It can be challenging to stay up to date with property taxes, especially if you reside in a high cost of living area. If you’re working with a limited or fixed income and are interested in finding out more about this program, we share the details here. Benefits of the tax deferral program Boulder and the surrounding areas have higher-than-average property taxes. As property values continue to rise, many senior citizens are looking for a way to ease the financial burden. Luckily, the senior property tax deferral program can provide relief for qualified individuals. While this program doesn’t eliminate property taxes, it allows the homeowner to delay tax payments until the sale of the residence or
settlement of the estate. If you’re eligible for the tax deferral, you have the option of postponing the entire value of the taxes, or choosing to pay half of the total. However, it’s crucial to keep in mind that interest is charged each year that you defer payments. For 2018, the interest rate is 2.25 percent. Eligibility requirements To qualify for the senior property tax deferral program, you must fulfill the following criterion: • On or before January 1st of this year, you should be at least 65 years of age. • You must be the trustee and beneficiary if the property is in a trust. • You may not use the property to earn income. • The property must be your primary place of residence. • Your property taxes must not be delinquent at the time of your application. Additional details If you’re thinking about applying for the senior property tax deferral program, there are a few additional details you should note before beginning the process. In most cases, your application won’t be approved if you have a
reverse mortgage. However, you may be able to come to a solution with your lender if they agree to subordinate. To proceed, you’ll need to request an application or get in touch with the Treasurer’s Office. Before you begin your application, be sure to have the following information on hand: • Your full, legal name • The name of the trust, if applicable • Your date of birth • The address of the property • Your current phone number • The name of your lender • The current balance of your mortgage Applying for the senior property tax deferral program may help ease financial burden and stress for those aged 65 or over. Despite monthly swings, Boulder County home sales hold a strong course If there is one constant in Boulder Valley, it’s a strong real estate market. last year – 3,880 vs. 3,881. “It’s hard to characterize our market here in Boulder County. Given all of the factors, it can be difficult to decipher trends as opposed to an event,” says Ken Hotard, senior vice president of public affairs for the Boulder Area Realtor® Association. “While the swings add volatility to the market, the market exhibits good health with strong demand, and prices and sales holding steady,” he says, adding that a strong economy and job growth continue to be drivers. County saw a month-over-month sales decrease of 5.2 percent, with 110 units sold in October compared to 116 in September. Year-to-date attached dwelling sales rose four percent through October – 1,317 vs. 1,266. October’s inventory for attached dwellings also increased 7.3 percent over September with 280 units available in October compared to 261 the prior month. Single-family home inventory declined 10 percent, with 945 homes available for sale in October compared to 1,050 in September 2018.

Here's how to prepare your home for winter

Here are some key tips to keep in mind. 1. Consider installing heat tape or using a heat tracing system. This can be critical in preventing freezing pipes in the case of a home that is seldom used such as a part-time or weekend residence. 2. Drain outdoor hoses and faucets. These should be winterized as soon as possible to prevent freezing. 3. Trim landscaping. This will help ensure a full, lush spring landscape. 4. Rake leaves. This is important in helping to maintain a lush, green lawn come spring. Leftbehind leaves will potentially corrode a lawn post snowfall. 5. Finish any outdoor repairs. 6. Replace or make sure windows and doors are airtight. Typically heat escapes through
windows and doors. 7. Check oil and gas levels. You will want to make sure heating sources such as oil and gas are replenished in case of power outages. 8. Trim large trees and branches. In instances of ice, large branches can cause a potential hazard should they break and fall. 9. Repair potholes and damage to driveways and sidewalks. Large holes and damage can be a potential tripping hazard or cause tire damage. 10. Check your furnace and hot water heater. These pieces of equipment are typically used to capacity in colder months and you will want to make sure they are in full working order. New Colorado real estate contracts coming January 2019 In Colorado, real estate brokers are not licensed to practice law and/or give legal advice. Yet licensed brokers can prepare contracts to BY DUANE buy and sell DUGGAN houses as a Realtor and Author daily course RE/MAX of Boulder of business. Colorado brokers are allowed to render services to real estate clients to a greater degree than in many states. This allowance dates back to the infamous (at least in the Colorado real estate industry) Conway-Bogue case. The bottom line of the decision was that brokers were allowed to work with contracts in real estate transactions without an attorney only if they filled in the blanks of standard and approved forms. Part of the issue back then, however, was that there were no defined standard and approved forms. The Conway-Bogue Case dates back to 1957, but it wasn’t until 1971 when the Colorado Real Estate Commission was directed to adopt Rule F by the Attorney General, to provide Real Estate Commission approved contracts and forms for brokers. When I first started selling real estate in 1978, the standard form to list a house was one page and the standard form to sell a house was one page. Now, 40 years later, the real estate industry has evolved, and legislative and economic conditions as well as lending rules have changed. I recently took the new contracts class for the forms that licensed brokers will be required to use on January 1, 2019. The body of the Contract to Buy and Sell Real Estate (Residential), printed out to 19 pages! Remember, in 1978, it was only ONE page. That doesn’t even count the multi-page additions of a variety of required disclosures. It seems like a lot! After four decades working in the real estate industry, the changes and additions each year never seemed like a lot to me. But now as I look back and see how those revisions have added up, I have to say, “WOW!” All of these updates to the contract come about from the Forms Committee of the Colorado November 23-24, 2018
Division of Real Estate. Some of the revisions are submitted because of new Federal or Colorado Legislation. Other edits and additions are introduced to solve problems that occurred because issues were not clarified. For example, the early one-page contract from the 1970s had no Inspection Provisions. Back in the “old days,” there was definitely the approach of Caveat Emptor or “buyer beware”. Now, looking at the 19-page contract we will be using starting on January 1, I can see how it is really is an amazing work of art. Having “grown up” seeing every single clause added to the contract for the past 40 years, I have an understanding of the situation that created the need for many of the new clauses. At the same time, it’s important to be aware that some new clauses are approved, but then are removed the following year because in practice, they didn’t really function the way the Forms Committee thought they would. The end result is that, in most cases, our Standard Real Estate Commission Form allows us to help buyers and sellers come to an agreement that results in a real estate closing where everyone is smiling. There are many changes to the 2019 contract. Some of them are merely “housekeeping” items or industry terminology changes, and others are more significant and adjust the normal course of business. To see them all, here’s the redline version of the Contract to Buy and Sell (Residential), which compares the contract we were using in 2018 to the new one for 2019, available on the Division of Real Estate website
at: https://drive.google.com/ file/d/14nlLsfNA4mzr7gAcWcDlzgRuhrXWFW_/view. A quick summary of the updates: • Many of the changes in the new contract are oneword updates. For example, the word “objection” was changed to “termination” numerous times. • In the personal property section, a reference is made to a new form, allowing for some personal property to be transferred outside of the contract. Resort brokers should like this addition as they often sell homes furnished down to the dishes and silverware. • The Loan Objection clause is changed to Loan Review and some of the provisions within it have changed. The Lender Property Requirements section has been clarified. • The Homeowner’s Association Section has been changed to match the current legislation. • The Off-Record Title section excludes any New Survey or Improvement Location Certificate. • There is new language on disclosing Adverse Material Facts that appear after contract, but before closing. • The Lead Based Paint Disclosure date is agreed
upon in the dates and deadlines instead of being at time of contract. • A Special Warranty Deed is now the default deed in the contract for conveyance of title. • There is a new section for FIRPTA and Colorado 2% Withholding. I found it entertaining that the new clause doesn’t say what FIRPTA stands for. You know though, right? It stands for Foreign Investment in Real Property Tax Act! • The Counter/Rejected box at the end of the contract has been removed. Again, this is just a quick summary of some of the revisions. Remember, Licensed Real Estate Brokers are only licensed to fill out standard forms, and are required to advise buyers and sellers to seek legal advice on any legal matters they do not understand. How to save money and keep your house warm this winter If you lower it to about 120 or 125 degrees, you'll reduce the amount of fuel needed. But you can follow some tips to keep your house warm and save energy at the same time. Make some basic changes Some of the most effective methods for warming up your house are the simplest. For example, open your
blinds in the morning to let in both light and heat during winter. Close them at night to prevent a chill from cold windows. Switch your ceiling fan so it runs clockwise at a low speed – the toggle should be on the side of the fan body. Since warm air tends to rise, this gently pushes heat down back into the living space. Save water heater energy usage Most water heaters are automatically set to 140 degrees.
Turn your home into an airtight space You spend a lot of time, money and energy warming up your home, so you don't want it to go to waste. Prevent warm air from slipping outside by creating a tight envelope. Replace, caulk or apply weather stripping to drafty windows and doors. Don't overlook air leaks from utility cut-throughs – the gaps that allow pipes into your home, as well as chimneys and recessed lights. A clear plastic sheet taped tightly to your window frames can stop air from escaping as well. Schedule an inspection with an insulation professional to make sure old and worn-out insulation isn't causing leaks. Check your ducts to make sure you don't have holes, which can seriously impact your bills.
Perform an energy audit A professional energy audit will teach you more than you ever imagined about your home's energy usage. The auditor will use a variety of tests, including a blower door and possibly infrared imaging, to identify air leakages, air infiltration, humidity levels and insulation efficiency. They'll offer recommendations to clear up air loss. The cost can range up to several hundred dollars, but the savings in energy over the months and years to come will more than recoup it. Maintain your hvac equipment Before the cold months begin, hire an HVAC service to inspect, clean and maintain your heating system. A good technician will tune up the system for peak performance, and they can also catch small problems before they become big problems that leave your family shivering in the middle of the night. Also, check and replace your HVAC filters once per month. A dirty filter makes your system work harder to generate the same amount of heat, so you're

with water so the tree does not dry out quickly. • Place all trees away from fireplaces, radiators and other heat sources. Make sure the tree does not block foot traffic or doorways. • Do not use more than three light sets on any one extension cord. Do not run cords under rugs, around furniture legs or across doorways. Before you string lights on your house or trees, inspect the strands, to make sure there aren’t any frayed cords or cracked bulbs. Also, don’t use indoor lights outside. Check the tag on the string of lights to be sure.
