THE CONVEYANCING JOURNEY

If you’re a seller in England preparing for conveyancing, it’s important to understand your responsibilities and what information you’ll need to provide. Your conveyancer or solicitor will help you through this process step by step, but here is a helpful overview of what you should prepare and expect during the process:

INSTRUCT A SOLICITOR OR CONVEYANCER

3 Choose a qualified conveyancer early – ideally before accepting an offer.

3 They’ll handle all legal aspects of the sale, including:

o drafting the contract of sale o responding to the buyer’s conveyancer’s queries o managing exchange and completion

COMPLETE PROPERTY FORMS

TA6 – Property Information Form

3 Details about the property: boundaries, disputes, utilities, planning, etc.

3 Includes information about building works, guarantees and insurance.

TA10 – Fittings and Contents Form

3 Specifies what items (e.g. carpets, curtains, appliances) are included/excluded in the sale.

TA7 – Leasehold Information Form (if leasehold)

3 If selling a leasehold property, this gives details about:

o ground rent o service charges o management company contact details o lease terms.

GATHER SUPPORTING DOCUMENTS

You’ll likely need to provide:

3 Title deeds (your conveyancer may retrieve these electronically from the Land Registry).

3 Energy Performance Certificate (EPC) – this is a legal requirement.

3 Building regulations approvals (for extensions, loft conversions, etc.).

3 Planning permission documents (if applicable).

3 FENSA certificates (for windows/ doors).

3 Electrical/Gas safety certificates.

3 Guarantees (damp proofing, roof work, appliances, etc.).

3 Leasehold documentation (if applicable).

RESPOND TO ENQUIRIES

Once the buyer’s conveyancer receives your contract pack, they’ll raise enquiries. Your conveyancer may need you to help answer them, e.g. clarifying works done on the property or providing missing documents.

AGREE ON DATES

Objective: Negotiate and secure the deal.

3 You’ll negotiate exchange and completion dates.

3 Completion is when keys are handed over and funds are transferred.

EXCHANGE OF CONTRACTS

3 You’ll sign the contract and agree on a completion date.

3 At this point, the sale becomes legally binding.

3 If you back out after this, you could face penalties.

COMPLETION DAY

3 Your conveyancer receives funds from the buyer’s conveyancer.

3 You hand over keys (often via the estate agent).

3 Your conveyancer repays any mortgage and deducts fees and disbursements before transferring the remainder to you.
