Beaver, wildlife rules appeal holds water with hearings board By JUSTIN BURNETT South Whidbey Record Island County’s 2014 beaver dam rules sprang a significant leak recently when a state regulatory board found they failed to protect critical areas as required by state law and were not based on best available science. The Growth Management Hearings Board for Western Washington issued the ruling late last month. It also identified six other failures

in the fish and wildlife habitat conservation areas update adopted by the Island County Commissioners this past September. The decision leaves the commissioners with a one-year deadline to bring the ordinance into compliance, and a local environmental group once again saying, “I told you so.” “I try not to, but you can see it 100 miles away … and here we are all over again,” said Marianne Edain.

Edain is the “brushfire” coordinator for Whidbey Environmental Action Network (or WEAN), a non-profit group with a mission to restore and preserve native biological diversity on Whidbey Island and in the Pacific Northwest. The group has repeatedly and successfully challenged county growth and development rules, such as its critical areas ordinances. The 2014 update itself was the result of an earlier hearings board decision in

which WEAN protested the county’s plan to complete the wildlife rules and comprehensive plan updates at the same time in 2016. The county was already years past a statemandated 2005 deadline and the hearings board upheld WEAN’s appeal that it be completed sooner rather than later. Congressman Rick Larsen visited county officials in Coupeville earlier this week to talk about transportation needs for the area.

Roads, bridges, highways, ferries — all are essential for the economic health of the state and Island County, and Congress needs to pass a long-term bill to pay for critical infrastructure, Congressman Rick Larsen told county officials this week. The Second District Democrat visited Coupeville Wednesday to talk with Island County leaders about transportation needs for the area and to tout a $478 billion, six-year transportation proposal floated by the

White House. The Grow America Act would provide more money and a steady source of revenue for highways, bridges, transit and rail systems. It’s paid for by supplementing revenue from the federal Highway Trust Fund and taxing corporate overseas profit. Larsen helped introduce the bill earlier this year. Commuters brace as Deception Pass bridge closure begins soon By JESSIE STENSLAND South Whidbey Record Deception Pass bridge will close to traffic for five consecutive nights beginning Sunday, July 12, according to the Washington State Department of Transportation. The closures are scheduled from 7:30 p.m. to 5:30 a.m. Meanwhile, the only other way to the mainland for commuters is the state ferry between Clinton and Mukilteo. Ferries Division announced the following extra sailings during the closure period, July 12-17: 9 p.m., 1:30, 2:30 and 3:30

a.m. leaving Clinton, and 9:30 p.m., 2, 3 and 4 a.m. departing from Mukilteo. Work on the bridge spans is weather dependent and the date could be pushed back due to rain or cool temperatures. If all goes well, the bridge paving should be done by Friday morning, July 17, according to the state agency. The bridge work is the last portion of a project to repave Highway 20, from Frostad Road on Whidbey Island to Sharpes Point on Fidalgo Island, which is about five miles. Contractor crews finished the roadway paving on June 23. Tom Pearce, spokesman

for the department of transportation, said the dates were chosen partly because the contractor wants to get the work done as soon as possible and has the necessary equipment reserved for that week. Also, the agency claimed that officials have been working with businesses and others for months to coordinate the closure. “We know closing the bridges for five nights will inconvenience some people, but this plan strikes a balance between the needs of drivers and the most efficient way to successfully complete this critical work,” Engineering Manager Jay Drye said.

Full closures are neces-

sary, the agency reported, because the bridge roadways are only 22 feet wide, which doesn’t provide enough room to accommodate construction equipment and traffic simultaneously. Ideally, asphalt should be replaced every 15 years. The asphalt on the Deception Pass and Canoe Pass bridges is about 20 years old, the agency reported.

In wake of inmate’s death, sheriff announces jail reforms By JESSIE STENSLAND, South Whidbey Record In response to a report on an inmate’s death, Island County Sheriff Mark Brown announced that he instituted immediate reforms to ensure the safety and health of people in the Island County jail. The sheriff also named an expert in jail management to review the policies and procedures at the jail. Results of that review are likely to be a couple of months away. Additional changes may be instituted after the full review. Brown said he was dedicated to transparency as the process of instituting changes continues. Brown said he opened a dialogue with other agencies to help with the reforms. The sheriff’s office is now working with Island County Human Services to review all mental health services to

inmates. Mental health professionals from the department will be available every weekday at the jail. They will have direct contact with inmates who express a need or exhibit mental health issues. The treatment will be comprehensive, according to Brown, and well documented. Health information will be shared with appropriate entities. Corrections staff members are authorized to transport inmates to the hospital emergency room or request 911 whenever they feel there is a need; approval from a supervisor is not required. Island County Health Department is reviewing all medical practices and treatments in the jail. Brown said all medical records received from other agencies and those generated in the jail will be copied

and forwarded to the next receiving facility, whether it’s a jail, prison or mental-health facility. Inmate health takes priority over other issues, Brown said, and corrections deputies can call a jail administrator at any time. The sheriff said he’s also moving forward with fixing the surveillance system in the jail. A replacement server was ordered to allow 16 current cameras to record. He is requesting 16 additional cameras to cover areas in the jail that aren’t currently being covered. He said he’s also ensuring that supervisors are reviewing safety cell logs every two hours, as policy dictates.

“Through these changes, we have already made substantial progress in improving our policies and procedures in keeping our inmates safe and healthy,” Brown said. “We will continue to keep the public informed as more changes are recommended and implemented.” Keaton Farris, a 25-yearold Lopez Island man and former Coupeville student, was suffering from mental

health issues and died in the jail from dehydration April 8. A detective’s report on the tragedy was released earlier this month. It describes how the jailers’ failure to follow basic policies led to the tragedy. Since then, the jail chief retired, the second-in-command supervisor was fired and two corrections deputies who falsified logs quit.

FREELAND Car crash closes East Harbor Road

CLARIFICATION

A one-car accident shut down East Harbor Road for more than an hour early Wednesday and knocked out power to a nearby home. The driver was identified by the Island County Sheriff’s Office as Freeland resident Newton Kellogg, 18. He was southbound in a 2003 Mazda MPV at about 5 a.m. when his vehicle veered off the road and struck a power pole. The vehicle also rolled and destroyed a fence. Kellogg was unharmed in the crash and declined to be taken to the hospital as a precautionary measure. “The driver was very lucky not to suffer any injuries from the incident,” said Paul Busch, assistant chief of South

appointments to the ethics board. The two candidates are Sharon Betcher and Monica Guzman. Already appointed are Bob Frause and Fred Herzon, whose confirmations came in April and May. The ethics board is, by city rule, supposed to have five members plus an alternate. Mayor Fred McCarthy has also enforced the idea of gender parity among the members and has sought three men and three women to serve. Another restriction is that the majority of its members must be residents of Langley, while the others must live within the South Whidbey boundary south of Classic Road. Marriage equality is the law of the land after the United States Supreme Court voted 5-4 in favor of allowing same-sex couples to wed across the nation. In Langley, a small celebration was held on the steps of the United Methodist Church the evening it was announced. Washington legislators already legalized same-sex marriage in 2012, and it was upheld by 53 percent of voters who approved Referendum 74.

Councilwoman lays out resignation criteria if husband elected mayor By BEN WATANABE South Whidbey Record Councilwoman Robin Black is willing to give up her seat if a particular mayoral candidate wins. That candidate is Tim Callison, her husband. Black announced her decision to submit a contingent resignation earlier this month after speaking about the issue with Callison. They checked the state’s laws and found no rule prohibiting a husband and wife from holding positions in government together, and Black said she did not believe there was an issue after reviewing the state’s Appearance of Fairness Doctrine. The situation is not in violation because they are both elected positions, and one does not work for the other. The council creates policy, which the mayor enforces and implements. Council members vote on resolutions, ordinances and other official city business. The mayor does not vote. In the letter she sent to Mayor Fred McCarthy on June 2, she said her resignation was contingent on three things. Her husband has to win the elections, and the ethics board and city council have to deem it necessary. “However, due to the questions that have arisen about conflict of interest and/or the appearance of fairness, if the Langley City Council and the Ethics Board (once in place) deem necessary, I am willing to step down from my coun-

cil position if Tim Callison is elected mayor of Langley.” While she refers to questions being raised over the husband and wife sitting in council chambers, no formal complaint was raised. McCarthy said he received only one communication questioning the impropriety of Black and Callison serving as elected officials together. One of Callison’s opponents said it would be a shame if Black had to resign. “… I feel like we do a disservice to lose Robin,” said Councilman Thomas Gill, who is running for mayor, in an email. “She has already done a significant amount of work in her short time on the council.” He noted, however, that the perception of a violation could exist if they met with another Langley elected official. The Open Public Meetings Act only governs a meeting of public agencies which have a quorum, or majority of voting members, when they discuss official government business. “Any sort of interaction that they would have with a council member could be seen as relating to the Open Meetings Act, if there’s any discussion of city business,” he said. Mayoral candidate Sharon Emerson said Black’s resignation should have only been contingent upon Callison’s election and not also upon a request from the ethics board and council. “Instead she wants another as yet non-existent body to

Editorial Letters Marriage equality is Response Great food truck, indeed a right under not so great story our great Constitution The United States Supreme Court has ruled on the matter of same-sex marriage, just in time for the annual celebration of America’s independence. It is a fitting time as we celebrate our Constitutional freedoms. By abolishing Don’t Ask, Don’t Tell in September 2011 and recognizing that gays and lesbians are valued members of our armed services, the federal government undoubtedly paved the way for acceptance of gay unions in a way previously unfathomable in this country. The decision also likely helped to shift the tide away from fear and lack of understanding to one of acceptance and empathy. It’s a world that’s much different from the one in which many of us were raised, in which gays were openly treated as inferior to the rest of the population. At one time in the notso-distant past, it was argued that gays serving in the military would somehow lead to a breakdown in morale and order. Now it’s understood that couldn’t be further from the truth. Gays and lesbians have served in the military with distinction and honor for decades, but only recently openly and without fear of being kicked out. Among those who blazed the path for gays to serve is Whidbey Island resident Trish Rose, who spoke in June at the Joint Base Lewis McChord Color Our World With Pride event in recognition of Gay Pride month. Rose is currently the highest ranking openly gay service member serving in the U.S. Military. A major general who serves as deputy chief of staff for Logistics, Installations and Mission Support in the Air Force, Rose spoke at JBLM about the importance of diversity and leadership, according to a press release issued by the 446th Airlift Wing. The Supreme Court’s ruling is a clear reflection of society’s changing attitudes, but there is still work ahead. While the 5-4 vote by the court was not unexpected, the dissent by Chief Justice John Roberts and justices Antonin Scalia, Clarence Thomas and Samuel Alito is disheartening because it seeks to deny the legitimacy of the ruling and right of samesex couples to be treated equally under the law. In his written dissent, Roberts doesn’t claim that same-sex marriages are illegal, just that the question of opening marriage to same-sex couples should be left to the states, not decided by courts. “If you are among the many Americans — of whatever sexual orientation — who favor expanding same-sex marriage, by all means celebrate today’s decision,” Roberts said. “Celebrate the achievement of a desired goal. Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not celebrate the Constitution. It had nothing to do with it.” The Constitution has everything to do with the decision, and this weekend we can all celebrate that marriage equality is the law of the land under that precious 227-year-old document.

Editor, After enjoying a delicious lunch at the new food truck on First Street I picked up a copy of Saturday’s Record and read a negative and largely trivial article about this pleasant new addition to Langley’s food scene. I had expected a very positive report on the surprisingly impressive and diverse menu, praise for the quality of the food and support for an appealing new attraction to our downtown. Apparently, most of the “problems” listed in the article had already been corrected in just the first few days of The Great Wierzbowski operation. It’s time for another article, this time a review of the food and service of the new food truck and a recommendation to your readers to give it a try. I’m certain they too will enjoy the experience. Farm talks should be made public Editor, It has become all too clear that Greenbank Farm, as we know it now, may change dramatically in the near future. Most of the business tenants have been leasing on a month-to-month basis for nearly three or more years, all the time hoping that issues between the Port of Coupeville commissioners and the Greenbank Farm Management Group would be resolved. For the past six months, port commissioners have regularly informed

us that they were working on our new leases, which would be forthcoming “soon.” This position does not match what has come to light via the recently revealed private discussions between some port personnel, Washington State University and Island County Commissioner Helen Price Johnson. We do not wish to be misled any longer regarding the future for the tenants at Greenbank Farm. As I read The Record from June 24 edition about the Port of South Whidbey and Goosefoot thinking about a commercial kitchen, I was led to believe that there aren’t any kitchens on the island for start-ups and farmers markets, and even basic food processing.

In the 16 years of having my 1,400-square-foot, 24-hour access kitchen at Kens Korner, I have had people who needed a place that is certified by Department of Health and the Department of Agriculture to start a food business, a space to use because their equipment broke, or a place to process their berries to make syrup. Some of these businesses have moved on to either find themselves with a thriving food business, while others have discovered that this industry is not for them. I am proud to have given all of these people a place to develop their ideas, help them with suppliers and get culinary and promotional feedback from the other foodies in the kitchen. Currently I have four full-time tenants, including myself, with one monthly vacancy; I always have room for daily rentals. And that is the way it goes. I don’t advertise the kitchen because those who are serious find me through word of mouth from others in the industry. It’s open season on the fat of the sea: crab Experts offer hot spots, bait advice for crabbing success By BEN WATANABE South Whidbey Record Clinton was buzzing Thursday morning as people lined the Port of South Whidbey pier, lines tied to the railing a few paces apart, hoping to catch a crustacean. Thursday was the season opener for crab in all the marine areas around Whidbey Island, and few places were as busy as the Clinton dock adjacent to the ferry terminal. Many of the crabbers were there at the 6 a.m. opening with buckets, traps, bait and rods in hand. Millie Zante of Woodinville has visited the Clinton dock for years on opening day and beyond. It’s her go-to crabbing spot, even through the winter catch season. By 7:45 a.m., she had one Dungeness and five red rock crab, a poor haul by her standards compared to years past. “It’s kind of slow this year,” she said. A few paces down the dock, 17-year-old Everett resident Kenneth Joven and his family had pulled one Dungeness and a few red rock crab. To make the journey over, they were up at 4:30 a.m., he said, only to arrive to their once-private spot and see it crowded with other crab seekers. “Normally, around 8 if there’s nobody here, we’d have five or six crabs,” he said. Three areas offer plenty of options for would-be Whidbey crab catchers. Marine Area 8-1 is said to be the best so far by Washington Department of Fish and Wildlife biologist Don Velasquez, but is also the farthest from South Whidbey. The area stretches from West Point of North Whidbey down to East Point, between the Baby Island area and Camano Island. “If I was going to declare a hot spot, I would keep my pot in 8-1,” he said from the Mill Creek office this week. He wouldn’t give the specific average number of retainable crabs from some exploratory fishing forays, but said they were impressive. “Crabbing, at least based on the test fishing results prior to anyone going in the water before tribal fishing began, I’ve never seen better results in 8-1,” he added. Marine Areas 8-2 (Port Susan, Saratoga Passage, Port Gardner and south to Possession Point) and 9 (the west side of Whidbey) were on par with past seasons, Velasquez said. The biologist who specializes in crab and shrimp said that the two catchable species — red rock and Dungeness — are pretty much everywhere, unlike shrimp. Throw

Marine Area 8-2 included Langley and the Port of South Whidbey Harbor dock. Bright yellow lines dangled over the railing with a dozen or so traps cast out from high above on the raised dock during a low tide Thursday morning. Four young men were hanging out awaiting the 9 a.m. opening of the expanded dock where they had set some traps earlier. They were using ring traps and checking them about every 15 minutes or so. After starting bright and early, they had caught one Dungeness and four red rock crab. They had only one plan for their haul at the end of the day. “Eat ’em,” said the oldest of the group, 20-year-old Brandon Brown of Langley. “We’re hoping to limit out.” Added Jordan Bond, “We’re here for this.” Getting set up with all the necessary gear to catch crab from a dock or boat costs somewhere

between $65 and $159 at three South Whidbey stores. At Jim’s Hardware in Clinton, a bundle of a square pot, 100 feet of lead line, harness, bait bag and buoy costs $75.99. The bundled option at Freeland Ace Hardware cost $64.99 and included a square trap, 100 feet of lead line, bait bag and buoy. Sebo’s Do-It Center in Bayview offered the most choices for traps, ranging from a basic square pot for $24.99 to a commercial-type pot for $159. The Sebo’s bundle included a circular pot with a bait cage, 100 feet of lead line and buoy for $105.99. All three have frozen bait and store employees touted the bait pellets. Crab can be caught with pots as far out as 400 feet deep and as shallow as 10 feet. The sweet spot, Velasquez said, is between 20 feet and 200 feet deep, with gear limitations factoring into that as well. Throw out more line, and the more line has to be hauled up either by hand or by a line hauler. “They have a good sense of smell,” he said. “Underwater, they

If they’re down current from it, they’ll follow their noses, so to speak.” People throw all kinds of bait into their pots. By and large, however, it has a distinct funk to its scent that is more akin to putrid than potpourri. Some people use rotten chicken, fish heads and guts, even cat food. Velasquez recommended taking a page out of the professionals’ handbook.

“I just look at what the commercial folks use,” he said. “They typically use some combination of fish and clam or mollusk.” Rules for the gear can be a bit complicated, but the good news is that three major hardware stores on South Whidbey have it all set up. “I would stay away from major traffic lanes and places where boats are funneled down, just because it avoids vessels colliding with buoys and lines,” Velasquez said.
