Switzerland wants to legalise cannabis
Health and youth protection: Recreational cannabis If the law comes into force, which is to be expected given the current situation, adults living in Switzerland will be able to grow, purchase, possess and consume cannabis in the future. The rules for passive smoke protection must be implemented. The supply and sale of cannabis to minors will be prohibited. Adults may grow a maximum of three female plants in the flowering phase. The maximum quantities not yet set will apply to properties in public and private spaces. Commercial production, import and export of cannabis flowers should also be legalised under strict conditions. Cannabis products must be neutral, without branding, have warnings and information leaflets and be packaged in a way that is safe for children. The sale of marijuana etc. should be reserved for the state.
The Swiss Social Security and Health Commission of the National Council (SGK-N) decided at its meeting on 13 February to adopt the Cannabis Act, to regulate the cannabis market and to submit it to the consultation process. The basis for this is the parliamentary initiative 20.473 “Regulation of the cannabis market for better protection of young people and consumers” submitted on 25 September 2020 by Hans Siegenthaler (Die Mitte party). This means that adults should be granted
“strictly regulated access to cannabis,” as the press release from the Swiss Parliament states. To prevent the law from being used to force the use of cannabis products, they should be “sold on a non-profit basis and subject to an incentive tax.” This tax should be dependent on both the THC content of the products and the form of consumption. This is what the corresponding proposal from the Health Commission provides. A federal bill on cannabis products was approved by the commission with 14 votes in favor, 9 against and two abstentions.

Advertising of cannabis products, i.e. flowers, resin, extracts, as well as cuttings and seeds, as well as accessories for cultivation and consumption, will be strictly prohibited. If the law becomes reality, the cantons “should play an important role in the implementation according to previous practice and continue to focus in particular on young people in the area of training, counselling and prevention. You must monitor the quality of the product and sales. They also need to make test purchases.” People who continue to serve the black market in any way will be prosecuted much more severely after the Cannabis Act comes into force than they are today. In addition, unlike in Germany, there will be absolute zero tolerance for road traffic. Cannabis consumption should be considered an exclusion criterion – in plain English: anyone who has consumed cannabis may not get behind the wheel.

The cantons issue licenses for retail trade, the Confederation can grant the license for online trade.
