Hearings on turbine plan start Thursday
County meeting turns into scold-fest

The Island County hearing examiner will listen for two days to arguments regarding permits for a proposed tidal turbine pilot project in waters off Whidbey Island. The Tulalip Tribes and the PC Landing Corp. are appealing permits issued by Island County for the temporary installation of two tidal energy generators in Admiralty Inlet and related onshore equipment structures. The project is proposed by Snohomish Public Utility District. The hearing starts Thursday, March 6. Craig Collar, assistant general manager of the PUD, said the appeals are nothing new, but are the same issues the parties brought up in challenges to the Federal Energy Regulation Commission, or FERC. He said FERC rejected the appeals and is expected to issue a license shortly. Whidbey Environmental Action Network, or WEAN, filed as an intervenor with FERC. Members of the environmental group said they’re concerned about the on-land portion of the project, which could impact a scarce plant community. Marianne Edain of WEAN said the group is interested in sustainable alternatives to fossil and nuclear fuels, but technology that may do damage in other ways is not a true alternative. “We would love to see a genuine test of this technology,” she said in an email.
For publicly reprimanding Treasurer Ana Maria Nunez Monday, Island County Commissioner Jill Johnson drew fire from her fellow commissioners. Commissioners scolded Johnson, saying she acted unprofessionally and made a “spectacular display” of the issue. At the root of the issue was a difference in the appearance of 2014 tax statements mailed last month from those issued in 2013. Changes led some Camano residents to believe their taxes increased. Nunez said that was a “misperception” and a clarification letter would be mailed this week. While the issue turned out to be a miscommunication with the public, Johnson expressed displeasure with how Nunez handled the situation. “I feel I’m standing in front of the principal, which I’ve never done,” Nunez said. The letter that was sent to printers last week from Nunez to the public appears to place blame on the county Assessor’s Office, said Johnson. “If you have any questions about the levy itself, please call the Assessor’s office,” the letter states. Johnson first briefly questioned County Assessor Mary Engle, establishing that Engle gave the Nunez’s office correct tax data for both 2013 and 2014. Johnson then called up

A 20-year quest to bring home Lolita, the last of seven orcas captured from Penn Cove decades ago, has resulted in a small but significant victory. In late January, National Marine Fisheries, a division of the National Oceanic and Atmospheric Administration, announced that the whale is considered a member of the Southern Resident orca population, which is listed under the Endangered Species Act of 1973. The decision is not yet official, nor is there any guarantee that Lolita will be released from captivity, but it would afford her all the same protections as her Puget Sound relatives. “This is the best shot Lolita’s ever had for returning home,” said Howard Garrett, a founder of Whidbey Island-
based Orca Network, a group that has lobbied for the whale’s release for two decades. “Finally, something is bearing fruit,” he said. LOLITA WAS captured in the famous orca roundup of 1970 in Penn Cove. An estimated 90 members of L-pod were corralled and seven, including the then 4- to 6-yearold Lolita, were taken and sold to marine parks around the world. Miami Seaquarium has been Lolita’s home since. She is the only surviving member of the capture. Six orcas died in captivity within five years. That roundup and others eventually led to a court decision banning orca captures in Washington state and helped pave the way for the Marine Mammal Protection Act of 1972. Local businessman injured in car crash By JESSIE STENSLAND Staff reporter
Oak Harbor resident George Churchill, a wellknown and longtime businessman in the community, was seriously injured in a one-car accident Sunday afternoon. Churchill, 69, was airlifted to Harborview Medical Center in Seattle. He remained in serious condition in the intensive care unit Tuesday. Churchill was driving north in a 2005 Honda Accord on Crosby Road when he crossed the centerline. He overcorrected and
the car began sliding broadside, striking a couple of trees before coming to a rest, according to the Washington State Patrol. Trooper J. Greene said Churchill was not wearing a seatbelt and was partially ejected. Greene said speed appeared to be the cause of the accident. He said drugs and alcohol are not considered a factor in the crash. Churchill and his family have a long history in the Oak Harbor community. He is married to Island County Superior Court Judge Vickie Churchill.
Man, 25, charged with assault by blow torch By JESSIE STENSLAND Staff reporter
An Oak Harbor man with a history of mental illness and substance abuse problems is facing a felony charge for allegedly menacing his father with a blow torch last month, according to court records. Prosecutors charged Andrew P. Shumate, 25, in Island County Superior Court Feb. 20 with seconddegree assault and malicious mischief in the third degree. Both were charged as domestic-violence related crimes. Shumate’s mother reported to 911 on Feb. 15 that her son “was threatening to blow up the house and had a blow torch,” according to
the report by Officer William Wilke with the Oak Harbor Police Department. Shumate had been arguing with his mother about his drug use; he got angry and threw a phone, a TV remote and a glass bottle of gravy on the floor, according to the report. Shumate’s father intervenes and Shumate went into the garage. He emerged a short time later with a lit blow torch in one hand and a propane cylinder in the other. After his father tried to grab the blow torch, Shumate pointed the flame at his father’s face, bringing the flame within inches of his skin, Wilke wrote. The two men wrestled for the lit blow torch until the older man finally disarmed Shumate.

New asst. superintendent familiar with island living Oak Harbor school district signs King to one-year contract By RON NEWBERRY Staff reporter
Steve King expects to feel at home when he moves his family to Whidbey Island this summer. The Oak Harbor School District’s newly named assistant superintendent grew up in Friday Harbor on San Juan Island. He and his wife Kelli are high school sweethearts who have known each other since elementary school. “It seemed like a logical next step for me,” King said. “When my wife and I visited Oak Harbor, we both liked the feeling of the community. We really like island living and the island lifestyle and the closeness of the Oak Harbor community.” “The school district seemed headed in a positive direction and I liked the idea of being a part of leading them in that direction.” King, 44, will take over as the school district’s No. 2 in charge on July 1. His one-year contract will pay him a salary of $116,428. He’ll come to Oak Harbor after spending nine years as principal at Mount Baker High School, which

For the past three years, he’s served double duty as principal of both the high school and junior high school there. “Our impressions of Steve that we heard were that he’s a really incredible, bright, personable and energetic leader; that he really knows good instruction and how to bring staffs together to increase success,” said Lance Gibbon, Oak Harbor superintendent. When Gibbon met King for himself, he didn’t disappoint, noticing something special about him when he later took him on a tour of the schools. “He was friendly and at ease with students, staff and parents,” Gibbon said. “He definitely shone in that setting.” Karst Brandsma, Oak Harbor’s interim assistant superintendent until July,

spoke highly of King’s qualities but didn’t particate in the interview process. Brandsma saw a top central administration candidate in the making when he oversaw the Mount Baker School District as an interim superintendent and worked with King during the 2011-12 school year. He remembers suggesting to King that he ought to consider seeking his superintendent credentials. King did just that and will finish his superintendent’s program this year. “I was glad to see after I left that he actually enrolled in that program and developed interest in central administration,” Brandsma said. “It didn’t surprise me at all that he’d be considered a strong candidate.” King, who has a master’s degree in school administration from Western Washington University, will oversee all aspects of instructional programs related to teaching and learning in Oak Harbor. He brings 15 years of experience at the secondary level, including 11 years as an administrator. He and his wife have three children, including a daughter who will be a senior at the high school. “I’m an extremely caring person,” King said. “I think relationships are the foundation in any improvements and successes we’re going to have in schools.”

Burning popcorn leads to alarming meeting on EIS By JANIS REID Staff reporter
A burnt bag of popcorn caused a minor disruption during a public meeting on Navy testing and training in the Northwest. About 30 minutes after the doors opened at 6 p.m. Wednesday, Feb. 26, a fire alarm forced the approximately 30 people to evacuate the Oak Harbor High School cafeteria and wait in the parking lot until North Whidbey firefighters cleared the building. Students overcooking popcorn were identified as the culprits and the meeting resumed. Wendy Campbell DeWinter, who spoke during the public comment period of the meeting, said she thought the meeting was poorly attended. “It was very disappointing,” Campbell DeWinter said. “The fact that public didn’t show up.” The Navy said about 40 people attended the twohour event, a vastly lower number than at other recent EIS meetings. The purpose of this EIS is to determine the environmental impact of the Navy’s training and testing required to remain combat-ready, according to the Navy. Some of this training takes place at the five sites examined in this EIS, which comprise primarily off-shore areas throughout the Sound and does not include Whidbey Island Naval Air Station’s Ault Field or Outlying Field

This EIS is not related to the ongoing studies for the P-8A Poseidons, which will be completed in May, or the EA-18G Growlers EIS, which started in July. Testing and training exercises include technology system development with missiles, radar, active and passive sonar, unmanned undersea vehicles and unmanned aerial vehicles. The areas are also used to evaluate and maintain vessels, aircraft and operating systems. A main distinction of this EIS is that it combines the EIS of the five testing areas into one, according to Lianne Nakahara, Navy Region Northwest public affairs specialist. Nakahara stressed that while it may appear the Navy’s testing and training area is getting bigger, they are simply consolidating multiple regional testing
areas into one review process to save on cost. Campbell DeWinter is a founding member of Concerned Island Citizens and started a new community action group, Whidbey Island Noise Coalition, or WINC, a few months ago. She said her primary concern is that the Navy is going to “destroy” the environmental beauty of the island. “My forefathers landed at Ebey’s Landing in 1852,” Campbell DeWinter said. “What they passed onto me was that we were to protect the earth and the sea. I don’t think we are doing that.” The public comment portion of the EIS continues through March 25. The public is invited to comment online or by mail. OHscars raises $8,500 for fireworks By JANIS REID Staff reporter

The second annual “OHscars,” a takeoff on the Oscars, highlighted favorite comedy films and moviethemed table displays were raffled off along with gift baskets. Proceeds from the $50-a-seat dinner goes toward the Oak Harbor Fourth of July fireworks display. “I thought the event was a great success this year and people really seemed to enjoy themselves,” said Kathy Reed, Oak Harbor chamber executive director. Reed served as master of ceremonies. Whidbey Coffee, which is celebrating its 25th anniversary, was revealed as the 2014 Grand Fireworks Sponsor, donating the first $6,000. In addition, the event raised roughly $2,500 for a total of $8,500 so far. Coupeville holding 28th annual Mussel Festival this weekend By MEGAN HANSEN Contributing editor
Businesses in Coupeville are gearing up for a weekend mussel enthusiasts look forward to each year. The Penn Cove Mussel Festival is March 7-9. Mussel Mingle kicks off the weekend 5:30-8:30 p.m. Friday at Coupeville Recreation Hall. Tickets are $20 and are available at Aqua Gifts, bayleaf and the Coupeville Chamber of Commerce office. A ticket entitles the holder to two drinks, mussels, a hot dog and an evening of live music. Every restaurant in town, 15 in all, are participating in the chowder tasting contest. Three different chowder tasting tickets are being sold, with five tastings per ticket both Saturday and Sunday. Tickets will be sold at 10 a.m. each day. A total of 1,500 tickets will be sold each day and tickets tend to sell out on Saturday. Each business expects to give out 500 samples of chowder each day. Chowder tasting is 11 a.m. to 3:30 p.m. both days. All mussels for the chowder are provided by Penn Cove Shellfish. Each participating restaurant uses 40 pounds of

mussels. The cost of those mussels is being split between the Waterfront Association and the shellfish company. This is the first time Penn Cove Shellfish has donated mussels for a chowder contest, organizers said. Also, new this year is an open-air beer and wine garden in the Rec Hall parking lot, sponsored by the Waterfront Association. The addition stems from requests for another space for people to sit and relax. There will still be a beer and wine tent located across the street from the Rec Hall. Other businesses will be offering dining options, such as Coupeville’s newly reopened restaurant Oystercatcher. The fine dining restaurant will not only participate in the chowder contest, but will be have a sandwich booth outside the restaurant. Organizers are also working to create more seating around town. Activities throughout the day include mussel bed tours at Penn Cove Shellfish. Tours will leave from Coupeville Wharf throughout the day. Cost is $10.

COMMISSIONERS CONTINUED FROM A1 Nunez and scolded her for blaming the Assessor’s Office. In addition, Johnson, a Republican, was perturbed that Nunez waited five days to discuss the issue with her and Commissioner Kelly Emerson, also Republican, who represents Camano Island. Nunez, a Democrat, was in contact with Commissioner Helen Price Johnson, a Democrat. Johnson said the full board should have been notified as soon as the issue arose. “I didn’t attempt to hide anything or pass the blame
onto anyone else,” Nunez responded. Sending approximately 12,000 clarification letters to Camano Island residents will cost the Treasurer’s Office $4,500 in postage alone, Nunez said. Discussion began with Price Johnson suggesting the county commissioners share the cost of the extra mailing. Johnson said she doesn’t like the idea of island taxpayers having to shoulder the cost of the treasurer’s error. The Stanwood-Camano School District and the assessors office received calls in
recent weeks after tax statements were sent out with what appeared to be a rate increase in the school buildings maintenance and operations levy. When the last levy was being proposed, Camano Island residents were told that, if the measure was approved, it would replace an expiring levy and not result in a tax increase. Nunez said some taxpayers interpreted the erroneous higher amount for 2014 as the school district “breaking faith” with the voters. “I want to make sure the public understands that the school district kept their word,” Nunez said. Johnson said Price Johnson sent out an email prior to the
meeting stating her intention to raise the issue at Monday’s meeting. During the meeting, however, both Price Johnson and Emerson said they did not support Johnson’s decision to scold Nunez during “Commissioner Comments.” “This is inappropriate for a business meeting,” Emerson said. “I’m going to have to ask you to stop.” Despite her disagreement with Johnson’s approach, Emerson said she agrees that she also should have been notified immediately about taxpayer’s concerns.

“I wish that would have been brought to me,” Emerson said. Price Johnson, who attended the meeting via phone from Washington D.C., suggested addressing the issue “in a more professional manner” when the three commissioners meet in person next. Johnson said she raised the issue during Monday’s meeting in response to Price Johnson’s email. Johnson said, the commissioners won’t have a work session that all three can attend for three weeks, therefore the issue needed to be addressed
immediately. “We needed transparency and we needed to own the mistake,” Johnson said. “It was important that everyone knew what was going on.” Price Johnson said Tuesday that her was intention to bring the issue up more informally and “corroboratively” after “Commissioner Comments.” Price Johnson said she said she is sorry for the misunderstanding and the resulting conflict. She added that her communication with Nunez has been minimal due to her absence.

Seattle, King Co. officers could learn from Whidbey Island’s law enforcement GUEST COMMENTARY

They say the grass is always greener on the other side of the street, but that’s not always so, particularly when it comes to Whidbey Island first responders. Never is that so clear as with the ongoing debate in Seattle over the interaction between a city police officer and Stranger editor Dominic Holden. Last year, Holden was bicycling through the city and stopped to take pictures of officers surrounding a single suspect. Though on public property, Holden was told to leave — and that taking pictures was a form of harassing the officers. He was treated with derision for doing his job. Seattle officer John Marion asked how Holden would like it if he went to his newspaper and interfered with his work. A video of the incident was captured and people can decide for themselves whether Holden contributed to the argument. However, the contempt shown to the reporter is disappointing and, frankly, embarrassing for the King County and Seattle police departments. These agencies could learn from Island County’s finest, along with other first responders, especially local firefighters. During my seven years of reporting for Whidbey Island newspapers I covered car accidents, house fires, plane crashes, environmental disasters, sunken and beached boats and all types of criminal crises. And through them all, I’ve had just two negative encounters. The majority of police officers and firefighters are consummate professionals and earned my respect. At two recent and separate car accidents, Trooper Chris Merwin and Trooper Norm Larsen didn’t interfere with my job and took time to respond to questions with respect. Langley Police Chief David Marks similarly demonstrated himself a man of transparency and a credit to the uniform Thursday at an incident at the middle school. Earlier that same day at an unrelated call, South Whidbey Fire/EMS Deputy Chief Jon Beck treated me with kindness and an explanation of the emergency. Island County Sheriff’s Deputy Chris Garden, Lt. Evan Tingstad, Central Whidbey Fire and Rescue Battalion Chief Chad Michael, North Whidbey Fire and Rescue Deputy Chief Mike Brown — this is just a short list of the many fine examples of open and friendly first responders who work on Whidbey Island. They may not always like with the news or even like the reporter, but their actions over the years have demonstrated their commitment to open government and a respect for the people they serve. n Justin Burnett is editor for the South Whidbey Record. Is concerned about children losing hearing Editor, When I moved to Oak Harbor in 1982, I knew there was a Navy base here. My cousin who was stationed here during World War II told me he flew planes under Deception Pass Bridge. What I didn’t expect was that planes would be flying over my house. This was 10 years before a noise disclosure form was required, and the seller didn’t mention it. I didn’t ask him whether my house was under the flight path, and I didn’t ask the neighbors. I also didn’t ask them whether the Navy did target practice on our block. In 1982 it was inconceivable to me that there could be a flight path over civilians’ houses. It was inconceivable that the U.S. military would train anyplace where training would damage civilians. Just as I assumed no bullets would be flying in the street, I assumed no planes would be flying over my house low enough to destroy my hearing. I was right about the bullets. Loss of hearing happens gradually, but when it’s gone, it’s gone. The
Navy’s own safety center says planes as loud as those that fly over my house can cause permanent hearing loss. After living under those planes for 30 years, even with hearing aids it’s hard for me to make sense of a conversation with as few as five people. One person has to repeat words frequently. In a restaurant the noise from other tables, magnified by my hearing aids, is torture. Videos are unintelligible without captions, and music is toneless and monotonous. I cringe when people say their young children just love living under the jets, that they laugh and wave at the pilots. Somebody should tell them that those kids could be deaf before they’re old enough to vote. Ann Adams Oak Harbor

Flinstone car represents Oak Harbor history Editor, Recently, Editor and Publisher Keven Graves questioned in his column why Oak Harbor has a Flintstone car. Maybe it is time for the paper to do a story on the history of the Flintstone Freeway and the car. Flintstone Freeway was created from nothing in the bay and Oak Harbor received permission from the creators of the Flintstones to use the name Flintstone Freeway. Editor, I would like to extend a heartfelt thank you to the rehab unit staff at Careage of Whidbey. Recently my mother was fortunate enough to receive care there following hip replacement surgery. The nurses and therapists exhibited kindness and compassion along with a much needed dose of humor throughout my mother’s recovery. Thank you for your incredible hard work, encouragement and professionalism. The residents of Whidbey Island are blessed to have such a top notch facility. Diana Goss Moorpark, Calif.
Editor, The fairgrounds in Langley is a wonderful community owned property with a rich history and great potential. For generations we have enjoyed the fair every year, but it is not immune from the national trend of local fairs struggling to maintain too many aging structures, rising utility and insurance costs and not enough income to keep the property viable and adequately maintained for the annual event. Last week, a strategic plan for the fairgrounds was presented. It described a flexible plan for

building on the strengths of the property and our community to create a sustainable program over the long term. What I liked about it most was that it isn’t an all-or-nothing plan. It has built in steps so it can be adjusted and the community can stays involved as decisions are made. For instance, if the revenue projections fall short, course corrections can be made along the way. Each phase can be evaluated before moving on to the next. The idea is to take measured but meaningful steps to move toward financial independence while promoting local food, local arts and local artisans. The vision is for the property to become a year-round events center capable of hosting a variety of uses
at one time, while still supporting the needs of the annual fair. This is a worthy goal, and we will need to take careful consideration along the way to make sure it is successful. With a phased approach as described, public input is maximized, financial risk and the use of tax dollars are minimized, and the community is able to utilize this amazing resource while enhancing local economic development. This is an exciting opportunity for our community and I hope you will add your voice to the conversation. Irene A. Stevens
Irene A. Stevens, 95, died at 5:15 p.m. Feb. 26, 2014, at Careage of Whidbey. She was born March 12, 1918 in Chicago, Ill., to Olaf Leonard and Anna Kristine Lovendahl (from Denmark). Irene grew up on the north side of Chicago, graduated from high school and became a bookkeeper for a Chicago ice skating rink, Peterson Furniture, Matel Corp, and Gencoe Park District. She was married to Willard C. Stevens in 1942 and had three children: Judith, Gary and Gayle. Irene retired in 1984 and moved with Willard to La Habra, Calif., close to Gayle’s family. Willard passed away in 1996, and in 2005 Irene moved to Greenbank, Wash. She was an active member of the senior center, volunteered at Whidbey General Hospital and the Freeland Library and attended the Evangelical Free Church. She loved crafts and making quilts for her great grand-
children. She is survived by her daughters Judith Slepyan (David) of Langley and Gayle Rogers of Freeland; daughter-in-law Ruthie Stevens Patton of Cedar Grove, Wis.; nine granddaughters; 11 great-grandchildren; and her best friend Mildred Fredrickson Larson. She is preceded in death by husband Willard, son Gary Willard Stevens and son-in-law John Rogers. The family thanks Kelly, Stacie, Freddie and the entire staff at Careage for their kindness and care. Long-time Coupeville resident Jackie Weber passed away of natural causes on Feb. 11, 2014, after a long battle with Alzheimer’s Disease. Jacqueline Louise Weber was born May 15, 1938, and raised in Seattle. She attended Queen Anne High School and graduated from San Jose State College in 1960 with a degree in education. Jackie went on to teach elementary school in California and in the Shoreline School District in Washington for a total of 10 years. Jackie married Dick Weber in 1965 and together they had two daughters. After the younger daughter was in school, Jackie began a second career in advertising and sales, first with Cuisinart and later with Valpak of Western Washington, until her retirement in 2003. After retiring, Jackie and Dick enjoyed traveling to interesting places including Antarctica, Europe and Kamchatka. Jackie is survived by

Fifteen Oak Harbor and five Coupeville athletes received recognition when their respective conferences announced their all-league teams this week. Oak Harbor swimmer senior Caley Powers led in postseason honors, earning first team status in four events: 50 free style, 100 butterfly, 200 medley relay and 200 freestyle relay. He was joined on the relays by senior Cedric Cabigting, junior Dakota Powers and sophomore Micah Geist. Cabigting (100 backstroke) and Geist (200 individual medley) also picked up firstteam honors in individual events. Coupeville’s lone first-team selection was sophomore Makana Stone in girls basketball. Oak Harbor dominated the Wesco North wrestling first team: junior Christian Bertram (113 pounds), junior Jeremy Vester (132), senior Jahleel Vester (138), junior Mark Johnston (152), senior Ray Quinday (220) and junior Jackson Constant (285). Sophomore Amber CramseyBehnke (235) was a firstteam choice among the girls. In Western Conference basketball, both divisions were combined to form the all-league teams and senior Drew Washington earned second-team honors. Senior Zach Gibbs and sophomore Dyllan Harris were honorable mention selections, as was senior Joanna Leete on the girls team. Workshop focuses on Whidbey newcomers By RON NEWBERRY Staff reporter
One fact gardeners must realize on Whidbey Island is that the island isn’t the same from one end to the other. Clinton, for instance, averages much more rainfall per year than Coupeville or Oak Harbor. “There are a range of conditions on Whidbey just like there are anywhere else,” said Marty Wingate, Seattle author and popular speaker on gardening. “There are drier parts of the island and wetter parts of the island.” Providing helpful gardening knowledge to newcomers to Whidbey is one of the themes of the Whidbey Gardeners Workshop that takes place at Oak Harbor High School Saturday. The workshop, put on by the Island County Master Gardeners, features 39 classes and 18 new instructors and will run from 9:30 a.m. to 2:45 p.m. Working to keep the material fresh, 13 new classes are offered this year. Assisting the gardener new to Whidbey is a predominant theme. Many classes are designed to give gardeners insight into the island’s climate, soil, hydrology and wildlife, among other areas. Wingate will be the workshop’s keynote speaker with her theme focusing on “Choosing the right plants for your Northwest garden.” The cost for the workshop is $45 at the door Saturday with more information at www.whidbeygardeningworkshop.org One class, “New to Gardening on Whidbey Island,” came about after a survey revealed that one out of every four attendees at the event last year was new to the island. A panel of experts will talk about unique gardening and growing conditions on Whidbey. Nic Loyd, a weather specialist from Washington State University’s AgWeatherNet will share information on how a weather station in Coupeville can help gardeners on the island.

Studio overhaul By RON NEWBERRY Staff reporter
Five years ago, Megan Wise stared at a neglected red barn in her backyard and saw an eyesore. Her husband Mike Wise saw an opportunity. Normally inspired to paint barns, Mike Wise decided to tear this one apart. The result was a spectacular transformation that turned the barn into one of the showcase art studios featured on the Whidbey Working Artists Studio Tour this weekend. Walk through two huge glass entry doors and the Wise Studio in Coupeville reveals a plush interior that features 9-foot ceilings and massive fir beams above a pool table that rests on a stained concrete floor. The barn’s exterior is covered with cedar shingles straight from a cedar mill in Forks. Wise did most of the
work himself, including electrical and plumbing, to provide a place for their artistic family to work, play and display their art. Mike is a contemporary impressionist oil painter of still life and landscape subjects. Many of his works are displayed in the studio lit by track lighting. Megan makes jewelry from vintage pieces. Her 9-year-old daughter Ella also has taken up jewelry making. “I think it’s awesome,” Ella said of their family pastime. “All three of us spend time together,” Megan said. “It’s a family thing for us.” “Creating things rather than watching people do things is what I prefer,” Mike said. Mike, once a stockbroker in downtown Seattle, has been a full-time painter for eight years on Whidbey Island, noticing better results the more time he’s
been able to put into his craft. His wife works as a commercial loan officer for Whidbey Island Bank and makes jewelry when she can. “Maybe that’s what drew us together,” Mike said. “I didn’t know she had interest in doing this when I met her.” The Wise’s studio on the outskirts of Coupeville is one of 17 stops on a tour that gives the public a peek into the lives of Whidbey’s working artists. The free self-guided studio tour stretches from Oak Harbor to Freeland and runs from 10 a.m.-5 p.m. March 7-9 (for map, see www.whidbeyworkingartists. com). He’ll take a photograph of a scene that catches his attention then displays it on a flatscreen monitor attached to a wall
behind an easel. Then, he goes to work, painting boats, landscapes, barns and other scenes inside an old converted barn that not long ago had dirt floors, livestock stalls and a heap of discarded items laying around. “It probably would have just been easier to tear it down,” Mike said.

NOAA’s recent decision was the result of a 2011 lawsuit by People for the Ethical Treatment of Animals, or PETA. PETA SUED the agency over a 2005 ruling that listed Southern Resident orcas under the Endangered
Species Act, but specifically excluded whales already in captivity. “They basically carved out this exception just for Lolita,” because she is the last remaining Southern Resident orca in captivity, said Jared Goodman, PETA’s director of animal law. A settlement was reached, however, and PETA followed up with a petition for NOAA to reconsider the earlier decision. On Jan. 24, 2014, the federal agency announced it agrees with PETA’s position, and officially ruled that Lolita
is indeed a Southern Resident orca based on the biology of her genetics and acoustics, according to NOAA officials. “We were thrilled [but] it was expected,” Goodman said. NOAA’S DECISION is open for public comment until March 28, and a formal decision will be made within one year of that date. For Garrett, NOAA’s announcement was not a conclusive victory, but it is a step in the right direction. “It’s a huge ray of hope,” he said. “This is the first time we’ve had the legal lever-
age to mandate her return home.” For the first time since her capture, Garrett said Lolita’s fate is undecided. “It will be up to NOAA and not Seaquarium, and that makes all the difference.” HOW MUCH of a difference, however, may be a matter of interpretation. Lynne Barre, Seattle branch chief of NOAA’s Protected Resource Division, said the January determination does not empower the federal agency to make decisions about the whale’s own-

ership. “That’s not the position that we have,” said Barre, nor does it mean she’ll be released. In fact, NOAA’s official opinion is that the orca may be afforded protections under the Endangered Species Act while remaining in captivity, Barre said. NOAA’s policy reversal from its 2005 decision, she said, but it remains unclear what that will mean for mammals such as Lolita. It’s unclear whether Lolita’s protection under the act would prohibit her from performing. “It’s probably for our lawyers to figure out,” Barre said. GOODMAN SAID the PETA believes the issue is clear. PETA is involved in a separate lawsuit with the U.S. Department of Agriculture

That does not further the science.” Collar strongly disagrees with this characterization. “We would invite anyone who is interested to actually review the FERC application, record, and project plan and draw their own conclusions based on the facts,” he said Island County Planning Director Dave Wechner said the county is in an unusual position with regard to the appeals. The county issued a shoreline conditional use permit to the Snohomish PUD based on the PUD’s own environmental study required under the State Environmental
over Lolita’s living space at Seaquarium. “We believe her current conditions violate the Endangered Species Act,” he said. “It’s unquestionable that those conditions are unhealthy and she’s being harmed and harassed in violation of the law.” PETA representatives argue that Lolita should be released, returned to Washington state and gradually reintegrated into the wild. Orca Network is advocating that she be reintroduced into Puget Sound in an enclosed pen in Kanaka Bay on San Juan Island. In time, Garrett said he hopes she can be successfully reunited with L-25, the whale some believe to be her mother, and the rest of L-pod. “It would be such a fairy tale, a cultural and iconic story that there is a way to change our attitudes and behavior toward nature.” Policy Act, or SEPA, he said. Though the Tulalip Tribe and PC Landing are challenging Island County’s issuance of the permit, they are focusing arguments on the sufficiency of the PUD’s environmental review. Snohomish PUD proposes placing the “hydrokinetic pilot project” one kilometer west of Central Whidbey’s Keystone Harbor. It would be the centerpiece of the utility’s project to study the viability of using tidal currents to generate electricity. The Tulalip Tribe argues that the PUD’s environmental study failed to address cumulation environmental impacts, failed to address impacts on endangered species and failed to address adverse impacts to Tulalip Tribe’s cultural sites in Central Whidbey from upland cable trenching operations, according to the statement of appeal.
