Prudent house hunters usually await the results of a professional inspection before buying their dream home. All too often, though, one of the biggest contributors to a home’s value is neglected: the landscape. And that can prove costly.
“I feel bad telling people who’ve already put their life’s savings into a new house that their sprinkler system is outdated or was installed wrong,� said Jeff Wolfe of Sun Wolfe Irrigation Inc. in Phoenix. etro Phoenix’s lackluster housing market needs a boost. Home sales are down from a year ago. Prices are flat or down in most Valley neighborhoods. And more homeowners are trying to sell. Put simply — supply is up and demand down. The latest report from Arizona State University’s W.P. Carey School shows during October home sales were down 5 percent from October 2013’s already slowing pace. The Valley’s median home price fell to $208,000 in October after hitting a five-year high of $211,500 in July. “To get our housing market back to what we would consider normal will require a major increase in demand from local first-time home buyers,� said Mike Orr, director of ASU’s Real Estate Theory and Practice at W. P. Carey. Stricter lending guidelines, including bigger down payments and more income documentation, are blamed for part of the market’s slowing. About 45 percent of renters didn’t buy a house this year because they didn’t have enough money for a down payment, according to a Federal Reserve survey. So what will it take to draw more buyers, particularly first-timers? Mortgage giants Fannie Mae and Freddie Mac announced plans earlier this month to help more first-time buyers. Both of the federally owned groups soon plan to begin backing mortgages with 3-percent down payments, something borrowers haven’t seen since the housing boom. During 2014, most lenders have required at least a 5- to 10-percent down payment. Freddie Mac launched Home Possible Advantages, a program that helps low-and moderate-income borrowers take out conventional mortgages with the lower down payment. The borrowers are required to go through a homeowners education program. Fannie Mae’s 3-percent down payment program is geared toward firsttime buyers, but borrowers must still meet all the more rigorous lending requirements in place now. Not everyone is a fan of lower mortgage down payments. Some housing advocates believe first-time buyers “need more skin in the game,� meaning a bigger payment that translates into more equity in their home. Many borrowers who lost houses to foreclosure or walked away from them during the crash had put little to nothing down to get a mortgage.

Question: When we purchased our home in Ahwatukee, the home inspector recommended by our real estate broker did the home inspection. The home inspector charged us $450. In the home inspector’s report, the home inspector said that the roof was “acceptable.” After we closed on the house, however, we immediately noticed leaks in the roof during even a light rain. Three different roofing companies have said that the roof is in terrible condition, and that the home inspector never should have stated that the roof was “acceptable.” The cost for a new roof will be $12,000. The home inspector admits that he was careless, but says that liability against him is limited to the $450 limit of liability stated in the agreement for the home inspector report. Can our home inspector “screw up” and still only be liable for $450? If so, do we have any claim against our real estate broker for referring us to this home inspector? Answer: Arizona law permits a home inspector to limit in writing any liability for a negligent home inspection report to the amount charged for the home inspection report; for example, the $450 that he charged you. You generally would not have a claim against the real estate broker for referring you to the home inspector just because the home inspector negligently failed to discover the problem with the roof. You might have a claim against your real estate broker for referring you to an incompetent home inspector, however, if the real estate broker knew or should have known that the home inspector was incompetent. I would suggest that you contact other real estate brokers and other home inspectors to see if this particular home inspector has a reputation for being incompetent. “Now they’re facing big expenditures,� he said. “Depending on the size of the property, costs for a new irrigation system can vary from $2,000 to $20,000. The same goes for lighting systems.� Landscape problems are more costly to correct when deferred, said Bruce Avery, an arborist with AAA Tree Experts Inc. in Tallahassee, Fla. “And the longer you wait, the more expensive it gets.� And inspections are increasingly important now that families are making more use of their outdoor living areas, he said. Pre-purchase landscape inspections should include such things as retaining walls, patios and decks, outdoor kitchens, water features, fireplaces and fire pits, irrigation systems, fencing, pools and spas, lighting, playgrounds, lawns and trees, Avery said. Regional considerations vary. “If you live in California, you’d probably want to know about wildfire hazards,� Avery said. “In Florida, hurricane (damage) prevention.� “Up north, ice and snow and their maintenance activities can cause landscape and hardscape damages,� he said. “Gulf Coast areas from Alabama to Texas are fighting invasive termites that attack healthy trees, and a similar pest in the Northeast coastal areas is expanding inland at a fast pace.� Large trees can be beautiful but also problematic, Avery said. “Mature trees can add significant value to a property,� he said. “Unfortu-

Get the soil tested before you buy, said Richard Koenig, a professor, associate dean and director of Washington State University Extension. “It is difficult if not impossible to address a soil problem after perennial
plants, irrigation systems and hardscape (sidewalks and such) are installed,� Koenig said. “Poor drainage, high or low pH and salinity are the most common problems. In rare situations, soils can be contaminated with heavy metals or pesticides from previous industrial activity or an accidental spill,� he said. If landscape problems are discovered during an inspection, then those
issues can be passed along to the homeowners for a suggested fix, be included in the price negotiations or become total deal-busters. “There are so many elements of the landscape that consumers have no idea what is hidden,� Avery said. “A wise homeowner or prospective buyer should always involve a qualified arborist or landscape professional to help answer their questions.�

Be safe as you celebrate holiday season Things seem a little more festive with fireworks. A sparkler outside or a fountain firework to celebrate the new year can create a beautiful photo and holi-
day memory. This holiday season, there are permitted dates for fireworks. It’s important to know what’s permitted in your apartment community to protect your family and your neighbors. Fireworks are for sale in stores and in other permitted venues from Dec. 10 to Jan. 3. You likely
have seen these displays offering fireworks. These may only be used in Phoenix from Dec. 24 to Jan. 3. The City of Phoenix has a chart online for how and which fireworks can be used during this time: phoenix.gov/firesite/ Documents/083287.pdf
Check what’s allowed When Arizona decided to allow the sale of fireworks, each city put restrictions on use to protect the public. Most cities permit the use of fireworks on private property. You are not permitted to
light fireworks in public places or parks. You should check with the management of your apartment community on rules. Never light fireworks from a balcony or throw a firework. Beyond the heavy fines police will assess, you could be responsible for any damage. Use of aerial fireworks is prohibited by consumers. The law can be confusing, and some of these fireworks are for sale. However, they cannot not be used in most cities. This includes single-tube devices, bottle rockets, aerials, and sky rockets.
Fire safety tips Check your surroundings before you light any firework. Be sure to set any standing fireworks far from people and away from trees and cars. Keep water, a fire extinguisher or sand handy. Clean up waste from fireworks because it can be hazardous to animals. Be careful using sparklers inside. They can make a cake special, but can be dangerous. Sparks can fall and damage the floor or cause burns. This time of year brings so many of us together. Be a good neighbor and be safe.
