Whidbey General Hospital coughs up cash for cleared nurse’s legal fees By JESSIE STENSLAND South Whidbey Record Whidbey General Hospital paid its chief nursing officer’s legal fees in defending against a gross-misdemeanor criminal charge of which she was found not guilty. The bill totaled about $250,000. The hospital will likely be repaid under a state fund that reimburses attorney’s fees for people charged with assault who are found to have acted in self defense. The fact that the public hospital was paying Chief Nursing

Officer Linda Gipson’s legal fees came out in court last Thursday. A jury found Gipson not guilty in April following a trial that was unique to district court in its length and complexity. Gipson had been accused of assaulting a mentally ill patient who was in restraints at the hospital, but the jury found that she had acted lawfully. Her attorney, Andrew Schwarz of Seattle, asked Island County District Court Judge Bill Hawkins to reimburse her from the fund and the judge agreed, despite the prosecutor’s objection.

Gipson didn’t attend the hearing. Until last Thursday, Schwarz didn’t disclose to the prosecution that the hospital paid almost all of his bills. His billing statements excluded the name of the “third party payer,” according to Island County Prosecutor Greg Banks. Banks said he doesn’t know if that means the hospital or its insurance carrier paid the bill, but he said it should have been a transparent decision by hospital officials if they decided to fund a public official’s criminal defense. He pointed out that state law forbids public

entities to gift individuals with public funds. State law specifically allows public agencies to defend public employees in lawsuits, but criminal cases are different, he said. Banks said he researched the issue and, so far, has found only one instance — a 1998 case in Illinois — in which a public entity paid for the criminal defense of public officials. Pair survives small plane crash near Oak Harbor airport By JESSIE STENSLAND South Whidbey Record Two people are in the hospital with non-life-threatening injuries after a skydiving plane crashed near the Oak Harbor airport Monday night, according to the Island County Sheriff’s Office. The Cessna 182, which was out of Monroe, apparently lost power on approach to Eisenberg Airport, which is just south of Oak Harbor, and crashed into trees in the backyard of a Windermere Lane home.

Lt. Mike Hawley said a pilot took a group of skydivers from Monroe in a Cessna 182 to jump over Whidbey Island. One of the passengers decided not to jump. Margaret Galbraith said she and her husband, Dwight, were home when the place crashed in their backyard at about 8:15 p.m. She said they didn’t hear anything until they heard the crash, which she described as a distinctive sound of wood on metal. Hawley said the plane was headed in from over the water and struck the trees about 20 feet from the ground, then spun about 180 degree before hitting the ground.

“It appeared they were trying to make an emergency landing in the field when they crashed,” Hawley said. The pilot and the passenger were both ejected, according to Galbraith. She said both men were on the ground when she got to them and seemed to be in shock. “It was pretty frightening,” she said. Robert Sweeton lives in the neighborhood and saw the aircraft from a distance. He said it looked “pretty low in the sky” and followed it to where it crashed. Hawley said both men are from the Seattle area. He said the pilot suffered a broken collar bone, but he’s not sure about the passenger’s injuries. Both men were released from the hospital late Monday, he said. The Federal Aviation Administration and the National Transportation Safety Board will investigate the crash, he added.

Fireworks will go on as county leaders urge restraint, caution By DEBRA VAUGHN and BEN WATANABE Whidbey News Group It’s hot and dry on Whidbey Island, so unseasonably Hades-like that the Island County fire marshal issued a countywide burn ban. But there’s one thing he can’t place an emergency ban on, no matter how extreme the weather: fireworks. That’s left some officials in Island County frustrated with their inability to stop revel-

ers from lighting explosive devices during one of the driest seasons on record. Island County Board of Commissioners passed a resolution last week to “encourage all within our jurisdiction to limit the discharge of personal fireworks to reduce fire danger on our islands.” The resolution has no more authority than a strongly-worded finger wag. “It seems crazy (the fire marshal) can restrict every other kind of burning and not fireworks,” said Commissioner Helen Price

She’s pushing for the county to add a clause to the books that would give the fire marshal the ability to call for an emergency ban on fireworks use. “We aren’t going to be able to take action this year,” she said. “That doesn’t mean we shouldn’t be able to get tools in place for the future.” State law allows local city and county governments to completely ban fireworks within their jurisdictions or add a clause allowing emergency bans — but only with a year advanced notice. The only person with the authority to issue a statewide temporary emergency ban on the firework sales and use is Gov. Jay Inslee, according the state Fire Marshal’s Office. After consulting with the state Attorney General’s Office, the governor determined he doesn’t have the legal authority to initiate a

statewide fireworks ban this year, said his spokeswoman, Jaime Smith. The governor, however, is asking residents to use extra caution because of extremely dry conditions and to forgo the use of personal fireworks, she said. The burn ban in Island County, which took effect Monday, prohibits all open fires. It’s OK to use charcoal and gas grills. Rules for when fireworks can be used varies by whether you live in the city or the county. In rural Island County, it’s now OK to use legal fireworks from 9 a.m. to 11 p.m. until the holiday, and on July 5. On the Fourth, fireworks may be used 9 a.m. until midnight. marshal for the county. He’s not sure this year if he would place an emergency ban on fireworks. He wouldn’t make that determination until consulting with all the fire chiefs in the county — the same protocol he uses before authorizing a burn ban. “I think I would if I felt there were a real danger,” he said. It makes sense to give the fire marshal that authority, he said. Brown would like to have the ability to tailor a ban by area since conditions may vary between the northern tip of Camano Island and the southern tip of Whidbey. South Whidbey Fire/EMS Chief Rusty Palmer said that he, like many others, enjoys the spectacle of a booming firework but he also knows the dangers they present, especially in the dry conditions on Whidbey Island this week. “Things are drier than in a lot of recent history,” he said Tuesday morning. “We’re weeks ahead, at least three weeks, of the normal drying period.” “I love fireworks, but I wouldn’t use them myself this year because of the fire

danger,” he added. Don LaMontagne, a member of the Kiwanis of South Whidbey and the group’s fireworks chairman, said he understood the county’s position on requesting a halt to fireworks use this year. But he also said that the fireworks they sell are not part of the problem in Island County. “I know Helen [Price Johnson] and respect her very much as a good friend,” LaMontagne said Tuesday morning. “She’s not opposed to fireworks. Her challenge is we have some individuals who are not buying fireworks from South Whidbey Kiwanis. The people who cause problems are people who buy fireworks from off the island and bring them over here … They go down to our beaches, have a little too much libations and make a general nuisance of themselves.” Citing the origin of fireworks celebrations on July 4, LaMontagne said he didn’t want to disrespect the founding fathers. “I’m not, for one, going to infringe upon my friend Benjamin Franklin,” he said.

It couldnâ€™t pop open a beer because the festival is held at a public park, but there is plenty of fun to be had. Celebrating sober has plenty of merit at this annual party for the old stars and stripes, largely geared as a family-friendly atmosphere by the organizing South Whidbey Assembly of God church. Fireworks gazing, stage entertainment and playhouses are all free. The only thing that costs money is food. Even parking and

LANGLEY City water use restriction issued Everyone hooked up to the City of Langley water system is being asked to limit their water use due to a main well pump malfunction. Mayor Fred McCarthy sent out a notice Monday alerting residents and business owners to restrict outdoor and other unnecessary water usage. According to the public notification, a well pump failure alarm went off Saturday, June 27. The Langley Public Works water department staff responded to the alarm and discovered that there was a mechanical issue with the pump, which pulls water to the 600,000

gallon tank. Located 280 feet underground, addressing the problem isn’t as simple as fixing a leaky faucet. A repair service is scheduled to bring the pump to the surface. Public Works Director Stan Berryman said a contractor from Seattle is scheduled to replace the unit Thursday. Langley had planned to replace the main well pump, which collects 500 gallons per minute, in 2016. Berryman said he did not know what went wrong or how old it is. “It’s a mechanical piece of equipment and they do age out,” he said. A pair of additional wells with limited capacity were activated and are running 24 hours a day to meet demand. They run 90 and 75 gallons per minute, totaling about a quarter of the broken pump’s capacity. Langley’s daily average use is 125,000 gallons.

CORRECTIONS The story entitled “Sweet songs for dying days,” published in the Saturday, June 27 issue of the South Whidbey Record, contained an error. The Threshold Singers are not part of Whidbey General Hospital, nor do they receive training at the hospital. It takes new members from six months to one year to memorize the songs and to establish a connection with fellow singers. In the story “Langley man may lose arm after hit, run crash” on page 1 of the Saturday, June 27 issue of The Record, some details were inaccurately reported. The crash was in Bothell and was not a hit and run. Berryman said the city wanted the replacement in ahead of the July 4 Independence Day holiday weekend, when water usage can easily double. “We want to get the main pump back in service as soon as we can,” Berryman said. “But it isn’t a total crisis emergency. The tank holds 600,000 gallons,” he added. “Until repairs can be made we ask that you limit your outdoor and other unnecessary water usage,” the notice reads. While the public notification does not specifically forbid or list any activities, some common outdoor water uses such as lawn sprinklers, pools, and car washing were agreed to by Berryman as examples of “unnecessary.”

FERRIES 7 percent fare increase floated Ferry fare increases totaling 5 percent for vehicles and 2 percent for passengers over two years are proposed by the Washington State Transportation Commission. In a news release, the fare hikes would be staggered over time. The first increase would occur Oct. 1 this year with 2.5 percent for vehicles and

1 percent for passengers. That would be mirrored again in May 2016. Other changes would affect over-height surcharges. A few public comment meetings will be held about the increases. One on South Whidbey will be from 6 to 8 p.m. Wednesday, July 8 at the Clinton Community Hall, 6411 Central Ave.

Plan ahead for holiday traffic The Independence Day holiday weekend is one of the busiest travel times of the year for Washington State Ferries. In a news release from the Washington State Department of Transportation, the agency encouraged ferry riders to plan ahead for heavy traffic at the Mukilteo and Clinton terminals Thursday, July 2 through Sunday, July 5. Ferries will operate on normal sailing schedules Saturday, July 4. Based on the terminal congestion table published by Washington State Ferries, a typical weekend sees heavy vehicle traffic leading to a wait of at least one sailing. Editor’s column Lots of Fourth of July fun to be had on South Whidbey By JUSTIN BURNETT

From where I’m sitting, there’s no better place in the world to celebrate Independence Day than right here on South Whidbey. Truly, between Celebrate America in Freeland and the Maxwelton Independence Day Parade, events that offer everything from great food, awesome music and an outstanding fireworks display to a glimpse of days gone by and good ol’ fashion fun, who could ask for more? Kicking things off right is Celebrate America. This annual event is held July 3 at Freeland Park. It’s a party in a family-friendly setting that rivals anything else held on Whidbey Island. From 3 to 7 p.m., kids can enjoy bouncy toys and face painting. Hot food begins at 4 p.m., with vendors whipping up meals such as burgers and Asian noodles and treats like kettle corn and cotton candy. A free shuttle service from Freeland’s Park and Ride lot located at Trinity Lutheran Church, and at the Island Transit bus stop on Main Street in front of Chase Bank starts at 4:30 p.m. Live entertainment begins at 6 p.m. The line up includes: Island Dance, The Kelly Chambers Band, magician Jeff Evans, Total Experience Gospel Choir, Maggies Fury and Soloist Sean King. Fireworks begin at “10:20ish,” according to organizers. This South Whidbey favorite is orchestrated by South Whidbey Assembly church with financial help from the community. They work and pay so we can play, for free — there is no cost for admission. But don’t play too hard, as this year’s parade in Maxwelton, held on July 4 the following morning, is one that should not be missed. This is the 100th parade, making it one for the history books. Show up and tell your grandkids you were there. The parade starts at 1 p.m. at the intersection of Maxwelton and Swede Hill roads and ends at Dave Mackie County Park. Following the process will be foot races for all ages, and an egg throwing contest.

Over $45,000 was raised. So many people from South Whidbey came out to give and to help. Out of town friends and family traveled for hours to be with us. Editor, Tim Callison’s concerns about traffic safety at the marina are well founded, but his proposed solutions of installing a traffic light and routing all boat traffic down First Street are expensive and create too many other problems. Instead, we could put up mirrors and install warning signs. These simple, inexpensive fixes would increase safety significantly. It might also be possible to widen the intersection (using grant money?), which would make turning from Wharf Street onto Cascade Avenue easier and safer. I see no need for a traffic light or to route big trucks pulling boats down

The event is always a fun time, and attendance in recent years has numbered in the thousands so it’s wise to show up early and get a good parking spot. Public parking is available at the following locations: the park, a field just up Maxwelton road from the parade’s start at Swede Hill (look for the signs) and overflow at the Little Brown Church up the road at the intersection of Maxwelton and French roads. Free shuttle service is provided between the overflow parking lot and Maxwelton Beach for the parade. If you do show up late and have to park up the street, the walk to the beach is quick — I always bring a skate board. What’s more to say? Devotion or Obsession?

ave you ever heard this before? “I love you so much… I don’t know what I’d do if you left me.” This may sound like a sweet and passionate partner but it can also be an obsessive behavior. Where is the line between devotion & obsession? Know your line. Being able to identify these red flags in not only your own relationship but in others’ too can help prevent domestic violence. Domestic violence is often only associated with physical abuse, and while that can be a significant part in some relationships, there are also many other more subtle ways that people are being manipulated and controlled in abusive relationships. Muzzy, is playing with a different select baseball team. Other returning varsity players were injured, or didn’t play due to family vacations, work, or other sports commitments. Instead, it’s the Falcons (and six Coupeville Wolves) of tomorrow who are sharpening their game, often through some mistakes and mishaps, in Legion play. With a roster of 18 players, and usually about a dozen who show up on game days, more of the underclassmen are taking the field. “That’s the way the whole season’s been,” said head coach Tom Fallon, who also leads the Falcon high school team. “We’ve had, more or

less, the younger guys playing.” “Same old thing. We make do with what we’ve got,” he added. On Friday against Burlington, there were a lot of bruises. The Sox took a quick lead after getting on base with a string of hits, and a couple of mistakes by fielders being out of proper position. Three errors were committed by the South Whidbey team in the first inning, and things never rebounded for the Falcons in the first half of the doubleheader. “It makes a big difference having more seasoned guys, our defense is a lot more solid when that happens,” Fallon said.

The loudest voice was Fallon’s as he chided a player for being out of position on what he later said was a routine grounder and should have been an out. “That’s where I get a little frustrated,” he said. “In summer ball, we take a lot different approach. But I’m still sending a message that I want them to work on fundamentals, and that’s the routine out.”

Jean Eloise Steele Porter

Jean Eloise Steele Porter passed away on June 26, at the age of 90. Jean was born in Knox County, Ill. in September, 1924. She grew up among aunts, uncles, grandparents and lots of cousins. She was the fifth child among six siblings: Kenneth (who died at age three) William, Charles, Alice (Furman) and Roger Steele. Jean attended the first eight grades in school in DeLong, Ill. before the family moved to Galesburg, where she attended three years of high school. Jean’s parents, William and Eva Steele, came to Whidbey Island in July of 1941 when Jean’s older brother was stationed at Fort Casey. Jean completed her senior year at Langley High School. She married high school sweetheart Omer K. Porter in December 1942 after graduation. The couple had four children: Sharon Goodwin (Jerry), Suzanne Mezo (Randy), Kenneth Porter and Keith (Jacqui) Porter. Jean attended the Church of Christian Fellowship on Saratoga Road, which later became the Langley Christian and Missionary

Alliance Church before relocating. The church is now known as the Island Church of Whidbey. Jean was a charter member of the Christian & Missionary Alliance Church. She was active in the church quilting group, which made quilts for the students at the Alaska Bible Institute; Child Evangelism Fellowship “Good News Clubs”; and in Jr. Church programs, as well as starting the church library with Pastor Russ Smith. Jean worked in the library for 25 years. She also made a great number of quilts for family members, baby showers and for the Good Cheer Thrift Store. Jean became involved with Good Cheer as a volunteer in 1971 and worked in various positions, including assistant manager in 1975 and 1980. She remained involved with the store until retiring in 2006 when she was no longer able to drive due to poor eyesight. She then sorted materials for the store, which were brought to her by special delivery, at her home. Jean was a creative person with her quilting, oil and watercolor paintings and homemade Christmas cards. She was a member of the Home-Makers group for several years. She loved games — Scrabble, dominoes, card games; and she was very competitive. She also participated in fishing, clamming, camping and beachcombing with the family, and enjoyed traveling to many states. Her friend, Don, helped to take care of the family farm for several years, mowing, pruning trees, picking fruit and keeping up the garden. Jean stayed on the farm for 63 and a half years before moving to Maple Ridge in 2012. There, she enjoyed playing bingo, pinochle and Boggle, as well as card games with the girls during their monthly

visit. Jean was preceded in death by her husband, Omer, in 1993, several months after celebrating their 50th wedding anniversary; and by five siblings. Surviving family members include her four children and their respective spouses; four grandchildren, Liana and Doug Mezo, Kevin Porter and Micah Goodwin; a step-granddaughter, Colleen Chakos (Gene); four greatgrandchildren, Keaghan Mezo, Brynn and Finley Bogosian and Isaac Goodwin; five step great-grandchildren; four step great-great-grandchildren; and numerous nieces, nephews and in-laws. in the town of Zillah to a Greek immigrant father, Emanuel Katsaros, and his wife, Beatrice (Huit) Katsaros from Bickelton, Wash. Michael is survived by his wife of 55 years, Kristina (Sander) Katsaros; son, Anthony Katsaros and his wife Corvidea; and daughter, Ester Katsaros, her husband John Fogarty and their children, Hugh and Sander Fogarty. Michael’s brother-in-law, Olof Sander, is a Whidbey Island resident. Michael’s one living sister, Elaine McCann (Walter), lives in the Boston area. During high school in Zillah, Michael was a star athlete lettering in three sports and playing clarinet in the school band. He was given the inspirational award in his senior year. Michael attended the University of Washington, where he graduated with a degree in architecture and construction management. He spent most of his working years as a designer for Safeway Stores in Bellevue, Wash. He and Kristina retired to Whidbey Island in 2003, living in their long-time summer home, a parcel of the August Hermanson homestead, which they bought in 1965 as their first child was

on his way. They were married at the Malmo home, south of Bush Point in 1959 and have had many old-time friends on the island. They became members of the Nordic Lodge of the Sons of Norway in Coupeville soon after retiring. Michael was a liberal thinker with strong feelings for social justice and international cooperation. He supported his wife’s work with foreign students at the University of Washington in the 1970s and 1980s. Each summer course ended with a day of fun and food on Whidbey Island. The farewell and burial

will be with the immediate family at Sunnyside Cemetery in Coupeville. A celebration of Michael’s life will take place at a later date. Michael’s family expresses our heartfelt thanks to Group Health Cooperative in Seattle’s Capitol Hill and to Hospice of Whidbey General Hospital. In lieu of flowers, we suggest a donation to Compassion and Choices, for whose kind service we are very grateful, or to your favorite charity.

tion of a simpler way of life. “It’s just good ole’ fashioned, clean fun,” he said. One of the parade’s organizers, Green is also the great-grandson of Peter Howard Mackie, one of four brothers who founded the event and developed the community more than a century ago. The Mackie brothers — Dave, TS (Theodore), James and PH (Peter Howard) — purchased 960 acres in the area, the Maxwelton Beach and Farm Tracts, and started the parade in what’s largely agreed to be 1905. The date is derived from Record stories written decades later. The first parade was held 18 years before the newspaper started in 1923, and a fire wiped out the publication’s archives in 1934. According to George Mills, an amateur historian of the Maxwelton area, what records do exist suggest the event was organized as

a way to bring attention to the new development, but it was also the family’s way of honoring Independence Day. “They were very patriotic people and wanted a celebration of the Fourth of July,” Mills said. “So, they did a parade.” While the details of the early years have been lost, such as who attended and what they did, it’s been largely an annual event ever since. There were years when it was cancelled, particularly during wartime — that’s why Saturday is the 100th parade, not the 110th — but it’s seemed to only grow in popularity over the decades. Today, it’s practically a South Whidbey tradition. If this weekend is like recent years, attendance may number in the thousands, according to Bob Brooks, coordinator for the Maxwelton Community Club, the organization that puts on the parade today. Spectators don’t register, so that’s just an estimate based on the walls of people who typically line the street

While the parade today is a packed and busy affair, many still remember it as a smaller event. “It wasn’t always this way,” Mills said. “Back in the 1950s just about everyone was related in one way or another, so there was always a family picnic afterwards.” The parade would typically start earlier in the day, so a potluck would follow. Then came the foot games and egg toss, both of which continue to this day, followed by softball matches and later fireworks. There some years, such as those right after the end of World War II, where it was a real party with people sleeping on the beach. “It was an all-night affair,” said Mary Sue Lile (Kinskie), a Langley High School graduate who remembers attending the event in the late 1940s. Her earliest recollection was of a year where she and her siblings wore chicken outfits made by her mother. “I remember coming home after school and seeing all these chicken cutouts and thinking, ‘What in the world are you doing?’ ” Lile said. That was pretty common then; parade floats were rare and most people marched in costumes or outfits that were homemade. There were a few other differences too, such as the inclusion of horses in the parade.

“It was simple life, and I guess the parade reflected that,” she added. Incidentally, Lile is related to Mills — they’re “first step-cousins.” She has a few years on him and she still remembers the younger man chasing after her and few of the other older children saying, “Wait for me, wait for me,” said Lile, with a chuckle. And of course there were the games, such as the now discontinued softball matches. Teams would come from all over, she recalled, including “big strapping boys” from Mukilteo. People rooted for their favorite teams, and it was a big part of the day, she said. For others, it was all about the foot races. That tradition, along with the egg toss, is still carried on today but there are some differences. Instead of ribbons, the victors walked away with riches: first place winners received a quarter, 15 cents was awarded for second and third got a dime. “I was fortunate to always finish in the money,” laughed Green, who organizes the games today. All children at the event also got a dime just for showing up. Combined, “you were rolling in the dough” Green said. Most of the spoils would be spent at what was then Cross Grocery across the street from the park where a quarter would buy an entire bag of candy. Sweets are still a big part

Last year, several returning children showed up with homemade candy catchers. Resembling butterfly nets, they were constructed of old tennis rackets, plastic bags and lots of tape. So, while some of the details have changed over the years, many of the long time attendees agree the event is just as special as ever. It’s a celebration of Independence Day, yes, but it’s also a reminder of days gone by, a period when everyone knew each other and came together periodically to enjoy each one another’s company, Green said. “It’s a throwback to that kinda life.” And in a time when the world seems to just keep getting bigger and busier, with neighbors growing ever more distant, that’s never been more important, he said.

Invasive weed identification South Whidbey Tilth will host a class on the issue of nonnative plants from 1-2:30 p.m. Sunday, July 5 at 2812 Thompson Road. Certain nonnative plants, including Scot’s broom, Canada thistle, yellow tansy and holly can cause problems in the Puget Sound region.

South Whidbey Tilth will educate attendees on these problems and their solutions. There will be a classroom session followed by a chance to see various invasive plants and learn hands-on methods to safely and effectively remove them without the use of environmentally harmful chemicals. Deputy Prosecutor Jacqueline Lawrence argued that Gipson doesn’t qualify to receive the reimbursement because it wasn’t really a selfdefense acquittal. She said the jury found, under the jury instruction, that Gipson had used lawful force but not that she was defending herself or others. The statutes don’t address the restraint of a mentalhealth patient. She also argued that Gipson didn’t qualify for reimbursement since the hospital had already paid most of the bill. She pointed out that Schwarz didn’t present a contract or any paperwork to show that the hospital paid the bills or that the reimbursement money would be paid back to the public entity. employer paid for her legal defense. He suggested that the hospital’s “malpractice carrier” may have covered the cost. He argued that the county would cover legal fees if a county official had been sued; he didn’t, however, seem to see the distinction between civil and criminal cases. Banks pointed out after the hearing that the county would not pay the legal defense of a county official accused of a crime. As to the size of the bill, Hawkins said that the prosecution didn’t question any particular line items in the bill. Lawrence said she just received the large billing statements the previous Friday and didn’t have the time to go through them thoroughly. Hawkins, however, said he had. He said he questioned the soundness of Schwarz’s decision to ask him to dismiss the case based on alleged improprieties of the Coupeville marshal and prosecutor, as well as the media attention. Hawkins did not agree to dismiss the case. He said Gipson would not have been able to have her attorney’s fees reimbursed if the case had been dismissed. As a result, he said Schwarz would not be reimbursed for the time it took to prepare the motion or argue it in court. Hawkins awarded Gipson $256,000 from the state reimbursement fund. The attorney fees include the cost of expert witnesses who testified at trial. Banks said he hasn’t decided whether he will appeal the decision. He said he contacted the state Attorney General’s Office about the issue.
