Leased solar panels cause confusion between seller, buyer By Ilyce Glink and Samuel J. Tamkin, Tribune Content Agency Q: I’m confused about when sellers are supposed to shut off utilities and how these get transferred. I thought that, typically, within a day or two post-settlement, the buyers would transfer utilities into their name, establish new accounts, etc. Here’s what happened to me. I recently sold a home that included a leased solar system. The buyer was required to assume the lease, similar to the normal utilities for the property. The buyer switched the rest of the utilities into his name but failed to assume the solar lease. A short time after settlement, one of the buyers had a stroke, which may have overtaken other mundane matters like the assumption of the lease. Since the lease was part of the sales agreement, is there a default on the part of the buyer? Am I required to continue making payments? If so, do I have any recourse? A: Here’s the bad news: While your sales contract may have required the buyer assume the lease on your solar panels, the obligation on that lease is yours. You entered into a lease with the solar company to lease the panels. Under that agreement, they’re your landlord and you’re the tenant. Your problems started when you assumed that because you required the buyer to assume the lease, it would happen automatically. You took your foot off the gas pedal, but you shouldn’t have. Before you closed on the sale of your home, you should have received a document from the solar company indicating that the buyer had been approved as a new tenant under the solar lease. It was up to you to make sure that the buyer had assumed the lease before the closing. The closing was your leverage. When it comes to general utilities, like electricity, gas, cable, phone, TV, sewer and water, in most cases, the sellers cancel their service and the new buyers set up their new service. Some municipalities may require the seller to pay off any balances owed on water, sewer and other
local charges, bills and penalties before allowing the sale to occur. But once the sale occurs, the seller is on the hook to pay whatever was owed before the account was shut off; and the buyer is on the hook for whatever is owed from and after the new service was established. And, if the buyers don’t establish new service for these utilities, well, that’s on them. Has your buyer has defaulted under the contract? In a sense, yes, but your remedies under the contract might be limited. In many states, there is a legal concept that says the obligations and representations made by the parties in the contract end at the time of the closing. In some other states, those obligations that clearly should survive the closing can be enforced even after the closing or settlement. Assuming that you can use the contract to go after the buyer, it may be expensive to do so. On the other hand, if the buyer is using the solar panels and is not paying the lease costs, and you’re not paying the bill, your credit history is being harmed. The solar panel company will report you as not paying on the lease or paying late. In either case, your credit score and credit history are negatively affected, so there is a cost to you. Are your buyers confused about who actually owns the panels? Perhaps your buyers believe they own the solar panels and may not remember that the solar
panel company exists. The solar company likely has the right, under the lease, to repossess the solar panels. That would result in the company taking them off the roof and hauling them away along with the other equipment they own. That would be unfortunate. So, you should have a conversation with your buyers to discuss what would happen if the solar panels are repossessed, and to remind them that they need to move the contract into their name. Start with a friendly conversation. After all, they’ve had some hard luck since moving into the home and perhaps this just hasn’t risen to the level of “emergency,” with so many other considerations. If you try and they still won’t take action to change the name on the lease, talk to an attorney that litigates cases to sue the buyer to enforce the terms of the contract. Weighing the cost of college: Homeownership delayed but earnings higher With school back in session, many students and parents face college decisions soon – and the steep costs of attending. On the cost side, since the recession college tuition has risen steadily and student loan balances have more than doubled, reaching about $1.5 trillion nationwide. The vast majority of current Colorado higher education students receive student aid. Nearly 90 percent of two-year students and 72 percent of fouryear students receive federal, state and institutional aid at Colorado schools, according to a report by the Colorado Department of Higher Education (CDHE}. That debt links directly to
today’s young adults impaired ability to buy a home. Nationwide homeownership for ages 24 to 32 fell from 45 to 36 percent between 2005 and 2014, reports the Federal Reserve. Increased student loan debt is linked to this age group’s homeownership rate dropping by two percent percentage points – resulting in over 400,000 young adults in the U.S. who didn’t own a home in 2014 because of the rise in debt. But the benefits of earning a college degree or technical certificate continue to make
the investment worthwhile for Colorado students. Colorado graduates see consistent wage gains within ten years, earning a median income of $50,000, $54,000 and $60,000 for certificate, associate and bachelor’s degrees respectively, reports CDHE. The highest return comes to those in science, technology, engineering and math (STEM). In industry trades, a one-year certificate program yields greater return than a four-year education. And the jobs are there. About 75 percent of all Colorado jobs and 97 percent of top ones – those that pay a living wage and have high growth rates – require a postsecondary credential, according to CDHE. The good news is that new student debt has leveled off at Colorado’s four-year colleges and declined at two-year programs. The reduction is in the proportion of Colorado undergraduates taking on debt and the average amount.

Taste of Tomato: Finding a way back into love apples Have you experienced the unbearable sadness of a lackluster tomato? Standing in front of the tables piled high with perfect, red, round fruit, BY CAROL we convince O’MEARA ourselves that Colorado State we know how University Extension, Boulder County to pick one that will be a tasty prize on our salad. Sadly, finding a commercially grown tomato with moan-worthy flavor is like finding a needle in a haystack. “Tomato is a particularly complicated flavor; there are many genes producing many different flavors. But it’s also a product of the environment, soil and tomato quality. And it’s highly subjective to each individual,” says Dr. Harry Klee, Horticulture Professor with the University of Florida and renowned researcher known for his work in breeding flavor back into commercially grown tomatoes. Modern tomatoes aren’t as flavorful – it’s been proven, says Klee, due to breeders selecting for size, yield, pest resistance, and other grower considerations. Each selection for these things often came at a small cost to the flavor of the tomato. Every small loss added up over decades to result in a fruit that doesn’t live up to expectations. “Imagine a symphony. If one violin leaves it’s no big deal, but when more and more leave, slowly

the music changes. That’s what happened to modern tomatoes over the past 50 years,” Klee said. “We lost a sugar here, a volatile there. Selecting for larger tomatoes means less sugar, less flavor. There’s more sugar in smaller fruit.” Klee has an interdisciplinary team working on identifying the flavors consumers like, then working backwards to breed those genes back into the tomato. There’s a psychology of flavor, taste and smell, but also biology as well. According to the Center for Smell and Taste at the University of Florida (cst.ufl.edu/taste-vsflavor-whats-the-difference.html) taste happens mostly on the tongue but also other areas with taste buds, such as the soft palate. While taste is a major component
of flavor, aroma also plays a role. Aroma from volatile chemicals in tomatoes is one area Klee is focusing on. “What happens in the mouth when you chew the tomato, it releases volatile chemicals that go up into your olfactory senses. Taste in the mouth is sweet, sour, salty, while flavor is from the volatile chemicals in the fruit. Volatiles are essential to good flavor. Test it yourself – take a tomato and hold your nose so you can’t smell it when you eat it,” said Klee. Crossing heirloom tomatoes with the modern elite varieties, Klee has developed several with great flavor. Making them available to the home gardener, he’s released them through Proven Winners as Garden Gem and Garden Treasure. Try them
next year to see if you agree that they’re vigorous, disease resistant, and are flavorful. In the meantime, if you’ve got a hankering for great tomatoes, head out to the Taste of Tomato in Boulder. The Heart of Equity Colorado Is Its People By Pam Moore, for At Home
I
f you’re looking for an established Front Range real estate brokerage that’s committed to putting your needs first, check out Equity Colorado. Established in 2009, their Northern Colorado office, in Longmont, has been serving the community since 2010. Though the dividing lines are not distinct, says Managing Broker/Owner Nancy Umbreit, the Northern Colorado office mainly covers Boulder, Larimer, and Weld counties, with agents covering some of Adams, Jefferson, and even Denver counties. The full-service brokerage’s agents work with both buyers and sellers in all types of real estate markets, including Residential, Commercial and Land. Umbreit established the Northern Colorado office nearly a decade ago. Right away, she was attracted to the company because of their unique business model. “Our fees are very low with agents receiving the same or better service, tools, and technology as the full 8

cost brokerages,” explains Umbreit. “I loved the fact that my agents would get to keep a lot more of their commission while giving their customers better service.” She’d been working for another brokerage when she interviewed with Equity Colorado. “I wanted the job immediately,” she recalls. Because Equity Colorado’s agents keep a greater percentage of their sales commission, they have the opportunity to take on fewer clients, which allows them to give each client more of their time and attention. Umbreit describes a scenario where a Realtor earns a $12,000 commission. In a traditional brokerage, they’d share up to $4,000, or more, of that fee with their brokerage. In contrast, Equity Colorado Realtors pay the brokerage only $500. How do they keep the fees so low? “They’re not paying for the [large] building or coaching or anything they don’t want,” Umbreit explains. Equity Colorado, she says, spends very little on advertising, seldom uses assistants and does not require agents to rent unnecessary office
space or to hire expensive coaching services. When Realtors do want support, Umbreit makes sure they have it. The brokerage recently relocated to a charming, historic space in downtown Longmont. One of the selling points was the large conference room, an ideal setting for trainings and seminars. Umbreit offers four classes a month. “I’m always working on classes for my agents to keep them up to date on current topics,” says Umbreit. “They love the education.” The new office space also offers all the amenities a Realtor might need, like copiers, scanners and private office spaces. The most important resource for Umbreit’s team, however, is Umbreit herself. “I always help them find a solution. If I don’t have one I get it. I’ll call a lawyer, I’ll call my boss, I’ll call CAR (the Colorado Association of Realtors), I’ll call anybody I have to get the answer they need.” Umbreit’s investment in her team has certainly been worthwhile. While she was initially drawn to
Equity Colorado because of their low fees, she’s still enthusiastic about the company because of her team of hard-working Realtors. One of the best parts of her job? “Teaching [my agents], growing them, being with them,” she says. “I’m available from nine in the morning until 7 p.m. by phone and then usually 7 to about 11 p.m. by text or e-mail.” She remembers the frustration of sharing up to 40 percent of her commission fee with her brokerage as a new Realtor yet having to wait, oftentimes more than 24 hours, to get her questions answered. For this reason, Umbreit adheres to a strict policy: She strives to always answer her agents’ questions within 90 minutes. Though Equity Colorado is committed to building and maintaining strong relationships with their clients and among their team of Realtors, they’re also focused on adopting new technology to stay on the cutting edge of the fast-paced real estate industry. Fall into autumn: 3 ways to ease in to a new season

By Katie Laughridge Tribune News Service I admit I am an early decorator – I like to enjoy my holidays and seasons for as long as possible – and fall is my absolute favorite. I just love sweater weather, hot tea and all the leaves turning into earthy, warm hues. So yes, the shop is already an autumn wonderland. However, I understand some people may want to wait until the weather drops below 80 to fully indulge, which is why I wanted to share three quick tips for falling into fall – without having to fully commit to the season. Switch out floral accents The first thing I do when preparing for a seasonal change is change up the florals and 10

greenery around my space. I have bud vases and containers galore, the perfect vessels to switch up every season for a new look. Small changes can make a big difference. Change out vibrant sunflowers for fall sunflowers with a dusty hue and antiqued feel. Switch bright green boxwoods for cranberry boxwood sprays to bring in the warmer tones we love during the fall months. I also love incorporating traditional elements like acorn branches and wheat to my displays to bring in hints of fall without going straight to fall leaves. Looking for more floral options? Try orange Allium or Wild Lantana bunches for fall hues that pop in any arrangement. Refresh vignettes and mantels Since we are easing into a new
season, there is no need for a complete overhaul all at once (unless that's your style). Start by playing with smaller vignettes and mantles. We mixed springy green and our year-round favorite, classic blue-and-white ginger jars with pops of orange, yellow and a pumpkin or two to start the transition on one of our mantels. It creates a soft look and provides a nice mix of seasonal elements. Warm metals are great, versatile materials to mix into your displays for a transitional look. I also like to pop a few whimsical items in to my groupings like owl figurines, glass pumpkins and perhaps even a mischievous squirrel or two. This takes a plain bookshelf or tray display into fall without bombarding your space with seasonally specific decor.
Revamp your textiles One of my favorite things to change up during a transitional time is my textiles, especially this time of year when I can highlight all my beautiful plaid fabrics. I use plaid year-round because I am obsessed, but I would consider fall and winter to be the official plaid seasons in the Midwest. From pillows and throws to tabletop accessories, baskets and bedroom decor, festive textiles always have a place. the best result. The most accurate information, however, comes from a professional radon test, which usually costs between $150 and $300. It is also often bundled into the cost of a standard home inspection. Many states require a new system be installed before home closing if testing indicates radon levels exceed 4 picocuries per liter of air. And the EPA urges you to consider installing a mitigation system if testing shows more than 2 pCi/L.
If you think about radon at all, odds are it’s because it came up during a home sale and created a hassle in the closing process. And indeed, it’s not really fun to think about radon – it’s a serious health problem that could lead to some costly fixes for your home. But you still need to be aware of it, because ignoring radon is much worse than addressing it. Where does radon come from? Radon is a colorless, odorless radioactive gas that comes from the natural decay of uranium that is found in nearly all soils. If radon shows up in your home, it’s not your fault. Any home – new or old, sealed or drafty, with or without basements – can have a radon problem. Radon is the second-leading cause of lung cancer, exceeded only by smoking. According to the Environmental Protection Agency, it’s responsible for 21,000 deaths per year.

There’s no easy way to check for radon. You can’t smell or see it, and even if your next-door neighbor has a test done, the levels can be different from house to house. You can use an inexpensive radon testing kit that you leave in your home for a few days, then send it to a laboratory for testing. If you purchase a radon testing kit, take care to follow the instructions exactly in order to get

What can I do about it? Here’s the good news: Although you can’t stop it from emerging out of soil, radon can be safely vented from your home. You’ll pay between $800 and $1,200 on average, although this cost can go higher for larger homes. The most common radon mitigation system drills a gap beneath the home to trap radon, then a fan forces radon out through a pipe. You can also use passive depressurization, which avoids use of a fan by
taking advantage of the home’s naturally rising air to expel harmful gases. However, they’re not as effective in homes with high levels of radon. Homes can also be made radon-resistant with sealing to minimize radon from getting in, but this is not as effective as mitigation. Your radon professional can help you determine the system that’s right for you. No federal agency licenses radon contractors, so check for state licensing and local requirements. After the work is done, conduct another test yourself or with an independent contractor to verify the radon has been removed. The EPA also strongly recommends that all new homes, even those that have been built with radon resistance or mitigation, be tested after occupancy. Paul F. P.
