Freeland banker faces jail time By JESSIE STENSLAND South Whidbey Record

Believed to be a record breaker in terms of property damage, the windstorm that blasted South Whidbey last week may help the state qualify for federal aid. Island County Emergency Management Director Eric Brooks confirmed Monday that Whidbey is among a host of Western Washington communities that are assessing the destruction to see if the total price tag reaches $9.5 million, the monetary benchmark that will allow the state to apply for Federal Emergency Management Agency funding. It’s unclear whether the combined devastation will reach the threshold, but

A former customer service manager at the Freeland branch of Whidbey Island Bank is facing time in federal prison for embezzling $162,000 from the bank. Shawna Brown is scheduled to be sentenced Friday in U.S. District Court in Seattle for one count of bank embezzlement. She pleaded guilty in September as part of a plea agreement. The U.S. Attorney is recommending a sentence of 15 months in prison, which is the maximum under the plea agreement. The sentencing memorandum describes the “lengthy scheme” in which Brown thwarted the bank’s

Whidbey General Hospital isn’t on trial, but both a judge and the deputy prosecutor directed some pointed comments about the administration during a court hearing Monday. At one point, Deputy Prosecutor Jacqueline Lawrence called the hospital’s actions “shocking and unconscionable.” She claimed the hospital appears to have a double standard in protecting an administrator, but hasn’t extended those protections to others. Linda Gipson, the chief nursing officer, is facing a fourth-degree assault charge for allegedly assaulting a restrained patient May 13, but much of the argument Monday was over decisions made by other hospital officials.

Cold snap hits Whidbey with near-zero weather

“Winter threw a Tuesday punch at South Whidbey this week, coming in on a wintry wind and then sticking around to push the temperatures down to levels not seen in years. “Complicating the problem, gusty winds early Tuesday morning put trees across the power lines south of Coupeville and put out electricity to South Whidbey from 6:20 a.m. until 8:30 a.m. In the meantime, snow which fell light and powdery turned all South Whidbey roads into sheets of glare ice.”

Support of Is. County Fair pledged by commissioners “Island County’s two commissioners-elect, John Vanderzicht and Ed Christoe, pledged complete support of the Island County Fair during a meeting at the fairgrounds Monday night of the fair direc-

tors. “The two new commissioners, who take office in January, also declared that they plan to continue the present policy of delegating authority for running the fair to the fair directors. “Those same fair directors, during the evening, re-elected Gust Skarberg as president; Jean Rowe as secretary and Helen Scott as treasurer. They also chose two new officers, Martin Boon of Oak Harbor, first vice president, and George Stockholm, second vice president. … “During the discussion of the fair’s future, Vanderzicht suggested that more North Whidbey support might be forthcoming if the president of the board were to make talks at meetings of North Whidbey clubs and organizations, such as the Rotary club. He also suggested that the concessionaire chairman visit Oak Harbor during the Fourth of July celebration and perhaps line up some of those concessions for the Fair, which is held in August.”

Local girl hurt in bad accident near Coupeville

“A heavy 1955 Cadillac driven by Sharon Cattron, 16, of Langley, ripped along the side of a truck between Coupeville and Kennedy’s Lagoon Saturday morning but neither Sharon nor her passenger, Carol Deposit, 15, of Clinton, were seriously injured. “The Langley teen-ager lost two teeth and had numerous stitches taken to close cuts in her face, but Carol was only shaken up badly. “Richard Lewis of Oak Harbor, driver of the truck, had only a slight cut on one hand and his son, a passenger in the truck, had no injuries at all, although he was shocked and shaken. “The Cadillac, owned by Sharon’s father, Francis “Cat” Cattron, was totaled. The entire left side of the heavy sedan was ripped and smashed and state trooper Del Honsberger said it was a miracle that no one was killed. “Sharon and her passenger were taken to the Island Medical Clinic in the North Whidbey ambulance, operated by Homer Bakker, a former South Whidbey resident. They were released Saturday afternoon after receiving treatment. “Only an hour or so earlier, a car driven by Robert Boyer of Oak Harbor left the road near Oak Harbor, smashing into a telephone pole and killing the driver.”

Langley reaffirms funicular study plans for 2015 By BEN WATANABE South Whidbey Record Langley’s $5.5 million budget for 2015 received the final approval from the city council Monday night. It was not without a few minor changes and one major one. The city council, at the request of Councilman Thomas Gill and resident Brian Woloshin, voted to change Mayor Fred McCarthy’s wording in the budget that originally stated construction of a conveyance linking the marina to Cascade Avenue would begin in spring of 2015. It now reads that the study of a conveyance will begin in 2015. Proposed for several years, Langley city leaders have sought a way to circumvent the Wharf Street hill for boaters visiting South Whidbey Harbor. Commonly known as Langley Marina, the dock is owned and operated by the Port of South Whidbey which recently finished one phase of expansion and has plans for additional future growth. Any further expansion will require more parking and, port and city leaders say, a reliable way to move people and their possessions up and down the

The cart would be on a tram along the bluff, landing somewhere near the base across Wharf Street from the marina and on top of Cascade Avenue near Fourth Street. Langley procured $500,000 in Island County grant funding to pay for the project. The funicular was scuttled last year in favor of pursu-

ing a bridge and elevator in partnership with Paul and Pam Schell; the former died in July only a couple of months after formally proposing it to the city. Needing somewhere to land either device, Langley needs a property owner to allow for a landing spot and an easement for people to walk from the bluff to the street. The Schells were willing, and Pam Schell has continued to

see it through and is, according to McCarthy, willing to change the project to the funicular. Funding for the project remained in the 2015 budget. That allows the city, if it desires, to move forward with construction without a budget amendment. At the city’s final regular meeting of the year on Monday, the project received one resident’s rejection and one resident’s approval. Woloshin, who has criticized the project at meetings earlier this year, questioned the need and efficacy of a cart to move dozens of people from tourist boats such as the Victoria Clipper. He also said the walk would be longer from the proposed bluff-top landing spot into the business area than if people just walked from the marina up the Wharf Street hill. Fred Lundahl, a business owner and a member of the Langley Main Street Association, spoke in favor of the project. He said he talked with someone representing the Clipper who told him it would not stop in Langley unless there was a reliable transport for people to get up the hill.

“I believe it’s an infrastructure project, much like Second Street,” Lundahl said. Questions and planning remain for the conveyance, in any form it takes. The carrying capacity of a funicular would have to be large enough to quickly move several people up the bluff to make it worthwhile for the Clipper or other tourist groups. Langley will need to provide maintenance and service estimates for the device as well. The city, according to council members, is waiting to move forward on the project until the Port of South Whidbey updates its master plan, now a decade old. Another pending change to the budget, likely requiring an amendment in January 2016, is the city’s tentative agreement to a three-year contract with the Langley Police Guild. One of the resolved issues was the removal of a pay schedule in favor of receiving raises similar to other city staff. McCarthy said the change saved the city about $8,000 and remained within the proposed budget. “I think it’s a good agreement,” McCarthy said.

SCHOOLS Board roles up for internal vote South Whidbey School District directors will select members of the board Wednesday to serve roles as chairperson, vice chair-board auditor and legislative representative for the upcoming year. The board will meet at 6:30 p.m. Wednesday, Dec. 17 in the Community Room at South Whidbey Elementary School. The annual organizational meeting, as outlined in policy number 1210, is an opportunity for board members to vote for their colleagues to either maintain or change positions.

“It is an opportunity to reorganize,” said Linda Racicot, current board chairwoman. “However, people can indicate their interest in continuing their position because there is a learning curve.” In order to designate the remaining positions such as Washington Interscholastic Activities Association representative and policy representative, the board may decide to either take a vote or the remaining board members may state their preference. Also on the agenda is the approval of a number of memoranda including policy number 3210 regarding nondiscrimination, policy number 2336 regarding required observances and policy number 2413 regarding the equivalency credit for

career and technical education courses. The directors will also discuss public records requests which have been submitted to the district, and the proposal to relocate an osprey nest on district property.

PARKS Facility, field use, salaries on table The South Whidbey Parks and Recreation District will discuss such matters as its facility and field use policy, and salary plan implementation, at its board meeting tonight. The district will meet at 6 p.m. in the park headquarters at 5475 Maxwelton Road, Langley. The board is set to make a decision on the implementation of the proposed Step in Grade compensation system, which board members have been discussing since mid-summer.

The compensation system is one which would set the salaries of Parks and Recreation District employees in line with those of similar Parks and Recreation districts, according to Director Doug Coutts. Parks commissioners will also be discussing the district’s field use policy and other regular business such as the Comprehensive Plan programs.

LANGLEY New Sue Taves sculpture OK’d Sue Taves’ first publicly financed piece of art in Langley sold in a hurry. As part of the city-sponsored art commission selection, she and Clinton artist Lloyd Whannell each had a sculpture on display on Second Street. Taves’ sculpture, “Waves,” sold within days. The program allows for buyers to purchase any city-backed art, though Langley had the first right to purchase it. It declined, and instead offered to put another Taves work on display to fill in the yearlong lease. Approval of the new sculpture was packed into a series of documents submitted by the arts commission on Dec. 15. Councilwoman Rene Neff asked who is responsible for cleaning and maintenance of the sculptures. “If you approve this plan, we’ll take care of it,” said Frank Rose, the commission chairman.

Storm recovery should be county’s first focus

Last week, Island County Auditor Sheilah Crider said her days of opening the administrative building to the public in the morning need to come to an end. She’s done it for years, it’s not her job and the time has come for someone else to take over. Seems fair enough, but with the complaint coming on the heels of Crider’s and other elected county officials’ recent grumbling about a commissioner-approved 2 percent raise — they wanted more and called the pay bump a “slap in the face” — it’s led at least one commissioner to speculate about Crider’s motives, insinuating that the former predicated the latter. Such vindictiveness seems difficult to believe, but at the moment the issue is hardly a pressing concern. South Whidbey was hit with a windstorm last week that first responders have called a “record breaker,” and trivial matters and political bickering in the county seat need to be shelved for another day. Homes were damaged, cars destroyed, countless power lines downed and private property ravaged. The destruction is still being weighed, but experts estimate it will run into the hundreds of thousands of dollars. Many on the South End are feeling the sharp financial sting of 69 mph winds, and who’s going to open the doors in the morning is the last thing they are worried about. They are far more concerned with how they are going to make it to work when their car sits smashed in the driveway, keeping the rain out of the hole in their roof, finding a new place to operate their business, clearing downed trees from their properties or all of the above. To date, it’s been inspiring to see how the community has reacted. Neighbors have come to each others aid, helping one another clean up and recover. Such kindliness, it seems, is a mark of South Whidbey. People help each other, and they know when the job is too much for just a few, a call for help will be answered. For example, The Back Country Horseman group has organized a cleanup this morning of the Putney Woods trail system, which the group helps maintain. No doubt, there will be many hands out there making light work of a big job. The group is meeting at 9:30 a.m. at the trailhead on Lone Lake Road. Volunteers should bring water, gloves, weather-appropriate clothing, a lunch, and be ready to work hard. At a time when so many are pulling together to recover from a “record breaker” windstorm, elected officials, especially the county commissioners, should put aside paltry county courthouse quibbles and focus their efforts on much bigger concerns.

Editor, Can this shame get any worse? Scott Dudley was railroaded out of the Island Transit board. The only person allowed to ask questions was ousted from an organization that needs to be questioned. Heads in the sand do not have clear vision as to how to fix the problem which is Island Transit. It is time to disband Island Transit in its entirety and turn it over to another transit company, such as Skagit Transit or Community Transit. Island Transit continues to run in the red, taking grant money given for specific purposes and spending the funds on whatever they feel is appropriate, deferring payments and claiming they are “in the black.” Yet employees still have benefits stripped and denied while the administrative staff suffers no cutbacks. Island Transit does what it wants regardless of the law, including the payout of $100,000 to a former director who was revealed to have inaccurately reported sick and vacation time. The paratransit services are operating out of bounds for a select few only. Route 5 has been canceled, yet para-buses continue to serve a select few on this defunct route under the guise of a “grandfather clause” which does not exist. ADA rules are very specific as to what area is covered. Only a corridor

along existing routes during route hours will be covered by para-services. No differing in what the ride is for as long as the rider is pre-approved to use para-service. There is no reason for a para-bus to be driving on East Harbor Road; this is an out-of-bounds area. Yet Island Transit para-service was granted for select riders in this area. A young para-rider who is enrolled in a para-art class must walk three miles along this road, which has no shoulder, because she has lost para-service. But the para-buses pass her by taking another para-rider home in this area. Once again, Island Transit is in clear violation of the federal law, which provides the public funding for this service, and the board has put its head in the sand. The criminal investigation into Island Transit must reach further than the theft of hours by the former director and stop the current administration from continued crimes against the taxpaying public. Bob Clay, I have asked to publish your recovery plan to no avail. It is past time for Island Transit to continue in this fashion. It must be dissolved or taken

South Whidbey firefighters’ work deserves thanks Editor, The icicle Christmas lights over the balcony danced animatedly as the wind picked up, and then the lights flickered. I lit candles to be on the safe side and set about making dinner, but as I was about to serve it, my partner Leckey’s pager erupted in static: “South Whidbey Fire, staff your stations.” Leckey put on his duty coat, grabbed his radio, and headed into the night. I put his uneaten dinner in the refrigerator, and then the lights went out. Warm and dry, I read a book with a flashlight, enjoying the silence inside. But outside, a neighbor’s wind chimes clattered wildly, gusts of wind slammed into the side of the building, and items flew off porches. Between 40 and 50 volunteer firefighters and emergency medical technicians (or EMTs) headed to six fire stations, bunked up, got into fire engines and rescue vehicles, and

responded to more than 60 calls. Although 911 dispatchers were able to take all the calls that came in, there were far too many to relay over the radio, so fire chiefs dispatched teams as calls showed up on computer maps. While I read my book, emergency responders cleared roadways that prevented them from reaching people who needed their aid. In wind gusts up to 65 mph, they put their own lives in danger as trees and branches continued to fall all around them. I went to bed worried for Leckey’s safety, but he came home at 2 a.m., tired and sore. On Friday, volunteer firefighters and EMTs all over Whidbey Island struggled to get through the day on half a night’s sleep. I’m writing to thank South Whidbey Fire/EMS volunteers for the way they care for their community and to remind them that, through Whidbey CareNet, their community cares for them. More than 30 providers offer free services to our community’s emergency responders. And storms like last night’s remind us why. In gratitude, PETRA MARTIN Whidbey CareNet founder

his wife and was struck by the car. The man said he hit the hood, rolled over and fell onto his back. He claimed that Locken was driving the car and “had a crazed look on his face,” according to the deputy’s report. Locken then drove off, the report indicates.

The alleged victim said he and his wife have had a continuing problem with Locken threatening them. The man declined medical treatment, but said his right side was sore. Locken denied doing anything and claimed he had been sleeping, the report states.

Turpin, Hodson, defense leads girls past Cedar Park By BEN WATANABE South Whidbey Record Turnovers by the Falcon girls basketball team were overcome by stingy defense against the visiting Cedar Park Christian Eagles in a 52-43 win Friday night. Playing as Cascade Conference foes for the first time, the Eagles and Falcons opened the game with seven turnovers in the first four minutes. But South Whidbey minimized its mistakes with a hard-to-penetrate zone defense and harassing defenders on the perimeter. South Whidbey took a 10-9 lead on a Megan Drake layup and never lost the advantage. The Falcons built their lead to six points by halftime and opened the second half on a tear, hitting back-to-back baskets. The game may have significance later in the season because both teams are 1A, and only the top three 1A teams from the league advance to the postseason. Free throws provided a boost for the Falcons. The percentage left something

to be desired, however, as South Whidbey’s players went 12-for-22. Cedar Park Christian fared worse. The Eagles hit 14 of their 28 free-throw shots. Early on, the Eagles showed a willingness to shoot three-pointers. The strategy may have backfired, as Cedar Park only connected on one three-point shot. South Whidbey relied on its offensive sets, moving the ball along the perimeter against Cedar Park’s defense. The Falcons also only scored a three-pointer, a secondchance basket after Drake missed a shot, recovered her own miss and was able to kick out to sophomore Kacie Hanson. Hodson gave South Whidbey its first double-digit lead of the night on a short jump shot. She and junior Emily Turpin tied for the game’s scoring lead with 13 points a piece. Nothing came easily for South Whidbey’s boys basketball team in a 52-50 overtime win over third-ranked Cedar Park Christian. Parker Collins, the Falcons’ senior star, finished with a game-high 24 points. But each and every one of those was hard-fought given the stifling defense the Eagles played all over the court and especially on Collins. “This is the one team we just didn’t know anything about,” Collins said. “We watched a little film, but that doesn’t tell anything once you get onto the court.” Now, South Whidbey and Cedar Park are intimately familiar. Inside Erickson Gym at South Whidbey High School, the competing crowds were raucous through much of the game. Cedar Park (0-1 Cascade Conference, 3-1 overall) had a sizable student crowd cheering for the Eagles, leading the often silent Falcon students to outyell their foes. The result was an electric environment, one Collins couldn’t recall being part of in previous seasons. “Today, I thought it was really fun,” Collins said. “High energy the whole game.” Having surged to an eight point lead late in the third quarter, Collins caught a pass and launched a threepointer that fell through as time expired. The shot boosted South Whidbey ahead 34-23 and charged South Whidbey’s fans going into the final period. Cedar Park Christian made a furious rally. Capitalizing on Falcon turnovers, the Eagles racked up a 13-5 run to tie the game with 4:45 remaining. Cedar Park played the final eight minutes of regulation and overtime without their star senior, David McLaurin, who fouled out with 3 minutes left. The Eagles’ quick defenders were able to poke away the ball and press enough to take a 41-40 lead after a Tim Larson three. Trailing for the first time in more than an hour, the Falcons relied on their size advantage and got the

Instead of grabbing it, he let it bounce on its way out of bounds, but an Eagle player ran past him and hurled the ball back to teammate Drew McLaurin who drilled the three-point shot with seven seconds left. “If we had gotten the ball, they would have fouled him,” said first-year Falcon head coach Mike Washington Sr. “That’s just a mistake. In a situation like that, we’ve got to get that ball.” “You can’t say too much about Parker,” he added. “Parker is the man.” In overtime, South Whidbey struck first on a Chandler Sutton layup. Following the play, Sutton sprinted back on defense, slapped the court and started clapping. His coach began clapping as well, leading the Falcon students to mirror his enthusiasm. Out of a Cedar Park time out, Collins missed a short

jumper, charged into the key for the rebound and hit the putback. South Whidbey’s final points, which proved to be the difference, came on a running floater by freshman point guard Lewis Pope. The youngest member of the Falcon squad finished with four points, but missed all four of his free throws which came in overtime and had a host of turnovers. “First time, nerves got the best of me … Now I know that situation and I feel I’ll do

better next time,” Pope said. As the primary Falcon ball handler, Pope was often pressured by one of Cedar Park’s feisty defenders. They gave him little to no space, essentially saying he could not get past them. The bill passed the House of Representatives 219-206 and if it passes through the U.S. Senate, the number of total Growlers purchased

Whidbey birders count down to important event By RON NEWBERRY Whidbey News Group In a small pond across the highway from Crockett Lake, Jill Hein spots a long string of diving ducks that scoot along the water in a straight line. “I can never get a picture of those guys,” Hein said of a species she calls scaups. “As soon as they see a person approaching, they take off.” This Saturday, Hein and others will get as close as possible to birds such as these, not to ruffle any feathers but to give birdkind a lift. Hein, of Coupeville, Jenny Brown, of Oak Harbor, and Govinda Rosling, of South Whidbey, are Whidbey Audubon Society members who are coordinators of the Audubon Christmas Bird Count that will be taking place on two different dates on Whidbey Island. Hein and Brown are organizers of the island’s north count, which will take place Dec. 20, spanning Coupeville and Oak Harbor. Rosling coordinates the south effort, taking place Jan. 3 and stretching over much of South Whidbey up to Greenbank and even to the shores of Camano Island. The purpose of the Christmas Bird Count, which is in its 115th year, is to gain global data of bird populations to aid research and conservation efforts. It is regarded as the longest running citizen-science survey in the world. “The Bird Count is one of the sources they used when Audubon came out with huge climate change information,” said Brown, a retired elementary school teacher. “They can really see some trends. They think over half of our birds are in danger. Their ranges are changing rapidly because of climate change.”

Whidbey Island is a popular landing spot for migratory birds and offers the sort of diverse habitat that keeps many resident birds content. This time of year, participants in the count expect to see a large variety of birds, including shorebirds, wading birds and raptors. Each team normally has one birder particularly skilled at bird identification. Participants don’t have to be Audubon members. North Whidbey teams

have been formed; however, residents of Oak Harbor and Coupeville who’d like to share bird counts from their own property on Dec. 20 may do so by emailing Brown at jennywahere@ gmail.com. South Whidbey teams are still seeking participants for their Jan. 3 count. Those interested may email Rosling at govinda@whidbey. com. The most common bird found during the north count last year was the European starling with 2,483 counted, followed by the seagull (1,783), American wigeon (1,443) and American robin (1,007). Also sighted were: 856 blackbirds, 828 dunlins, 812 dark-eyed juncos, 809 mallards, 658 northern pintails, 64 bald eagles, 59 common loons, 50 great blue herons, 35 Anna’s hummingbirds and 22 great horned owls, among many others. Crockett Lake in Coupeville and Deer Lagoon on Useless Bay are among the favorite places to visit for serious birders because of their rich diversity of species, particular migratory shorebirds. Each are labeled Important Birding Areas by the National Audubon Society. “We really are very fortunate because we have so many different habitats here,” Brown said. “We have a wide variety of birds that either live here or visit.” Whidbey Audubon, organized in 1982, orchestrated its first Christmas Bird Count in 1987. Rosling started the South Whidbey count three years ago. Hein hopes to get out to Crockett Lake. “I love sea birds,” Hein said. “Crockett Lake has so many of them. There’s just a large variety of birds.”

put together a warm clothing drive that brought in a few dozen jackets, scarves and gloves. Inspiration for the stuffed animal drive this year came during a car ride. Weston heard a radio commercial about gifts for foster children, prompting him to tell his parents that he wanted to give presents to the shelter. “Santa has a hard time finding them because they don’t have houses,” Weston said. He’s hoping to get 40 stuffed animals, either new or gently used, to give to young children — his peers — for Christmas presents by the weekend before the holiday. Weston, himself a fan of

stuffed animals and the comfort they bring him, wanted his peers living without permanent housing to have a similar experience this holiday season. “Because I feel good with stuffed animals, and I think they’d feel good with stuffed animals,” Weston said. “We’re gonna have a bow on them so it’s like a

Christmas present,” he added. Randy Haacke, the donor partnerships director at Everett Gospel Mission, said its two shelters serve an estimated 300 people every night and that there are an estimated 2,300 homeless men, women and children in the tri-county area. “It’s a growing population,”

they serve is always in flux, he added. One stuffed animal that won’t be gifted is “Woofie,” Weston’s favorite nighttime pal. Weston and Woofie, a stuffed dog that was purchased for him when Jennyrose was still pregnant with him, are hardly separated when it comes to sleep. Preparing for a sleepover with his cousins visiting from San Diego, Weston had to unpack Woofie to show it to The Record. Upon doing so, Weston happily pointed out that the W in the word “Woof” written on the blanket was the same letter in his name. “That’s a W, and that’s in my name,” he said. Just like Weston, Haacke said the presence of a stuffed animal can be stabilizing in a homeless child’s life. “It’s also a great sense of comfort,” he said. “Having your own possession in a place where you don’t have a lot of your own possessions is a great comfort.” Later, he added that: “Someone coming and handing them gifts and sharing

Auditor closes window on opening county doors By JANIS REID South Whidbey Record Determining who should open the doors of the Island County’s administration building on 6th Street hangs in the balance. After three years of handling the task, Auditor Sheilah Crider is asking the new facilities director to take the torch. The move comes after elected officials, including the auditor, told county commissioners last week that a lastminute budget change from a 4 percent raise to a 2 percent raise was “a slap in the face.”

Sheilah Crider Commissioner Jill Johnson, who supported the change to

a 2 percent raise, said the timing of Crider’s door-opening complaint “raises questions, and the issue is petty.” Crider said she stepped up to open the building’s three doors when the previous facilities director was out with an injury for nearly two years. “We took on that responsibility,” Crider said Thursday. She denied that the move has anything to do with the recent raise debate and that the facilities department opens all the other county buildings. “That’s the only building that Facilities has not returned to opening,” Crider said.

Facilities Director Larry Van Horn said Monday he was surprised that Crider emailed the commissioners and not him. An email was later forwarded to him. “I was a little taken aback that no one contacted me directly,” Van Horn said. Van Horn said that the buildings now opened by Facilities are opened between 7:30-8 a.m. and are accompanied by required maintenance checks. Staff is then deployed on various county projects both on Whidbey and Camano islands. The administration building doesn’t open until 9 a.m.

“We can be flexible, but there’s going to be days when we find it a challenge,” Van Horn said. “There’s 30-40 employees in there who are capable of opening the doors.” Van Horn said he has yet to discuss the issue with the auditor or the commissioners, but is willing to work out a solution with them moving forward. Island County Prosecutor Greg Banks, who took the lead for elected officials on the raise debate, said he doesn’t believe Crider is grandstanding. “I can’t imagine Sheilah

Crider would retaliate against the board over the salary resolution,” Banks said. “I think it has been an administrative point of contention for quite a while.” Banks said the issue of compensation for elected officials — which includes himself, the auditor, the sheriff and the assessor to name a few — is largely misunderstood. While the door-opening issue has yet to be resolved, Crider said her office will continue opening the doors to the public until a solution is found.

in a timely manner. Hawkins also grilled Emch over an internal investigation that the hospital is fighting to keep secret. Under questioning, Emch claimed that the internal investigation is solely a product of the quality assurance committee and that the hospital never conducted a disciplinary or humanresources investigation into Gipson’s actions. The Prosecutor’s Office, however, decided there is enough evidence from nurses who witnessed the event to

charge Gipson with a crime. Hawkins questioned whether the hospital’s quality assurance process is really “an end run around the Open Public Records Act.” The law protects quality assurance reports from disclosure, but not necessarily disciplinary investigations. The deputy prosecutor and attorneys for Gipson and the hospital argued over two subpoenas duces tecum — subpoenas for evidence — during the three-hour hearing, but the issues were not

settled. Hawkins scheduled another hearing for Jan. 6. The prosecutor subpoenaed the hospital’s internal investigation into Gipson’s conduct, but the hospital’s attorney is claiming it is exempt from release because it is a protected work of a quality assurance process and attorney-client privilege. Lawrence said it appears that hospital officials only extend its “privileges and protections” when it serves the hospital. She claimed that the hospital recently handed over an internal investigation of an employee accused of fraud and forgery to a law enforcement official; in contrast, officials declined to hand over an internal investigation even after Gipson — a member of the administration — was charged. Hawkins wants an evidentiary hearing to determine whether the report is a protected product of a quality assurance process. Hospital employees involved in the process will have to testify at the hearing. Gipson’s attorney, Andrew Schwarz of the Seattle firm Schwarz-Garrison, subpoenaed the alleged victim’s entire medical history. The prosecutor is fighting the subpoena, arguing that it is an unnecessary invasion of the woman’s privacy and would

allow Gipson to “pad” her knowledge of the woman’s medical history for a selfdefense claim. Schwarz argued that the alleged victim, who has a lengthy history of mental illness episodes, has made false claims of being assaulted at the hospital previously and he needed the medical records to support the defense. “Her bias is huge. She’s asking for a huge amount of money,” he said, referring to the alleged victim’s lawsuit against the hospital this fall. In addition, Schwarz said the medical records the prosecutor provided for the alleged victim’s recent hospitalization were incomplete. Lawrence pointed out that he has the same records she does. The alleged victim signed a waiver and the hospital was supposed to hand over the complete file. She said it was news to her if they are not complete. In the end, Hawkins said Schwarz’s arguments for the release of the records were persuasive. But he said he would review all the pertinent records before making a determination about what should be released. Hawkins said he wanted to find a way to “minimize the intrusion” into the woman’s medical records while still providing the defense the records it needs.

internal controls and created fake documents on a daily basis to avoid detection. Brown was a “low level supervisor” who was in charge of three to six bank tellers. Brown stole cash from her cash drawer from 2010 until she was caught in August 2013. Brown concealed the theft by creating a “cash ticket” in the computer system without creating a corresponding ticket in the bank’s ledger; instead, she created a false “general ledger screen shot from a template on her computer,” the sentencing memorandum states. “The defendant engaged in this deceptive conduct nearly every day for three years, including days when she had mandatory vacation,” Assistant U.S. Attorney Justin Arnold wrote. Brown convinced her fellow employees to allow her to balance the general ledger — convincing them that she was “doing them a favor” — even though it was against bank policy, the document states. The theft was finally discovered in August 2013 when an injury forced Brown to miss work and other employees uncovered the scheme. She admitted to the crime in interviews with the FBI and the FDIC, the report states. “The defendant’s actions not only caused the bank economic harm, but negatively impacted the lives of the defendant’s coworkers,” Arnold wrote. The branch manager was reprimanded and placed on probation for allowing Brown to work on vacation. Other co-workers were disciplined and the branch lost half of its staff, the document states. The document states that Brown needed the money because of “unforeseen economic problems in her household” and that she had a troubled upbringing which caused depression. Brown is not accused of stealing from bank customers. “There was no involvement of customer funds or customer accounts,” said Bryan McDonald, the executive vice president of Heritage Bank. Whidbey Island Bank and Heritage Bank merged in May.
