Should you invest extra cash or use it to pay off your mortgage? It’s a heated debate that rivals French press versus pour-over coffee and “Star Wars” or “Star Trek.” But while all three topics might get passionate believers on both sides all worked up, investing or paying off your mortgage is a choice with serious financial consequences. The Covenants, Conditions and Restrictions can probably still be enforced Question: One of the problems in our North Phoenix community has been our HOA failing to enforce the Covenants, Conditions and Restrictions that prohibit parking cars on the grass next to the driveway. At our annual meeting last month we elected a new Board of Directors for our HOA. Although several homeowners
have consistently parked cars on the grass next to their driveways for many years, the new Board of Directors wants to enforce the CC&Rs prohibiting parking of cars on the grass. Can the new Board of Directors enforce the CC&Rs, or after many years has there been a waiver of the right to enforce the CC&Rs? Answer: Most CC&Rs have a nonwaiver provision. If your CC&Rs have
this non-waiver provision, the CC&Rs prohibiting parking on the grass are probably still enforceable despite the failure to enforce prior violations for many years. E ven if your CC&Rs do not have a specific non-waiver provision, there is still probably not a waiver. For example, in a Wyoming appellate court decision, there was no waiver of the CC&Rs prohibiting front yard
fences even though 20 out of 157 homeowners in the community had front yard fences. However, if there has been a total abandonment by the HOA for many years of not enforcing any of the CC&Rs, all of the CC&Rs may no longer be enforceable. RENTER’S Legal Q & A Question: I gave my landlord a 30-day notice that I would be out by the end of the month. I just found out that the apartment I was going to move into wouldn’t be ready by the end of the month. The landlord indicated that he had already re-rented my apartment for the first of the following month. I told him that I simply couldn’t be out by the end of the month. I would have no place to live. He told me that I would be charged as a “hold over” tenant. Can he do that? Answer: Maybe. The statute indicates that if a tenant remains in possession without a landlord’s consent after expiration of the lease agreement or it’s termination, a landlord may bring action for possession. In addition, if the tenant’s hold over is willful and not in good faith, the landlord may recover an amount equal to not more than tow month’s periodic rent or twice the actual damages sustained by the landlord. Whichever is greater. The question here is whether or not the hold over is willful and not in good faith. Arguably, if another landlord told you that your new unit would be ready and it is not, then your failure to move is probably not willful or in bad faith. You may not be responsible for two month’s rent or twice the landlord’s actual damages, however, you would be responsible for the actual damages incurred by the landlord, which could include the lost revenues for the new lease.

According to Goodbread and Ric Edelman, founder of Edelman Financial Services in Fairfax, Virginia, the primary reasons for carrying a mortgage include: Homeowners need to maintain liquidity. If you have a financial emergency, cash reserves are essential. Homeowners who pour every dime into paying off their mortgage early might not have a cash cushion. You’ve essentially “buried the money in the walls of the house,” Edelman says. A mortgage doesn’t affect a home’s value. “The house itself doesn’t care if it has debt on it or not,” Goodbread says.
Over the long term, it’s likely to appreciate regardless of the amount you owe on it, he adds. Mortgage interest is inexpensive. Because the mortgage is secured by the value of the home, interest rates are much cheaper than for credit cards and personal loans — and the interest you pay is tax deductible. It’s likely the cheapest money you’ll ever borrow, Edelman says. Mortgage payments get easier with time. They’re often a budget stretch for young homeowners, but with a 30-year fixed mortgage, time is on your side. As the effects of inflation and a growing income take hold, “that monthly payment gets easier and easier to make,” Edelman says. Investments will outperform the interest cost of the mortgage over the
long term. “That scares some people,” Edelman concedes, because of the stock market crash of 2008. However, he’s not advocating 100% stock investments, but rather a diversified mix of investments built for a 30-year time frame. That period matches the term of a fixed-interest rate mortgage.
‘Debt-free homeownership’ ? But what about noted author and radio host Dave Ramsey’s advocacy of debtfree homeownership? “I’m right; he’s wrong!” Edelman laughs.
