How Real Estate Commissions Work In order to understand how real estate commissions are paid, it’s necessary to first understand the tool used in the vast majority of all home purchases: a Multiple Listing Service. Multiple Listing Services are essentially databases of all the homes for sale in a given market, maintained in most cases by local REALTOR® associations. Local REALTOR® associations also make most of this information publicly available for free, and each database often feeds home search sites. When a seller lists a property on one of these local broker marketplaces with a listing broker, they get access to the largest pool of possible buyers that have been brought to the marketplace by buyer brokers. Meanwhile, buyers can work with any broker and see ALL homes for sale. So where do commissions come in? Typically, the seller’s broker pays the buyer broker’s commission for finding a ready, willing and able buyer. This creates a larger pool of buyers for sellers and saves sellers time and money by working with an established group of brokers. For buyers, it saves them money at closing and enables the buyer to receive professional representation. The practice of listing brokers paying buyer brokers enables efficiency, effectiveness and accessibility for firsttime, low- and middle-income and buyers of all walks of life. This practice also has been the driving force behind a thriving American real estate market. From 2010 to 2020, this approach to commissions: • Enabled 88% of homebuyers to purchase their home through a real estate broker • Contributed to an $8.2 trillion increase in total housing wealth • Helped 6.3 million more new buyers become homeowners For the 90% of sellers who use a broker, they sell for 30% more on average than homes sold off the local broker marketplace as for sale by owner. That means someone working with an agent could get $390,000 for their home versus $300,000 if they tried to do it on their own. If this practice changed and sellers’ brokers stopped paying buyers’ brokers, what would be the likely outcome? • No centralized source of available
homes for consumers or brokers • Buyers would have to visit every broker in town to see all available homes • Outdated home status information • Fewer homes for buyers to choose from on real estate sites • Unverified, inaccurate and unreliable property information • Sellers would likely have to pay to list and advertise their properties on websites • Buyers unable to afford brokerages would have fewer options • Inconsistent broker information in listings across the marketplaces • Markets would be controlled by the largest brokers Facts About Commissions Commissions are always negotiable. The seller decides what fee they are willing to pay for their broker’s services and how much that listing broker should offer a broker who brings a buyer to close the transaction. Commissions can be negotiated at any point throughout the transaction, including at the outset and any time before the transaction closes. Broker cooperation benefits consumers. Broker cooperation in the commission process leads to brokers sharing their inventory with each other. In turn, that means sellers have access to the largest possible pool of potential buyers, and buyers have access to the greatest number of housing options in one place. Commissions cannot be included as part of a mortgage. The vast majority of mortgage lenders do not allow commissions to be added to home loans. Listing brokers’ offers of compensation to buyer brokers gives first-time and low- and middle-income homebuyers a better shot at affording a home and professional representation in the home-buying process. For many buyers, saving for a down payment is difficult enough, if buyers had to pay real estate commissions out-of-pocket on top of closing costs, it would push the dream of homeownership even further out of reach for countless people. Commission rates are determined by market forces. Commissions fluctuate over time and have notably de-
creased steadily in recent years. You get what you pay for. Local MLS broker marketplaces allow small brokerages to compete with large ones and provide for unprecedented competition among brokers, including different service and pricing models. So, you can choose from many commission models. Like with other things, you can expect someone with discounted commissions to provide a different service level. Those are choices to consider as you prepare to make likely the single most significant investment in your lifetime. U.S. real estate market is the world standard. The U.S. real estate model has long been viewed as the most consumer-friendly around the world. Buyers abroad are forced to wade through complex markets that require consumers to work with multiple brokerages to access fragmented inventory because listings are not shared freely in the marketplace. The result is more time consuming, impersonal and costly. FAQs Is there a “set commission” real estate brokers charge consumers? No. The market decides commission rates, and commissions are always negotiable. Consumers have the choice of who they want to pay and how they want to pay them. Because of the pro-consumer local MLS broker marketplace model, and options like a success fee, there is unprecedented competition among real estate brokers, especially when it comes to the service and commission options available to consumers. Why not require buyers to pay commissions directly to their broker instead of the historic practice of listing brokers paying the buyer broker? Forcing buyers to take on the additional out-of-pocket expense would cause them incredible hardship and would freeze many, particularly firsttime and low- and middle-income homebuyers, out from an already competitive market. That could also force homebuyers to forgo professional help during what is likely the most complex and consequential transaction they’ll make in their lifetime. How does the U.S. model compare to other, international broker marketplaces? The U.S. approach is the most con-
sumer-centric model. By consolidating fees and the overall process, our nation’s model simplifies the experience, provides greater certainty of success to both buyers and sellers, and provides guidelines that ensure the accuracy of housing inventory made available to real estate professionals and consumers, all at comparable or lower total costs than those in other countries. Why should real estate professionals make the money they do in commissions when so much information is available online? Real estate brokers provide essential guidance as consumers navigate the legal, financial and community aspects of a purchase, including everything from determining property value to negotiating the price. They also make local broker marketplaces, which online housing portals tap into, possible because of all the information they input into those databases. How does the current approach to commissions benefit small businesses? Access to inventory and free advertising as well as the practice of the listing broker paying the buyer brokers’ commission incentivizes participation in these local real estate marketplaces and creates the largest, most accessible and most accurate source of housing information available to consumers. That levels the playing field among brokerages, allowing small brokerages to compete with large ones, and provides for unprecedented competition among brokers, including different service and pricing models for consumers.

HOA Homefront Reader Questions
Your Handyman By Mark Baird
Sliding Closet Doors Question: The sliding closet doors in our bedrooms keep coming off the tracks, get jammed against each other and they are driving us crazy! My husband used to be able to get the doors back on track, but we now have two closets with doors that are jammed and we have given up. The doors are the original ones from when the house was built in 1964 and we would like to ask what can be done to fix these doors so I can get back into the closets! Your HandYMan: We get many service calls for sliding bypass closet doors and pocket doors that have come off track and even had one call where a lady in Montecito was trapped inside an upstairs bathroom by a jammed pocket door, managed to climb out the window and safely get back inside through another upstairs window that was open. The problem with the older style of sliding door is with the old above mounted tracks that support the rollers which are mounted on the top of the doors. These older tracks typically are in the shape of an open hanging “J” which allows the doors to come off track if they are pushed or lifted up rather than pulled horizontally from side to side. Often sliding doors can get hung up on carpeting or some obstruction in the closet, a person will then try to push up or lift the door in their efforts to open the doors to get into the closet, and the rollers then lift up and out of the track. Some sliding closet doors can be quite heavy and lifting them back onto the track can become a difficult task. Often the original sliding doors were installed over hard wood floors, carpeting was laid over the hardwood some time later and the bases of the doors were never trimmed to allow for the extra height of the carpeting. In this case simply removing the doors and trimming the base if the
doors are wood will get them back into working shape if the rollers and tracks are not damaged. If the rollers and tracks are worn out or if you just would like to upgrade the hardware, then the solution is to remove the old “J” style track and rollers and install the new style track and roller hardware that can be purchased at most hardware stores. The new style of track is shaped like the letter “C” mounted on its back and the rollers are like a little trolley that is completely enclosed inside the track. If installed correctly, it is impossible for the roller trolley to come off of the track and they will work correctly indefinitely. A typical 6’-7’ wide closet with 2 bypass doors should take about 23 hours to switch out the old track hardware with the new style hardware, assuming that the doors and closet frame are in good condition, and the hardware will cost about $150. We recently installed new hardware for a pair of old closet doors but also replaced the original slab style doors with new louvered doors, and it made for a nice improvement in the appearance of the bedroom. These same problems frequently occur with the old track and roller hardware for pocket doors however installing new hardware for a pocket door can be a bigger project depending on how the pocket door was installed, and what is involved with getting access to remove the old track. Replacing the track and roller hardware on a pocket door often requires that a 12” square foot opening is made in the drywall in order to get tools inside the pocket to remove the old hardware and install the new. If the drywall is carefully removed, it will be a simple job to use the same piece of drywall to seal up the opening. However, if the walls on the pocket door have cabinets or are tiled, then the project may involve temporarily moving the cabinets or making an opening in the tile.
Is there Double Jeopardy in HOAs, and Handling the Hateful? By Kelly G. Richardson, Esq. CCAL Kelly: If HOA failed to send letter to homeowner within fifteen days as required by Civil Code 5855, may they simply ignore that and hold another meeting or as many as they want, thereby removing the possibility if a homeowner’s using 5855as a defense? – P.M. Dear P.M.: As your question implies, Associations must in writing notify a member no later than 15 days after a disciplinary (or common area damage reimbursement) hearing of any action taken. Civil Code Section 5855 has several requirements which must be met, or per 5855(d) such action is “void.” “Void” means the HOA cannot enforce the disciplinary action or reimbursement claim. If the HOA errs in its process, it can restart the process (hopefully doing it correctly this time). There is no “double jeopardy” ban in the HOA world banning a second “prosecution,” unlike government criminal enforcement, so the disciplinary process can be restarted. Some lawyers, even HOA lawyers, contend that various constitutional rights apply to the “accused” of HOA violations, but this is clearly wrong – or juries would decide these violations not boards. Remember, these hearings are a group of neighbors trying to stop unneighborly behavior. Nobody is being incarcerated here! – Thanks for your question, Kelly Dear Mr. Richardson: Question: We have a resident who likes to instigate and fight with community members. Now she has the membership list and is sending out hatespeech and targeting certain residents. She is also a “racist” and it is awful What can be done? Our attorney says nothing. – E.E.

Dear E.E.: I am very sorry to learn of the hateful activity by your neighbor. If that hate is directed at residents because of their membership in one of the many protected classes in California (race, religion, ethnicity, gender, sexual orientation, and many more), the state Fair Housing regulations and H.U.D. regulations ban such activity as discriminatory. Section 12120 of the state regulations declare such discrimination illegal. Section 12010(c) requires the HOAto take what action it can to prevent such discrimination or it will be liable for that discrimination. By the way, pursuant to Section 12005(t) of the regulations, HOAs, their board members AND their managers are all defined as the “owner” of the property for purposes of Fair Housing liability. The HOA is only responsible to do what it can do under its documents, but it must at least try — so, and contrary to your attorney’s statement, it cannot just do nothing. The Fair Housing authorities expect the HOA to investigate the alleged discrimination and determine if illegal harassment happened. Then, the HOA is expected to try to do what it can to stop the behavior. This could be a letter from the HOA’s manager, board, or attorney. If the behavior is egregious enough that it constitutes a nuisance under the HOA CC&Rs, the HOA’s legal counsel may analyze whether that is a source of potential action. The residents victimized by this behavior have their own rights against the harasser, including complaining to the DFEH and even filing their own claim for discrimination. Hopefully the HOA can head off that kind of action by showing that such conduct will not be tolerated in your HOA community. – Best regards, Kelly

What should I ask driveway installers?

By Paul F. P. Pogue A new driveway is a fantastic way to spruce up your exterior and add more useful space for your vehicles. But not all driveways are created equal, so you want your installer to do the best job possible. Concrete and asphalt driveways bring different pros and cons, so make sure your contractor explains what’s best for you. Ask the following questions when vetting contractors to improve your chances for a perfect driveway:
1.
How much base material will be installed beneath the driveway? Most asphalt driveways require at least two base coats, plus a topcoat and sealant. When installing a new driveway, you usually need a gravel base of at least a couple of inches to support the asphalt.
2.
Do you have enough staffing for the job? Asphalt cools quickly after being poured, so time is of the essence. A larger crew works more quickly, and if the crew leader doesn’t apply enough work hours to installation, the driveway won’t last as long.
3.
What drainage plan will you use? Anticipating any potential drainage issues is critical to sound driveway installation. Drainage problems are frequently caused by the pavement preventing water from entering the ground. One solution is to install a drive-

way material that allows water to pass through it, such as some types of concrete or recycled glass. Placement is also crucial; driveways should be installed in an area with good drainage and slopes away from the house.
4.
How will the driveway be reinforced? Rebar is an essential component of concrete driveways. Asphalt relies on a certain amount of material flexibility to give it strength, so rebar isn’t required, but a concrete driveway needs to have a rebar mesh installed to support it. Rebar is available in a variety of strengths. Grade 40 is ideal for most residential uses, although contractors may recommend higher grade rebar for specific purposes. Rebar is particularly important because cracks are inevitable in concrete driveways. Keeping the concrete together after it cracks, so it doesn’t separate or shift vertically, is crucial. Fortunately, rebar or steel can help.
5.
How will you seal the driveway? When it comes to asphalt sealants and crack filler, there is a significant difference. Extra additives can make

Experts suggest making only one coat unless the sealer is being applied for the very first time. When two coats are applied to an existing driveway, it can cause the sealant to peel.
