Are neighbors crossing the line on fence? Q: My neighbor attached bolts into my fence to secure some items in his yard. I am concerned that this will damage my fence, especially if there is a storm. I asked BY GARY M. him to remove it, SINGER but he blew me Sun Sentinel off. What can I do? – Jonathan Q: My neighbor’s overgrown vines are destroying my fence. I asked them to trim them back and only get lip service. The vines remain and are getting worse. What are my rights? – Mary A: Sometimes, neighbors will build and maintain a shared fence together. In your case, you put up the fence yourself and have no deal with your neighbor for them to help maintain it. Your neighbor does not have any right to attach anything to your fence unless you let them. If they damage your fence, they will be responsible for paying for the repairs. Since you want them to remove the attachments altogether, you both already took the first step of speaking to them. The next step is sending a polite and professional certified letter, even though you live next door. You can trim any vegetation that is on your side of the fence as long as it does not permanently damage the plant. You should not

reach over the fence to remove the plants or hardware, even if you believe the fence is on your side of the line. To get them to remove the unwanted items from their side of your fence, you will need to file a lawsuit asking for an order making them remove their plants and attachments from your fence. Having a survey that shows the fence is fully on your property, along with proof you put up the fence, will go a long way to convincing the judge you are in the right. Gary M. Singer is a attorney

Caffeinate your sales price

It’s no secret: when searching for a new home, potential buyers want certain boxes checked, like number of bedrooms, school district and square BY SEAN footage. This 21st-century phenomenon, known as the Starbucks Effect, has a very real – and very positive – effect on home values, helping homeowners maximize their real estate investment when it’s time to sell. (Now, before you throw your artisanal Boulder latte in my face, know that I didn’t name this phenomenon). According to a Reuters interview with Stan Humphries, chief economist at Zillow, “Coffee houses emerged early on as a big predictor of future home value. Within a quarter mile,

close enough to smell the coffee brewing, that ring appreciates faster than rings further out.” Reuters goes on to state that Humphries’ data shows, “Over 17 years tabulated by Zillow, leading up to 2014, homes adjacent to the local Starbucks almost doubled in value, up by 96 percent. Those further out appreciated by 65 percent over the same period.” I’ll toast my Venti Frappuccino to that. But let it be known: not all java is created equal. Researchers at

Zillow compared listings near Starbucks storefronts to those near the more blue-collared Dunkin’ Donuts. Listings near Dunkin’ Donuts also outperformed the wider market, rising 80 percent over 17 years, but they fell behind properties that orbited a Starbucks storefront. And neighborhood gentrification doesn’t stop at coffee shops. Researchers have discovered that other storefronts can have an equally – if not more – powerful influence over real estate values. High-end specialty grocers, for example, can boost a home price by almost 18 percent, according to Johnson Economics, a west coast real-estate consultancy. Using this logic, the Starbucks Effect may have been more accurately coined the Whole Foods Effect. Of course, this whole scenario begs the chicken-or-the-egg question: Are coffee shops and high-end grocers actively boosting home values, or are the already popular chains choosing prime neighborhoods to land in, where

there’s already a real-estate upswing? Voted as one of America’s hottest up-and-coming coffee cultures by Expedia, Boulder boasts its fair share of caffeinated cafes, from the bustling and iconic Starbucks to the quieter momand-pop shop. Alongside our town’s penchant for percolation is our good taste in groceries. With a flagship Whole Foods, two Lucky’s Markets, Alfalfa’s and a host of others, it’s needless to say that our enjoyment of the finer things in life is having a positive effect on our real estate prices. Do people specifically search out neighborhoods containing a local coffee shop or grocer when looking for a home? If they don’t, maybe they should. Colorado ranks high for fun

BOULDER– Colorado ranked a respectable fifth in WalletHub’s analysis on states with the most fun, but locals would say endless BY TOM recreational KALINSKI opportunities make Colorado RE/MAX of Boulder tops year-round. Coloradoans have our own robust definition of fun. Inspired by the mountains and plenty of sunshine throughout the year, residents enjoy an exceptional outdoor lifestyle and recreation. All of that outdoor adventure makes us hungry for top-notch food and craft beer enjoyed on rooftop patios to keep the outdoor vibe going. “There are certain states where fun is not just an option, but also a way of life,” writes WalletHub in their report on the top states for fun. And that is the case in Colorado. Take for example the many gorgeous hikes close to our major metro areas. During these 4

mid-summer months, colorful wildflowers dot vistas that never end. Some favorite Boulder County wildflower hikes include Devils Thumb Lake, Gregory Canyon, and Mount Sanitas. And don’t forget, Crested Butte is the wildflower capital of the state. Of course, Colorado fun is punctuated by access to great skiing. Colorado took the No. 2 ranking for skiing facilities per capita, following top-rated Vermont, according to WalletHub. The report’s top states for skiing in the U.S. are: 1. Vermont 2. Colorado 3. A growing percentage of Americans have no emergency savings whatsoever By Amanda Dixon Bankrate.com Many of us would be at a loss if we were suddenly forced to replace a car engine or items lost in a house fire. Nearly three in 10 (28 percent) U.S. adults have no emergency savings, according to Bankrate’s latest Financial Security Index. One in four have a rainy day fund, but not enough money to cover three months’ worth of living expenses. Getting into the habit of regularly saving money is critical, experts say. If you’re making automatic contributions to a 401(k) plan at work, you might as well have a portion of each paycheck deposited into a vehicle such as a high-yield savings account. Unfortunately, it’ll take a lot more than that to solve the so-called savings crisis. Unprepared for a rainy day Just 18 percent of Americans say they could live off their savings for at least six months. That’s the lowest percentage of people with an adequate savings cushion in nine years of conducting Bankrate’s poll. Multiple factors have made it difficult to save for emergencies. “Household expenses have gone up and in many cases incomes haven’t kept pace,” says Greg McBride, CFA, Bankrate’s chief financial analyst. “So if you haven’t been adding to that savings, that and the regularity of unplanned expenses can easily chip away at what once was an adequate savings cushion.” Research, including a recent Bankrate study, also suggests that a growing number of workers have one or multiple side hustles. Achieving financial stability can be difficult when the need for your services as a consultant or freelance photographer can change from week to week. “If the demands aren’t really there, that really shifts a bunch of risk to the employee,” says John Thompson, chief program officer at the Financial Health Network, formerly known as the Center for Financial Services Innovation. “Do I know when I’m working? Do I know how many hours I’m going 6

to get, and then in turn what my income is going to be for this week or next week, or the week after? The employee is generally powerless against that kind of intelligence.” But Thompson notes that there is an income instability and predictability issue that’s present among different kinds of households and workers, not just tech workers in the gig economy. How much we should save for emergencies Though few respondents in the survey have six months’ worth of emergency savings, more than half (52 percent) say they need that much money readily available to feel comfortable about their financial situation. One in five say they would be comfortable with just three to five months’ worth of savings for a rainy day. How much you should save in order to be prepared for the unexpected varies depending on your personal circumstances and the kind of job you have. “There are instances where even a six month cushion is probably not enough, particularly those that are sole breadwinners or in business for themselves and those that have variable or unpredictable income,” McBride says. Noting the kinds of emergency expenses families might have to pay for, Bill Van Sant, senior vice president and managing director at Girard, a wealth advisory firm, recommends having enough cash to cover expenses for as many as 12 months. Rating the economy Compared to their poorer counterparts, wealthy Americans are more likely to have a sizable amount of emergency savings. Similarly, how the survey respondents feel about the economy depends in part on their own financial status. Nearly six in 10 adults believe the current economy is good (47 percent) or excellent (12 percent). That’s true for most (68 percent) of the highest earners. But among the poorest households, half describe the conditions as “not so good” or “poor.” “Lower-income Americans

and less-educated workers were really the final beneficiaries of the economic recovery,” McBride says. “It’s really only in the past two, three years that their situation has started to improve. But unfortunately, they’re also going to be the hardest hit and the first to be hit whenever the economy does take a downturn.” Perspectives vary widely based on political views, too. Republicans are significantly more likely to say that the economy is in good shape (77 percent say it’s “excellent” or “good”). Meanwhile, nearly half of Democrats (49 percent) describe the economy as “not so good” or “poor.” Predicting and preparing for the next recession Americans also disagree on how soon we’ll see the next recession. One in four (26 percent) believe it’ll be at least two years before the economy takes a turn for the worse. Younger millennials (29 percent) and Gen Xers (24 percent) are more likely to believe a recession has already begun. Baby boomers (34 percent) _ particularly the older members of the generation

– are more likely to believe the next recession is at least two years away. “Statistics have shown over time that those that start their careers during or shortly after a recession have a permanent hit to their earning capacity that stays with them for decades,” McBride says. Experts say we shouldn’t worry. McBride believes we’re more than 12 months away from another recession. In the meantime, he recommends paying down and consolidating debt, and locking in fixed rates. Build up your emergency fund and move cash into a high-yield CD or savings account. Protect your earning power as well, he says, by getting the latest professional certifications and ensuring you have the technological skills needed to remain competitive. If you’re preparing to head into retirement and concerned about signs of a future recession, reduce your equity exposure, says Van Sant from Girard. “Instant Offers” or iBuyers – What’s it all about? – Part 2 Zestimate?” From what I can tell, Zillow says no. If you get an offer from Zillow, check your Zestimate later and confirm this.

“Instant offer” or iBuyer programs – that are grabbing so much attention in the media – are based on the concept of a company BY DUANE buying a home DUGGAN directly from a home seller with Realtor and Author RE/MAX of Boulder a cash offer often without having to clean or stage your home. As I describe in Part 1 of this article, this concept is not new, as similar programs have been offered in the past. However, programs today are now backed by groups of investors and are rolled out on the Internet, so they are being implemented on a much larger scale. The attraction of these programs is the convenience of selling your home quickly through a simpler process without the usual issues of showing and staging the home. Yet as with anything else – like trading in your car for a new one – convenience comes at a cost. This is because when you list your home with a Realtor®, your home will be exposed to the open market and your home will sell for and net more for you than selling it to an iBuyer at a wholesale price. Who is offering iBuyer programs? iBuyer programs are currently being offered by companies such as Zillow, OfferPad, and Opendoor. Other companies such as Berkshire Hathaway, Realogy, and Keller Williams are jumping on the iBuyer bandwagon as well. 8

Where are these programs being offered? All of the companies providing “instant offer” or iBuyer programs initially tested out the concept in select markets and have expanded to most major markets. In many cases, there is a list of requirements a home needs to meet in order to qualify for the iBuyer purchase, such as age and maximum price range of the home. In the Boulder area, due to the age of our housing stock, many homes are eliminated from iBuyer program eligibility simply because they are too old. Also, most eligible homes have a maximum purchase price which is considerably lower than our average home price in Boulder. A newer home in Longmont under $600,000, for example, is much more likely to be an iBuyer candidate than a 5,000 square foot University Hill home in Boulder. How does a home seller get an iBuyer offer? On any of the “instant offer” or iBuyer websites, a prospective home seller can find an application and enter in the requested data about the home, such as number of bedrooms and bathrooms, square footage, renovations, plus upload photos of the home. Once the company receives the information, the application is reviewed, and an offer is made to the applicant. Merely completing the application does not commit the home seller to agreeing to the amount to being offered. The offer will likely include the opportunity for the iBuyer company to carry out an inspection to determine if any adjustments to the offer needs

to be made. The home seller can then accept or reject the offer and agree on a closing time. If you are a prospective home seller, the thing to keep in mind when you are reviewing an offer is that none of the iBuyer contracts I have seen use the standard Colorado Real Estate Commission approved contract to buy and sell. What this means is that the contract has been prepared by an attorney representing the iBuyer company. It would be prudent to have your own attorney, familiar with iBuying contracts, to review the document before you sign it. If you want to review a couple of iBuyer offers and compare them to offers you would get when using a Realtor or real estate agent, you can go to the Zavvie Offer Optimizer at zavvie.com. (As a side note, I have to laugh as I’m typing this article. I have never added so many new words, like Zavvie, to my dictionary.) Zavvie allows you to compare three offers: one from Zillow, one from Opendoor, and one when a real estate agent is assisting the sale. What are the costs of obtaining an iBuyer offer? This is where you want to review your documents carefully. Look first at the initial offer price, subtract any fees the iBuyer company is charging, less any allowance for repairs. In most cases, you won’t know the expense figure for repairs until an inspection is performed. Their cost for repairs may be more than what you would pay for a contractor. One of the questions I have had many people ask is, “Does the offer from Zillow change my

Once an iBuyer company owns a home, what happens? The home is typically placed on the market with a real estate agent who partners with the iBuyer company. It is placed on the open market for sale to the buying public. Overall, if market conditions allow the iBuyer company to make a profit, the iBuyer concept will continue in that market. If market conditions hinder profits, then the iBuyer company will either need to lower their offers or stop offering the program. Ripple effects of iBuyer programs There are already a couple of practical issues emerging when it comes to iBuyer programs. The first is that when the iBuyer company bought a home sold at a lower price, it is being used as a comparable for other homeowners trying to get their homes appraised on open market sales. The appraisal industry will have to decide if the comparable sale will be considered a distressed sale and not used in an appraisal, or if an adjustment can be made. The second issue is the effect of iBuyer closed sales on assessments for property tax. The assessor, like the appraisers, will need to decide how to treat those sales. The real estate industry is changing rapidly. Be sure to consult your Realtor to discuss the advantages and disadvantages of the “instant offer” or iBuyer process. Inspect your own home Just because you aren’t buying a home doesn’t mean you can’t be on the lookout for issues and address them when BY RICK necessary. If you are seeing any water damage or even discolored spots in your walls, ceiling, or flooring, you should take that as a sign of caution. Any visible water damage could mean serious problems within the walls, and even with your insulation. If you see any damage, you should have the area tested for mold. As you do this “self” home inspection, these DIY guidelines will help ensure that your house is safe. If you hire a home inspector after your inspection, make sure to walk through the inspection you have done with them. They may be able to uncover more than your initial inspection did. YOUR BERRY OWN HOME Advocating fiercely for clients and making home ownership attainable for Community MVPs

or nearly a decade, Heather Berry of Your Berry Own Home, powered by LoKation Real Estate, has been helping teachers, nurses, firefighters, police officers, veterans and other community standouts move into their “Berry Own Home,” as she likes to say. Berry explained, “My Community MVP program serves those who are the lifeblood of our community, people who don’t feel like heroes but are out there every day doing great things.” She donates at least 30 percent of her commission to qualifying MVPs, enabling some of her clients to settle into a stable home with little to no closing costs. She has given back over $40,000 to the community over the past two years. Essential support for Community MVPs “My eye opener was a teacher who taught for about 26 years 12

and had gone through a bad time personally, but she couldn’t move because she couldn’t afford it,” Berry said. “Our Community MVP program allowed her to get in her first home with $1,000 of her own money. Here she was, teaching our children (our future) and was struggling to buy her own home. I was going to do whatever necessary to get this woman a house.” That teacher, Nicole Bredl, recalled, “It was a pleasure working with Heather! It was a very positive experience from start to finish. The Community MVP Program and Heather’s donation through that program made it possible for my daughter and I to get out of the expensive rent ‘trap’ that we’ve been in for too long. I will forever be grateful to her for that!” Berry said, “It means the world to me that I can help these outstanding community leaders. Seeing how happy I made Nicole made me want to do it again and again. She cried, I cried, it was a beautiful thing.”

Another teacher Berry helped through her MVP program, Tasia Vander Vegt, a college instructor in Denver, added, “Working with Heather is great because she is trustworthy and always demonstrates that she has her client’s best interest in mind.” A rare knowledge of northern Colorado, devotion to clients Berry’s heart is in Boulder County, as she relocated to a farm in Longmont from Kansas as a girl in 1978 and attended schools in Longmont and Lyons. “Longmont is where I grew up. It’s where I raised my family. I love the culture and love having my office downtown.” Today Berry and her family are “Longmont car people,” she said, and frequently drive their “baby blue” 1951 Ford Coupe Deluxe in cruises benefiting the community. They are also members of the Dodge Challenger Club where they participate in many charitable events. “I remember when Main Street was a mecca for cruising,” she said with

a laugh. Her love of place pours into her real estate practice, through which she empowers families throughout northeastern Colorado “to buy and sell in a way that suits them,” she said. “I am very transparent. I let people know what works, what doesn’t, how long or short the process might take. Most of my clients come to me through referrals, and I am thankful people know I’ll talk straight with them.” Berry’s straight talk and refreshing honesty were cultivated on the other side of the housing market. After working as a paralegal for years, she represented two iconic brands, Maytag and Electrolux, in the appliance industry, during which time she absorbed almost everything there is to know about appliances, kitchen and bath design and even which home styles best suit specific cooking preferences. “It was a joy to work with builders, designers and architects, and I wanted to help others find a home they love with the look and features they’re passionate about,” she said. “My experience means I can help advise clients on which appliances they can purchase to increase their home value and enhance their own culinary style.” Berry’s commitment to her clients is fierce. “My clients are like my babies,” she said. “I’ll drive them to multiple houses and think about what they need nonstop.” She thrives on analysis and number crunching. “I love doing research, investigating an area and becoming a resource for my clients,” she said. “Heather Berry drove me from Bailey to Estes Park to Wiggins and Fort Morgan...Aurora and up towards Greeley searching for a home for me without even flinching at the drive times. Should I get gutter guards?

By Paul F. P. Pogue Angie’s List If you’re sick and tired of climbing a ladder to scoop leaves out of gutters, gutter guards and covers may be an answer. However, they’re not a replacement for regular gutter cleaning. Gutter guards and covers are essentially designed to act as a filter over your gutters in an attempt to block debris from entering your gutter without inhibiting the gutter’s ability to draw water away from the roof. Although these additions are often advertised as a cure-all solution to cleaning your gutters, many models may only block larger debris, while allowing smaller debris to enter the gutters despite the shield. Fall leaves and spring flower petals, seed pods and buds can still block up your gutters over time. Clogged gutters can damage your fascia, eaves, roof and foundations, so this is an important decision. Gutter guards can be purchased in a variety of categories, including screens, inserts and reserve curves.

The type you need will depend on your home’s location, as certain types of gutter guards are better in different circumstances. What you should expect to pay for gutter guard installation will depend on the length of your gutters and the type of guards you need to purchase. Gutter guards and covers cost between $.40 and $10 per foot. You can expect installation to cost $9 per foot on average, but this will vary widely. Certain installation methods take more time. Snap-on guards go in quickly, while screws and bolts add to the installation time and cost. If you have a steeply pitched roof or multiple rooflines, the job

will require more time and cost. Although having gutter guards and hoods dramatically reduces the number of times you will have to clean out your gutters, it doesn’t necessarily mean that you won’t ever have to do the work. Experts recommend cleaning your gutters at least once every two years, even with gutter guards and hoods installed. Here’s a look at the pros and cons of different gutter guards, and their material cost: Metal mesh screens: These sheets of metal have holes punched through them and stop most debris. Anything smaller than the holes will still get through. They cost $1.20-$4 per foot.

Micro mesh screens: These steel or aluminum frames are covered with fine wire mesh. It’s one of the most effective options, but the material cost around $9 per foot. Plastic or vinyl grid screens: These are not as durable as metal guards, but they’re among the cheapest, at $.40 to $4 per foot. Full surface tension covers: These solid pieces allow water to flow into a gap between the guard and gutter. Debris flows off the edge. They’re effective, but cost between $4 and $8 per foot. Gutter brushes: Long rolls of brush inside the tray allow water to pass through but block leaves. They do need to be periodically cleaned. They cost about $4 per foot. Foam inserts: These fit inside the trough and allow water to pass through while leaves get washed off. They cost about $2 per foot, but are far less durable than other options. Paul F. P. Unlike decorating and interior design, the intent and purpose of home staging is to use "lifestyle" selling techniques in order to allow a potential buyer to be able to envision themselves in a home. Gone should be personal photographs and unique color schemes, instead the approach should be one of neutrality in order to ensure your property appeals to the largest amount of potential buyers. Want some insider tips? Here are some staging secrets. 1. Research. One of the biggest mistakes home sellers make is underestimating their competition. Ask yourself "Who will buy this house?" From here, it is important to present your home in its best possible light. Remember once a property is placed on the market it is no longer your home, but a product on the market for sale that will be compared with other products.

2. Paint! If you do nothing to your home to prepare it for sale, be sure to paint. From painting walls a neutral color to covering up marks and scuffs, a fresh coat of paint can go a long way. 3. Do minor repairs. From re-caulking a bathroom to repairing a broken railing or step. Even small repairs may trigger a potential buyer to believe that your home is in poor condition. 4. Purge! The first aspect relating to preparing a property for sale relates to the removal of all excess, from extra furniture to clothing, now is the time to make your home feel as spacious as possible. 5. Create a basic marketing plan. A seller may need their real estate agents help with this one. The goal of this step is to simply decide who your target buyer is, as in some cases this may influence the staging process. 6. De-personalize. When a potential buyer walks into a property it is important for them to feel that it could be their home. Everything from personal photos to religious references should be

removed. 7. Neutralize. Even something as simple as repainting or replacing carpeting can be a deterrent for potential buyers. Taupes and grays are ideal colors to create a neutral, soothing color palette. 8. Return a room to its intended use. For example, a bedroom currently used as a home office, must be staged and styled as a bedroom. 9. Create a timeline. When you place your property on the market can be critical in capturing the most amount of potential buyers. Earlier in the selling season is best. 10. Hire a professional stager. When it comes to what is for most Americans their single biggest asset you are going to want to trust the staging of your home to a professional. One can begin by researching local staging companies, some may specialize in a specific style or geographic area.
