oncrete is back, reclaimed wood remains strong and porcelain tile is surging. Floors are basic in homes, but their beauty and functionality are the paths to a joyful experience for you, your family and your guests. “The floor is where it all starts, grounding the room and connecting with your energy, your relationship, your family,� said Esther Boivin of Esther Boivin Interiors in Scottsdale. “I love to set the tone for all of my designed spaces starting with flooring.� Floors, she said, shouldn’t be a practical decision based solely on utilitarian considerations. “They should be fun and a reflection of what makes you tick,� she said. It’s now safe to say metro Phoenix’s housing market has rebounded from last year’s lull. New data released last week shows both home sales and building are up again. The key indicators have been climbing since the spring. And real estate analyst Mike Orr, of Arizona State University’s W.P. Carey School of Business, recently told me the Valley’s housing market is finally back to normal. Normal is very good for the area’s housing market after the boom and devastating crash. So what what does “normalâ€? mean? Âť Almost 88 percent of all home sales in June were for regular sales and not tied to foreclosure. Only three years ago, nearly half of all Valley home sales were foreclosures, short sales and houses taken back by lenders and resold at bargain prices. Âť The median price of a house is up about 6 percent from a year ago. That’s similar to housing appreciation in the region before the boom/bust and is considered healthy. Âť About half of all houses sold in June were priced from $200,000 to $500,000. Too many bargain-priced houses will pull down prices as they did in 2011. Âť Condominium sales jumped 28 percent from June 2014. This is an indicator of more people moving closer in, and more younger buyers. Âť Cash buyers accounted for 20 percent of June’s home sales, half as many as in 2011-12. Most investors pay cash and turn houses into rentals. Fewer cash buyers means more regular buyers who plan to live in the homes they’ve bought. What’s not normal or quite in balance for our housing market is the supply of homes for sale. There aren’t enough. Listings are down 5 percent from a year ago, and houses priced below $250,000 in popular areas of Tempe, south Scottsdale and central Phoenix are sparking bidding wars. Of course, a drop in the number of houses for sale as buyer demand increases isn’t bad news for homeowners, who are likely to see their values climb as a result. Metro Phoenix home prices aren’t yet back to where they were before the crash. The area’s current median price of $221,000 is still $40,000 below the peak in 2006. It’s going to take a few more normal years for home prices to fully recover.

$2,995,000 Jeffrey and Jill Herzog paid cash through their family trust for a 6,917-square-foot house with pool built in 2015 at Paradise Home Estates in Paradise Valley. Jeffrey Herzog was the founder of iCrossing, a digital marketing
company that sold to Hearst Media for $325 million. Currently he is chairman and CEO of ZOG Digital, a marketing and advertising company in Scottsdale. The house was sold by William F. Jordan. Jordan sold a 3,189square-foot house west of the Camelback Golf Club in Paradise Valley for $4.5 million in 2008.

Question: We have made a significant amount of money since we began investing in the stock market in the early 1980s. We are concerned about the recent volatility of the stock market, however, and we would like to “cash out� our investments at their current higher prices. We would then use the sale proceeds to buy a small parcel of land in Payson to build our retirement home. Would this transaction be a taxfree exchange? Or would we have to pay income tax on the capital gains that we have made on our investments in the stock market? Answer: A taxpayer is only eligible for a tax-free exchange of investment property under Section 1031 of the Internal Revenue Code if “like kind� investment property is being exchanged. Inasmuch as your investments in the stock market are personal property, and the Payson land is real property, there is not an exchange of “like kind� investment property. Therefore, you will probably have to pay capital-gains tax when you sell your investments in the stock market. In general, the exchange of any investment real estate is a tax-free exchange under the Section 1031 rules. For example, exchanging a rental home for raw land, and exchanging an office building for a warehouse, both should be tax-free exchanges. Concrete floors, often integrally colored, polished and scored, are popular again, and they’re being used not only in contemporary desert design but also for a modern cowboy-ranch style, which has shown renewed interest in the Valley. Concrete tiles in great sizes are appearing, too, Sutton said.
Wood Hard surfaces for flooring, with area rugs rather than carpeting, have become prevalent, even in bedrooms. “We are in an age of great change with emerging technology that has given new life to old materials and solved the functional and aesthetic limitations of the past,” said Tony Sutton, founder of Est Est interior design in Scottsdale, the Valley’s oldest interior-design firm. “Wood flooring is gaining momentum as more aesthetic options and practical cost-effective choices become available,” he said. Reclaimed wood, harvested from old barns and farmhouses, for example, still is popular, and an engineered version is available from some manufacturers. Engineered wood is real wood at the top but has the crisscross pattern of plywood below to keep it from warping and cupping. “It solves many problems in durability and longevity,” Sutton said. that extra layer of plywood. Sutton always checks the Janka ratings for wood use, especially for floors. This hardness test measures the denting resistance of wood, from hard, such as ironwood, to soft, such as pine. For example, there are many subspecies of wood recognized as walnut or oak that vary in Janka ratings. “Wood density, which will identify its durability, helps a designer select not only aesthetic choices but practical ones as well,” he said.
Tile Glass tile continues to gain market share, with more sizes and styles available. At the same time, the half-inch deco and smaller linear tiles are becoming less popular. Because of its high-quality production, porcelain tile is being widely used for its beauty and because its low porosity makes it extremely practical for both residential and commercial, Sutton said. Pricing ranges with modest options.
“The carpet industry has responded to health concerns with improved compositions and performance,” Sutton said, explaining that many carpets no longer have traditional jute backing, which is organic, absorbent and capable of molding. New synthetic backings are easier to clean, he said, and pads now have a moisture barrier to prevent holding moisture and odors. The best carpet composition also will not support dust mites, which can cause allergies. Boivin said that before making a final flooring selection, the first question you should ask is: “How do I want to feel? “Do I want a clean look? Do I want a soft, subtle look? Or a strong, bold and confident look? Then choose a solid, confident color. Do I like to stand out in the crowd? You can do that with a bold explosion of pattern with high contrast.”

Safety reminders for getting our children back to school Back to school time is full of hope and energy. Here are some safety tips for protecting our kids. Buddy system: If you are a parent in an apartment community, look for other parents who are sending their kids on the same school buses or public transportation. Create a buddy system so your kids know a couple of schoolmates as they
board the school bus. If your student is riding on public transit, this is especially important. Students riding alone should practice the transit routes a couple of times with parents to gain confidence in the system. Practice the route: For children who are able to walk to school, take the time to show your student the best route and ways to walk safely. Show your students how to use the sidewalks and crosswalks.
Bicycle safety: Be sure that your student wears a fitted helmet and knows the rules of the road. Bike locks are a must. Practice coming home: Be sure your children know how to get into their apartment and lock the door. Talk with your manager and let them know your students may be home in the afternoon. If there’s a common area for your students to study, and they are of an appropriate age for the community room, re-
view the rules. As drivers, riders and neighbors, every one of us must take responsibility to ensure our kids get to school and home safely. Be cautious of bicycle riders as they get accustomed to their routes. Stop when you see school buses stopped in your area. Slow down in school zones. break in through the front door, and we replaced it at the landlord’s expense. Then, they had a broken window. Is a broken window similar to when you lease a vehicle where windshield damage is a lessee’s responsibility? Also, when a tenant vacates at the end of the lease term, but doesn’t return the keys, can the landlord make entry to the home?
Answer: The landlord would be responsible
for repairing the broken front door and window unless the landlord can show that the tenant caused the damages. Otherwise, this is just considered maintenance for the property which is the landlord’s responsibility. If the tenant did not cause the damage then they would not be responsible for the repair costs. Generally speaking, when a tenant vacates, but doesn’t return the keys, they have not surrendered possession of the rental property to the owner. If you go in you run the risk of the tenant claiming you made an unlawful entry and they can ask for one month’s rent or actual damages, whichever is greater. (missing jewelry, cash etc.) If you can get something in writing from the tenant that they have vacated and you can take possession, that would be fine. Otherwise, you would probably want to either do a notice of abandonment self help process or you could file for an eviction because the tenant is essentially holding over by not returning the keys. It is always a good idea to photograph the property after the tenant vacates, so there is no doubt about what was in the premises when it was returned to the landlord.
