Do You Exercise Your Right To Vote? By: Pat Farrell

It is historically significant that the right to vote has been a subject of contention almost since the United States was first established as an independent nation in 1776. Most of us today are happy to call voting just that (voting) but when one starts to research this activity they will find a number of synonyms still in use that include words like suffrage, enfranchisement (disenfranchisement), and simply put, ballot access, to define the right to vote. Drafting our country’s laws began in mid-1776, was completed in late 1777 and was finally ratified by all of the then 13 states in March of 1781. This document was called the “Articles of Confederation and Perpetual Union,” which gave states the right to determine their own rules governing who is eligible to vote and the right to control taxation, and it afforded the central government only limited powers. On March 4, 1789, the newly adopted U.S.

Constitution replaced the Articles of Confederation and Perpetual Union and has been the law of the land since then, granting the central government powers greater than those they had before. Exercising their entitlement under Article I of the U.S. Constitution most states, at that time, limited voting rights to white men who owned property and paid taxes. The Naturalization Acts of 1790 and 1795, while they granted free white males born outside of the United States the right to become citizens, they did not automatically entitle them with the right to vote. During the years between 1792 and 1856 the states gradually abolished the property requirements for their voters, but during that same period, while some black men had previously had voting privileges, at least in most of the northern states, those rights were later abolished in the states of Pennsylvania and New Jersey. In the 1820 election 108,359 votes were cast and as restrictions continued to ease in most of the states that number had risen to 2,412,694 by the 1840 election. Regarding their laws governing voting rights many factors entered into the make-up of a state’s laws depending upon where these states were located. The southern states of the United States of America, those that at one time were members of the Confederation States of America, continued to enforce laws like the “Jim Crow” laws that were designed to disenfranchise African-Americans and maintain racial segregation in schools and all public facilities (bathrooms and restaurants) and on all forms of transportation. According to Wikipedia (their words – not mine) “Jim Crow laws were state and local laws that enforced racial segregation in the Southern United States. These laws were enacted in the late 19th and early 20th centuries by

white Southern Democrat-dominated state legislatures to disenfranchise and remove political and economic gains made by black people during the Reconstruction period. The Jim Crow laws were enforced until 1965.” Setting the stage for further government intervention into the voting rights of Americans, the Fourteenth Amendment was added to the Constitution in 1868 guaranteeing citizenship to all male persons born or naturalized in the United States. This was followed by addition of the Fifteenth Amendment which prevents states from denying anyone the right to vote on the grounds of race, color or previous condition of servitude. Between the Jim Crow laws with literacy exams and poll taxes being assessed it was easy to see why it was almost impossible for African Americans or “poor whites” to afford to vote. It wasn’t until 1887 that citizenship was granted to Native Americans by the Dawes Act, so long as they agreed to give up their relationship with their tribes. And, in 1913 the Seventeenth Amendment was added to the Constitution permitting voters the right to elect their state Senators rather than leaving that to the state legislatures, as had been the previous policy. It did not go unnoticed that the disallowed discrimination against voting was specifically for males and made no mention of the female gender, so the struggles of women for suffrage continued to move forward. This fight was actually begun earlier by women who were originally participating in the anti-slavery movement, so once the Fifteenth Amendment was passed they were free to concentrate on the plight of women and began an earnest attempt to secure the vote for them in 1848 at a convention in Seneca Falls, NY orchestrated by Elizabeth Cady Stanton and Lucretia Mott.

Over the years other women joined in as the struggle continued and while some of those protesting were deemed peaceful, others could be somewhat militant. Finally, in 1920 the Nineteenth Amendment, giving women the right to vote, was added to the U.S. Constitution and the long battle for woman’s suffrage was over. By 1925 all Native Americans were now granted citizenship regardless of their tribal connections; however, some western states continued to bar them from voting in continued defiance of the Indian Citizenship Act of 1925. It wasn’t until 1943 that Chinese born U.S. residents were granted both the right to citizenship and the right to vote. In 1948 Arizona and New Mexico finally extended full voting rights to Native Americans, yet it wasn’t until 1961 that residents of Washington D.C. were afforded the right to vote in Presidential elections. During the period between 1962 and 1964 the U.S. Supreme Court made several important decisions that supported the concept of “one man, one vote” and an opinion from then Chief Justice of the U.S. Supreme Court, Earl Warren said, “The right to vote freely for the candidate of one’s choice is of the essence of a democratic society, and any restrictions on that right strike at the heart of representative government.” By 1964 the poll tax was prohibited as a condition required to vote by addition of the Twenty-fourth Amendment to the Constitution and through passage of the 1965 Voting Rights Act all minorities were then granted voting privileges. Whereas voting eligibility had always required that one be at least 21 years of age, the Vietnam War protests during the 1960s, that soldiers who were old enough to fight for the country should also be eligible to vote, led to addition of the Twenty-sixth

Amendment which changed that eligibility to 18 years of age. And in 1986 passage of the Uniformed and Overseas Citizens Absentee Voting Act permitted absentee voting by those military and citizens overseas, living on bases in the United States, abroad, or aboard ship. And so, back to my original question – do you exercise the right that you have been given to cast a vote, and if not, why

not? Many people have worked extremely hard to ensure that you can freely go to the polls, pay nothing, and make a choice as to who you would like to see serving in each of the various positions of government. This year, just as in other years in which Presidents are elected, that decision could be extremely important, as are the positions that will serve in the House and Senate. You are making a choice as to whom you trust

will see that this country, over the next four years, will recover safely from this pandemic and from the economic impact it has had and works hardest to get people back to work and the economy on an even keel. However, should you decide to skip the election and forfeit your right, and then you find the winners were not whom you would have chosen, then whose fault would that be?

The Way I See It By Cathey Meyer

Voter Redistribution The year I qualified to vote, there was no presidential election. I was too young for the epic Carter/Ford battle and had to wait for the Carter/Reagan fun. In the interim, I did exercise my right to vote in the city, county and state elections that fell into my voter window. As I enter my fourth decade of voting, I do not recall ever missing an opportunity to speak my voice through my vote. Back in the day, you could only vote on the designated voting day at your designated polling site. I remember waiting in line; needing my registration card; no photo ID; visions of legs and odd footwear beneath the voting booth velvet blue curtain; the moment of solitude as you were secluded in the booth with typed names and propositions and metal levers waiting for a pull. My most recent voting experience did not offer any of those treasured memories. It was the longdelayed run-off election of COVID July 2020. As a rule-follower, I showed up

for ‘early’ (not absentee as it was called in the day) with my mask, gloved hands, self-sanitizer, photo ID, voter registration card, silenced cellphone, conceal carry permit with my weapon well hidden in the car, and my bottled vodka that passed for water. Since one can vote almost anywhere, anytime between 8 AM and 6 PM, I like to select obscure locations that most likely will entertain very few voters. Nothing says RED, WHITE and BLUE like being the only voter in a room full of peppy poll judges. I randomly wandered into the unnamed polling place—honestly, I am not naming so it stays in limited use for the next election—on a midWednesday morning of day three of early voting. Parking was easy; I got the first slot past the eight unoccupied handicap spaces. I geared up with my patriotic mask, my clear plastic gloves and attempted to get out of my car. Rookie COVID errors: First, unfasten the seatbelt before putting on the

gloves. Plenty of plastic went sailing through the vehicle as everything snagged a bit of the gloves. They were shredded by the time I exited the car. As I grabbed my hydrating bottle, it fell to the parking lot and rolled too fast for recovery—Bonus for the street dude that found it. Second, do not bury your governmental photo ID at the bottom of anything. That pesky mask does not allow for below the nose searching with much accuracy. Pulling out a magazine of ammo is frowned upon at polling sites. Finally, secure your car fob in an easy to retrieve spot as the fun just repeats itself all over again when you attempt to leave. The small hike to the voting area winded me just enough to cause my sunglasses to fog. This naturally caused confusion as I approached the ‘line’ of no other voters. As you might guess, just handing over my photo ID was not acceptable. The nice nursing home lady squinted at my tiny photo and then at me and requested I remove my glasses, mask, and shredded gloves to prove my identity. She was fully PPP’d up, so I could not confirm whether she was legitimate on her side of the table either. I decided to trust in the system. With all my germs exposed to the room, my identity was approved to move to the next section one step over. There I was instructed to re-mask but leave my fingers free to sign for my right to vote. In my confusion to leave the car, I left my person

writing instrument, so I had to sanitize, sign and re-sanitize. The next assisted living escapee offered me a scantron sheet just like my high school final exam sheets and instructed me on how to vote via computer screen. I would be touching things again but was instructed not to use my re-gloved hand but another previously used pen gadget. I did have my choice of voting machines of various heights and brightness, but alas, there was no blue velvet curtain to offer me total privacy while I pondered my pound points to cast my vote. Mask on, I did my best to pretend I was alone and tried not to worry that I was being judged on more than my shoe choice for this excursion. I slid my scantroned ballet into the questionable slot and got my I VOTED sticker from the nice lady. This next election will present many obstacles no one can predict. First time voters will never know the joy of our former voting habits. They will embrace the COVID precautions, the techie vibe and month-long option for voting. I will lament voting habits gone by and laugh because I am now Grandma Meyer lamenting the days of yore. I will take care to dress for success, sanitize like my life depends on it and vote with the spirit my forefathers and foremothers intended. I treasure the privilege to have a say in our democracy—so fair warning on the process my fellow Americans and GET OUT AND VOTE!

Rocky Road Chocolate Cake (In a Crockpot)! • 1 (19.25 oz) package German chocolate cake mix • 1 cup sour cream • 1 (3.9 oz) package chocolate instant pudding mix • 1 tsp vanilla extract • 3 large eggs, lightly beaten • 1/2 cup chopped pecans • 1 1/2 cups miniatures marshmallows • 1/3 cup butter melted • 1 (3.4 oz) package chocolate cook and serve pudding mix • 3 1/4 cups milk, divided • 1/2 cup chopped pecans • 1 cup semisweet chocolate morsels

Vanilla Ice Cream (Don’t Forget)! Beat cake mix, next five ingredients, and 1 1/4 cups milk at medium speed with electric mixer 2 minutes, scraping sides down as needed. Pour batter into a lightly greased 4-qt slow cooker. Cook remaining 2 cups milk in a heavy nonaluminum saucepan over medium heat, stirring often, 3 to 5 minutes or just until bubbles appear (do not boil); remove from heat. Sprinkle cook and serve pudding mix over batter. Slowly pour hot milk over pudding. Cover and cook on LOW 3 1/2 hours. Meanwhile, heat pecans in a small non stick skillet over medium heat, stirring often 3 to 5 minutes until slightly toasted and fragrant. Turn off slow cooker. Sprinkle cake with pecans, marshmallows and chocolate morsels. Let stand 15 minutes or until marshmallows are slightly melted. Spoon into desert dishes and serve with ice cream! This cake will look like it needs to cook just a little longer, but will be just fine. ENJOY!

Are you thinking of starting a new business? Should I incorporate, if I want to start my own small business? I get asked this question quite a bit. The answer is almost always, YES! Whether the business is a retail business, a restaurant or real estate, it is important to carefully choose the correct business structure. Picking the correct business structure can have real-world consequences and, in some cases, can even mean the difference between success and failure. An incorporated business can also help minimize your tax burden while also allowing your business to bring in outside investors, should you decide that is something that is needed. When an attorney talks about “incorporating,” they are usually referring to a wide range of possible business structures.

In Texas you can be a corporation, limited liability company, limited partnership or several other types of businesses. While incorporating can help you protect your personal assets, it also adds some legitimacy to your company. Many small businesses start off as a sole proprietorship or a simple partnership, without any legal protection. But there are potential issues when they do this. The biggest threat is that, by not incorporating, the business owner puts his or per personal assets at risk. So, what happens if someone is injured by the product you are selling? Or what happens if your customer is in your vehicle and you are in a wreck? Is your business insurance going to be enough to cover the injures? If not, then the
