Industry slowdown leads to homebuyer incentives

I
n the industry for more than 25 years and licensed as an architect since 1996, Steve Judge has worked on untold residential remodeling projects. But the Scottsdale man said he also has walked away from countless others when, after informing the investor or homeowner that a permit — be it building, electrical, plumbing or mechanical — was necessary for certain parts of the job, his words went unheeded and, upon his departure, the work was completed anyway without the appropriate paperwork and oversight. “It has given a black eye to the industry,” he said, “especially one with so many licensed people who have integrity.” Though he believes most people do the right thing and obtain the proper permits, the truth is that many don’t, and that puts the health and safety of the public at risk. Considering most older homes for sale have undergone some renovation, Judge and local municipal building officials said it’s imperative that buyers perform their due diligence

Buyers should be wary when purchasing a house that has been remodeled. Perform due diligence to see whether the proper permits were obtained for a project that was more than cosmetic.

his year’s slowdown in new-home building and sales across metro Phoenix isn’t good for the economy or people with jobs in the construction industry. But the slower-than-expected sales are prompting builders to offer buyers more deals. Most builders are offering at least $5,000 off upgrades and other options for new homes and/or closing costs. Homebuilding research and analytics firm RL Brown Reports offers details on prices, popular locations, the busiest builders and popular floor plans: » Through July, new-home sales were running about 10 percent below 2013’s pace for the same period. Homebuilding is down about 15 percent. » Approximately 10,800 new houses are expected to be sold in the Phoenix area this year, and 11,800 built. The forecast is for continued slow growth in the area’s new-home market for the next few years. » The Valley’s median newhome price is $289,000, down from a record $305,000 in May. » About 36 percent of the Valley’s new homes in 2014 have gone up in Mesa and Gilbert. The north Valley is the second-top spot for building, capturing more than 21 percent of the market. Another 20 percent of the area’s new houses were in the southwest Valley. » Taylor Morrison is the busiest builder, with 481 permits for new-home construction across metro Phoenix during the first six months of the year. Question: I signed a contract to have a house built by a major homebuilder. I signed this contract without using either a real-estate agent or a real-estate attorney. When I purchased homes in Cleveland before moving to Arizona I used a real-estate agent and a real-estate attorney. Should I contact a real-estate agent or attorney now? Should I purchase title insurance at a cost of more than $1,100 or should I simply rely on the good reputation of this homebuilder? Answer: A real-estate agent representing a buyer is primarily involved in locating the buyer’s desired home. A real-estate attorney representing the buyer is primarily involved in reviewing and drafting documents for the purchase of the home. (Under Arizona’s constitution a realestate agent in Arizona also can review and draft real-estate documents.) Inasmuch as you have already signed the purchase contract for the home, the main reasons for a buyer having representation by a realestate agent or attorney are no longer present. I would suggest, however, that you review your contract carefully, and if you have any questions arrange for a consultation with a real-estate attorney. At the time of this discussion you can decide if the attorney should assist you in the transaction. In regard to your question about purchasing title insurance, the answer is “yes.” Any buyer of real property must have title insurance at the time of closing. before purchasing any home that has been remodeled on more than just a cosmetic basis. “Do your homework and really look at the house,” Judge said. “It’s very much a buyer-beware situation, and you could be putting your family’s life in danger.” In some cases, he said, the failure to obtain a permit — and get approval for the job, because just obtaining a permit doesn’t mean the work is automatically accepted — is due to a lack of knowledge or a misunderstanding, such as an owner, investor or contractor not being aware a permit is needed. In other cases, Judge said the permit process is intentionally undermined to save time and money. “The recession has created this cutthroat environment we’re in, with everyone scraping by,” he said. “People are doing what they can to create a living. Every shortcut they take, every corner they cut, adds to their profit while putting the public in harm’s way.” Steve Gallant, Scottsdale’s building-inspection supervisor, said the situation is disappointing, because not only does it not take a lot of time to obtain a permit, but permits aren’t terribly pricey. “They’re not too expensive, but they’re not free,” he said. Both Gallant and Mike Tibbett, building official for Carefree, said their staffers do their best to catch violators, but noted there are always folks who flout the law and get away with it. Luckily, they said their departments also get assistance from residents and neighbors who call in tips about non-permitted construction work being done in their areas. front window can raise suspicions and merit an in-person visit from Gallant, Tibbett or someone else in their departments. “I get a lot of phone calls about this problem,” Gallant said, adding that tipsters can also submit information online and remain anonymous. He has also seen people abuse the system outright, applying for and receiving one of the cheaper $78 permits, posting it in the home’s window and then beginning work on a project that does not in any way relate to the permit. Building officials have recourse, though. Retroactive permits are available, but cost twice the original fee. And Gallant said that occasionally when a departmentissued “notice to comply” is ignored more than once or if a situation is too dangerous, power and/or water to a suspect home can be shut off. So what’s a would-be homebuyer to do? Before purchasing a remodeled home, perform your due diligence and ask the following questions: » What has been remodeled in the home, and did the work require a permit? Listings often denote a home has been remodeled, but that may refer only to cosmetic changes, Gallant said. The installation of new carpet, flooring, paint, countertops or replacing or adding cabinetry does not require a permit. Structural or mechanical changes, however, do. In Scottsdale, for example, that includes projects like installing a new water heater (even one that’s replaced during an emergency requires a permit and, technically, would be considered a retroactive per-
mit), relocating a sink or new electrical wiring and adding a retaining wall. Most homeimprovement projects will require a permit, but always check first with the local municipality as they tend to differ. This is also a question that a real-estate agent working on a buyer’s behalf should ask, Tibbett said. » Was the work that required a permit executed by licensed professionals? Remember that licensed contractors, architects and Realtors are the specialists charged by the state of Arizona to protect the health, safety and welfare of the public, Judge said. » Do you have beforeand-after photos? Pictures are a great way to convey the work that has been done, and they tell their own story. For example, Gallant said, the majority of homes in Scottsdale’s southern reaches are older and were not constructed with the open floor plan desired by so many homebuyers today. So if you walk into a home in that part of town and see an open floor plan, there’s a good chance it has been remodeled and may have had a load-bearing wall altered. That’s a structural change that would require a permit. » May I see the permit history? Judge said if the owner or investor is unable to provide documentation and a permit was called for, request that a retroactive permit be obtained. If the owner or investor refuses, “you walk away,” he said, and alert the local building inspector. In addition, many municipalities have residential-permit information available online.

Same community, different rules? Arizona’s condominium boom a few years ago led to a number of rental apartments being converted to for-sale condos, which can lead to a lot of confusion now that many of those have reverted back to rentals. Think about renting an apartment in a traditional apartment community. The
management company oversees all of the amenities and has a trained maintenance team on site to assist residents. Right next to your new place, and unknown to you, your neighbor is renting from the owner of unit that was a purchased as a condo. Same community, different owners, and some different rules. The conversions (and now reversions) have created a
challenge for management companies and residents. Individual owners of condos in a converted community pay HOA fees, and the common community amenities are well maintained for all residents. Enforcement of rules and customer service in these communities can be more complicated, though. Who is responsible for repairs? In most rental commu-
nities, the management company will attend to repairs in your apartment. If you live in a conversion unit, however, you will need to contact the owner and arrange for repairs. Be sure to get clarity on timing expectations and what is covered in repairs. Medical-marijuana lease addendums. Many apartment communities allow the use of medical marijuana on the premises (although they don’t legally have to, and if financed by a government entity, may not be legally permit-
ted to do so). If you have been asked to sign a medical-marijuana lease addendum, the rules for its use, or the refusal to allow its use, may be in that addendum. Because these issues are complex, we’ve split this column over two weeks. Next week: lease terms (length of contract and background screenings) and crime-free addendums. I had a tenant in a property for 4 years and when he left, both the carpet and paint was totally destroyed as he had kept the house very filthy – it seems he had never cleaned the house in 4 years.

The carpet was installed in 2007, has a life of about 10 years and the original cost was about $2,000.00 I believe that I can only claim the depreciated value of the carpet, but I am not sure how to calculate it. Also, can I claim for painting the house and if so, how do I calculate the cost? Would that also need to be depreciated?

Answer:
To determine the proper pro rata portion to assess against a resident, the landlord must determine the reasonable lifespan of the item in question. For carpeting, a resident is allotted consumption on a one-for-one basis. If, for example, the lifespan of the carpeting is ten years and the resident lives there for four years, the resident is granted 40% of the carpet’s reasonable use as “normal wear and tear.” When the item is destroyed before its expected expiration, the resident may be held responsible for that share of the lifespan that should have existed after the end of tenancy. If the carpeting was new at the start of that resident’s tenancy and you replace the carpeting with a similar type, then the resident’s pro rata share is 60% of your replacement cost. However, if the carpeting was new two years before the start of the destructive resident’s tenancy and the previous tenant took reasonable care, then the pro rata replacement share for the destructive resident is only 40% (10 years less 2 for the previous resident and 4 for this resident equals 4, divided by the lifespan of 10 years).

Repainting is a harder issue to assess. Frequently a landlord will repaint the walls after the conclusion of a tenancy unless the dwelling was left in a spotless condition. In a tenancy of four years, as in this example, it’s reasonable to assume that repainting would have been necessary anyway. However, if repainting is necessary due to wall repairs (such as large holes or other significant damage), then repainting for the affected walls/rooms would be a reasonable charge. There are no hardand-fast rules for “normal wear and tear” on walls, however.
