Real Estate A study that tracks ÿrst names of homebuyers shows that more millennials are in the pink when it comes to taking the big step of home ownership while Gen-Xers and baby boomers decline

What’s in a name? Proof of a shift in who is buying homes, according to a new real estate study that tracked the ÿrst names of home buyers nationwide in 2017. The number of buyers with popular millennial names is climbing nationally, while buyers with top Gen-X and baby boomer names are declining. In Arizona, buyers with the ÿrst name Lindsay posted the biggest increase in sales – 115 percent last year, according to national data ÿrm ATTOM Data Solutions. Lindsay peaked in popularity for baby names in 1983, according to the Social Securi-
ty Administration. That potentially means more older millennials are buying metro Phoenix homes. Nationally, homebuyers named Dylan posted the biggest increase, according to the four million home sale records ATTOM analyzed. Dylan, which like Lindsay can be for a boy or girl, jumped in popularity around 1992. Homebuyers named Dylan posted the third highest increase – 72 percent – in Arizona last year. Dylan was the top name for increases in buyers in Texas, Colorado, Michigan and Pennsylvania last year. In Arizona, buyers named Greg had the second highest increase – 95 percent - in home sales during 2017. Greg was a popular baby name for GenXers and late baby boomers, which makes sense since the Valley has a lot of move-up and young retiree buyers.
Caleb, which spiked in popularity among baby names in the late 1990s, topped the ATTOM list in California and Tennessee. That name didn’t crack Arizona’s top 20. Housing market watchers are on the lookout to see if Millennials will buy homes at the same rate of their Gen-X older siblings or baby boomer parents. Homebuyers named Edwin and Carol dropped the most in Arizona last year – about 35 percent. Nationally, Gerald, Kristin, Stanley, Kurt and Jaime - which like Edwin and Carol were popular baby names between 1916 and 1976 declined among homebuyers the most. There’s no exact science to track how many millennials are becoming homeowners since buyers aren’t required to list their ages on most real estate records. But this research is deÿnitely an interesting look at home sales I haven’t seen before.

Question: We have lived in our Goodyear home for more than 20 years. We never had any problems with our neighbors. Last year a young couple moved in next door. Every weekend there are parties, and I think that drugs are involved. We have listed our home for sale because we want to move into a smaller home now that our children are grown. Our listing agent said that we have to disclose to buyers any material and adverse fact regarding our home. Do we have to disclose these new neighbors?
Our son is a lawyer in Los Angeles, and he says that a young couple having parties on the weekend, even if drugs might be involved, is not a material and adverse fact because that’s what young couples do. Help! We want to be honest, but we don’t want to scare buyers. Answer: What is considered a material and adverse fact requiring disclosure depends on what is legally reasonable. Although a Trump voter may think an Obama voter living next door would be a material and adverse fact, and vice versa, that is probably not legally reasonable. Therefore, whether the next door neighbor is a Trump voter or an Obama voter would not need to be disclosed by the seller. If the seller, however, is speciÿcally asked by a buyer if the

next door neighbor is an Obama or Trump supporter, the seller has to tell the truth and cannot lie. Telling the truth doesn’t mean that the seller has to say that the neighbor supports Trump or Obama; for example, the seller can simply say it is “none of your business.” By way of background regarding what a seller needs to disclose, our law ÿrm founded and operated a Hotline for the Arizona Association of REALTORS® for more than 20 years. The purpose of the Hotline was to answer real estate questions from real estate brokers throughout Arizona. One of the most common questions from these real estate brokers related to what facts about the home were required to be disclosed by the real estate broker to buyers. Our
initial response to these disclosure questions was, one, disclosure to a buyer is required if it’s a material and adverse fact and, two, if it’s not a material and adverse fact, then why not disclose it? Both sellers and real estate brokers, however, want speciÿc answers as to what is a material and adverse fact that must be disclosed. Ultimately, a jury would decide whether disclosure by a seller or a real estate broker was required. In regard to your situation with the young couple next door, to older jurors the disclosure of neighbors partying over the weekend with possible drugs may be a material and adverse fact. To younger jurors, maybe not.

Some years the holiday elves can be very generous with the gifts! A new laptop or television set might have found its way into your home or under the tree. There are so many great new technologies out now and many of them are increasingly affordable. If you are replacing an aging television or computer, you may have some major pieces of electronic equipment to recycle. These electronics should never go into your dumpster. They are hazardous electronic waste and it’s your responsibility to dispose of them properly. The beginning of the tends to create additional e-waste and it can be hard to

The speed of new electronics entering the market, from phones, to computers to gaming systems, is creating a lot of electronic waste. Many of these electronics contain hazardous or toxic materials including metals and chemicals that we don’t want to have in landÿlls. Some of these systems may also make you vulnerable to identify theft. Your old computer or smartphone, that hasn’t been wiped clean, could be used to steal your private information if it’s
not disposed of properly. Appliances and small home electronics should also be recycled when possible. If your appliance or television is still in good working order, consider donating it to Goodwill or another nonproÿt. Most resale shops won’t accept CRT televisions or TVs that are more than 5 years old, so those should be properly recycled. Some cities offer electronic waste recycling on speciÿc days to their residents. This may require that you bring
your city water or another bill to prove residency. Some Best Buys offer e-waste recycling and there are Boy Scout troops that have partnered to collect electronics. You can also check with o‘ce supply companies like Staples and O‘ce Max to see if/what they are recycling and you can even get credit for recycling your old toner and ink cartridges. These also should not be placed in your regular trash. It’s a great time to enjoy new electronic toys; just be sure to protect our environment as you get rid of the old technologies.
