When I first started selling real estate in 1978, the contract to purchase a home a home was only one page long. BY DUANE Now in 2019, the contract DUGGAN to purchase a Realtor and Author home has grown RE/MAX of Boulder to 14 pages, plus multiple pages of disclosures, approaching 30 pages total. I have watched the contract grow, a few clauses at a time, over the last 40 years. In the past, contracts were updated as often as once a year. Now, they are usually updated every two years, unless there is a Federal or Colorado legislative mandatory update. This year is one of the mandatory legislative update years. On March 6, 2019, the Colorado Association of Realtors® (CAR) announced that Governor Jared Polis signed House Bill19-1098, known as the “Deeds to Convey Real Property Bill” into law. Several members and representatives of CAR, including CAR Chair Justin Knoll and CAR General Legal Counsel Scott Petersen, were on hand for the signing. There were many industry stakeholders such as title companies, attorneys and lenders involved in developing this bill. CAR worked with them to develop the bill for the benefit of all. According to the announcement

from CAR, the common-sense solutions in the legislation will: •

Reduce confusion and lessen disputes arising from the current contract form to transfer real property Ensure a clear public record of the real estate transaction

What the Bill does: •

Authorizes a title company to prepare a deed using one of the forms of statutory deed established by this legislation Fairly and reasonably balances the risks between the seller, buyer and title company

The good news is that the legislation only requires a change to Section 13 of the Colorado Standard Contract to Buy and Sell. Section 13 is known as the Transfer of Title Section. This is as a result of the passing of House Bill-19-1098 by the Colorado Legislature, which passed unanimously. The new statute says that if title transfers via General Warranty deed, title will be transferred “subject to statutory exceptions,” which are defined in the Colorado Revised Statutes 38-30-113(5)(a). The passage of this bill means the contracts will change and will be mandatory on July 1, 2019. In the past, the default deed in the section was a General Warranty deed. Now, the default

deed is a Special Warranty Deed. There are check boxes for the other types of deeds that might be used. Home buyers and sellers can discuss this further with their attorney, Realtor® and title company if there is a reason to use a deed other than the default Special Warranty deed. In addition, House Bill 19-1098 clears up a longstanding problem concerning the authority to draft deeds conveying real property in a transaction. Previously, a licensed real estate broker could prepare a deed, but the broker could delegate the limited authority to the title company as the broker’s scrivener. This legislation gives the title company the authority to prepare the deeds, without being the broker’s scrivener. The key point to remember is that in less than a month, on July 1, 2019, the new contracts will be mandatory for licensed agents to use. Case-Shiller: U.S. home-price growth cools to slowest pace in 7 years By Deborah Kearns Bankrate.com Home-price growth is cooling, and that's good news for buyers. In fact, U.S. home prices rose by just 3.7 percent in March on an annualized basis, marking the 12th straight month of slowing price growth, according to the latest S&P CoreLogic Case-Shiller National Home Price Index. March's number is down from 3.9 percent in February and is the slowest pace of growth since September 2012 when real estate was swinging into recovery from the Great Recession. Average home prices for the top 10 metropolitan areas in the U.S. climbed 2.3 percent in March, down from the 2.5 percent growth recorded in February. On a yearover-year basis, the top 20 metro areas saw a gain of 2.7 percent, down from 3 percent in February, according to the index. The moderation in price

With mortgage rates continuing to fall, along with slower homeprice growth, homebuyers have more of an incentive to get off the sidelines this spring. National mortgage rates for the 30-year fixed loan are averaging 4.27 percent, according to Bankrate's latest analysis. "This should help to take the cold edge off what has otherwise been a market slow to thaw from the winter months," McLaughlin wrote. Most of the metro areas seeing the biggest declines in price growth are in the West, including Seattle (11.4 percent), San Francisco (9.9 percent) and Los Angeles (6.7 percent). Meanwhile, some markets saw their highest year-over-year annual price increases, including Las Vegas (8.2 percent), Phoenix (6.1 percent) and Tampa (5.3 percent). Home improvements with best ROI

Not all home improvements are equal when it comes to recovering the costs of the job. In Colorado and its fellow Mountain Region states, BY TOM homeowners KALINSKI recoup RE/MAX of Boulder considerably more of their costs for some projects than others, according to the Remodeling 2019 Cost vs. Value Report (costvsvalue.com). Produced by Remodeling Magazine, the report provides an in-depth look at the return on investment (ROI) of common remodeling projects. This year’s analysis compares average costs for 22 remodeling projects with the value those projects retain at resale in 136 U.S. markets. Across the Mountain region states of Colorado, Utah, Arizona, New Mexico, Idaho and Montana, the highest return for upscale homes – 98.6 percent – comes

from replacing the garage door. For midrange homes, the top return is 96.5 percent for manufactured stone veneer. The lowest ROI projects for an upscale and midrange home in the Mountain region, respectively, are a master suite addition – 48 percent – and a universal design bathroom remodel – 55 percent. Here are the remodeling projects that topped this year’s report with the Mountain Region’s best ROI. Garage door replacement You’ve probably noticed that a stylish, new garage door makes a home pop with curb appeal. That’s probably why this $3,550 investment returns 98.6 percent or an estimated $3,502. The project analyzed is for the removal and replacement of a 16x7-foot garage door and tracks. The new door has a lifetime warranty, is made with high-tensile-strength steel with two coats of factory-applied paint, is foam insulated to minimum R-12, and ruses the existing motorized opener. Windows in top panel are ½-inch insulated glass.

The project analyzed included installing new shaker-style wood panels and new hardware on cabinet and drawer fronts, replacing the cooktop, oven range and refrigerator, and putting in new laminate countertops and resilient flooring. Project cost is $21,726 and returns $17,349. Siding replacement New siding adds new life to a home and returns 75 percent of the money spent to do the job. Though it may seem mundane, fresh siding make your entire home feel new. Project cost is $15,317 for 1,250 square feet, and returns an estimated $11,545. Rounding out home

improvements that return above 60 percent are deck addition (wood) 74.3 percent; window replacement (vinyl) 71.3 percent; grand entrance (fiberglass) 71 percent; deck addition (composite), 66.5 percent; roofing replacement (asphalt shingles), 65.6 percent; entry door replacement (steel) 64.2 percent; bathroom remodel, 61.9 percent; major kitchen remodel (midrange homes), 60.6 percent; and roofing replacement (metal), 60.1 percent. Whether you live in a warm climate year-round or an area where you see a change of seasons, these maintenance items should make it onto your summer checklist. Replace windows While this may sound like a winter checklist item, proper windows and doors can be just as important in the summer, when looking to keep hot temperatures out and cool temperatures in. Plant a garden There is nothing quite as wonderful as growing your own vegetables. Landscape cleanup Typically fall, late spring or early summer are ideal times for a cleanup and sprucing of items such as mulching and weeding. Add additional lighting Although the days are longer in the summer, lighting is still just as important as children and adults extend outdoor activities.

How should I pressure wash my house?

By Paul F. P. Pogue Angie's List Pressure washing offers a great way to quickly blast dirt and grime from exterior surfaces like driveways and decks, quickly and efficiently freshening up the surface.

Pressure washing basically uses a water pump and electric or gasoline motor to power a high-pressure hose and sprayer to generate an extremely powerful spray. In some cases, detergents or other chemicals are used to enhance the effect. Sometimes, the term is used interchangeably with "power washing," but they're not quite the same thing. They use very similar tools, but power washers also heat up the water to loosen up dirt or grease. You should take great care when it comes to both pressure washing and power washing, as both require the use of potent tools typically best left to the professionals. Hiring a power washing service On average, you can expect to pay between $180 and $380 for a pressure washing job. When you hire a pressure washing or power washing service, make sure they're up to date on EPA regulations regarding runoff water and environmentally safe chemicals. Also, be sure they have experience

with the type of house you have and verify that they carry their own insurance to cover any damage to your home that may occur. Most professionals suggest you avoid power washing siding. Siding is particularly vulnerable to damage, and the vents in most siding can allow water to get caught in between the siding and the home, causing wood rot. This is a case where it's best to rely on a professional who has the expertise to use the right pressure settings and who can identify whether your siding will be easily damaged. If your house's exterior contains lead paint, the work needs to be done by an EPA-certified specialist who can safely wash the exterior without contaminating the nearby area. Doing it yourself If you do decide to rent a pressure or power washer and do the job yourself, take care to do it correctly and safely. A rental washer will generally cost you between $40 and $75 per day. You

can buy your own electric model for between $70 and $200, while a more powerful gas model ranges between $300 and $1,000. Protect your face with safety goggles or a face shield. And, before you use the washer, inspect it for damage such as cracked hoses, broken seals or rusty nozzles. Read the instructions carefully, and follow them. Familiarize yourself with the various power settings; in many cases, more power is not necessarily better, and it can make damage more likely. Treat the washer itself with proper respect. The stream can strip skin from the body, so never aim it at another person, and make sure the area is well clear of bystanders while you work. Take special care to protect your doors, windows and plants from the stream. A pressure washer can break glass and even doors. Paul F. P. Electricity demand can get so high that it triggers power outages, according to Edison International, one of the nation's largest utilities distributors. Talk about sweating. You can't control the temperature outside, but there are things you can do to make your house cooler and minimize air conditioning costs. Use these tips to save money and beat the heat. Plant trees around your house "Most heat that accumulates inside a house comes directly from the sun shining onto the roof or through windows, and heating the house directly," says John Krigger, founder and president of Saturn Resource Management in Helena, Montana. Krigger, an energy conservation specialist, writes books, lectures and trains others in energy conservation for buildings. Planting leafy trees around the outside of your home will help block the sun and cool your house. "Even for the cost of going to the nursery and buying a 15- to 20-foot-tall tree, trees are still the best value," Krigger says. Using trees or shrubs to shade your air conditioner can increase its efficiency by up to 10 percent, according to the U.S. Department of Energy. Clothe your windows During cool seasons, about 76 percent of sunlight on windows enters in the form of heat, according to the U.S. Department of Energy. Solar screens, or meshlike window screens, can intercept this energy before it gets into the house. Window screens are particularly effective on east- and west-facing windows. Window films are another option. They are transparent, metalized sheets that reflect heat before it can be transmitted through glass. However, windows must be shut 14

for window films to work, while solar screens do double duty, keeping sun and insects out, even with the windows open. Flip a switch Try to raise your air conditioner's thermostat setting to 78 degrees Fahrenheit when you're at home, and at a higher temperature while you're at work. You can save as much as 10 percent on your power bills by raising the temperature setting on your thermostat when you're not home, says the U.S. Department of Energy. Some people might forget to raise their air conditioner before they leave for the day – this can be a frustrating realization while at work. Programmable thermostats can be put on a set schedule to adjust the temperature for certain hours each day of the week. That way, you'll never leave the air conditioner running on high when it doesn't need to be – and you might save some money on your energy bill as a result. Run some fans If possible, operate fans on your home's upper level and open the windows on a lower level. If you live in a one-story house or apartment, close windows near the fan and open windows in rooms far from the fan, preferably on your home's windward side, the U.S. Department of Energy advises. Krigger says the key is to

circulate air inside the house. Moving air also helps evaporate the sweat from your skin, says Paul Scheckel, author of "The Home Energy Diet." "Evaporational cooling is an incredibly efficient process for removing heat, and our bodies do it all by themselves. A little help can increase the cooling effect," Scheckel says. Chill in the basement Camp out in your basement, advises Stan Cox, a scientist, environmental writer and author of "Losing Our Cool: Uncomfortable Truths about Our Air-Conditioned World (and Finding New Ways to Get Through the Summer)." In your eco-cooled basement, a TV, a couch and a cold drink may be all you need. Scheckel warns against opening basement windows when outdoor air is heavy with humidity. "Warm, moist air will cause condensation on cool surfaces such as basement walls, ultimately increasing the humidity in your home," Scheckel says. Avoid using the stove and oven Don't cook on the stovetop or use your oven during hot spells. Reduce indoor heat by cooking in the microwave, firing up the outdoor grill or eating cooler foods, such as salads and fruit. If you must bake lasagna for

"Keep the filter clean to allow for good air movement and keep the unit level so the condensation drains properly." You can cut your energy costs in half by swapping your older air conditioner for a newer, more efficient unit. Look for a high energy efficiency ratio, or EER, or an Energy Star-qualified unit. Higher EER ratings indicate a more efficient air conditioner. Energy Star is a system used by the U.S. government to designate energy-efficient products. Let humidity dictate cooling settings Put the air-conditioner fan speed on high, except on very humid days, according to the U.S. Department of Energy. On humid days, put the fan speed on low. The slower air movement through the air-conditioning equipment removes more moisture from the air, improving comfort in your home. Splash in the bath Step in the shower, hop in a pool, spray yourself with a water bottle or use a cool cloth on the back of your neck. If you don't chill out right away, don't give up. Pre-drywall inspection

Are you having a brand new house built? If so, a pre-drywall inspection is a smart move. When you decide to BY RICK have a house built there are JACQUEMARD Flatirons Home multiple stages Inspections in the building process, some that seem to take an eternity and some that fly by. One of the most important stages in new construction for the home buyer is just before the installation of the drywall. At this point in construction the house is about to turn from a “not too hard to change things situation” to an “it’s going to cost you to change things situation.” Hiring an inspector for a pre-drywall inspection can help keep things in the not too hard to change category. Predrywall inspections generally cost significantly less than full home inspections and some Realtors will cover the cost of this service.

Some of the items an inspector might look at during a pre-drywall inspection include but are not limited to: Is the framing square? Is the framing plumb? Are drywall shims in place where necessary? Are there strap ties in place where required? Does the plumbing and electrical lines have nail protection plates? Are hurricane clips installed? Are the HVAC joints taped? Is insulation installed correctly? Depending on the type of construction and the location of the property there may be several

others. Don’t be afraid to offend the builder, any reputable builder will have no problem in fact most welcome it. This is a great opportunity to have a trained set of eyes check for problems, miscues and mistakes before they get covered up and it’s too late. Homes are built by many different contractors, plumbers, electricians, drywall installers, framers and painters – any one of them could have had an off day. You should make sure you don’t end up

paying for it later. Many people ask why hire an inspector if the county/city inspector has already inspected the house. The answer is, the county/city inspector is there to insure the house meets code, your inspector works for you. After receiving your pre-drywall inspection report it is a good idea to have your real estate agent arrange a walk-through with the builder or site superintendent so that all parties can agree on how to proceed. This is also the time to see if you can add items you may have missed during design meetings. For example, adding an electrical outlet in the floor of a living room for a reading light. Take pictures or video during your walk-through so you know what is behind the walls should you decide to change or add something in the years to come.
