With every passing year, Colorado’s real estate contracts are getting longer and BY SEAN MCILLWAIN longer. Our state’s MOD Boulder current Real Estate Contract to Buy and Sell Real Estate is over 20 pages long. But the long-windedness isn’t anything new; the statute of frauds, which requires that real estate contracts be in writing, has roots that span back to the English Parliament of 1677. Aiming to prevent contractual misunderstandings and fraudulent activity, the 1677 legislation stipulated that an oral contract wouldn’t suffice, and that a written contract must be used for transactions where a large amount of money was at stake. Influenced by their English counterparts, this legislation was adopted by the founders of the New World. And as with many of our rules and regulations, there’s much debate over how to interpret 17th-century laws in
a 21st-century world. With the inception of devices like fax machines and computers and today’s preference for emails and texts, there’s been a growing universal acceptance of the e-signature. While e-signatures seem like a new technology, as with most advances, they truly are evolutionary versus revolutionary. Let’s go back to the 1830s, when Morse code was first used to send electric messages via telegraph. A revolution in long-distance communication, Morse code was able to send enforceable contracts and agreements. In fact, the enforceability of such contracts via Morse code went all the way to the New Hampshire Supreme Court in 1869 with Howley vs. Whipple. In terms of e-signatures as we know them today, the idea was first floated in 1976 by Stanford cryptography pioneers Whitfield Diffie and Martin Hellman. While they envisioned a digital signature scheme, they only theorized such a scheme, but never implemented it. It wasn’t until 1988, when Lotus Notes 1.0 became the first widely marketed software package

to offer such digital signatures. Around the same time, fax machines became the du-jour device for transmitting time-sensitive, high-priority documents. At the turn of the 21st century, the 106th Congress passed the Electronic Signatures in Global and National Commerce Act, commonly known as ESIGN. ESIGN created four major requirements for an electronic signature to be recognized as valid under U.S. law, which are: Intent to sign, Consent to do business electronically, Association of signature with the record, and Record retention. Unsurprisingly, litigation around e-signatures versus handwritten signatures have skyrocketed in the last 20 years. Most recently, emails and even text messages have been disputed—and included— in what the courts consider a “binding” legal contract. And today, e-signatures are well established as the most trusted way to sign real estate documents and other legally binding contracts online.

When buying a home, many of our homebuyers will ask, “Where is the sun?” The immediate answer is “look up and see!” BY DUANE However, it DUGGAN is a bit more Realtor and Author complicated RE/MAX of Boulder than that. It’s essential to know where the sun is relative to the home you are thinking about buying. Where and how much natural sunlight illuminates the home throughout the year affects a variety of factors. Those factors include how much snow you will shovel off your driveway, solar access for your solar system, solar access easements, electricity and utility consumption levels, the amount of natural light in your rooms, types of lighting and window treatments, outdoor living spaces, landscaping, and more. The days are getting shorter, and fall colors are here! On the Front Range, the sun falls behind the mountains early on a winter day. The closer the home is to the mountains, the more likely it is to be sitting in what we call the “early sunset zone”. Luckily, nowadays, you can do more than just “look up” at the sky to determine all you need to know about the sun’s orientation relative to your home. Sun Seeker is an app you can add to your smart phone or tablet. I think the most obvious is determining how much sunlight will shine into your home on the shortest winter day. It can help you determine at what time a west-facing patio will cool down in the heat of summer or figure out the best spot to plan a shade tree to protect the patio. Obviously, the snow on southfacing driveways melt the fastest, but you can figure out how much sun the home will receive from other exposures. For example, the app can help you determine the best spot to locate your garden. If you are building a home, the
app can help you decide where to place windows, determine roof angles, solar system placement, porch locations, and much more. When selling your home and preparing for photographs and video, the app will help you determine the best sunlight times and direction. How does it do all this? Local government impacts your home’s value and your happiness Liz Farmer Rate.com (TNS) When you buy a home, you’re also investing in the community, so it’s important to know whether it’s a well-run municipality or a city on the decline. Local governments, in addition to being among the nation’s largest collective employers, are also among their region’s top revenue generators, according to National Bureau of Economic Research data. Los Angeles’ annual revenue tops each of the roughly 55 public companies headquartered there. New York’s revenue is close to some of the largest financial services firms in the world, including Goldman Sachs and Citigroup. And Denver’s revenues are close to Molson-Coors, the second largest U.S. brewer. More relevant to Denverites than Molson-Coors’ latest brew is how well their city spends on the services: libraries, parks, garbage pick-up, police, roads, public transit. Is the city investing in these community building blocks or making cuts? Is it spending more than it collects? What’s its fiscal outlook? All of these factors help tell you how well a city is run and, by extension, whether such services will enhance a house’s value, or detract from it. I’ll walk you through two examples — Denver and Sacramento — to show how you

can research your own city. Population growth — and whether new jobs are high- or low-paying — affects the rate of increase in city expenses and in revenue. If personal income growth outpaces population growth, that’s good for the local government’s financial health. On the other hand, smaller, poorer cities tend to see their expenses grow faster than revenue. Denver’s increased 21% over the last decade, Sacramento’s 10%, according to the U.S. Census; the agency’s tools, linked here, allow easy comparison of cities. Household income in Denver grew by 24%, while Sacramento’s grew by 16%. Using the Fiscally Standardized Cities database, we’ll create a downloadable spreadsheet selecting for: both cities, years 2010 and 2017, their total revenue, all the available spending categories, adjusted for inflation. Given the income and population growth trends, we should expect both cities to be in decent financial shape. But that’s not what we find. Sacramento’s revenue has been stagnant, and it has cut spending by about 15%. Libraries, transportation and parks and recreation have all been cut by more than half. Cuts to these quality-of-life services have ramifications. One good source for assessing this is the National Community Survey, an ongoing
citizen survey run by the National Resource Council. Participating cities receive reports on what their residents think is going well and what’s not. Sacramento’s latest citizen survey tells us the city ranks poorly and lower than the national average on things like recreation programs and facilities, parking, streets/sidewalks, public transportation and affordable housing. Despite the cuts to libraries and parks, those two still rate fairly well. Denver’s numbers are more what we’d expect. Revenue increased by 25% over seven years, while spending grew by 12%. The city cut library spending but increased spending on things like transportation, parks and rec, and housing and community development. Denver residents rate the city’s livability highly and better than other cities in recreation, open space, ease of walking and cultural activities. It ranks low in cost of living, affordable housing and traffic congestion. Another budget strain is debt. Denver’s annual interest payments on debt have fallen, while Sacramento’s more than doubled. Scrolling through local headlines tells us that Sacramento’s annual debt payments are poised to take a larger and larger bite out of the city budget in the coming years. In other words, more city spending is going toward paying
for past investments (or expenses) rather than generating new growth. Putting this all together, we get a picture of how local government spending has a direct impact on residents’ quality of life and the overall economy. A reduction in services usually means budget pressure, so it’s also worth investigating whether property taxes — Denver’s are unusually low — and other levies and fees have been rising, or if that’s being considered. If you’re looking to buy a house, chances are you’ve set a budget and spent countless hours researching the possibilities. Set aside a little of that time to make sure your chosen community is also an investment you’re willing to make. Be mindful, too, that the value of your home in the future will be highly dependent on the local supply of housing.
