Aboriginal and Torres Strait Islander Statement
Inner West Council acknowledges the Gadigal and Wangal peoples of the Eora Nation, who are the traditional custodians of the lands in which the Inner West local government area is situated.
We celebrate the survival of Aboriginal and Torres Strait Islander cultures, heritage, beliefs and their relationship with the land and water. We acknowledge the continuing importance of this relationship to Aboriginal and Torres Strait Islander peoples living today, despite the devastating impacts of European invasion. We express our sorrow for past injustices and support the rights of Aboriginal and Torres Strait Islanders to self determination.
Inner West Council understands our responsibilities and role in working with the Aboriginal community to promote cultural heritage and history, address areas of disadvantage, and protect and preserve the environment as well as sites of significance to Aboriginal peoples. In doing so, we acknowledge that Aboriginal cultures continue to strengthen and enrich our community.
Today, diverse groups of Aboriginal and Torres Strait Islander peoples live and work across Inner West. We admire the resilience displayed in their significant achievements and in making immense contributions to both Council and the broader community.
Inner West Council is committed to embedding the values and perspectives of the Aboriginal and Torres Strait Islander communities to ensure we learn from the mistakes of our past and forge a positive future of long-lasting value built on mutual respect, equality and opportunity.

1. UsingtheDCP
Overview
The Inner WestDevelopment ControlPlan2026 (the DCP)supports the Inner West Local Environmental Plan2022 (the LEP) providing aconsistentsetof planningcontrolstoapplythroughoutthe Inner West. The DCPprovidesa Local GovernmentArea (LGA) wideapproachtomattersasdiverse asamenity andriskmanagement, transport, andwaste minimisationwhile recognisingandaccommodatingthe distinctcharacter ofInner West neighbourhoods
The DCP:
• Guidesassessmentof developmentapplications under Section4.15ofthe Environmental Planningand AssessmentAct1979 (EP&A Act)
• Applies tolandcovered bythe LEP andCallanPark
• Applies toall developmentapplicationsandcertaincomplyingdevelopmentwhere requiredby SEPPs
Compliance withthe DCPdoes notguarantee consent.

ThisDCPexcludeslandcoveredbyBalmainLeagues Clubsite and SEPP(Precincts –EasternHarbour City) 2021.The BalmainLeagues Clubsite issubject toLeichhardt DCP2000.

1.3 PurposeandAimsofthisDCP
The purpose ofthisDevelopmentControl Planistoprovide more detailed requirementstofacilitate development andtogive effecttothe aimsandobjectives, includingthe landuse objectives, inthe LEP andtoguidethe assessment ofdevelopmentapplicationsinaccordance withSection4.15ofthe EP&A Act
The DCPaimsto:
• Tofacilitate the achievement ofthe aimsandobjectives of the LEP
• Toprovidehighquality, sustainable urbandesign outcomes.
• Toenhance the unique, distinctive character ofInner West neighbourhoods andcentres, while accommodatingsustainable urbangrowth.
• Toensure development positivelyrespondstothe desired future character ofthe neighbourhood
• Tomitigate climate changeandimprove the resilience ofthe communityandinfrastructure of Inner Westtofuture shocksandstresses.
• Toensure areasonable level ofamenityforresidents, workers, andvisitors.
• Tomaintainandenhance the significance of heritage places withinInner West.
• Toensure development respondstoitscontextandtothe needsofall people withinthe community.
• Toprotectendangeredecological communities, enhance habitatfor endemic species, and increase tree canopy.

Structure
The mainbodyofthisDCPisstructuredinfive parts, eachcontainingobjectives andcontrols. Parts1to 4workfromthe mostgeneral tothe mostspecific, withPart 1applyingtoall developmentapplications, andPart 4applyingtospecific areas.
Inthe event ofaninconsistencybetweenacontrol inamore general partofthe DCPandamore specific part, the controlsinthe more specific partapply.
Parts and Sections
The five Parts ofthe DCP include:
Part 1 - Usingthe DCP- ExplainswhataDCPisandhow itisused -(Step1).
Part 2 -General ConsiderationsforDevelopment - Identifies andprovidesguidance formatterswhich will generallyapplytoall, oralarge sub-setof, applicationse.g.stormwater management, heritage, biodiversity, transport, amenity, waste managementetc (Step2).
Part 3 -LandUse Controls –Identifies andprovides guidance formatterswhichapplytocertaintypes ofdevelopmente.g.residential, mixeduse, commercial etc The provisionsinthisPart overrideand similarprovisionsinPart 2(Step3).
Part 4:Place Specific Controls –(controls for neighbourhoods, heritage conservationareas and specific sites).Development istobeconsistent withall other relevantprovisionsofthe DCP.The provisionsinthisPartoverridesimilarprovisions inParts 2and3where there isconflict(Step4).
Part 5:Definitionsand Abbreviations
EachPart issubdividedintoSections.Eachsectionofthe DCPincludes:
• Overview (plainEnglishsummary)
• Objectives (anobjective isastatementofthe desired future character or the outcome ofa development)
