A 32-year-old Federal Way man was charged with several counts of communicating with
minors online in a sexual manner. The Bend Police Department in Oregon investigated Micah Kevin Kennedy after one of the victim’s parents saw that her son was communicating with Kennedy on his cell phone. The police took over the phone and coordinated a meeting with

Kennedy, who believed he was meeting the juvenile male and was arrested, according to Cathy Schrock, Federal Way police spokeswoman. Bend police prepared a search warrant for the apartment in Federal Way Nov. 6 in the 28400 block of Pacific Highway S. Federal Way police assisted with the warrant
service. At this time there are no charges in Washington. Police believe Kennedy brought juvenile males from Oregon to Federal Way, but there is no evidence at this point to show a crime occurred in Federal Way. The case is also being looked at for federal prosecution, Schrock said.

“We have to make an arrest if the crime occurred within a four-hour period,” Hwang said. “Generally one of the parties will be arrested.” Police have to err on the side of caution, Hwang added, because even if there’s no visible injuries but someone’s alleging assault, the intent of the law is to prevent further violence. “Where somebody could make a false allegation, that’s where the training and expertise of officers comes in,” he said. “Officers are in a tough situation.” If an arrest is made at the scene, the suspect is held without bail until they see a judge. Suspects arrested for a felony have their cases heard in King County Superior Court, while the Federal Way Municipal Court judges hear misdemeanor and gross misdemeanor cases. Someone charged with a misdemeanor can face up to 90 days in jail with a $1,000 fine and a gross misdemeanor conviction will be up to 364 days in jail, a $5,000 fine and five years of probation for each crime. Felony sentences are broken into different classes and can vary in length or severity based on the suspect’s “offender score.” After a suspected abuser sees a judge for his or her arraignment, they may be let go on personal recognizance with conditions or bail is imposed. Although the defendant has a right to a speedy trial, Larson said there are waivers and it can often take longer for more investigation time. If the suspect chooses not to plead guilty, a trial
date is set, a jury is chosen and prosecutors have the burden of proof to prove the suspect is guilty beyond all reasonable doubt. Federal Way domestic violence prosecutor Pauline Freund has worked for the

Police ran the name the homeless man gave the victim but could not find him. Sex offense: At 7:21 p.m. Nov. 9 in the 100 block of S. Third St., a woman reported that her 14-year-old daughter was video chatting an unknown male via Skype on Nov. 8 and the daughter took off her clothing at the man’s request during the video chat. She told police the girl was naked for approximately 10-15 minutes while the chat was being broadcast. The 14-year-old refused to go into detail about the chat itself, but said that the next day she was again chatting the male and he told her in the chat that he had recorded the previous video chat while was naked. She said he threatened to post it on the internet if she did not do it again, but she refused. The girl could only provide police the male’s Skype ID. She said she thought he said he was from Europe, but was unsure. She also provided police a series of numbers the man listed as his mobile phone number on his Skype profile. Rock attack: At 1:37 p.m. Nov. 10 in the 2900 block of SW 320th St., two unknown suspects placed garbage cans in
lot. An officer found a male and female in the backseat and they claimed they were not having sex, but were planning it. The male gave a false name and police discovered he had a warrant out of Federal Way for obstructing. The male was transported and booked into SCORE without incident and the female was released at the scene. Juvenile runaway arrested: At 1:26 p.m. Nov. 7 at 1928 S. Commons, a woman reported her boyfriend’s child, who was wanted as a juvenile runaway and had a warrant, was at The Commons mall. Dispatch stated he had a current no bail warrant for dependency. Officers arrived and detained the juvenile without incident. Son runs away for trading cards: At 2:15 p.m. Nov. 8 at an unknown address, a woman reported her foster son as a missing person. She advised he might be off trying to find more Magic the Gathering trading cards. Staff at West Coast Sports Cards were informed he might be arriving at their store. When he did arrive three hours later, police were called and the boy was escorted home without incident. Homeless man robs helper: At 11 a.m. Nov. 9 in the 2200 block of S. Star Lake Rd., a man reported he allowed a homeless man to stay at his residence for the past two days. He took a nap and left the man in the living

Upon inspection, the handgun was found to be an Airsoft toy gun and it was wet from the rain. Police could not find any recent incidents in the area where the gun was used and no suspicious circumstances were involved. The gun was submitted for destruction. No known owner was found. Domestic violence reported: At 2:13 p.m. Nov. 5 in the 31000 block of 42nd Place SW, a female told police she began dating a male a few days ago. A dispute began when he was flirting with her cousin. Also, a window was broken from a truck parked on 30th Avenue Southwest, most likely from the same suspects. Police did not locate the suspects. Burglar throws chair into wrong window: At 7:49 p.m. Nov. 10 in the 2100 block of SW 337th Place, police were called to a residential burglary in progress. Upon arrival, officers determined a man threw a chair into an apartment window, but realized it was not the correct apartment he intended to break into. He had planned to break into his daughter’s apartment. The man then broke the window to his daughter’s apartment and gained entry, damaging the apartment before gaining access to her bedroom. The suspect fled prior to police arrival. Suspect caught in hospital: At 7 p.m. Nov. 10 at 34515 Ninth Ave. S., police received a tip that a suspect wanted for an outstanding felony juvenile warrant was at St. Francis Hospital for treatment. Once the man was positively identified and contacted, the warrant was confirmed and he was arrested. He was transported to the King County Juvenile Detention for booking.

State Representative, Roger Freeman, died Wednesday, October 29, at St. Francis Hospital in Federal Way. He was born on November 30, 1965 in Omaha, Nebraska. He was an attorney for Society of Counsel Representing Accused Persons (SCRAP) for 19 years. Roger was elected to the Federal Way City Council in 2009, then went on to win a seat for the 30th District in the Washington State House of Representatives in 2012. He was running for re-election at the time of his death, and will be remembered as a motivator, encourager, and an advocate for all, especially those with no voice. Roger is survived by his wife, Sonya; daughter, Ayana; and son, Isaiah, of Federal Way; his mother, Janice Stambaugh; father, Roger Freeman; brother, Henry (Hank) Hobson; and sister, Lisa Ward, all of Omaha, NE. He was preceded in death by his maternal and paternal grandparents. A Celebration of Life service will be held on Saturday, November 22 at 1:00PM, at Our Savior’s Baptist Church, 701 S. 320th St, Federal Way, WA.

heers to Federal Way Municipal Court Judge David Larson for raising awareness about how domestic violence affects our community. Last month, he partnered with the Tukwila Municipal Court, the Supreme Court Gender and Justice Commission and St. Vincent de Paul Parish and held a public workshop on the issue that inspired the Mirror to publish a domestic violence series. Jeers to Weyerhaeuser for moving its headquarters to Seattle, effective in 2016, after establishing its roots here more than 40 years ago. Cheers to Federal Way Public Schools for involving the community in their superintendent search. Cheers to Interim Superintendent Sally McLean for stepping up into the superintendent position and providing much-needed stability to the school district. Jeers to former school board President Tony Moore and to former Superintendent Rob Neu for their conduct. Moore was convicted of seven counts of felony theft in April. Neu promised 100 percent graduation rates but “left school early” when he took a new superintendent job with Oklahoma City Public Schools the same week his counterpart was convicted. This was also after the district gave Neu a handsome raise that made him the third-highest paid superintendent in Washington state. Cheers to school board member Hiroshi Eto for his constant letters to the editor and opening dialogue with the community. Jeers for traffic camera tickets and cameras that are questionably legal. Cheers to the Federal Way City Council for extending its moratorium on marijuana-related business in Federal Way to give city officials enough time to mull the issue. But jeers to the Council for confusing the public when it voted to extend its moratorium last month. They left a 19-day gap between the current moratorium’s expiration date (Nov. 5) and when the extended moratorium takes effect (Nov. 24). Cheers to Kohl’s, DICK’s Sporting Goods and Seattle Children’s Hospital for recognizing that Federal Way is a great place to do business. Jeers to those who illegally grow marijuana, including the grow-op that caused a large fire that destroyed businesses last month. Cheers to the late Rep. Roger Freeman for his service to the Federal Way community and 30th Legislative District. Jeers to the school district for selling the former bus barn property to a developer who will build the High Point project. The affordable housing the project will provide will not outweigh the neighborhood issues the project will cause, including more traffic in an already-congested area. Cheers to Mayor Jim Ferrell and Council for coming up with a biennial budget that involves no new taxes nor cuts. Cheers to former Mayor Skip Priest for leaving millions of dollars in reserves to help make this possible. Jeers to the school district and Neu. Their recent spending spree on travel was a black eye to the district. Cheers to all of the 30th District candidates who played above board during the campaign and didn’t mudsling. But jeers to all the negative campaigning during the election season. Cheers to the mayor for his efforts to keep the Public Health Center open in Federal Way for another two years. The clinic serves approximately 13,700 low-income mothers and children every year. Jeers to the school district for continuing to use the questionable standards-based grading system. Cheers to Mr. Federal Way, who keeps his humor through good times and bad. Jeers to the Mirror for their lack of any Y chromosomes in their editorial staff.
Reflections on election and looking ahead Turnout, turnout, turnout! Those who vote get to decide for everyone else what is important and who wins! History says the opposing party to the president makes gains in off-year elections. And history keeps repeating itself. Nationally, Republicans took control of the Senate from the Democrats and cemented their hold on the House of Representatives. And Federal Way played kingmaker by providing the 25th vote to give Republicans control of the state Senate with Mark Miloscia’s win over Shari Song. Republicans will actually have 26 votes as Democrat Tim Sheldon will continue to caucus with the Republicans. The Democrats will have 23 votes in the Senate. Washington is a blue Democratic state when most voters vote. But Republicans tend to be more consistent voters in off-year elections. Republicans knew they had a chance to make a big move this year and they did, as moder-
ate voters joined conservatives to change the dynamics in Olympia. Republicans didn’t quite win the state House, but they came close enough to make political life for Democratic Gov. Jay Inslee and Democratic House speaker Frank Chopp more of an adventure than ever before. Conservative-to-moderate leaning voters joined liberals in passing Initiative 594 to require additional background checks on the transfer of guns, with close to 60 percent, but voters apprehension about the true impact of Initiative 1531 regarding school class size dropped the vote to 51-49 percent in late returns. Voters had been polled all year as favoring additional gun requirements as too many acts of violence had occurred, not in some other far away state, but right here in our home towns. Roger Freeman, Proud to call Federal Way home Federal Way’s advocate Thank you to all those involved in making the city so beautiful. As I traveled across Veterans Way (South 320th Street) towards the east it made my heart swell to see those glorious flags waving in the wind. The red, white and blue against the beautiful blue sky and our majestic Mt. Rainier to the right made a picture I have captured in my mind.
In the 39 years that I have lived in Federal Way, two elected officials stand out for their dedication to serving the poor, the underprivileged and the vulnerable. The first was my friend, former state Sen. Mary Ann Mitchell, who was so devoted to seniors that we named a senior housing complex (Mitchell Place) and a
street overpass after her. The second is the late state Rep. Roger Freeman, whose reputation for effective legislation and caring for the most needy transcends the borders of his legislative district. With a degree in law, he could have chosen a lucrative career. Instead, he chose to defend those who need help most. People from as far away as Redmond and the Kitsap Peninsula have told me how lucky I was to have a representative who cared for people from all walks of life. Thank you, Roger, for caring about others rather than serving yourself.

www.federalwaymirror.com ballots, the initiative would have passed by a larger margin, just as a similar one did several years ago, the house would still be under Chopp’s firm control, the Senate would have a Democratic majority leader, and the progress the democrats made on the east side of King County would have continued. But the Republicans were more energized — and they voted. In Federal Way, the 2014 election will always be remembered for Democratic state Rep. Roger Freeman whose courageous battle with cancer came to an end just a few days before the election.
However, Freeman won and his position will now be filled by appointment. Freeman had been locked in a tight race with former Federal Way Mayor and Councilman Jack Dovey, a Republican. Freeman’s win should not be seen as simply a melancholy vote in appreciation of his service. He was well liked and Dovey held an impressive resume of accomplishments in local politics. But questions about Dovey’s financial dealings in the closing days of the election undermined his campaign. As expected, Republican incumbent Linda Kochmar defeated firefighter Greg
Baruso and former Democratic House member Mark Miloscia was elected as a Republican to the state Senate. Due to its statewide importance, the race between Miloscia and Democratic businesswoman Shari Song was heavily financed and hard hitting. Miloscia supporters repeatedly accused Song of being a carpetbagger and only moving here to run for office. She couldn’t seem to put the allegation behind her. Her campaign tried to use women’s issues as a wedge to move voters into her column but the vote totals suggest local voters already knew of Miloscia’s

upstate New York. The damage in the Oso mudslide area will seem trivial compared to what can happen here in Washington from a typhoon. Gov. Jay Inslee has expressed concerns about the oyster growers in Puget Sound. He has made minor noises about trivial aspects of this problem. He has made no major effort to override the Washington state Senate’s inaction. He will have to show much greater leadership. Even his alliance to develop an effective plan with the political leadership of California, Oregon and British Columbia is insufficient and amounts to nothing more than a stalling tactic in the face of the crisis before us all. They have all failed to present their problem to their respective federal governments. It has become clear that some of the decline in the rate of global warming is a direct result of the warming of the oceans as they store
the heat in deep waters. This warming will soon majorly change currents. These coastal currents keep temperatures within a moderate range all the way into Canada on both coasts. Loss of these offshore warm currents can happen here and increase the temperature range along our coast that keeps Washington such a pleasant place to live. A direct result of the warming deep ocean waters, to make matters worse, is that methane, which is contained on the bottom in the deep ocean depths along both coasts, is being released and bubbling up into the planet’s atmosphere. Methane is about 80 times worse than carbon dioxide in heating the atmosphere. In addition, recently scientists have linked our excessive use of agricultural fertilizers to the formation by bacteria from ammonia to nitrogen oxides that acts just like methane. The current warming

Based on GPS measurements that indicate the rise of the mountains points to a loss of 63 trillion gallons of water. In our area, one has only to look at Mt. Rainier to see the loss of glaciers on its flanks. Other work using satellites points to a further loss of 123 trillion gallons of water from deep ground waters just on the West Coast. Another factor is the effect of stronger, warmer easterly winds that are pushing a huge deep water wave of warm water toward the western coast of the Americas.

Police, school district team up to serve 120 families FROM STAFF REPORTS
The Federal Way Police Department and Grace Church will again partner this year for the annual Adopt-A-Family Program. The need in the Federal Way community continues to grow and this partnership has proven the police department and church can serve more families with combined resources, said police Chief Andy Hwang. “We are extremely grateful for the generous support from various organizations and individuals that make it possible for us to serve others in need in our community, and our goal this year is to double the amount of families,” he said. Federal Way Public Schools will identify and

Grace Church will host with the assistance of their members, and Federal Way police representatives, a Christmas experience for 120 families. The experience allows parents to select gifts for their children and have assistance wrapping them, all while their children are supervised making crafts/ gifts for their parents. The families will also go home with a ham for their holiday dinner. The event will be held in mid-December. This is the second year in a row that the police department has leveraged resources to allow the partnership to double the amount of families they can serve, due in part by The Korum for Kids Foundation and other community sponsors. Larson said. “Then you’ve got on the other side of the spectrum, somebody with five or six domestic violence violations that may never get past a push or slap. And then you have the person that, hypothetically, the worst they have had is maybe a traffic ticket and they end up killing their family. How can you as anybody, let alone a judge, figure out which cases are going to be dangerous and which cases aren’t?” Larson said the way to try and figure it all out is through training, education and not simply going through the motions. “If you care about this stuff, it can be very challenging,” he said. “If you’re just thinking you’re up there on the bench, checking boxes, then it’s easy but I’m not a box checker.” The judge’s motto is “no repeat customers,” which is also the goal of probation. “One time I was at Federal Way High School speaking to some students and they said, ‘Well, you don’t handle very important cases do you?’” Larson recalled. “And I said, ‘I was a civil lawyer before I became a judge and my cases were complex litigation involving 25 or more parties, I managed 15,000 lawsuits nationwide and everything else, I mean, I get complex litigation. “My response was, ‘Actually they’re the most important cases because I can reach somebody before they graduate to felonies. I can try to work with somebody because at the entry level court, this is where we get people so they don’t go on further and do worse things, whether it’s a traffic offense, whether it’s a crime, this is an opportunity and most of our ‘customers’ are between 18-25 and that’s all crimes, not just domestic violence. And if we can reach people and get them to stop doing what they’re doing, then we’ve accomplished something.”

Woman in custody battle with former NBA player claims baby is in Spain BY RAECHEL DAWSON rdawson@fedwaymirror.com

ederal Way resident Sandra Boughner hasn’t seen her infant daughter Rahda since early October. The baby’s currently in Spain with her father, a former NBA basketball player from Federal Way, Michael Deangelo Dickerson. Boughner would not speak to the details surrounding the custody battle per her attorney’s recommendations but confirmed the case at hand. Her friends recently set up a gofundme.com account, a website that allows users to request funds for causes, in hopes to raise $50,000 toward legal fees Boughner is expected to accrue. The site currently has $1,025 in donations. “She basically just fell in love with the wrong guy,” said her friend Je Myung, one of the organizers of the crowd funding account. “It’s frustrating for me because even while she was in Spain, I was like, ‘Why don’t you go to the police?’” Myung and Boughner have been best friends since high school. Myung attended Thomas Jefferson
High School, while Boughner attended Federal Way High School. Myung said Dickerson and her friend have had an on-again, off-again relationship throughout the last 10 years with alleged issues of controlling behavior. But their relationship didn’t start to worry her until Boughner took a trip that would change her life. The two had gotten engaged, Myung said, and the trip was meant to be a spiritual one to deepen their faith in Hare Krishna. They planned on visiting India, Thailand and Spain. “I thought that’s great, you get to travel the world,” Myung said. “But we didn’t know she was pregnant. Rahda was born on July 5, so she was pregnant during that time.” It got more alarming for family and friends when they weren’t able to get ahold of her because they hadn’t spoken to her for months at a time. They eventually reported her missing with the belief that she was forbidden from contacting them. “Around July or just before August is when she finally reached out,” Myung said, noting her friend had

Boughner came back to Federal Way in August to tell family and friends about her year, but Myung found it strange Rahda wasn’t with her. Dickerson reportedly refused to let Rahda go with her mother. During that time, Boughner found out he had allegedly been “communicating with a lot with other women” and he was in a financial bind. “It was the father’s idea to travel,” the gofundme. com account states. “He agreed since Sandra was
pregnant and had to quit her jobs in order to travel with him that he would pay her monthly bills, making her financially dependent on him.” While in Federal Way, she discovered all of her monthly bills from the last five months before Rahda’s birth were sent to collections and her SUV was in repossession. “Everything he had been telling her was a lie,” Myung said. Boughner boarded a plane on Sept. 6 to Spain with the intent to bring Rahda home as their relationship clearly wasn’t going to work out, Myung said. When she got to Spain, she realized he “pretty much disappeared.” “He kept stringing her along,” Myung said. “She didn’t want to go to the officials at first, she wanted to work it out. He kept saying they’d meet Sept. 12, Sept. 26, whatever.” Finally, in October, Boughner was able to see Rahda for five days before he “flipped again.” “He left with Rahda in the middle of the night while she was asleep and wouldn’t respond to calls,”
Myung said. According to the gofundme.com account, on the fifth night, Dickerson “told Sandra he was taking baby Rahda upstairs for a bath” but never returned. He allegedly sent her a text the next morning telling her to leave his cousin’s house, where he was staying. Boughner contacted the Spanish police department and filed a police report but when police went to Dickerson’s cousin’s house, he showed them the custody documents. Police told her to get an attorney. Boughner flew home to Federal Way on Nov. 2 after her attorney told her there was no point in being in Spain. Now, she’s in the process of working with an attorney from Flexx Law in Seattle to determine the jurisdiction where the custody suit can take place. Since they are both from Washington and have lived or have properties in South King County, Boughner is arguing that her case should be heard here. “Hopefully there’s a light at the end of the tunnel,” [ more BABY, page 18 ]

Seahawks’ Lynch is as good as ever, if not better A his career at an age when most running backs are slowing down. And on a day when quarterback Russell Wilson struggled, throwing two interceptions, Lynch also showed he is just as important to Seattle’s offense as ever. “He’s our backbone, man,” said guard Alvin Bailey. “We know day in, day out that we can hand him the ball and each time he gets it, he’s only going to get better. He’s our backbone, man. I couldn’t imagine our offense without the way he runs the ball, because that’s our attitude. That’s what we all feed off of.” Lynch was not available to comment after the game, having left the locker room before it opened to the media. But any teammate who was asked about him had the same opinion of the running back who has been the driving force of Seattle’s offense since coming here in a 2010 trade: he’s as good if not better than ever, and he’s as valuable to the offense as ever. “Each year he’s gotten better since I’ve been here, so that’s been pretty amazing to see,” said fellow running back Robert Turbin. “To me he’s the best running back in John Boyle

Bowman could have hit Lynch, though it’s highly unlikely that he would have done anything to prevent the 16-yard touchdown that was Lynch’s fourth score in Seattle’s 38-17 win. Lynch’s friend and former teammate Michael Robinson wrote on Twitter that Bowman, “made a business decision,” and it was a decision we’ve seen plenty of defensive backs make over the years when it comes to getting between Lynch and his desired destination. Sunday’s 140-yard, fourtouchdown game, which was part of a team-record 350 rushing yards, was just the latest impressive effort from Lynch, who at 28 is showing no signs of slowing down. If anything, Lynch showed again against the Giants that he might be playing the best football of
the NFL.” Seahawks head coach Pete Carroll has repeatedly said this year that Lynch looks the best he has since coming to Seattle. And left tackle Russell Okung says even now that Lynch isn’t done improving: “There’s a lot more in him. I’m excited to see where we’re going to go in the future with him.” Even receivers, who in theory should want fewer handoffs to Lynch and more passes thrown their way, know that the Seahawks are at their best when Lynch is involved and productive. “Marshawn Lynch is our engine,” receiver Doug Baldwin said. “Everything runs through him. “Man, he is unbelievable. Any time he touches the ball, something magical happens, and he did it again today.” There have been reports this season about a disconnect between Lynch and his coaches, and it has long been speculated that he may not see the final year of his contract for salary cap reasons. But Sunday’s game, and really the first nine games this season, both when Lynch has been heavily involved in the offense and just as significantly when he hasn’t, show that he is very much still the Seahawks’ present, regard-

But even though Lynch represents an $8.5 million salary cap hit, and even though he’ll be a 29-yearold running back with a ton of physical carries on his resume, and even though the Seahawks need to find money to pay some of their young players headed towards second contracts, most notably Wilson, it’s becoming increasingly difficult to envision this offense without Lynch in 2015. Or at least to envision this offense functioning at a high level without him. And it isn’t just that Lynch is so hard to tackle. Or that he’s deceptively fast
and nimble. Or that he’s an underrated pass catcher that makes him so important to the Seahawks. It’s also the identity he helps bring to Seattle’s offense. “Marshawn’s one of my favorite people of all time,” center Max Unger said. “Just the way he does it on the field. It’s amazing. We want to just claw and fight for every yard he gets. “Him pulling the pile and just fighting for yards every time he gets the ball, that’s huge. It’s really just amazing. He’s a freak. Beast mode.”

Seahawks tight end goes on season-ending injured reserve BY JOHN BOYLE The Herald
A week ago, head coach Pete Carroll talked optimistically about his beat-up Seattle Seahawks finally getting key players back from injuries. And yes, the Seahawks were indeed healthier for Sunday’s game against the New York Giants than they had been in several weeks, but this week has brought more significant bad news on the injury front. On Monday, Seattle placed de-
fensive tackle Brandon Mebane on injured reserve, the result of a torn hamstring suffered a day earlier. And on Tuesday another key player was ruled out for the remainder of the 2014 season with tight end Zach Miller also landing on injured reserve. Miller had missed the past six games while recovering from ankle surgery, but the Seahawks had hoped to get him back at some point this season. Instead, Carroll said Miller just didn’t recover as well as expected, and will need
another operation on his ankle. “He doesn’t feel right,” Carroll said. “He’s not ready, it’s not like he’s really close to getting back. It’s just been a long process. He had a nasty ankle and they were hoping to not do a really big surgery to give him a chance to be able to play this year, and it just isn’t that way. So they’ll have to do the final work there and get him set up for next year.” While Miller has never been a prolific pass catcher since signing with the Seahawks in 2011, he’s a vital part of their offense for his
blocking ability, both in the running game and in pass protection. Now that the Seahawks know definitively that they won’t have Miller back this year, they’ll go forward with Luke Willson, who himself is recovering from an ankle sprain, Cooper Helfet, and two recent additions, veteran Tony Moeaki, who they signed last week, and rookie RaShaun Allen, who was signed off Minnesota’s practice squad Tuesday. “We’ll all be ready, the tight end group, to do whatever they ask us

: Mr. Federal Way, we were so disappointed that the Mirror did not cover the recent “Shindig” fundraiser for the Performing Arts and Conference Center. Why doesn’t the Mirror support such a worthwhile project? A: Mr. Federal Way doesn’t need to spell out what happens to people when they assume things — at least not in this community paper. But before Mr. Federal Way answers your question, some context to the situation may offer more illumination than the miniflashlight some keep in their pockets. Last week, Mirror staff heard feedback and criticism from several people in Federal Way, expressing disappointment that newspaper staff were not at the event. On Monday, the newspaper received two letters to the editor on the
subject. On Tuesday, the editor was approached during an election night party at the Twin Lakes Golf and Country Club with similar comments. These people were probably prompted by one of the Shindig’s performers, who made a big fuss during the event that no one from the Mirror was present. Mr. Federal Way will leave it up to your imaginations to decide whether Mr. Federal Way heard the artist’s comment from him, or from Mr. Federal Way’s insiders. Nevertheless, the puzzling thing is that Mirror staff had been in touch with the event organizers since early October trying to land an interview with one of the Shindig’s performers, Robert McPherson. The Mirror hoped to interview McPherson and publish a preview story prior to the event to ensure a packed
house the night of the fundraiser. An event organizer notified staff that she contacted the artist and urged him to contact the newspaper on numerous occasions. The Mirror was disappointed that the artist never responded. The newspaper published a write-up about the event in print a week prior to the event and also included information in our community calendar for weeks leading up to the Shindig — the same treatment we would give to any other community effort such as this. So the assumption that the Mirror doesn’t support the Performing Arts and Conference Center is outrageous. Mr. Federal Way is certainly a patron of the arts and may purchase tickets to future performances there if the price is right. And Mr. Federal Way will stress that our editorial board has never endorsed the project, one way or the other. The bigger question is, what prompted the Shindig [ more MR. FW, page 27 ]

Students explore epidemics with UW Medicine FROM STAFF REPORTS
Students at Nautilus Middle School participated in a unique lesson on epidemics last week, with the help of staff from University of Washington Medicine. Nautilus teachers Dan Haegele and Candace Ray helped create the partnership with University of Washington Medicine to bring the lesson to the school. Students researched historical and current epidemics and also learned how a virus attacks animal cells. The university visited Nautilus and worked with the

students to help them learn how diseases spread. Students also visited the University of Washington research facility to learn about the daily activities of researchers. For their culminating project, the students will put together a Center for Disease Control panel to control an epidemic of their choice.

Center will no longer be a distribution center for holiday gifts for children, the organization will still provide holiday food and is working with several other non-profits to provide Hope for the Holidays by providing holiday gifts for children of low-income or homeless families. The community can purchase new, medium-sized toys, games, or gift cards for children ages 1 to 18 years. Gifts should be valued at $20 or more as this may be a child’s only gift. Gifts should be unwrapped and delivered to the information booth at The Commons at Federal Way, Multi-Service Center at 1200 S. 336th in Federal Way, or to any participating Hope for the Holidays collection sites by Dec. 12.

Jury rules in city’s favor in wrongful termination lawsuit Longtime police lieutenant plans to file second appeal in six-year case BY RAECHEL DAWSON AND CARRIE RODRIGUEZ The Mirror

King County Superior Court jury recently found that the city of Federal Way did not wrongfully terminate a long-time police lieutenant twice in 2006 and 2007. The former Federal Way police lieutenant, Robert Piel, and his wife filed a civil lawsuit against the city in January 2008. The suit involves nearly seven years of legal maneuvering, including a Supreme Court appeal that ruled in the Piels’ favor on June 27, 2013. But it’s not over. The Piels told the court they plan to appeal the case within 30 days of the verdict’s filing on Nov. 5. Both Piel and city spokesman Chris Carrel declined to comment on the case, given the appeal that will soon be filed, which keeps the case in active litigation. Piel’s suit outlines numerous complaints against the
city, ranging from nepotism and retaliation to wrongful termination.
YEARS OF CONTENTION
In January 2008, Piel and his wife filed their first civil lawsuit seeking damages for wrongful termination based on several factors. He alleged he was terminated in 2006 and 2007 for retaliation and that the city violated public policy. Also, he said officials violated the family medical leave act, committed an invasion of his privacy rights and violated his freedom of speech in addition to claiming a loss of consortium, as his wife has suffered a strain on her family relationship and “lost the companionship of her husband.” A former Federal Way police patrol officer of two years and lieutenant of eight years, Piel alleges it all began when one of his officers was the target of an investigation involving a dog “bite” in the early 2000s. Believing a commander
lied about the situation, he went to the police chief at the time and expressed his concerns. However, he said she seemed “annoyed” and not interested in his written statement. The commander resigned a few months later for unknown reasons, his complaint states. Piel writes in his suit that before she quit, he noticed she interacted with another commander — Greg Wilson, the younger brother of the current chief of staff, Brian Wilson. Brian Wilson was the deputy chief for the police department at that time until he became police chief in 2006. Their interaction caused Piel to conclude “there was a romantic relationship between [the commander] and [Greg] Wilson.” In a response to Piel’s complaint, the city stated they were “without knowledge or information to form a belief as to the allegations” that the two were romantically involved. During the same time, the Federal Way lieutenants voted to unionize and Piel’s peers asked him to take the lead.
Although he said he was at first hesitant because “he feared resentment and reprisal” from upper administration, he continued because the chief allegedly assured officers that management supported their desire to organize. Still, Piel felt uneasy because he said he heard a former Federal Way lieutenant was “forced out of the agency” shortly after he organized the Patrol Officer’s Guild and a former guild president had also left after “having difficulty with upper management over guild matters.” However, court documents indicate the city denies the lieutenant left shortly after, nor was the president forced out over guild matters. Later, the chief changed her mind, Piel states. According to the lawsuit, she allegedly said at a management meeting if the lieutenants went through with plans to unionize, they wouldn’t remain “as close to her administration” as they once were. The city said they were “without knowledge or information sufficient to form a
belief” as to Piel’s allegations regarding the former chief’s opinion of unions. Piel notes all of his annual work evaluations had been above average until January 2005. However, the city denied he had a good working relationship with the city in years past. Throughout 2003-04, when he helped start the guild, Piel said he felt he was being scrutinized by the Professional Standards Division — a division then-commander Greg Wilson was in charge of, and Piel alleged nepotism. Yet, city officials denied all nepotism allegations. That summer, Piel was allegedly second guessed for “nearly every” use of force review and citizen complaint his team of officers generated. Piel’s supervisor at the time, Commander Kyle Sumpter — now the current deputy chief — would discuss with Piel each case that was returned for more information, the lawsuit states, and “agreed it was unfair and upsetting the officers.” But most of the complaints were coming from “career criminals” and were minor, Piel said.
“Because Commander Sumpter was satisfied with his performance, Lt. Piel continued to do the best he could and accepted the belief that he was being targeted for his involvement in the guild, and that it would subside in time,” the lawsuit continues. However, in a motion for judgement document filed by the city in King County Superior Court, they state the, “Plaintiffs have offered no evidence that Chief Brian Wilson expressed any negative attitude toward the formation of the Lieutenants’ Association,” the one who would eventually terminate Piel. Furthermore, the city denied that Piel was being singled out for the use of force reviews. Piel was removed from leading that squad at the end of that summer and was told he was a “losing coach” by the chief and Brian Wilson. The city responded they “didn’t have enough information sufficient to form a belief as to the allegations” whether Piel was told he was a “losing coach” or that he “lacked leadership.” Piel said he eventually reviewed department records relating to the amount of [ more LAWSUIT, page 26 ]

He reinstated Piel’s employment and he returned to work on Aug. 13, 2007. Piel was also awarded all back pay and benefits, which the city initially refused to pay, according to state Supreme Court documents. Upon the arbitrator’s decision, Piel claims Brian Wilson, now police chief, said Piel “would never work [for the city of Federal Way] again,” an allegation the city denies.
SECOND TERMINATION
Piel was placed on administrative leave pending another investigation on Aug. 15, 2007, based on allegations he threatened to shoot the command staff. Despite taking a polygraph examination, which “confirmed his truthfulness” that he never said those things, he was terminated again. Piel said on his first two days back he felt uneasy, according to court documents. On the second day, as he put his stuff away in the locker room, he saw two swing-shift officers. Attempting to “break the ice,” he struck up a conversation with them and answered questions about what he did during his time away. He “tried to be funny and relieve his intense feelings of discomfort and exhaustion” throughout the conversation, the documents continue. But the next day, Sumpter took his gun and holster and Piel found himself in a conference room talking to then-Deputy Chief Andy Hwang, now police chief. He was being placed on administrative leave because of the allegation that he had threatened the administration. Piel was not allowed any witness statements, despite a code he interpreted to allow him to, and later received a letter accusing him of six policy violations. Five accusations were later dropped, but the single charge remained. Piel took questions from a September 2007 investigation interview to a polygraph expert, who tested him and found him truthful, according to court documents. He sent these documents to the investigator but someone was reassigned to the case because he was not allowed to conduct a polygraph per the guild’s policies. The city said Piel’s questions he took to the polygraph expert were not the same as the one’s on the investigator’s original list, according to court documents. “In addition, given that Piel is a trained polygrapher, [the investigator] suspected that Piel might be able to manipulate the exam,” the documents state, noting that his willingness to take the test was not “evidence of his honesty.” On Oct. 2, 2007 the new investigator found that he was lying and based her decision on the witness statements who alleged the remarks — two who were the swing-shift officers he had encountered his second day at work, one was a man named Jason Wilson, the quarter master. According to court documents, the witnesses’ statements all mention that Piel alluded to shooting or murdering administration staff but all had presumed he was joking, being sarcastic or wasn’t serious. In a second interview after the investigator had apparently already made a conclusion, Piel said he was “insistently re-questioned” and admitted that “anything is possible,” but never agreed he made the remark in the interview. The investigator changed her mind and stated, “In such circumstances, Piel could credibly be unable to recall making one of
many negative comments. This could be true even regarding the murder comment, which he said in passing without particular emphasis.” She stated Piel’s mental state could have influenced his ability to remember what he said or “he could have failed in good faith to recall most of it.” Nevertheless, his termination was sustained.
SUPREME COURT APPEAL, JURY VERDICT
During the course of the legal proceedings, the city sought for the case to be dismissed early. King County Superior Court Judge Bruce Heller dismissed most of the Piels’ claims, except for their complaint alleging wrongful termination in violation of public policy. Regarding wrongful termination, the city argued that Piel lied during the investigation when he denied that he threatened anyone in the police department because he subsequently admitted that “anything is possible,” according to court documents. Heller ruled to dismiss the Piels’ case and granted the city’s motion for summary judgement in October 2009. The judge relied on a Washington Supreme Court ruling in the 2005 Korslund v. Dyncorp Tri-Cities Services, Inc. case to dismiss the wrongful discharge claim. However, the plaintiffs appealed the dismissal to the Washington state Supreme Court shortly after. “The only issue [the court addressed] was whether he could file a wrongful termination suit,” said Amy Jo Pearsall, city attorney, who could only comment on the context of the case. “The court’s issue was whether the jeopardy element was met or not — that’s the only thing they were deciding.” The case required the Supreme Court to consider complex legal analysis and decisions on previous Supreme Court cases, including Korslund and a 2000 decision in Smith v. Bates Technical College. In Smith, the court recognized that an employee in Piel’s position, who is protected by a collective bargaining agreement, may bring a common law claim for wrongful termination based on the public policy provisions of RCW 41.56, regardless of the administrative remedies available through the Public Employees Relations Commission. The Supreme Court’s opinion in Piel’s case held that nothing in the court’s later opinion in the Korslund case altered the aforesaid holding. Therefore, the Supreme Court reversed the King County Superior Court’s dismissal of Piel’s wrongful discharge claim on June 27, 2013 and remanded the case back to superior court for further proceedings. The court determined that Piel could pursue his claim that he was wrongfully terminated in violation of public policy for engaging in protected union activity. The case picked back up again in March and went to trial on Oct. 13. During the 10day trial, Piel argued that he was wrongfully terminated and said the city should pay him over $1 million in lost wages and benefits, in addition to damages for emotional distress and six years worth of attorney fees. However, the jury returned a verdict in favor of the city on all claims on Oct. 22. The jury rejected Piel’s claim that his termination was motivated by his protected union activity. “What it came down to was, there was no evidence of union bias and there was no evidence that [Brian] Wilson was motivated by the fact that Piel had helped form the lieutenant’s union,” Pearsall said. “Because [Piel] filed a grievance in 2006, there was no anti-union animus when [Wilson] made his termination decision.”

Mr. Federal Way can only conclude the following: that McPherson’s inbox was full and he did not receive any of the emails that the event organizers allegedly sent him notifying him of the Mirror’s requests for an interview; that those alleged emails went into his spam folder; that event organizers never sent said emails or spoke to a McPherson look-alike; that McPherson made those comments in jest and some attendees have a weak sense of humor; or the artist didn’t have time to respond to the Mirror and, as a result, the event organizers blamed the Mirror for not publishing the story they had envisioned. Whatever the case, Mr. Federal Way hopes whoever is behind this strange madness will stop playing games and, if you feel like the newspaper is unsupportive of a particular endeavor, then write a letter to the editor with substantial reasons why. Q: Mr. Federal Way, I shop at the Costco right along Enchanted Parkway in Federal way and also across the street at the Crossings complex. In the last year, I have noticed an increase in the number of panhandlers in this area. They used to be only at the stop sign next to the Olive Garden as you exit the business center, but now they are at every single corner, including the major traffic signals. What do you think is the cause of this increase and do you think something can be done about it? A: Mr. Federal Way has noticed panhandlers in these areas too and even saw a woman with two young daughters panhandling in front of Walmart recently. While Mr. Federal Way
sympathizes with panhandlers whose dire situations lead them out on the streets, Mr. Federal Way generally refrains from doling out dough and gives, rather, to local organizations that combat more systemic issues, such as homelessness. While some organizations do not correlate homelessness and panhandling because they don’t keep track of the latter, Mr. Federal Way has no doubt the two are connected. And you are probably seeing a surge in panhandlers this year because King County experienced a significant surge in homeless people from 2013 to 2014. King County has one of the nation’s bestestablished counts of the homeless called the One Night Count. Every year at the end of January, hundreds of volunteers take to the streets of various cities throughout the county for three hours and take an actual head count of homeless people. In 2013, volunteers counted at least 2,736 men, women and children without shelter during the count throughout the county — including 118 homeless in Federal Way. This year, volunteers counted over 9,294 homeless people. A total of 113 homeless people were counted in Federal Way, including 28 men, three women, one minor and 81 with unknown genders. Fifty-five were found sleeping in cars and trucks, two in doorways, 19 in bushes, 18 walking around, among other places. While this year’s count in Federal Way found five less people than last year, Mr. Federal Way doesn’t think that means much. Homelessness and panhandling are transient by nature and people migrate to wherever they can find resources, shelter and safety. There are two trends largely responsible for the homelessness surge over the past 20 years: a growing shortage of affordable rental housing
November 14, 2014 [27] and a simultaneous increase in poverty, according to FUSION (Friends United to Shelter the Indigent, Oppressed and Needy). The most common causes of homelessness for families include a lack of or reduced income, medical and family emergencies and domestic violence, according to FUSION’s website. So panhandling is no doubt an issue if you correlate it to the number of homeless people on Federal Way streets. But if you’re looking for a legal remedy to the issue, you’re not going to find one. It’s not illegal to panhandle. But Federal Way does have an ordinance prohibiting aggressive panhandling. City ordinance article 6, section 188 defines aggressive begging as begging with intent to intimidate another person into giving money or goods. Police don’t approach men or women who are simply holding signs on public property. So what can you do? Volunteer to participate in this year’s One Night Count to gain a deeper understanding of homelessness and the issues homeless people face. Or donate to a worthwhile local organization that addresses homelessness and poverty.
