pay time and a half and then double time for that caregiver or you would have to hire three caregivers a day to work 8 hour shifts to prevent paying the higher costs. This would be so catastrophic that most people would not be able to keep their loved ones at home. The Universiade is a multi-sport event organized for university athletes by the International University Sports Federation (FISU). The name is a combination of the words “university” and “olympiad.” The Universiade is often referred to in English as the World University Games or World Student Games; however, this latter term can also refer to competitions for sub-university grades students. Universiades are the second-largest sporting events in the world by participation, eclipsed only by Olympiads. More than 10,400 university athletes from 162 countries participated in 13 mandatory and 14 optional sports, making the 2013 Universiade the biggest ever in the history of the event. 152 Sea Lions named PacWest scholar-athletes The Point Loma Sea Lions placed 152 student-athletes on the Pacific West Conference All-Academic team for the 2012-13 academic year. Each PLNU team had at least three selections on the PacWest All-Academic squad, including the women’s track and field team, which led the Sea Lions with 33 award recipients. Alaina Bird helped pace the team academically with a perfect 4.0 gradepoint average. She is one of only four

seniors in the entire conference to register a perfect GPA. She was one of eight PLNU women track and field student-athletes to have a cumulative GPA over 3.85. Meanwhile, the baseball team and the women’s soccer team came tied for second among PLNU teams with 20 academic all-conference selections. Andy Littlefield paces the baseball team with a 3.94 GPA, while Leah Porter and Nicole Craft are tied atop the women’s soccer team with a flawless 4.0 GPA. A number of other teams also had 10 or more student-athletes selected to the team. This included the women’s cross country team with 15, men’s soccer with 12 and men’s track and field with 11. Other teams with all-academic selections included men’s basketball (five), women’s basketball (seven), men’s cross country (five), men’s golf (three), women’s golf (three), men’s tennis (four), women’s tennis (seven) and volleyball (seven). Nineteen PLNU student-athletes received PacWest academic honors in more than one sport. This list included Lindsay Honea, Jake DeSaegher, Jacob Roth, Dylan Poorboy, Tristan OliverMallory, Alaina Bird, Caitlin Brandt, Gina Erbacci, Sarah Feddersen, Heather Kastein, Jessica Lucas, Bailey Massenburg, Breelan Matranga, Ashley Matsen, Haili Matsukawa, Alisa Poplawski, Sally Rudi, Briana Swendener and Ashlee Szabo. As a whole, the PacWest Conference named more than 1,600 student-athletes to the All-Academic Team. Women’s volleyball led the way with 238 total selections. To qualify for the PacWest All-Academic Team, student-athletes must have a 3.0 cumulative GPA at their university and participate in a conferencesponsored sport.

BY SCOTT HOPKINS | THE BEACON For Mike Hastings, this marks his 20th year on the Pointer staff and his 16th season as head coach while he prepares his team for its season-opener against South Bay’s Olympian High on Saturday, Aug. 31 at 3 p.m. on Bennie Edens Field in newly spruced-up Pete Ross Stadium. The game follows the debut of both the Dogs’ freshman (10 a.m.) and junior varsity teams (12:30 p.m.) in the first of three Saturday afternoon home games that will allow greater community attendance. Each of the five home games this season will feature a theme, with the season-opener a “Salute to Military/Police/Fire/Lifeguards” game. Other Saturday games are Sept. 14 with the same schedule against Lincoln (“Pointer Association Kickoff Game”) and Sept. 28 when the junior varsity (10:30 a.m.) and varsity (1 p.m.) take on Scripps Ranch (“Staff Appreciation Game”). Friday games are set for Nov. 1 (“Youth Football/Cheer Game”) and the annual Homecoming game under the lights on Nov. 8. Visitors to Pointer games this season will likely note the disappearance of the infamous bank of blue portable restrooms that have lined the stadium’s plaza on Voltaire Street and in the west end zone near the scoreboard for several seasons. In their place, fans will find a new multi-purpose building, gates, plaza and landscaping greeting following the completion of a stadium entrance

remodel funded with San Diego Unified School District Prop. S funds. Working with limited space, district architects designed a structure that will serve as ticket booth, concession stand and long-awaited new restroom facility. The 1,100-square-foot steel structure is in the final construction phase as the school year approaches. It replaces a wooden structure condemned because of structural decay. The unsightly and uneven asphalt plaza has been replaced with a smooth deck of fresh concrete, while several palm trees dominate new landscaping at the entrance that greets visitors with beauty and color where a small patch of lawn previously existed for decades. EXTRA POINTS • The stadium entrance upgrade has been under construction since June 2012 at a cost of about $1 million. • Seniors over 63 years of age are always admitted free to regular-season Pointer home athletic events. (Does not apply to playoff games). • Regular admission prices for the 2013 football season are $6 for adults, $2 for ages 5-12, while children under 5 are admitted free. Admission will be charged for all games on Saturdays and Friday varsity games. Members of the military, police officers, firefighters and lifeguards with IDs will be admitted to the season opener as guests of PLHS. They will be saluted in a halftime program. Police and fire vehicles are expected to be on hand.

It produced several all-league players, including defensive player-of-the year Jamal Agnew. Three of the Pointer losses were by a total of 23 points against two CIF champions. The 2013 group will be focused on stopping their opponents and returning possession to their offensive teammates. Defensive line: “This group has some kids that played last year in the secondary or backup roles who now move forward,” said Hastings. “A returning starter who had a very good year is Pedro DaSilva. Then there’s a big kid, Jared Polonitza, who plays on the offense but is a very good defensive lineman. Also in that mix

And there are some others we can rotate in at that spot.” Defensive backs: “This will be a real challenge, but coach Joe Radovich is doing a good job working hard with the new kids and the ones who were second string last year. We have some good athletes who will play a bigger role on defense, kids like Smith and Lacy will be in the secondary, along with one of our seniors, Adrian Bueno, who should do some good things for us. Jonathan Cook, up from the junior varsity, has been impressive in practice. Frankie Lopez,

returning to football, and a newcomer, basketball player DeAndre Benson, are there. And a couple juniors, Sergio Gallegos and Joel Bracamontes, will also be in the secondary. It’s a good group and they are making progress each day.” Special teams: “We have a couple young kids moving up. Jason Shoemaker is a very good placekicker, and another one, a lineman with a good leg, is Luke Legerton. We’re expecting a good competition with those two and both can punt, but also in the mix is Jamie Medina. Lopez also has a very live leg as a punter.” The 2013 roster includes four sophomores who earned roster spots: wide receiver/defensive back Griffin, kicker/punter Medina and a pair of fullback/linebackers Dillman and Agho. The team’s seniors realize their prep careers end in just over three months. Each has dreams of winning a Western League banner and CIF championship for their school. Each week, they’ll battle as a team, fighting through fatigue and pain in an effort to realize that dream. The quest begins Aug. 31 at 3 p.m.

Montrucchio passed away July 12. Beginning at 4 p.m., the stage will rock with performances from the surviving members of Downspell, alongside Revenge Death Ball, Kut U Up and Temporal Riff. Admission will be collected by way of donations at the door, with all proceeds going to the Montrucchio family to help with funeral expenses. In addition to being a tragedy for his family and friends, Montrucchio’s passing was a blow to San Diego’s music scene. He had worked with some of the biggest names in metal. He was a man of many talents, playing in several other bands, including Scumchrist, and producing videos for such heavy hitters as Napalm Death and the Venomous Concept, which featured members of Brujeria, Anthrax and Brutal Truth. But Montrucchio’s most recognizable role to fans was with Downspell. Formed in 1999, Downspell was originally based in Sitka, Alaska, though it only played three shows before heading south, arriving in San Diego around 2000. Over the years the band had sev-

eral lineup changes. Montrucchio joined in 2004, with only guitarist Jake Phillips and co-singer Wayne Price left from the original line up that left Alaska. But the band has persevered, building a local and subsequently international following the old-fashioned way — putting on a visceral, in-your-face show and gigging whenever possible. Loud and abrasive, Downspell’s music is not for the faint of heart. Built on pure adrenaline and tension, songs like “A Lesson Before Dying” aim at the gut, as well as the mind. Montrucchio’s videos perfectly matched the songs’ manic energy. While quite popular in the U.S., the sextet proved to be particularly popular in Europe and Latin America, where it has played several festivals, most recently in March at the Obscene Extreme in Mexico. Downspell released its debut album “Afterbirth” in 2005, with an EP “7 Dead, 6 Wounded” in 2010. The following year, the band released “The Violent Majority,” scoring a trophy for Best Hard Rock Album at the 2011 San Diego Music Awards in the process. The second of two benefits for the Montrucchio family, plans for the event are modest, but heartfelt. “I just hope friends and family show up,” said Price. “Even if people didn’t know him, I hope they come out, show some support and celebrate his life.”

As much as he misses a band mate, Price said the friendship was just as important. “I just miss hanging with the guy,” he said. “Tyson was a road brother. We really miss his personality.” Price said Montrucchio had an uncanny knack for meeting rock stars and making them his friends. “He was a good all-around media guy, just multi-talented on all counts. It’s really a big loss for us.”

Still, Price said the band will move forward. “We’re taking this in stride, going back and sharpening our sticks,” he said. “We’ll be back soon, harder and heavier than ever. In fact, Downspell is currently in the studio writing our next album. We don’t have a name for it yet, but we’re just plugging away.” Sadly, Montrucchio passed away before any recording happened. However, songwriting had already begun, Price

said. “We will use the vocals that he wrote,” said Price. “He wrote some of the lyrics as well, and we did collaborate on things. Tony Fountain, a 12-year resident of Ocean Beach, took his favorite hometown newspaper along to an ecology workshop at the Lienhuachih Research Center in central Taiwan. The mountainous forest reserve is home to numerous studies of ecology and biodiversity. Scientists from the Taiwan Forestry Research Institute (TFRI) regularly hold international workshops at the research center. For the last four years, scientists and students from UCSD have been invited to participate in research and training programs at the Lienhuachih Research Center. “Although it was officially a ‘work’ trip, we slipped in some time for holidays. This large engraved rock marks the entrance to the research center main station,” said Fountain.

Luc and Patricia Simpson travelled to the Caribbean island of Guadeloupe with their Beacon. They went kayaking and snorkeled along the beautiful reef of St. François and visited the local spice-filled markets.

Ella and Jackson Riley take their Beacon along during their first international trip, where they visited Punta de Mita, Mexico, a small little beach town an hour north of Puerto Vallarta. Ella, 8, swam with a whale, while Jackson, 5, experienced parasailing for the first time.

Wes and Sara Whitaker travelled to Iceland this summer to celebrate their honeymoon. The happy couple holds the Beacon in Southern Iceland at a waterfall called Skogarfoss, at the foot of the Eyjafjallajokull volcano that erupted in 2010, causing havoc to European airspace.

The LWVSD’s position on mental healthcare supports adequate, steady funding for a variety of programs and services for the mentally ill, including treatment centers, outreach programs, shelters and training for emergency personnel who respond to emergencies involving people with mental illness. According to the Centers for Disease

Control (CDC), only 17 percent of adults in the U.S. are estimated to have optimal mental health. It said about 50 percent of adults will develop some form of mental illness during their life. In its report, the CDC concluded that mental illness is a major public-health issue. Mental illness has a major economic impact and is associated with medical conditions like heart disease and obesity. Remember, real-estate agents are small business owners too! BY CHARLES SCHEVKER & NATASHA ALEXANDER The real-estate market is finally making its move toward a recovery. If you have decided to sell your old house and/or purchase a new gorgeous home in La Jolla — the best place in the USA — that’s exciting news. However, the bummer is that you need to choose a real-estate agent, and of course, everyone you know is telling you that “their agent” (as though we are personal possessions) is the best. Some people prefer to choose a licensed friend or family member (although this choice is risky). Others prefer the top sales producers in the area, and then there are those who prefer the agent who has been mailing them refrigerator magnets for the last 20 years (you know who you are). What you probably never thought about is that real-estate agents are actually small business owners. Whether we choose to be affiliated with a brand-recognized brokerage firm or whether we operate our own brokerage, we are bona fide entrepreneurs — not unlike any

other service provider. There are currently 413,266 licensed real-estate agents in California (not all are actively practicing), which means that on average one in every 91 persons is licensed in real estate. Think about that for a minute. To put this into another perspective, if you were attending a football game at Qualcomm stadium and the announcer were to broadcast, “We have an emergency, is there a realestate agent in the house?”, then statistically speaking, 775 people from their seats would rise to answer the request. So, in addition to whether you should listen to friends, family, bench ads or your intuition, your dilemma is how to select the best real-estate agent to meet your needs. You can read articles on the Internet about how to select the best agent. The truth is that most recommend you hire someone with about 90 years experience, a “neighborhood expert,” someone whose credentials appears like a foreign language on their business cards, and that you spend the next six months interviewing before making your selec-

tion. Here are a few things to consider about that advice. First, this is not a dating experience and you do not have unlimited time to make your selection. Second, while a “neighborhood expert” is ideal, think about it — no one can make a living by only selling houses in a single neighborhood. You really want someone with a more global understanding of the local markets. Third, caution should be exercised when considering the advice of friends and family. Sure, their intentions are good, but their advice comes from their “know-it-all” perspective. We all cling to the ownership of our decisions, and while your friends’ real-estate agent may have been great for them, that same agent may not be a match for you. Finally, while 90 years of experience will have its benefits, an agent who is current with technology, up-to-date with changes in laws and the industry and who has a diverse background and education will likely offer you new perspectives. First and foremost, remember that
