BY MARY LYNN BRUNY I bought some printer paper recently and told my husband I bought the cheapest brand. He replied, “That’s okay since most our printing is for internal use only.” What? Internal use only? I think for a moment he forgot I was his wife and thought I was his work associate. This is kind of understandable for a number of reasons even though it’s slightly disturbing. First: We were work acquaintances before we started dating a gazillion years ago. (We met at the Design Engineering Show in Chicago, then basically a gathering of thousands of the world’s geekiest males. I was one of about five female attendees; we got noticed.) Second: I do a few computer-related tasks for my husband that supposedly his system can’t (or perhaps he chooses not to because I will). Third: He is my first-line editor. So we are literally in each other’s business. But being quarantined together 24/7 while both working from home has somehow changed our dynamic. Having no kids around or a social life to divert us, we seem to be sliding into a work zone. Sometimes it feels like our house is now the corporate headquarters of Bruny, Inc. For instance, our dining room has become a meeting room. If we need to spread out projects or review things for each other, this is where we go. If someone swapped out our antique dining

chairs for modern black leather swivel ones that seem to be in most corporate conference rooms, I’m sure neither of us would notice. Our kitchen is definitely the break room that we both meander to, mainly to kvetch about work stuff and gossip. You know, just like every employee in every company in every town in America does. “Oh, my gosh, you should have seen Tony’s hair today at our first quarter update tele-meeting! It looks like his toddler cut it!” We don’t have the requisite water cooler but we always have some old smelly leftovers in the refrigerator someone forgot about, just like at the office. We now also both have “Do Not Disturb” signs that we put outside of our office doors during tele-calls. This became a rule after I walked into my husband’s office clad in a robe while he was on a tele-call with an important client. This was mildly embarrassing. But let me tell you, moments before I had on less; I put on a robe because I was cold. It could have been a meeting that client would not soon forget (but wished he could). Now my husband and I are always properly clothed when entering each other’s offices. (A sound corporate policy.)

There is one challenge I’m experiencing: I always have a To-Do list of home-related tasks and now my husband tries to hold me accountable. He is use to managing efficient people, and I’m the only person around. I’m not accustomed to this. During “normal” times the guy is gone a lot, and the cat and I lackadaisically run the joint and do as we please. “Did you follow up with the electrician? What’s his availability?” he asks pleasantly. “What does it matter? We’re always here,” I reply a bit peevishly. “Well, good to keep on it,” he cheerfully responds. Between the cat and me, we’re not having it. We are use to being our own bosses and like it that way. I think of raising a certain finger and telling him, “This is for internal use only.” But of course I don’t. After all, I’m a model Bruny, Inc. employee. Part 1: Investing in Real Estate Using Retirement Plan Funds

When most people think of IRAs, SEPs, and 401ks, they usually think of investing in the stock market or mutual funds. However, if you set up a selfdirected IRA account (SDIRA), your retirement plan has the capability to hold real estate along with a variety of other real estate-related investments, such as notes. Anyone can use their retirement plan to invest in real estate -- you just need to have the proper plan in place. Using retirement funds to invest in real estate has been available since the 1970s, but plan administrators have restricted investment in real estate, not the IRS. In fact, the idea of real estate not being allowed is so entrenched that many CPAs are now just learning about the concept and “approving” it for their clients. Here are the steps you can take and requirements you should be aware of. Setting Up Your Plan to Invest in Real Estate The first step is to find a plan administrator or custodian that specializes in self-directed IRA plan services because many traditional brokerage firms do not. Next, determine which type of retirement plan fits your situation best. The custodian can help open your account or roll over your current IRA or 401K savings into a SDIRA. Not all plans can be rolled over 6

or transferred, so check with your current retirement plan administrator, your tax advisor, and the new SDIRA custodian. A SDIRA custodian will not give investment advice, but only acts upon direction from you. The custodian typically charges a fee per asset per year to administer the plan. Fees may also be structured based on the size of the account. They typically will also have a charge per check written on behalf of the account. The IRA holder makes all investment decisions, not the administrator. Once your plan is set up and funded, you are ready to go. Permissible Real EstateRelated Investments You are able to invest in any form of real estate, such as single-family homes, condos, multi-family housing, ministorage, industrial or commercial properties, land, farmland, and more. You can also buy, sell, and flip properties. However, the property cannot be one that you, your spouse, your parents, your children or “disqualified persons” currently own, or property that you would personally benefit from, such as a vacation home for your family. Other investments can include: • Real Estate Options meaning your plan can make a loan to

another party and secure it with a note and deed of trust secured by real estate, • discounted notes, • ownership share of a limited liability company or LLC, • Triple Net leased properties, • property improvements or renovation. The ability to invest in a hard asset like real estate in your retirement account will allow you to diversify and spread out the risk. In addition to real estate, you can still invest in all other forms of “traditional” retirement account investments. In fact, you can make any investment allowed by law. What You Can’t Invest In (It’s A Very Short List) • Life Insurance • Collectibles Using Cash from Your Plan to Buy Real Estate If your retirement plan has enough money, you might be able to buy a property free and clear. As an example, if you had $500,000 in the plan, you could buy a single-family house. If it rented for $24,000 per year, and you factored in expenses for taxes, insurance, maintenance, and management, after those expenses, the net cash flow might be $19,000. The net cash flow can remain in your plan and grow tax-free. You need to direct

your administrator where to invest the cash. Using Financing to Buy Real Estate in Your Retirement Plan Non-recourse financing must be used for any financing required within your retirement plan. This is because you cannot be personally liable, and your plan is not a person. Nonrecourse usually means that you will be required to have a larger down payment. Non-recourse loans are not available through a typical 1-4 unit lender, but they are available through experienced IRA lenders. In Part 2 of this two-part series, I will discuss the process of buying real estate with your plan, UBIT, multi-unit buildings, using an LLC, managing the property, and more. I speak for myself and Texas here, but both parties were ill prepared for the Artic blast we have just experienced. In my case it was on account of pure slothfulness that I had a pipe freeze, but fortunately we caught it before anything burst. Our sympathies go out to other souls who were less fortunate. Two days of water usage like most of the third world is subjected to every day was enough of a reminder to pay more attention next time. But still Colorado weather is misunderstood. Certainly, walking the dogs in sub-zero temperatures in a gentle but frigid breeze was excruciating, but the retrievers thought they were on the beach! Next day was well below freezing but with the sun out and no wind, it was really one of those magical Colorado winter days. Now 32 degrees feels balmy, but the reality is that we are not fully equipped to withstand those freak conditions.

Widow considers leaving her home in foreclosure Ilyce Glink and Samuel J. Tamkin, Tribune Content Agency

Q:

I am a widow in my 70s and my mortgage is underwater. Can I just let the bank foreclose and move on? I don’t want to buy again, just rent.

A:

We’re not fans of just letting the bank foreclose on homes. We think foreclosure should be a plan of last resort. Underwater homeowners usually fare better if they try to market and sell the home with a real estate agent. Sometimes, the price you get by selling will be sufficient to pay off the lender and all expenses of the sale, and you’ll walk away with other options. In other situations, the cash coming out of the deal may

not be enough pay all of the expenses and the lender will agree to a short sale. When the lender agrees to a short sale, the lender may also agree to waive going after you for any deficiency in the amount you owe the lender. If you get the short sale approved and the lender waives the deficiency, you come out of the sale not owing the lender any more money and don’t need to worry about the lender coming after you. On the other hand, be aware that the Internal Revenue Service might view the lender’s waiver of the balance you owe the lender as income to you and you may owe the IRS money on the amount waived. Certainly, however, if you sell the home and get more from the sale of the home than if the lender forecloses on the home and you have a much larger deficiency

owed to the lender from the foreclosure sale, you’re better off. You also need to remember that you might have a great credit score and credit history now, but if you stop paying the lender and let the home go into foreclosure, your credit score can take a huge hit and your credit history will show the foreclosure. Some landlords will pull your credit history to determine if they want to rent to you. If they don’t like what they see, your application for a lease might be denied. Keep that in mind before you make your final decision about which way to go. Some cities have restricted the use of credit histories and credit scores to rent properties to tenants, and if you live in one of those, you’ll have some measure of protection. But, in general, we suspect you’ll be better off trying

to sell your home. We hope you can find a good agent to help you get it done, and then be able to move on without worrying about the lender or the IRS coming after you. Good luck.
