Coronavirus and 1031 Exchanges A 1031 Exchange is a tax-deferred real estate transaction that “swaps” one investment property with another investment property under very strict IRS BY DUANE rules for the DUGGAN timeline and Realtor, RE/MAX of deadlines that structure the Boulder transaction. Today, stay-at-home orders have suspended in-person showings of properties, which makes it tough to identify a replacement property in a timely manner. This adds pressure on an Exchangor of real estate, who may have previously entered into an agreement to meet the date deadlines. When no extensions for deadlines granted last week, The National Association of REALTORS® (NAR) lobbied, and as of this week, deadline extensions have been granted for exchangers already in an Exchange Agreement. Remember, as with all issues dealing with COVID-19, changes can occur daily. Be sure to consult your REALTOR® and tax professional for any recent updates. What is a 1031 Exchange? A 1031 Exchange is a transaction in which the IRS allows you to sell a real estate investment and replace it with another, without paying capital gains tax on the gain of the first property at the time of sale. If you own investment real estate and want to continue to climb the investment ladder, the 1031 Exchange allows you to continue your investment in real estate, while deferring taxes on any gain, so that you can climb faster. This tax concept allows you to keep trading up without having to write a check to the government each time. Sometimes these exchanges are called “tax free” but they are actually tax deferred. Tax is finally paid when you no longer want to be a real estate investor and are ready to cash out. To qualify for a 1031 Exchange there are seven basic requirements. Requirements two through seven are unaffected by coronavirus restrictions, but the rule most affected is rule No. 1. General Rules for a 1031 Exchange 1. The current rule reads that upon closing the sale of the first property, the owner has 45 days to locate the exchange property and 180 days to close on it. Therefore, it is wise to talk with your CPA and your REALTOR® before selling and closing on your property. If 45 days after the closing of the sale of your old property you don’t have an exchange property
selected, your exchange will be disallowed, and tax will be due. Those 45 days can pass very quickly. 2. The “Like Kind” rule of section 1031 of the code states that the properties exchanged must be “like kind.” This simply means that the investment must continue in real estate. For example, if you own vacant land, you can exchange it for an improved income-producing property such as an apartment building or an office building. It doesn’t have to be a land-for-land exchange. 3. Must be qualifying property. Qualifying property is property held for investment or used in a taxpayer’s trade or business. 4. Any “boot” received will be taxable. Boot is any property which is not “like kind”. If the seller desires some cash or debt reduction, this is okay as long the seller realizes some tax will be due. You don’t want to receive any boot if you want the transaction to be 100% tax deferred. 5. A rule of thumb to defer taxes is to always replace the exchange property with one of equal or greater value and debt. 6. You should bring cash to the closing of the exchange property to cover charges, which are not transaction costs, such as utility escrows, rent pro-rations, etc. 7. An Exchange Intermediary must be used to hold the exchange funds from the closing of the old property. In the typical exchange you will be selling a property, which you have been holding for investment. According to the IRS rules you cannot touch the money that comes from the closing of your former property. You need to hire what is called an exchange intermediary. The intermediary will charge a fee for completing the exchange agreement
and all the necessary paperwork. The intermediary will hold your cash proceeds until you are ready to close on the replacement investment property. 1031 Exchange Dates Extension The National Association of REALTORS® (NAR) announced that the IRS has ruled that investors involved in a 1031 Exchange who need to either identify or close on a property between April 1 and July 15 will now have until July 15. This assumes that either of those dates fall between April 1 and July 15. But if an investor now has until July 15 to identify the property, the original 180-day closing date would likely remain since it falls outside the affected date ranges. If an investor is closing on the old property on June 1, and has 45 days to identify replacement property, the identification deadline is still July 15. Due to the unknown nature of the length of time of the no inperson showings and stay-at-home coronavirus rulings, these deadlines could change again. Colorado Economic Discussion: What We Know During COVID-19
Economic leaders are taking stock of the Colorado economy and BY TOM KALINSKI finding some hope among the Broker/Owner RE/MAX of Boulder negative impacts of COVID-19 and the resulting stay-at-home order. Data for March shows a steep downturn for the state’s economy, says Dr. Richard Wobbekind, senior economist and associate dean of CU Boulder Leeds Business Research Division. “In a presentation last year, I made the mistake of saying that the economy was on really sound footing and the only thing that could really affect us was a black swan event,” says Wobbekind in a recent virtual presentation. A “black swan event” is an unforeseen catastrophic occurrence that shuts down all of business very quickly, like the pandemic has done. It’s like a Katrina-level hurricane that hits the entire nation. “But unlike a natural disaster, our physical infrastructure and economy remain intact; the physical spaces are still there and do not need to be rebuilt,” explains Wobbekind. While it’s challenging to model this unprecedented event, CU-Boulder economists draw on extensive data
and key indicators to illustrate what has been learned so far, and where Colorado’s economy may be headed for the next couple of quarters. “We need to focus on how to keep business and government infrastructure in place to maximize recovery,” he says. Fortunately, Colorado entered the COVID-19 crisis with a strong economy. With a tight labor market, the state economy led the nation for growth and is No. 3 in the U.S. for jobs recovery since the Great Recession, reports Brian Lewandowski, executive director of CU Boulder Leeds Business Research Division. As recently as February, the unemployment rate was 2.5 percent, its lowest since the latter 1960s, notes Lewandowski. But then came the pandemic, which started a cascade of job losses. Initial statewide jobless claims spiked from below 3,000 to 60,784 claims for the week ending March 28. While the average salary in Colorado is $61,200, the hardest hit are in low wage jobs, especially in three industries that employ a large number of Coloradoans: -Retail trade, transportation (public and airline), utilities -Leisure and hospitality such as ski, golf, pro sports, performing arts, gaming, fitness, hotels, restaurants, bars

larger ticket items, interest rates are low. -Dramatic federal spending recently increased including the $2 trillion stimulus, which helps people in the short run although it adds to an already large federal deficit. -Unemployment payments have doubled. -Federal policies passed in the CARE Act help mitigate economic impacts. -Many Coloradoans are employed in business and professional services, which can be done remotely and are higher paying and strong in the long run. “The majority of Coloradoans still have their jobs and they tend to be higher paying jobs,” observes Lewandowski. Wobbekind points to expected demand that will spur spending when stay at home orders are lifted and the economy gets its footing. He anticipates seeing a recovery start in mid-May or June. But the situation is dramatically different than that of the Great Recession and depending on the coronavirus, the drop probably will not last as long. As Wobbekind looks at today’s forecasted gross domestic product (GDP) growth, he anticipates a 25-30% drop in the third quarter and growth in quarter four. In 2021 projected GDP growth is 3%. But he points out that China—with a COVID-19 timetable that precedes that of the U.S.—is already in recovery with a positive GDP projected in quarter two. If the U.S. were on China’s timetable, “our recovery would start in May, if we’re optimistic. But we’re not likely to be on as quick a recovery path as China,” says Wobbekind. While Colorado is overexposed to the downturn in some areas, the state is well-positioned in others: -Colorado’s rate of confirmed COVID-19 cases has slowed. -Consumer confidence is more optimistic than business confidence, which is the basis for consumer spending. -If people have the funds to purchase

Common Home Inspection Misconceptions After viewing multiple homes, you’ve found your dream house. You’ve been preapproved for financing and have plans to BY RICK make it look JACQUEMARD amazing. Now, Flatirons Home after some Inspections negotiating the seller has accepted your offer. The next step is the home inspection, one of the most important steps in the home buying process. Many buyers have some false assumptions about how the process works. The following are some of the most common misconceptions regarding home inspectors and home inspections. 1: Inspectors will find every little thing wrong with a home. As much as they wish they could, home inspectors simply cannot uncover everything that may be a problem. For instance, inspectors cannot see behind walls. Home inspectors are guests in the
seller’s home which limits what they can do. That said, home inspectors do use specialized tools such as gas leak detectors, moisture meters and radon detectors that allow them to gather more detailed information. Buyers need to be realistic about what they’ll learn from an inspection report. IE if you are buying a house in winter months the inspector will not be able to test airconditioning units or be able to inspect decks, patios, roofs or driveways if they are covered with snow. In summer months it may not be possible to determine exactly how efficient a heating system is. 2: Home inspectors can advise you whether to go ahead with the purchase. Inspectors can only tell you about the functionality and safety aspects of the house, not whether you should buy it. Even though most inspections are done at the buyer’s request, inspectors are impartial. 3: A home inspection is the same thing as a home appraisal. These are two completely different things. An appraisals function is to determine the value of a house on behalf of the lender. Home inspections are used to
determine the integrity and safety of the home. 4: You don’t need to attend the inspection. Buyers should attend a walk-through of the inspection with the inspector. It is not necessary to watch the inspector test every electrical outlet, door, window and appliance. However, inspectors can go into much more detail in person than in a report. You will also be able to ask questions. While it is true that an inspector cannot advise you to buy or not buy, they can give you maintenance tips and advice. 5: Brand-new homes don’t need inspections. Poor construction may lead to expensive repairs in the future, so even newly constructed homes should be inspected. With a house that’s already been lived in signs of leaks, settling, mold or other issues that occur over a period of time become obvious. In a brand-new house where the appliances, bathrooms, doors and windows etc. have not been used and issues may not be apparent. New homes should be inspected, even though they may be under warranty. 6: Home inspectors can predict the future. Inspectors can’t tell you when
items in a home will need to be repaired or replaced. A home inspection is like a snapshot in time in the life of a home. Inspectors can tell you how old certain appliances are and what the useful life of them may be. The cannot however, tell you when a furnace or water heater is going to fail or when a plumbing leak may happen. Buyers should understand that everything in the house will need to be replaced at some point. 7: A house will either pass or fail an inspection. Home inspection reports will never indicate whether a property passes or fails. What may be acceptable for one buyer could cause another to walk away. First time buyers may be less likely to go ahead with the purchase if an inspection reveals a lot of issues. However, some issues may be useful in purchase price negotiations. In the long run if buyers can live with the results of a home inspection that is all that matters. Home office So let’s start with that most critical and obvious space. Home offices have been an increasing trend and this moment may cement that as a “must have”. Fortunately, they can be quite small, but they do typically need a door (for acoustic privacy) and decent lighting. 2. Home investment For the last decade construction costs have been going up roughly 10% per year. With the shutdown, we may see a temporary flattening of these increases as contractors are suddenly hungry for work for the first time in ten years. But when the brakes come off the economy later this year, it will likely trigger a wave of
deferred construction projects, so if you want to lock in a contractor’s attention and better pricing, don’t delay in getting your project started. 3. Acoustic insulation Well built homes often have acoustic insulation (cotton or fiberglass) in the walls around bathrooms and bedrooms, and between floors of a home. Home gym While going for a bike ride or a jog around the neighborhood is great when the weather is nice, a home gym gives us the flexibility to work out anytime. Minimum typical size is that of a small bedroom, so in some cases it can come from space that you already have. Most importantly, make sure it’s a space that you want to be in, otherwise all that fancy equipment is going to get really lonely.

5. Mother-in-law suite/ADU Cities are relaxing rules for Accessory Dwelling Units, realizing that it is one of the most important tools for creating low-impact affordable housing, as well as increased cash flow and convenience for homeowners. During COVID, many families are suddenly having a multigenerational living experience. Maintaining privacy (with separate entrances and kitchens) by means of an ADU gives families greater flexibility and long-term social sustainability. Many of these ADU’s are also being created with “Universal design” principals in mind (handicapped accessible entrances, 3 ft. wide doorways, roll-in showers, etc.) so that our aging parents might have someplace to live. 6. Separate TV/game area Tired of hearing ‘Call of Duty’ explode in the background while hosting a Zoom call? Many households are creating kids TV/ game areas that can be closed off. One way to do this without adding yet more square footage is to give the kids what might have
been your media room, and make your great room into the main TV space. “But we don’t want the main social space to be visually dominated by a TV!” you protest. One solution is to disguise it with something like the Samsung Frame TV, which looks like framed art when not in use. Or, if you nest your TV into built-in casework, it tends to look discrete and integrated into the decor. 7. Food storage COVID created a newfound anxiety in many households about possible food shortages, so some are increasing the size of pantries and adding auxiliary fridges and freezers. Fridges use more electricity than any other appliance, so make sure they are Energy Star rated. 8. Multi-tasking spaces All these purpose-built spaces could quickly bloat the size of the house, which may not be possible. The “Not so Big House” movement recommends designing every space to do double duty. For example, use a Murphy bed, a fold-down table, built-in storage in a single room, instead
of a separate space for each. Even though custom-built furnishings can be expensive, they are much cheaper than extra square footage. 9. Breathe easy If you want to be sure that the air in your home is healthy you can add an advanced air filter to your forced air ductwork. Nearly all homes have a filter, but some are far more robust than others. The HEPA filter is able to screen out particles as small as a virus. You can also increase the amount of outdoor air that you are bringing into your home without ruining your energy-efficiency by utilizing an Energy-recovery ventilator (ERV). 10. Resiliency and Technology With increasing dependency on our electronic devices, many new homes and remodels are opting for battery back-up power. The Tesla Powerwall and other lithiumion based options range from $7K-50K depending on how much of your house you want to run and for how long. Most battery solutions can only support a home for a matter of hours, but that may be sufficient to get through
short power outages. Another upgrade is Cat5 or Cat6 wiring for optimal internet speeds. 11. Indoor/outdoor Our home has become our sanctuary and the outdoor spaces around our home may become more even more precious. You can cover porches and add misters to make them cool in the summer, and add radiant heat or firepits to keep them comfy when it’s nippy. Bonus idea—Build a moat. You may have become acutely aware of those home remodeling projects that you’ve put off. From repairs like fixing doors that don’t close right, to projects such as updating your olive green kitchen or adding square footage, now is the time to start planning.
