Survey shows why homeownership makes people happier Ninety-three percent of Americans say they are happier after buying a home, and 83 percent would never go back to renting, according BY TOM to Bank of KALINSKI America’s latest RE/MAX of Boulder Homebuyer Insights Report. Of the nearly 2,000 consumers surveyed, most say buying a home is the best decision they’ve ever made. Since owning a home is a life goal for many, it’s not surprising to hear that achieving homeownership makes the buyer feel good. What is interesting are the various ways those surveyed say they feel better about their life. They report having a positive emotional attachment to their home, an improved lifestyle, a greater variety of hobbies, a more empowered lifestyle and a greater sense of satisfaction. Seventy-nine percent believe

The report shows that homeownership positively impacts an individual’s satisfaction with their financial status. Seventy-seven percent of homeowner’s sense of financial well-being ranks higher than that of prospective buyers. And while homeownership is known for enhancing personal wealth, emotional connection dominates financial benefits as top of mind among those surveyed. More respondents think of home
as a place to make memories than as a financial investment – 58 percent compared to 42. No wonder owning a home is considered by many to be the American dream. While it’s the biggest financial decision most will make, making a wellreasoned decision to buy has a lasting positive impact. Understanding RESPA If you’ve never heard of the Real Estate Settlement Procedures Act (RESPA), you’re not alone. In the event that your loan is transferred to a new servicer, RESPA allows you a 60day grace period against late fees. You’ll get a written notification from your current servicer alerting you to the change at least 15 days prior to the transfer date. If you’re accustomed to making payments to your previous servicer or miss the notice, it’s not uncommon to mistakenly send your mortgage payment to your previous servicer. Thanks to RESPA, you’ll benefit from the grace period as long as
your payment was submitted to your previous servicer on time or within the allotted 60 days. This statute curbs a multitude of unethical practices, and plaintiffs have one year from closing to bring forth a lawsuit regarding potential RESPA violations. How the Fed’s interest rate decisions affect mortgage rates By Natalie Campisi Bankrate.com The Fed lowered rates by a quarter of a percentage point Wednesday, for the third time this year, in an 8-2 vote. Citing “global developments for the economic outlook as well as muted inflation pressures” in a statement released by the Federal Reserve, policymakers dropped the target range for the federal funds rate to 1-{ to 1-} percent. The mortgage holders that will benefit from the rate cut are those with adjustable rate mortgages or ARMs, as a Fed cut means another reduction to their mortgage bill. Variable rates usually move in the same direction as the federal funds rate. The federal funds rate, however, doesn’t directly affect long-term rates, which include financial prod ucts like 30-year fixed-rate mortgages; those tend to move with long-term Treasury yields. “Fed rate cuts have very little direct correlation to long-term fixed mortgage rates. We have seen mortgage rates moving in the other direction of the rate cut or not moving at all in the past,” says Shashank Shekhar, CEO of Arcus Lending in San Jose, California. “However, in the short term, a Fed rate cut usually boosts the stock prices and takes the money away from bonds. Also, a rate cut is intended to increase economic growth which can be inflationary. All of this is usually bad for mortgage rates and could result in higher rates for the borrower in the immediate future.” How fed rate affects short-term loans Most variable and short-term
rates are linked to two benchmark rates: the prime or the London interbank offered rate (Libor) plus a margin, which is a number of percentage points. These rates usually march in step with the federal funds rate, so today’s rate means an extra jingle in some borrowers’ pockets. One thing to note is that Libor as the key rate in mortgage contracts is on its way out, which is important for consumers to keep an eye on. Loans might get more expensive once Libor is replaced, says Greg McBride, CFA, Bankrate chief financial analyst. “The future for many adjustable-rate mortgages is further clouded by the coming demise of Libor as a loan index. There is an open question as to whether the replacement index and margin will mean a higher rate for borrowers than the current Libor plus margin,” says McBride. Addled with credibility issues, largely due to manipulating rates in order to drive profit, Libor will likely be replaced by risk-free rates or RFRs. The major flaw in Libor is that it depends on empirical data, which means banks report rates without being required to provide numbers to back up their claims. This process led to some Libor banks underreporting their interest rates for profit, which meant higher loan prices for some borrowers. Unlike Libor, RFRs would promote transparency by calculating rates based on real transactions in the market. What arm borrowers should know Variable-rate loans, such as 3/1 and 5/1 ARMs, as well as home
equity lines of credit, or HELOCs, get more or less expensive as the Fed boosts or lowers rates. This can be a boon for borrowers or a drain on their wallets, which makes variable-rate loans a sometimes-risky proposition. Products like 5/1 ARMs give consumers the first five years with a fixed rate; after the fixed-rate period ends, there are annual rate adjustments for the remainder of the loan. So, if your rate drops during the adjustment period the cost of your ARM drops, too. Many HELOCs are also variable rate loans, which means a win for borrowers in a falling rate environment. The problem is that rates don’t always drop. So, it’s important for borrowers to analyze all scenarios: how much they’ll spend as well as how much they’ll save if rates rise and fall. It’s important to ask yourself: can I afford my mortgage payments if rates spike? Although your initial out-of-pocket payment will likely be lower with an ARM, that low cost might not last if rates rise. “My brother and sister-in-law have a 5/5 ARM with a great rate and a low down payment. But, if rates go up in five years, their payment might go up by a couple hundred bucks a month. That’s a big increase,” says Sean Murphy, associate vice president of equity lending at Navy Federal Credit Union. (A 5/5 ARM is a 30-year adjustable-rate mortgage with a principal and interest payment that stays the same for the first 60 months, and after that, the interest rate could rise or fall every five years.) Often borrowers choose ARMs to get the lowest initial rate
possible, regardless of the variablerate risk. This can be a cost-saving strategy if the borrower is certain they’re going to sell before the fixed-rate period ends or can refinance into another mortgage. For borrowers who plan on staying put or might not be able to refinance later (due to credit or employment issues, for example), that upfront cost-savings likely isn’t a worthwhile gamble. “There is only about onequarter percentage point difference between the rate on a 7/1 ARM and a 30-year fixed. For a quarter percentage point, are you going to subject yourself to potentially higher rates seven years from now? You’ve got to be awfully certain you’ll be out of that house within seven years to make that risk pay off,” McBride says. Consumers may want to keep an eye on these indicators The Fed’s decisions on rate movement are often influenced by several economic factors, which consumers can easily track. Employment, inflation and consumer price index are essential data the Fed considers when deciding what to do with rates. One thing consumers may want to look at is the employment report, which is published monthly by the Bureau of Labor Statistics. The target inflation rate is another yardstick for rate changes. Currently, inflation is still dipping just below the Fed’s target 2% rate, which – in concert with other economic trends – could nudge the Fed toward future rate cuts. As long-term rates hover below 4 percent, many borrowers are in a good position to save money.

Just what is a home inspection? Home inspections are limited, non-invasive, examinations of the condition of a home. Inspections Typically, home inspections are conducted by a home inspector who has the training and certifications to perform such inspections. The inspector prepares and delivers to the client a written report of findings. The client then uses the knowledge gained in the report to make informed decisions about their pending real estate purchase. The report describes the condition of the home at the time of inspection but does not guarantee the future condition, efficiency, or life expectancy of systems or components. A good home inspector will, however,
recommend either the services of an engineer, disciplined in a particular field, or other specialist when the need for further investigation is warranted. A home inspection doesn’t just provide you with a list of problems to negotiate with the seller to have fixed or something catastrophic that may cause you back out of the deal altogether. It will provide you a detailed report that is something of a “new owner’s manual” for the home. It is your opportunity to learn the exact condition of the house including maintenance tips and schedules you should follow. If you’re like most home buyers, you want to know the condition of the house and its components, questions like: Is the roof leaking? Is the heating system working properly? Does the plumbing function properly? Are there any electrical hazards? Are there items in the house that will need repair or replacing and when? Does the wood framing have any damage? Do the doors and windows function properly? Does the basement get wet?
Etc. Answering these, and other similar questions is precisely the job of a professional home inspector during a complete visual examination of the property. Home inspections are sometimes confused with a real estate appraisal. An inspection determines the condition of a structure and all its components including but not limited to plumbing, electrical, roofing, doors/windows and siding. An appraisal determines the value of a property. While not all states or municipalities regulate home inspectors, there are professional associations for home inspectors that provide education, training, and networking opportunities. A professional home inspection is a snapshot in time of the current condition of a house. It is not a building inspection; building inspection is a term often used for building code compliance inspections in the United States. Most inspectors, at a minimum, will invite you and your agent for a walk-through with them at the end of the inspection. You can ask to attend the entire inspection
if you wish. The time you will be the varies by the size, age and condition of the home. Ask your inspector in advance how long you should plan on being there. Your inspector should explain your home’s systems and give you maintenance tips. Those should also be in the final report, along with pictures. But hearing and seeing it in person is helpful. Your realtor can provide you with contact information for reputable home inspectors. Most will refer more than one inspector and let the buyer make their own choice. This way there is no conflict of interest. Referrals from friends or relatives who may have used a quality inspector in the past are also good. Owner financing real estate in Colorado
Owner financing is when a real estate owner has enough equity to loan all or part of the money for a buyer’s purchase of BY DUANE their real estate. It can also be helpful to close the deal faster if banks and lenders will not offer the entire amount of financing necessary, or the home buyer has trouble qualifying for a traditional mortgage or needs more flexibility with a down payment or other financing terms. Owner financing is usually pretty safe since the owner knows the property and the investment is secured by a note and deed of trust. On top of that, the return on the investment can typically be more than what might be available in the investment marketplace. There are two parts of an owner-financed transaction that create the agreement between the borrower and the owner/lender: the note and the deed of trust. The note is a written agreement stating that the debt is acknowledged and there is a promise to repay it. The deed of trust is a written agreement, which allows the owner of the note and deed of trust to foreclose in the event that the buyer defaults on the payments. This second document is almost always recorded publicly in county records. Over the years, owner financing has changed and evolved dramatically. In the ’70s, standardized Bradford forms were often used by real estate brokers in a real estate transaction. Rather than brokers creating forms or using Bradford forms, the Colorado Real Estate Commission came up with a set of approved notes and deeds of trust for real estate brokers to use. Those forms were used by Colorado Real Estate Brokers through 2013. As a result of Federal legislation commonly known as Dodd-Frank in January 2014, the Colorado Real Estate Commission removed the financing language from the standard Colorado Contract to 8

Buy and Sell. The standard forms for notes and deed of trusts were repealed, and a whole new set of rules followed suit. Today, there are two common types of owner financing. In the first type of owner financing, a seller owns a property free and clear of any mortgages. This enables the seller to carry a note and a first deed of trust. In this case, the buyer and seller agree to a down payment amount and the terms (length of loan, interest rate, and payment schedule). At closing, title will transfer to the buyer, and the seller’s security is the deed of trust signed by the buyer. In the second type of owner financing, a seller carries a “second” lien on a property. It is called a “second” because the loan will be in second position, or subordinate to a first mortgage from a bank or mortgage company. Just like the first deed of trust, the buyer and seller agree to the down payment amount and the terms of the loan. From the seller’s point of view, there might be more risk because the first deed of trust is
in front of the “second” and if the buyer defaults, the seller would need to foreclose and pay off the first mortgage before the second lien. If the buyer is getting a new conventional first mortgage, the buyer always needs to disclose the terms of the “second” to the first lender for qualifying purposes. Sellers of their personal residence essentially get a free pass to sell their home without having to comply with more complicated owner carry rules. However, it is still a good idea to employ a real estate attorney or licensed mortgage loan originator (MLO), to make sure the documents are prepared correctly, in accordance with both Federal and Colorado law. In Colorado, the law allows up to three owner-financed transactions a year without have to comply with additional rules. In the event a seller has more than three properties and wants to sell them with owner financing in the same year, it is required that a seller use an MLO to process and qualify the transaction. It is possible for sellers of multiple
properties to actually become a licensed MLO rather than hiring an independent one. As always, anyone considering selling their home or buying a home with owner financing should consult the appropriate licensed professionals, such as an attorney, mortgage loan officer, and Realtor® to help them make their decision and structure the transaction. How can I keep warm without using my heater? By Paul F. P. Pogue Angie's List As the temperature drops (and keeps dropping!) in the weeks to come, it might feel like time to turn on your heating system and switch the thermostat to warm things up. But heating your home can be an energy-guzzler. Here are a few steps to help endure the cold that don't involve just putting on a sweater or bumping the temperature up a few degrees. Save energy and increase comfort with these tips. Set your ceiling fan to run in reverse. There should be a switch on the body of the fan that you can flip. Warm air tends to rise, but reversing your fan will push heat down into the room rather than letting it collect by the ceiling. (Make sure you clean your fan first, or else you may send a swirl of dust into your room!) Add extra protection around areas of heat loss. Place thicker treatments over your windows and use heavy drapes to keep the cold out more effectively than curtains. It's also a good idea to open

curtains on south-facing windows during the day to allow sunlight to naturally heat your home. Use fabric snakes to block drafts underneath doors. In a pinch, you can cut a pool noodle in half lengthwise and slide it beneath your door. Wrap it in fabric to add some style! Also, if you have tile or hardwood floors, lay down rugs or floor coverings to insulate against the chill. Move large furniture away from exterior walls and make sure vents are clear to allow air to circulate. Perform routine maintenance on
your home. Change your air filter regularly; this step alone can lower your energy usage by 10 percent. And check the weather stripping and seals around your doors and windows. Even a small gap in the seals can make a big difference in your comfort. Think of how alternate methods of heating around the house can help. Obviously, a fireplace is an excellent heating source, but when the fire's not burning, make sure you keep the damper closed. Add caulking around the hearth and check the seal on the flue damper
to make it as snug as possible. Another idea is to use your oven and stove for cooking; not only will they add heat to the rooms, hot meals will keep you cozy as well! Check the insulation in your attic and walls, and hire a professional if necessary to improve the situation. An under-insulated attic will make a big difference in your heating bills. Also make sure that your basement is properly sealed and caulked. Unsealed basements allow cold air to infiltrate the home and push warm air out of the living space. Consider using landscaping elements to improve your comfort. Windbreaks to the north, west and east sides of your home can block the cold winter wind. A wall or fence, evergreen trees and shrubs can make effective windbreaks, according to Energy Star. Paul F. P. The art of (a bidding) war Even in a balanced real estate market, competition between eager bidders may arise – so how do you make an offer that truly stands out BY SEAN among the rest? MCILLWAIN A strong price Mod Boulder is an obvious tactic, but there are a few other tricks of the trade that can make your offer the bright, shiny object that’s hard for any seller to resist.
Dates and deadlines Whether it’s a quick close, an extended occupancy, or any other scheduling requirement, sellers often have their eye on a specific closing date – and if you can meet that date, your flexibility may be as good as a higher-priced offer. For example, some sellers put a premium on a post-closing occupancy situation. If the sellers need to stay in the house past the closing date – and this agreement works for you – your willingness may be more enticing to the seller than cold, hard cash. Additional earnest money While it’s a simple notion, it’s
one many buyers don’t consider: offering extra earnest money. Not only does it show your enthusiasm, it indicates you’ve got plenty of cash on hand, which may alleviate concerns the sellers have about your financial qualifications. Contingency removals Inspections, appraisals, and loan conditions: these are the three big hurdles that must be cleared during the purchasing process. If you can remove one or all of these, it strengthens your offer significantly. First, let’s talk about the biggie: the inspection. As a general rule, removing the inspection clause from an offer isn’t recommended – imagine, your worst nightmare would be to discover a faulty HVAC system, a leaky roof, or an unknown foundation issue post-closing. But occasionally, this contingency can be waived. If you’re confident about the condition of the home, you can still request an inspection, letting the seller know you’re only inspecting it for your personal knowledge and you don’t expect to renegotiate the offer. The appraisal can be handled several ways. If you’re not concerned about the home
meeting the appraised value—or you’ve got enough cash on hand to bring a larger down payment to the table – by all means, remove the appraisal contingency. If you’re limited on your down payment, you can still offer that you won’t object to the appraisal, as long as it meets a certain threshold. This method works well for both buyer and seller, while providing a safety net should the house appraise significantly lower than expected. Lastly, while they’re good for buyer protection, loan conditions are a potential red flag for sellers. Under these conditions, buyers are protected from unforeseen financial circumstances. However, because they’re often scheduled near closing, sellers can see them as a threat and potential timewaster if the deal falls through. If you’re extremely comfortable with your finances – and you’ve been thoroughly vetted by a lender – removing this obstacle makes your offer as good as cash. Escalation clause I mentioned it before: a strong price is the primary driving force behind a strong offer. Even when you’re confident with your own offer, you can’t be sure how it’ll stand up to others. (Cue the

It’s a savvy strategy that shows the seller’s strong interest, but it’s important to stay within your budget – and your lane – and know when to walk away if the bid goes beyond your limit. A basic example would be, “Buyer is willing to pay $500,000 or $5,000 over any competing offer up to $525,000”. These clauses always require that the competing offer be presented to the escalating buyer, with personal details redacted. More than any clause or contingency, though, the best decision you can make is to hire an experienced real estate agent to guide you through the buying process. Having an advocate who knows the local market inside and out – and who can advise you on tough negotiations – means you’ve got a well-stocked arsenal to enter the bidding war. This month we focus on cleaning, protecting and maintaining. Pull on a sweater, grab a rake and be thankful for the past – and hopeful for the future. 1.

Advance planning will provide a big holiday payoff: Pot up amaryllis and paperwhites for blooming centerpieces next month. To encourage Christmas cactus blooms for the holidays, expose plants to bright light 10 hours daily and complete darkness (at 55 to 60 degrees) 14 hours nightly. Daylight Saving Time ends at 2 a.m. Set clock back one hour to return to standard time. Give the lawn one last – and short – mowing. Just this once, set blades to 1.5 inches. Plant spring bulbs if you haven’t already. Continue planting until the ground is too hard to dig. AT HOME COLORADO

Remove unwanted garden plants and turn over the soil, then apply mulch to bare spots to prepare the bed for spring planting. Fill garden holes with soil from spent container plants, then wash pots with a 1:1 water-bleach solution. Harvest winter squash after vines die back – but before a deep frost. To all my readers who are veterans: A bouquet of gratitude for your service! Store clay pots indoors to prevent cracking from freezing temperatures. Prune weak, cracked or diseased tree branches to prevent from causing injury or damage during winter storms. Cut asparagus all the way down and cover with 2 inches of well-rotted manure. Clean bird feeders and stock with seed. Don’t forget to provide clean water. Heed my (unfortunately) experienced advice: Mice seeking warmth can fit

through a pencil-width hole; seal gaps and cracks in foundations, and around windows and doors. Loosely tie arborvitaes and upright junipers with twine to protect against damage from ice and snow. Inspect patio furniture, tree trunks and undersides of branches for gypsy moth egg masses – beige blobs – and pry off with a sharp knife if you spot them. Discard in the trash. Clean the ground under and around roses, fruit trees, lilacs and any plants that were diseased this year; discard debris in trash to prevent reinfection. Keep raking! Consider shredding leaves with a pass of the mower, and apply around plants in place of mulch after several hard frosts. To prevent birdbath water from freezing, consider buying a de-icer. Clear a bed now for planting peas in March. As long as the temperature is above 40 degrees, apply an anti-desiccant to protect broadleaf evergreens, like rhododendrons, from
dehydration. 24. Turn over vegetable patch soil to disrupt the life cycle of pests that may be trying to settle in. 25. Keep watering new plantings and transplants until the ground freezes. 26. Dig up and store cannas, caladiums, colocasias, dahlias and gladioli after they’ve been blackened by frost. 27. Happy Diwali! Winter watering crucial for trees, shrubs The wintry blast we’ve recently received should remind all gardeners that it’s time to plan for helping our gardens through a long, cold, dry winter. While it’s BY CAROL true we just had a O’MEARA wet storm and our Colorado State plants got a nice University Extension drink of water, gardeners should think ahead on how to make sure your plants stay watered in winter. The influx of moisture into the soil is good for the landscape, but for long-term success, keep track of our storms and set reminders to water your trees and shrubs if Mother Nature turns off the charm. Once every four weeks is the rule of thumb for assessing whether the weather brought an inch of moisture to the land. To help trees and shrubs harden off for dormancy, we needed our landscapes to dry out a bit; having dialed back on irrigating in September and October was
crucial to this process. But the soil can’t remain dry the entire winter or roots will dry and die, so sending the plants to bed with a long, deep drink ensures that, once the soil warms again, roots will be able to expand and resume its job of taking up water and nutrients. The ideal time for that deep irrigation is once the leaves have fallen from the trees; both evergreens and deciduous woody plants benefit from it. Research has shown that this watering is the foundation for success in overwintering woody plants so it’s nice that Mother Nature sent the storm when she did. Not so nice is the one she sent a few weeks ago, abruptly ending the warm fall and freezing leaves on their branches. Because we didn’t plunge into low temperatures and stay there, the plants should be fine. They need a series of cold events to signal that the time is nigh for settling into a winter’s nap. Tuck them in with a blanket of mulch, approximately four inches deep – but don’t mulch
all the way up to the trunk of trees. Creating a mulch volcano with a tree sticking out of it like a sacrificial offering in one way to offer your plant to the vole gods, who relish having a cover to hide under when gnawing on the bark. Instead, take the mulch away from the trunk about 12-inches, then create a mulch ring around the plant. When: Water once per month now through March if we don’t get an inch of water through snow or rain. Make it easy: Measure snowfall at your house with a ruler; don’t rely on total accumulation listed in the news. Write each storm’s amount on your calendar and add it up every four weeks. If it’s less than 12 inches of snow, it’s time to water. How: Warm days when temperatures are above 40 are best for watering. Choose days when no snow is on the ground and the soil isn’t frozen. In cold weather, water should be trickled
slowly into the soil. Make it easy: Coil a soaker hose so that it spirals out from around the tree and leave it there for use over the next few months. Long hoses can be used to water several trees of the same size at the same time. Have an inexpensive timer on the faucet automatically shut off the hoses, or set timers in the house to remind you to turn off water. How much: Researchers are still working on this, but a good rule of thumb is to give your trees 10 gallons of water per diameter inch of trunk for them to survive. Carol A. Make your mantels merry and bright By Katie Laughridge Tribune News Service
Now that the weather is starting to turn crisp and is soon to be cold in Kansas City, I can begin daydreaming about warming my hands on a cup of tea and my feet by the fireplace. After a busy day of work for my husband and me – and a busy day of preschool for my 3-year-old – it is nice to have a spot to regroup and spend a few moments together. With so much cozy family time spent around the hearth, especially during the colder months, I think it’s lovely to have your mantel be a focal point in the home all season long. Recently I was at Mary Carol’s guest cottage and her mantel is – unsurprisingly beautifully decorated. She has the gift of simplistic elegance that is truly eye-catching without being overwhelming. Her mantel is a great example of using varying heights and asymmetrical balance to create a captivating design. Not one to repeat an item, she uses different art pieces, plates, lamps, books and jars to create a display full of texture and depth without overdoing it with color. While simplistic at first glance, the more you admire it the more you can see the thought and balance that went into creating the dynamic display. When it comes to holiday cheer, there are a
few ways to approach a mantel display. There is subtle Christmas, and then there is what I can only describe as a “holiday explosion.” Both are looks I enjoy and admire. For a fuss-free approach, I like the look we created at our designer Anne’s home. We used a healthy amount of greenery with pinecones to provide a natural base for her mantel. She has a lot of wooden accents and natural materials throughout her home, as well as a stunning large-scale piece of art we wanted to include. We introduced boxwood wreaths to help bridge the gap between her tall art and the greenery and brought in a wooden lantern. We added more Christmas cheer by including Santa in the mix as well. The best thing about the display is its versatility. By switching out a few elements (like the Santa) the display could be used for Thanksgiving as well as a generic winter design once Christmas has passed. Now for our “holiday explosion” decorators. One of our signature over-the-fireplace tricks is layering a mirror with a fun detail like a wreath or bust. This year we are showcasing a deer bust that has hipster flair like none I have ever seen. It is a show-stopping accent that doesn’t take itself too seriously, which we paired with traditional greenery to help soften.
