Joseph R. Biden Jr. selected Senator Kamala Harris of California as his vice-presidential running mate on Tuesday, embracing a former rival who sharply criticized him in the Democratic primaries but emerged after ending her campaign as a vocal supporter of Mr. Biden and a prominent advocate of racialjustice legislation after the death of George Floyd in late May. Ms. Harris, 55, is the first Black woman and the first person of Indian descent to be nominated for national office by a major party, and only the fourth woman in history to be chosen for one of their presidential tickets. She brings to the race a far more vigorous campaign style than Mr. Biden’s, including a gift for capturing moments of raw political electricity on the debate stage and elsewhere, and a personal identity and family story that many find inspiring. Mr. Biden announced the selection over text message and in a follow-up email to supporters: “Joe Biden here. Big news: I’ve chosen Kamala Harris as my running mate. Together, with you, we’re going to beat Trump.” The two are expected to appear together in Wilmington, Del., on Wednesday. After her own presidential bid disintegrated last year, many Democrats regarded Ms. Harris as all but certain to attempt another run for the White House in the future. By choosing her as his political partner, Mr. Biden may well be anointing her as the de facto leader of the party in four or eight years. A pragmatic moderate who spent most of her career as a
prosecutor, Ms. Harris was seen throughout the vice-presidential search as among the safest choices available to Mr. Biden. She has been a reliable ally of the Democratic establishment, with flexible policy priorities that largely mirror Mr. Biden’s, and her supporters argued that she could reinforce Mr. Biden’s appeal to Black voters and women without stirring particularly vehement opposition on the right or left. While she endorsed a number of left-wing policy proposals during her presidential bid, Ms. Harris also showed a distinctly Biden-like impatience with what she characterized as the grand but impractical governing designs of some in her party. “Policy has to be relevant,” Ms. Harris said last summer in an interview with The New York Times. “That’s my guiding principle: Is it relevant? Not, ‘Is it a beautiful sonnet?’” In a Twitter post Tuesday, Ms. Harris said she was honored to join Mr. Biden on the ticket. “Joe Biden can unify the American people because he’s spent his life fighting for us,’’ she wrote. For all the complexity of Mr. Biden’s vice-presidential search, there is a certain foreordained quality to Ms. Harris’s nomination. She has been regarded as a rising figure in Democratic politics since around the turn of the century, and as a confident representative of the country’s multiracial future. Ms. Harris sought to capture that sense of destiny in her own presidential campaign, announcing her candidacy on Martin Luther King Day in 2019 and paying frequent homage to Shirley Chisholm,
the first Black candidate to seek a major party’s nomination. Throughout her rise, Ms. Harris has excited Democrats with a personal story that set her apart even in the diverse political melting pot that is California: she is the daughter of two immigrant academics, an Indian-American mother and a father from Jamaica. Ms. Harris was raised in Oakland and Berkeley, attended Howard University and pursued a career in criminal justice before becoming only the second Black woman ever elected to the Senate. Poorer Americans have much lower voting rates in national elections than the nonpoor, a study finds. Still, Ms. Harris was far from a shoo-in for the role of Mr. Biden’s running mate, and some of Mr. Biden’s advisers harbored persistent reservations about her because of her unsteady performance as a presidential candidate and the finely staged ambush she mounted against Mr. Biden in the first debate of the primary season. Jill Biden, the former second lady, called Ms. Harris’s debate stage remarks a “punch to the gut” at a fund-raiser in March. In the end, however, Mr. Biden may have come to see the panache Ms. Harris displayed in that debate — when she confronted him over his past opposition to busing as a means of integrating public schools — as more of a potential asset to his ticket than as a source of lingering grievance. Indeed, even in the bleaker periods of her presidential candidacy last year, Ms. Harris maintained an ability to excite Democratic
voters with the imagined prospect of a debate-stage clash between her and President Trump. Minutes after the announcement, the Biden campaign released what they called a fact sheet — “Biden-Harris: Ready to lead,” read the subject line. Perhaps in recognition of the attention paid to tensions between the Biden family and Ms. Harris surrounding the debate stage attack, the release included a section titled, “Kamala’s partnership with Joe Biden.” The document noted that she served as attorney general of California when Mr. Biden’s son, Beau, was attorney general of Delaware. “The two grew close while fighting to take on the banking industry,” read one bullet point. “Through her friendship with Beau, she got to know Joe Biden. From hearing about Kamala from Beau, to seeing her fight for others directly, Joe has long been impressed by how tough Kamala is.” Mr. Biden’s choice drew immediate praise Tuesday afternoon from some of his former rivals for the Democratic nomination. Senator Amy Klobuchar of Minnesota, herself a onetime candidate for the vice-presidential slot, called it a “historic moment” and praised Ms. Harris’s leadership, experience and character. The Trump campaign responded to Ms. Harris’s selection with a statement branding her as “proof that Joe Biden is an empty shell being filled with the extreme agenda of the radicals on the left.” Katrina Pierson, a spokeswoman for the campaign, attacked the policy stances Ms. Harris adopted during her own presidential campaign and highlighted her past attacks on Mr. Biden. “Clearly, Phony Kamala will abandon her own morals, as well as try to bury her record as a prosecutor, in order to appease the anti-police extremists controlling the Democrat Party,” Ms. Pierson said. After leaving the presidential race in December, Ms. Harris turned her attention back to the Senate and found new purpose amid a wave of nationwide protests this spring against racism and police brutality. She marched beside protesters and forcefully championed proposals to overhaul policing and make lynching a federal crime, often speaking with a kind of clarity that had eluded her in the presidential primaries on economic issues continued on page 6
In November, Californians will vote on a proposition that could expand voting rights to include parolees. If passed, Proposition 17, which passed the State Senate as ACA 6 June 24, would amend the state constitution so that any otherwise eligible person who is not currently incarcerated can vote. The current law in California prohibits previously incarcerated persons from voting while on parole, though they can vote while on probation, county PostRelease Community Supervision and federal supervised release. Allowing parolees to vote would enfranchise over 40,000 Californians currently on parole. According to Ballotpedia, as of 2020, California is one of three states that require people convicted of felonies to complete their prison and parole sentences to regain their right to vote. Seventeen states and the District of Columbia restore voting rights to people convicted of felonies after they complete their prison term. Assemblymember Kevin McCar t y (D-Sacramento) introduced the bill in the California Legislature. It was sponsored by the California Secretary of State Alex Padilla, the American Civil Liberties Union (ACLU) of California, and Initiate Justice, an advocacy group focused on ending mass incarceration. The bill was also a priority bill of the California Legislative Black Caucus. “ACA 6 gives Californians the chance to right a wrong and restore voting rights for a marginalized community and people of color,” McCarty said June 24. “This is good for democracy and good for public safety.” Parole is the re-entry period after serving a prison term that allows a convicted felon to be released from prison with restrictions. The ballot measure brings up the question of whether the right to vote is a necessary restriction that’s integral to the parole process. Supporters of Prop 17 argue that previously incarcerated persons contribute to society while on parole, through working
and volunteering. They say because of those contributions, parolees should have a say in the legislative process. “This bill says once you have paid your debts to society and have returned to society to work and pay taxes and contribute, that you should also have the right to voice your opinion about your elected representative,” argued Senator Holly Mitchell (D-Los Angeles). Opponents of the ballot measure argue that withholding the right to vote as part of the re-entry process is meant “to incentivize further appropriate behavior.” Election Integrity Project California, a voter roll watchdog group, submitted a letter opposing ACA 6 to the state legislature. “While on parole, the individual’s liberties, such as movement, association, activities and even ownership of certain items are still heavily restricted and regularly monitored by the system. Any misstep results in immediate re-incarceration. In other words, an individual on parole has not regained the full trust of the society at large, nor the privilege to participate as a full member of that society,” the letter read. Prop 17 disproportionately affects Black and Brown Californians, who comprise most incarcerated people in the state. According to the Public Policy Institute of California, Black people make up 26% of parolees. About 6% of the population of California is Black. “People on parole are our family members, our colleagues, our neighbors, our friends,” said Senator Steven Bradford (D-Gardena). “They go to work every day. They pay taxes. They do their part to successfully reintegrate themselves back into society, yet the stigma exists for them.” “The removal of the right to vote is not based in an interest in public safety. Rather, it is rooted in a punitive justice belief system that intentionally attempts to rob marginalized people of their political power,” said Taina Vargas-Edmond, Executive Director of Initiate Justice.

California Census Hits Benchmark For Hard-To-Count Populations – But Wealthy Communities Far Behind

by Sunita Sohrabji SA N FR A NCISCO — California’s Census self-response rate is a nationwide leader, but many residents in the state’s wealthy enclaves have yet to respond. 9.7 million households in the state have already responded — more than 64 percent — but more than two million households have not participated in the nine-question online survey at census2020.gov. A mail-in form is also available. California’s self-response rate is higher than the national average – slightly more than 64 percent versus 62.8 percent throughout the country as of July 30, according to data from California Complete Count-Census 2020. California also has the highest average self-response rate in census tracts where a large percentage of residents are foreign born. As part of its original strategy, California Complete Count focused its outreach on 3.5 to 4.1 million households considered “hardest-to-count” because they lack access to broadband Internet and therefore cannot complete the online form. Hard-to-count households may also speak English as a second language and live at or near the poverty line. So far, 2 million hard-to-count households have responded, which
meets the state’s initial target and puts it ahead of 10 other states with similarly high racial and ethnic diversity. California has the largest number of hard to count households in the country, according to California Complete Count. Surprisingly, however, wealthy cities in the state — which in past censuses have been easy to count — have had a lower response rate in the 2020 census. In posh Malibu, for example, self-response rates dipped to 36 percent. In San Francisco, wealthy neighborhoods such as Cow Hollow, the Marina, Pacific Heights, and the Presidio have self-response rates of 53 percent, a startling drop from the 2010 census, when these neighborhoods e xc e e d e d 70 p e r c e n t .
Ditas Katague, longtime director of California Complete Count-Census 2020, the state’s initiative to ensure an accurate census count, said during an Aug. 3 press briefing that there are only a few days left to respond to avoid enumerators coming knocking at the door. All residents in the country are required to respond to the Census regardless of immigration status. “This is a pivotal time in our nation’s history. Face to face contact is limited,” she said, also noting the uncertainty of door-to-door field work. U.S. Census Bureau Director Steven Dillingham announced Aug. 3 that he was cutting short the time for field data collection. Earlier, enumerators
were scheduled to continue knocking on doors until Oct. 31. But Dillingham’s memo said field operations would end on Sept. 30 to ensure that the Bureau would meet its statutory deadline of Dec. 31 for delivering census results to the White House. The shortened timeline for data collection immediately evoked response from critics. House Majority leader Steny Hoyer, D-Maryland, issued a series of tweets Aug. 4, stating: “Last night’s announcement that the 2020 Census will be cut short before its work is done is yet another example of this Administration’s blat a nt assault on ou r Constitution and our democracy.” “Trump has been trying to undermine the Census since before it began. The House will continue to investigate these abuses. With only 6 in 10 people counted so far, I urge the Commerce Secretary & Census Director to insist on conducting the full count as mandated by our Constitution,” tweeted Hoyer. CASE SYNOPSIS On Thursday, July 23, 2020, deputies from the San Bernardino County Sheriff’s Department responded to a motel in the 15700 block of Mojave Drive in Victorville, regarding a disturbance. During their investigation, Dwayne Charles Hammer was arrested after resisting the deputies. Our office has reviewed this case and charged Hammer with violating the following sections of the California Penal Code:

(Photo: iStockphoto / NNPA) President Donald Trump has rolled back a Barack Obama-era housing rule intended to halt racial segregation and eliminate racial disparities in American suburbs. Tr u mp a n nou nced on Wednesday, July 29, that he officially eliminated the Affirmatively Furthering Fair Housing (AFFH) rule that Obama put in place in 2015. The rule required local governments to identify and address racial segregation patterns outlawed under the Fair Housing Act of 1968. The law tied federal funding to efforts to bridge inequalities. The AFFH helped low-income and minority households, many of whom now face housing uncertainty because of the coronavirus pandemic. Some interpret the move as an attempt to stoke fears in Trump’s base, which could drive supporters to the polls in November. To others, the president is no longer using dog whistles. Instead, it’s apparent he has issued a clarion call for white supremacists and other racists that African Americans and other non-whites represent a danger to suburbia.
That the formal announcement of the rule change came on the day before Obama eulogized Rep. John Lewis (D-Ga.) in Atlanta, wasn’t lost on many who expressed exasperation with the president. “Oh my. I mean, it’s not even a dog whistle anymore,” Sen. Chris Murphy (D-Conn.) wrote on Twitter. “Our president is now a proud, vocal segregationist.” “Vile, despicable, racist,” Diane Yentel, president of the National Low Income Housing Coalition, tweeted about the decision. “Secretary [Ben] Carson has worked to undermine fair housing since the day he stepped into the HUD building, so this action is not surprising. But it is abhorrent for Trump to use a critical fair housing tool for election year race-baiting, particularly during a time of reckoning for racial injustices,” Yentel said. There will be no more low-income housing forced into the suburbs.” Carson added that the AFFH rule was unworkable and “ultimately a waste of time for localities to comply with.” ABC News reported that Trump is again “counting on the suburban voters he won in 201r – apparent by his repeated false and fearinvoking claims that Democrats want to ‘abolish’ suburbs – but his divisive rhetoric may not
be working this time around.” The network cited a recent ABC News/Washington Post poll showing the president trailing Biden in those neighborhoods by 9 percent – the most significant margin in the suburbs that polls had recorded since the 1980s when Republicans were winning there by double digits. ABC News further reported that a New York Times/Siena College poll from June found 38 percent of voters in the suburbs approve of Trump’s job performance compared with 59 percent who disapprove. T he key demog raph ic disapproved of Tr u mp’s handling of recent protests and race relations by an even wider margin, according to the Times. Meanwhile, The Lawyers’ Committee for Civil Rights Under Law said the elimination of the Obama-era housing rule would “eviscerate all oversight of state and local government compliance with fair housing laws.” “It’s a full-frontal assault on the rule of law,” the group wrote. “The civil rights movement will fight this tooth and nail.”

Unified School District (SBCUSD) is eager to enroll the Class of 2033. Online registration for kindergarten and transitional kindergarten in SBCUSD is underway. Classes started August 3, but space is still available and students can begin distance learning as soon as the enrollment process is complete. Children who will be 5 years old by September 1, 2020, are eligible to enroll in kindergarten for the 2020–2021 school year. Transitional kindergar ten (TK) is available for students who will turn 5 years old from September 2 to December 2, 2020. According to Elementary Instruction Director Tasha Doizan, children benefit from kindergarten in various ways. Black Employees Say Veterans Affairs Has a Serious Racism Problem, and the Stories Are Pretty Damning State/Government News A survey of employees at Veterans Affairs has revealed that nearly 80 percent of them believe that racism is a serious and widespread problem within the government agency. The nationwide survey of 1,500 workers at the VA was conducted by the American Federation of Government Employe e s la st mont h , reports the Washington Post. An example of the racism that workers at a VA center in Kansas City, Missouri just this June—even as an uprising for racial justice was rippling across the country—underscores the survey’s findings that racism is all over the organization. From the Washington Post: At an event to mark Juneteenth, a holiday commemorating the end of slavery in the United States, Black employees became “living display” pieces, performing as Martin Luther King Jr., Harriet Tubman and Floyd, according to two medical
center staffers and internal emails obtained by The Post. One staffer, speaking on the condition of anonymity over a fear of retaliation, told The Post they were urged by senior leaders at the medical center to dress as their characters in period clothing and that one supervisor, who is White, suggested in a conference call that they serve watermelon and fried chicken during the event. The supervisor later apologized, the staffer said. Employees at the Kansas City VA Medical Center have filed over a hundred complaints with their local NAACP chapter for that incident, though a spokesperson for the center has denied that racist discrimination is an issue there and said the event was voluntary. Kamala Harris Is Biden’s Choice for Vice President...continued from page 1 like health care and taxation. Ms. Harris is likely, however, to face some skepticism from the left — and attacks from Mr. Trump — over her record as district attorney of San Francisco and attorney general of California. She has struggled in the past to defend her handling of some highly sensitive cases, including one involving a death-row inmate seeking to obtain DNA evidence for his case, as well as her decision to defend California’s death penalty in court despite her stated opposition to capital punishment. In perhaps her worst moment of the 2020 primary race, Ms. Harris during a debate appeared entirely unable to rebut searing criticism from an obscure rival, Representative Tulsi Gabbard of Hawaii, who demanded that Ms. Harris apologize for having prosecuted so many people for marijuana infractions. At other times, Ms. Harris struggled to articulate clear positions on litmus-test issues like single-payer health care. But if Mr. Biden’s selection of Ms. Harris is met with a cold shoulder by some on the left, she is likely to be embraced by Mr. Biden’s most important electoral constituency within the Democratic Party: Black voters. Indeed, his choice reflects an emphatic recognition of the diversity of the Democratic political coalition and the foundational role that Black women in particular play within the party. Black women are among the most loyal Democratic constituencies, and without their
overwhelming support Mr. Biden would have been unlikely to secure the Democratic nomination in the first place. By nominating a Black woman for national office, Mr. Biden appears to be acknowledging the immensity of that political debt. He considered at least five Black women for the job, including Susan Rice, the former national security adviser to former President Barack Obama, and Representative Karen Bass, before ultimately settling on Ms. Harris. While Mr. Biden never described race as a central criterion in his decisionmaking, he stressed repeatedly throughout the process that he was reviewing a highly diverse group of candidates, including Latina and Asian-American candidates. Mr. Biden faced only limited pressure from voters and Black elected officials to select an African-American running mate, and polls found that even liberals and Black voters themselves mostly believed that race should not be a factor in his decision. But the political atmosphere that took hold after the killing of Mr. Floyd in Minneapolis seemed to demand a running mate who could speak with great authority on matters of racism, law enforcement and social inequity — and there is little doubt that Ms. Harris will be called upon to do just that. Some Democratic leaders also urged Mr. Biden to choose a Black running mate for purely strategic reasons, arguing that an increase in Black turnout across the South and Midwest could improve both Mr. Biden’s chances of winning

the Electoral College and his party’s odds of winning a majority in the Senate. Still, it remains an open question how much Ms. Harris will help Mr. Biden and his party in that respect: Last year, she never garnered strong support in the diverse primary states of South Carolina and Nevada, and opinion research conducted by Mr. Biden’s team in recent weeks suggested she was not especially compelling to Black voters. The question of Mr. Biden’s potential running mate was an urgent issue even for his core admirers, some of whom supported him in the Democratic primaries because they believed he could win the election but worried about whether he would be able to generate passionate enthusiasm for his candidacy. Part of Ms. Harris’s task now may be to stir the energy of Mr. Biden’s coalition in a way he has seldom managed to do himself. The immediate political impact of Ms. Harris’s selection could be relatively muted in a campaign shaped so heavily by forces of extraordinary scale, most of all a global pandemic that has claimed many tens of thousands of American lives and pushed the economy into a painful recession. Yet it has been clear for months that Mr. Biden’s vicepresidential decision would have unusually weighty implications for the Democratic Party, and for national politics in general. If he wins in November, Mr. Biden would become the oldest president ever to hold the office, and few senior Democrats believe
he is likely to seek a second term that would begin after his 82nd birthday. As a result, when Democrats formally approve Ms. Harris as Mr. Biden’s running mate this month, they may well be naming her as a powerful favorite to lead their party into the 2024 presidential race. Mr. Biden’s age — 77 — also may have heightened the importance of finding a running mate with thoroughly convincing political credentials. Mr. Biden himself seemed sensitive to that reality, reiterating often that he wanted a vice president who would be ready to assume the top job immediately. “The first and most important attribute is, if something happens to me, the moment after it does, that that person is capable of taking over as President of the United States of America,” he said at a fund-raiser in May. The vice-presidential search was at once highly public — involving tryouts on television and in online campaign events for more than half a dozen candidates — and surprisingly discreet for a campaign that has weathered a sizable number of leaks over the last 15 months. Much of the process was carried out by a committee of four trusted advisers named by Mr. Biden in late April: former Senator Christopher J. Dodd of Connecticut, Representative Lisa Blunt Rochester of Delaware, Mayor Eric Garcetti of Los Angeles and Cynthia C. Hogan, Mr. Biden’s former chief counsel. Aided by a team of lawyers,
this group held interviews with a range of vice-presidential prospects and delved into their political records, personal finances and private lives before referring a smaller number of them for interviews with Mr. Biden. The field of women considered was certainly the most diverse array of vice-presidential candidates in history, beginning with a pool of more than a dozen contenders that included governors, senators, members of the House, a former United Nations ambassador, the mayor of Atlanta and a decorated combat veteran. The group included two Asian-American women and the first openly gay person elected to the Senate. Mr. Dodd in particular is said to have pressed for a large list with some unconventional names on it, to give Mr. Biden maximum flexibility in his choice. By the end of June, a smaller cluster of candidates had emerged as strong contenders, impressing the screening committee in interviews and reaching a point in the process that involved extensive document requests from Mr. Biden’s lawyers. Among that group were Ms. Harris, Senators Elizabeth Warren of Massachusetts and Tammy Duckworth of Illinois, Representative Val Demings of Florida, Gov. Michelle Lujan Grisham of New Mexico, Ms. Bass of California and Ms. Rice, the former national security adviser and United Nations ambassador. Yet more than in any other recent vice-presidential process, it was also plain enough from the start
that this one would be decided by one person, and one person alone, with an unusually well-developed sense of the vice presidency and firm convictions about how to do the job right. After all, Mr. Biden is the first presidential candidate in 20 years to choose a running mate after serving as the vice president himself. On the campaign trail, Mr. Biden constantly fielded inquiries about a possible vice-presidential pick, leading him to craft a wellhoned answer about his criteria. In addition to being able to assume the presidency immediately, if necessary, Mr. Biden’s running mate must be “simpatico” with him on critical issues of the day, as well as on a broader vision for how to lead the nation. Mr. Biden’s running mate should also balance him out with “some qualities that I don’t possess,” he has said. Perhaps most importantly, he has emphasized the need to select a vice president with whom he could have the same trusting, candid relationship that he had with Mr. Obama. “We disagreed on some tactical approaches,” Mr. Biden recalled at a fund-raiser in April, describing the lunches he and Mr. Obama had “where everything was on the table.” But, he went on, “It has to happen in private. You always have to have the president’s back.”

Far from being a challenge to exert as much energy and strength as possible, treading water was a challenge to conserve energy as much as possible, to slow down, to rest and let the water support you. By contrast, we live in a society that values energy and strength, speed and power. Keep up, or you risk losing out. Fight the deluge that assumes your disposability, or you risk drowning in it. In 2016, the Centers for Disease Control and Prevention (CDC) reported that 1 in 3 American adults do not get enough sleep for physical health and mental well-being. Lack of healthy sleep was disproportionately prevalent in the lives of indigenous and Black Americans. The recent end to the eviction moratorium and the lapsed federal support for unemployment insurance puts 20 million people at risk of not having a place to sleep at all – let alone sleep well – according to the Covid-19 Eviction Defense Project. Re s t a n d wel l - b e i n g a re pr iv ileges reser ved for the few in our society. Even in the work of justice. The resistance of unjust social structures can easily, temptingly, even logically assume the same conditions as those structures: testing exertion and requiring multi-tasking, calling for both urgency and endurance, leveraging power and speed, matching the pace of injustice with the pace of organizing. In the name of God
and for the sake of one another, we rally to the cry that nothing less than 110% is acceptable. As Madeleine L’Engle writes in Walking on Water, “We have to be braver than we think we can be, because God is constantly calling us to be more than we are, to see through the plastic sham to living, breathing reality. Earthbound as we are, even we can walk on water.” The work of walking on water must be paired with a delight in treading water. In the New Testament, Peter was weary from a long night of wrestling against waves and wind in the disciples’ boat when Jesus invited him to take walk on water. God knows, Jesus is no less demanding when we are tired than when we are well-rested. We may have the faith to walk on water, but we are not made from dust that can be sustained in hyperdrive. The cry of justice can only be just when it is paired with an invitation to rest. To prioritize well-being as much as labor. To value rest alongside restlessness. To fight for healthy sleep as much as we fight for healthy work. To believe that none are expendable to satisfy the storm’s torment. To insist that water – that life – can work for those most vulnerable, not against them. Reach out. Breathe. Pull in. Breathe. Kick. Breathe. Rest. Breathe.

Vanessa Bryant Calls Foul on Venue Change Motion in Kobe Bryant Trial Antonio Ray Harvey | California Black Media
The civil lawsuit Vanessa Bryant filed in February has yet to be litigated in a courtroom to determine who was at fault when her husband, NBA-hall-of-famer Kobe Bryant, and the couple’s 13-year-old daughter, died in a helicopter crash last January. But just as the questioning of potential jurors was scheduled to begin, Berge Zobayan, the brother of pilot Ara Zoboyan, who also died in the crash, asked for a change of venue for the trial -- from Los Angeles County to neighboring Orange County. Mrs. Bryant is calling foul. Kobe Bryant and his daughter Gianna “GiGi” Bryant died in the tragic helicopter crash. Seven other people, counting the pilot, also passed away in the fatal accident that happened on Jan. 26 in Calabasas, a city about 30 miles northwest of Los Angeles. Vanessa Bryant filed a countermotion to Berge Zobayan’s bid, in which he asks for the trial relocation, citing the immense popularity of the former Lakers’ star in Los Angeles County. “Defendant cannot show that there is any county to which this case may be transferred where the basis for his objection does not exist,” the filing said. “Defendant fails to acknowledge the extent to which Kobe Bryant’s legacy penetrates American culture; there is no county line at which Kobe Bryant’s
Photo by Antonio Ray Harvey celebrity suddenly evaporates.” Mrs. Bryant also points out that her family has lived in Orange County for 20 years. The deceased Zobayan was the pilot of an Island Express-operated aircraft owned by Island Express Holdings Corp., which is named in the lawsuit. Zobayan allegedly took flight in extreme foggy weather, which investigators say was a factor in the accident. The helicopter, a Lockheed Martin’s Sikorsky S-76B, was traveling from John Wayne Airport in Orange County to Camarillo Airport in Ventura
County. The helicopter hit a hillside in Los Angeles County before crashing and bursting into flames. Neither a flight data recorder nor a cockpit voice recorder was installed in the aircraft. But Berge Zobayan said Vanessa Bryant is not entitled to compensation, putting the onus on Kobe Bryant, and arguing that the basketball player knew, and agreed to, the risks of traveling by helicopter. Berge Zobayan’s attorneys argue that damages were “directly caused in full, or in part, by the negligence or fault” of Kobe Bryant. It’s been long reported
that Bryant chartered helicopter flights back and forth to games and practice – from near his home in Newport Coast to the Staples Center 51 miles away in El Segundo, where the Lakers played. The day of the crash, Bryant was traveling with his daughter and friends to Thousand Oaks to attend a basketball game at his Mamba Sports Academy. “The shock of the accident affected all staff, and management decided that service would be suspended until such time as it was deemed appropriate for staff and customers,” Island Express said in
a written statement after the crash. Zobayan’s position for a venue change is due to Kobe Bryant’s “personification” of the city of Los Angeles, Zobayan says, maintaining that it would be difficult to seat an unbiased jury of 12 persons. There are no special skills or legal knowledge needed to become a juror in California. The state of California only asks that jurors have an open mind, be able to work with prospective peers to make judicial decisions and be impartial. “In other words, your decisions must not be influenced
by personal feelings and bias,” states California’s “Court and Community: Information and Instructions for Responding to Your Jury Summons,” brochure. “Jur y service is the responsibility of all qualified citizens, but also an opportunity for us to participate directly in our system of justice and contribute to our communities,” Hon. Judge Tani Cantil-Sakauye, Chief Justice of California, states in the brochure. Wherever the Bryant v. Island Express Helicopters et al. case ends up taking place, Vanessa Bryant will allege that the pilot, in a manner not in accordance with accepted standards, flew the aircraft under “instrument flight rules,” the court filing states. Island Express Helicopters was only regulated to fly under “visual flight rules,” the plaintiffs argue. Those regulations restrict pilots to only operating an aircraft when they can clearly see ahead of them in flight. “Plaintiffs are confident that the voir dire process will yield twelve citizens from Los Angeles County who — when called upon to serve — will uphold their oaths and render a verdict, ‘according only to the evidence presented [and] the instructions of the court,’” Vanessa Bryant’s court filing states. The next hearing in the case will be held at Los Angeles Superior Court on August 19.
