coffee stand, a car wash and a gas station are being shut down to make way for a five-story apartment complex along Central Way in downtown Kirkland. The two small businesses - Coffee Crossing and White Swan car wash - have been with the Kirkland community for more than 20 years but the combined 20 or so employees will soon be displaced. White Swan car wash and Chevron are expected to close “for good” Saturday,

Aug. 31 with Coffee Crossing’s last day on Sept. 3. “It has been our privilege and great joy to be a part of a great city,” said White Swan general manager Dave Ridley about the 40-yearold car wash. “Other than the ownership changes, the business is considerably less than it used to be. When it opened, there was no other gas stations or car washes. Now there’s competition up the street.” White Swan has won an award from the Legends Car Club in 2000 and 2007. A Seattle man was recently charged with two counts of possession of stolen mail after he allegedly took mail from six Kirkland residents among 40 others in the Puget Sound area. Hossein Shaghaghi, 26, was supposed to be arraigned Aug. 22 but did not appear. He now has a $5,000 bench warrant out for his arrest. On Dec. 13, 2012, a Kenmore deputy saw Shaghaghi, who was driving a silver Mitsubishi Gallant, reach into a mailbox with gloved hands on 78th Avenue Northeast, just at the boundary of Kenmore

and Kirkland. The deputy ran Shaghaghi’s license plate and discovered the vehicle was registered out of Seattle, which caused the deputy to believe he may be stealing the mail. The deputy saw Shaghaghi pull into a driveway, but because the deputy often patrols the area at least twice a day, he did not recognize Shaghaghi’s car belonging to that home. The deputy approached Shaghaghi, who informed the officer he had been at a friend’s house down the street and was placing blue flyers from his church in the mailboxes in the area. “While talking to Hos-

sein, [the deputy] noticed a large military style duffle bag on the front passenger side floor board that appeared to be three quarters full,” probably cause documents state. “… On the front passenger seat [the deputy] saw the glove he had removed and what [he] recognized through training and experience as a black plastic homemade smoking pipe often used to smoke prescription pills off the surface of tin foil.” The deputy said he did not see any blue flyers but the car was filled with assorted boxes, bags, tools and food in the backseat. And the car wash was on the Kirkland Reporter readers’ Best of Kirkland list for 2012. “I hate to see the car wash go, that was my life but it just got to be with gas prices,” said former White Swan car wash owner Steve Rall. “It was hard to convince somebody to fill their Volkswagan up with $50 to $60 and then an extra $10 extra for a car wash. The whole car wash industry has slowed down.” While business may not be as booming as it used to be for White Swan, Coffee Crossing owner Brandee Krumbah said her business still has hundreds of dedicated and loyal customers. She fears many will not know about the change or where to find her - if she can find a new location. “I’m working with the [Greater Kirkland] Chamber of Commerce right now to help me relocate somewhere,” said Krumbah, who’s worked at Coffee Crossing for 15 years and owned it for 10. “I mean, we’re doing our best because Kirkland’s hard. We got grandfathered in here more than 20 years ago.” Krumbah said commercial zoning is hard to find for Coffee Crossing, which is a drive-thru, walk-up coffee stand and has three to seven employees. “I’ve had my good and bad days since this has all been told to me,” said Krumbah. “And this morning I was just bawling and crying as I was making coffee because I’m starting to get the word more out there because a lot of people just don’t know it’s happening so quickly.”

She said her customers have pulled together for her since the closure was announced. One customer offered to help crane the coffee stand out, another offered his flatbed truck and another offered a place for her to store the wood-frame coffee stand until she can find a new place. “We’re gonna move this little guy. There’s just too many memories, you know?” she said. Krumbah said with each of the four owners in seven years, there’s always been some type of closure threat. “I have hundreds of regulars and nobody wants the building to go on,” she said. “They’re sick of construction, they’re sick of how our own little town is not our little town anymore. We don’t want to be Bellevue, we’re Kirkland. We’re different.” The business closures come at a time when many Kirkland residents feel dissatisfied with big development projects in downtown Kirkland such as the Potala Village apartment complex and the Lake Street Place project. Kirkland Associate Planner Tony Leavitt said Tony Fan with the architecture firm Studio Meng Strazzara applied for a Design Review Board approval earlier this year on behalf of developer Continental Properties LLC, which is based out of Bellevue. The Design Review Board approved the five-story mixed-use project on June 3 that is expected to have 7,500 square feet of ground floor retail restaurant space and four stories of 73 apartment units on top.

An underground parking garage with about 145 parking stalls is also planned. The project is designed to fit on the 0.63 acre property at 324 Central Way. Claudio Guincher with Continental Properties LLC said he hopes to secure building permits by the end of this year or early 2014 so they can break ground within the first quarter of 2014. If all goes according to plan, the building, which will include a “nice lobby” and a small gym, will be complete by the summer of 2015. “Kirkland’s fantastic,” Guincher said, adding Continental Properties built the current Kirkland Center Condominiums. “We have quite a bit of history in downtown Kirkland. We think it’s a great place to live, my wife and I have spent a lot of time in the summer in Kirkland and it’s a great place to be.” Meanwhile, Ridley, Krumbah and the other two dozen employees will look for work elsewhere. “It’s hard financially, I have a little girl to take care of and I help my mom financially and stuff, but that isn’t even the biggest thing,” Krumbah said on the verge of tears. “It just hurts my heart knowing that I’m not going to see [my regulars] every day anymore unless we can find somewhere to be.” To connect with Brandee Krumbah of Coffee Crossing, visit The Coffee Crossing Co. on Facebook or at her coffee stand at 324 Central Way in Kirkland. known as Armand by family members, passed away on Aug. 11 at the Evergreen Hospice Center from complications of a longtime battle with spinal stenosis. He was 91 years old. Now, the Martineau family hopes to work with the city to name a Cross Kirkland Corridor railroad bridge after him, as he persuaded the Burlington Northern Santa Fe railroad company to rebuild it for safety reasons many years ago. The Seattle native was born March 28, 1922 at Providence Hospital. Upon graduating from Seattle Prep in 1940, Martineau finished the Civilian Pilot Training program in Seattle, went to Seattle and Gonzaga universities and then joined the U.S. Army Air Corps in 1942. “Upon joining the USAAC, the Army decided that Joe’s name was way too long and would not fit on their forms,” said Jim Martineau in a biography about his father. His birth name was Joseph Armand Amedee Letourneau Martineau. Upon joining the Army, Joe Martineau and his “bomber” crew were bombarded during an early mission in World War II, the time in which he lost his eye. “It puts everything in perspective,” said Terry Ellis, former Kirkland city manager who worked with Martineau from 1985-1987. “He was quite a guy.” Joe Martineau returned home and married Annabelle Loranger on Feb. 16, 1946 at St. Edwards Catholic Church in Seattle. The two went on to build their first homes and have six children. Joe Martineau worked with the Veterans of Foreign Wars, the Nisei Veterans, a property management firm, King County, the city of Seattle and the Seattle Master Builders Association, to which he lobbied for the construction industry to state and U.S. legislators. But in 1961, he and his family built a new home in Houghton and he became involved in politics “almost immediately” and joined

the Houghton Community Council. “It was extremely helpful having Joe Martineau representing the Houghton side, he was key to having the consolidation go smoothly,” said former Kirkland Mayor Bill Woods. “Joe was very active early on, he was a great addition to our community.” Woods said there was a lot of animosity from Houghton residents during the consolidation but Martineau was an advocate “because he realized Houghton was bankrupt.” Former Mayor and Councilman Bob Neir, who knew Joe Martineau for around 50 years, outlines in his book “A City Comes of Age” a story about the “Joe Martineau Bridge” on Northeast 68th Street, which is adjacent to Lakeview Elementary school. “Joe badgered the Burlington Northern [Santa Fe railroad company] until they came through,” Neir said. “The street was deepened; a new bridge was built.” Yvonne Martineau said the bridge overpass was a good example of her father’s civic service. Mayor Joan McBride said while there is no official process of how bridges are named, she said there will be a discussion and some research about the possibility of naming the bridge after Joe Martineau. “He is a bonafide hero of our city with 27 years of commitment and work for the city,” said McBride, who knew him during his early years on the Kirkland City Council. “He is someone who made our city a beautiful and great place to be today.” McBride recalls how passionate he was about sewer infrastructure and other city issues that many take for granted. “Joe was a friend of infrastructure,” said Ellis. “He had a steady hand on that, probably from the work he did for the building industry. Joe Martineau is survived by his children Suzanne Banchero and husband Lew; Jim Martineau and wife Kathy; Tom Martineau and wife Turie; Annette Tomkins and husband John Robert; Yvonne Martineau and husband Eric Herrmann; and Therese Quig and husband Steve.

The battle for public records

T

hose looking for a more transparent government are increasingly relying on public records to make it happen.They hope the more documents they obtain the clearer their view of what’s really going on behind closed doors in school districts, city halls and county buildings. But there are those throughout the public sector convinced some of these Washingtonians are abusing the Public Records Act. An alliance of government forces — whose members often are the targets of the records — tried unsuccessfully earlier this year to rewrite the act to make it easier to repel requesters whose motives they question. With the help of Republican and Democratic lawmakers, they pushed a bill to make it easier for public agencies to block requests and to limit the time spent compiling records. Though the bill died in the legislative process, the matter reappeared in the state budget in the form of a provision to spend $25,000 contemplating ways to help governments deal with records requests they consider harassing. Lawmakers tapped the Ruckelshaus Center, a joint venture of the University of Washington and Washington State University, to facilitate a conversation between those in the alliance and those who viewed the failed bill as an unprecedented attack on citizens’ right to petition their government. By Dec. 15, the center is supposed to put forth recommendations. Michael Kern, the center director, said this week the time frame is too tight to pull the parties together for fruitful face-to-face sessions. The game plan is to speak with 20 to 30 people who’ve been visible and vocal in the legislative conflict then prepare an assessment of the situation based on what center staff hears in the interviews. “We’ll report what the diverse interests say,” he said. “It will not include our opinions because we don’t have opinions. That’s not quite what Democratic Rep. Dean Takko of Longview envisioned when he helped persuade leaders of his party to put the proviso in the budget. Takko, who sponsored the failed bill, hoped the skilled forces at the center could blaze a trail lawmakers could not. “Myself and quite a number of other people think there’s something we need to address,” said Takko,. Now, we’ll take whatever they provide this winter as a possible starting point for legislation in 2014. “In all honesty, we probably will not be a whole lot further than when the session ended,” he said. “It’s a big enough issue that we have to take some baby steps forward.” Another person interested in talking with Kern’s team is Jason Mercier, an analyst with the Washington Policy Center and member of the Washington Coalition for Open Government. The coalition strongly opposed Takko’s bill. He sees no reason to change the Public Records

Act. The problem isn’t the law, he said, but officials understanding of it. Many do not realize what tools are already available to them when someone submits one of those so-called burdensome requests. He suggested lawmakers asked the wrong question with the budget proviso. Leaders in local governments say hefty requests can chew up staff time and taxpayer dollars, but there’s no data on how much time and money is wasted to back up their claims, he said. Getting the answer would really inform the discussion, he said. Sounds like something a public records request, or two, could clear up.

In-your-face campaign to steamroll and deceive Kirkland residents The following letter was also sent to Kirkland City Council members. Minions of Lobsang and Tamara Agassi Dargey recently descended on Lake Washington Boulevard to hang huge banners on a newly-erected fence on property the couple leased from Luella O’Connor proclaiming “Mixed-use Project Coming Soon.” When asked about the banners, Dargey’s banner-hangers responded that Potala was going to be built and the city supported it. Is this true? If not, what are you going to do about it? This hideous project is still going through a court and a hearing process. It is not even close to being a done deal. The Dargeys do not have a building permit; and according to Washington state law, they are not vested in this project – whether they call it Potala Village, Kirkland Aqua, or Lob and Tami’s Rabbit Warren on the Shore. What’s going on here is an in-your-face offensive (in more ways than one) campaign to intimidate, steamroll and deceive the people of Kirkland - and to hold the city of Kirkland complicit in their deed. Is the city complicit in this PR offensive? Did anyone on the council, in the City Manager’s office, attorney’s office, the Planning Department know Dargey was going to

hang these banners? Was explicit or implicit approval communicated to anyone on the Dargey team? That is what these banners imply. If the city had absolutely no part in this, do you not feel it your obligation to tell that to your constituents and take action to tell the Dargeys to back off and remove the banners, which make a false claim not only for the Dargeys but also for the city of Kirkland, and a mockery of our legislative, legal and hearing processes? I do. One can hang up a sign saying they just had a cheese danish with Jesus if they want, but is the city going to allow these signs to remain hanging on Lake Washington Boulevard, announcing the coming of the Dargeys’ 100-143 unit apartment/ commercial complex, made possible by the city of Kirkland? What is the city’s response? Editor’s note: The letter writer later said the city told residents they were not aware of the banners and they have since been removed.

Public says ‘no’ to traffic from Path America’s Potala Village, Kirkland Aqua A new traffic concurrency test notice on Aug. 23 indicates that Path America’s project (sometimes called Potala Village, sometimes called Kirkland Aqua) has “passed” the traffic concur-

rency test. This is subject to appeal, which is handled a bit like a court proceeding in front of a Hearing Examiner. There is a window of seven to 14 calendar days after a notice of concurrency is issued for appealing the decision. Public notice of the concurrency test is required. Once again, the city of Kirkland has failed to provide public notice. The results of the concurrency test were known on Aug. 23. Citizens inquired mid-day about how the city would notify the community. Was it posted on the property - no. Was it put into the Seattle Times (official location for posting Kirkland notices) - no. Was it mailed to surrounding neighbors - no. Was a notice pushed out in an email to all those who the city has promised full and timely updates through the Listserv - no. When residents asked city officials on Aug. 23 whether this would be the seven or the 14-day appeal window, they were told they would hear on Aug. 26. At this point, the ability to appeal will have been shortened nearly in half, and actually more if one needs to mail the appeal or check to the city offices. The city has stolen the residents’ ability to appeal (if seven days). And what does a resident need to do in the 24-48 hours that would remain of the appeal window?

nervous, could not keep his hands out of his pockets and told the officer he was planning on parking at the residence until a friend called. The suspect denied having identification on him but told the deputy a different name, later discovered to be his brother’s name. After he gave consent to a pat down, the officer discovered two debit cards and three electronic access devices. The deputy arrested Shaghaghi until he could verify the cards weren’t stolen and the suspect continued to act suspiciously. A second officer joined the two and looked in the mailboxes where Shaghaghi said he was placing blue flyers but found none. After running Shaghaghi’s correct name, the deputy discovered he had a pending third-degree theft warrant, but the suspect still denied he was Hossein Shaghaghi. But after calling the suspect’s phone, whose name was listed as Hosein Shaghaghi, the deputy noticed a few pieces of mail sticking out from under the driver’s floor mat. The suspect informed police his wallet was in the glove box and gave them permission to retrieve it. However, when doing so, an officer saw a large white plastic postal bag with a Kirkland zip code in the back seat. “The bag was a post office waterproof type bag that had already been delivered,” court documents state. The wallet had an ID that did not look like the suspect, and he was advised of his Miranda rights. Officers later confirmed the suspect’s real identity after looking at his most recent booking photo. Shaghaghi’s car was impounded for a search warrant soon after. After the search warrant was approved the next day, the deputy found a green duffle bag full of stolen mail, a postal bag that contained a package for a Kirkland resident and a receipt for a holiday doormat that was ordered by another Kirkland resident. The suspect’s wallet contained five credit/debit cards with other people’s names. The search also turned up drug paraphernalia. Police eventually found mail belonging to 40 individual victims, 29 of whom stated they did not know the suspect. The others could not be contacted.

Kirkland Reporter website gets fresh update The website for the Kirkland Reporter got a fresh look this week that will help readers get faster access to local news — and more of it. The new crisp-and-clean design makes space for more stories and photographs on the newspaper’s home page, and also offers easier access to readers on-the-go. The home page is topped by a new navigation bar that boasts a quick-glance box for current weather conditions. Also at the top: icons for mobile applications and social media, so readers can quickly share stories and news with others. on weekends only from Sept. 7 through Oct. 27 in the neighborhoods of North Rose Hill, Central Houghton, Everest and Finn Hill. “Pet licensing is the law,” said Kirkland Police Chief Eric Olsen. “Kirkland Municipal Code adopts by reference King County Code 11.04.030, requiring that all cats and dogs, eight weeks and older be licensed, whether they are indoor or outdoor pets.” The Kirkland Police Department administers the contract the city has with the county for licensing, sheltering and control services. The three-year contract expires Dec. 31, 2015. King County pet license canvassers are easily recognized by county name badges, logo shirts, business cards and pet licensing documents. They are trained and follow strict guidelines regarding professional conduct. For example, canvassers do not peer in windows or over fences looking for pets. They do not engage in lengthy conversation with anyone answering the door who appears to be under 18 years of age. They do not ask to enter inside homes and will generally avoid houses that are clearly posted as “No Trespassing” or “No Soliciting.” King County has implemented a residential pet license canvassing program throughout the County for the past 20 years. The last time any pet license canvassing was conducted in the City of Kirkland was in 2009. A first-time grant to Juanita Elementary School’s Summer PERK program kept students reading this summer by opening the school library on Wednesday evenings for reading practice with tutors and checking out books. Parents attended along with their children, making it a fun community gathering. Last summer, PERK students read more than 1,000 books. Thoreau Elementary will use grant funds to purchase five Orff xylophones, which will support new district music curriculum.

All Thoreau students will use the instruments to learn the language of music while developing coordination, dexterity and concentration. Reaching for Success grants can be used for either a classroom or an entire school, and school principals, teachers or parent volunteers are encouraged to apply. Lake Washington Schools Foundation thanks the teachers and staff who submitted 2013-2014 grant applications for their dedication to student learning, and the donors who helped fund these opportunities. Lake Washington School District students scored above state averages on state standardized tests, performing particularly well in mathematics. Math scores improved in five grades and the two high school endof-course exams and fell in parallel with state scores in grade six. “Our staff and students have worked hard in mathematics to improve scores,” said Traci Pierce, superintendent. “In most grades, we are seeing a clear upward trend over the last five years.” District math scores improved in all three elementary grades tested. Third grade math showed the most improvement, rising from 81.6 to 83.4 percent at standard. State scores remained about the same in that grade. Fourth grade gained over 1 percent, and the increase from 80.2 to 81.5 percent represented the third straight year of increases. State scores rose

even more, from 59.3 percent to 62.5 percent. District fifth grade scores improved slightly, rising from 81.5 percent to 81.9 percent, while state scores fell 1.2 percent to 62.6. At middle school, sixth grade math scores fell at both the state and district levels. District scores fell 2 percent from 81.7 to 79.7 percent, erasing most of last year’s gains but remaining well above the scores from 2009 to 2011. State scores fell about the same amount, by 2.1 percent. District seventh grade scores followed last year’s 6.6 percent increase with another increase of 3.6 percent, rising from 80.7 percent to 84.3 percent. That’s more than 10 percent higher than the 2009 score of 73.5 percent. State scores for seventh grade rose from 59.2 percent to 63.7 percent. Eighth grade math scores increased from 73.1 percent at standard to 74.9 percent. State eighth grade math scores, on the other hand, fell from 55.4 percent to 53.2 percent. On the end-of-course exams in math, 88.7 percent of district students were at standard on the math year one exam compared to 80.7 percent at the state level. For year two, 95 percent

of district students were at standard compared to 89.4 percent statewide. Science scores in fifth grade in Lake Washington rose from 87 percent to 87.9 percent, building on last year’s 6.5 percent gain. State scores rose 0.2 percent in fifth grade science, from 66.3 percent to 66.5 percent. Eighth grade scores slipped statewide and in Lake Washington. District scores fell from 84.9 percent to 82.9 percent while state scores fell from 66.4 percent to 64.9 percent. On the new end-ofcourse biology exam, 92.5 percent of Lake Washington students were at standard, compared to 81.7 percent at the state level. “Science continues to be a strength in Lake Washington, although we will review our eighth grade scores,” said Pierce. District reading scores tended to rise at the elementary level. Elementary grades three through five all rose in reading, with increases of 2.8 percent, 1.5 percent and 2.5 percent of students meeting the standard respectively in grades three, four and five. State scores also rose in all elementary grades.
