Investors swarm metro Phoenix homeowners Many metro Phoenix homeowners have a new issue to deal with now that they have equity in their homes again. Letters, calls and knocks on the door from investors looking to buy Valley houses have ramped up. One day last week, I got a call on my cell phone from an investor wanting to buy my home for “far more than I owe on it.” A letter from a different investor arrived offering to pay cash and close in a few weeks, plus a card on my door from another investor asking me to call if I wanted to sell fast. How cities provide fair housing laws for more groups Question: In a recent column you said that age is not a protected class under state and federal fair housing laws, and that senior citizens have no protection under fair housing laws just because they are old, e.g., some senior citizens run marathons. You also said, however, that many

senior citizens are “disabled,” which is a protected class under state and federal fair housing laws. You are correct about state and federal fair housing laws, but cities and towns can provide in their fair housing laws for additional protected classes. For example, age by itself is a protected class in Tucson. Therefore, in rental housing near the University of Arizona campus a land-

lord in Tucson is not allowed to advertise “all tenants signing the lease must be over 30.” Answer: Thank you for the information. Fair housing laws, like many other laws, have evolved over the years. In the original Fair Housing Act of 1968 the only protected classes were race, religion, national origin, and sex. Today, two additional protected classes

under fair housing laws are familial status (families with children) and disability. Although towns and cities can have their own fair housing laws, state fair housing laws generally mirror federal fair housing laws. The reason is that the Attorney General in Arizona and attorney generals in other states are then able to enforce all fair housing laws.

signs from investors looking to buy homes “for cash.” “The claims (from would-be buyers) seem to be nothing short of a miracle — top price, fast close, no closing costs, no brokerage fee, and they might even pay for my move,” Scottsdale homeowner Lou Kissling recently told me about the offers he is receiving from investors. “I always laugh at the solicitations, thinking how can these companies pay top dollar when they have to turn around and sell that same house for maybe 10 to 20 percent higher to make a profit,” he said.

Flips up 16 percent Flips — homes bought and then resold within 180 days — are up 16 percent so far this year in metro Phoenix. But not necessarily because the many smaller investors soliciting homeowners to sell are successful. Real estate analyst Tom Ruff with The Information Market said flips are up mainly because the big real estate firms Opendoor and OfferPad buy Valley houses at market- rate prices and then resell them. Flippers typically pay bargain prices for houses that need work, fix them up and resell them for heftier profits than Opendoor or OfferPad. Those big firms typically don’t buy houses that need a lot of work. This year through mid-October, 7,502 Valley homes have been bought and resold within 180 days.

Tougher to find bargains During the crash, most flippers could be found on the Maricopa County Courthouse steps bidding on foreclosures. Few were contacting homeowners because most of us didn’t have any equity in our homes. In 2011, almost 50 percent of Valley homeowners were under-

Question: Is it legal for management to collect the mail from the mailman, sort it and then put it all in her desk drawer and not notify you in any way that you have mail? You have to ask daily. I can see her doing that if this were a motel or hotel, but it’s not, it’s a huge apartment complex. In 2 months, it will be one year since I moved in and in all that time I have NEVER received any junk mail or ads. Is that legal for her to decide what you get in the mail? Is there anything I can do to change this method of distributing the mail? Answer: The delivery of mail is covered under Federal law, not state law. It is a crime to remove or deal with somebody else’s mail. Certainly you have the right to receive whatever is sent to the property, including junk mail. I would put the property on written notice, under the Arizona Residential Landlord and Tenant Act that they need to deliver all your mail, not just what they this is pertinent. You may also want to talk to your mail carrier as this is something that could be investigated by the United States Attorney General’s office.

Domestic violence awareness – we all have a role Purple ribbons and branded posters educating us about Domestic Violence Awareness month offer an important reminder about the role that we all have in preventing and addressing domestic violence. This very personal issue touches millions of men and women across the United States and many victims stay silent out of fear and shame. Nearly one quarter of all women will be affected by domestic violence in their

lives and it’s the third leading cause of homelessness for women. Today, there are numerous resources to help women and men move out of domestic violence situations into safety. Nonprofits around Arizona can help victims, families with children, and even their pets get to a safer place. Some women report being afraid or unable to leave violent situations because they don’t want to be separated from their children or their pets. Fortunately, there are family shelters to help ensure you can stay together.

For those victims living in apartments, your management company may be able to help you move to another apartment, away from the abuser.
