The election to recall Gov. Gavin Newsom is about a week away. Some mail-in ballots have already been counted. In person voting is now possible at voting centers and voting continues by mail, drop boxes and dropping off mail-in ballots at voting centers. But if you expect to be among the Californians who exercise their civic duty in person at the polls on Sept. 14, there are rules you need to follow and rights you have that workers at the polls must respect.

Several conservatives have died of complications of COVID as the Delta variant rages through the southern part of the U.S. Many of them have publicly downplayed the seriousness of the coronavirus pandemic and have opposed mask mandate laws in the U.S. On August 28, Texas antimask organizer Caleb Wallace died after being infected with the COVID virus and remaining in the hospital since July 30. Wallace,

30, organized a “Freedom Rally” in early July for those “sick of the government being in control of our lives.” Wallace was a founder of the San Angelo Freedom Defenders. On August 14, longtime conservative radio host Dick Farrel, 65, who was based in Palm Beach and a skeptic of the seriousness of the coronavirus, died. Farrel refused to get the COVID vaccine. During his show on July 2, Farrel described

A Red Flag on the West Coast By Ben Jealous In just a few days, California will wrap up its recall election targeting Governor Gavin Newsom, a scheme orchestrated by a Far Right still seething over the Big Lie. At first glance that may seem like a problem that only affects California. But it’s not, and the red flag being raised in the West deserves attention from all of us. Thanks to an oddity of California law, voters could end up replacing Newsom with a candidate who wins only a fraction of the total vote. That’s because there are more than 40 people on a list of folks vying to be that replacement, a list that by law does not include Newsom. Whoever gets the most votes in the overcrowded field, wins, and for weeks now the leader has been Larry Elder, an ultraconservative talk show host whose extreme positions embrace racist, sexist, anti-im mig rant, COV I D denying, and anti-environment stances - among others. Elder’s ascendance is very troubling on a whole host of levels. That it was engineered at all in a progressive state like California shows the stop-at-nothing determination of a Far Right enraged and emboldened by the Big Lie. And Elder himself is a marquee example of the type of candidate that could soon be foisted on voters everywhere. He is more than just one person running for one office; he is the product of an unsavory stew of extremist factions liberated by Trump to do their worst. One of Elder’s biggest promoters is a radio host named Eric Metaxas, the host of a “Stop the Steal” rally where the Oath Keepers threatened civil war if Trump didn’t stay in power after losing to Joe Biden. Another is a megachurch pastor named Jack Hibbs, who says Speaker Nancy

Ben Jealous Pelosi and Vice President Kamala Harris have “antichrist views.” Elder is a Black man who allies himself with white supremacists. He denies that systemic racism exists. He argued forcefully to the Los Angeles Times that he wants to “change the rhetoric about how bad the cops are.” According to the same Times article, he “shared a graphic with so-called facts depicting Black people as murderous,” cherry-picking and skewing data to suggest Black people are disproportionately criminal. This is tragic. From a national standpoint, Elder’s election would certainly send a very dangerous message and encourage extremists. But it would also have the potential for more concrete effects. If California’s 88-year-old senior U.S. senator, Dianne Feinstein, had to step down during an Elder term, he could appoint someone to her seat and flip the Senate. That would spell doom for the agenda we elected the BidenHarris administration to advance. As someone who grew up in California, and whose parents still live there, I find all of this incredibly disturbing. I worry that progressive Californians, thinking “it can’t happen here,” will dismiss the chance of an ultraconservative coup in their state and skip voting against the recall. I’m aware that conservatives in the state, by contrast, are incredibly continued on page 6

On August 21, another conservative COVID skeptic, radio host Phil Valentine, died. In late July Valentine’s radio station, 99.7 WTN in Nashville, announced that Valentine was hospitalized and “in very serious condition, suffering from Covid pneumonia.” On August 5, another Texas anti-mask/anti-vaccine activist, Scott Apley, 45, died of COVID complications. Apley was a leader in the Texas Republican Party and a member of the Dickinson City Council. Apley wrote, “You are an absolute enemy of a free people,” as he replied on a

twitter to news that clinical trials showed that the Pfizer vaccine was effective at fighting COVID. On August 20, South Carolina tea party Republican leader Pressley Stutts died from complications of COVID. He was 64. Stutts opposed mask mandates but stated on social media that Covid-19 was a serious and deadly disease. Days before his death Stutts wrote on social media that he was choosing to go on a ventilator to take “a short rest.” COVID has killed over 600,000 people in the U.S. before the pandemic struck in March of 2020. President Donald Trump attempted to downplay the seriousness of the pandemic. President Biden has had a different approach. Plans for a booster shot of the vaccine are expected to get underway in September.

Williams, 54, was discovered face-down and unconscious in the dining room of his luxury Williamsburg pad with what appeared to be a large amount of heroin on the kitchen table, sources said. One of the acclaimed actor’s nephews talked to him Friday, and Williams was supposed to show up to an event Saturday but never made it, sources said. A nephew then went to Williams’ home Monday, and someone called cops to the address at 440 Kent Ave. just before 2 p.m., saying there was a man there who was

EDITORIAL California’s eviction protections remain in effect through September 30 CA COVID-19 Rent Relief Program still accepting applications Community/Education News SACRAMENTO – AB 832, signed by Governor Gavin Newsom on June 28, extended California’s critical eviction protections through September 30, 2021, giving California the strongest eviction protections in the country. The bill also provided $5.2 billion to help struggling California renters remain housed by covering rent and utilities that date back to April 2020. Off icials are st rongly encouraging both tenants and landlords with unpaid rent to apply as soon as possible to the CA COVID-19 Rent Relief program following California’s extension of eviction protections. Under AB 832, the program now covers up to 100 percent of unpaid or future rent and may also help low-income renters pay some or all their unpaid utility bills, including gas, electric, water and internet services. Landlords and income-eligible renters who have been impacted by COVID-19, and have unpaid rent or utilities, or need help with future rent can apply to the CA COVID-19 Rent Relief program at HousingIsKey.com. The application process has been streamlined with many improvements that include increasing language access, a shorter application, and less paperwork to upload. Applicants

who have already applied for relief, including those who have already been paid for past due rent or utilities, do not need to reapply to obtain additional assistance for future support. A notification will go out to tenants and their landlords 60 days after initial payments are received with an invitation to update their current application with additional requests for financial assistance. FCC Proposes $5 Million Fine For Right-Wing Operatives Jacob Wohl And Jack Burkman By Sebastian Murdock

Credit: Shutterstock Two right-wing operatives already facing felony charges for thousands of robocalls that discouraged absentee voting during the 2020 election should be fined more than $5 million, the Federal Communications Commission proposed on Tuesday. The FCC said Jacob Wohl and Jack Burkman should pay $5,134,000 “for apparently making 1,141 unlawful robocalls to wireless phones without prior express consent in violation of the Telephone Consumer Protection Act,” according to a statement. The robocalls, made on Aug. 26 and Sept. 14, 2020, across several key states up for grabs in the 2020 presidential election, falsely told callers that voting by mail could lead to their personal information becoming part of a public database. That database would then be “used by police departments to track down old warrants and be used by credit card companies to collect outstanding debts,” the calls claimed. In total, more than 85,000 robocalls went out in urban areas across the country. Wohl

and Burkman now face felony charges in Michigan and Ohio, where several of the calls were placed. Each charge carries a five or seven-year sentence, The Washington Post reported. In May, New York Attorney General Letitia James filed a complaint against the two seeking more than $2.5 million in damages after their robocalls targeted 5,500 New Yorkers. “The investigation revealed that Wohl and Burkman clearly and deliberately targeted Black communities in carrying out their widespread robocall campaign,” said a statement James released in May. “On August 25, 2020, the day before the robocalls were placed, Wohl emailed Burkman the audio file for the call and stated, ‘[w]e should send it to black neighborhoods…’ The next day, after the calls were sent and received by thousands of voters, Burkman emailed to congratulate Wohl, stating that ‘i love these robo calls…getting angry black call backs…win or lose…the black robo was a great [Jacob Wohl] idea.’”

Both men have pleaded not guilty but admitted in court that they were responsible for the calls, which they claim are legal, according to NBC News. CFPB Proposes Rule to Shine New Light on Small Businesses’ Access to Credit Proposal Would Increase Transparency in a $2.4 Trillion Sector of the American Economy and Bolster Fair Lending State/Government/Business News WASHINGTON, D.C. — The Consumer Financial Protection Bureau (CFPB) today proposed a new rule designed to help small businesses gain access to the credit they need and deserve by increasing transparency in the lending marketplace. This rule, mandated by Congress in the DoddFrank Act, would, if finalized, require lenders to disclose information about their lending to small businesses, allowing community organizations, researchers, lenders, and others to better support small business and community development needs. Under the proposal, lenders would be required to report the amount and type of small business credit applied for and extended, demographic information about small business credit applicants, and key elements of the price of the credit offered. The CFPB today also launched a web portal for small business entrepreneurs to share their stories about applying for credit, which will help the CFPB understand small business entrepreneurs’ challenges and successes in accessing credit. “Small businesses are the primary job creators and wealth builders in communities across the country,” said CFPB Acting Director Dave Uejio. “After homeownership, small business ownership is the primary means by which families and communities

build wealth. Yet too often, small business development is starved for want of access to responsible, fairly priced credit. Today, we are proposing a rule that would help us all learn how small enterprises fare when trying to access financing, and what barriers are holding them back from further prosperity. Over the next three months, we look forward to hearing from small business entrepreneurs, community organizations, researchers, lenders, and others about how we can improve on this proposal to make sure the final rule serves the purposes Congress had in mind when it mandated this rulemaking in 2010. To provide better information about small business lending, the CFPB is proposing to require lenders to collect and report data about credit applications from small businesses, including women-owned and minorityowned small businesses. The data submitted by lenders would shed light on whether they are meeting the needs of the nation’s small businesses. The proposed requirements, which would apply to a wide range of credit products, including term loans, lines of credit, credit cards, and merchant cash advances, would help the CFPB and the public at large, better understand: Information about the credit small businesses seek and obtain: Data regarding small business applications for credit would help us better understand small business lending. Lenders would be required to report information about the purpose, type, and amount of credit being applied for, the amount approved or originated, census tract, gross annual revenue, industry code, number of workers, time in business, number of principal owners, and key elements of the cost of the credit (the interest rate and certain fees). Demographic information about small business owners: Demographic information about an applicant’s owners would help the government, lenders, and the public identify areas of business and community development needs, new lending program opportunities, and potential fair lending concerns. Lenders would be required to report whether the business is minority-owned or women-owned, and the ethnicity, race, and sex of the applicant’s principal owners. Under the proposal, applicants may decline to answer these questions if they so choose. Lenders would be required to tell applicants that they cannot discriminate on the basis of this demographic information. How applicat ion s a re received and their outcomes: Understanding how applications are received, and their outcomes, would, for the first time, shed light on application-level information related to small business lending. The CFPB is proposing that lenders report information about the application date, method the application was received (inperson, telephone, online, or mail), recipient of the application (the lender or its affiliate, or submitted via a third party), action taken by the lender on the application (originated, approved but not

Because small business ownership is a key path to wealth creation for individuals, families, and communities, small business lending can foster greater equity, and its absence can exacerbate existing inequalities. Failing to make small business lending accessible to all who qualify stifles innovation and competitiveness, and it hampers American entrepreneurship in our cities and suburbs, on our farms, and in all our communities. The COVID-19 pandemic highlighted the negative economic impact that occurs when policymakers lack the data to best target financial relief. The pandemic hit small businesses hard, with over 33% of small businesses closed at the height of the pandemic. Yet many small businesses struggled to access the small business relief funds Congress appropriated during the COVID-19 emergency. The House Select Subcommittee on the Coronavirus Crisis reported, in October 2020, that some larger banks participating in the Paycheck Protection Program (PPP) “failed to prioritize small businesses in underserved markets, including minority and women-owned businesses.” The report also found that those same small businesses had to wait longer to access the PPP funds once they submitted applications to banks. Congressional Mandate Section 1071 of the DoddFrank Act requires the CFPB to collect data about small business

lending to facilitate enforcement of fair lending laws and to help identify business and community development need s a nd opportunities. Today’s proposal is the result of years of research, engagement, supervisory work, and policy development. In 2017, the CFPB held a public field hearing on the topic, issued a Request for Information, and published a white paper on the key dimensions of the small business lending landscape. The CFPB also held a symposium on small business lending in 2019. In 2020, pursuant to the Small Business Regulatory Enforcement Fairness Act (SBREFA), the CFPB published an outline of proposals, convened a Small Business Review Panel to gather input on those proposals under consideration, and released a report from the Panel summarizing that input and their recommendations. The CFPB also solicited input from the general public on the outline of proposals and received nearly 60 comments. The data that would be collected under the proposed rule would assist the CFPB and other stakeholders to identify and address difficulties small businesses experience in trying to access credit, and how current lending practices can be improved. Policymakers, community groups, investors, and bankers will be able to use the data to design more effective small business and community development programs across the nation. Additionally, the CFPB and other government agencies will be able to use the data to aid their ongoing fair lending, supervisory, and enforcement effor ts. Specific and detailed feedback and suggestions for ways to improve the rule will be especially helpful as the CFPB works to finalize the rule in a timely manner. The comment period is 90 days from publication in the Federal Register, and the CFPB does not anticipate a deadline extension. All comments will be carefully considered. Witness For Justice#1063

We Were So Close Roberto Ochoa Last August, I wrote an op-ed piece for the United Church of Christ’s Witness for Justice blog, entitled “Spiritual Malpractice” in which I stated: “Health care experts and scientists all agree that face masks, preferably made of cloth, hand washing, physical distancing and avoiding close contact gatherings especially indoors, are the best ways to prevent contracting the coronavirus. “Yet the wearing of face masks has become a symbol of weakness by some political and religious leaders. Some pastors have encouraged congregational members to attend indoor worship services while stating that if we truly believe in God, God will protect us from the disease. Thereby suggesting that contracting Covid-19 is a sign of retribution for a lack of faith.” I was very clear that I disagreed with any theological concept that only faith in God would keep believers from dying of Covid-19, without following CDC guidelines. At the time of the writing, 166,000 deaths had occurred. I ended the article by saying, “When you see me wear a mask, I am saying ‘I see you. I value you. I care for you.’” This past April, my 97-year-old father-in-law, my spouse, and I received our second dose of the Moderna vaccine. We breathed a sigh of relief that our family was finally protected from this deadly pandemic that had claimed the lives of over half a million U.S. residents. In Massachusetts this spring, people were lining up to receive the vaccine in greater numbers than most parts of the country and by the end of May, our state was opening up and getting back to a resemblance of normalcy, even though it was still different than 2019. We were so hopeful as we entered the summer that my husband and I took a trip to visit family in California in June, yet when we were there, we

sensed something was wrong. We were surprised to find that most of my family had chosen not to be vaccinated and not to wear masks for an array of reasons. Then we began to hear about the advent of a new, more contagious and dangerous strain of Covid called Delta. I did my best to urge my reluctant loved ones to reconsider their hesitancy of getting vaccinated, or at least to wear masks and follow social distancing protocols. I did so in the least judgmental way that I could, but the fear of losing family members to the Delta was gutwrenching. People are dying needlessly, and it breaks my heart. At this writing, 650,000 people have died of Covid-19 in the United States, and we are seeing a resurgence of hospitals overwhelmed with the sick and dying that we haven’t seen since last winter. Though the Delta wave was initially called “a pandemic of the unvaccinated,” the number of “breakthrough” cases of vaccinated people contracting, getting sick, and infecting others with Covid is also growing. The health care professionals are now advising: vaccinated or not, wear a mask, social distance, wash your hands, and stay home if you feel sick, until our country has “herd immunity” (when the number of vaccinated reaches 80-90% of the population). At the beginning of summer, I thought we were so close in beating this virus. We still can beat it, with each other’s and God’s help. And though I am vaccinated, I choose to wear my mask for the sake of others. When you see me wear a mask, I am still saying “I see you. I value you. Then, on his 25th birthday, ever y thing changed. “There was a popping party going on in Queens,” Williams says. “I went outside to get some air, and I saw that two of my other friends were being surrounded by some dudes I didn’t know.” Thinking his friends were about to get jumped, Williams told them it was time to go home. While a musical tribute was a given, what wasn’t as expected was a full-bodied theatrical performance from Michael K. Williams channeling the late rapper himself.
