Mid-Coast Trolley could eventually extend into PB By DAVE SCHWAB Though years away – if it ever does materialize – the prospect of linking the new Mid-Coast Trolley station planned for Balboa/Morena serving Pacific Beach/Clairemont with light-rail beach service is already controversial. A public meeting planned prior to the next Pacific Beach Planning Group meeting, scheduled on Oct. 28 to discuss SANDAG’s beach line transit study, has been cancelled and will be rescheduled. But the debate has already begun among community planners, and their regional counterparts at SANDAG, the region’s transportation planning agency,

City's CPC votes against short-term rentals in residential neighborhoods By DAVE SCHWAB Local leaders on both sides of the short-term vacation rental (STVR) debate are weighing in on a recent decision by the city’s Community Planners Committee (CPC) to reject a city proposal to allow rentals to operate, with greater restrictions, in San Diego residential neighborhoods. The CPC is an umbrella organization representing more than 40 community planning groups that make land-use recommendations to the city. The CPC recently voted overwhelmingly to support the contention that the city’s municipal
code already prohibits STVR’s in single-family zones. "The CPC supports hosted home sharing in concept,” noted Brian Curry, Pacific Beach Planning Group chair. Curry pointed out CPC determined that whole-house rentals for less than 30 days are considered visitor accommodations. “We are happy with the CPC vote, which was to be open to regulated ‘hosted’ short-term vacation rentals, but not wholehouse vacation rentals for less than 30 days,” Curry said. “The SEE RENTALS, Page 13

Bicyclist seriously injured on Mission Bay Drive A 51-year-old male bicyclist was seriously injured by a motorist attempting to cross 4300 Mission Bay Drive eastbound with no crosswalk or intersection on Sunday, Oct. 4. The bicyclist was not wearing
safety equipment. A 36-year-old male motorist was traveling northbound off I-5 into Mission Bay Drive and struck the bicyclist, causing serious injury. The bicyclist's injuries include a fractured cervical vertebra.
News Court dismisses $25M tree branch lawsuit A Superior Court judge has dismissed a lawsuit filed by a woman who was injured when a eucalyptus branch fell on her as she walked along a paved path near Mission Bay. Lorin Toeppe sought $25 million from taxpayers – $5 million in economic damages and $20 million in punitive damages – for injuries she sustained when the branch struck her in 2013. She alleged that the Mission Bay path was a dangerous condition for which the city was responsible. Her lawsuit was found meritless after the City Attorney’s Office
argued that cities have statutory immunity for the conditions of pathways, such as the Mission Bay trails, which give the public access to recreational or scenic areas. Public entities were given this immunity to encourage them to open their property to the public. Otherwise, courts have found, municipalities would sooner close their recreation areas to the public than bear the burden and expense of maintaining perpetually “safe” conditions and defending and paying claims of injuries. In its motion for summary judgment, the city noted that hundreds
of thousands of people annually use the Mission Bay trail on which Toeppe was injured. Many are bicyclists, rollerbladers, skateboarders and walkers, traveling at different speeds, who are vulnerable to collisions with each other and encounters with debris, rocks and tree branches. “Clearly, if the city could be liable any time someone was injured while doing any one of a myriad of available recreational activities on the path, including recreational walking, the city would have to close the park,” the City Attorney’s Office argued.
Jurors hear opening statements in Owens trial By NEAL PUTNAM The attorney for a woman accused of injuring six bicyclists on Fiesta Island while allegedly under the influence of methamphetamine told a jury Oct. 6 that the level of the drug in her system was not enough to impair her. “Sometimes, an accident is just an accident,” began attorney Brian Schmidt, who represents Theresa Owens, 50, of San Diego. While acknowledging the Aug. 12, 2014 collision was “a horrific accident,” Schmidt said there were no one-way signs on Fiesta Island Road and implied Owens did not know she
was driving the wrong way. “She could not avoid hitting the bicyclists, as they couldn’t see each other,” said Schmidt, who added Owens drove into a blind corner of the road before the collision. In her opening statement, Deputy District Attorney Jessica Coto began by saying, “This is a case about choices – a choice about taking methamphetamine and getting behind the wheel.” “Out of nowhere, the defendant’s car came driving the wrong way on a one-way road,” said Coto, who added Owens “didn’t swerve at all” before striking the riders.
Coto said there were 25 bicyclists going about 24 miles an hour in a double column in the loop around the island when suddenly Owens’ car appeared and struck 10 of them. She said one woman was embedded into the windshield. Coto said Juan Carlos Vinolo, 44, was “embedded into the hood” of Owens’ car and is now paralyzed from the waist down. including two at Clairemont Drive and Balboa Avenue. Construction, costing approximately $2 billion, is expected to begin in 2016 and be completed in 2019. The trolley extension has been designed to provide a viable alternative to highway congestion. Charles (Muggs) Stoll, director of land use and transportation planning for SANDAG, said discussion of using light rail or other alternatives to create an interlocking network of transportation modes for those coming to the beach in the future is still in its “infancy.” “We have an extension of the trolley in the plan from the Morena Station with the Mid-Coast project going through PB, which is about to get under construction,” said Stoll. “At this point, it’s very conceptual, basically a line on the map to extend a trolley line from the future Morena Station out to PB then take it further back to the east towards Kearny Mesa, ultimately linking with the Green Line Trolley.” Stoll said the ultimate objective is to “give people more transportation choices, anything we can do to get people out of driving alone in their cars, giving them more viable options.” Stoll said there's also been discussion of the feasibility of using more
future-oriented, cutting-edge transportation alternatives. “As part of this (transportation) study,” he said, “we’re also looking at things like ‘driverless’ mass transit as well as considering a skyway vehicle that runs on cables. There are places in the world where this technology has been used and can operate at a very high level.” Greater public vetting of future transportation alternatives has been greeted with mixed reaction by local planners, like Chris Olson and Henish Pulickal of the Pacific Beach Planning Group. “It is thrilling to see that our city and regional planners are listening to our call to plan improvements along our oceanfront and connect our beach area to the Mid-Coast Trolley,” said Olson. “The method of getting people in and out of PB will certainly be multi-modal. The emerging technology that will clearly change the way we think about getting around is autonomous vehicles, whether they be shared or owned.” Olson noted he’s “unsure how to predict how this technology is going to evolve,” but he added, “If you think about it compared to our current transportation methods, there will be less of a need for parking spaces and traffic lanes.” He pointed out that “one section of 1-15 has 18 lanes, and some people are asking for more. I think it is time to change our strategy.” Pulickal, vice chair of the plan-
ning group, cautioned that viable future transportation alternatives need to be carefully considered, pointing out light rail, with its comparatively high cost, might not be the best option. “Self-driving cars and automated trains could be in the future,” Pulickal said, noting, “I'm strongly against long-term plans with rail as a proposed solution.” The community planner added he’s “strongly considering forming a citizen group to strengthen support on this issue,” pointing out, “Anytime I talk to someone about this issue, they are easily persuaded by the strength of the evidence and logic associated with supporting driverless cars instead of train lines.” Pulickal believes that “driverless cars are the most exciting transportation tech coming out in the next few years.” He pointed out that “car sharing users have already reduced car ownership by nearly 50 percent across 20 metro areas in the United States and Canada. These same car sharing companies (such as car2go) and car companies (Tesla and all major manufacturers) are investing billions in driverless technology.” Pulickal said transportation planning needs to be forward-thinking. “What will reduced car ownership and reduced traffic do to our current traffic and parking concerns?” he asked. Business 99 Cups of Coffee and more as the eatery expands By DAVE SCHWAB A year ago, UCLA engineering grad Broc Chavez and some family members opted to go into business for themselves opening a coffee boutique in Pacific Beach named 99 Cups of Coffee. Things have gone so well that Chavez has acquired the retail space next door for expansion. Formerly a smoke shop, that space is in the process of being renovated by Chavez to add to the coffee shop. “We’re going to have a full kitchen and prep sink over there, which will allow us to bake our own bread and wash our own produce, which we get pre-washed now,” said Chavez of his establishment at 4680 Cass St. He added he’d like do more things from scratch, like “making our own marshmallows.” A self-professed coffee “nerd,” Chavez tried engineering work for a while but “got tired of that and decided it was time to open a coffee shop.” Chavez said acquiring the retail space next door will allow him to go from nine to 30 seats indoors plus add more patio seating. The new expansion will also help Chavez develop a cleaner, newer look to his shop as he adds stainless-steel countertops and the like.

Something of a conversation piece at 99 Cups is a giant clock on the wall that points out it’s always time to drink coffee. Chavez said his location is great, gets lots of foot traffic and is squarely in the heart of town near Pacific Beach Post Office. It’s all part of the growing, ever-changing mix of commercial retail in the area. Ninety-Nine Cups offers locally roasted, fair trade and organic coffee as well as sandwiches and pastries. Eventually, Chavez intends to have a full-service deli. The boutique continues to have a daily meal deal for a sandwich, chips
and a drink. The business also has a soda fountain and serves daiquiristyle smoothies to go along with its array of coffees. Ninety-Nine Cups is also a family affair. Chavez’s sister works as his manager. El Trebol Mariscos is a new Mexican mom-and-pop in Pacific Beach. Translating as “the clover seafood” in English, the new establishment, at 2015 Garnet Ave., No. 102, is a hybrid of styles. The name derives from the fact that the owner’s birthday is March 16, the day before St. Patrick’s Day. “I tried to create a restaurant and a sports bar,” said business owner Sergio Vivaurri. “It’s like being in Mexico without crossing the border.” A native of Tijuana, Vivaurri said Mexican food at El Trebol is the “real” thing. “If you’ve gone to Ensenada and had a fish taco, it’s the same taste; we use the same ingredients,” he said. “I want to be as Mexican as possible,” he added. “I don’t want to sell something advertised as Mexican and not taste like Mexican. That’s the difference between me and the others. All the recipes and ingredients and everything come from Mexico.” El Trebol opened May 1 in a retail space that was formerly a barbecue place. Opening a restaurant was a radical departure for Vivaurri, who previously was in the used car business. “It started as an experiment,” he said. “My friends encouraged me to

open it.” Vivaurri noted the original concept was to have a food truck. But after talking it over, he and his associates opted instead to create a new kind of restaurant to “try and make a difference” as well as to expose people to “natural Mexican” cuisine. The restaurateur said it took him about a month to remodel the space working long hours, with he and his friends doing all the remodeling themselves. The restaurant’s décor, too, is an interesting admixture of Baja and beachy. There’s a huge fish aquarium, a centerpiece, in the rear. “I like fishes; it’s kind of relaxing,” Vivaurri said. El Trebol’s menu features fish, shrimp, scallops and other seafood. There are about a dozen different taco choices. “An item with bacon, shrimp and fish is one of our top sellers,” Vivaurri said. “Another top seller is tuna.” The menu also includes about a half dozen types of burritos as well as flautas and sopes. “Chips and salsa are complimen-
tary; we don’t charge for it,” Vivaurri said, claiming his prices are “the lowest on the market.” A taco plate is in the $4-$5 range. Ceviche, which just won an award at Fat Fish as the people’s choice in PB, is $3.50. Of his fish taco plate, Vivaurri said, “You eat two and you’re full.” Restaurant-sports bar hours are 10 a.m. to 10 p.m. daily. Vivaurri said he got a fair amount of business from tourists during the busy summer season. But his breadand-butter clientele are locals, adding that played into his choice of décor. “I didn’t want to be too fancy, but I wanted to be an upscale seafood place,” he said, pointing out that’s why he has trendy furniture that is not plastic. El Trebol started with four employees. That number has grown to 10. Vivaurri pointed out he’s just one of the gang. “If you come in here, you’ll see me washing dishes or waiting on tables,” he said, adding, “Some people don’t even know that I’m the owner.” Will there ever be a chain of El Trebols? “If we ever do, we’re going to have the same good service and treat everybody the same,” Vivaurri said. “Service, that’s the most important part. That makes the difference.”

Community Celebrate with pierogies and polka at PB's Polish Festival One of Pacific Beach’s signature events, the annual Polish Festival at St. Maximilian Kolbe Roman Catholic Church, will be Friday and Saturday, Oct. 9 and 10 at 1735 Grand Ave. This is the 20th anniversary for the colorful Polish Festival, an annual fundraiser for St. Maximilian, which is a tribute to Polish heritage, culture and cuisine. One of the area's most popular ethnic festivals, the event features Polish song, dance and food. It attracts people from all over San Diego as well as international visitors who want to get a taste of what Poland is all about. "This annual fundraising event – already our 20th – is one of the most popular ethnic festivals in the Pacific Beach area," said Bogdan Maziarz, head of the festival's organizing committee. "For those who want to learn more about our mission and also join in prayer, daily Mass and tours of the church will be offered. The church building was recently renovated and features magnificent stained-glass windows portraying patrons of the Mission. Veneration of the relics of St. John Paul II, St. Maximilian Kolbe, St. Sister Faustina, Mother Teresa of Calcutta, St. Padre Pio and other saints will also be offered." On the menu will be traditional Polish fare: pierogies (dumplings stuffed with sauerkraut or potato and cheese), golabki (meat-stuffed cabbage rolls), bigos (Hunter’s stew), potato pancakes and grilled kielbasa (Polish sausage), which are
all worth the turnout. The festival menu is rounded out by Polish pastries and soft drinks, coffee and tea. There is also a beer garden for ages 21 and up, which will feature wellknown Polish beers like Zywiec, Okocim, Tatra and Warka. Event entertainers will include Polish folk-dance groups Polonez from San Diego and Krakusky from Los Angeles, 224 Kosciuszko Polka Band and Il Giardino d’Amore baroque chamber orchestra from Vienna. There will also be a polka band and a DJ entertaining festival guests. St. Maximilian was built in 1995 in Pacific Beach to serve the Polish community, a large number of whom who emigrated from their native land during the Solidarity labor-union movement of the 1990s. The church is named for St. Maximilian Kolbe, a Franciscan friar and World War II-era hero who voluntarily sacrificed himself in the place of a stranger at the infamous Auschwitz concentration camp. Kolbe provided shelter to refugees from greater Poland, including 2,000 Jews, whom he hid from Nazi persecution in his friary until he was arrested by the German Gestapo and imprisoned. While imprisoned, Kolbe volunteered to take the place of a man condemned to be starved to death. In his cell, Kolbe led men in songs and prayer. After three weeks of dehydration and starvation, only he and three others were still alive. He was murdered with an injection of carbolic acid.

Dignitaries from Xiamen University and from Confucius Institute at Sam Diego State University attended the event with board trustee Michael McQuary, Anne Rosser from Kiwanis, sixth graders, ASB students, and parents and students in PB Middle’s Mandarin Chinese language program.

The Mission Bay varsity girls volleyball team took first place in the 12th annual Bucs Bash Tournament this past weekend. Competing against teams from all over San Diego County, MBHS volleyball, led by coach Steve Upp, swept the tournament, winning every single game. They won all their matches in two, against every team, to win the championship and take home the trophy. The Bucs are the top-ranked volleyball team in their league, with a 14-3 record. Apparently, San Diego is sexy. At least that's what Victoria's Secret's Twitter fans concluded. The popular lingerie company recently released its 2015 What Is Sexy? List, and America's Finest City earned the Sexiest City title, via voting on Twitter. That honor came with a reward – Victoria's Secret Angel Martha Hunt – who visited the company's store at Fashion Valley Mall Saturday afternoon. That's where I come in. Local scribes were given around five minutes each to speak with Hunt and discuss the sexiness of San Diego. Ushered in by a publicist after a 20-minute delay, I had my chance to question an angel. Hunt, blonde with blue eyes, wore a skintight dark blue dress with high heels, stood in front of a wall of colorful bras and sipped iced coffee. Me? Bulky and bearded, I wore my best flipflops and couldn't help but feel sexy. I did my homework on Hunt. She's 5-10, from Wilson, N.C. and a 26-year-old model. OK, there wasn't much to go on. I played the interview straight at first, but somewhere along the way the subject of animal husbandry and horny pandas got her giggling. How did we get there? Read the conversation below and, as always, stay sexy, San Diego. TM: What's the sexy list? MH: It's about honoring the hottest, most inspiring women in Hollywood. And this year the fans got to vote for a couple of the categories, and that's why San Diego won sexiest city. That's why we're here. The list has the sexiest eyes, sexiest bikini body, sexiest smile, sexiest legs, sexiest sense of humor, which went to my girl Amy Schumer – I think she's hilarious. TM: You were in Taylor Swift's
'Bad Blood' video? MH: I was. It was awesome and exciting. I was Home Slice because I slice people with my swords. Taylor is a pal. She won sexiest legs. Can you think of someone who deserved it more? Her legs are incredible. TM: You did your first runway show in Paris? MH: Yes, my first runway show was in Paris. I was 18. I didn't do any runway until I graduated high school. Sort of went from Wilson, N.C. to Paris. I stopped in New York City briefly but then went on to Paris.
TM: Yes, that's the first thing I look for in a city. I thought about Miami or L.A., but decided on sexy San Diego. I thought I would fit right in. TM: What else do you like about San Diego? MH: The people, the energy and the food. The food is great here. TM: How was your fish taco for lunch? MH: How did you know? Did someone text you that? Can you smell it on me – oh, that's not sexy.

CPC insists the current municipal code is clear that vacation rentals are transient occupancy visitor accommodations, which are a prohibited use in residential zones. “The latest ordinance revision proposal by the city's Development Services Department, which answers directly to the mayor, is unacceptable,” Curry continued. “It would allow free reign for short-term vacation rentals (both hosted and whole house) in all residential zones. This misguided policy would legitimize having commercial hospitality uses in all residential neighborhoods. “Apparently, the city envisions the benefit of transient occupancy taxes to outweigh the considerable negative impacts to residents. Hopefully, the city will listen to the CPC and residents and revisit their STVR policy,”
Curry said. Longtime PB resident and activist Marcie Beckett concurred that the CPC’s recommendation on STVRs are a step in the right direction. “The CPC recognizes that wholehouse STVRs damage communities by displacing long-term residents and by diminishing housing supply,” Beckett said. "They want the city to do its job to protect our residential neighborhoods for the citizens who want to live in San Diego.” STVR industry spokesman Jonah Mechanic has defended the proponents’ position that “STVRs bring many tangible benefits to homeowners, residents, travelers, neighborhoods and local businesses as well as economic health to cities in which they are allowed to thrive.” “Recent studies have shown that visitors who stay in STVR accommodations spend more on local businesses and are more likely to be return guests to the market as a result of

members who rent on a short-term basis often rely on it to supplement their income. The financial security this provides to homeowners plays an important role in neighborhood resilience.” Ronan Gray, president and spokesman for Save San Diego Neighborhoods, a group opposed to STVRs in residential zones, was also pleased by the CPC’s recommendations. “This is a big step forward for San Diego residents in communities all across the city and county who have been asking the City Council to simply enforce the existing municipal code, which clearly does not allow these commercial operations in residential zones” said Gray. “CPC recommends that the city uphold and enforce its existing municipal code. “The committee also recommended changes be made to the municipal code section regarding boarder and lodger accommodations, which would allow home sharing where the

their experience,” Mechanic said. “These guests distribute the economic benefits of tourism to neighborhoods that would not otherwise receive them, allowing for opportunities of growth and revitalization at a truly local level. More money spent outside of traditional tourist neighborhoods strengthens communities and businesses, a benefit to all residents.” Mechanic added that “community

homeowner is present on site during the visitor stays with some restrictions on the minimum length of stay and maximum number of lodgers allowed.” CPC chair Joe LaCava noted the STVR process “is being fast-tracked as everyone agrees that clarity in the regulations is to everyone’s benefit." Moving forward, LaCava said the CPC recommendation will be bundled with recommendations from the Technical Advisory Committee and the Code Monitoring Team for Planning Commission consideration in late October. From there, LaCava said the issue will be forwarded to the City Council. “This will not be going back to Smart Growth & Land Use Committee,” LaCava said, adding, “We could have final action on new language by early November. Of course, the new regulations would not apply in the coastal area until they are ratified by the Coastal Commission.”
