The President The nation’s health protection agency is being censored by the Trump administration, according to a report from The Washington Post. Seven words — “diversity,” “transgender,” “evidencebased,” “science-based,” “vulnerable,” “entitlement” and “fetus” — have all reportedly been banned from use at the Centers for Disease Control and Prevention in documents relating to next year’s budget. An analyst who attended a briefing on the new requirements told The Post that in some cases a different phrase was provided. “Science-based” and “evidencebased” can, for instance, be replaced with “CDC bases its recommendations on science in consideration with community standards and wishes.” Not every banned word received a new option. CDC officials have disputed the claim. An official with Planned Parenthood told STAT that the directives will put “millions of lives in danger.” “You cannot fight against the Zika virus, or improve women’s and fetal health, if you are unable to use the word ‘fetus.’ You must be able to talk about science and evidence if you are to research cures for infectious diseases such as Ebola,” said Dana Singiser, the organization’s VP of public policy. “You must be able to acknowledge the humanity of transgender people in order to address their health care needs. You cannot erase health inequities faced by people of color simply by forbidding the use of the words ‘vulnerable’ or ‘diversity.’” Dr. Ashish Jha, director of the Harvard Global Health Institute, said that the ban will likely extend beyond the budget report. “So of course the administration and its defenders are going to argue that this is only about what goes into the budget,” Jha reported to STAT. “But we know that the signal to the agency is much stronger than that. And it’s going to change behavior of people who work there. And that’s much more damaging than any direct censorship.” Dr. Sandro Galea, dean of Boston University’s School of Public Health, told The Associated Press that banning certain words speaks volumes to the (continued on page 3)

Democratic candidate Doug Jones defeated former judge Roy Moore in a highly contentious special election in Alabama for Attorney General Jeff Sessions’ vacated U.S. Senate seat. (Wikimedia Commons) A heavy African American turnout in Alabama’s special election propelled underdog Democratic candidate Doug Jones to victory, in a hotly-contested race against the flawed, yet heavily-favored, Republican candidate Roy Moore. The New York Times reported that Jones defeated Moore 49.9 percent to 48.4 percent with 1.7 percent of voters preferring a write-in candidate. According to CNN exit polling, 68 percent of White voters, including 72 percent of White men voters and 63 percent of White women voters, supported Moore, an alleged child predator. Meanwhile, 96 percent of Black voters supported Jones, including 93 percent of Black men voters and 98 percent of Black women voters. Blacks accounted for a 29 percent share of all voters in the special election in Alabama. Black voter turnout played a key role in getting Jones elected as Alabama voters were forced to choose between a Republican who’s perceived as a racist and accused of child abuse and a Democrat who has earned his chops prosecuting the Ku Klux Klan. The contest also was viewed, by many, as a test of racial progress in the Deep South, and the power of President Donald Trump’s rhetoric to sway voters. Trump campaigned hard for Moore, recording a robocall for the former judge, and convincing the Republican National Committee (RNC) to back the man who was possibly banned from the local mall in Gadsen for badgering young women, according to “The New Yorker.” On the day of the special election, #RoyMoore trended all day
on Twitter with some straight-forward and emotional posts. “That White Supremacist #RoyMoore rode in on a horse to vote. Kudos to him,” tweeted Greg Carr, chair of Howard University’s Department of AfroAmerican studies and frequent guest on “NewsOne Now” on TV One. “As White Supremacy dies, this is what it looks like. It won’t go without a fight. Bannon. Trump. Moore. All of their comrades and enablers. They’re daring humanity to respond.” One of Wisconsin Representative Gwen Moore’s posts was retweeted more than 30,000 times: “Another #RoyMoore supporter just called my office posing as an @AP reporter. Once their cover was blown they started screaming and called me and my staff the n-word and other racial slurs. I won’t be intimidated. I won’t stop speaking out. You will not shut me down. Believe it.” Already facing numerous accusations of sexual misconduct with children, Moore, in recent weeks, further aligned himself with the old South with his racially insensitive comments. When asked by a reporter to explain the last time America was great, Moore didn’t hesitate to respond with stunning clarity with an answer that seemed to out-Trump the president’s comments when he was on the campaign trail. “I think it was great at the time when families were united—even though we had slavery. There was singing, dancing and
testimonies from the residents and members of Gamma Omega Chapter. The highlight of the visit was the recitals and personal interactions with the youth group and the residents that brought smiles to everyone’s face. born. Each day of Kwanzaa emphasizes a different principle. Mr. Majadi shared, the name Kwanzaa is derived from the phrase “matunda ya kwanza” which means “first fruits” in Swahili. Celebrations may include songs and dances, African drums, storytelling, poetry reading, and a large traditional meal. CAL FIRE/Riverside County Fire Department will make its dramatic delivery of Santa Claus to the medical center at 10 a.m. on Saturday (Dec. 23). The jolly elf— a firefighter—will delight children and adults alike by scaling an engine ladder to the medical center’s third floor pediatric unit to deliver gifts from the Spark of Love Toy Drive. “We are often at the medical center following an accident or a tragedy,” CAL FIRE/Riverside County Fire Department’s City of Moreno Valley Division Chief Abdul Ahmad said. “It’s really gratifying to come in the spirit of the holidays—to know we are brightening the day for children, employees and guests.” Ahmad said the Spark of Love Toy Drive would not be a success without support from the community, firefighters and volunteers who donate their time
and/or toys to make this annual event flourish. Toy donations are received then distributed to children throughout the community for Christmas. Toys are also given to ill or injured children who may have to spend their holidays in the hospital instead of at home with their families. Monica Yerena, who helps coordinate Santa’s visit as part of her role as a child life specialist at the Medical Center, said there is always a lot of excitement in the pediatric unit when Santa makes his holiday visit. “Our kids just can’t stop smiling,” Yerena said. On Sunday, December 17, 2017, the end of the year conversation with the Beautillion Knights included guest speaker Mr. Jonathan Rodgers, Sir Knight 2017 who is a current college student at
UCLA. On December 12, Congresswoman Maxine Waters (CA-43) registered a complaint with the Office of General Counsel of the United States House of Representatives concerning an illegally fabricated letter (Attached) purporting to be from her office on official congressional letterhead. The letter is a forgery and a fake. It was not written by Rep. Waters. Upon notification of the Congresswoman’s complaint, the House General Counsel forwarded the matter, in a written criminal referral, to the United States Attorney for the Central District of California and the Fraud Section of the Criminal Di-
vision for the United States Department of Justice (Attached). Similarly, the House General Counsel notified Twitter detailing how the tweet violates the platform’s terms of service concerning illegal conduct. Among other federal and California state laws, it is a federal crime to impersonate an officer or employee of the United States (See 18 U.S.C. § 912). The forged document was posted on Twitter by Omar Navarro (@RealOmarNavarro) on December 11, 2017 in a tweet falsely representing the letter as an authentic and official correspondence from Congresswoman Waters’ office.
Deported Marine Corps Veteran Marco Chavez Returning to U.S. After 15 Years in Exile Landmark victory gives hope to hundreds of deported vets Political/GovernmentNews
SAN DIEGO -- Christmas is coming early this year for one military family, as Marco Chavez, a Marine Corps veteran deported to Mexico in 2002, has won his bid to return home to the country he fought to defend. “Fifteen years ago, my life was upended when I was deported to Mexico, a country I left as an infant,” Chavez said. “I missed the childhood of my three children and I have two grandchildren now I’ve not met. With the restoration of my legal status, I feel like I’ve been given my life back.” Earlier this year, at the request of the Honorably Discharged, Dishonorably Deported Coalition, Gov. Jerry Brown pardoned Chavez, along with two other deported California veterans, paving the way for them to restore their permanent residency status in the United States or to become citizens. Governor Jerry Brown said, “Marco served our country, earned a pardon and deserves to come back home,” of Marco’s return home. Nathan Fletcher, the Chair of the Honorably Discharged, Dishonorably Deported coalition said, “No one who was willing to die for this country should be deported. In a time when the immigration debate in America seems so dark, Marco Chavez’s historic legal victory and return home is a ray of light and hope.” Chavez will return to the United States reunited with his family before Christmas. The date of his homecoming will be announced soon. Born in Mexico, Chavez was brought to California as an infant. He served in the Marine Corps as a lawful permanent resident before being deported on the basis of a single criminal offense in 2002. After Gov. Brown granted him a full and unconditional pardon for
that offense, attorneys moved the San Diego Immigration Court to reopen and terminate his removal proceedings. The court agreed that Chavez's pardon entitled him to return to the United States as a lawful permanent resident. “This victory for Marco is truly historic. Governor Brown’s pardon recognized the ongoing punishment of permanent exile that Marco has lived with since his conviction. Brown’s clemency has given Marco back his life in the United States, and given his family back their son, their father, and their grandfather,” said Jennie Pasquarella, director of immigrants’ rights and senior staff attorney for the ACLU of California. Pro bono attorneys John Wilson and Allen Rowe of Latham & Watkins represented Chavez in his bid to have his legal permanent resident status restored. "We were pleased to provide the legal counsel that helped Marco, an honorably discharged veteran of the United States Marine Corps, return home to his family and the country he served," Wilson said. HDDD was formed in September of 2016 in conjunction with the ACLU and other groups to advocate legislative relief for deported veterans in response to the report “Discharged, then Discarded.” The groups advocated for the Governor to pardon Chavez ahead of his Easter pardons. His actions represented the first time a governor has recognized the injustice of the deportation of armed forces veterans. “This is an important step in the right direction, but we must keep fighting to ensure the return of every deported veteran,” said Congressman Juan Vargas of San Diego. “Congratulations to Mr. Chavez, and welcome home."

The phrase, “It ain’t over until it’s over” was first made famous by the late New York Yankees pitcher, Yogi Berra. It was one of many enduring Yogi-isms that coined humorous phrases that were often grammatically-challenged. Even so, people usually understood what he meant to convey. Unfortunately, some who walk the halls on Capitol Hill seem to
ignore this specific Yogi-ism. For them, even when legislation or rules are enacted, it’s never over. Just ask the payday lenders and their supporters. Their relentless determination reveals values that ignore the financial exploitation of people with the fewest resources to derive billion-dollar profits. Even after consumer laws and regulations are enacted – following years of extensive research and a growing momentum by advocates and consumers alike -- they still steadfastly work to overturn popular reforms aimed at stopping (continued in next 2 columns)
the debt trap. The latest illustration of these misguided attacks is the payday lenders’ effort to undo the Consumer Financial Protection Bureau’s (CFPB) small-dollar loan rule that addresses the worst harms of 300 percent or higher interest on payday and car-title loans. Finalized this October and scheduled to take effect in 2019, in the middle of the holiday season payday lenders have launched an effort to end the rule before it begins. Five bipartisan lawmakers in the House of Representatives introduced a measure on December 1 that would accomplish two specific goals: Stop CFPB’s rule from going into effect that would stop the harms of unaffordable payday loans; and Deny all federal agencies – including the CFPB – from pursing a similar rule in the future. Known as H.J. Resolution 122, Florida Congressman Dennis Ross is its chief sponsor, who represents a state where the average payday loan interest rate is 304 percent. He is aided by another Florida colleague, Rep. Alcee Hastings from the Ft. Lauderdale area, and a long-time supporter of payday lenders. Other Members of Congress joining this payday rule repeal effort hail from Georgia, Minnesota, Ohio and Texas. These Congressmen could secure a floor vote on the measure before the congressional holiday recess begins. Among these states, Georgia is the only one with a state law that keeps payday lenders out of the Peach State. Georgia consumers, and others living in 14 additional states and the District of Columbia all have state protections that

As a result, these states collectively save an estimated $2.2 billion each year.In the other 36 states where payday lenders can legally charge triple-digit rates as high as 600 percent or more, the typical $350 payday loan that is borrowed for two weeks costs $458 in fees. Research released earlier this year by the Center for Responsible Lending found that each year these same states’ payday borrowers end up paying $4.1 billion in annual fees. Similarly, this report found that in the 23 states where car-title loans are sold, borrowers of this predatory loan pay another $3.9 billion in fees each year. As vehicles are used as collateral on the loans, repossession – not repayment – is a common result that can jeopardizes employment and more. When fees are totaled on these two types of loans, $8 billion in fees is paid every year by consumers with average incomes of only $25,000. The proposed resolution would allow this abusive product to be sold across the country without restrictions. For Texas Congressman Henry Cuellar who has termed his district “as one of the poorest in the country” he sees payday lending providing a market-based need for consumers who lack access to full-service banking. But the poverty that he sees is likely worsened by the typical payday loan rate of 662 percent that the Lone Star State’s consumers are charged. Payday lenders are associated with harms such as increased likelihood of bankruptcy (continued in last 2 columns)
and delinquency on other bills such as rent and medical expenses. When the long-awaited rule was announced, the CFPB made clear that the rule was meant to stop the payday debt trap from plaguing communities across the country. For the first time, federal financial safeguards were put in place to prevent payday lenders from setting up all borrowers to eventually fail. Previously and under the Military Lending Act, active-duty servicemembers and their families were protected. It seems somehow un-American for the working poor to be forced to accept triple-digit debt traps when they only need a few hundred dollars. Ample data exists that clearly proves how triple-
digit interest causes debt traps that leave consumers worse off financially. With every renewal of a payday or car-title loan, borrowers’ financial stress increases as the costly payments grow and often lead to delinquency on other bills and/or lost checking accounts. For consumer advocates, there’s a name for it: predatory lending. “The line in the sand is clear – you’re either siding with payday lenders or you’re siding with consumers,” said Yana Miles, Senior Legislative Counsel at the Center for Responsible Lending. “Unfortunately, for these members who introduced this Congressional Review Act resolution, their allegiance is to the payday lenders.”

Your Medicare costs in 2018 By Greg Dill
How much will your Medicare cost in the coming year? The numbers just came out, so let’s go over them. We’ll start with the Medicare Part B premium. Part B covers doctor services, outpatient hospital services, certain home health services, durable medical equipment, and other items. The standard monthly premium for people with Part B will be $134 for 2018, the same amount as in 2017. Under the law, people with Part B pay 25 percent of the costs of running the program, with the government picking up 75 percent. A statutory “hold harmless” provision applies each year to about 70 percent of Part B enrollees. For these enrollees, any increase in Part B premiums must be lower than any cost-of-living increase in their Social Security benefits. After several years of no or very small increases, Social Security benefits will increase by 2 percent in 2018 due to a cost-of-living adjustment. Therefore, some beneficiaries who were held harmless against Part B premium increases in prior years will see a higher premium in 2018. Part B enrollees held harmless in 2016 and 2017 will see an increase in their Part B premiums from the roughly $109, on average, they paid in 2017. An estimated 42 percent of Part B enrollees are subject to the hold harmless provision in 2018 but will pay the full premium of $134, because the increase in their Social Security benefit will be greater than or equal to an increase in their Part B premiums up to the full 2018 amount. About 28 percent of Part B enrollees are subject to the hold harmless provision in 2018 but will pay less than the full $134 premium. That’s because the increase in their Social Security benefit isn’t big enough to cover the full Part B premium increase. The remaining 30 percent of Part B enrollees aren’t subject to the hold harmless provision and will pay the full $134 per month in 2018. This group includes benefi-
ciaries who don’t receive Social Security benefits; enroll in Part B for the first time in 2018; are directly billed for their Part B premium; are eligible for both Medicare and Medicaid and have their premiums paid by state Medicaid agencies; and pay higher premiums because their incomes are higher. Since 2007, beneficiaries with higher incomes have paid higher Part B premiums. These higher premiums apply to about 5 percent of people with Part B. Now let’s take a look at Medicare Part A, which covers inpatient hospital care, skilled nursing services, and some home health services. About 99 percent of Medicare beneficiaries don’t pay any Part A premium since they’ve worked for at least 40 quarters in Medicare-covered jobs. The Part A deductible that beneficiaries pay when admitted to the hospital in 2018 will be $1,340 per benefit period, a rise of $24 from 2017. The Part A deductible covers beneficiaries’ share of costs for the first 60 days of Medicare-covered inpatient hospital care in a benefit period. Beneficiaries must pay a coinsurance amount of $335 per day for the 61st through 90th day of a hospitalization (versus $329 in 2017) in a benefit period, and $670 per day for lifetime reserve days ($658 in 2017). For beneficiaries in skilled nursing facilities, the daily coinsurance for days 21 through 100 of extended care services in a benefit period will be $167.50 in 2018 ($164.50 in 2017). Riverside County: First flu-related death confirmed Health News A Murrieta child who recently died in Riverside County tested positive for influenza, according to health officials. The death is the first flu-associated death of this flu season in Riverside County. The child is under 10 and was a Murrieta resident, according to Dr. Cameron Kaiser, Riverside County public health officer. “This is a tragic reminder that the flu still kills,” Dr. Kaiser said. “Get your flu shot and get protected.” The child’s vaccination status and whether there were any underlying health issues such as a compromised immune system are
not known. There is still time to get the flu shot, Kaiser said, adding that the Centers for Disease Control and Prevention (CDC) recommends that all persons 6 months of age and older receive a flu vaccination each year. Dr. Kaiser also recommends frequent hand washing and avoiding getting close to people who are sick as ways to avoid the flu. And if you or your child are sick, stay home from work and school. And during this time of the year, families fly and drive to gather around the dinner table. We reflect on, laugh about and grieve over memories of years and those who have passed. Not only is it an important time to catch up with relatives, but also to make sure they’re well and taken care of. It’s also during the holidays when it’s often most clear that Grandma’s health is faltering and that she needs someone to help her transition into a care facility. Or we realize that Dad doesn’t have anybody to take care of him when he gets his hip replaced next month, meaning no one to help him shop for groceries or get him to his rehabilitation appointments. The good news is that, if you do have to take a few weeks off from work to get Grandma settled in a care facility or get Dad nursed back to full health, you might get some of your pay while on leave. Through California’s Paid Family Leave (PFL) program, eligible workers can get up to six weeks of paid benefits to care for a seriously ill or injured family member (including spouses, registered domestic partners, siblings, children, grandchildren, parents, parents-in-laws and grandparents). This time off from work can be taken all at once or taken as needed over the course of a year, meaning you can be there for your family members over an extended period of time or intermittently, depending on the kind of care and support they need. Starting in January, paid benefits are increasing to up to 70 percent of weekly income for some Californians. California was the first state in the nation to acknowledge the importance of being there for family during these important life moments by enacting a PFL program. Now, our state will also lead the nation with the highest wage replacement rate, further reducing the financial strain that these tough times can have on families. Importantly, these are benefits that workers have already paid for – PFL is NOT a government assistance program. Thanks to paycheck deductions for the State Disability Insurance program (noted as “CASDI” on paystubs), you have been putting away money for these life moments without noticing it. So, if you take time off without applying for PFL, you’re potentially walking away from money that you’ve already saved for exactly this kind of situation. In total, some 18.1 million Californians are covered by PFL benefits – and you may be one of them. Ask Dr. Kevin: Understanding Clinical Trials And Sickle Cell Disease In The Black Community By Dr. Kevin Williams (Chief Medical Officer, Pfizer Rare Disease Unit)
Dr. Kevin Williams says that finding enough patient volunteers is often a challenge in conducting clinical trials. This article is the third installment in the “Ask Dr. Kevin” series, brought to you by Pfizer Rare Disease in collaboration with the National Newspaper Publishers Association (NNPA) to increase understanding of sickle cell disease. Clinical trials are critical to bringing new medicines to people who need them, particularly those affected by conditions with limited treatment options, such as sickle cell disease (SCD). These studies, which determine the safety and effectiveness of new investigational treatments, rely on the participation of volunteers. Without enough volunteers, researchers are unable to complete the research required by the U.S. Food and Drug Administration (FDA) to evaluate if a new drug should be made available to patients.
Therefore, the only way to get any drug approved by the FDA and accessible to patients in need is through clinical trials. Unfortunately, finding enough patient volunteers is often a challenge in conducting clinical trials, and this has been particularly true for trials exploring new treatment options for SCD, which occurs in one out of every 365 African American births. Although African Americans make up 12 percent of the U.S. population, they comprise only 5 percent of clinical trial participants overall. Fear and misunderstanding about clinical trials likely contribute to the difficulty of recruiting participants. Recently, Pfizer and the NNPA collaborated on a national poll consisting of 741 participants to learn more about perceptions of SCD and clinical trials in the African American community. A majority of respondents indicated a willingness to participate in future clinical trials for SCD, if given appropriate knowledge and recommendations from health care professionals. Of those who indicated that they would not participate in clinical trials, ‘fear of uncertainties’ was the most cited reason. To help address some of these (continued in next 2 columns)
Ask Dr. Kevin: Understanding Clinical Trials And Sickle Cell Disease In The Black Community...continued uncertainties, I’m here to answer the most common questions about clinical trials. It is my hope that this information will help you make an informed decision should you or a loved one choose to participate in a clinical trial in the future. Are clinical trials safe? Strict guidelines and supervision are in place to protect the safety of people who take part in studies—from careful study design to periodic monitoring of study data by independent experts. That said, clinical trials are designed for research purposes, and because of this, there is some level of risk involved. However, before an investigational drug can be given to clinical trial volunteers, researchers must complete a rigorous screening and preclinical testing process (in the laboratory and in animals), which can take up to six years to complete. If I participate in a clinical trial, will I get a “sugar pill” or placebo instead of a real drug? Participants in a clinical trial using a placebo will always be informed if there is a possibility they could be receiving the placebo, which looks identical to the real drug but does not contain the active ingredient. However, the vast majority of studies are not placebo-controlled trials, and patients in the clinical trial who are not receiving the drug under study will receive the current standard of care available to the public. Patients who take part in clinical trials will never be asked to sacrifice quality of care. Will it be expensive to participate in a clinical trial? Patient care costs are generally covered by health insurance, as they are for tests and treatments you would receive even if you were not involved in the research. The majority of participants in clinical studies receive at least some reimbursement from their health insurance. Most often, the clinical trial sponsors will pay for the study therapy and insurance companies will pay for the routine care procedures, such as blood tests. Before participating in clinical trials, I recommend checking with the researchers regarding your financial responsibilities as a patient, as well as with your health insurance carrier regarding coverage.
How do I find out about clinical trials? You can always talk to your doctor; however, he or she may not know about all available clinical trials that might apply to you. Only approximately 1 in 5 patients say that their health care professionals have talked to them about participating in a clinical trial. As for resources, the National Institutes of Health has an online database that is a great tool to search for appropriate trials: https://clinicaltrials.gov. Another great resource is “I’m In,” a campaign to build awareness about the importance of diversity in clinical trials, especially among African Americans, Asian Americans, and Hispanic populations. You can find more information on Pfizer’s Clinical Trial page, too. What’s the timeframe for clinical trials? I’m often asked, “Why does a new treatment take so long?” The short answer is that treatment takes as long as it does because the cardinal rule of medicine is “First, do no harm.” Thus, the development of a new therapy is a multi-stage, complex process that has to meet the highest standards of patient protection. Clinical trials, which generally take 5 to 10 years, are at the center of the rigorous science that demonstrates the safety and efficacy of a medicine and provides a thorough view of its benefits and risks, and is the only avenue to bring medications to patients in need. Sleeping With Your Phone Can Cause Cancer, Infertility & More Health News
We do everything with our mobile phones. We order gifts, we find directions, we check on family pictures, we share our ups and downs…oh, and of course we call people too. We are on them so much, many of us fall asleep with cell phones in our bed. Now, it’s how often we are using these phones that we are at risk of certain diseases. According to the California Department Of Public Health, it’s because mobile phones put out radio frequency (RF) energy. Some scientists and public health officials believe RF energy may affect human health. Although the science is still evolving, some laboratory experiments and human health studies have suggested the possibility that long-term, high use of cell phones may be linked to certain types of cancer and other health effects, including: – brain cancer and tumors of the acoustic nerve (needed for hearing and maintaining balance) and salivary glands – lower sperm counts and inactive or less mobile sperm – headaches and effects on learning and memory, hearing, behavior, and sleep The notice comes after several cities, including Berkeley and San Francisco, issued local warnings that people should make some distance between their phones and their bodies. While the RF from mobile phones remains at relatively low levels compared to large scale industrial instruments, research has suggested that our frequent and
close-range exposure to mobile phones means it could be enough to put us at risk. In fact, some smartphone manufacturers like Apple agree and even include an ‘RF exposure’ notice in the iPhone’s settings. Apple explains that the iPhone’s RF emissions were tested at 5mm from the body, and fall within the US standards of safety, as well as providing advice for reducing exposure like using speakerphone or handsfree accessories. Previous studies have shown evidence that mobile phone exposure may cause tumors in the brain or ears, while…psychologists have warned it could also be linked to poor mental health, attention and sleep in teenagers. The California guidelines warn against close contact when phones have two or fewer bars of signal, when moving in a car, or if you’re trying to receive or send large quantities of data. Instead of leaning your head on your phone or sleeping with the phone in your bed, the study also suggests using headsets, sleeping with your phone away from you like on a night stand or across the room and carrying them in a bag instead of in your pocket.

How To File a Fictitious Business Name in California You must register an assumed name within 40 days of starting to conduct business (which can be different from the date of forming your business entity). For 30 days after registering, you must run a weekly notice in a newspaper of record for the county, and attest this afterwards by affidavit to the Clerk. The registration must be renewed every 5 years, but newspaper publication is not required unless details have changed. Registering a fictitious business name does not create a business entity. The document is actually known as a "statement" and it purely creates a record that gives the general public a way to know who they're dealing with, as well as allowing formal process to reach through a brand name to the legal structure underlying it. Additional statements can be filed to record that the assumed name has now been abandoned, or that a partner has withdrawn from a partnership operating under a fictitious business name, and is no longer to be connected with that name. FICTITIOUS BUSINESS NAME REQUIREMENTS A fictitious business name cannot be the same as a name already in use, or so similar as to confuse or mislead. And while certain legal designations such as "Inc" and "LLC" cannot be used unless you are such an entity, certain unsupported designations such as "Company" or "Ltd" are allowed in California. If you're a self-employed contractor, you're a sole proprietorship by default, and the name of the legal "entity" doing business is you, under your name. You can use a business name that includes your surname without needing to register a fictitious name - for example, "John Doe Cars". But to obscure the name ("JD Cars") or to imply more owners or a different structure ("Doe & Sons", "Doe & Associates", "Doe Company") will require recording the name as an FBN. Frequently a sole proprietorship will do business under a fictitious name for ease of transactions. A partnership is also legally named from its owners' names, and will often make a similar choice. Filing an FBN will usually be necessary before a bank will open a business account under the assumed name. Obviously a business wants to receive payments made out to its trade name - and this is increasingly common with Internet domain-name branding, when many business names have a “DotCom” attached to them. Corporations and LLCs can choose their business name when they file their Articles to form the entity. But frequently they'll want to adopt a different name, or many such names, for branding or trademark reasons. If a company is launching a new product or service, marketing decisions may call for a new brand name. Or, if John Doe Texas wants to expand operations into California and finds John Doe California already in business use, a new fictitious business name will be required. HOW TO REGISTER YOUR FICTITIOUS BUSINESS NAME State law (California Business And Professions Code Sections 17900-17930) requires you to register with the Clerk of the county housing your principal place of business, or with San Bernardino County if you're an out-of-state company. There's no limit to the number of names you can register, provided they're available and meet relevant criteria. The recording fee is set by law , but individual counties will vary . San Bernardino County, for example, charges $55, and $10 for each additional name in the same filing. Registration forms also vary by county. And it doesn’t just build to one climax; it crescendos from one climax, to the next and the next, ratcheting up the tension every time. Action/adventure fans will be dancing in the aisles. There is something biblical about “Star Wars: The Last Jedi.” There’s the Old Testament: Princess Leia (Carrie Fisher), Luke Skywalker (Mark Hamill) and Chewbacca (Peter Mayhew); the New Testament: Rey (Daisy Ridley), Finn (John Boyega) and Poe Dameron (Oscar Isaac); Devils: Supreme Leader Snoke (Andy Serkis), General Hux (Domhnall Gleeson) and Kylo Reb (Adam Driver); there’s temptation; a hunt for the “Promised Land”; and a desperate escape from the wicked. On a desolate, mountainous isle, the young warrior Rey begs the aged Luke Skywalker for guidance and help for The Resistance’s fighters. “We need you. We need the Jedi order back. We need Luke Skywalker,” pleads Rey. She delivers that message from Princess Leia, but the old Jedi is not moved. Meanwhile in outer space, the Resistance is under attack by the First Order and trying to evade them. Finn and Poe go rogue to save the day. Snoke, Hux and Reb are out to crush the rebels. The very heady, ethereal script by writer/director Rian Johnson (“Looper”) unearths many questions and is stingy with the answers. Your curiosity will drive you crazy. Only when you are stumped and at wit’s end will you find closure. Just know that the wait is worth it. The editing by Bob Ducsay (“Looper”) and Johnson’s inventive direction, measure the drama, action and rescue attempts out in a rhythm that is almost spiritual, like the rhythm of life. Help comes when it is preordained. Characters enter, they embark on divergent paths and head out on enthralling missions. Scenes flow smoothly and have a similar feel, unlike 2015’s “Star Wars: The Force Awakens,” when energiz-
ing action sequences butted up against too many stagnant moments. There are some slower passages, but they are never boring. Use these opportunities to gather your thoughts, digest what you’ve seen and take a deep breath. You will need the rest. Your attention will be overpowered by a force that doesn’t let you decompress, substantially, for 2 hours and 32 minutes. There are moments when you might think, “This is so overwrought. So melodramatic.” Then a glib line is rendered or a wacky scene (wide-eyed urchins screeching) breaks the spell. You laugh for a moment or smirk. Then you jump back into the conflict again, just as a laser slices a villain in half, as a courageous fighter goes down in flames or as two individuals have an intimate telepathic conversation even though they are eons away from each other. The script, direction and acting are excellent. The imagery is even better. Some visions will be engraved on your pupils forever. Scenes in Snoke’s throne room with blood red walls, warriors in similarly colored uniforms and his gold brocade robe (designed by Michael Kaplan, “Blade Runner”) are indelible. Rickety old fighter planes sand surfing over white salty terrain, leaving a trail of poinsettia red gashes and the sight of galloping alien horse-like creatures will also stay with you. The work by art directors Andrew Bennett and Neal Callow, production designer Rick Heinrichs and cinematographer Steve Yedlin is exquisite. These are the kind of visuals you see in a Yimou Zhang art film (like his “Hero” or “Raise the Red Lantern”), not in an action/adventure movie. Ridley, Bodega, Isaac and Driver provide an unbridled energy. Yet, it’s the heavyweights, the late Carrie Fisher and grayhaired Mark Hamill, who lend a gravitas that stabilizes this fantasy in an altered reality that’s become the heart of the Star Wars saga. Nationwide — Time magazine is under fire for their latest “Person of the Year” issue which addresses the #MeToo social movement on it’s cover, but excludes Tarana Burke, the Black woman who actually started the movement. Critics says Time wanted to give more attention and credit to the white celebrity women who helped publicize the movement. The cover features actress Ashley Judd, singer Taylor Swift, corporate lobbyist Adama Iwu, worker Isabel Pascual and former Uber engineer Susan Fowler. Three of these women are white, and two are Black, but again, the woman who started the slogan is missing. Burke, who is 44-years old, was interviewed by Ebony magazine earlier this year, and said she launched the Me Too slogan back in 2006 as a grassroots movement to aid sexual assault survivors in underprivileged communities. During the interview, she said, “It wasn’t built to be a viral campaign or a hashtag that is here today and forgotten tomorrow. It
was a catchphrase to be used from survivor to survivor to let folks know that they were not alone and that a movement for radical healing was happening and possible.” “What’s happening now is powerful and I salute it and the women who have disclosed but the power of using ‘me too’ has always been in the fact that it can be a conversation starter or the whole conversation – but it was us talking to us,” she continued. Most people, including actress Alyssa Milano, who was featured on the cover of Time, acknowledge that Burke started the slogan. Milano recently tweeted, “I was just made aware of an earlier #MeToo movement, and the origin story is equal parts heartbreaking and inspiring”. Simeon Booker, An Icon Of Black Journalism, Dies At 99 By Stacy M. Brown (NNPA Newswire Contributor)

(Wikimedia Commons) Simeon Booker, a trailblazing Black journalist, who covered the Civil Rights Movement for the iconic African American magazines EBONY and Jet and who was the first Black person to work as a full-time Washington Post reporter, has died. Booker, who’s credited with playing an integral role in delivering the story of Emmett Till’s murder, was 99. “As Chairman of the NNPA, I know that we honored Simeon Booker during Black Press Week for his overall excellence of journalism and certainly he is someone that has been very, very important to our industry,” said Dorothy Leavell, the national chairman of the NNPA and publisher of the Crusader Newspapers in Chicago, Ill., and Gary, Indiana. “His presence will be deeply missed. Even though he lived a long life, we still mourn and we send our sympathies to his family and want them to know that he was highly-appreciated at the NNPA and the Black Press around the country,” Leavell said. Simeon Saunders Booker, Jr. was born on August 27, 1918, in Baltimore, Maryland to Roberta Waring and Simeon Saunders Booker, Sr., a YMCA director and minister, according to his biography published by The HistoryMakers. After his family moved to Youngstown, Ohio, Booker became interested in journalism through a family friend, Carl Murphy, the owner and operator
of “The Afro-American” newspapers, also known as “The Afro,” in Baltimore, Md. In 1942, after receiving his bachelor’s degree in English from Virginia Union University in Richmond, Booker took a job at the The Afro-American as a young reporter. In 1945, he moved back to Ohio to work for the “Call and Post.” Five years later, Booker was the recipient of the Nieman Fellowship from Harvard University to study journalism and develop his talent as a reporter. After leaving Harvard in 1951, Booker became the first full-time Black reporter at “The Washington Post.” In 1954, Booker was hired by the Johnson Publishing Company to report on current events in its weekly digest, Jet. In 1955, Booker helped to redefine the role of Jet and the entire Civil Rights Movement with his famous coverage of the Emmett Till murder and trial, turning an all too familiar event in the Deep South into a national tragedy that united the Black community. Booker remained on the dangerous frontlines of the Civil Rights Movement, reporting on the 1957 integration of Central High School in Little Rock, Arkansas. In 1961, Booker rode with the Congress on Racial Equality (CORE) Freedom Riders through the Deep South. When the buses were firebombed in Anniston, Alabama, Booker arranged the Freedom Riders’ evacuation with U.S. Attorney General Robert F. Kennedy. Continuing his work of in-depth reporting, Booker toured Vietnam and interviewed General Westmoreland for Jet in the mid1960s. In 1964, Booker outlined the importance of the ongoing Civil Rights Movement in his (continued on page 7)

Ivy Beckwith Faith Formation Team Leader A few years ago I sat around a table with my colleagues at the national offices of the United Church of Christ. As we were waiting to address the topic for the meeting, one of my colleagues mentioned that he had been on the phone that morning with one of our churches whose rainbow banner had been vandalized. The church was seeking advice on how to deal with this. Several people spoke up – asking questions and offering help. I asked if, in the course of the conversation, the person calling from the church had asked how to talk with their children and youth about this act of violence. They had not. I believed then, and I believe now, that not addressing what happened to the banner with the church's children and youth was a lost opportunity for faith formation and helping them understand God's dream of a just world for all. After all, they know that it happened. Just because we don't directly tell our children and youth about something that happens in our churches doesn't mean they don't know about it – because they do. By specifically addressing this with them the church had the opportunity to talk about why displaying the banner is important for the church's justice witness and to talk about the appropriate response to the people who committed the vandalism. This discussion could help the children and youth connect this stand for justice with the life of a person who follows Jesus and understand that God loves everyone even those who deface property that does not be-
long to them. When we leave children and youth out of our discussions about and concrete actions for justice in our world we deprive them of an important piece of their faith formation as they never learn to connect what they learn at church with the shalom of the reign of God. Kathleen and James McGinnis, in their book Parenting for Peace and Justice, offer some tips for involving children in social justice activities. Invite children to join you in social action that is within their capabilities. Give them age appropriate experiences with victims of injustice. Integrate fun whenever possible and remember involvement means "with" not "for." Family Protest, a new video from the Riverside Church of New York City, provides some concrete ideas for your church and your families. And, I would add a fourth tip – always make the connection between working for justice and being a follower of Jesus. We fight injustice and work for a just world for all because this is what people who love God and follow Jesus do. So the church with the defaced banner might have said “We hang this banner because we believe that God loves everyone and no one should be mistreated because of who they love. This is what people who follow Jesus do.” Making that connection will help your church and your families grow children and young people who both love their neighbors and love Jesus.

Precious Angel Smith, one of the program participants, said that she’s working to dispel the negative stereotypes that millennials don’t understand the importance of working hard and that they’re too obsessed with technology to engage with the world around them. Smith said that it can be hard searching for jobs and networking as a Black millennial. “Being Black sets me apart as it is, then when you add the fact that I’m a woman and a millennial, that’s when things get sticky,” said Smith. “Because of those three attributes, I constantly find myself having to go the extra mile and surpass the expectations that have been predetermined for me.” Smith continued: “I’ve learned that in this world, being a Black millennial will never be easy, I will have to continue to work three times as hard as [White men]. However, one thing I will never do is jeopardize my morals and values in an attempt to be accepted in the workforce.” Xavier Robertson said that sometimes millennials are stereotyped for lacking a strong work ethic. “This is a misunderstanding,” said Robertson. “It’s not that we don’t like to work, it’s that we like to do work that matters and for people that care.” Robertson continued: “We
want to make an impact and we want to be respected. Millennials want to be challenged and inspired on a daily basis, so that we can maximize our potential.” During the Seattle trip, Chevrolet provided millennials with the Chevy Trax sports utility vehicle to use as a mobile working space. The 4G LTE Wi-Fi within the vehicle allowed the teams (up to seven devices) to connect to the Internet, research necessary information and collaborate on their findings. While traveling to their various destinations, the drivers used Apple CarPlay or Android Auto for navigation and playing music. Chevrolet equipped the Trax with a printer, coffee machine and other office gadgets that were plugged into the 12-volt outlet in the rear seats. Once each team arrived at their destination, the front passenger seat folded down, providing a completely flat working desk for laptops, tablets or writing. Following the think tanks, the National Millennial Community participants traveled to a central location and crafted a tool kit designed to help their peers find jobs and network more effectively. Smith said that as a member of the National Millennial Community, she has benefitted in ways that she could have never imagined. Smith said that she has not only traveled to different states to share different perspectives as a millennial, she has also had the opportunity to meet CEOs and owners of major corporations. Robertson agreed that the experiences provided through the National Millennial Community are life-changing. “The National Millennial Community is an awesome group of diverse individuals working to inform people about the misconceptions about millennials,” said Robertson. “This community not only assembles millennials from around the country to talk about these issues, but we also had the opportunity to talk face to face with the leaders of influential brands in the United States.” Robertson continued: “We are able to have a direct impact on the conversation about us. Washington, D.C. – Congresswoman Barbara Lee released the following statement after House Republicans voted to advance a tax bill that steals from middle-income families to line the pockets of the wealthiest 1%: “House Republicans just passed the greatest tax scam in American history. The Tax Cuts and Jobs Act is not tax reform, it’s a crooked scheme that steals from the hard-earned pay checks of low and middle income families just to line the pockets of millionaires, billionaires and wealthy corporations. Independent economic experts have weighed in and one thing is certain: this bill only benefits the rich. “Just yesterday, the Tax Policy Center found that under this bill more than half of all Americans would face tax increases in the next ten years. That means 86 million middle-income households
will see their taxes go up, just so Republicans can line the pockets of millionaires, billionaires and wealthy corporations. The GOP Tax Bill is Final: How Does it Affect You? CA Black Media The Republicans’ final tax plan perpetuates economic, educational, and wealth disparities in the United States and the President is committed to signing it. However, the Joint Committee on Taxation and Tax Policy Center found that all income groups will, on average, see a tax cut in 2018 and 2019, with proper planning. Californians did not fare as well as the rest of the nation, since the final plan limits the deductions for income, sales, and property taxes to $10,000 annually and California has the highest income and sales taxes and second highest gas taxes in the nation. This reminds me of a Belizean proverb that says “Don’t call the alligator a big-mouth until you have crossed the river” If you itemize deductions, the GOP plan preserves 401(k) rules, the adoption tax credit, and deductions for the graduate school stipend (tax-free tuition waiver), the student loan interest and charitable giving. In addition, the medical expense deduction threshold was lowered to 7.5 percent for 2018 and 2019, but it reverts to 10 percent thereafter. To capitalize on these it would be wise to plan any major medical procedures in 2018 or 2019. You should consider increasing your 2017 charitable deduction, 401(k) IRA deductions, and contributions to your children’s college now. The GOP plan allows mortgage interest deduction on new loans up to $750K. Existing loans remain deductible up to $1 million under current law. If you are planning to purchase a new home in 2018, consider asking the seller to carry a second “principle-only” loan, and/or increasing your down payment to avoid a home mortgage greater than $750,000. Additionally, be sure to claim the property tax homeowner’s exemption of $7,000 with your local county assessor
and examine any additional property tax assessments (school bonds, water district taxes, municipal bonds, etc.) which could increase the cost of your new home and your taxes. Don’t get it twisted, buying a home is still a good investment considering the appreciation and long term savings from rent increases. The plan eliminates the personal exemptions of $4,050 for each family member, but doubles the standard deduction to $24,000 if married, $18,000 for heads of household, and $12,000 if single. It also expands the child tax credit from $1,000 to $2,000 (of-which $1,400 is refundable) and provides for a temporary $500 credit for each non-child dependent (for example, a child 17 or older, an ailing elderly parent, an adult child with a disability). The plan also expands the use of 529 accounts to reimburse up to $10,000 in educational expenses for students in K-12 private schools or who are homeschooled and preserves the Earned Income Tax Credit of up to $6,318 for qualified individuals earning less than $53,930 (for the 2017 federal tax year). If you qualify for all of the above, you may actually receive a refund, even if you paid zero taxes and are not required to file your tax return. Grandparents can profit from the annual gift tax exclusion of up to $14,000 by giving their children money to pay for childcare and summer camp, depending on their income, and your children can then claim the childcare deductions. You could also give money to your college graduate to double down on their college loan interest, depending on their income, and then they can deduct the student interest; keeping the money all in the family. Changes to Obamacare eliminated the mandatory provisions (continued on page 8 )
Did She Resign or Was She Fired From the White House? — Omarosa Explains Local/National News
Nationwide — Omarosa Manigault Newman, President Donald Trump’s aide who resigned earlier this week, says that she was not terminated or escorted off White House premises, but simply “resigned to pursue other opportunities.” But the United States Secret Service has confirmed that although they were not involved, she was, in fact, dismissed. The agency tweeted: “The Secret Service was not involved in the termination process of Ms Manigault Newman or the escort off of the complex. Our only involvement in this matter was to deactivate the individual’s pass which grants access to the complex.” But Omarosa continues to deny such reports. She is also denying
that she left the White House after a rumored confrontation with White House chief of staff John Kelly. In addition, she is denying that she allegedly tried to re-enter the White House to confront President Trump about her dismissal. Omarosa was one of Trump’s most high-profile African-American supporters, and received a lot of backlash from the Black community because of it. The two met when she was a contestant on his hit reality TV show The Apprentice, and when he decided to run for president, she was hired to his staff. Trump addressed her publicly on his Twitter account, saying, “Thank you Omarosa for your service! I wish you continued success.” But CNN reports that several White House staff members had a problem with her, and specifically John Kelly, who became the White House Chief of Staff in July 2017, wanted to fire Omarosa… and eventually did!
You remember the saying: “like father like son?” It is only a few days since the former Former Congressman John Conyers resigned from his public position, but seemingly he might be returning back to politics to maintain his political image, through his son. Conyers resigned amid sexual harassment, but now he is endorsing John Conyers III, his son to succeed him in an effort to maintain his decades-long political legacy. However, the younger Conyers, who partners with a Detroit minority-operated hedge fund, hasn’t yet decided if he’ll follow his dad’s footstep, saying that he’ll need “time to keenly listen to the community.” “It’s an honor that my dad endorsed me for his Congressional position,” he stated. “I am grateful for the incredible support that we received before and after the endorsement.” But before he decided, Conyers III, said: “During the coming few weeks, I will hear from our civic leaders and the folks of Detroit who are spearheading one of the greatest stories of Urban America.” “I have not yet concluded if I’ll be a candidate,” he added. “But I hope to decide by the New Year — after I have taken enough time to listen to the community, thoroughly.” Despite having about a half dozen women haunting him down for sexual harassment, the former Rep seems optimis-
tic that his son will succeed him. “My legacy cannot be diminished or compromised—by what we’re currently undergoing—in any way,” the senior Conyers said while in the hospital. “This one too shall pass.” And even before deciding whether to vie or not, news of the young Conyers’ involvement in domestic violence with his girlfriend in Feb., has reemerged. The younger Conyers was allegedly involved in a domestic fight with his ex-fiancé which ended with the lady sustaining a stab wound on her arm. The prosecutors, however, declined to bring charges, arguing that “the complainant could not prove a misdemeanor domestic battery.” “I didn’t stab her,” Conyers III said in an interview. “I am not a violent guy. That’s absolutely false. That isn’t me.” He admits that “there was an intense verbal altercation that escalated. But I never tried to go grab or do anything with a knife.” Meanwhile, If he finally runs, Conyers III will compete with another family member, as the Michigan state Senator and older Conyers’ grandnephew—Ian Conyers—announced that he would be contesting for the office. Another threatening name in the race is Coleman Young II, who’s the son of Detroit’s 1st Black mayor, Coleman Young.

There were problems. We had slavery; we’ve overcome slavery. We’ve had prejudice; we still have prejudice, but we’ve turned the tide on civil rights. We’ve done a lot of things to bring this country around, and I think we can still make it better.” Moore’s wife, Kayla, even got into the controversial fray. One day before the election, Kayla Moore argued that her husband isn’t a bigot. “One of our attorneys is a Jew,” she said. “Fake news would tell you that we don’t care for Jews. And I tell you all this, because I’ve seen it and I just want to set the record straight, while they’re here,” she said gesturing to mainstream media outlets that were in the room. “One of our attorneys is a Jew. We have very close friends that are Jewish, and rabbis, and we also fellowship with them.” Moore has never been one to stay above controversy. Even before the allegations that he pursued sexual relationships with teens, Moore was the most controversial major-party U.S. Senate nominee in recent memory, according to CNN. He was booted off the Alabama Supreme Court bench when he served as chief justice for refusing to remove a two-ton statue of the Ten Commandments that he’d ordered placed on state property. He was elected back to the job, but ousted again in 2016 for refusing to abide by the U.S. Supreme Court’s decision legalizing same-sex marriage. Moore said that homosexual activity should be illegal and argued against removing segregationist language from the state constitution. One of Moore’s accusers said he molested her when she was 14; another said that he tried to rape her and she fought him off. Still, Trump and the RNC threw their
support behind him. Fifty percent of voters said the allegations against Moore were definitely or probably true, while 44 percent saw them as definitely or probably false, according to preliminary exit poll results reported by ABC News. A majority of voters (54 percent) said the allegations were a minor factor or not a factor at all. Chris Cillizza wrote that, “Jones’ victory means that for now Democrats are only two seats away from the majority—Vice President Mike Pence casts the tie-breaking vote when it is 50-50. While a Democratic move into the majority still looks like a long shot, it’s now not out of the question.” Jones, an attorney and prosecutor, served as U.S. Attorney for the Northern District of Alabama, and won acclaim for prosecuting the remaining Klansmen responsible for the 16th Street Baptist Church bombing that killed four African American girls in 1963. Shortly after mainstream news outlets predicted that Jones had won the special election, he took to Twitter to celebrate the victory. “Thank you Alabama,” Jones tweeted the night of the election. In a statement about the Alabama Senate race, Reverend Jesse Jackson, Sr., the founder of the Rainbow PUSH Coalition, said that a coalition of Black and White voters spared Alabama from international shame and disgrace by electing Jones to be the state’s next United States Senator. “The coalition that pushed Jones over the finish line can win and redeem the whole South,” said Jackson. “It is a stinging repudiation of the divisive politics of Moore, President Donald Trump and strategist Steven Bannon and bodes well for Democrats looking at House and Senate congressional races in 2018.” Freddie Allen contributed reporting for this story.

Kellogg Foundation (WKKF) grantees, partners and communities across the United States mark the second annual National Day of Racial Healing (#NDORH) on Jan. 16, 2018. "Racial healing is a process we can undertake as individuals, in communities and across society," says Kellogg Foundation President and CEO La June Montgomery Tabron. "At the Kellogg Foundation, we are committed to racial healing in order to create vibrant futures for children. The National Day of Racial Healing is a powerful platform for highlighting the healing work already underway and widening the circle of leaders committed to transforming their communities through this essential work." WKKF established the National Day of Racial Healing in January 2017 as an extension of its ongoing Truth, Racial Healing & Transformation (TRHT) efforts. Through a wide range of events, discussions and activities, groups brought together by civic, community, government and private organizations will focus on healing the wounds created by conscious and unconscious bias (racial, ethnic and religious). "In healing, we acknowledge the truth of past wrongs and the authentic narratives of people across communities," Tabron says. This will likely cause the premiums to increase significantly for those who remain, including Californians unless the state legislature takes immediate action to subsidize the program. Equally concerning, Congress has yet to reauthorize $2 billion in funding for the Children’s Health Insurance Program (CHIP), which provides health care coverage for 1 million children. The legislature must act immediately to encourage Congress to reauthorize the CHIP. Another devastating aspect of the Plan is that in 2018 it eliminates the deduction for casualty losses – for property lost or damaged by a fire, flood, earthquake, or due to theft – unless the area is declared a federal disaster area. The California legislature should seek federal designation of all calamities in California immediately. Losses resulting from our recent wild fires in 2017 remain deductible. Wealthy Californians will save millions with some strategic tax planning. Warren Buffett, the
second richest man in America, noted in the New York Times that he paid “a lower percentage of his taxable income than any of the other 20 people in his office.” Under the GOP tax plan, Mr. Buffett will pay even less taxes. The plan cuts the tax rate for households making over $600,000 and individuals making over $500,000 from 39.6% to 37%. The plan also cuts the corporate tax rate to 21%, down from 35%; and the Individual Alternative Minimum Tax exemption will be increased to $500K for individuals and $1 million for couples filing jointly, up from the current $54,300 for individuals and $84,500 for couples. In 2018, the plan doubles the amount of the current exemption from Estate Tax from $5.5 million to $11 million for individuals, and from $11 million to $22 million for couples filing jointly, with annual adjustments for inflation. Individuals with pass-through companies such as S corporations, LLCs, partnerships, or sole proprietorships will be allowed to deduct 20% of their taxable in(continued in next 2 columns)

Service businesses such as law firms, doctors’ offices, and investment firms can only take the 20% deduction if they make up to $315,000 (for couples.) In addition, the final bill gets rid of the corporate alternative minimum tax, a big relief to the business community, and allows for a new capital investment deduction for new capital equipment. Accordingly, if you work as an employee for companies such as Uber, you should consider setting yourself up as an independent contractor to take advantage of this huge tax break and waiting until 2018 to purchase any equipment. Doctors and lawyers may want to set up split companies where the assets are owned by a corporation and the partnership pays the salaries. Lastly, the plan changes the current worldwide tax system for multi-national corporations to a territorial tax system, which provides for a significant reduction in taxes on upwards of $3 trillion in foreign profits left abroad to avoid paying U.S. taxes and allows U.S. companies to delay the repatriation for years. To protect its taxpayers, California must consider tax reform that will stimulate long-term career employment for the 947,000 unemployed and 800,000 individuals living in poverty in California. I would recommend an onthe-job (OTJ) training program that provides job training for the unemployed, lowering the state income tax rate for the poor and middle-income earners to stimulate the economy, doubling the renter’s tax credit to increase af-
fordable living, and providing a deduction for parents who donate time and resources to public schools. To pay for these policies, the legislature could prioritize redirecting the current billions in existing tax credits and loopholes: toll the OTJ credit for one and 1/2 years to allow the state to capitalize on the economic stimuli of the credit; establish government efficiency programs that allow the state to recapture lost federal dollars, such as the $1.4 billion in unclaimed federal Earned Income Tax Credits; collect the upwards of $9 billion in taxes from the black market operators who unfairly compete with California businesses; and establish government efficiency programs to recapture the upwards of $18 billion in accounts receivables (unpaid taxes) at California’s taxing agencies. California leads the way in protecting children of immigrants, rightfully so, and we should do the same to protect Californians from the Republicans’ tax and public policies. The facts make some people uncomfortable. Pressure from people with a limited grasp of the past recently led the National Park Service to cancel a University of California historical research project regarding the Black Panther Party.
We know the Black Panthers are controversial. Even the document that awarded the grant refers to “the complex history of the Black Panther Party.” But the project was for understanding that history, for probing into it, and how it related to historical incidents going back to (continued in next 2 columns)

Instead of exploring history, we get an attempt to cover up the past by defunding the project. The Fraternal Order of Police wrote to President Donald Trump, protesting the grant for the research. That group has a complex history of its own, including protesting sales of Black Lives Matter tshirts. In their letter to the President, they called the Black Panthers “anti-American,” and quoted old FBI statements labeling it as “a black extremist group” advocating the “overthrow of the U.S. Government.” FBI Director J. Edgar Hoover listed the Black Panthers as a hate group. Yet, the FBI’s anti-Black Panther history goes far beyond that. The Black Panthers were subjected to constant surveillance, infiltration and attempts to discredit their activities. Its members were criminalized, attacked, and sometimes killed for their pursuit of justice in the Black community. Much of this was covered in an exhibit this year at the Oakland Museum of California. It is history. A thorough look at the Panthers’ history would include - as the Oakland museum did – the Party’s original 10 “wants.” They started with freedom, employment, and education, before getting to point 7: “We want an immediate end to police brutality and the murder of black people.” Officially sanctioned violence against Blacks is a fact of American history, going back to the Atlantic Slave Trade. The letter opposing the National Park Service grant barely touches on that shameful past, and in a skewed manner. The letter suggests a parallel between its opposition to the research project and opposition to memorials to the Confederacy that subjugated Blacks as slaves. That is wrong. To call Confederate markers, as the letter does, “memorials to aspects of the darker times in our history,” glosses over the 400year legacy of the horrors inflicted on African Americans and on our
country by the Confederacy. Today, communities of color still face negative reactions for organizing to pursue justice and equality in the face of incidents of peace officer violence. Groups like Black Lives Matter are seen as threats to a conservative world view. Those who share that view use the killing of a park ranger by a Panther as an excuse to defund the Black Panther project. That is an attempt to cover up history. Some members of the Black Panthers committed inexcusable acts. We won’t cover that up. But we also know Black Panthers filled a void in the social safety net for its community through programs such as benefits counseling; drug/alcohol abuse awareness programs; free food, dental, and health programs; and much more. The Black Panther Party, despite any failings, had positive impacts in its communities. To say otherwise is either distortion, or willful ignorance. The historical research project that has been aborted promised to collect oral histories by those affected by the Black Panthers and their movement. The project award document put out by the Parks Service speaks to an effort to “truthfully” address the legacy of the Black Panthers. Those who want to stifle the project seem afraid to engage in meaningful dialogue about the past. If history, any history, offers a lesson to us, it is that they will not be successful in the long run. It has been suggested by Martin Luther King, Jr. and by Theodore Parker, a 19th-century anti-slavery activist, that the arc of the moral universe bends towards justice. Maybe it’s right for opponents of this research to be afraid of history, because the facts suggest history will not be kind to them.
