our home’s energy-efficiency is a bit of a complex topic what with talk of building envelopes, advanced framing techniques, R-values, the HERS Index and more. Yet understanding all of this can save you plenty of money. Many homes today are built to the specifications of the Environmental Protection Agency’s (EPA’s) ENERGY STAR® Bryan Snider via Marac ay Homes program, including homes built by Robson Communities. Others, like Maracay Homes, build LEED-certified homes. Settling 101 Post-tension slabs help reduce cracks and other issues related to construction settling By Elise Riley

P

art of the attraction of buying a new home is the newness: new carpet, new paint, new appliances and, ideally, none of those cracks or creaks that an older home might have. But no matter the home, builder or neighborhood, all homes will settle in some fashion. Why’s that? Soils sometimes shift. Foundations, as a result, can move too. The result can be cracks in floors and walls — some just cosmetic, others indicative of something more serious. But builders have a technique to remedy most issues related to homesettling. Post-tension slabs, which are offered by most builders in the Valley, help homes adjust to the inevitable shifts in the ground beneath them.

Understanding post-tension slabs Fulton Homes has used post-tension slabs in all its homes since 2000. “We’re 100 percent post-tension,” said Dennis Webb, Fulton Homes’ vice president of operations. “It’s just a better foundation than non-post-tension, and it really makes the framing more stable. It’s a better overall result in the long run for the home.” Post-tension slabs feature steel rods that are laid out in a grid pattern. The foundation is then poured, surrounding the rods so they’re encased in the foundation. Then, specialists tighten the rods (kind of like tuning an instrument) to create a firm, uniform foundation. The result is that the framing and drywall — obviously major components of the home — are unified. If settling happens and the foundation shifts ever so slightly, the home shifts in unity.

Getty Images

“It moves together,” Webb said. “It’s a much smaller movement than if half the house moved one way and half the house moved another way.” The nature of soils Soils throughout the Valley vary in composition. Some areas have soil that is prone to subtle movement and adjustment. Post-tension slabs solved foundation-related issues related to expansive soil. And now, they’ve become the standard across the Valley. “In all circumstances we use post-tension slabs,” said Matt Cody, president of Cachet Homes. “We use them exclusively throughout the Valley. The soil conditions in Arizona, particularly in the West Valley or Southeast Valley, demands the use of

post-tension. Because the slab is pulled tight together you have hairline cracks rather than significant cracks.”

program. Some issues are covered for a year, others are covered for a longer period of time.

The benefit of home warranties There are a number of adjustments a home makes as it “lives” through its first winter and first summer. That’s why homebuilders offer warranties and have dedicated customer service teams to make adjustments and repairs in the months after construction is complete. “Any time you put a house through seasons, you’re having expanding and contraction,” Cody said. “Thanks to post-tension slabs, you see reduced issues related to settling.” During your final walk-through, find out about your builder’s warranty

The bottom line Settling is a normal process for all homes, whether or not they have post-tension foundations. And while post-tension slabs can mitigate many of the structural issues that result from settling, it’s possible that your new home could show some cosmetic effects of settling. However, it can be hard to know what is structural versus what might be cosmetic and not a more serious concern. If you begin to notice large cracks, particularly something that looks more like a gap as opposed to a hairline, call your builder’s customer service department.

“TRID is still in force today and it has brought consistency, transparency and a simplified approach to disclosing and explaining the paperwork used when financing a home,” LaVanway said.

RESPA: Disclosing before closing Settlement costs should not be a surprise

By David M. Brown

ESPA, the Real Estate Settlement Procedures Act, became effective July 20, 1975. Enforced by the U.S. Department of Housing and Urban Development (HUD), RESPA helps consumers be better shoppers in the home-buying process.

Timely disclosure In brief, RESPA mandates that lenders fully and in a timely manner inform borrowers about all closing costs, lender servicing and escrow-account practices, or any other fees. In addition, business relationships between closing-service providers and other parties to the transaction must be disclosed to the consumer. “Without RESPA, lenders were charging whatever they wanted and nothing would prohibit them from adding fees at the last minute,” said Shirley Boynton, a senior vice president at Scottsdale-based OnQ Financial. “When that happened, a consumer would feel cornered and not able to do anything about unknown fees,” she added.

Better informed consumers After RESPA, consumers are much more informed. “They have ample time to shop other lenders for the best rate and fees that they can find. They can also shop for some services that will be required by the lender such as title and settlement service companies,” Boynton said. “Also, with the prohibition of kickback fees, the consumer is less likely to have inflated costs to pay for other services.” “The initial intent of RESPA was to provide transparency and consistency regarding disclosures, fee disclosures and documentation,” said James LaVanway, a licensed mortgage professional for the Tempe office of San Diego-based Guild Mortgage Company. The buyer and seller in a home-purchase transaction are both notified throughout the process within clearly defined trigger dates. “There are disclosure restrictions to what the seller and Realtors are privy to during the transaction but the buyer is informed each step of the way,” he said.

Updated over the years In 1990, Congress updated RESPA to address loan-servicing escrow accounts after the loan is closed as well as guidance on how those monies would be handled. In 1996, another update addressed affiliated business arrangements between parties to let the consumer know about fees paid to each other. “These arrangements were able to bypass kickback rules by disclosing the arrangement to consumers while not requiring them to use their services,” LaVanway said. In 2008, another RESPA update added various implementation of dates and other disclosures including the opportunity to electronically sign. Two years later, as part of the DoddFrank Financial Reform Act, the new Consumer Financial Protection Bureau (CFPB) began aggressive enforcement. At the end of 2014, the TILA RESPA Integrated Disclosure (TRID) merged the Truth in Lending Disclosure with the HUD Settlement Statement Disclosure.

Designated timeframes RESPA requires lenders or loan servicers to provide specific disclosures within a designated timeframe that describe costs related to the real estate settlement process, Boynton said. First, within three days of the application, a lender must provide a loan estimate that clearly discloses the cost to obtain the loan and the proposed monthly payments. In addition, “Any time there is a change in the transaction that increases fees, a revised disclosure will need to be issued,” Boynton said, noting that the issuing of a new disclosure could, in turn, trigger a new waiting period. Once the loan estimate is issued, there is a seven-day waiting period before the loan can close. A closing disclosure is then prepared three days before the scheduled closing of the loan. “This disclosure shows the final closing figures and payment amounts. These must match with the initial loan estimate although there are small tolerance amounts that may have changed due to a higher insurance or appraisal fee,” LaVanway said. After a loan closes, the servicing company that manages the monthly account on a loan is required to provide an annual Escrow Account Disclosure. “RESPA was much needed to help consumers understand the cost of a real estate transaction,” Boynton said. “It also gives them the opportunity to shop for a lender that they can trust to help them with [what is often] the single most important financial decision of their lives.”

The average Courtland Supergarage is 40 feet long and 18 feet wide with 14- to 16-foot ceilings. There is an option to extend the garage with the largest option being 75 feet long and 16 feet wide. “About 90 percent of our homebuyers purchase an RV-garage plan,” Ebding said. The garages are insulated, energyefficient, include fluorescent lighting and have options to add air conditioning and a rear garage door.

nce there was a time when a home’s garage was … well … a garage. It was a one- or two-car attachment to a home where folks parked their cars or often just stored accumulated holiday decorations, sports equipment and more. Now there’s the RV garage, also known as an accessory garage. These super-sized garages are an often-cushy place where homeowners can house all sorts of toys. “Not everyone has an RV, but if you see ‘Supergarage’, you think, ‘wow, what’s that?’” said Jill Ebding, marketing director for Courtland Communities in Phoenix, referring to the company’s Supergarage homes. From cars, boats and ATVs to hobbies and extra storage, “there’s a laundry list of things people put in these garages,” she said, adding that Courtland’s RV-garage homes include standard two- or three-car garages plus the larger addition.

Homes by Towne’s larger RV garage (50 feet long, 18 feet wide and 16 feet high) makes it easy and accessible for homeowners to park an RV onsite at their home without the worry of offsite storage fees. “If not used for an RV, I’ve seen it used for boats and trailers or

car collectors,” Childress said. Options include evaporative coolers and upgraded insulation as well as lighting and outlets with higher amperage for use with various vehicle and/or tool accoutrements. Homes by Towne offers a larger RV garage and a smaller option they call a “toy garage.” According to Melinda Childress, sales manager at Homes by Towne, the company’s “toy garage” is 36 feet long, 18 feet wide and 14 feet high making it ideal for ATVs, dune buggies, dirt bikes, small camping trailers or general storage. “If you aren’t into that type of thing, they

The Man Cave has options for a bathroom, air conditioning and even an attached cabana. “The space has become very popular with homebuyers because a large number of customers have toys or other interests and the space is workable for them,” Ashton said, adding that 25 percent of buyers at The Pecans community in Queen Creek purchased the option.

SRP ENERGY STAR® Community Partner Program

W

hat does it mean to be an SRP ENERGY STARcertified home? Salt River Project Program Manager Terry Rother explains.

Statesman

Toscana of Desert Ridge By Statesman

Toscana of Desert Ridge is a luxury condominium community located in the masterplanned community of Desert Ridge in the North Phoenix/Scottsdale area. At Toscana of Desert Ridge, The Statesman Group wanted to provide turnkey homes to year-round residents of all ages as well as investors and/or retirees who are looking to escape cold winters. Unlike timeshares, buyers who purchase a condo in Toscana of Desert Ridge have 100 percent ownership of their home. The Toscana Building #10 offers buyers the chance to purchase a luxury condominium in the final phase of the 24/7 guard-gated community. The condominiums feature one or two bedrooms with two full baths, all on one level. If the buyer desires, homes may be purchased fully furnished and finished with high-end interior touches and accessories. A limited number of condominiums with a view are still available. At Toscana of Desert Ridge, amenities include three heated resort-style pools and spas, two Statesman fitness centers (with his and her steam rooms), three clubhouses and a business center with Wi-Fi. The resort’s staff provides a number of monthly activities and events for residents as well as White Glove Concierge™ services including booking tee-times and making dinner reservations. The community is within walking distance of many of the area’s restaurants, shops and entertainment venues.

Overall, what does it mean to be ENERGY STARcertified by the U.S. Environmental Protection Agency (EPA) and how does it benefit homebuyers? An EPA ENERGY STAR-certified home meets the Environmental Protection Agency’s strict energyefficiency performance requirements by incorporating advanced building science-based construction techniques with a comprehensive package of energyefficient equipment. Several steps are taken by the builder and a third-party Home Energy Rater throughout the design and construction of the homes to ensure all ENERGY STAR requirements are met and verified. Homeowners benefit because greater energy-efficiency and performance equals lower utility and maintenance costs. ENERGY STAR homes typically use 15 to 30 percent less energy than a typical new home.

In an SRP ENERGY STAR Partner Community, is it the individual homes that are SRP ENERGY STAR-certified or is it the builder? Participating SRP community partners are required to be registered [EPA] ENERGY STAR partners and they commit to 100 percent of a given community being built to ENERGY STAR Version 3 requirements. Within SRP’s program [the SRP ENERGY STAR Community Partner program], all homes in the participating communities are required to be ENERGY STAR-certified. —Debra Gelbart

What is SRP’s role in ENERGY STAR community partnerships? How do you partner with the EPA? SRP helps to promote the adoption of the ENERGY STAR Program with outreach to help builders promote the program and their participation in it. There’s also training to help builders and their various trades understand the program requirements and advanced construction practices that are employed in the construction of ENERGY STAR-certified homes.

the more room remains for insulating material. Increasingly, homebuilders are using what are known as advanced framing techniques. According to GreenBuildingAdvisor. com, an organization focused on providing information related to designing and building energy-efficient homes, advanced framing aims to reduce the amount of lumber used to frame buildings to the bare minimum. The amount and type of insulation added (fiberglass, cellulose or the more expensive spray foam) determines a home’s “R-value” — a measure of the insulation’s ability to resist heat traveling through it, according to the website for the EPA’s ENERGY STAR program. The higher the R-value, the better the thermal performance of the insulation. Every home can be assigned a number along the HERS (Home Energy Ratings System) Index, a measure introduced in 2006 by the nonprofit Residential Energy

Mandalay Homes

Services Network (RESNET) to indicate overall energy-efficiency. A score of 100 equates to the energy usage of a standard American code-built structure constructed in 2006. A score of zero means that a home produces as much energy through renewable resources — such as solar panels — as it consumes. “A typical new home today has a score of between 75 and 90,” Ferrell said. That means it’s between 10 and 25 percent more energy-efficient than a 2006-code-built home. Mandalay’s goal is to build every home with a HERS Index of no higher than 50, meaning it is 50 percent more energy-efficient than a 2006-code-built

home. By comparison, a 20-year-old home likely has a score of about 150, which means it’s 50 percent less efficient than a 2006-code-built home, Ferrell noted. Local utility companies encourage builders to construct energy-efficient homes, Kelly [of LGI Homes] pointed out. “The building codes have improved but the utility company rebates have really had a big impact on the homebuilders. The best rebate programs challenge the builders to deliver a new home that is anywhere from 10 to 30 percent more efficient than a typical home.”

Many new-home communities are ENERGY STAR-certified by the EPA and most utility companies have ENERGY STAR programs that offer information and advice about the ENERGY STAR program to the homebuilders in their various service areas. In Arizona, communities are serviced by a number of utility companies, including SRP, APS and other smaller companies. Check with your builder for details about the utility service provider and its ENERGY STAR programs for the community/communities you’re considering.

Questions to ask your homebuilder about energy efficiency

1.

What is the home’s R-value?

2.

What type of framing techniques are used and how do they impact energy-efficiency?

3. 4.

What type of insulation is used? What is the Seasonal Energy Efficiency Rating (SEER) of the air conditioning unit? (Federal regional standards for cooling equipment mandate a SEER of at least 14 for A/C units in Arizona.)

5.

Are the windows dual pane? (Adding a second pane of glass traps a layer of still air, a good insulator, between the panes.)

6.

What is the HERS Index for the home?

7.

Is the home ENERGY STAR- or LEED-certified?

ou are basking in the glow of your new home when reality starts to sink in. It’s time to tackle the next big project — planning your new pool. Fortunately, some new-home buyers have a better option. That’s because a number of Valley homebuilders partner with pool builders so construction of the house and pool can overlap. “Who wouldn’t want to enjoy their pool the very first week or weekend they move in?” said Kevin Rosinski, Toll Brothers’ Arizona division senior vice president.

Traditionally, new-home buyers enter into a contract with builders for the home only. Once the buyers move in, they are often faced with planning their pools, landscaping and other desired outdoor amenities. The additional projects can stretch out for months, making for what can feel like a neverending move-in process. But merging the projects can eliminate that wait time or at least significantly reduce it, depending on the builder. So if a new pool is on your wish list, here’s what you need to know:

Take your pick. Builders work with “preferred” pool vendors that they have approved. Buyers may be given one choice or multiple choices, depending on the builder. Toll Brothers, for instance, works with four pool and landscape companies around the Valley while Blandford Homes works with a single vendor. The approved vendors work with project managers to coordinate construction of the home and pool as much as possible. If a buyer wants to use a pool company not approved by the builder, the pool will have to wait to be built until after closing.

homebuyer visits a builder’s design center to choose features like kitchen cabinets, the buyer meets with the pool vendor to start planning the pool, said Eric Williams, a Realtor and project manager with Blandford Homes. The buyer may also make a site visit with the vendor to work out details such as placement of the pool. Financing the deal. The cost of the pool can generally be rolled into the new home loan which makes the process seamless for buyers and keeps the interest rate lower with a single loan, said Jay Starks, the Arizona district manager for Bell Mortgage. A buyer who takes out a separate pool loan might face a higher rate because that loan could be treated like a second mortgage. Buyers will want to make sure the appraisal supports the cost of the new pool; if not, they could have out-of-pocket costs or might need to scale back plans. Ask your builder New-home buyers have a range of options for outdoor amenities through a builder’s preferred vendors. It’s important to consider what will work best for your move-in timeline, budget, family and lifestyle. “Building the house and pool together is a much more streamlined process,” Williams said. “It can shave four to six weeks (off of construction time) after closing. This gives buyers more time to use the pool.”

Advice from the pros Buyers have several considerations before jumping into a new pool project. Here are a couple of important nuggets of advice from the pros: • If your builder offers a choice of preferred pool vendors, shop around and meet with them all. • If you already have a relationship with a pool company that is not on your builder’s preferred vendor list, you can certainly wait to build your pool until after closing. ou’ve picked out the new home of your dreams and a new pool is next on the list. But before you dive in, there’s plenty you need to know to keep kids — and adults — safe in the water. Arizona law as well as various city ordinances mandate certain requirements aimed at preventing water-related incidents in swimming pools. That’s because homeowners who are new to the state or new to having a pool may be unaware of the potential dangers. But already this year, several young children have died in water-related incidents. “People don’t know what they don’t know,” said Tanja Tanner, community risk reduction coordinator for the Goodyear Fire Department. “New home, new pool, and they just don’t understand how fast someone can slip or trip in — a child, an adult, even a pet.” Arizona state statutes spell out multiple requirements for swimming pools. Among them, a pool must be protected by at least a five-foot-tall barrier and gates must be equipped with self-closing, self-latching hardware. In addition to state law, municipalities may have additional requirements. Layers of protection A common refrain from new homeowners is that fencing is unattractive or will block scenic views. But there are several options for barriers beyond the traditional black wrought-iron pool fence, Tanner said. Pool owners can use a mesh fence, which is less obtrusive and removable, or a pool safety net that covers the surface of the pool when it is not in use. Safety experts say that it is vital to consider a range of protections, not just a

Maintenance is equally important, she said. Pool owners should regularly check their pool fences for unexpected openings and check all pool latches to ensure they are working properly. “Pools are expensive toys just like an expensive boat,” Schmidt said. “You have to take the time to regularly maintain them. This means ensuring all of the safety measures are checked and kept in good condition.”

Many incidents are preventable Every year, Valley fire departments report serious incidents as well as deaths, many of which are considered preventable, in swimming pools. A recent Arizona Department of Health Services report showed there were 91 serious water-related incidents

in the Valley in 2014, the most recent year statistics have been compiled by the agency. Of those, 36 incidents occurred in pools and included children age four and younger. Eight of the kids died and another four suffered serious injury. “Nobody thinks it will happen to them,” Schmidt said. “But we have to respect the water. We need to take precautions to keep everyone safe.”

single one like a barrier. A five-foot fence around a pool, for instance, can be enhanced with high door locks and door alarms. “We like to have layers of protection in place for everybody,” said Lori Schmidt, immediate past president of the Drowning Prevention Coalition of Arizona and also public information officer for the Scottsdale Fire Department.
