The estate of a 30-year-old Renton man gunned down inside the nowdefunct Munchbar nightclub in Bellevue on Christmas Eve 2012 was awarded $3.7 million by a jury presiding over a civil suit filed by the family of DeShawn Milliken against Brewhaha Bellevue. Ja’Mari Jones shot Milliken multiple times inside the nightclub, killing the Renton man. Milliken and his sister, Destiny, were standing near Jones in the club, when court documents state Milliken tackled his murderer. A friend of Jones’ reportedly intervened. It was at this point that Jones pulled out a handgun and shot Milliken several times in the back, his sister and another patron also being struck during the shooting. Jones, who was 19 at the time, was later apprehended in a stolen vehicle, along with his 20-year-old girlfriend, and charged with second-degree murder. Munchbar closed shortly after. He pleaded guilty in December to one count of second-degree murder and was sentenced to 18 1/2 years in prison one month later.

Milliken’s family alleged in its November 2013 complaint negligence on the part of Munchbar operator Brewhaha Bellevue and property owner Kemper Development Company for not addressing a pattern of violence, underage drinking, overserving of bar patrons and inadequate security measures. The family sought compensation for emotional and physical damages, including financial loss due to Milliken’s death. In the nearly two years Munchbar was in operation, Bellevue Police responded to 377 calls for service at the nightclub. A jury awarded DeShawn Milliken’s estate $3.7 million in damages and another $520,000 to his sister, Destiny. The jury also found Milliken and his sister were partially at fault. Because the jury found Milliken 20 percent at fault, the actual amount to be awarded to his estate is $2.775 million, while Destiny Milliken will receive $390,000 due to the jury finding her 5 percent at fault. “They really just wanted accountability by Munchbar for what happened to their daughter and son,” said attorney Felix Luna, who represented the family. Luna said DeShawn Milliken’s 8-year-old daughter is the sole beneficiary of her father’s estate, and the awarded $2.775 million will likely be placed into a trust until she turns 18.

The Bellevue City Council approved Monday an ordinance to prevent dormitory-style rentals in single-family neighborhoods, requiring residences with up to four unrelated tenants to exist as a family-style unit under one lease. Spiritwood residents became concerned in May 2013 about a number of houses being purchased and renovated by investors into multi-room rentals, increasing traffic and decreasing their sense of neighborly community. An emergency ordinance was enacted three months

later, and had been in effect through a number of extensions ever since. The city planning commission recommended the city planning director be able to verify whether the up to four tenants that will now be allowed to share a home in a single-family residence are living in a family-style unit, meaning they share the entire home, food and utility costs, furniture and appliance ownership and can prove their living arrangement is not temporary. Paul Bell with the Office of Student Legislative Affairs at Bellevue College advocated for amending the ordinance to allow up to five unrelated tenants.

He added he was recently searching for a Bellevue apartment and viewed several homes where families wanted to rent a room and other multi-room rentals that were less attractive. “Some were incredibly scary,” he said, “and some were preying on the most vulnerable and the most at need in the community.” Bellevue College President Dave Rule said Monday night the college supports the ordinance, adding a request for proposals for an on-campus dormitory for 350-500 beds (See Page 6) was recently released. Expedia announced on April 2 it will relocate its headquarters from downtown Bellevue to the 40-acre Amgen campus in Seattle, expecting to close on the $228.9 million property purchase later this year. "It has been a tough decision to leave Bellevue, which has been a welcoming and supportive home to Expedia for many years," said Dara Khosrowshahi, Expedia CEO, in a news release. "Owning an iconic waterfront headquarters will position us well in the competition for top talent and aligns with the work hard, play hard culture that defines Expedia. We are thrilled to make Seattle our permanent home with a new headquarters befitting the growing global technology company we are." The online travel company had hinted earlier this year it was looking elsewhere for more space to accommodate its growth — having recently acquired Travelocity and Orbitz. Expedia currently occupies a majority of the 20-story, 414,964-square-foot Expedia Building in Bellevue, but expects to be expanding buildings on the Amgen campus beyond the available 750,000 square feet of office space there now. About 75 percent of Expedia's workforce lives on the Eastside. The company, an offspring of Microsoft, expects to have 4,500 employees in its new headquarters in a few years. Seattle Mayor Ed Murray joined in last Thursday's announcement, expressing his desire for the city to work with Expedia to integrate the company and its presence into the city. In a statement, Bellevue City Manager Brad Miyake expressed disappointment with Expedia's decision to leave the city,

Opportunity lost

I

t is a huge disappointment that legislation proposed to raise the legal age to buy tobacco to 21, failed. The bill, requested by Attorney General Bob Ferguson, would raise the legal age to buy tobacco from 18 to 21. However, House Bill 1458 did not make it through a committee hearing that reduced the proposed upper age limit of 21 for buying tobacco products to 19. The original proposal was essentially rendered useless. The new law, sponsored by Sen. Mark Miloscia (R-Federal Way) and Rep. Tina Orwall (D-Des Moines), would apply to tobacco and other nicotine products, including “vaping.” A mountain of research, including a recent report from the Institute of Medicine, indicates that increasing the smoking age to 21 would significantly reduce the number of young people who start smoking; reduce deaths from smoking; and immediately improve the health of adolescents, young adults, and those around them. So why is this so hard? Late adolescence and young adulthood is the time that smoking begins. We should be pushing any way possible to stem the tide of new smokers. Research from the Centers for Disease Control indicates that each day in the United States, more than 3,200 people younger than 18 years of age smoke their first cigarette, and an estimated 2,100 youth and young adults who have been occasional smokers become daily cigarette smokers. More young men begin smoking than young women. But a newer trend has emerged with both young men and women using a variety of tobaccotype products. Smoking is expensive and gross. Letters On water: A letter to Governor Inslee Water is a critical resource and an action now is necessary to maintain an adequate supply. The purpose of this letter is to suggest two new sources. Save flood water in a diversity of new reservoirs and * import snow and ice from Canada and those states that suffer severe winter storms. Use the existing budget for flood control to build reservoirs, tank farms, dams and new lakes. Having numerous water storage resources will aid fighting forest fires. Many states were overwhelmed by snow this past winter. That unwanted snow is the new source of water. Load the snow into enclosed boxcars of the type that carry grain. (This type of boxcar is emptied by turning it upside down.) The states where snow is unwanted may even pay a fee for disposal. In the event that there is excess water, other western states would welcome a new supply. To begin, develop the first group of reservoirs in a state-owned forest to verify the concept and determine the cost of the entire program. Perhaps Mr. Bill Gates, the world’s foremost philanthropist, who is interested in water, may be willing to fund some of the more costly changes. Indian tribes and lumber companies would handle the cost of changing their properties. Dumping ice and snow into rivers, lakes and dams is the least complicated change. A boxcar lift is needed for each dump area. One or more pipelines may be needed also. The program may qualify for funding from the U.S. government agencies such as the Army Corps of Engineers and the Forest Service.

Unleashed dogs are not allowed in parks

We live near the Surrey Downs Park and use it frequently to walk our dog and we compliment the Park Department on the outstanding condition and appearance of the park for a va-

riety of community uses. A child was bitten by a dog at this park recently. This should caution all dog owners to abide by the Bellevue City Park Rules to keep animals on leashes. We do at all times but there are almost always dogs running loose in the park. Our dog was attacked by a larger unleashed dog and I now carry a walking stick to protect against such attacks. The park rules are plainly visible upon entering the park yet folks fail to read and adhere to these rules for the safety of all park users. The current entrance signs show a long list of “Do’s & Don’ts” in small print that are rarely noticed by park visitors. However, a dog off leash may seem harmless in itself, but it can threaten a park guest or other animal and provoke an incident and cause harm to her animals or people. Request we all show concern and respect for the safety and comfort of all park guests by adhering to the Park Rules of leashing all pets. Another recommendation is for more visible signs concerning dogs off leash. The current entrance signs show a long list of “Do’s & Don’ts” in small print that are rarely noticed by park visitors.

WSDOT ‘lack of honesty’

The 3/27 Bellevue Reporter frontpage article, “Commission approves I-405 express tolls”, is just the latest example of WSDOT mendacity when it comes to dealing with the area’s transportation problems. While they pawn off direct responsibility, the WSTC was obviously doing so at the behest of the WSDOT. First of all, the whole idea that an HOV lane increases capacity is absurd unless it is used to accommodate large numbers of buses. For example buses use the two I-5 HOV lanes to accommodate 14 million riders annually or 44% of commuters. It makes no sense to restrict a highway lane to facilitate bus service that currently consists of Sound Transit’s ST535 between Lynnwood and Bellevue every 30 minutes. Car pool benefits don’t have to include HOV access. I did so for years (before HOV) as a Boeing employee commuting between Bellevue and SEE LETTER, 5

$50,000 scholarship for Bellevue Student

Guillermo Zuniga Brambila of Bellevue is the recipient of a $50,000 scholarship from Western Governors University. WGU is a nonprofit, online university that is committed to making higher education more affordable and accessible for nontraditional students. WGU typically awards scholarships based on the applicant’s academic record, readiness for online study, financial need and other considerations. In 2014, WGU awarded more than 1,000 scholarships — 671 of those to new students — and offered more than $1.8 million in tuition assistance. It also awards career-based scholarships for current and aspiring nurses, teachers, information technology and business professionals. Tuition at the school is about $3,000 per six-month term for most WGU programs. It is a flat rate that covers all the courses a student is able to complete. The school said that tuition has not increased since 2008. Established in 1997, WGU has

Jackson of Bellevue, who attends Sammamish High School, is the winner of a National Achievement Scholarship of $2,500, underwritten by the Xerox Foundation. Jackson plans to study industrial engineering. Through its foundation, Xerox Corporation funds this award as part of its contributions program for higher education, which has as one of its significant interests the support of equal education opportunities. The article claims the average tolls will be between 75 cents and $4 increasing to $10 as a maximum for congestion expected only 10 percent of the travel days. They predict tolls for “seventy-seven percent of the trips are expected to be below $1.00.” Yet the WSDOT in the same article reports “I-405 experiences up to eight hours of congestion daily, amounting to one of the worst traffic situations in the state”. How is it possible that maximum congestion is expected only “10% of the travel days” and “seventy seven percent of the trips won’t occur during the eight hours of congestion.” Even these absurdities are topped by the claim “All lanes of I-405 will be able to go 45 mph or faster once the express lanes open this fall”. Again, the tolling debacle is just the latest example of the mendacity of WSDOT in dealing with the area’s transportation.

Bellevue College is taking its first steps to creating student housing on campus, with plans of opening a 350-room dormitory in the fall of 2018. A feasibility study was conducted by the

college to determine how to provide student housing and completed in October. “That told us where to build it it, how many beds to build and how to pay for it,” said Ray White, Bellevue College’s vice president of administrative services. “We’ve got quite a few architects interested in it.”

The 4-story dormitory will be constructed where a service parking lot is now, near Bellevue College’s baseball field at the north end of the campus, and is the first of three development phases to achieve 1,100 rooms for students in the next 10 years. Seattle and Washington State have an unusual role in the Vietnam War Commemoration, a national initiative to thank Vietnam veterans a half century after the United States rapidly escalated its deployment of troops to South Vietnam following the Gulf of Tonkin incident. Many of the troops who returned home were met with disdain rather than with the thanks that veterans of other conflicts received. Joe Galloway, the Vietnam correspondent who authored the book “We Were Soldiers Once... And Young” (adapted into the 2002 film “We Were Soldiers”), is in Seattle for a week of interviews with local Vietnam veterans. He will speak at Seattle Rotary’s noon luncheon April 15 and will be featured at a breakfast interview session at the Columbia Tower Club on April 17. The Vietnam War Commemoration is aimed at spurring events and activities in states, cities and towns around the country to recognize Vietnam veterans and their families for their service and sacrifice. Vietnam author Galloway to visit Seattle Joe Galloway, the Vietnam correspondent whose book “We Were Soldiers Once… and Young” and the movie “We Were Soldiers” that was produced from it, will be in Seattle doing a week of interviews with Vietnam veterans as a special project for the 50th Anniversary Commemorative. Galloway has been going around the country doing three two-hour interviews a day with Vietnam veterans from across the services spectrum and by now has well over 75 two-hour interviews done, as he explained it, “beginning with Colin Powell and working outward.” Galloway was a Texas boy who became a correspondent for United Press International and, in the battle of Ia Drang that his book and its movie adaptation made famous, he was decorated for heroism on the battlefield, receiving the bronze star for rescuing two wounded soldiers while under fire. He was praised by the late Gen. Norman Schwartzkopf as “the soldiers’ reporter” because of his caring and regard for those whose battles he covered.

Lawmakers: Affordable housing only part of solution for seniors BY DAN AZNOFF SPECIAL TO THE REPORTER

This article is the second in a series on the growing number of senior citizens among the Eastside’s homeless population. The One Night Count conducted in January last year in King County revealed that more than one quarter of the 6,400 homeless people huddled in shelters for protection from the cold were senior citizens. The elderly population among the homeless on the Eastside has continued to grow in the past decade primarily due to a lack of affordable housing, said state Rep. Tana Senn (D-41). Senn said she will continue her fight to provide affordable housing to what she describes as “the most vulnerable members of our society.” The number of seniors counted last year were among the 2,906 people in overnight or emergency shelters and 3,265 people in transitional housing programs. Volunteers who participated in The One Night Count in 2014 counted the number of people who were living on the streets without a breakdown of their ages or ethnicities. The total number of homeless people surveyed in the county last year exceeded 9,300. The senior population in King County is expected to reach 23 percent of

the overall population within the next 10 years. “We all know that seniors are becoming a larger part of the overall population, but the disproportional increase among seniors who live on the streets on the Eastside is staggering,” Senn said with a heavy sigh. “Many of these seniors thought that pensions or Social Security would be enough to maintain their lifestyles. And now many of those aging seniors are dealing with very expensive medical conditions, such as Alzheimer's, that they never expected they’d have to deal with.” Senn was a member of the Mercer Island City Council when it voted to approve the first affordable housing project in that community. She emphasized the fact that affordable housing is one of many issues that deserve the time and money from lawmakers in Olympia this year. But she quickly admitted that there is never enough of either. “There are 70 seniors on the waiting list for affordable housing in Bellevue right now,” said Senn. “And that number has not changed over the past five years.” Senn was appointed to the Legislature in 2013 and was re-elected last fall. Her district includes portions of Bellevue and Issaquah as well as Mercer Island and Newcastle. Eastside Rep. Ross Hunter (D-

48) agreed with Senn that there is simply not enough money available to deal with the numerous social issues that face residents of the state. “Too many seniors are outliving their resources and find themselves being forced to choose between life-saving medication and an acceptable place to live,” said Hunter, the head of the House Ways and Means Committee. The lack of affordable housing and the high cost of health care have combined to force many seniors to find homes in communities far from the Eastside, Hunter said. “The Eastside is not like Seattle. Most of our communities were not developed with an urban core that would allow seniors to live within easy access to public transportation or medical care.” Hunter’s concept for a senior community would be built with a universal design that includes private residential units equipped with grab bars and wider hallways to accommodate wheelchairs and walkers. The residential complexes would each have a common open space that would give seniors the chance to socialize as well as maintain the semblance of a normal life. After months of speculation about what will fill the vacant J.C. Penney building at Bellevue Square, UNIQLO on Monday announced 13,000 square feet of it will be a new retail outlet for the Japanese casual apparel company. UNIQLO opened its first store in New York City in 2006, and now has 39 outlets that include New Jersey, Connecticut, Philadelphia, Boston, San Francisco and Los Angeles. The Bellevue Square expansion marks UNIQLO’s expansion into Washington, and is expected to be a little larger than its store in Denver.

said, with transit-oriented development planned on the eastern edge of the property. She added it does not call for development on top of the maintenance facility. If the maintenance facility is sited in Bel-Red, the MOU also calls for the construction of a trail within a one-mile stretch of the Eastside Rail Corridor to connect to a station at 120th Avenue Northeast. The East Link alignment will not change under the amended MOU and other agreements the city and Sound Transit are set to approve later this month.

Use the proper techniques

Gabriel Simental, Arden Chew and Jose Castillo are the Interlake Saints boys soccer team captains and have led their team to a 6-1-1 start in the first eight games of the 2015 season.

Interlake Saints head coach Dan Peterson shouted words of encouragement to his players during a passing drill on a sunny Thursday afternoon in late March. If players made an errant pass, they immediately dropped to do 20 pushups. The drill is designed to ensure each player is intensely focused on the job at hand. The results of this attention to detail are already well apparent at this early juncture of the 2015 season. The Saints, who have started off the season with a 6-1-1 overall record, are striving to clinch a berth in the Class 3A state tournament this May. “We have done really well the past five or six years. When we were in 2A, we went to the state tournament four years in a row (2009-2012),” Peterson said. “Last year we were a playoff team but lost on a last second goal to Liberty. We are hoping to get back to state this year with this group.” The Saints are led by senior tri-captains Gabriel Simental, Arden Chew and Jose Castillo. Peterson said the trio epitomizes what it means to be leaders. “How well our seniors get along with each other and how they always include the underclassman is a huge benefit to our team,” Peterson said. You can’t teach speed, and that is one asset the Saints have in droves. “We are athletic. We have six or seven different guys who can attack the goal. We’re tough to defend and are really balanced offensively,” Peterson said. Castillo, who splits his time between for-

ward and midfield, concurred with Peterson’s assessment. “Most of our returning players from last year are on offense. That is where all of our experience is,” Castillo said. The defense is in good hands as well. Peterson said the goalie tandem of Forrest Gobble and Sam Dawson is proficient between the posts. “We did the same thing last year,” Peterson said of splitting time between keepers. “They both play so well. I just have a hard time picking one over the other. We’re very comfortable with both of them.” Castillo thinks the Saints possess the talent and team chemistry to advance to state. The team lost in district playoffs last year. “We ended last year on a bad note. Everyone on this team wants to go to state. Especially the seniors,” he said. Simental, who plays center defender, said camaraderie is a team strength. “We all just blend and gel together,” Simental said. Chew said the Saints are determined to prove themselves in 3A division. The Saints moved up to the division in 2013 but have yet to advance to the state tournament. “We haven’t excelled in the past in 3A. It would be nice to take it a step further with all of these seniors on this team. Hopefully we can make a good run,” Chew said. Castillo said Peterson has been a fixture at Interlake ever since he was a child. Peterson, who landed the head coaching job in 2002, lives just minutes from the campus. “He has coached my cousins and my older brother in the past. I used to come here to watch games all the time growing up,” Castillo said. “My brother was a captain and now I’m a captain. HUGE $5.97 SPRING PLANT SALE Issaquah, Washington

Oh my gosh, it’s barely spring, and we have way too many great plants! They have to go! We’ve had such an early spring they need to be in gardens!

All this stuff is $5.97!

We have quart, one gallon, and even 2 gallon size plants priced at just $5.97, including about 10 different kinds of trees and shrubs and over 25 flavors of perennials. Lots of them were grown right here in our front yard. Our plants are hardy and beautiful and ready for their forever homes. My favorite is the Kousa Chinese Dogwoods. Some of these are almost 3 ft tall, in big 2 gallon pots. Honestly, these should be priced at about $20, and I should have my head examined for selling them for $5.97. That’s crazy. No way you can do that unless you grow them yourself. You have to see these. We have Japanese Red Maple trees. Can you believe that? A Japanese Red Maple for $5.97? They’re about 2 ft tall, with bright red leaves and trunks, and they’re so darn cute. Shrubs? We have big 2 gallon Fujino Spireas. Fujino is the first Spirea to bloom in spring. We have Nugget Ninebarks bright gold leaves. Some of these are 2 gallon size, also. Lots of the Doublefile Viburnums are 2 gallon size, and they’ll be covered with white flowers

We have about 9 kinds of Coral Bells. Some are fire engine red, some are sort of a frosty red, some are kind of peachy, some are burgundy, and some are so dark they are almost black. This is probably the largest collection of Coral Bells you’ll find anywhere, but it won’t last long. Looking for plants for shade? We’re all over it with Hostas. I don’t even know how many different varieties we have. Green and white, green and gold, plain green, and they are all growing like crazy. You know what looks great with Hostas? Old Fashioned Bleeding Hearts. These little guys are in bloom right now, with lots cute pink and while flowers, and the foliage is so feathery and light. These keep growing year after year, getting nice and full but not taking over. Well behaved. There’s lots more, all $5.97. I can’t even think of it all. We’ve got a great little plant that deer don’t like. It’s called Purple Euphorbia, and it is awesome. Deep wine colored leaves, with brilliant yellowgreen flowers on top. Stays in flower for months, and the handsome foliage is evergreen. Can’t ask for much more than that. It’s coming into bloom right now, and the flowers will last for

months. Tuck in some Japanese Forest Grass, which is also deer resistant, and those golden girls will light up any landscape. Are you looking for evergreens? We have Bird’s Nest Spruce. These fuzzy little guys will keep a green spot in your garden all year long without taking up too much space. And Rosemary, the kind you use for those delicious recipes, is beautiful with it’s blue green little needles and bright blue flowers. We have good looking, low maintenance, high performance groundcovers. Emerald & Gold Wintercreeper, Emerald Gaiety Wintercreeper, and Bearberry Cotoneaster. These choke out weeds, fill in open spaces, cascade down hills, and are hardy as rocks. Looking for groundcovers with flowers? Got that too! Candytuft has about a bazillion little white flowers and looks great cascading over walls, and Lithodora has bright blue flowers and is one of the easiest plants ever. Put it next to the driveway where the sprinkler doesn’t quite reach, and walk away. It’ll be just fine. Nothing says spring like Azaleas in bloom! We have Hino Crimson, and Vuyk’s Scarlet, and Ramapo, which is really a Rhododendron, covered with purple blue flowers, only $7.97. And I saved the best for last. We’ve got absolutely lovely Japanese Laceleaf Maples.

Division-1 bound Clouse is dominating on the hill Bellevue Bulldogs sophomore pitcher Zander Clouse takes a winding road to his lifelong goal on the baseball diamond BY SHAUN SCOTT BELLEVUE REPORTER

Nearly two years ago Bellevue College Bulldogs ace hurler Zander Clouse made a tough decision with regards to his future in baseball. Clouse, who graduated from Archbishop Murphy High School in 2013, spurned a slew of Division III universities, instead opting to sign with the Bellevue College CLOUSE baseball program. It’s been one of the best decisions he’s ever made. Clouse is in the midst of a sophomore season for the ages. He has an undefeated record of 4-0 and boasts an earned run average of 0.59. The right-hander has allowed just 13 hits in 29 innings of work and has struck out 26 batters. The Bulldogs have compiled an overall record of 15-7 thus far during the 2015 season. Clouse is hoping to go out with a bang in his final season of junior college baseball this May. “I won a state championship (2012) in

high school and I would love nothing more than to win a NWAC Championship,” Clouse said. This fall Clouse will take his baseball talents to Liberty University. Liberty is a Division-1 baseball program located in Lynchburg, Va. Clouse said he never would had gotten a chance to play at the Division-1 level if it wasn’t for Bellevue College. “I had pretty good grades going through high school and I could have played at almost every D-3 (Division III) program in the area, but I always wanted to be a D-1 baseball player. That wasn’t going to be an opportunity for me coming out of high school, but coming to a JC (junior college) definitely got me prepared and got me ready,” Clouse said. “I definitely became a better pitcher here. You got to work your ass off to play college baseball. It is definitely a whole different ballgame.” Clouse said his change-up is his best pitch and his fastball consistently fluctuates between 86 to 88 miles per hour. He said he popped 93 miles per hour during the fall of 2014. Recently the Bellevue Reporter had an opportunity to ask Clouse a few questions about his life away from the baseball diamond.
