Study proposes full staff, but neither option allows 24/7 coverage By BEN WATANABE South Whidbey Record A months-long study of whether the Langley Police Department should have three or four officers, set to be discussed by city leaders Tuesday night, concludes that four officers are needed. But Mayor Fred McCarthy, the man in charge of setting staff sizes and city hall priorities, neither agreed with nor rejected the study’s position ahead of the city council meeting. The study was conducted at McCarthy’s request by acting Chief David Marks. The mayor declined to divulge his recommendation, saying he had not informed his staff and wanted

to reveal his position at Tuesday’s meeting. “There’s all sorts of opinions and controversy about what the size of our force would be,” McCarthy said, adding that the study will give city leaders something to lean on as a defense of the police force’s numbers. “We’ll have the response that we did a comprehensive study.” Despite not tipping his hand as to whether he would seek to hire a fourth officer, McCarthy said his recommendation would not allow for 24-hour Langley Police Department coverage for the city. “I don’t think we can get 24/7 coverage from either recom-

mendation,” he said. The more-than-60-page study concludes that the estimated $70,000 savings for Langley by having two officers and a police chief would be negated by overtime costs, reserve officer pay and a potential strong-arm move by the Police Guild. “I included some strong language in there, but it’s pretty clear to me that we need four officers,” Marks said. A proposed change to a law aimed at preserving farmland and open space could result in higher taxes for some Washington property owners, including in Island County.

House Bill 2306 would expand a tax classification on land actively used for agriculture, timber production or undeveloped open space. While property tax is generally assessed on the market value of a parcel, the state’s Open Space Taxation Act allows land to be taxed at a lower rate based on its

current use, such as farming. Under the current law, if a farming operation is 20 acres or more, the parcels must be contiguous in order to be eligible for the lower tax classification. The bill proposes to take out the SEE FARMLAND, A9

Gary Clay Fisher

Gary Clay Fisher, 75, of Oak Harbor passed away on Feb. 10, 2014, of cardiac arrest. He was born in Santa Rosa, Calif., on July 1, 1938 to Clay and Beatrice Fisher. He grew up during WWII while his father was aboard ship with the U.S. Navy in the Pacific. He worked for his grandfather and uncle on their farms and had a farm driver’s license at age 14. He went to Santa Rosa High School and participated in Future Farmers of America hoping one day to be a veterinarian. He received an appointment to the Naval Academy, but due to his defective color vision he was not accepted. Rather than give up, he joined the U.S. Navy at age

17 and for eight years was a Naval Weatherman at Kodiak, Alaska; Alameda, Calif.; and Holy Loch, Scotland after schooling at NAS Lakehurst, N.J. As the first weatherman on a Submarine Tender at Holy Loch, he was notified he was accepted for Officer Candidate School at Newport, R.I., then to Supply Corps School at Athens, Ga. where he became a Supply Corps Officer. Assignments afloat, ashore and overseas included Supply Officer of a Fleet Oiler and on two Aircraft Carriers. He was Aide to three of the Senior Admirals in the U.S. Navy and was selected as Captain, U.S. Navy while as Executive Officer at Subic Bay in the Philippines. He retired from Philadelphia, Pa., after 32 years of active duty. He earned a BS in business administration and an MS in material management at the Naval University in Monterey, Calif., with doctoral studies at the University of Tennessee. After retirement, he was professor of business subjects at several colleges and universities for 15 years, retiring in 2003. He was recognized as Instructor of the Year in 1993 and received the Director’s Award in 2002. He received many awards including the Outstanding Young Man of America in 1973, President of the United States Award

for Life Saving in 1984 and 4-H Co-leader of the Year in 2000 with his wife Lois. They were leaders of the 4-H club Colonial Critters, receiving a record number of awards at the Island County Fair. He started the 4-H club Weather or Not in 2010 to teach youth about world weather. During retirement, he was a volunteer firefighter, Fireman of the Year in 1992 and President of the Fire Association for three years. Other volunteer activities included co-president of the Whidbey Playhouse, Boy Scouts of America Woodbadge Award and BSA district commissioner, Ducks Unlimited district chairman, president of Whidbey Sportsman’s Clubs, American Red Cross board and ARC Disaster Team, Conservation Futures Fund board member, chairman Island County Fair Board and trained on the Community Emergency Response Team or CERT for Island County. He was a judge at the Miss America Pageant in Atlantic City in 1985. He was a life member of NRA, North American Hunting and Fishing Clubs, American Sheep Industry Association and American Livestock Breeds Conservatory. Gary loved farming and with his wife Lois, developed a state-of-the-art farm, Camelot Downs. They raised Colonial livestock being one

of the few in the U.S. to do so. Camelot Downs was declared the Merit Farm of Whidbey Island for conservation of natural resources, wetlands and creating wildlife habitat plus animal husbandry. In 2010 Camelot Downs granted a Conservation Easement to Farmland Trust. He loved his pets and critters. A good story-teller, he enjoyed sitting at a campfire at the family retreat, Rocky Top, in Ellensburg, Wash., with his family. He enjoyed hunting all his life and was a conservationist and preservationist to the end. He is survived by his wife of 54 years. They were married in Santa Rosa, Calif., in 1959. They were united after attending Santa Rosa High School together, graduating in 1958. They had three children: Geoffrey Clay, Marsha Rae (Deiter) and Glenn Merritt; six grandchildren, Jake and Jared Deiter, Courteney, Tyler, Gabrielle and Emily Fisher; and four greatgrandsons, Ethan and Ean Deiter, Jayden Funnell and Jack Ogren. He is also survived by his sister, Doralynn

Mindie is survived by her husband Tim, daughter Devin, and three brothers, Brandt and his family, Patty and Jeromy; Dennis and his family Sue, Emily and Jessica; and Kevin, along with a multitude of friends. PORT Appointment pushed two weeks Commissioners at the Port of South Whidbey plan to appoint a representative for Position 2 during a special meeting tentatively scheduled for 7 p.m. Tuesday, Feb. 25. Commissioners Curt Gordon and Dennis Gregoire met and interviewed the sole candidate for the position during a regular meeting Tuesday, Feb. 11. Downed tree breaks radiator A tree knocked down by high winds over the weekend poked through the front-end of a car, damaging its radiator. The driver, a man, was not injured in the crash on Maxwelton Road near Rivendell Road. Upon impact, the reportedly dead tree splintered. “It was lucky it was a dead tree,” said South Whidbey Fire/EMS Chief Rusty Palmer. Wind gusts reached 47 mph around Whidbey Island, with wind speeds measured up to 36 mph. The fire protection district responded to 15 calls Saturday and 12 calls Sunday, many of which were related to tree branches blown onto streets. None of the calls involved injury or damage to homes. “All of the calls were timed where we’d clear from one then head off to the next one,” Palmer

said. One call was about a car off the road on Lone Lake Road early Saturday morning. The car was reported the night before, but no driver was found when emergency responders arrived and no signs of injury were seen inside the car.

Late boat near completion South Whidbey Fire/ EMS Chief Rusty Palmer reported Tuesday morning the district’s nearly $500,000 fire boat is close to completion and delivery. More than 45 days late, the boat had only a couple of small issues to be addressed by the fire district’s final deadline on Tuesday, Feb. 18. If Freeland manufacturer North Cross Aluminum had missed the date, the commissioners were prepared to withhold a final payment of $9,600 as per the contract’s late fee clause. A team of fire district personnel was scheduled to do a final inspection Wednesday afternoon to make sure the boat was in working order. Should everything go well, North Cross will get its final check. “Unless they find something, which I don’t expect, when they do the final inspection that doesn’t work or hasn’t been adequately cor-

rected,” Palmer said. One recent delay was delivery of a fabric cover. Once finished, Palmer said the district will receive it directly rather than get it from the boat builder. One possible issue with the manufacturer’s nameplate and phone number — possibly considered public advertising — welded onto the port and starboard sides was negated. Palmer said there were no federal regulations prohibiting the inclusion of the company’s phone number, though he noted that it was unusual. “Just because we have the phone number on it, doesn’t mean we’re advertising for them,” Palmer said.

PARKS Healthy youths get funding boost The Healthy Island Youth Initiative received a big boost from three donations totaling $5,600. Island Thrift gave the committee $5,000, Soroptimist International of Oak Harbor donated $300 and Walmart added $300. The Healthy Island Youth Initiative scholarship was developed to get children physically active for at least 60 minutes every day. The donations help children participate in activities like sports and clubs. Since 2011, 66 scholarships have been awarded, totaling $5,283 and ranging from $35 to $150. The South Whidbey Parks & Aquatics Foundation, a 501(c)3 organization, acts as the

fiscal agent for the initiative and its scholarships. Donations to the scholarship fund can be made payable to South Whidbey Parks & Aquatics Foundation and mailed to P.O. STATE Rep. Hayes’ bill passes House State Rep. Dave Hayes had a bill move through the Washington State House of Representatives that affects law enforcement throughout the state. Hayes, a Snohomish County Sheriff’s Office sergeant, sponsored the bill to change one word in state law about misdemeanor arrests, making it possible for officers to arrest a suspect without a warrant despite not being the witnessing officer. It was in response to a case where a Seattle officer in a multi-story building saw a misdemeanor drug deal occurring on the street. Another officer was called to make the arrest, but it was later thrown out of court because of the law’s wording that a suspect may be arrested without a warrant by “the” arresting officer, not “an” officer. The measure passed the House 93-4 and moves to the Senate for further consideration.

Caller checked on him; he was drunk and ran off.

SUNDAY, FEB. 9 1:22 a.m. — A caller driving on Highway 525 near Langley Road reported a male passenger was threatening to jump out of the vehicle, is obstinate and yelling. The male got out then got back in; male keeps getting out of the car while it’s moving. 2:07 a.m. — A dispatcher reported a call from a Sunlight Beach Road location, hearing “You’re not taking the motorcycle.” Male then advised his son is trying to leave and is intoxicated. Not physical yet but close. 7:41 a.m. — A caller on Woodard Avenue reported her car is stuck on the side of the road in the snow. She is in the middle of the road. 9:52 a.m. — A caller on Cultus Bay Road and Goldfinch Lane reported their car is in the ditch and partially blocking traffic. The caller said they slid on the ice. 10:25 a.m. — A caller on Bayview Road reported their vehicle blocking traffic. The driver said the car in front of him slowed down too much and he lost traction. 10:33 a.m. — A caller on Cedar Vista Drive reported a female in a vehicle broadside in the street, about 40 yards from Highway 525. The caller said she’s “refusing” to move the vehicle and started screaming at him, saying she’s waiting for someone to help. 11:50 a.m. — A caller on Mutiny Bay Road reported she went off the road, hit her head and isn’t sure if she is

injured or not. 2:54 p.m. — A caller on Highway 525 said a non-profit club employee posted camera footage of someone breaking into their location. Caller says he knows the subject.

A male told her he was from the University of Minnesota and was doing a survey on attitudes of pornography. Ignoring arrests flies in face of transparent judicial system in U.S. By KEVEN GRAVES

Two recent stories in Whidbey newspapers drew some particularly emotional reactions from some readers. The first was an article about the arrest of Coupeville Deputy Marshal Hodges Gowdey III. Gowdey, 44, was charged with unlawful imprisonment and witness tampering in connection with an incident that allegedly occurred in 2007. Gowdey was ordered held in lieu of $30,000 bail and put on administrative leave. The second story was about a police officer candidate and former firefighter Dylan G. Jefferies, who reportedly failed a lie detector test required for the position and allegedly admitted to having child pornography on his home computer. Friends and supporters of each man went on the attack, accusing Whidbey newspapers of convicting each man in the court of public opinion. Talk about shooting the messenger. Both articles were clear that the allegations against the suspects are just that — allegations, meaning they are yet to be proven in court. However, charges were filed against both men, and the cases for those charges were laid out in detail out by the investigating agencies. The fact that both men held positions of public trust — police officer and firefighter — means society and the courts hold them to a higher standard than the average citizen. In the articles, the newspaper offered absolutely no observations about either man’s innocence or guilt. Rather, they presented the information obtained from court documents — that’s the information investigating agencies rely on when taking cases before a judge. The appearance in court by Gowdey and Jefferies is the beginning of what may be a long and detailed legal process, one in which this country has placed great faith and trust. Nearly all Superior Court proceedings, particularly in criminal cases, are open to the public, and court documents are available for any citizen to review. The judicial system in the United States is open for a reason. Transparency ensures not only that everyone receives a fair trial, but also that justice is properly served. Will Gowdey and Jefferies receive a fair trial? I believe they will. Both men will have representation and have the legal right to trials by jury or judge, if the cases get to that stage. Suggesting that local newspapers should ignore the arrest of Gowdey and Jefferies is in contradiction with a judicial system that functions well because of its transparency. I believe the public deserves and wants to know what is happening in its courtrooms.

Support downtown sewer plan Editor, We’re all familiar with the saying, “Some Things Never Change” — but I’m writing to say that just maybe some things DO change. Last Thursday, I attended a meeting of the Freeland Water and Sewer District. On the agenda were complaints from commercial rate payers about high water bills, followed by a presentation on sewers by district consultants. I expected the rate issue to be tabled. Instead the commissioners admitted the formula was unfair and voted to cut the rates. Bravo. But the big surprise was their position on sewers. Those of you who follow this subject are familiar with the dismal history of Freeland sewers. But, if I was hearing right, the commissioners and their consultants might actually have it right. Instead of an oversized sewer plan that nobody wants, they’re looking at a plan that will serve just the downtown core and nothing more. Finally, a sensible plan that all of Freeland can get behind. And if we can help them turn good intentions into action, we could have an affordable, modern sewer system to hook up all of downtown in just a few years. I encourage all South Whidbey business owners and commercial property owners to get involved and support this timely issue, because a sewer for downtown Freeland could be the cornerstone of future development and economic prosperity for all of South Whidbey. My friend and I were remarking on how easy the horses were moving and how nice the trails were. Forty minutes into the ride, her horse stumbled and in a second she was face down on the trail, unconscious and bleeding. After a trip to Whidbey General Hospital and Harborview Medical Center in Seattle, she is now home and recovering. Thank you to all the first responders for what could have resulted in a worse fate for my dear friend. Freeland gains two supporters for sewer plan By JUSTIN BURNETT South Whidbey Record The Freeland Water and Sewer District’s latest plans for sewers in Freeland received a small but ringing endorsement last week. District commissioners held a public meeting Thursday evening to discuss details of the proposal, and although it was attended by just two commercial core property owners, the board closed the meeting with what appear to be two advocates of the project. “I’m ver y impressed,” said Richard Soto, owner of the Harbor Inn. “You’ve made a believer out of me ... I wish you guys were here 10 years ago.” Al Peyser, the other property owner in attendance, also spoke favorably of the proposal, though he maintained it must make sense financially for users. “I would love to have a sewer system, but it has to pay,” Peyser said. The construction of sewers in Freeland has been an ongoing discussion for years. Plans in 2012 came to a screeching halt, however, due to concerns that a nearly $40 million proposal was too far reaching. The district is reviving a version of the plan, which is significant-

Rather than encompassing the greater Freeland area, the commissioners are looking at sewers just in the commercial core — roughly between the post office and China City, and from the Freeland Library to Highway 525. The exact cost of the project remains unconfirmed, but district

officials have estimated the price tag at about $8 million. About $3 million is already in the bank and plans are in the works to secure additional state and federal funding. Thursday’s discussion was geared around a presentation by Gray & Osborne, Inc., the district’s hired consulting firm, about project engineering details, such as opera-

tional flow rates and the type of treatment plant used. Largely based on work done years earlier, the district is considering a membrane bio reactor or MBR plant to process effluent. It’s the same technology Oak Harbor plans to use for its new treatment facility, which may cost as much as $76 million. MBR systems are more expensive than traditional technologies, but are generally more effective and require less space for operation. But while the technology of a future system appears clear, the size of the plant the district needs has yet to be determined. “That’s the million dollar question,” Commissioner Eric Hansen said. “How big does this plant need to be?” The goal is to have a facility that can treat up to 75,000 gallons a day in 20 years, but the district may opt to purchase a smaller facility that’s expandable, which might reduce the initial cost and match early and lighter flow rates. According to Freeland Water and Sewer District Manager Andy Campbell, the plant’s size will be determined through a Gray & Osborne feasibility study, which is slated for completion this summer.

Three Falcon wrestlers make Mat Classic Friday Harbor sails

By BEN WATANABE South Whidbey Record Oh, what could have been for the South Whidbey wrestling team. Three Falcons qualified for the 1A state wrestling tournament, known as the Mat Classic, after finishing in the top four of their weights in 1A Region 1. And two more will go as alternates, though one was a single point away from a guaranteed spot. “Beck should have been third place in the region,” said Falcon head coach Jim Thompson of 182-pound senior Beck Davis. “It would have been amazing to have a guy in only his second year [of wrestling] make it.” After losing a close battle in the first round, a 2-0 drop to Forks senior Gavin Castenada, Davis worked his way through the consolation bracket. Looking at a third-place finish at best and an elimination at worst, he pinned his next opponent, Montesano sophomore Aavin Howell. Then came the decisive and controversial match against Blaine senior Tanner Anthony, the 15th-ranked 182pound wrestler in 1A, according to rankings by washingtonwrestlingreport.com. Tied 8-8 in the third period with seconds remaining, Davis was underneath Anthony. He stood up, but could not escape Anthony’s grasp. In Thompson’s opinion, it should have been a point for an escape, but the call never came from the referee, and the match went into an extra period. Anthony and Davis battled in the sudden-death, first-to-score wins round, but Anthony got a late takedown to advance to the third-place bout, knocking Davis to the alternate match. “It was a horrible feeling,” Davis said. “I’m kind of bummed, but I’m hoping to wrestle.” One of the surprises for South Whidbey was junior Pierce Jackson, who qualified in the 285. Jackson pinned his first opponent in a dominant performance, according to Thompson. “After the first heavyweight match, I looked at Paul [Newman, the assistant

Forks junior Miguel Morales made it a little difficult, however, as the second-ranked 1A heavyweight pinned Jackson, sending the Falcon to the consolation bracket. Facing elimination, Jackson pinned Mount Baker freshman Kole Hickey to advance to the third-place bout. He lost his next match but still finished in fourth place, a state-qualifying spot. If ever there was a guaranteed state tournament wrestler this season, it was Falcon senior Andy Madsen. Thompson, who jokingly said that he would have bet his house that Madsen would qualify, said the 145-pound senior rolled through his opposition, save for one close near fall that wasn’t called. Madsen pinned his first opponent, but missed out on a three-second call on a tilt that would have given Madsen two points for a near fall. “If there’s one weakness in Andy’s game, it’s that he’s not great on his feet,” Thompson said. Instead, Forks junior Javier Contreras moved on with a 4-2 victory to the championship match. Bumped to the elimination round, Madsen pinned Tenino junior Zeb Chamberlain to advance to the third-place match against his teammate, senior Kyrell Broyles. It was the second time in as many weeks the two squared off for third place. Last week in the District 1 tournament, Madsen defeated his teammate. Other teams with two of their own wrestlers facing each other opted to have one forfeit rather than risk

He pinned Forks sophomore Joel Mohn, lost 19-5 to Rochester junior Juan Jimenez, but recovered for the fifthplace finish against Nooksack Valley sophomore Jared Parson with an 11-2 win. “James being an alternate, that was a surprise,” Thompson said. “I knew he had it in him though.” For South Whidbey, sending five wrestlers to the state tournament was a long time coming. The last occasion Thompson remembered taking five wrestlers to Tacoma was 2008. “I’m happier than hell,” he said.

can go and what they can do. Should city leaders opt for a three-officer staff, the guild would seek compensation for on-call time, cutting the potential cost savings. “The Police Guild has never asked for its officers to be compensated for their on-call time,” Marks wrote in the study’s conclusion. “However, if the city decides to stay with three officers, the guild has stated they intend to demand compensation for on-call time.” Langley figured to save about $70,000 on salary and benefits by eliminating a fourth officer. In the city’s 2014 budget, however, a fourth officer was penciled into the General Fund, though a new police chief would be hired first if city law enforcement ranks revert to a four-man department. In 2012, $51,089.63 was spent on overtime and reserve officer pay, a sharp jump from 2011 when the city employed 3.5 officers and paid $21,590.63 in overtime and reserve officer pay. The last full year Langley had three officers and a chief, 2010, the city paid a five-year low of $10,806.37 for overtime and reserve wages. The immeasurable toll on the officers is fatigue, Marks said. Currently, Langley police are on a vacation freeze, and several have worked their full 40-hour shifts plus several hours of unpaid, on-call time. Marks said it got to the point where he and his officers wear their uniforms while on-call and even while sleeping. Keeping three officers would be a continuation of wearing out the city’s law enforcement.

“It looks like a lot of on-call time, officers working when they’re sick,” Marks said. “It’s hard to take vacation.” According to the study, Langley police responded to 1,252 calls in 2012. Many were non-violent, from giving legal advice and opening a car with the keys locked inside to jump starting dead batteries, welfare checks and commercial alarms. One of the duties performed by Langley touted in the study is the department’s ability to do checks on temporarily vacated properties and vacation homes, as well as responding to animal and noise complaints. A piece of good news was tucked away in the city’s call response log: only one death investigation occurred in 2012, a historically low number for the city. Typically, according to the report, at least one death investigation is performed each month. Of the more common crimes, such as theft, domestic violence, and car prowling, numbers were also low. A total of 95 domestic disputes — 62 physical, 33 verbal — were responded to by Langley officers; 25 aggravated assaults, 15 thefts, two shoplifting reports, and four car prowling incidents, which the study called “another historically low number. We’ve worked diligently to force known car prowlers out of the city.” A hiring process will commence for a new police chief to potentially replace Marks, who was appointed acting chief in September after former chief Randy Heston retired. It would likely take a month and will begin once the council confirms the mayor’s recommendation.

“contiguous” stipulation, opening up this tax classification to farms that have multiple parcels that total 20 acres or more but aren’t necessarily touching each other. While the bill’s sponsor, Rep. Kristine Lytton, D-Anacortes, said her goal is simply the preservation of farmland, some tax assessors worry that the bill may result in an unfair tax shift. Island County Assessor Mary Engle said that parcels under 20 acres would be able to partner with larger farms, allowing them to be taxed under the lower rate. This could cost a shift of taxes onto other farmers, Engle said, but she wasn’t clear about how that might play out for Island County. Island County contains roughly 10 farms over 20 acres, Engle said, with the rest of the farms existing as smallscale operations on smaller parcels. Engle said that the law change, as

proposed, contains no requirement of proof that the larger farm is actually doing the farming on the smaller parcel. For that reason, farms smaller than 20 acres could slip through under the lower tax rate. For example, on a Coupeville farm less than 20 acres that is assessed at $800,000, its current tax bill of $8,000 would drop to $2,000 if the small farm was able partner with a larger farm. “How do you audit that if you don’t have to prove anything?” Engle said. “You could start seeing a tax shift if people figure out [how] to work the system.” Statewide, the average farm size has decreased by about 12.5 percent from 2003 to 2012, but the number of farms increased by about 7 percent during the same time period, according to a report from the United States Department of Agriculture. It’s hard to know how much of a tax shift could result from allowing more parcels to qualify for the lower tax rate, as there’s no estimate of exactly

how much land could be eligible, says Yakima County Assessor Dave Cook. Each county in the state collects a specific amount of property-tax revenue, with the total amount spread across all taxable properties. When some properties are assessed at a lower rate, the other properties in the taxing district must make up the difference. Depending on how much property is eligible to be assessed at the lower agricultural rate, the increase in property taxes paid by others in the district could be significant. Cook says the legislation could result in a $70 million loss of assessed property value in Yakima County because more farmland would be assessed at its current use rather than market value. Property owners with a decrease in assessed property value will likely pay less in taxes, a difference that would have to be made up by other taxpayers in the county. “The tax-shift implications are significant when you go on a statewide basis,” Cook said.
