Mayor Randy Rowse may have tested positive for COVID-19, but you couldn’t tell it from the way he answered the phone Monday. “I’m good, thanks,” he told the News-Press. “What’s going on?” The mayor, who stressed that he’s asymptomatic, said he tested negative Monday, three days after a rapid at-home testing kit revealed he had been infected with COVID-19. He began taking Paxlovid on

advice from his doctor. Doctors prescribe the antiviral drug to reduce the risk of severe illness for people infected with COVID. He plans to speak with his doctor again on Wednesday, and if he tests negative again, he could be cleared to attend this year’s Old Spanish Days Fiesta festivities, which begin later that day with La Fiesta Pequena, scheduled for 7:30 p.m. at the Santa Barbara Mission. The Fiesta Historical Parade will return this Friday after three years of pandemic-related interruption. Known for its horses, dancers and floats, the Old Spanish Days procession is scheduled to run from noon to 3 p.m. However, rather than streaming down State Street as in previous years, the parade will begin staging by the Carriage and Western Arts Museum on Castillo Street, then proceed down Cabrillo Boulevard for about 3 miles until the Chromatic Gate between Milpas Street and Calle Ceasar Chavez. That’s where the procession will turn and head back down Cabrillo. The change in route is due primarily to the advent of restaurant parklets that have come to line State Street, the parade’s longtime home, during the COVID-19 pandemic. “I think it’s going to be a good route,” parade chairman Gary MacDonald said in an interview with the News-Press. “It’s going to be wider (than the State Street route), more people will be able to see the parade, and I think it’s going to make for a better family event just because it has the beach right there where the kids can play.” “We’re going to have this same kind of weather (that Santa Barbara has been experiencing) where it’s muggy and humid, probably in the mid-to-low 80s, so we’re hoping it’ll be cooler on the Cabrillo route because of the sea breeze,” added chief of

The parade will feature close to 800 participants in the procession, as well as more than 400 horses from Santa Barbara County, Arizona, Nevada, as well as other areas of California including Chico, San Diego and Temecula. “They’ve been a big supporter of Fiesta. They’re a community company, and they do a lot for Santa Barbara and the parade,” Mr. MacDonald told the NewsPress. “We’ve got them in a really nice stagecoach with a four-up team pulling it, which means two pairs of horses. It’s going to be impressive.” In addition to familiar Fiesta parade mainstays such as the De la Guerra wedding party, a few new sights will also be on display for parade watchers. Among these

will be floats for Santa Barbara Unified School District, as well as for this year’s La Presidente, Maria Cabrera, who usually rides on a horse. Additionally, the Presidentes of the 2020 and 2021 Old Spanish Days Fiestas will also be honored with a float after their parades were canceled due to the pandemic. (The Center Square) – Republicans have a sizable edge over Democrats as the midterm elections draw closer, according to a new poll. Updated CBS News’ Battleground Tracker data now projects 230 House seats for Republicans, compared to 205 for Democrats. Currently, Democrats have a slight majority in the House 221 to 214. If Republicans retake the House, Speaker Nancy Pelosi’s four-year run in charge would be over. Midterm elections have featured big losses for the party of the incumbent administration in recent years for both Republicans and Democrats. The latest polling shows that the same pattern is projected to repeat itself unless something changes. Real Clear Politics polling currently predicts 47 Republican U.S. senators and 46 Democratic senators with 7 marked “tossup.”

At the same time, President Joe Biden’s approval rating has steadily dropped since taking office. Gallup’s approval rating hit a new low for President Biden over the weekend, dropping to 38% with 59% of Americans disapproving. “A year ago, Biden’s honeymoon period came to an end when his approval rating dropped to 50% amid a surge in U.S. coronavirus cases,” Gallup said. “Since then, his public support has eroded after the chaotic U.S. withdrawal from Afghanistan, the highest inflation in four decades, recordhigh gas prices and continuing supply chain issues.” Those figures are lower than President Biden’s predecessors. “No president elected to his first term has had a lower sixthquarter average than Biden, although Jimmy Carter’s and Donald Trump’s ratings were only slightly better, at 42%,” Gallup said. “Barack Obama, Bill Clinton and Ronald Reagan also averaged below majority approval.”

The 98th Santa Barbara Fiesta Stock Horse Show returns this year with organizers promising spectacular performances and plenty of fun for everyone. The Horse Show and Rodeo at the historic Earl Warren Showgrounds, 3400 Calle Real, kicks off on Thursday and wraps up on Sunday. Enter gate B to park and follow the walkway to the equestrian arenas. The event will bring together the best horsemen and women from Santa Barbara, San Luis Obispo and Ventura counties as they show off their riding and roping skills. The public is welcome to come watch competitors in the

The city of Goleta’s Beautify Goleta Community Cleanup event cleared 734 pounds of trash across five different cleanup sites this past Saturday in what the city is declaring a “huge victory” in preventing trash pollution in neighborhoods, creeks and oceans. In addition to the trash collected by the event’s 80 volunteers, 7,966 pounds of furniture, mattresses and other items were collected from residents at the Bulky Item Drop-off for Fairview/Kellogg Neighborhood Spotlight. Of the total 8,700 pounds of waste that was collected by volunteers and at the Bulky Item Drop-off, 70% was able to be recycled rather than sent to landfill. “The city is grateful to all the volunteers who came out on Saturday to help Beautify Goleta,” Goleta officials said in a news

The judgment includes the following provisions: • $860,000 in civil penalties, including $46,120 to the Santa Barbara County District Attorney’s Office and $5,360 to Santa Barbara County Environmental Health Services. • $250,000 for supplemental environmental projects. • $250,000 for reimbursement of enforcement costs, including $9,250 to Santa Barbara County District Attorney’s Office and $400 to Santa Barbara County Environmental Health Services. ODFL also has to comply with environmental laws and regulations, employ a full time employee responsible for environmental, health, regulatory, and safety compliance, and submit annual status reports concerning compliance with the judgment. Shortly after prosecutors brought these matters to ODFL’s attention, ODFL developed and implemented new policies, procedures and training programs designed to properly manage and dispose of hazardous waste. ODFL cooperated with prosecutors throughout the investigation and evaluation of this matter. District Attorney Dudley said, “These violations posed serious risks to the environment, the public, first responders and company personnel. SANTA BARBARA — District Attorney Joyce Dudley announced Monday that her Consumer and Environmental Protection Unit, along with 15 other district attorney’s offices and one city attorney’s office, settled a case with Old Dominion Freight Line resolving allegations that the company failed to properly manage and dispose of hazardous waste at its facilities throughout the state. Old Dominion Freight Line agreed to pay $1.36 million for environmental violations. The judgment, filed this week in Orange County, is the result of a multi-jurisdiction investigation into numerous unlawful practices by ODFL, including illegal disposal of hazardous waste in ODFL trash receptacles, unlawful transport of hazardous waste out-of-state without proper documentation and without a transporter’s registration, and failure to train employees in the proper management of hazardous waste. These hazardous wastes included commercial chemical products, paint materials, electronic devices, batteries, ignitable liquids, aerosol products, cleaning agents, and other

GOLETA — Santa Barbara County sheriff’s detectives have arrested a Goleta man on suspicion of alleged lewd acts with a child and are reaching out to the community to identify any additional survivors. On May 3, detectives began investigating a report of lewd acts with a child that occurred at the suspect’s business in the 200 block of Pine Avenue in Goleta prior to 2019, sheriff’s officials said in a news release. As a result of their investigation into this initial report, detectives arrested the suspect, 79-year-old Samuel Camargo Reyes, also known as Samuel Reyes Camargo, on a warrant for lewd acts with a child under the age of 14, a felony. Mr. Reyes is being held on $500,000 at the Main Jail in Santa Barbara. Detectives strongly believe there are additional survivors of sexual assault who have not yet been identified. Detectives believe Mr. Reyes had access to other children at his business, which is located at the corner of Pine Avenue and Gaviota Street in an unmarked office space where he has sold nutritional supplements since approximately 2011. SANTA BARBARA — Heal the Ocean is urging Fiesta residents and visitors to be “extra confetti conscious” this year to prevent any litter from entering storm drains and ending up in the ocean. “Fiesta is around the corner, which means we all need to be extra confetti conscious to ensure our streets, sidewalks, parks, creeks and ocean remain clean and safe from litter!” Hillary Hauser, HTO executive director, wrote in the group’s newsletter. “Plastic, mylar, glitter and sequin confetti does not biodegrade,” she said. “Instead, it goes down the storm drain and into the ocean where wildlife mistakes it for food.” A few Fiestas ago, HTO was approached by the city about covering storm drains to prevent confetti from getting into them, and consequently the ocean, she said. “Together we created a map of storm drains to cover before festivities start.” This year, HTO Operations Manager Jasmin Tupy and HTO Operations Intern Sydni Trigueiro worked with the city on an updated map because the parade has been moved to Cabrillo Boulevard, between Castillo Street and the Chromatic Gate near the Hilton Santa Barbara Beachfront Resort, Ms. Hauser said, adding “State Street is expected to get its usual share of confetti, too.” Additionally, Heal the Ocean is providing the services of Andrew Velikanje and his Earthcomb crew to work on keeping the streets clean during Fiesta. “All of us can help in this effort to keep our streets and gutters clean,” Ms. Hauser said.

(The Center Square) – Kansas voters will decide Tuesday whether to amend the state constitution so that it says there’s no right to abortions. The proposed amendment would also give state lawmakers the power to pass abortion-related legislation. The measure, titled the “Kansas No State Constitutional Right to Abortion and Legislative Power to Regulate Abortion Amendment,” comes in the wake of the U.S. Supreme Court’s ruling in Dobbs v. Jackson, which overturned the landmark Roe v. Wade decision. In 2019, the Kansas Supreme Court ruled that abortion is a fundamental right under the state constitution, but Republican legislators voted last year to put the issue on the ballot. Organizations in the state have lined up for and against the proposed constitutional amendment. Organizers hope to return parade to State Street in future

Critics say amendment is unnecessary as abortion is already heavily regulated KANSAS

Planned Parenthood Action is also active in advocating against the measure, saying on its website, “Kansas can either be a state where abortion remains safe and legal, or a state where it isn’t.” Mackenzie Haddix, spokesperson for the Value Them Both Coalition, which backs the measure, said a yes vote would “protect moms and babies from an unregulated, unlimited abortion industry.” Kansas Catholic Conference Executive Director Chuck Weber told The Center Square that passage of the amendment is critical for Kansans who seek a civil discussion about the volatile issue of abortion policy. “According to the Kansas State Supreme Court, all laws touching on the issue of abortion are now ‘presumed unconstitutional’ (page 72 of the Hodes ruling),” Mr. Weber said.

While organizers are excited for the return of the parade, they’d like to see the route go back to State Street in the future, and they’re providing input on the city’s State Street plan to hopefully make it a reality within the next two years. “We’re coming up on the 100year anniversary (of Fiesta) in two years, so that would be the preference to be able to go back to our roots and be able to do it on State Street,” said Mr. MacDonald. “It’s historical. We’ve done the parade there for nearly 100 years. It’s just the history, the ambience of downtown, and I think Santa Barbara is used to that tradition.” “We’re not against the idea of State Street as a promenade,” he continued. “But make the

restaurant parklets mobile so they could move them off State Street just for the day.” The route down Cabrillo will result in the following street closures on Friday: Beginning at 6 a.m. • The 00 and 100 blocks of Castillo Street. • The 300 block of W. Mason Street. • The 400-700 blocks of Shoreline Drive • Cabrillo Boulevard between Castillo and State streets will be restricted to local traffic only until 11 a.m. Beginning at 11 a.m.: • Cabrillo Boulevard between Castillo Street and Corona Del Mar. Buses, taxis, and local deliveries will be allowed until 11:30 a.m. Street sweeping will begin immediately after the parade and will reopen streets block-by-block as they are swept, with all road

closures expected to be lifted by 4 p.m. Parking on Cabrillo Boulevard will also be restricted starting at 6 a.m. The Palm Park Lot, located at Cabrillo and Garden streets, will remain open for parking until 11 a.m., after which no cars will be allowed in or out until street sweeping is completed following the parade. Due to limited parking near the event, Fiesta and the Downtown Organization are partnering with the city of Santa Barbara to provide free trolley rides from various locations downtown between 10 a.m. and 5 p.m. Those who use the service will be dropped off on State Street near the Amtrak station just one block from the parade route. Two of the three trolleys will be ADA- and wheelchair-accessible, according to Santa Barbara city officials.

“We want to be able to get people who would normally be able to walk to State Street to participate” with the new route, said Mr. Miller. “We want to make sure elderly folks and families have the ability to easily get down to Cabrillo.” Pickups for the free trolley service will occur at the following locations, with pickups scheduled every 10 minutes: • The 900 block of Chapala Street near City Lot 2 • The 1100 block of Anacapa Street, next to the Central Library, across from the Santa Barbara County Courthouse, and between the Library Garage and the Granada Garage • The 600 block of Anacapa Street near Ortega Street and next to City Lot 10 For more information, visit sbfiesta.org. email: jdaniels@newspress.com

Asked how he contracted COVID, he quipped, “I don’t know. How did (President) Biden get it?” He said he probably got it from someone close to him who had tested positive. “It just happened,” he said, despite the fact that he’s been vaccinated and gotten two booster shots. “It’s not unusual to not feel anything from this variant, which is nice.” Mayor Rowse said some of his fellow city council members have tested positive for

COVID. “I know it’s gone through there.” The mayor attended the past two council meetings in person without wearing a mask, but said Monday that council members sit “pretty far apart” from each other so no one was at risk. Born the third of nine siblings in Calvillo, Aguascalientes, Mexico. He had only the chance to get through fourth grade. He left school and had to begin working to help the family. At nine years old he hustled and bustled through his formative years and always made sure to protect his siblings and help provide for his younger brothers and sisters. He decided at the ripe age of 21 to make a leap RI IDLWK DQG JR WR WKH 8 6 +H FDPH WR ÀQG D ´EHWWHUµ OLIH and send money back to his mom and dad in Guadalajara from where he ultimately settled for over 55 years in Santa Barbara. It was during that time that he found and worked his way into the heart of the love of his life that would become his wife of 49 years, Maria Luisa Valdez. With hard work, love, and determination they laid a beautifully strong foundation for their children Alfonso, Jaime and Annel. A life formed and centered around love, devotion, and joy that continues to this day. Innumerable reunions with family and friends were the hallmark of his life well lived. Hard work was always a signature of the family. Thirty plus years in construction work provided a different opportunity generated through the Laborers 591, introduced by his cousin and longtime supporter, Aurelio Torres. Beyond the work, came a love of the game of golf that connected him to countless people from all walks of life and cemented a bond with his sons that can never be replaced. His love for his wife precluded all serious conversations because he recognized WKH LPSRUWDQFH RI KHU SDUWQHUVKLS HYHQ XQWLO KLV ODVW GD\V KH XQVHOÀVKO\ JDYH FUHGLW to the principal role she played in their success and the upbringing of their children and generations to follow. His soft spot was a unique relationship with his daughter, a.k.a. La Negra or as he would say his baby. Among all things important to him, his grandchildren in many ways brought him his greatest joy. He leaves behind a legacy of friends, family, and ability. Those who were fortunate to know him, felt not only special but loved. He will be sorely missed by many but will equally be remembered as the person that made them feel special. His wife Maria Luisa, sons Alfonso and Jaime, daughter Annel, daughter-in-law’s Grace and Kelli, and grandchildren Diego, Mia, Valeria, Eliana, Amiya, and Vida were physically present at his passing along with prayers and genuine sentiment from direct and indirect family and will forever be grateful for the life lived and the example he provided of what a life well-lived truly means. Dancers, including Tara Mata, the Spirit of Fiesta, and Layla Gocong, the Junior Spirit, performed at the reception. (There will be

Go, Krypto! “DC League of Superpets” soared to the top of the box office in its opening weekend with a gross of $23 million. The movie earned fans’ respect with a story and dialogue that entertains both kids and adults. And Dwayne “The Rock” Johnson, who knows how to be funny by acting very serious, is the ideal choice as the voice of Krypto in a movie that blends comedy, drama and Easter eggs for longtime comic book fans. And the animators did a great job creating Ace, a shelter dog who brings Krypto down to earth,

in a story about empowered pets saving Krypto’s buddy Superman (John Krasinki) and other heroes in the Justice League of America from an unexpected villain. The animators obviously enjoyed matching Ace’s eye movements and facial expressions to the comedic beat delivered by the voice actor behind Ace, Kevin Hart. Falling to second place at the box office was Jordan Peele’s scifi/horror thriller “Nope,” with a $18.5 million gross in its second weekend. “Thor: Love and Thunder” placed third with $13 million. “Minions: The Rise of Gru” was the No. 4 movie with $10.9 million. “Top Gun: Maverick” placed

fifth with $8.2 million. Placing sixth was the movie based on a bestseller, “Where the Crawdads Sing.” It grossed $7.5 million. “Elvis” has not left the building. It remains in the top 10 movies, placing seventh with $5.8 million. The horror thriller “The Black Phone” placed eighth with $2.5 million. “Jurassic World: Dominion” was in ninth place with $2 million. And “Vengeance,” a movie about a journalist investigating the death of a woman he knew, opened in 10th place with $1.75 million.

can feel it when my partner is upset with me. She can be as sweet as honey, doing her thing on the other side of the house, maybe on the other side of the planet, and I can still feel the uncomfortable vibes. You see, there are no secrets in a relationship, not really. It’s true for most of us. We can sense when something isn’t quite right, even if you can’t put a finger on exactly what it is. We go through the day just a little off-balance because the person with whom we share our home and heart is disgruntled for some reason. When the two of you stop talking, you are in trouble. I have seen couples do this dance for years. Silently upset with one another, doing or not doing little things that annoy their partner. The more we internally struggle with dark feelings, the deeper we sink into them. The answer here is to identify that something is going on and to ask your partner to sit down with you, so the two of you can talk, seriously and with kindness. The

conversation could go something like this: “Honey, I feel like you might be upset for some reason. Would you like to talk about it?” If your partner says, “No, not right now,” then you should ask when would be a good time to talk that day, so you don’t let the negative energy fester. The longer you let it go, the stronger it gets, and it becomes harder to find the words. Once you agree to discuss the feelings, you should do it face to face in a secluded place, so you are both comfortable sharing what’s going on for you. Give yourselves at least one uninterrupted hour to resolve the issue, but it’s OK if you get it cleared up sooner. Keeping your hurt or anger inside and trying to make your partner see what you are feeling is a fool’s errand. If you want your partner to know what has raised your ire, speak up! I guarantee you that your mate isn’t psychic enough to read your mind, and at this point, you need to give yourself a little clarity about why your knickers are in a twist and

ask yourself if your anger is really worth it. Walking around your home like two tigers in a cage isn’t going to accomplish anything other than wearing out your carpet. Again, all it takes is a little initiative to start doing something constructive, like talking to your partner. What you will most likely find is that the issue wasn’t all that big, or that there was a complete misunderstanding. Add a simple apology, try to discover the genesis of the discomfort so it doesn’t happen again, and you’re good to go. It all starts with honoring what it is you are feeling and having the bravery to bring it up to the one you love so that you can both feel good about each other once again. Nichelle Nichols inspired generations of fans

As Nichelle Nichols came forward in her wheelchair down an aisle in a ballroom, she blew kisses enthusiastically to the fans she inspired. That was last December at Los Angeles Comic Con, where she was given an hour-long tribute at the Los Angeles Convention Center for the ways she’s inspired everyone from “Star Trek” fans to astronauts to actresses. “I am only here because of her,” Soenqua Martin-Green, a black actress who stars today as Capt. Michael Burnham in “Star Trek: Discovery,” said in a video message as Ms. Nichols and her family and a large ballroom of fans watched in December during Los Angeles Comic Con. Ms. Nichols impressed people such as Dr. Martin Luther King Jr., who told her she needed to continue to play Lt. Nyota Uhura, one of the early, non stereotypical roles for black actors on “Star Trek.” Ms. Nichols was one of the first black actresses in a major role in TV. Ms. Nichols, who died Saturday at age 89 at Silver City, New Mexico, went beyond playing a communications officer in the original TV series and the subsequent six movies starring the original “Star Trek” cast. At NASA’s request after “Star Trek” went off the air, she worked to recruit minorities and women as astronauts. “Ultimately she devoted her entire life to the progress of

black people, people of color and women,” Ms. Martin-Green said. “She gave everything, her time, her energy, her intelligence, her wisdom, her leadership, her heart for the betterment of the world.” A NASA representative, Denise Young, presented Ms. Nichols at the December tribute with a public achievement medal, for her success in recruiting minorities and women for the astronaut corps. And the tribute host was an astronaut: Dr. Mae Jemison, the first black woman in the astronaut corps and the first woman of color to go into space. The engineer, physician and former astronaut was a fan of not only Uhura but the actress who played her since she was a child. She said she wasn’t among those recruited by Ms. Nichols in the 1970s and ’80s for NASA, but found out about a “Star Trek” convention in the 1990s in Orlando, which wasn’t too far from her work at Cape Canaveral. She showed up unannounced at a “Star Trek” convention, and when Ms. Nichols heard the astronaut wanted to meet her, she said, “You have Mae Jemison outside? Bring her in!” “We’ve been buddies ever since,” Dr. Jemison said. “And I’ve started every work session with the words ‘Hailing frequencies open.’” In addition to Dr. Jemison’s tribute, NASA administrators recorded video tributes for Ms. Nichols, and there was a video montage of various women at NASA who praised her for inspiring them. When Ms. Young of NASA read a speech honoring Ms. Nichols

during the medal presentation, fans in the audience teared up. “Ms. Nichols, NASA honors you for truly and boldly going where none other have gone before, for your influence in making NASA a more diverse and inclusive agency for people of all backgrounds, for your unforgettable influence and your legacy,” Ms. Young said. “Therefore, on behalf of the NASA leadership, its workforce and myself, I am so honored to stow upon you the NASA Exceptional Public Achievement Medal.” At that point, fans were allowed to come up and take photos of Ms. Nichols, and her son, Kyle Johnson, held a microphone and thanked NASA. “Of course, I’m very proud of all she has done and the meaning of her work, not just as an actress but the very real and important work she inspires and enables others to undertake,” Mr. Johnson said. “We see and feel and experience the effects of that work so often and so profoundly that we actually forget how important it is and what a miracle it is and how it benefits all of us deeply.” After that, groups of fans took turns taking photos of Ms. Nichols with various guest stars who worked with her in episodes of the original “Star Trek” series. (The Center Square) – One explanation given by Texas Attorney General Ken Paxton’s office to not declare an invasion at the southern border is at odds with a legal analysis published by a Washington, D.C., think tank and of a Navy JAG officer and national security law expert. Mr. Paxton’s office’s interpretation of 18 USC 242, First Attorney General Brent Webster said last week, is one reason why Mr. Paxton won’t be declaring an invasion. The statute was established in 1886 after the Civil War and broadened in 1874 through the Fourteenth Amendment. The statute, Mr. Webster said, “basically says if you violate someone’s rights under the color of the law and you cause their death, you’re subject to the death penalty yourself. No one’s explained how we get around that statute if we use war powers.” Instead, Mr. Paxton’s office’s goal is to challenge a 2012 U.S. Supreme Court ruling, Arizona v. U.S., which is the “biggest problem to states stepping in and stopping this invasion and stopping this illegal immigration,” Mr. Webster said. In it, the majority of the court struck down portions of an Arizona law authorizing state law enforcement officers to make warrantless arrests of foreign nationals suspected of being in the U.S. illegally. But the Center for Renewing America argues the issue isn’t about immigration but about state sovereignty. Navy JAG officer and national security law analyst Jonathan Hullihan argues Supreme Court Justice Anthony Scalia’s dissent in Arizona actually predicted the need for Texas to declare an invasion. The center’s extensive analysis of 18 USC 242 draws the opposite conclusion of Mr. Webster’s: federal law doesn’t criminalize the conduct of state officials when they act to repel an invasion. The center argues that border states “have the ability … and … responsibility … to invoke their constitutional authority, explicitly stated in Article I, Section 10 of the Constitution to declare an invasion and secure the border, particularly in light of the federal government’s refusal to carry out its Article IV, Section 4 duties to the states to protect them from invasion.” It argues “Article I authority to declare and respond to an invasion is clear,” which Arizona AG Mark Brnovich’s historic opinion declaring an invasion affirmed. While Gov. Greg Abbott has suggested that declaring an invasion could make Texas law enforcement officers and guardsmen susceptible to being detained and prosecuted by federal authorities “presumably under 18 U.S.C. § 242.4,” the center argues, “neither Article I of the Constitution, the statute’s text, its legislative history, nor its case law to date, justifies” such a concern. In other words, Section 242 doesn’t trump the U.S. Constitution. Because of these and other factors, the center argues there doesn’t appear to be “a significant threat of such prosecutions in the event that a border-state governor

declared an invasion and used state personnel” to repel it. “State agents removing invading aliens … to Mexico face a very-low risk of successful prosecution,” the analysis states. Neither the 14th Amendment nor Section 242 were designed to “hamper” states’ invasion responses or “cramp the powers of state officers responding to external invasions.” Mr. Brnovich’s opinion addressed the presence of largescale, stateless transnational criminal organizations facilitating an invasion using human, drug and weapons trafficking and smuggling as a “substantive justification for the invocation of Article I authority to repel that invasion.” At least eight Texas counties and one city have declared an invasion, with more expected to follow. Gov. Abbott hasn’t declared an invasion although he’s taken unprecedented action to thwart criminal activity coming through the southern border. If federal officials were to arrest state actors under Section 242, they’d face “numerous, unprecedented political, policy, logistical, and legal hurdles,” the center argues. When it comes to Arizona, Mr. Hullihan says Justice Scalia predicted in 2012 what is happening now. His dissent was “a cautionary prediction” that the federal government would leave border states unprotected. Justice Scalia said the majority opinion “deprives states of what most would consider the defining characteristic of sovereignty: the power to exclude from the sovereign’s territory people who have no right to be there. Neither the Constitution itself nor even any law passed by Congress supports this result.” Arizona also “left open the question of whether states can detain aliens who violate federal immigration law, and it appears Texas policy and legal strategy is focused on this Constitutional framework and line of caselaw,” Mr. Hullihan says. Gov. Abbott’s recent order cites the majority opinion “to avoid a legal pre-emption challenge” to his actions, Mr. Hullihan notes. But the Constitution’s Self-Defense Clause and Texas Constitution give Texas “the authority to act to protect the lives and liberty of our citizens, declare and repel invasions, and not be dependent on a litigation strategy that may or may not be successful,” he argues. “The problem” with Gov. Abbott’s and Mr. Paxton’s approach, Mr. Hullihan said, is “every action or position being taken is from the viewpoint of state enforcement of federal immigration law,” when the issue isn’t about that. “As Scalia feared,” the federal government has left states helpless and the constitution gives them the right to defend themselves. “The problem with the current strategy is a challenge to Arizona may or may not happen at some time in the distant future, which is certainly going to be too late when you consider the historic damage being done,” he said. As they plan for litigation, “the invasion continues,” he said, pointing to thousands of people smuggled and trafficked into Texas and thousands more killed by fentanyl.

Pennsylvania city, where 25% live in poverty, debates police funding By TOM GANTERT THE CENTER SQUARE

(The Center Square) - In a city where the median household income is $38,655 and 1-in4 residents live in poverty, the top-paid police officer in Pennsylvania’s fifth-largest city made more than $159,000 in 2021. And it wasn’t the chief. The city of Erie, population 94,831 in the 2020 census, is engrossed in citywide debate about the cost of law enforcement. Police spending is projected to increase 28% from 2019 to 2022, according to city budget documents. The city projects it will spend $38.8 million on policing in 2022. The police and fire departments spending makes up 66% of the city’s general fund expenses. Spending on public safety is increasing and Mayor Joseph Schember wants to hire 13 more officers and six detectives as part of a $14.1 million plan to use federal coronavirus relief money to pay for it. That comes at a time when city budget documents show the city’s general fund was in deficit in 2021 and is projected to continue to be in the red from 2022 through 2026. The city projects its general fund will be $8.7 million in deficit by 2026.

The city stated in 2021 that it cost $191,000 on average to fund one police officer with 14 years of service, the average amount on the force. That included a base wage of $86,916 and $104,200 in benefits and other costs. That figure would go higher if overtime were included. There were 30 employees of the police department who made $20,000 or more in overtime in 2021, according to city documents. One police officer made $68,992 in overtime in 2021, pushing gross pay to $159,345. Another police officer’s overtime was $60,935 with a gross pay of $147,724. By comparison, the police chief’s gross pay was $117,541. Nathan Benefield, senior vice president at the conservativeleaning Commonwealth Foundation think tank, questioned using one-time federal relief money for long-term expenses such as police officers. “It’s unwise to use one-time funds for ongoing costs. It raises a key question as to how the city would continue to pay for these officers in the future,” Mr. Benefield said. Police Chief Dan Spizarny, Mayor Joseph Schember and City Council Member Maurice Troop did not respond to emails seeking comment.
