After an unfavorable decision at the state appeals court and a mixed decision by a local hearing examiner, Black Diamond’s only medical marijuana-related business is shutting down. The owners of Lady Buds withdrew their appeal against the city’s decision to revoke its business license on April 4, three days before its scheduled hearing. In the withdrawal document, Lady Buds’ attorney Jay Berneburg wrote that business owners Vali Bauer and Angie Reed stick by their beliefs that they did not violate federal law or Black Diamond’s various moratoriums, however, the recent state court of appeals decision that allows cities to ban medical marijuana businesses gave the women no chance at a fair fight. “The city would still refuse to

The Maple Valley City Council and city staff are pondering the city’s own version of a fiscal cliff as talks about the Comprehensive Plan and the city’s future ramp up this month. The term, City Manager David Johnston said, caught on after it was used in a report prepared by the International Economic Development Council on the city’s future related to economic development. “We’ve been talking about this for about two or three years,” Johnston said of the broader idea behind the term. “What has to be appreciated by everybody is that the city has funded its growth with the revenue from aggressive residential development.”

KENT SCHOOL BOARD SEEKS PUBLIC INPUT The recently passed four year levy lets the Kent School District Board of Directors restore programs lost during past budget reductions. The Board is asking for input from community and staff in two public hearings on April 16 and 22. The first public hearing will be held from 7-8:30 p.m. in the Kent-Meridian High School cafeteria. The second will be from 7-8:30 p.m. in the Kentwood gym. According to Chief Business Officer Richard Stedry, taxpayer-approved additional dollars available for program restorations will be limited to between $3-4 million per year.
The Black Diamond City Council is looking into some pretty scary stuff. Organizers of the Great Horror Campout, which describes itself as a “choose your own adventure” overnight, interactive camping experience, have applied for a special event permit in the city. Their goal: to bring terror to a horde of fearloving young professionals. The 12-hour campout runs from 8 p.m. to 8 a.m. and targets 18-34 year olds — a majority of who are male — that are looking for a freaky adrenaline rush in the comic/fantasy/sci-fi/horror vein. That means cages, kidnappers, voodoo rituals, “blood tag,” horror movies on a large outdoor screen, bonfire sing-a-longs and the “Hell Hunt” interactive challenge, where the winning “Hellmaster” receives a sash, patch and future camping perks. There’s a “chicken zone” for a more mild experience and participants are also told to shout the safe phrase “I want my mommy” to stop the nightmare if they’re too scared.

The Maple Valley-Black Diamond Kiwanis Club delivered loads of free firewood to area residents during the group’s One Day project. The wood was donated from the YarrowBay construction site in Black Diamond and was given to low-income community members. A group of Kiwanis members cut and split the logs a few weeks ago and delivered the wood on April 6. President Jim Nannery declared the project a “huge success!”

Ten Thirty One Productions, based out of Los Angeles, created the event in 2013 and has a tour planned for major cities in California and Texas this summer. The campout would be held on about 15 of Palmer Coking Coal’s 600-acre property, located at 31407 3rd Ave. The site has been used for Tough Mudder obstacle course runs in the past, which have drawn upwards of 10,000 participants. This event would run on two nights, July 25-26, and is estimated to draw 1,000 people to each. No alcohol or drugs are allowed at the event and participants must be at least 18 years old. Melissa Carbone, CEO and president of Ten Thirty One Productions, called the Black Diamond spot one of her favorites on the tour. “It’s exactly what we are going for,” she said. “It’s very campy… It’s close enough to a major metropolitan area to pull enough people, but it feels very isolated.” Carbone brought the company to the national stage when she pitched it on the popular reality TV show “Shark Tank.” She caught the

From chicks to roving demons
Life decisions are funny things. The bad thing about actually making a decision is that you have made a decision, which I believe is the reason for male pattern baldness. There are genetic reasons for lifelong procrastination and ambivalence. This column could take a number of forks in the road – elections, religion, government transparency. The most illuminating in my view are chickens. A certain reporter in our office (she shall remain anonymous, but we will refer to her as Theresa De Lay) found herself the owner and keeper of six baby chicks this weekend that will very soon be chickens. Chicks into chickens – it is the transformation of yellow innocence into a roving demon from the depths. A reader may wonder why I take this dim view of the simple and plain gallus gallus domesticus. I was raised on a farm until about the sixth grade. One of my jobs that I couldn’t whine my way out of (I was the youngest and had the most hair) was taking care of the stupid chickens. When my dad bought chickens they came in a big crate of 50, half chickens and half demons. All but one of the roosters were soon directed to the dinner table. God, I love this time of year. Spring has sprung, my allergies will kick in any day now and your Seattle Mariners have taken the field. I know, I know, the long baseball season has just begun, but as John Fogerty once crooned: “Well beat the drum and hold the phone the sun came out today. We’re born again, there’s new grass on

Who am I kidding? If the M’s make the playoffs this town would go crazy all over again. And making the playoffs would be good enough. We loved it two years ago when the Seahawks made it, but were denied in the playoffs one game short of the NFC Championship. But one year later, they stayed patient and hungry, and went out and did the unbelievable, won a champion-
ship. And that’s all us Mariner fans could hope for this year — a playoff spot. So let’s all gather round and join hands. Let’s find some leftover razor stubble from Lou Pinella. Let’s mix in some used chewing tobacco from Jay Buhner, find some pine tar from Edgar Martinez’s bat and burn it all in an old athletic supporter from Ken Griffey Jr. After the smell dies down lets all chant together: “Remember 95! Remember 95! Remember 95!” Chant it over and over until the voice of the late great Dave Niehaus rises up and yells, “Get out the rye bread and mustard Grandma, it’s grand salami time!” Let’s get out and give these boys some “10th Man” Mojo. They sure could use it.

Nor did anyone else. I welcome this investigation and have been cooperating fully. I know that I have done nothing wrong or illegal and I believe that the investigation will prove this.” Todd has been out of the office since March 24. A message was sent to her city email account by The Reporter seeking comment. An automatic reply said she would be out of the office and unavailable until April 8, which was after press deadline.
INVESTIGATION OR WITCH HUNT? Councilman Ron Taylor, who was not present at the April 3 meeting, sent a statement to The Reporter expressing his personal views the afternoon of April 4. He stated Gordon has been implicated in sexual harassment and hostile work environment allegations and he and the council take the allegations “very seriously” and intend to see they are “aggressively investigated.” “The unfortunate thing, in my view, is that this is only the tip of a bigger iceberg,” Taylor wrote. “The
very troubling matters surrounding the mayor are much broader and deeper.” Taylor issued a frank disapproval of Gordon’s leadership abilities, writing the mayor’s actions have caused “the fabric of the city government to unravel.” “If Mayor Gordon truly cares about the well-being of the city, as he says he does, then I call for him to resign now and let the city pick up the pieces,” he wrote. In a response to Taylor’s statement, Gordon said the councilman leveled a number of “unwarranted” personal attacks that seem more like a “witch hunt.” “Mr. Taylor’s letter is extremely unfair,” Gordon wrote. “He would ‘try and convict me’ in the eyes of the public by issuing his letter first – before the city has even had an opportunity to complete its investigation.” Gordon added in his response the city’s personnel policy protocols should be followed. He alleged Taylor’s letter is attempting to “bypass” the protocols and, “Given Mr. Taylor’s public statement before the investigation has been completed and the parties have responded, it raises serious questions regarding whether Mr. Taylor can objectively and fairly assess the results of that investigation.”
JOB, MARRIAGE AND REPUTATION One of the most incendiary developments between the mayor and the council concerns a meeting that took place between Gor-
don, Taylor and Councilwoman Janie Edelman in late March. According to Gordon, Taylor and Edelman came to his office to demand his resignation despite being aware the city’s insurance company had cleared him of the sexual harassment claim by Todd. “They both acknowledged I was perfectly innocent, but still demanded my resignation,” Gordon said. “They both threatened my job (at Boeing), my marriage and my reputation in the community, after they both acknowledged I was innocent.” When Edelman was contacted concerning the conversation by phone on Monday, she said, “That (allegation) is an outright lie. I have asked for the mayor’s resignation, but I have never said I am out to destroy his marriage or get him fired from his job. That is a lie.” Edelman called back on Tuesday with a different statement concerning the events. She said that there was a meeting between her, the mayor and one other individual, whom she declined to name, that lasted almost an hour. She said she made a point to the mayor that he should resign, otherwise there would be repercussions with his family and job if the story made the newspapers. “I never threatened to go to his job or ruin his marriage; that was never our intent,” Edelman said. “Our intent was to do this quietly
so to save the embarrassment for everybody.” Edelman said she initially called the allegations “an outright lie” because the phrasing of the question was being twisted. “I was in the meeting; I know what was said,” Edelman said. “We did not say we were going to ruin his marriage or ruin his job. What we were trying to tell him is that there were repercussions for his actions and there would be consequences affecting his wife and his job. Not that we were going to do anything. That was never said.” When asked if the discussion could have been interpreted as threatening, Edelman responded, “I don’t know. I don’t know.” When contacted Sunday evening concerning the meeting Taylor said he could not comment. Gordon called the meeting, “just a power grab. It’s a political coup. What this is about is a conspiracy effort to change the form of government to councilmanager after the people voted that down. This is a conspiracy and has nothing to do with the investigation.” The residents voted down a ballot measure by 59 percent to change the form of government to councilmanager in November 2012.
RIVAL DEFENDS GORDON Numerous allegations have surfaced about some council members attempting a “cabal” to force

Gordon out of office in an effort to stop the YarrowBay developments. The allegations included statements of conspiracy and “vigilante justice” concerning YarrowBay. Edelman called the accusation “a bunch of baloney.” “That is crazy,” she said. “We don’t even talk about the master planned development, other than we notice there are trees cut down…. We as a council are not in the business to stop YarrowBay…. I have never said that I was going to stop YarrowBay. The mayor has said that when he was campaigning. I have never said that. I have said I want it responsibly done.” Olness, who was embroiled in a bitter campaign against Gordon, provided a statement to The Reporter that defended her rival and asked that the city move forward in spite of the City Council. “No matter how you say it, the mayor has been bamboozled, hoodwinked or tricked by Save Black Diamond and most of the City Council,” Olness wrote. “They thought he would be their puppet and when he stood up to them they are trying to get rid of him.” Olness said despite the unsettling campaign “with many lies told about me” she “admires” Gordon for trying to get help and fight the allegations. “Gordon is being, ‘depicted as the bad guy’ when in fact he is being a ‘good guy’
by trying to get out of the mess he is in,” Olness wrote. “The City Council is trying to run both the legislative and executive branches of the city.” The former mayor added the Black Diamond citizens should see Gordon through his term. “There are many former adversaries (of Gordon) who are coming to the mayor’s defense and are willing to help him,” she wrote. “I have also spoken to many city staff members in the past few days and they are behind the mayor 100 percent.”
THE RIGHT THING Taylor said during the phone interview Sunday, “We (the council) are simply trying to do the right thing. It is not about YarrowBay. I’m not against the development. Those words have been put in my mouth, but it’s not true.” Edelman said Tuesday, “I don’t regret anything I’ve said to that man (Gordon). Whatever I’ve said to that man I was thinking of the best interest for city of Black Diamond…. Now it’s all coming out in the newspapers. We were trying to protect him in a way, but he chose to do something different.” Gordon has told The Reporter repeatedly he is innocent of any wrongdoing concerning the allegations brought against him. “If Dave Gordon can’t make it as a mayor, then an honest man can’t do it,” he said.

Luckily, strawberries, blueberries and raspberries grow better here in western Washington than almost anyplace else in the world. If you have the room (and the energy) to plant an entire row of raspberries or bed of strawberries into the ground then grow for it. Otherwise, virgin gardeners may want to start small and invest in a pot of alreadyplanted strawberries. Beginning gardeners tend to make the same mistakes – planting in poor soil, not remembering to water and trying to grow edibles in the shade or partial shade. The easy answer is to grow herbs. Mints will spread (often too enthusiastically)

This makes herbs among the most forgiving of plants for first time gardeners - especially gardeners that love to cook – and eat. A simple way to get started with herbs is to grow a Pizza Garden – plant tomatoes and your favorite fresh herbs you use on a pizza. A sunny spot and well-drained soil is all you really need to begin harvesting basil, oregano and parsley. In a small space you can group your tomatoes and Mediterranean herbs together into one large container or wooden box. Just don’t set these heat-loving plants into the garden too soon. Wait until the nights are warm in late May or even June. This summer you can enjoy a delicious

However, the fact that marijuana was at the business was never something the Lady Buds owners claimed. “What we claimed is that we were not buying or selling marijuana,” Bauer said. “We never claimed there wasn’t anything on site.” Black Diamond City Attorney Carol Morris said she didn’t know why the hearing examiner needed more proof on the matter. “I can’t understand his decision making as to why more evidence was needed,” Morris said. “When have someone admit that it is something they are doing and it is against the law it should be end of story.” Bauer said Lady Buds has ceased operations and are directing patients to other locations until their lease officially ends at the end of the month. Bauer said the pair is in the process of creating a website — omnieweed.com — that would direct patients to information on doctors, grow shops and lawyers. They will be applying for an internet business license from the city. “We would like to stay here if we can,” Bauer said.

And that means the city has to find new revenue streams or face decreasing services the city provides. The fiscal cliff term is being applied to the general fund balance as a percentage of expenditures. “The fiscal cliff is just revenue streams versus expenditures,” Councilman Noel Gerken said. That number, 16.7 percent, covers two months of the city’s expenses, Johnston said. And, he explained, that threshold is recommended by financial institutions.
Previously, the city’s threshold had been 10 percent, but the council increased it to 16.7 percent last year to meet the recommended minimum. “So how we look at it is that 16.7 percent equals zero in the check book balance,” Johnston said. The current forecast by the city has the percentage dipping down to 16.1 in 2017. “We’re around 19 percent now,” Johnston said. “We feel with our residential development we have on the books now we are good for two or three years. That’s why economic development is urgent.” The conversation of how to grow other revenue streams or face service reductions has been a long time coming, according to Johnston. “It something that the (former mayor
Laurie) Iddings administration recognized and this administration now has to deal with it,” Johnston said. The approach going forward is to market the city to investors and to prioritize city programs. “I think we have to talk about prioritizing services rather then say, ‘hey, everybody has to take a 5 percent cut,’” Johnston said. Going below the recommended threshold could affect the city’s bond rating, which would in turn affect the interest rates at which the city could take on debt. “I don’t see it as a fiscal cliff, I see it as we know what’s happening and I think last year we did pretty good,” Gerken said. “I don’t see disaster looming, but we might have to make some cuts.” If economic development doesn’t occur

That list could include deferring maintenance on infrastructure such as parks and roads, cutting from the city’s grant funding program for community organizations and looking at city staff positions. “Right now we think we are providing Cadillac level services; that’s what our residents expect and that’s what a competitive community in economic development expects, but if you don’t have the resources you have to make compromises,” Johnston said. “Probably the budget process at the end of 2016 is talk turkey time.”

The No. 31 jersey always hangs inside the Tahoma dugout on game day. It switches colors along with the team for home and away contests. Before jogging out to the diamond, starting catcher Matt Thompson kisses his fingers and touches the stitching. He whispers things such as, “I need you this game” and “This one is for you.” It seems to help. “After the funeral I felt the emptiness,” Thompson said. “Then I put on my Tahoma jersey and Tahoma hat and stepped on the field. I felt filled up. It put the fear of death away from me.” Connor Johnson, 18, was driving on Highway 410 to work his part-time job at the Crystal Mountain Ski Resort on Feb. 15, when his pickup hit black ice and skidded into a ditch outside Greenwater in Pierce County. Authorities said he died instantly. As a relief pitcher, Connor Johnson didn’t play every day, but he always had an impact on the games he entered. Now that he’s
gone, teammates say his spirit and jersey have been the impetus for every win. “Connor still lives through Tahoma baseball,” said Thompson, who caught for Johnson since seventh grade. “We’re gonna make it known he is still here.” Adversity is known to either tear a group apart or make it stronger. In Tahoma, it has been the latter. Thompson and teammate Jake Lambrow said the 2013 squad consisted of nine individuals trying to win games. This year, it’s a team. “It made the team closer together,” said Lambrow, a junior starting pitcher. “It gave purpose to the team.” It’s not fair to call the Tahoma baseball team’s 7-3 start a Cinderella story or a group of misfits that came together in sadness; the veteran group finished 10-6 in the SPSL North division in 2013 and expected to be even better when the season started. But when the devastation struck, baseball took on a new meaning. The group decided to dedicate their season, and the school’s quest for its first ever baseball state title, to Johnson. Thompson and

His father, Craig Johnson, called him “a man of few words.” In fact, Connor didn’t tell his parents he’d even applied to Washington State University until he was accepted and was asking for money to pay the registration fee. He’d planned to study criminal justice. “It’s a fear of every parent and it’s a nightmare,” Craig said. “...We were still buying more shoes. He was growing.” Craig and his wife Julie were in South America when the accident occurred. Craig said the city rallied around the family at its most dire moments. “Maple Valley has just been unbelievable,” Craig said. “The support that

Beyond the extra motivation, Hayden called this

Meanwhile, the JV team threw two nohitters last week and also won a game 40-0. But even those triumphs are put into perspective. Hayden said another of the Bears’ baseball players fell asleep at the wheel on the first day of daylight savings time and hit a telephone pole. Though that teammate walked away from the accident, the team isn’t taking the game, or life, for granted. “Being out here is a privilege,” Lambrow said. “We have to go out and love every minute of it.”
