La Nueva Ley de Amparo: Un Giro Total para el Mercado Inmobiliario
L
The New Amparo Law: A Total Game Changer for the Real Estate Market
T
he newly reformed Amparo Law in Mexico, enacted in 2025, marks one of the most significant legal shifts for the real estate sector in recent years. The reform aims to prevent public and private projects from being halted through easily obtained provisional suspensions, while narrowing the criteria for who can challenge government acts. As a result, obtaining a suspension that stops construction, freezes permits, or blocks administrative decisions will now be considerably harder. Judges must apply stricter criteria, determining whether the challenged action truly violates fundamental rights and whether granting a suspen-

sion would harm public interest or contradict public policy. In practice, this substantially reduces the likelihood of stopping projects through injunctions, directly reshaping the dynamics of real estate development—especially in high-demand coastal regions where environmental sensitivity, community rights, and commercial pressure converge. For developers, the reform transforms the level of responsibility required before breaking ground. Gone are the days when a project could move forward
with incomplete documentation, counting on the possibility that opponents might halt it through an amparo. Now, even if a project contains irregularities, it may continue during the litigation process—only to face severe consequences if the final judgment rules against it. This expands the risk horizon: instead of being stopped early, a project could build infrastructure, sell units, and invest capital before later being subject to demolition orders, revocations of licenses, fines, or environmental restoration obligations. As a result, developers in coastal markets must strengthen their technical, environmental, and urban-planning files, including impact studies, consultations with local communities, property-title verification, and compliance with shoreline and ZOFEMAT regulations. Buyers—particularly those investing in beachfront properties—must now exercise increased caution. Without the automatic possibility of stopping construction through a suspension, a buyer could unknowingly invest in a project CONTINUES PAGE 10
10 | ENERO/ JANUARY 2026 | No. 411 compradores afectados.
whose legality remains under dispute. A development may advance rapidly, offer presales, and build amenities even with pending legal challenges, only to face sanctions once the court reaches a final decision. This makes thorough due diligence essential: reviewing title chains, environmental permits, land-use authorizations, zoning, litigation history, and concession status. Sellers and real estate agents will also bear greater responsibility; transparency and verifiable documentation will be fundamental to protect both clients and professionals from future liability. A pivotal aspect of the reform is the redefinition of “legitimate interest.” Previously, environmental groups and civil organizations could file amparos to stop works that threatened ecosystems or community rights. Under the new framework, only those who demonstrate a direct, personal impact may file such challenges. In coastal regions—where ejidos, private owners, hotel groups, and local populations often coexist—this significantly reduces the reach of collective protections. Although the reform accelerates project timelines, it may weaken preventive environmental defense. Without the possibility of obtaining quick suspensions, fragile ecosystems such as mangroves, dunes, wetlands, and turtle-nesting areas may suffer irreversible damage before a court issues a final decision. This makes early community engagement, transparent permitting, and rigorous environmental compliance more crucial than ever. Economically, the reform creates a mixed landscape. On the positive side, it provides greater certainty for well-structured developments, reducing the threat of long delays caused by injunctions. However, it increases transaction costs across the real estate chain: developers must invest more in legal compliance, buyers must perform more comprehensive due diligence, and sellers must ensure all property documentation is accurate and defensible. In coastal destinations such as Los Cabos, Puerto Vallarta, Riviera Nayarit, Tulum, and Costa Alegre—where land values are high and environmental oversight is strict—the reform reshapes how projects are planned, approved, marketed, and protected. Ultimately, the new Amparo Law signals a shift toward prevention rather than reaction. The projects that will thrive under this framework are those built on transparency, robust documentation, strong community relations, and full regulatory compliance. Those attempting shortcuts may progress during construction but face costly consequences later. For buyers, sellers, and developers in Mexico’s coastal real estate markets, this reform redefines not only the legal landscape but the entire approach to investment, development, and long-term risk.

ARQUITECTURA
El hombre que hizo bailar The Man Who Made al acero: El legado Steel Dance: Frank desafiante de Frank Gehry Gehry’s Defiant Legacy
L

rchitecture, by definition, is a discipline of rigidity. It fights gravity, demands firm structures, and for centuries, surrendered to the straight line. But Frank Gehry, who passed away on December 5th in Santa Monica at the age of 96, was never interested in rigidity. He was interested in movement. Looking back at his nearly eight-decade career, it is easy to get lost in hyperbole, but in Gehry’s case, the reality is astounding enough. He didn’t just design buildings; he designed a new way to build and perceive cities. With his departure, the world loses not CONTINUES PAGE 14
While Modernism preached purity and Postmodernism played with historical irony, Gehry declared: “Construction is raw, life is chaotic—let’s celebrate that.” It was the dawn of Deconstructivism, though he never wanted to carry the “ism.” That house taught us that architecture could be a collage, a three-dimensional sketch that never quite dries.
The “Bilbao Effect” and the Reinvention of the City

just a “starchitect”—a label he loathed—but the last great humanist of steel and titanium.
From Chain-Link to Titanium
To understand Gehry, one must look past the glimmer of the Guggenheim for a moment and return
to 1978, to a suburban corner in Santa Monica. There, Gehry took a pink Dutch Colonial bungalow and effectively “exploded” it. He wrapped it in “cheap” materials: raw plywood, corrugated metal, and, most shockingly, chain-link fencing. That house was a manifesto.
If Santa Monica was his laboratory, Bilbao was his consecration. When the Guggenheim Museum opened in 1997, it changed the global economics of cultural tourism overnight. Before Gehry, museums were neutral boxes for storing art. Gehry demonstrated that the building could be the work of art. The titanium curves, evoking ships and fish (a recurring obsession in his work), were not mere aesthetic whims; they were technical feats achieved thanks to CATIA, software designed for aviation that CONTINUES PAGE 16
his studio adapted. Gehry was a pioneer in using technology not to standardize, but to personalize, allowing stone and metal to flow like fabric.
The Acoustics of Light: Walt Disney Concert Hall
Many critics argue, and I concur, that his masterpiece is not in Spain, but in Los Angeles. The Walt Disney Concert Hall (completed in 2003) is perhaps his most resolved building. Here, the exterior exuberance of stainless steel serves a sacred interior purpose. Unlike the coldness of some modern auditoriums, the interior of the Disney Hall, lined in Douglas fir, feels warm, intimate, almost like being inside a cello. Gehry understood that architecture, at the end of the day, is for people. He created spaces that embraced you, even if on the outside they looked ready to take flight.
Beyond Form
Over the years, he was accused of being repetitive, of “crumpling paper” and turning it into buildings. That is a superficial reading. If we look at works like the Dancing House in Prague or the Louis Vuitton Foundation in Paris, we see a deep sensitivity to the environment. The Dancing House is not just a strange building; it is a dialogue with Prague’s Baroque and Art Nouveau history, a couple dancing (Fred and Ginger) on a corner bombed during the war. It is history healed with humor and grace.
An Unfinished Legacy
Frank Gehry worked until the very end. His creative longevity was unheard of. He leaves us a legacy that goes beyond sculptural forms; he leaves us freedom. He liberated architects from the fear of imperfection and engineers from the fear of the impossible. In a world trending increasingly toward algorithmic efficiency and generic glass boxes, we will deeply miss his controlled disorder. Frank Gehry taught us that buildings can have feelings, and that if we listen closely, steel can also cry, laugh, and dance. REST IN PEACE, MASTER OF MOVEMENT.

Beyond its athletic impact, the tournament is triggering a wave of investment and tourism that will directly benefit key destinations in Mexico's Pacific corridor —especially Puerto Vallarta and Riviera Nayarit. While these cities are not official host venues, expanded tourism mobility, increased air connectivity, and global exposure from the World Cup are generating a second-wave effect that is strengthening the regional real estate market. Mexico is expected to receive up to 5.5 million during the tournament, according to official es-

This extraordinary influx of travelers—primarily from North America and Europe—opens the door for a significant portion to extend their stay or seek out complementary destinations. Puerto Vallarta and Riviera Nayarit are leading the way in these options due to their tourism reputation, hotel offerings, air connectivity, and growing presence in the international luxury market. For these destinations, the first major impact is seen in short-term rentals. The profile of the World Cup tourist favors the rental of apartments, villas, and private residences, generating greater demand in areas such as Marina Vallarta, the Romantic Zone, Conchas Chinas, Punta de Mita, Nuevo Vallarta, and Bucerías. This drives an increase in rates on platforms like Airbnb and VRBO, in addition to improving the return on investment for owners of units intended for the vacation rental market. The growing air travel also plays a key role. Puerto Vallarta Airport has been consolidating its position as one of the most dynamic tourism hubs in the country, and the 2026 World Cup will accelerate the arrival of new flights, additional frequencies, and greater connectivity with US and Canadian cities. This has a direct effect on property values, benefiting both established residential areas and new development zones gea-
red toward investment. The real estate sector is responding to this new landscape with a boom in mixed-use projects, luxury developments, and turnkey schemes tailored to buyers seeking easy-tooperate properties with high rental potential. Regions like Flamingos, Nuevo Vallarta, Punta de Mita, and the southern area of Vallarta are experiencing a surge of interest from both Mexican and foreign investors. The fact that the United States and Canada are co-hosting the World Cup has a direct impact on the type of visitor coming to the country: travelers with a historical affinity for Mexico, high purchasing power, and an interest in buying vacation properties or retirement residences. This reinforces the growth of the real estate market in the region, driving the influx of capital, new investments, and the consolidation of sustainable, residential, and tourism projects. Taken together, the 2026 World Cup represents an exceptional opportunity for Puerto Vallarta and Riviera Nayarit. Although the matches will be played in other cities, the tourism, economic, and media impact places the Mexican Pacific coast in a unique position to attract residential, commercial, and tourism investment. For developers, agents, and buyers, this is one of the most strategic moments to finalize projects and acquire properties in two of the most dynamic and profitable real estate markets in the country. How to Choose the Right Real Estate Agent for Buying or Selling Your Property in Puerto Vallarta?
P
It happens nearly every day: A newcomer posts a question in one of Vallarta’s dozens of helpful Facebook groups asking, “Can anyone recommend a good realtor?” Within minutes, the floodgates open. Dozens, sometimes hundreds of replies roll in, usually with the same handful of names being repeated over and over again. If there’s additional questions in the post, they are rarely answered beyond the realtor referral. And here’s the problem I have with this: Almost no one stops to ask what the original poster is actually asking. Are they buying or selling? Is this for residential or commercial? Are they looking for ocean views, walkability, rental income, or privacy in the jungle? Do they need someone who speaks English or Spanish fluently, or who understands the AMPI-certified process in Mexico? Most of the answers come from wellCONTINUES PAGE 40

meaning locals, other agents, or possibly even paid recommenders. And while some of the names mentioned are great agents, others are simply “facebook popular,” and not necessarily well-qualified for your particular situation. So how do you cut through the noise and find the right real estate professional for your specific needs in Puerto Vallarta? Let’s break it down.
Puerto Vallarta’s Realtor are as Is Diverse as the Market
Puerto Vallarta isn’t just one real estate market, it’s many. Each neighborhood has its own rhythm, pricing, zoning, clientele, and quirks. An agent who’s a top producer in Marina Vallarta may have never set foot in Bucerias. A condo specialist might know little about raw land deals in Sayulita or commercial property sales in Nuevo Vallarta.
Key Considerations:
Location-specific expertise: Know the areas your agent actively works in. Property type: Not all agents are trained in commercial, business, land, pre-construction, or multi-unit sales. Legal literacy: Can they explain Fideicomisos, capital gains, closing costs, and AMPI regulations? Many are not well-trained for Mexican law and often use legal terms (in their offer contract for example) from their own country, where they may also be a realtor. These terms, which are usually in English and do not translate into a legal tender or language, especially in a simple Google Translate on your offer contract, just do not work in a Mexican legal contract. Without full understanding of the Mexican legal framework and language, your CONTINUES PAGE 42

about the Mexican market without having to “do more research” or “check with their broker” for details to your questions? Do they know their numbers or are they hesitating when asked about prices? (this is a KEY indicator of how your realtor works … do they understand the market, or not?) Do they have recent experience in the specific type of property you’re buying or selling? (for example: Have they worked with a pre-construction single family home builder before?) Can they show a portfolio of past sales or client testimonials relevant to your transaction? Do they provide bilingual service and understand international buyers/sellers? Are they local experts or simply promoting listings for exposure?
Red Flags and Facebook Fictions
realtor from Alberta … who’s licensed in Alberta and even AMPI certified here … may lose you deals because they are not wellversed on how the Mexican market (and sellers) truly operate. This kind of situation crops up a lot, I’ve noticed, especially when working with Canadian and USlicensed realtors trying to also do business down here.
What to Look for in a Qualified Realtor in Puerto Vallarta
Before choosing an agent based on social media praise, or their licensing in your home country, ask for and verify, the following: Are they AMPI-certified or affiliated with the Mexican equivalent of NAR or CREA? Do they seem knowledgeable
Beware of PV Realtors who appear in every or many of comment threads where the question is some iteration of the above example. And especially if the recommendation offers no areas of specialty, no clear qualifications (besides “He’s Canadian too!”), and only a rehearsed “thank you so-so” by the agent themselves. To me, this is just real estate and social media theatre, at its best. Ditto for the (usually fake) “supporters” who comment with “So-so-First name (linked and tagged profile), s/he’s the best.” or So-so-First name (linked and tagged profile), is the guy to talk to.” Instead, go to the AMPI website and search for Puerto Vallarta Realtor who speaks your language, and is based in the area you think you may want to live, or makes a claim for sales in that area. Or, snoop these recommended people on LinkedIn and their company website (not just Facebook!) and have a look at their Website or listings currently in the market. Do your “digital” homework on the person! You can learn a lot by asking Google or chatGPT about someone.

important for agents to understand, if this is the first question on your first “date” with a PV realtor, before even understanding why you’re buying, when you want to make the move, or what type of place you’re looking for, it’s probably because their priority is not you, but how much commission they stand to make on your purchase. While not a terrible thing
(everyone has bills to pay, yes?), this is definitely a yellow flag and sets the tone for the agent’s true agenda or priority. We always train (and retrain) our agents that we are advisors, not sales people. Because advisors listen and help. Salespeople Sell. Never believe everything you read on social media alone. Do your own homework! Where to Actually Find a Great Agent (Beyond Facebook) Ask in AMPI chapters (Puerto Vallarta, Riviera Nayarit) or visit https://ampi.org Check FlexMLS Puerto Vallarta / Nayarit for active agents with verifiable listings (not just an agencyconnected website for listings). El Paraíso Tiene un Nuevo Precio y no se Mide en Dólares, sino en Metros Cúbicos
E
Paradise Has a New Price— And It’s Not Measured in Dollars, but in Cubic Meters
O
n December 11, 2025, Mexico’s real estate sector entered a new era with the publication in the Official Federal Gazette of the New General Water Law. For developers eyeing the jewels of the Pacific—from the cliffs of Los Cabos to the lush jungles of Riviera Nayarit—the rules of the game have changed dramatically. It’s no longer just about securing the parcel with the best ocean view; now, the legal certainty of any project hangs by a single thread: water availability and management.
A Paradigm Shift: From Market Commodity to Human Right
Historically, water in coastal developments was managed under a concession-based system that, in practice, allowed a secondary market of rights. The new law, driven by the principle of “state stewardship,” eliminates this approach.
Key points of the reform:
Farewell to hoarding: Unused water must be returned to CONAGUA. The long-standing practice of “banking” concessions for future phases of a master plan is now prohibited. Priority of use: Domestic and environmental needs outweigh all commercial or tourism interests. In a water crisis, authorities may reassign supply, putting hotels and golf courses at operational risk. Digital Oversight: With the creation of the National Water Registry for Wellbeing, monitoring will occur in real time. Administrative opacity will no longer shield excess consumption.
Direct Impact on Construction and Design
For developments in states such as Baja California Sur, Nayarit, and Jalisco—regions already facing significant water stress—the law introduces technical requirements that will increase capital expenditure. Mandatory Rainwater Harvesting: All new residential and commercial construction in wa-

ter-stressed zones must include rainwater collection systems. Greywater Recycling: The law requires on-site infrastructure for the treatment and reuse of greywater. Architectural design must now be functionally circular. Water Feasibility Certifications: Municipal utilities (such as SEAPAL in Vallarta or OOMSAPAS in Los Cabos) will undergo stricter federal audits. Securing a “feasibility certificate” will no longer be a standard counter procedure, but a technical and legal challenge.
The Pacific: Mexico’s Water Frontline
Mexico’s Pacific coastline is particularly vulnerable. Saltwater intrusion into coastal aquifers, caused by overextraction, has already degraded water quality in destinations such as Mazatlán and Riviera Nayarit. The new law classifies “water-related crimes,” meaning developers who extract water from unauthorized wells or contaminate aquifers with inadequate discharge systems may face not only multimillion-peso fines but also criminal liability. For foreign investors, this significantly elevates the risk profile. “Sustainability is no longer a buzzword in a sales brochure—it has become a condition for legal survival. Any developer who fails to invest now in its own desalination plants or ultrafiltration systems is building an asset with an expiration date.”
What Should Investors and Developers Do?
In light of this scenario, legal and business advisors offer clear guidance: Immediate Water Audit: Review the validity and compliance of current water concession titles. Under the new law, extensions will be much harder to obtain. Project Reengineering: Integrate savings and recirculation technologies from the pre-sales phase. The premium market already values “water independence.” Engage with Local Authorities: States have 180 days to harmonize their legislation. This is the moment to participate in working groups to ensure that public infrastructure supports private growth. The New Water Law is a cold shower for unregulated expansion, but a golden opportunity for regenerative real estate development. The Pacific will remain an investment magnet, but only for those who understand that in Mexico’s 2026 landscape, real estate success is written with H2O.

Moving with Pets: New Home, Zero Stress
The Stress of Moving: An Animal Perspective
Mudanza con Mascotas: Hogar Nuevo, Estrés Cero
El Estrés de la Mudanza: Una Perspectiva Animal
U
M
oving is, undoubtedly, one of the most stressful events in a human's life. However, for a pet—be it a dog, a cat, or even a rodent— the impact can be even more profound. Our animal companions are creatures of habit and depend on a stable, familiar environment with known scents to feel safe. "Animals perceive changes before we do and can manifest stress in the presence of movement and disorder; if a move is traumatic for a person, it is even more so for a pet." Before the first box is loaded, your pet has already detected the anomaly. Visual disorder (stacked boxes), auditory alteration (packing noise, strangers entering and leaving), and, crucially, the change in the olfactory landscape (the smell of new cardboard, adhesive tape, or cleaning products) are alarm signals that undermine their sense of security and trigger stress.
Pre-Move Stage: Preparation and Desensitization
The key to a successful transition is planning and gradual
desensitization. While disorder reigns in the rest of the house, it is essential to designate a "safe room" for your pet. This room should be the last to be packed and the first to be unpacked, and must contain their essential items: bed, food bowls, favorite toys, and litter box (for cats). It is crucial that this space has restricted access for strangers and moving personnel, and it is recommended to use scent therapy (such as synthetic pheromone diffusers) to create a calm environment. In addition to this sanctuary, anxiety is reduced if the new disruptive element: boxes, is gradually introduced. Present empty boxes around the house weeks before and use them as part of the pet's play or exploration routine so that they perceive them as neutral elements. Finally, it is vital to keep feeding, walking, and play schedules unchanged; predictability in the routine is the antidote to anxiety. The other major pre-move challenge is transportation. The carrier or crate should be perceived as a refuge, not a punishment. This is achieved by leaving it open and accessible at home, placing blankets with their scent, treats, and toys inside. To reduce travel stress, it is advisable to take small car trips before the moving day, so that the animal associates the vehicle with an outing and not

Zero Day: Strategies to Avoid Chaos
Moving day represents the peak of stress, so the main objective is to minimize the pet's exposure to frantic activity. The ideal option is to leave them with a trusted sitter, family member, or at a daycare for a day. If this is not possible, the pet must remain in their safe room with the door closed, and it is essential to place a warning note for the movers. In the case of cats, they should be confined to this room or, even better, inside their carrier in a quiet, dark bathroom or closet. For dogs, keeping them leashed or in their carrier is safest, especially if combined with a long, exhausting walk first thing in the morning to help them relax. It is crucial that the pet wears a collar with updated identification (phone and, if possible, the new address) and, to prevent anxiety-related motion sickness and vomiting, large meals should be avoided just before or during the transfer.
castigo.
Arrival at the New Home: Creating a Safe Space
The new home is unknown territory, and your pet should explore it at their own pace. Before releasing the animal, a new safe room must be unpacked and set up. This should be the priority: placing the bed, bowls, and litter box/training pad. Using the same blanket and toys from the previous house is vital, as familiar scent is the main anchor of security. For cats, and also recom-
mended for more anxious dogs, the 24-Hour Rule should be applied, keeping them confined to this room for the first day. This allows them to acclimate to the general sound and smell of the new house without being overwhelmed by the entire space. Once the initial period has passed, exploration must be supervised. For the dog, a "scent walk" through the house and garden with a leash on at first is recommended, helping them feel accompanied and safe. For cats, you should simply open the door to the safe room and let them exit on their own, without forcing them. It is essential that owners of outdoor cats do not allow them outside for at least two weeks, thus ensuring they have established the new home as their safe base. Finally, as an essential safety step, all contact information on the microchip and ID tag must be updated, as the risk of loss is higher in the first few days.
Routine as a Focus of Stability
The best real estate trick for moving with pets is simple and powerful: establish a routine as soon as possible. This involves quickly unpacking their essential items, returning to fixed feeding and walking/play schedules, and dedicating extra quality time to reinforce the bond. Patience and attention to detail are the best allies in this process. By approaching the move from your animal companion's perspective, you not only reduce their stress but also accelerate the adaptation process and the happiness of the entire family in the new home.
