Taking a dispute over $3,500 to small claims court Real Estate Q&A Christopher Combs Special to Arizona Republic USA TODAY NETWORK

Question: When we purchased our home in Apache Junction six months ago, the seller said in the Seller’s Property Disclosure Statement that there had been no roof problems. After the ÿrst monsoon rain we had signiÿcant water damage in our master bedroom due to a

roof leak that we paid $4,800 to repair. Our roof repairman said that there had been prior roof repairs in the same location on the roof. In addition, our neighbor said that the seller had constantly complained about roof problems. After using all of our money to buy our home and repair our roof, we have no money left for a lawyer. Is there anything that we can do? Answer: If you contact the seller and the seller denies having had any roof problems, the purchase contract initially requires mediation between you and the

seller, unless the claim is less than $3,500. The Arizona Association of Realtors has a packet for information on buyer-seller dispute resolution that is available online at www.aaronline.com. If the mediation is unsuccessful, you can then ÿle a lawsuit for $4,800 in Justice Court. Although you do not need a lawyer and Justice Court is less complex than Superior Court, prosecuting a lawsuit in Justice Court is still not a simple process. As I said, however, the purchase con-

tract does not require mediation for any claims under $3,500. These claims under $3,500 can be ÿled in the Small Claims Division of the Justice Court. Therefore, you have the option to reduce your claim from $4 ,800 to $3500, and then ÿle your claim for minimal cost in Small Claims Court. The procedure in Small Claims Court is basically the same format as TV’s Judge Judy: no attorneys, no jury and no appeal. At the hearing before “Judge Judy,” your roof repairman and your neighbor can testify for you.

Home prices increase in August even as sales slip

ÿve years. The new tax bill will require sellers to live in a home for at least ÿve of the past eight years to get the tax break. That could impact metro Phoenix’s high-end housing market, causing few people to move. Sales are already slower for Valley homes priced above $750,000. But Orr said while homeowners in high-priced homes might be slower to sell, they also might spend more money on renovations if they stay put.

Continued from Page 1R

The bill would lower the size of mortgage loans on which homeowners can deduct interest payments to $500,000 from $1 million. “The mortgage interest deduction is not as important as many in the housing industry believe,” Orr told me. “In California that limit looks low, but in Arizona few people will be affected.” The median price of a Valley home is about $250,000. In San Francisco, the median is $1.35 million. It’s $606,000 in Los Angeles and $605,000 San Diego. The median home price in Seattle is $700,000. Property tax deductions would be capped at $10,000. That’s another issue that’s much bigger for California and higher-priced home areas than metro Phoenix, Orr said. The median property tax in Arizona is less than $1,500 a year, according to several tax groups. The standard deduction would rise to $12,000 for individuals and $24,000 for couples. This change could mean fewer people are enticed to buy homes just to get the tax incentive. This provision could slow Valley home sales, but it would give the rental market a boost. “Doubling the standard deduction will give most ÿlers the tax beneÿt of owning a home without the bother of having to actually purchase one,” Orr said. He said Phoenix-area landlords and real-estate investors would beneÿt. A change to the capital gains exemption homeowners can tap when they sell their home. It currently allows individuals $250,000 and couples $500,000 in proÿts from a sale, if they have lived in a house for two of the past

Christopher Rugaber ASSOCIATED PRESS

WASHINGTON – Home prices rose sharply in August from a year ago, a trend that is thwarting many would-be buyers and potentially slowing sales. The Standard & Poor’s CoreLogic Case-Shiller national home price index increased 6.1 percent in August from a year earlier. That’s higher than the 5.9 percent annual gain in July. In nine of the 20 cities tracked by the index, yearly price gains in August were faster than in July. Fewer Americans are selling their homes, and builders aren’t putting up enough new houses to meet demand. That has forced home buyers into bidding wars, lifting prices. Mortgage rates remain at historically low levels, making it easier to afford higher costs. That has resulted in rising prices even as sales have slipped this year. “Home price increases appear to be unstoppable,” says David M. Blitzer, chairman of the Index Committee at S&P Dow Jones Indices. Housing costs are climbing much faster than overall in‘ation or wages. Sales of existing homes ticked up in September after falling for three months. Still, sales have fallen 1.5 percent from a year ago, according to the National Association of Realtors, the ÿrst year-over-year decline since July 2016. Yet the declining sales ÿgures don’t re‘ect a lack of demand. A typical home in September was snapped up just 34 days after listing, down from 39 days a year ago. Surveys show most renters consider it a good time to buy a

Help instead of hurt? Some housing market experts believe the changes could give metro Phoenix’s housing market a bit of boost. HomeSmart International founder and CEO Matt Widdows said he doesn’t see the tax plan as having a big impact on ÿrst-time homebuyers and middleclass America. Widdows believes cities like Phoenix with lower costs of living and home prices could beneÿt from the tax changes if people decide to “look to areas that accommodate the lower mortgage-interest deduction and lower property taxes.” Much of the concern from national real-estate groups has been over the change to the mortgage-interest deduction. But Valley real-estate agent Joseph Callaway of Those Callaways said that isn’t typically the main reason people buy homes. “It has been a long time since we had a buyer say that they were buying a home for the tax deduction on interest,” he said. “If tax reforms bring more prosperity to people, then home ownership and demand will go up.” And all the experts noted the tax-reform bill hasn’t passed yet, and more changes could come as Congress battles over the proposal.

ELISE AMENDOLA/AP

home, and increasing numbers of millennials are employed and entering prime home-buying years. Those buyers simply aren’t ÿnding many options, particularly among lessexpensive homes. The number of homes for sale in September was 6.4 percent lower than a year ago. There were just 1.9 million existing homes for sale that month, the fewest in any September since the Realtors began tracking the ÿgure in 2001. With so few properties available, more Americans are paying list price for homes or higher. Forty-two percent of buyers have done so this year, according to a separate report from the Realtors’ group. That’s the highest on records dating back to 2007. The survey also found that Americans are staying in their homes longer, one reason that fewer homes are for sale. The typical seller this year owned a home for 10 years before listing it, the same as last year. But before 2009, the ÿgure was usually six years, the Realtors said.

By attending these monthly meetings you’ll find: Information of general interest to all involved in managing properties as well as specific information pertinent to the location of your property Insight from guest speakers on how to improve your property’s performance Information from local police on what’s happening in your area Free Q&A with AMA Member attorneys Legislative updates that affect property owners and managers Networking opportunities to support you in your community FREE LUNCH

Whether you own or manage, you CANNOT afford to miss these Apartment Coalition meetings. ALL area owners and managers are welcome to attend. For more information, contact Stephanie Garcia at sgarcia@azama.org to find out about the next meeting in your area! AR-0008727327-01

months. We purchased a mobile home and will move the end of this month. We know we must continue to pay rent at our current apartment through the end of the lease. My question is: If we no longer live in the apartment and it will be available for rental, do we still have to maintain insurance and electricity until the end of the lease? If management rents the apartment, must they reimburse us for the portion we paid? Answer: Under Arizona law, if you vacate prior to your lease term, you are liable for the rent until the lease ends, unless it is rerented prior. The tenant would be responsible for anything that is called for under the lease; such as late charges, utility payments, etc. The landlord does have a duty to mitigate or reduce their damages by taking responsible steps to re-rent the premises under the same terms and conditions of the prior lease. The landlord would also be entitled to any costs to re-market the property for rental. The landlord does not have to use what the courts call “heroic efforts”, but simply reasonable efforts to the get the property re-rented. The landlord would need to reimburse any portion that was paid in advance if the property is re-rented prior to the lease ending.

Editor’s note: Readers who have non-emergency, general landlord-tenant, fair housing or multi-housing real estate questions can mail them to: The Arizona Republic c/o Rental Team, 200 E. Van Buren Street, Second Floor, Phoenix, AZ 85004. While all cannot be answered in this weekly column, we will attempt to publish those questions that would be of interest to most readers. For specific or urgent advice, consult your own legal advisors before making a decision. Legal Q&A participating attorneys: Scott Clark (602) 957-7877

6R z SUNDAY, NOVEMBER 12, 2017 z THE ARIZONA REPUBLIC

Be a good neighbor during the holidays Rent Smart Courtney Gilstrap LeVinus Special to the Arizona Republic USA TODAY NETWORK

The best part of the holidays is gatherings with friends, family and neighbors. Friends and family travel in from near and far to spend time together. Those living in apartments and communities with limited parking can plan to ensure that their neighbors are not inconvenienced and their cars aren’t missing by the end of the evening. If your community has assigned parking, let your guests know that those parking spaces are off limits. There’s

nothing more frustrating than coming home and ÿnding a guest car in your space. Let your guests know where they should park in your community or better yet, encourage them to carpool or use a ride-sharing service. Holiday parties and dinners can get a little louder than traditional dinner parties. Remember that you live near others who want to be able to enjoy their evening too. If you are planning a party that you know will be loud or long, you might consider letting your neighbors know, or even inviting them. A little notice might allow them to make other plans or be a bit more tolerant of a courteous neighbor. Many communities feature spaces for

special events like community rooms, kitchens, theaters and wine rooms. These spaces offer more square footage, unique experiences and less intrusion on your neighbors. If you’re planning to use a community space for a holiday party, be sure to restore the space following your event. A smart lessee will read over the contract to understand the set up and clean up times and what fees are involved. There may be additional charges for cleaning or damage if you don’t plan in advance for clean-up. The Arizona Multihousing Association is the statewide trade association for the apartment industry, representing more than 2,000 members in legislative, legal and regulatory matters.

The best part of the holidays is gathering together. GETTY IMAGES
