Many Americans will buy a home at some point in their lives, and there’s a good chance owners will refinance their original mortgages. Yet these transactions are among the most complicated financial deals most Americas ever face — and they don’t always go smoothly. Confusing terms, last-minute surprises and a multitude of pages can make the closing or loanfinalization process challenging. “Consumers face a daunting package of closing documents that is too large to absorb and too difficult to understand,” said the federal Consumer Financial Protection Bureau in a new report. “This makes many consumers feel over-

whelmed and with little control over this important process.” Can you survive the mortgage-closing process? Here are some things to know.

There’s a lot to go over

A big problem with the closing process is that document packages sometimes approach 100 pages, if not more. A lot of the verbiage is boilerplate text, but there are many references to loan terms, customer names and property addresses that must be verified. The fact there are different stakeholders adds to the clutter. These include the lender, settlement agent, government regulators and investors who ultimately buy the loan. etro Phoenix no longer ranks as a top market for investors looking for inexpensive houses to turn into rentals. The number of investors buying houses in the Valley has been falling steadily since 2012, when prices began to soar and foreclosures plummeted. In March, about 17 percent of all home sales were investor-driven, according to Arizona State University’s W.P. Carey School of Business. That’s less than half the number of investor purchases during 2011, at the bottom of the housing crash. “The institutional investors are doing very little buying or selling in the Phoenix area at the moment,” said Mike Orr, real-estate analyst with ASU’s W.P. Carey School. “Their focus has turned to property management, rather than acquisition or disposal.” Home sales have slowed this year from 2013’s pace, but demand for rentals is strong. There were about 3,700 houses available to lease in early April, according to the Arizona Regional Multiple Listing Service. At the beginning of March, there were more than 4,100 houses available to rent. Most investors, particularly the big institutional buyers, paid cash for rentals during their buying frenzy. Many of those property owners are earning 10 percent to 20 percent on their investments now. But because sales prices are higher, the return rate for rental-home investments is down in metro Phoenix. The average gross yield on a Maricopa County rental purchased for $180,000 and rented out for about $1,400 a month is 9 percent, according to RealtyTrac, a national real-estate research company. Rental houses in Pinal County are yielding returns of about 13 percent because sales prices are lower, but the See REAGOR, Page R3

Question: We have lived in our Paradise Valley home for more than 15 years. There are large oleanders on the boundary line between our home and our neighbor’s. We could not build a garage (only a carport), because the oleanders are 13 feet away, and Paradise Valley requires a 20-foot setback from the property line for a permanent structure. For the past 15 years, we have watered the oleanders and paid for our landscaper to trim and maintain them. Our neighbor has done nothing. If we have an adverse possession claim to move the property line to the other side of the oleanders, we could build a garage. Do we have a claim? Answer: Probably. The basic elements for an adverse possession claim are open, notorious, continuous and hostile possession of the property for at least 10 years. In other words, “treating the property as your property” even if you are not the legal owner. If your neighbor knew you were maintaining the oleanders and did nothing, you should have a claim for adverse possession of the 7 feet. If your neighbor will not agree to deed this to you, you should probably contact a lawyer who would file a quiet title action to get a court order that you are the owner of this 7 feet. After you record the deed or the court order, Paradise Valley should acknowledge compliance with the 20foot setback requirement. parties add to the number of closing documents and complicate the process, the CFPB said.

“too late to digest the information, ask questions about changes in fees or correct errors without delaying the closing,” the CFPB said. Still, borrowers need to verify the accuracy of key terms such as the loan amount, interest rate, monthly payment and closing-cash requirements. Timing problems range from delays in receiving paperwork to errors caused by rushing. It can help to ask questions before closing and request documents. For example, HUD-1 forms must be provided 24 hours in advance, if requested.

Answers slow to come

Although many borrowers feel pressured for time and not in control, the closing meeting offers an opportunity to ask questions. It might be the last such chance for consumers to learn about the obligations to which they’re committing, said the CFPB, which noted that a lack of understanding can increase the risk of default. Yet some borrowers have told the CFPB they couldn’t get satisfactory explanations to questions from closing agents. Borrowers should be ready to delay a transaction if something material isn’t correct. Misspelled names and the omission of a spouse are among common problems that can require documents to be sent back and corrected first.

Rules get in the way

Closings are so challenging partially because of increased oversight of the process, which became more cumbersome in the wake of the realestate meltdown. Lenders often require additional forms “to protect themselves during foreclosure proceedings and ensure that they are in compliance with federal and state regulations,” the CFPB said. For example: fee-itemization addendums that portray closing costs in a different format from what’s found on other documents. Forms required by the Federal Housing Administration and Department of Veterans Affairs also muddle the process, said the CFPB; nearly onefourth of loans are issued through FHA and VA programs.

Borrowers: Be ready

Consumers need to ensure they don’t delay the closing process, too. They will need to sign documents and must bring a driver’s license or other acceptable photo identification. Many people owe money at closing but can’t just whip out a personal check or credit card — certified checks usually are required, and that

means a visit to the bank first. Borrowers also should review fees carefully so that they don’t face surprises. Mortgage-origination and other closing fees on a typical $200,000 home averaged $2,372 in Arizona last year, according to Bankrate.com; that’s slightly below the U.S. average of $2,402.

Pros also are frustrated

The CFPB study found that industry participants also struggle with the process, especially because they often must deal with multiple closings in a day. Many have told the CFPB that unneeded duplication of documents bogs down the process. Professionals also complain about a lack of standardization, which requires lenders, settlement agents, notaries and others to be familiar with an array of documents. Some critics even blame the CFPB for adding to the layer of disclosure requirements with its own rules.

One reform in sight is the CFPB’s “Know Before You Owe” rule that will take effect in August 2015. This initiative will spell out a new closingdisclosure form that should make it easier to compare changes in costs. It also limits which fees can change and by how much, and it requires borrowers to receive closing documents at least three business days in advance. Beyond that, the CFPB said it would like to see consumers given the choice to review and sign key documents in a paperless or eClosing format. And the agency hopes to reduce and simplify documents in the closing package, though it acknowledges that the multitude of required forms and many parties involved “create high barriers.” 3052
