with the ability to work from home, people are also figuring out ways to stay, or come back.” It doesn’t hurt that L.A. is only a two-hour drive, and the Bay Area is about a six-hour road trip. Also, in recent years, the Santa Barbara Airport has increased the number of flights to travel hubs and major destinations. But this big shift of people leaving the big cities to settle in small towns isn’t exactly new, according to those who watch the trends. While the social distancing

big part of the current surge of people moving to Santa Barbara has a lot to do with longing. Many of the newly arrived have actually been here before. Some were born and raised here and then moved away for school or work. Others lived in Santa Barbara temporarily for college. Still more were married here or, growing up, visited on vacation. All of them, it seems, have since been longing to come back. “For many, there’s always been that Rubik’s Cube,” says Josiah Hamilton, a Realtor with Berkshire Hathaway HomeServices California Properties. “They’re wondering, ‘How do I get back to Santa Barbara?’ ” As we all know, Santa Barbara is an appealing place to call home, with interesting history, culture, architectural design, and a vibrant countywide food-anddrink scene. And, of course, we have the mountains and the sea — plus those islands — all of it blessed with great weather pretty much all year long. “It’s a real lifestyle change for people coming from L.A. or the Bay Area,” says Hamilton, whose local family roots date back five generations. “Santa Barbara is a pretty good choice.” Like San Francisco, for example, prices in Santa Barbara remain high, points out Giffin & Crane Principal Derek Shue. “But for those with the financial wherewithal, if they can do the same job while living in this quiet beach town — for some, the choice is obvious.” Ramping up last year during the spiking pandemic, there’s been a big shift to remote working, remote learning, and just about remote everything. That makes a beach town like Santa Barbara become “even more appealing because the walls of commerce have disappeared,” adds Hamilton. “Yes, a lot of people have left California because of higher tax rates,” adds Shue. “But at the same time,

and work-from-home realities of 2020 certainly piqued interest in people wanting more elbow room than their metropolitan counterparts, this uptick dates back at least five years. Overall, during that time frame, growth in cities has trended slightly downward as suburban populations have sloped up. Finding a path out of the concrete jungle has been easier as work-from-home resources — such as strong and dependable wireless services, for example — have become more abundant and affordable. Some employers have also become more lenient in recent years, allowing workers to punch in remotely. As the pandemic shut down indoor gathering spaces, dedicated remote workers proved that many businesses could stay successful even without the traditional shared office space. “The pandemic has changed how we look at our homes,” adds Hamilton. “Now, a home is less a place just to eat and sleep and be with your family. Your home is now your fortress, self-contained, where you have everything you need to live and work and play and raise a family and have people come over.” In that respect, points out Shue, when a home sells and its new owners arrive, they’re not just looking at the home office space but also at the interior and exterior living spaces as places to be able to conduct business and take online classes. But the perfect at-home workspace setup is a rare product in the real estate market. Often, these spaces have to be built. While so-called Zoom rooms can be achieved with furniture and privacy features, new owners now often want to have the option of setting up their mobile desks in a private corner of the bedroom or outside in the quiet shade. For some, all the pieces come together. Santa Barbara’s newest arrivals have found their way back — or here for the very first time — to a smaller, more tightknit community with great weather, schools, and places to work productively, reliably, and safely.

etail has been hurting for a number of years, but the pandemic really drove home that point. During the initial days of lockdown, retailers and property owners both began to try to determine how they would handle the post-pandemic world. The face of retail is going to look very different once it is said and done. Retailers who had been concerned about the delivery capabilities of companies such as Amazon found that rather than trying to beat them they would have to join them, or in some cases collaborate with them. The past year has seen a huge increase in delivery services offered for everything from restaurants and soft goods to groceries to daily essentials. The number of delivery options blew up almost overnight. Now these companies are shifting to smaller footprints and fewer locations. This means more vacancy in the marketplace. What Is A Signature? Q: Marsha, I’m currently in a contract to purchase a home
in Santa Barbara. The good news is all the paperwork is being signed electronically. The bad news is there is so much of it! Just when I think I’ve signed everything I possibly could, my agent emails me another stack of documents. Why all this overkill for signatures? are at least two inches thick and often larger. According to the Statute of Frauds, real estate contracts must be in writing. ConReal Estate Q&A tracts must identify the property, state the terms of the agreement, and be signed by both parties. The large files are primarily disclosures. Unfortunately, they are necessary and vital in today’s litigious world. They protect the principals, the agents, and the brokerages. That’s right, I said text messages! When agents exchange emails and discuss terms and price, an email “contract” is formed. If a dispute occurs, one may deny the emails’ validity (Statute of Frauds) and try to renege on the email contract. Courts have been upholding these email contracts. Now it’s text messages that appear to be binding as well, at least in Massachusetts for now. Be aware of not only what but how you put business discourse in writing. It’s a brave new world we are living in.

A: In today’s real estate world, files for one transaction
and confusion when deciding who sold what, to whom, when and for how much. The statute they passed became known as “A Statute for the Prevention of Frauds and Perjuries.” A version of the Statute of Frauds exists today in 48 states. The statute applies to real estate in many ways. Dilemmas occur when deciding how to interpret 17th-century doctrines in the 21st-century world. The last two decades of the 20th century saw universal acceptance of fax machines in real estate followed by email, texts, e-signatures, and multiple platforms of communication. In 2000, the 106th Congress passed the Electronic Signatures in Global and National Commerce Act, commonly known as E-sign. Courts began to be deluged with cases questioning whether a signature in writing really occurred. More and more courts accepted e-signatures in many different formats as valid as “wet” or handwritten signatures. A fascinating case was discussed in Lexology, a newsletter for business and legal professionals. A 2016 article titled “Texts that Bind: Text Messages May Form Binding Real Property Contract” discussed that a Massachusetts Land Court judge found that text messages between two commercial real estate brokers formed a binding legal contract for the principals.

Zoofari Returns to Basecamp
O
n August 28, the Santa Barbara Zoo hosted its 35th Zoofari event, which sold out a month early and raised more than $200,000 for the zoo. With a “Return to Basecamp” theme, many of the 650 guests arrived sporting stylish safari attire, while others opted for animal prints or animal costumes. Guests trekked up the walkway, passing animal exhibits along the way, to the scenic, hilltop venue. During the two-hour cocktail reception, guests greeted each other with excitement and were happy to experience this treasured Santa Barbara venue after hours. As always, Rincon Events provided gourmet appetizers at multiple stations and a delicious buffet dinner later on. Extensive silent auction offerings were located throughout the area. For dinner, guests adjourned just a bit further up the hill, where they were seated at tables adorned with small drums and other African-themed items. During the short program, CEO Rich Block welcomed guests and Board Chair George Leis paid tribute to Event Honorary Co-Chairs Ted and Nancy McToldridge. Ted was the founding zoo director and his wife, Nancy, is the

current zoo director (as well as one of the event coordinators). After dinner, guests danced into the night to music Laurie Leis and Board Chair George Leis by The Replicas. Since the start of COVID, there’s been quite a baby boom at the zoo — Twiga the Masai giraffe was born in March 2020, Pauline the lion cub in November 2020, and last month, Marta the Amur leopard cub. Adia and Audrey, both Masai giraffes, are expecting, which will make a dozen Masai giraffe births at the zoo since 2013. Eight of these baby giraffes have gone to other zoos as part of a cooperative breeding program for this endangered species. Later this year, the zoo will open its Australian Walkabout, a 15,000-square-foot exhibit with the iconic western grey kangaroo, Bennett’s wallaby, and emu. It will be located on the former elephant exhibit site. Adjacent aviaries will feature the sulphur-crested cockatoo, the tawny Boardmember and Event Committee Member Betsy Turner and Holly Murphy frogmouth, and the kookaburra.
