Campaign for Access, Representation, and Equity (CARE) for Immigrant Families
Pass the first-in-the-nation Access to Representation Act to ensure a right to counsel for all immigrants facing deportation in New York (S. /A. )
and guarantee that no one must defend themselves against a trained government lawyer alone to protect themselves and their families from deportation. The Access to Representation Act will mandate that the State appoint a lawyer to anyone in New York who has a case before an immigration judge or who has a basis to appeal or request to reopen an old deportation order, and meets income requirements
Allocate $100 million in the FY24 New York State budget to meet urgent and long-term legal and social service needs of immigrant families in New York.
Invest $55 million in launching the first year of the Access to Representation Act
and guarantee that no one must defend themselves against a trained government lawyer alone to protect themselves and their families from deportation The Access to Representation Act will mandate that the State appoint a lawyer to anyone in New York who has a case before an immigration judge or who has a basis to appeal or request to reopen an old deportation order, and meets income requirements.
Increase immigration legal services funding, including the budget line known as the Liberty Defense Project, to $35 million from its current $12 million.
This additional funding will ensure that existing programs including the New York Immigrant Family Unity Project (NYIFUP), have the resources they need for training, recruitment, and ongoing representation
Allocate $10 million to meet urgent needs of asylum seekers and other immigrants:
Ensure that New York is equipped to welcome immigrants newly arriving in our state by investing $10 million in emergency legal and social service support to meet the urgent needs of the newest New Yorkers as they establish stability and safety in this state. These services would help meet immediate needs of communities in crisis, including legal screenings, triage and referrals, know your rights, and volunteer trainings.
Coverage for All
New York State should allocate $345 million to create a state-funded Essential Plan for ALL low-income New Yorkers regardless of immigration status by enacting (S. /A. )
This would immediately provide coverage to immigrants not eligible for insurance due to their immigration status At the same time, our elected leaders should also join advocates in pushing for the Federal Government to approve the State's 1332 waiver, which could secure federal funding for health coverage extension
There are 154,000 uninsured, low-income New Yorkers who are ineligible for coverage because of their immigration status New York policymakers can make them eligible for quality, affordable coverage through a state-funded Essential Plan. We estimate that 46,000 of them would enroll annually when the program is fully implemented. Other states including California, Minnesota and Illinois have established state-only funded programs for certain groups of immigrants, such as young people and older people.
Expansion of the Office of New Americans to Meet the Needs of Immigrant New Yorkers
Increasing funding from the current $8M to $20M would allow for ONA to expand geographically and provide improved services for the 4.4 million immigrants across New York State.
Additional funding would allow for the creation of new ONA Opportunity Centers in underserved areas, additional staff to support affirmative non-deportation naturalization proceedings, additional adult literacy classes closer to the actual cost of service, increased coverage for additional languages, and improved New Americans Hotline support and staffing Despite providing these essential services, ONA is still drastically underfunded. The number of ONA Opportunity Centers was reduced from 27 to 24, adult literacy services were cut and then partially restored at the extremely low rate of $400 per student, and many of the 4 4 million immigrant New Yorkers are still unable to access the support they need to navigate both their communities and their naturalization process. New York created the first state-level immigrant assistance office of its kind, and it must now maintain its position as a leader for immigrant New Yorkers by continuing to expand the geographical reach and quality of services.
NYIC 2023 State Priorities - Legislative
New York for All
Pass the New York for All Act (S. /A. ) which broadly prohibits state and local officers from enforcing federal immigration laws, funneling people into ICE custody, and sharing sensitive information with ICE.
It prohibits ICE from entering non-public areas of state and local property without a judicial warrant It also ensures that people in custody are given notice of their rights before being interviewed by ICE, and starts the process of limiting ICE access to state information databases.
ICE leans on local law enforcement and local government agencies as multiplier forces, to search for, arrest, and deport New Yorkers When local agencies conspire with ICE, it leads not only to unconstitutional racial profiling, but also to the misuse of our local tax dollars and resources for ICE’s racist and abusive agenda
Expanding Language Access
Ensure the Office of Language Access (OLA) is accessible to community members and Community-Based Organizations (CBOs) and Increase collaboration with the new Director Introduce and pass new legislation to further expand on the current language access policy (S. /A. )
to assist with implementation of the law, provide expertise and knowledge from community organizations who interact directly with LEP communities, create a process to collect and report complaints and community feedback, provide regional language data, and policy recommendations
to include additional State agencies such as the Department of Motor Vehicles and Department of Education, require biennial language assessment using both Census and Community Survey data, and for local variances from the state-wide languages to be accounted for by regions adding the top 3 languages for that region that do not already appear on the statewide list
Lack of language access is one of the most significant barriers New York’s immigrant communities face to accessing critical State services This language access issue was made more prevalent in the wake of the global pandemic Most COVID-related information was rapid, instantaneous, and mostly in languages that were not accessible to many immigrant communities
Access to Representation
Ending State Support for Deportation, Detention and Mass Incarceration
Campaign for Access, Representation, and Equity (CARE) for Immigrant Families
Unlike in criminal proceedings, where defendants will be given a lawyer if they cannot afford one, immigrants do not have a right to a government-paid attorney in immigration court Those who cannot afford to hire a private attorney must find a nonprofit able to help or represent themselves. But immigrant New Yorkers lack affordable legal services, especially outside of New York City. Approximately 50,000 people in New York lack representation. Moreover, the uncertainty around continued funding for immigration legal service providers has made it hard for organizations to hire and retain staff, and to guarantee clients they will have lawyers for the duration of their cases. Having a lawyer represent someone in deportation proceedings makes an enormous difference. 60% of undetained immigrants with lawyers win their cases, versus 17% who don’t have legal help. Detained immigrants with legal representation are 10 times more likely to win their cases compared to those who lack counsel, and are seven times more likely to be released from custody than those without counsel
New York State can make sure that no immigrant fails to access the defenses and protections available to them under the law solely for lack of an attorney to make their case The State should do its part to provide due process, fairness, and access to justice for immigrants facing deportation proceedings By becoming the first state to enact a right to counsel for immigrants and, in the meantime, by renewing and adding to its initial investment, New York can once again show itself to be a leader in enacting commonsense policies that uplift all New Yorkers

New York has a history of providing some coverage to immigrant communities excluded from federal programs. More recently compared to other states we are falling behind. The state should continue to step up where federal policies fall short and lead nationally on immigrant healthcare issues by enacting a state-funded Essential Plan for immigrants.
Recommendation:

Expansion of the Office of New Americans to Meet the Needs of Immigrant New Yorkers
The Office for New Americans (ONA) funds essential paths to citizenship services, DACA screenings, naturalization support, work authorization support, and more to assist new Americans through a statewide network of culturally competent, linguistically diverse community-based providers. In addition to affirmative non-deportation related legal assistance, ONA supports highly needed adult literacy classes, community navigation, and workforce development workshops across the state through its 24 Opportunity Centers, which provide critical access points for immigrants to attain quality services at the centers as well as referrals to other needed services. ONA also runs the New Americans Hotline, which provides tens of thousands of referrals every year.
Despite providing these essential services, ONA is still drastically underfunded. Expanding Language Access
Language access means providing Limited English Proficient (LEP) communities with equal access to the same services as English speaking individuals Lack of language access is one of the most significant barriers New York’s immigrant communities face to accessing critical State services. This language access issue was made more prevalent in the wake of the global pandemic. Most COVID-related information was rapid, instantaneous, and mostly in languages that were not accessible to many immigrant communities.
In April 2022, Governor Hochul codified Executive Order 26 1 (§ 202-A of the Executive Law) as part of the FY 2023 Enacted Budget EO 26 1, signed in March 2021 by former Governor Cuomo and directs State agencies to provide for the translation of vital documents in the 10 most commonly spoken non-English languages The current law expanded New York State’s language access policy and directs all State agencies to provide interpretation services in any language with respect to the provision of agency services or benefits, and translate vital agency documents into the top 12 most commonly spoken non-English languages (Spanish, Chinese, Russian, Bengali, Yiddish, Haitian Creole, Korean, Italian, Arabic, Polish, French, Urdu). The new law took effect on July 1, 2022 with the launch of a new Office of Language Access. However, similar to the Executive Order, under the new law translation is only mandatory for the agencies under the jurisdiction of the Governor, instead of across all subdivisions of state and county government leaving out important agencies that many immigrants interact with like the Department of Motor Vehicles and the Department of Education The law does not provide for the use of the most recent U S Census and Community Survey data, or consideration for local variances
Recommendations:

modeled after a successful model in place in the District of Columbia since 2007 to increase the supply of trained, vetted immigration legal interpreters by committing funds to be provided to community-based nonprofit organizations
Provide funding to create three Language Services Cooperatives
to enable immigrant community-based organizations to develop and launch three language services worker-owned cooperative--for African languages of limited diffusion (LLDs), Asian LLDs, and indigenous Latin American LLDs.

Asegurar acceso a servicios lingüísticos se refiere a proporcionar a las comunidades con Dominio Limitado del Inglés (LEP, por sus siglas en inglés), acceso equitativo a los mismos servicios como a las personas que hablan inglés. La falta de acceso a servicios lingüísticos es una de las barreras más significativas que enfrentan las comunidades de inmigrantes de Nueva York para acceder a servicios estatales críticos. El problema de acceso a servicios lingüísticos se hizo más notorio a raíz de la pandemia. La mayor parte de la información relacionada con COVID surgía de forma rápida, instantánea y principalmente en idiomas que no eran accesibles para muchas comunidades de inmigrantes
Recomendaciones:
Garantizar que la Oficina de Acceso Lingüístico (OLA, por sus siglas en inglés) sea accesible para los miembros de la comunidad y las Organizaciones de Base Comunitaria (CBO, por sus siglas en inglés), y aumentar la colaboración con el nuevo director;

En abril de 2022, el Gobernador Hochul codificó la Orden Ejecutiva 26 1 (§ 202-A de la Ley Ejecutiva) como parte del Presupuesto Aprobado para el Año Fiscal 2023. DJ Rehka
DJ Rekha, née Rekha Malhotra, pioneered the merging of Bhangra and Bollywood sounds with contemporary electronic dance music. Rooted in hip-hop and dub their DJ sets range from Brazilian Baile Funk to Balkan Beats and everything in between. They founded Basement Bhangra, one of NYC's
longest-running club nights (1997-2017). Their debut album "DJ Rekha presents Basement Bhangra" (featuring a track with Wyclef Jean) won much critical acclaim and was nominated for best DJ album by the 2008 Plug Awards. They are the founder of Basement Bhangra TM, Bollywood Disco, and co-founder of Mutiny Club nights.
They were named "Ambassador of Bhangra" by the New York Times. Rekha was the sound designer for the TONY award‐winning Broadway Show, "Bridge and Tunnel," and received a Drama Desk Award nomination for their work on the play "Rafta Rafta." Rekha was also the associate producer for the NPR Radio Documentary, "A Feet in Two Worlds." They have done remixes for artists that range from Meredith Monk to Priyanka Chopra.
Rekha was NYU's A/P/A Artist-in-Residence for 2006-2007. They have received numerous community awards and in 2009 was inducted into the New York City's Peoples’ Hall of Fame. They have curated events for Celebrate Brooklyn, Central Park Summerstage, and has performed at the Obama White House and internationally. Rekha was a Grand Marshall of the 9th Annual NYC Dance Parade in 2015. In January of 2017, they performed at the historic Women's March on D.C. They graduated with a Master’s of Science in Comparative Media Studies from MIT in 2019. Most recently DJ Rekha produced the 2022 Basement Bhangra 25th Encore at Central Park's SummerStage with 5,500+ attendees and a line-up of heavy hitters such as Jasmine Sandlas, Raaginder, Red Baraat, Ganavya Doriswamy and more.
